Presentation - Recognition for Heroic Actions in an Emergency by Fire Chief Stephen Cousins.

**Background:** Recognition of 7-year-old Deltona resident Aria for her courage, quick thinking, and decisive actions during an emergency involving her 2-year-old brother, Elijah. Aria's alertness and immediate response helped her family initiate lifesaving measures, contributing to Elijah's full recovery. The City will recognize Aria for her heroism and acknowledge the Deltona Fire Department personnel involved in the emergency response.

Request for approval of a reduction in fine request by the respondent.

**Background:** On August 26, 2026, Property owner Brandyn Schwalm of Home Solution Investment LLC, appeared before the Special Magistrate to request a recommendation to reduce the fines. Mr. VanLaningham's recommendation, the aggregate accrued fine of $17,250.00 should be reduced to a single amount of $6,000.00. That amount includes the case enforcement costs substantiated by the City; those costs should not be added to the $6,000.00. City reported cost is $3,550.50. This property is not homesteaded.

Request for approval of Resolution No. 2026-85, Award Whitehouse Contracting, LLC the contract for concrete sidewalk enhancements at Harris M. Saxon Community Center.

**Background:** The funds required for this project are available in the Park Capital Improvements Fund as approved by the City Commission. The item before you is for concrete sidewalk enhancements at Harris M. Saxon Community Center. The scope of work will provide ADA compliant sidewalk connectivity to the newly constructed amenities as part of the ongoing Capital improvement project for Harris M. Saxon Park. Whitehouse Contracting, LLC. is the City's awarded vendor for the ITB# PW 2022-01: as needed new sidewalk installation and repairs.

Request for approval of Resolution No. 2026-89, Project / Capital Carryforward Budget Amendment for Fiscal Year 2025-2026.

**Background:** This is the year end Project / Capital Carryforward budget amendment for Fiscal Year 2025-2026. The Commission approved the annual budget for FY 2025-2026 on September 22, 2025. This amendment is necessary to account for operations, capital improvement projects and capital outlay budgets that must be moved into FY 2026-2027.

Public Hearing - Ordinance No. 19-2026 Temporary Moratorium for Data Centers at First Reading.

**Background:** The City Commission finds that the Florida Legislature's recent enactment of Florida Statute §163.326 warrants a comprehensive evaluation of data centers and whether amendments to the City's Comprehensive Plan, Land Development Code, or other regulations are appropriate to address the unique impacts associated with such facilities. Although a moratorium is not necessary to prohibit a use that is already unauthorized under the City's existing Land Development Code, it is prudent and in the public interest to formally maintain the City's existing regulatory status quo for a limited period while the City evaluates whether additional or specific regulations addressing data centers are appropriate.

Request for approval of Resolution No. 2026-87, Adopting the Final Millage for Fiscal Year 2026 - 2027.

**Background:** Per Florida Statute Section 200.065, the City Commission shall adopt a final millage rate prior to the adoption of a final budget and shall otherwise comply with the controlling provisions of the law. The Volusia County Property Appraiser has certified the gross taxable value of property for operating purposes within the City as $5,920,885,741 and certified a rolled-back rate of 6.4948 per $1,000 of taxable value for the City of Deltona. The City Commission deems it necessary to levy and does hereby levy a Final tax of $6.4948 mills upon all real and personal property within the City for operational purposes. The operating levy of 6.4948 mills per $1,000 represents a 0.00% increase from the rolled-back rate of 6.4948 mills per $1,000 of taxable value. The final operating millage for Fiscal Year 2025-2026 would provide a final budget of $36,532,220 at 95% in ad valorem proceeds.

Request for approval of Resolution No. 2026-88, Adopting the Final Budget for FY 2026-2027.

**Background:** This is a request for the City Commission to approve the final budget for Fiscal Year 2026-2027. The Southwest Deltona CRA budget was approved on July 20, 2026, and submitted to the City of Deltona for inclusion in the City's budget. The City Commission of the City of Deltona has complied with all requirements and procedures of Florida law in processing this resolution. The City Commission pursuant to the Charter of the City of Deltona and Chapter 166, Florida Statutes, does hereby adopt the final General Fund, Special Revenue Funds, Debt Service, Capital Improvements Funds (CIP), Enterprise Funds and other Internal Service Funds, in the amount of $177,524,364 and is attached to the Resolution as Exhibit "A". Florida Statutes, including Section 200.065, provide that
