Everyone is welcome to please join me in a moment of silence. All right. Our next item on the agenda is our agenda approval. We have an agenda before us.

Now is the time we set aside for public comment. This is an opportunity for anyone in the audience to address the board on any topic of their choosing that pertains to the town. We do ask that you when you're called upon approach the podium speaking through the microphone. Identify yourself by name and address. There will be no debates. Please keep your comments to three minutes if you're speaking as an individual or five minutes if you are speaking on behalf of a group. Hello. Hey, I'm Katie Morgan. I live in Collington. Um, please ma'am. I'm sorry.
Your address? 101 Maddox Crossing. You're welcome. Um, so I came out tonight just because I had I guess a question um and a comment, two things. I was out. I'm a big proponent of the disc golf course. I think we all know that here. I was out playing disc golf the other day and um I felt Terry, you know, he was really a big supporter of the disc golf course and it just made me start thinking about everything and I was like, you know, I called Bob Sanders today and he's the um Nag's head commissioner and also one of the heads of the disc golf club which is highly successful, hugely popular. People come here to play disc golf. Anyways, the point of the story is that I was playing. I called him. I said, "Hey, wasn't there weren't there all kinds of um markings out on this course because I thought that it was going to be considered that y'all were going to build a pavilion and and a parking lot and some things like that." And I just I guess my question was if anything like that was happening. Um, and also I remember Bob had mentioned that there was going to be a committee possibly um, formed with the local disc golf club just to kind of make sure that everybody, you know, thought everything was going well. And I he had said that nobody had reached out to him about that. So I didn't know if maybe if that committee was still happening. And then my comment was, wouldn't it be, this is just something I thought out there. Wouldn't it be amazing and awesome if we did name like the big pavilion after Terry or and honor it because I know that was a huge thing. I talked to him a lot on the phone about it. Um I don't know just a thought and like I said just questions because I remember seeing um I can't think of the markings out there on the course a while ago. So yeah, that was all. Thank you.

I saw another hand pop up. Hello, my name is Kathleen Wnooki, 313 Cameron Street. Um, good evening. I'm here today on behalf of the League of Women Voters, wanting to um, present you guys with the 2026 Citizens Guide. This is a guide that's filled with all kinds of information, state, federal, um, local government information, election information, all kinds of of things that people like. Um, this is our 37th year presenting them and we're in the midst right now of distributing and I I get a little waverly when I speak in public so excuse me. We're right now distributing 6,400 um throughout Dair County from Duck to Hatteris Village um to mainland Rono Island um and you can find them in libraries at the towns at at businesses all throughout. wanted to come out here to present these to you all and also thank the town for their gracious gracious contribution. We have sponsors on the back that have helped make this happen. That's financially as well as town employees have answered questions to make sure that this is the most accurate information possible. So, the the League of Women Voters, just so you guys know, is a nonpartisan political organization that encourages informed and educated active participation in um government and we influence public policy through education and advocacy and this is part of our process. All right. Uh seeing nobody else, we'll close public comment. Uh response to public comment. Um Katie, I'm so happy to hear that you enjoyed disc golf. I think it I think our board wholeheartedly agrees with you that it is a wonderful resource that we certainly prioritize. Um improvements to the disc golf course has been a priority of ours for a long time. We're still looking for ways to incorporate those in future planning and future in capital investments. Um you know that that hasn't changed. I don't have a can I give you exact timeline where we're going to break ground and do things not today. But uh that is definitely something that's been on important to us and hasn't changed for quite a long time. Uh to my knowledge at this time there is no committee in discussion for improvements. uh talking about the Terry's legacy and committee work. the the Westside group invested lots of time and I think we have some Westside Group members maybe here um really looking into that and and prioritizing you know pedestrian uses and and really maximizing that space as a while and in regards to you know potentially naming a future improvement after Terry's memory I think that is definitely something that's on our list is definitely top of mind for us we're just going kind of when that opportunity arises, take advantage of it. But yes, Terry hasn't gone far from our hearts and minds and won't and that won't happen. Um, Kathleen, I love those books. It's a they're a wonderful resource to share and have around Dair County. and they uh you know I'm glad that we the league keeps this I mean 37 years is
I didn't know it's that long that's rather impressive to have uh this resource out there for folks to have so thank you and thank the lead for all their all their good work any other response to I would just say that uh definitely agree something in this town will be named after Terry Gray uh I'm sure most everybody agrees with that in this room. So, we'll do something for for him for sure. And that's that might be that might be as good as any. But yeah, thank you.
Hey, mayor. Um, and I'll also address the uh the stakes you're talking about. We recently had the property surveyed. Kind of step one getting the ball rolling and what we're doing at Bum Track. Uh, we had the property surveyed. The last survey that was done was 2008. So, there's disc off there. There's a lot more going on there. Um, edge of waters changed, wetlands have changed. So we got the property uh new boundary survey and we also got a new wetland delineation which was just approved by the core of engineers. Um that's good for five years. So now we can kind of start the concept planning planning stages. Um really what do we want to see there? So mapping the holes of disc golf and what's actually there and being used was important to really see what other kind of space we have and how other things may work. So, um, we'll be looking for services for some concept design and stuff that we'll bring back to the board and then that'll be opened up, you know, in a public setting. So, that's kind of where we where we are and where we're going.

