I'd like to call this meeting to order. Would everyone please stand for the pledge of allegiance to the flag of the United States of America and to the republic for which it stands. Thank you. Before we move into the meeting, I want to make an announcement. There is going to be a special city council meeting next Thursday, March 12th, at 700 p.m. here in the council chambers. Now, since there's no introductions or recognitions tonight, we're going to move straight to the public hearing. At this time, the council will recess to conduct a public hearing regarding a request for a special use permit for outdoor use, parentheses, meat smoker, and for outdoor dining at Lona's Little Eats restaurant in the B1 zoning district at 612 West Woodbine Avenue. Miss Graves, do you wish to enter any exhibits into the record?
Yes, Mayor, I do. I'd like to enter the following exhibits. Exhibit one, which is an affidavit of publication showing that an ad was placed in the St. Louis County on February 13, 2026. Exhibit two, which is an affidavit of publication showing that an ad was placed in the Webster Kirkwood Times on February 13, 2026. Exhibit three, which is a list of property owners whom notice of the public hearing was sent to. Exhibit four is the viewer map showing the list of property owners to whom notice of the public hearing was sent to. Exhibit five is a memorandum from city planner 2, Amy Lowry, dated March March 5th, 2026. And exhibit six is the res the report of the planning and zoning commission meeting dated February 5th, 2026. Finally, exhibit seven is the Kirkwood Code of Ordinances.
Thank you, Mr. Wedler. Who will present this issue to the city council?
That'll be city planner 2, Amy Lowry. Good evening, mayor and council. Um the subject site is um located on the south side of Woodbine Avenue just west of Guyire. And that's the site right here. Um and it's in the B1 uh neighborhood commercial district. And just to show you uh a little bit uh zoomed in version of the overhead view. Um, just to give background on restaurants in the B1 zoning district. So, they are permitted with standards, but those two standards are that the maximum tenant space cannot exceed 5,000 square ft and that the establishment shall not operate between 11:00 p.m. and 7:00 a.m. Those hours may be extended through the approval of special use permit. So, the property in question is about uh 35,000 square feet and the restaurant is about 4,500 square feet. So, it does meet that. And according to the applicant's cover letter, they are proposing hours 11:00 a.m. to 900 p.m. um 6 days a week. They may open till 10 on Friday and Saturday, but that's within those those hours in the um standards. And they are um thinking that they will have 15 employees with 8 to 10 on the maximum shift. So, I'll start with the outdoor dining area, which will be in the front of the restaurant. And they are um asking for 36 seats in front. And then they are asking for a let me go back here. A smoker to be a meat smoker to be in the rear of the building. And this kind of shows the rear here. It would be between There's an addition right here that they're going to take off and put a cooler in. instead. And then there's kind of an addition here. So, it'd be
tucked in between. Um there'd be a fence around it and it would be locked. So, just a little uh enlarged version of what um the smoker area will look like. Um they are going to be using the smoker overnight so that they can smoke the meats for the next day's um um restaurant uh patrons. Um just some photos. There's the front of the building. Um, again, here's the uh smoker area where the smoker is going to go in the rear of the building and then um the front of the building where the um outdoor uh dining will go. So, and they did provide just a model of the what the smoker would look like. Um the PNZ did recommend approval uh with just standard conditions that we usually use outside entertainment in the form of speakers but no live entertainment the use of the smoker to be permitted overnight and the operating hours for the outdoor dining to be the same as the restaurant. Um, so in the proposed ordinance, we just made those a little bit more specific that meat smoker would may be used out overnight outside the hours of operation for a restaurant in the B1 neighborhood district. Um, outdoor dining should be permitted for up to 36 seats on the north side of the building. Um, the outdoor dining shall comply with all the conditions in section 2545 of the zoning code. And that's just um the standards for outdoor dining that we have for all outdoor dining. That mainly has to do with the seats have to be uniform. If you're using umbrellas, they have to be uniform. You know, trash provided, that type of thing. So, those are just standard. And then um days and hours of operation for the outdoor dining from 7:00 a.m. to 11:00 p.m. That's a little bit uh longer than what their operating hours are proposed at, but that way they
don't have to come back and amend the special use permit if they decide to change those operating hours. And then outside entertainment in the form of speaker shall be permitted. Um, in my memo to you, I did um reference that after the planning and zoning commission meeting, we did um look into this further and outdoor speakers and music are not permitted on public sidewalks. So, I've asked the applicant for a survey because we did not get a survey of the property. So, if this sidewalk in front, they're going to look, but if this sidewalk in front is actually the city sidewalk, we do allow dining out there, but we would not allow the speakers. And so, um, hopefully by the time we, um, have the first reading on the ordinance, we'll get that, um, worked out whether they want that or don't want that and take that out if that if the survey shows that that's city property. So, that's um, I think that's all that I've got. I'm happy to answer any questions and the applicant is here as well. Okay. Um, we did get an email from the woman who owns the apartments behind the building and she was concerned about her mostly older residents in her in the apartments. Music, you said music is only going to be in the front of the building.
If there's music, it would only be in the front. Yeah. And um and then the smoker will be about I thought I think I read 150 feet away. This is the closest building and it that is 150 ft. Um it's about 175 this way and I think it's about 180 to this residence right here. If you know people are upset with the smoke, is there um anything that that could be done? I mean, can you
I mean, the smell would be under our nuisance code, so we would um deal with it that way. Um I I think the applicant when when that came up with the planning and zoning commission and they did have some comments about how odiferous it is, so maybe they would want to answer that question. Be great. We have them come up now. Yeah. And I don't want you to think by uh asking these questions that we're not excited about Lona's Little Eats coming to Kirkwood. We very much are. How you doing? Craig with Camelan. We're the developer of the builder for Lona. Lona's here as well too. So she'll join for future questions if we need to pick up Luna.
But I can address the question as far as the smoke. You know, if if there does become a nuisance, there's an air scrubber you can put on it. You know, it's not a full smokehouse, so I don't intend that being the issue. You know, we're not rolling smoke out of the smoker. It's just a light smoke for some of their meals. Their whole menu is not based on smoked meats. So, just a portion of it of the meats that is smoked. So, it's not Okay. The smoke is not the whole menu or the smoked meats is not the whole menu for everything. Great. Um, okay. And other questions? Yeah.
Oh, thanks. Um, well, again about Thank you again about possible smoke. Um, as I said earlier, I sort of lived down wind from Jack and Phil's on Graoway. Loved it, but I didn't have to live next door to it. We're not talking anywhere near that kind. I mean, the winds can shift and all of that. I just want to make sure that maybe in like beta testing of this, right? You guys will, you know, make sure that, you know, if you need a charcoal scrubber or something like that, um, that is a possibility to add to it. Yes.
Yeah. Okay. that that was the the main thing and I already said I'm excited to have you come to the neighborhood. So that's all. Thank you, Council Member Schaper. Thank you. Uh so I got a couple of questions. U so are are we going to um do some stainless steel buildout around the smoker? And the only reason I asked this is because uh we had a barbecue spot over on Big Bend and Honey Pit at No, it it's High Point now. But uh anyway, the they didn't want to do all the buildout that the fire marshall wanted,
correct? And it then it caught on fire and then they were happy that they had done it. So I the fire marshall is obviously going to look at all this. Correct. Yeah, the fire marshall has looked at it. He's fine with all the clearances inside the specs for the smoker. It is zero or 2 in clearance anywhere up from the smoker to the building. Okay. Two inches on the sides and they require request 18 in for access to any of the controls for any kind of service. But it's 2 in away from any surface. It is a stainless box, right? And it's looks like it's on wheels, so it'll it's okay. All right. So that that's one. I'm just raising the point. And then two, were we doing anything with a fence around the property and removing all that the messy honeysuckle that backs up to the apartments?
Yeah. A lot of the overgrowth that is encroaching on the parking lot. So, all that's going to get cleaned up. You know, we're not going to focus on the any of the underbrush for more of a privacy. We're not planning on putting a privacy fence on the south side of it. There's an existing one on the east and an existing one on the west. Right. Um, so any of the overgrowth that's coming into the parking lot, that's going to get cleaned up and get pushed back, which is a lot of the undergrowth under the growth we're seeing right now. So, yes, that will get cleaned up. New asphalt's coming in on the on the lot. And then anything further past, our intent is not to touch any of that to kind of keep a natural barrier between the two spaces. Okay. So, no fence like what's on either side with the privacy in between them. Correct.
Okay. All right. Well, that'll be a debate. Um, and so LONA, you purchased the entire building. So you So what's the intent with the other part of the building? Are you going to make that all restaurant? The other side we thinking about putting some maybe people coffee or it depends. It's like a a like a grab a morning coffee. Oh, sweet.
So I'm thinking about it and uh first I was thinking about some martial arts and this maybe like the past the parking situation but kind of a very exciting like if I'm thinking can thinking you know got it but that's I'm thinking about it is somebody rent it out to that space all right the restaurant's taking 3600 portion of it still two additional future tenants that we haven't established anybody yet, but there is still room for two spaces.