New business, item number one, proposed amendment to chapter 93. Uh nuances ordinance 93.01 certain conditions declared nuisances nuances uh clarity clarify business code compliance cameras.
Yes, thank you. Tonight you do have a a proposed amendment to 9301J and this is really more housekeeping. This was identified by staff that the current regulations do not address the appropriate nuisances that are associated with building code compliance issues. Uh the proposed amendment clarifies that all construction that poses a risk to public safety are considered a nuisance. And this is the following language as you can see on the screen. Uh building code compliance. This will include any any structure or construction including addition, alteration, repair, and or remodel that are not compliant with the North Carolina building code effective on the date of their construction or have not been permitted in coordinates with North Carolina building code presenting a risk to public health or safety. Staff recommends the board of commissioners approve the amendment as presented. And I'm happy to answer any questions on particulars if you have any.
Looks sorry. Go ahead. We're just kind of clearing up the language like the dur language of this, but in practice it's not going to change. It it's not going to change a lot. It's going to it's going to help us out. For example, um if parking lot light poles fall down, there's exposed wiring, right? That's a public health and safety nuisance. Our ordinance right now really only is catered to decks, stairs, handrails. There's a lot there's a lot of other things out there that that if if we're really trying to get these things accomplished, it'll be a tool that will be helpful.
Um we, you know, we can cite people for violations of the electrical code and things of that nature. But when we're talking nuisances, this is something, you know, that it's got to really fall in that box of, you know, presenting a risk to public health or safety. But it's a it's really a housekeeping amendment to address some of these before. Yeah. Yeah. Got it. Thank you. Parking lot light poles are a good example. Yeah. The those metal metal entities exposed to the elements tend to deteriorate faster here than other places. And it's not always in and it's not always um exterior. You know, if somebody
uh you know, guts an entire house and does a lot of electrical work and we're made aware of it. Um that's that's scary for the people in in the home and also the neighbors. So, uh, you know, this this just helps protect protect our town. So, all right. Well, um, welcome a motion for any further discussion if we have it. Now we'll move on to new business item number two, appointments and nominations. Item A, possible appointment to fill vacancy on the board of commissioners. Um, Mr. Odell, I'll turn proceedings over to you. Mayor and commissioners, good evening.
At your January 12th, 2026 meeting, the board unanimous unanimously approved the timeline and process by which to build the vacancy created by the death of sitting commissioner Terry Grace, Senior on November 27th, 2025. As part of the process, interested residents had to submit an application by February the 2nd, 2026. And then my office then transmitted those applications to you for review in which you as individuals could then meet with the applicants that were qualified, which all that we forwarded um over to you to be considered this evening. As part of this evening's process, you will the board staff recommended and the board will be conducting a nomination and ballot process which has been utilized by the board which has been adopted and utilized by the board for the last two or three vacancies that were created by the board uh over over the several years. So what is going to occur is I will entertain a motion or excuse me a nomination and as pure as per your rules of procedure any nomination requires a second. So that means that if I would nominate Casey Barnell if he were qualified.
Oh boy. Luckily he is not. He like I live in Kittyhawk. Um
then if I had a nomination I would there a second would be required for the person to be considered. One thing that as from staff's point of view which I would like to just happen to comment is that it was my honor and privilege to read all these applications and I do not I couldn't make the choice myself. You have an amazing pool of citizens who are interested in serving. Those who have submitted applications are as follows. Zachary Edwards, William Foxwell, Terry Gray Jr., Bill Kingston, Justin O Sullivan, Timothy Owens, Nancy Rickenbach, Marie Riierro. I hope I got that right. Thank you. Ron Simon, Gina Southol, and John Tor. However, since the time of submission of applications, Mr. Tyler's withdrawn his name from consideration. What will now occur is I have ballots set with names of the citizens which I will hand you after there are nominations any nominations and seconds for the position to fill the vacancy on the board of commissioners. So I will entertain any nominations as presented.