Two spaces and then there's these nasty parking requirements that someone over here just so you're all knowing that when you I'm sure you know it all. I just want to make sure that it's out here. Yes. No, with the restaurant and then, you know, that's why I should mention with the martial arts, you're getting a lot of parking there that would get into the park. So, we kind of got to tow the line a little bit on what we can put in there, but you know, I know there's a lot of additional spaces that we have on the on the east side of the building for future expansion. Also, in the future, probably I just use that building by myself because you know me, I like that space. Got it. Thank you. Thank you.
Additional questions. Yes. um parking uh the outdoor dining on the street. There's a bike lane and traffic there. Uh have you all talked about any type of protection for the patrons there? Um just in case a bike's flying down and or you know something would happen like that. Have you considered what could be used as some type of protection for your outdoor patrons?
Right. We haven't discussed it. There is a wide parking lot or wide uh sidewalk that is there. There's also a bike lane in the road that's breaking it off. Then you've got the public sidewalk through there and then we're coming up where all of our seating will be tucked up close to the building. So there is two natural barriers there that would keep us off of any public rideways. Okay, great. Thank you. Additional questions. Um just a couple of comments on the outdoor music. I'm glad to see no live music. Um, do you have outdoor music at any of your other um, restaurants?
Not right. We we never really use outdoor music and uh so in my only restaurant only and uh never really think about that pro I mean if I really we want a music probably really low like a volume that's I'm thinking and also so we never really want I never really want to open my restaurant over like a late I like it to close shut down 9 clean probably until around 10 they're completely out and that's the my expecting I never really passed that my older one and yeah it's that's the my plan but in the future if I do something lot of music and I will be apply again probably but I don't I never really come on my mind want to play anything like that because we never open late like a bar type of it we just like a little hometown like a eating restaurant,
which is good to hear because the live music sometimes gets out of control and I think your recorded stuff you can control the volume probably a little bit better though. And again, cognizant of the neighbors and the neighborhood. Um, you know, just to keep that in mind as you look at that outdoor music. Thank you. You know, also on the inside, we've removed all the bar. It's not going to have the whole the bar's gone seating. It's just Sorry. So, it's it's more we're more family style than it is bar and grill, which is really nice. Very nice to see coming to Kirkwood. So, great. Great. Thank you. Thank you.

Well, as long as we get it done everything when we get everything you from you guys put on pressure on this guy. Okay. We're hoping by the end of April. Oh wow. Wow. This this year just clarifying. Nope. That's our goal. Yeah. I'm exciting and I cannot wait to get down which is a lot of work. Um Phil, me and Nay. So we all getting exciting too. Great. Great. Thank you guys. Thank Okay. Uh we'll now move into uh comments from the public. Statement mayor. Yes, please. All right. Uh the public comments portion of the meeting is an opportunity for the city council to listen to comments from citizens. It is not a question and answer session and the city council will not respond to comments or answer questions during this period period. The mayor may refer any matter brought up to the city council to the interim chief administrative officer or city clerk if action is needed.

Yeah, I need to switch it. First, I'd like to thank you all for being here and for your service to the city. I sometimes leave these meetings just wondering what just happened. The mayor the other day reminded me that we need to sometimes think about the good things that happen here in Kirkwood. Some days, I'm sure that gets a little challenging for you and for the rest of us citizens. I'm not here so much to speak to you guys. I'm going to speak to those 800 people that listen to you on YouTube, on the Facebook, on the web, because we got some challenges coming up. We also have an election coming up and I'm here representing the Kirkwood Social Justice Coalition. We're going to have an election next month and I want those people and the people behind me to know the candidates that are running and to get to know them even better by coming to the forum on March 10th at 700 p.m. at Kirkwood United Methodist Church. All four of the candidates happen to be sitting in this room right now taking it all in. Well, believe it or not, they are important just the same as you are because they're going to represent you and me and the people listening. The council that sits here in front of me has made a commitment to work for us, the citizens. Those four people signed up also to work for us, but we get to choose only three of them. And the only way we can do that is by those people coming out to vote first of all, but also getting to know the issues and getting to know the candidates.
So, we're asking you to stop complaining, start looking at some of the positive things in Kirkwood, but yeah, you can question some of those things you got issues about, but these are the people we have to ask. And those candidates are the ones we need to confront and see where they stand on those issues. So, the only way to do that is come on March 10th and listen to them, give your opinion, and ask the questions. and show up to vote and I hope to see you on the 10th. Thank you. Thank you, Fonda. Okay. All right. So, now we will move to um and I don't think you need to read it again. We'll move into um public comments. Yes. Sorry about that. That's okay. We had the first from Fonda. The second is from Clarence Patterson. Welcome Clarence for afternoon. Good evening.