Uh before we jump into this I just would like to re kind of echo uh Mr. Adele sentiments of the high quality of applicants that we had to choose from and how lucky and pleased we are as a board that have such talented qualified people who want to serve and or want to serve for the right reasons. I think there's a lot of folks who genuinely love our town and want to be a part of this board to help make it better. And I enjoyed all of the interviews I had with several candidates getting to know everybody. And uh as Mr. Odell said, "You guys didn't make this easy on us at all." So, it definitely is a tough tough tough choice. That said,
I'll make a motion to um nominate Ron Sidman. I'll second that motion. All right, we have a motion and we have a second. What are there any other nominations?
Yes. I move to nominate Marie Rajira as commissioner. Is there a second? Are there any other nominations? Okay. I will now hand out your pallet and then I'll explain the process.

Under North Carolina state law, there are no secret ballots. What will occur is just a moment I will ask you to please complete this ballot which is ballot number one. I made extras just in case. It has a listing of every name of every qualified person and applicant was which is listed. What will occur for the office of the clerk once those votes are made? I will collect them and tally the result and make an announcement. These ballots will then be on file for the public to enter to inspect at their convenience and they will remain in my possession until the minutes of this meeting are approved in which at that time by state statute they can be destroyed. So as a result of this ballot um a vote must be made and your signature must be at the bottom of it. So, also just to make you aware, there's only been one actual nomination that is made and that is for Ron Seidman. Uh, Mr. Riierro had a nomination, but there was no second. So, technically, procedurally through Robert's rules of order, it dies for lack of a second. So, that is not an option to vote. I apologize. Rules of Robert. So, if you will please make your nom if you will please make your vote, sign your ballot and then I will collect them momentarily. And while they are voting, staff would just like to turn all the applicants attention to the fact that um the board does uh has instructed us and reminded us to share with you all that um we will be providing a we'll be sending out an application for our boards and committees for our various boards and committees that we do have. Um and uh
the board has asked us to make sure that you have copy of that to please consider that also. Thank you. Offic Town clerk sees that there are four votes for Ron Sidman.