Uh so I'll start off. Good evening, Mayor Mayor Gibbons, Kirkwood council members. I want to thank you for the opportunity to address you all tonight. Uh, for those who don't know me, my name is Clarence Patterson. I'm superintendent for Kirkwood Water for the last 10 years. I've been with the Kirkwood Water Department since June 2008. And since my time with Kirkwood, I've had the pleasure of working under three mayors, uh, two city administrators, and three departments, I'm sorry, three department heads. Uh throughout my career here with the city, I've personally bought into the idea of team Kirkwood. Having spent both uh on the job and outside of work, developing relationships with fellow employees, residents, and businesses, you do not have to look far to see that Kirkwood residents take pride in their town. Uh this is an attitude that goes handinhand with the excellent service Kirkwood sanitation, electric, and water departments provide to the city of Kirkwood. Over the years, our team members have developed a rapport with the community. And in my 17 years with the city, I've witnessed and participated in the coallescence of distribution and support services team for the water department. Each of these team members possess the knowledge and the skills tailored specifically for the Kirkwood distribution system. To put this in perspective, uh the distribution or the department's current employees total 155 years of experience. and that's from working directly on the Kirkwoods distribution system. With this amount of time spent on Kirkwood's water system, our team members have developed a personal uh sense of ownership and their familiarity with the system allows for shorter interruptions in the service when completing repairs and examples of that less time spent searching for valves. Uh familiarity with the system, knowledge of flushing practices based on system sensitivity and so so forth and so on. uh city's elevations also comes into play when doing flushing. So we
have that that knowledge base. Not only has each employee gained on the job experience within Kirkwood system, but each also qualifies uh has a qualified license as a water professional as a DS1 through three. Uh since April 25 uh April 2025, each employee possesses a distribution operator's license. That license also allows them uh the ability uh to make decisions on the fly uh in the water industry. So each employee of the water department has this qualification uh as a competent person when dealing with water main uh scenarios. Uh the customer service that Kirk Kirkwood Water provides is top-notch. Our team assists daily in customer billing inquiries, leak investigations, uh, privately owned services, meter read verifications, pressure and water quality complaints, and more. Though the team works from 6:30 a.m. to 3:30 p.m., employees are responsible for being readily available to respond to emergencies around the clock. That's 365 days of the year. Uh, however, this level of dedication comes at a price. Because of the demand of their job, many employees have missed opportunities to spend time with their families. Many or all at some point have missed Christmases, birthdays, anniversaries, holidays, the list goes on. Mayor, I recall a conversation we had at Kirkwood Park uh last year during a softball event and you asked me, take a look at the field, where are the water department guys? And my answer to you at that point was, you know, uh they work extended amounts of hours uh outside of regular business hours. So their times away from this place, they're trying to maximize that time with their families. And so that's the reason why you didn't see them that day.
Uh I explained, uh let me get back there to it. And as example of the time that's been missed from families, uh I'm sure you all can recall the May 8th event last year, 2025, uh which which we've coined now the term of water getting for good reason. A water gate water. And so that main break event, it was caused by a communications failure from SCADA uh that caused a pump to not shut off at the time it should have been. And so it overcharged a system, an old system, and caused a lot of main breaks across the town.
Uh there were a total of 25 initial breaks. There were about 15 residual breaks that occurred at towards the end of May or I should say up until the end of May. We had 12 team members that were available during that time. Uh May 8th uh and that was Mother's Day weekend at the by the way. Uh the team totally uh together the 12 of them worked a total of 985 hours in the course of those 5 days from Thursday to Monday. The water department received assistance from three different contractors JLO Contracting, Bates utility and PCX. Uh to break down the repairs of those initial 25 uh JLC JO Contracting completed six, Bates completed six, PCX completed four, uh Kirkwood Water completed nine. And of those other repairs that we didn't uh complete uh downright, we assisted with operating our valves and providing instruction during the time of those five days. Uh our team has a responsibility and we've been entrusted with providing a critical service and protecting the public's investment. Providing PBO drinking water, community fire protection, high quality service is our department's daily focus. The department's historical records, including our routine state DNR inspections, prove our team is accomplishing this goal despite Kirkwood owning an aging distribution system. Our water department uh presented some new information during the last subcommittee meeting. We learned from Curtis uh Catelli, manager for Missouri Public Service Commission during the meeting uh that took place over at the Kpack that Missouri American does not classify their leaks as water main breaks. And so we had to reclassify our data that we had provided during the MA uh the master plan revision. And so when we classified reclassified our main brakes, we had an average of breaks
between uh an average period of 2013 to 2025, 40 brakes per 100 miles and that is 10 brakes less per 100 miles than Missouri American as stated in the master plan revision by CMT. Uh the American Waterworks Association AWA states that 25 to 30 breaks per 100 miles is an industry standard for distribution system quality performance. In 2025, Kirkwood Kirkwood's main brakes was 14.8 brakes per 100 miles. This information confirms that though Kirkwood's distribution system may be old, it is still functional. And the overall and and over the course of the department's history, our team has been able to maintain a mission statement despite limited funding. Today, council and the subcommittee members are faced with what may be the toughest decision here in Kirkwood's 173 year history. During the water subcommittee's meetings, our water department provided as much insight as possible so that the committee may be thoroughly equipped to make a sound recommendation to council. We understand the financial dilemma that the city of Kirkwood currently faces. Even though the option to sell the water department utility is on the table, we still believe that Kirkwood Council is presented with a golden opportunity to provide a wing solution for the overall success of Kirkwood and its citizens. I personally would like to thank the subcommittee for taking the time to assess the city's water utility and also to thank both the subcommittee and council for your courage, your vision. Regardless of how the ruling goes, I truly believe you all will do the right do what is right to ensure Kirkwood's longevity and success here. I just want to thank you all for your time.

I want to thank you for this opportunity to meet all of you and speak about my concerns. Um, I've been a proud resident of the city of Kirkwood for 35 years and raised my two wonderful daughters here. Um, I'm still enjoying this lovely community. One of the things I love about it the most is our local utilities. I think it provides an unique service. Having come from Fulton, Missouri, where they also have this similar setup, it just provides this unique excellence that you can't get anywhere else. And I know you're under a lot of determination factors. Um, but recently I've had an amazing experience. I've spoken with Mr. Patterson, Matt and Andy, and a lot of workers. Um, they have helped us locate uh leaks at my place looking into lead pipes. Luckily, they were copper. Um, but I got to interact with the water department here. And I've just been super impressed with the excellence of the service that they provide the community. And I would caution you, having come from two different places, two different cities and communities that have these local gyms, I'm afraid that if you do sell that you can't get that back. And I think having our local utilities here, and I'm not just speaking for myself, I talked to a lot of my neighbors and they feel the same way. So, I appreciate the time to raise my concerns and hope that you'll really dive deep into this situation and think long and hard. It really is a gem and I think it's what makes Kirkwood so special and I hope that we can somehow maintain our water company. Um, they are excellent and I'm grateful for this time to to um listen to me.

Mayor and Council, this is an ordinance adopting and approving the operating capital budgets for the city of Kirkwood for the fiscal year April 1st, 2026 through March 31st, 2027, and appropriating such sums as are set forth herein for all departments and the accounts therein specified for all expenditures of the city of such year. which appropriations total $123,54,765. capital projects of 22,680,955 appropriating the sum of $782,350 for payment of interfund loans and reappropriating 1,363,235 for previously approved projects that will be incomplete as of March 31st, 2026.

So just I should have explained that but we had a conversation um during work session and we um we are going to um have some things David's going to work on some things and we'll be better prepared next week. Thank you, Mayor. So, I I'm commending the building department. We had an uh citizen of Kirkwood that contacted me on Saturday morning about uh a adult daycare center that our adult help me here. Um Manor Grove, we'll just call it what it is. They had no hot water and they've had no hot water for over a week. I got a phone call from one of the people that were in there and I gotta say, I called our building commissioner and he had somebody over there within an hour after I had made that phone call. I made a few other phone calls. I had a phone call out to somebody else who stepped up as a team member to help me with this and they finally had hot water after eight days. So, I just wanted to commend the building department for getting somebody out there on a Saturday uh to get these people hot water. It to me that's absurd and ridiculous. and the state was involved as well throughout the week, but it they still hadn't had it resolved by Saturday morning. By Saturday evening, by 8 o'clock, they had hot water. Um, so I'll leave it there. So, thank you.

Yes, your honor. I have the report of the March 4th, 2026 meeting of the planning and zoning commission. The following action was taken after a presentation by staff in review of an application for a special use permit for outdoor use um gas grill and for outdoor dining for Fox's Finest Market at 159 West Argon Drive. The commission recommended approval by a vote of five to zero with conditions. Um a public hearing will be scheduled before the city council on April 2nd, 2026. Um just so because I know people are probably start thinking about the election coming up and how we're going to work that out. I've already spoken with the mayor about um she is authorized for us to have first reading of that bill the same night so we can have this issue addressed before this current council. So that's that's all I have.