All right. Um, next item on the agenda is committee reports. Anybody have any committee reports to share? No for me, sir.
Um, the Coastal Resource Advisory Council met a week and a half ago, I believe. I had a medical appointment that I had to attend in Virginia, so I wasn't able to attend, but I did listen to all six hours of the meeting on 1.5. So, um and it was still like almost six hours. Um obviously there's a lot um with what's happening down south. Most of the meeting um referred to that hardened structures. The science panel is coming up with um a presentation which should happen in April. So, um, I'll keep everyone updated on that, but nothing specific to Kota at the moment.
Wow. Four hours, six hours for this. It was like five and a half even with it sped up on YouTube. Yes. But it's it's two days of me. I mean, it's two days of meetings. So, it's
any other committee reports? All right. Commissioner's agenda. Nothing on mine. Nothing. All right. Uh mayor's agenda. I have uh one one item this evening. And uh Captain Carter, I'd like to please invite you to the podium to discuss our uh kind of a new idea that's recently come about Operation Ride Safe.
Good evening, Mayor, Commissioners. Miss Diaz. Um, Operation Ride Safe was something we were asked to look into for ebikes. Um, yeah, there's a quite a few of them on our multi-use paths now, sidewalks, whichever way you want to prefer it. Um, and it's a shared space and we our main goal is to figure out how to share it uh as safely as possible with everybody. So, our COP officer, Anthony Lane, has uh put something together uh more in lines with education and with talking to our juveniles. uh juveniles create a another issue for the stops and those kinds of things. So, we're trying to go about it as as democratically as possible with the parents, the schools, and having the uh having them kind of police their own so that uh it just comes out easier for the children and for everybody that's going to share these spaces. Uh so, he's doing that with uh he's meeting with the school resource officers, trying to meet with the principles. He's spending time out on Bay Drive if it's nothing more than like, you know, asking them to make sure they wear a helmet, make sure they they share uh that they they drive as sa or ride as safe as possible. And um and just being out in the public to make everyone aware that that that we do have to share these spaces and and do it as safely as possible. Um that's pretty much the the overall of it. you know, we're we're compiling data, talking to the kids and talking to the schools, um, and trying to ensure that all the ebikes are actually ebikes. And for those, we'll be trying to make sure that we get to the parents and those things first, um, to give them a chance to correct all of that on their own. And then I'll I'll be happy to take any questions from you um, that you may have. I'll just say I I believe wholeheartedly in the in the kids of this town. Uh and there's some, you know, they're they're really spectacular young men and women.
And I think that yes, with just simple education and working with them, not against them, you're going to, you know, get the response you want. Uh because, you know, uh again, we have really, you know, good school here, good good parents, good families. Um and just don't want them to feel um like they're being um attacked at the same time. Educate them. Obviously, helmets, we've been we've been on that for a long time, but certainly on a on an ebike. and then uh uh the speed that that goes and then just educating them about sharing the multi-use path and all the various things. They're not drivers yet. They don't understand necessarily everything. How to yield, how to stop. So, uh and the more education I believe will be that'll work.
That's what we're hoping for because this span of kids is not just say high school kids. Uh I've met them as young as in fifth grade I think that officer Lane has already and spanning through there. So there there's a huge spread of of age groups and maturity uh amongst that and that's the best way right now we can figure out how to you know keep everybody in the town happy and safe. Oh yeah many motorcycles you know in in all for all intents and purposes and some of those we'll be looking at to ensure that they meet the laws of North Carolina as best we can.
Oh yeah. Thank you and everybody uh with the police department for putting this together and I think Officer Lane is a wonderful representative to be interacting with kids. I've attended a bike safety course he did for Cub Scouts and he really has the people skills to relate to young people of all ages and I think uh you know having him out modeling the right behaviors and teaching kids how to handle these things safely is a great way to invest his and our our town's time. Thank you. He is and so far he is he's been doing it at least twice a day right now trying to reach all of these kids. Awesome. That's good. Very good. Yes, sir. Thank you. Thank you. Yes, sir. I do have something this evening. Um, as the board knows, we currently lease the property that the Chamber of Commerce building is on, and that lease is um coming up for one of its renewals. Um, the board has indicated to staff that they are interested in leasing a portion of the old town hall fire station to Mustang Music Outreach Program, which is a 501c3 nonprofit. Um, we've been working with them um on providing community- based music education um outreach and relatable charity events that benefit the visitors and the red um residents. So through the consensus with the board, we've been exploring different options with that. What we're presenting you with this evening is the information that's governed by general statute 168272, which requires a 30-day public notice period before municipality may enter um consider entering into lease arrangements. And that's simply what this is. is putting the public on notice um that we look are looking at these two um leases. The Mustang music outreach would be a new lease and the chamber would just be a continuation and these will be on on future agendas for your actions. Thank you.
Thank you. If I could add to that too, just um under a just to clarify or add some additional um information as to why we were um requesting that that you all seek this out. Um John and I have have been working on stay the child and one of the biggest outcomes in the surveys for stay the child was recreation outside of sports. You know, we're this county is really good at recre sports, that kind of thing in terms of recreation and we lack a little bit in in outside of sports or even alternative, you know, we have great alternative sports obviously, but music, fine arts, that kind of thing. We just don't have as many opportunities. And so that was one thing that we saw through that survey in addition to the parks and recck survey. So just it comes with a little data behind it.
Yeah. instead of us just decid like saying we you know there there's some there's some backup to it. really the decision to get to this point, like you said, really started at the state of the child conference two years ago and a need that was identified that uh for young people to kind of have more options in music and the arts and such where it's an opportunity and to leverage a portion of that building for this purpose, I think, and to partner with an established nonprofit who has uh give them a space to grow and they have a lot of trust and and use already as a natural partnership. So, we're Thank you, town manager, for Yes, sir. moving this forward.

Um I hope you had an opportunity to read Caleb's um memo that explains what we're doing and and why. um recommendation for audit services and continuing the services through 2028. The firm DMJPS LLC, formerly Pottering Company. Don't know why they changed that, but um they've worked with us over the past several years and been very beneficial for the town and helping us implement a number of complicated accounting standards. Um we're looking for the contract for fiscal year 2526 audit and then it would have the proposal for estimates for the um next two fiscal years and approval of the consent agenda would authorize the manager to execute the contract agreement audit services for 2526 and approve the firm's continuing services through 2728. Staff recommends consent agenda approved as presented. I'll make a motion to approve the consent agenda.
