We're waiting on one more council member and then we will begin our meeting. Thank you for your patience. The council met in executive sessions and no votes were taken. We will move into um continuation of call to order and I ask Jay Ortiz, our city chaplain, to lead us in invocation. Thank you, Mayor, City Council. Um my city manager, Ryan Fabbri, assistant city manager, Ms. Tara. My police officer, sorry, my police chief, uh Dana Crowl, isn't with us here. Uh my deputy fire chief is here with us as well, John Galganski, as well as my assistant chief, assistant police chief, uh Johnny Sellers is with us as well. I hear we have a citizens academy that's also with us. You guys have been working hard with that. That's fantastic. Thank you for doing that with us. Of course, our city uh officials that I may have missed. And most importantly, um the beautiful residents of North Myrtle Beach. Um can we go before the Lord in prayer? Is that okay? Let's pray. Gracious heavenly Father, thank you so much for the day. Lord, your word says that this is the day that you have made. Father, and we will rejoice and be glad in it. God, I thank you for all that you're doing here, Lord Jesus. I thank you for this council, Lord God, and the wisdom that you're giving them. I can I pray continue wisdom, knowledge, understanding to serve and favor for all that they do, Lord Jesus. They've been entrusted to do a job for the city and they do a fantastic job doing it, but Lord, they can't do it without you, nor that it do they want to do it without you. I pray that you would continue, Father, to give them that wisdom that they need. Bless this great city, Lord.

It's it's just really a privilege to work with um Jim Granger and council, mayor, and council people, you've got a great uh parks and recreation board.

So, move into item B is um recognition of the citizens police academy graduates and our police chief, Dana Crowl, is going to give those. Taylor, if you'll come up. Good evening, everyone. I uh typed it this time. I'm not reading from my phone. So, my name's Officer Mitchell. I work with the community service division. Uh I oversee the citizens police academy on behalf of the North Myrtle Beach Police Department. It is my honor tonight to stand before you to recognize the outstanding group of individuals, our 18 graduates of the North Myrtle Beach Citizens Police Academy. Over the last 8 weeks, each of you have made a commitment not only of your time, but your curiosity, your willingness to learn, and your dedication to better understand the role of law enforcement within our community. Week after week, you've showed up ready to engage, ask questions, and take a deeper look into the realities of policing. Law enforcement is a 24-hour responsibility and you've witnessed that dedication up close. The Citizens Police Academy is not des- designated to make you a police officer, but is designed to build something that is just as important. The understanding, the trust, and most importantly, the partnership. Each of you now carry a greater appreciation of the decisions officers must make each day. Whether you choose to participate in our upcoming volunteer programs or simply carry this knowledge forward in your daily lives, your role is vital. Strong communities are built on relationships, and tonight we celebrate the strengthening of those bonds.
Our 18 graduates, congratulations. Your dedication does not go unnoticed. We are grateful for your investment in making the city of North North Myrtle Beach a safe, stronger community. Thank you. Thank you. I'm coming out there with you. Thank you, chief. Thank you all as well. Okay, we'll move into item C, which is a presentation by Coast RTA to update council on service changes and expansion. Great. How are you? Nice to meet you. So, uh Oh, yeah. Need someone else to steer. Thank you so much. Just wanted to uh give you all an update um on kind of all things Coast RTA. Uh, we do have some route changes coming up. Um but I did want to start on some deferred capital that we're trying to work on right now. Um these buses on the left are 2003 North American Bus Industry uh suburban coaches. They all had over 2 million miles on them. We actually got them from Dallas in 2015 uh when when I moved here. So, I'm actually getting ready to celebrate my 11th year here at Coast RTA.
Um and we are replacing them with four of the buses that you see on the right side. Um those that are in the picture are 2021 uh New Flyer Excelsior XDs. I love the names of these buses. They're like a car, but uh and those four but or there's five of them there, but those four those buses were $487,000 apiece uh in 2021. The four that we're getting later on this month are $750,000 apiece including tariffs. And so, uh really uh hit our industry hard um over the last few years, um but we're very happy that they're coming and they're basically replacing these 2003 NABI's, but that's just wanted to illustrate a little bit on you know, we we've we've been utilizing equipment. Those buses saved our bacon back in 2015, but uh they were pretty tired and uh we sent them uh pleasantly to uh Don's Car Crushing. We are also working on a new bus operating and maintenance facility. Um this is our current site plan that you'll see on the on the list here. Uh just a quick update. Uh we were able to uh acquire the property. So, the property is in our name. Uh we are sharing this property with a uh with the city of Myrtle Beach. Uh they're uh putting in a new fire station. Uh and then we're putting two facilities in there, a transit center, which you can see at the bottom of the screen. Um and then the bus operating maintenance facility in the back. Uh the entire site is 21 and 1/2 acres. Um but we're obviously happy to start moving forward and I guess the really bigger news is that uh in November we received notice that we were awarded a uh low no uh emission grant from Federal Transit Administration for 25 and 1/2 million
dollars. Um and so, that's uh providing the federal side and we have money from Ride 4 uh to to uh match those dollars uh to build these two facilities. The grant also includes five more buses that will be uh diesel hybrid buses. They'll have battery um powered as we continue to upgrade our fleet. Uh we have executed a contract with the architect. Uh we're working on right-sizing the facility, but right now our plans are to put 45 buses um and 60 uh 40 40 45 large buses and 60 uh small buses uh so so that we're able to expand uh services. Currently, we operate 21 buses and uh 23 small vehicles. So, that's a pretty significant uh room for growth. Um right now, since we're funding, the name of the game is to expedite the construction of this uh parcel. I don't really have a date certain on when we'll have opening day. We do expect to break ground in the fall of this year, so it is imminent. Um but this is an important project for us uh if we are going to grow and and start utilizing uh additional funds from from Ride 4. Um we are proposing some service changes this uh this summer uh beginning June 1st. Um we're effectively uh recovering from some cuts we had to make at the end of the road use fee era um in our funding. Uh we had two routes that just could not get uh to one one from Socastee up to uh Myrtle Beach and the other one from Conway to Myrtle Beach uh that just could not maintain hourly frequencies. And so, uh we didn't have the money to put additional service out there, so we just uh widened the amount of time it takes the buses to get to and from and and um moved those frequencies to 75 minutes uh which really was uh
detrimental to our service. We lost about 10 to 15% of our ridership as a result of those changes. So, with these changes that we're putting in, we'll be able to put that service back, but then also upgrade services to between Myrtle Beach and North Myrtle Beach, and I'll talk about that in a minute. There are some significant alignment changes. And I and while this isn't really the size increase in service that we were hoping for in our first uh iteration out of the box, um uh it's uh it's an important one and I think it'll it'll bring back quite a bit of uh ridership and we'll start implementing additional changes and additional increases over a phased approach in the in the coming years. Uh we are uh um uh running public meetings. We hijacked your lobby here earlier today uh for a public meeting and got quite a bit quite a good good amount of uh input. Um and a lot to uh think about as we move forward. Um so, just focusing on on June 1st, uh we are really focusing on workforce transportation. Um you know, almost 78% of our ridership is are people going to and from work. Um it reestablishes a uh pulse service to the to the Myrtle Beach Transit Center and what I mean by that is six routes will come in every hour, exchange passengers, and and leave the Transit Center. What that does is it avoids long layovers or long a lot of waiting time at the Transit Center. Um and and by virtue of eliminating that uh waiting time, it shortens the amount of travel time to get to and from and and navigate our system. We're making some improvements to service to the airport. Um and and I've highlighted it for you all because this is uh impacts uh North
Myrtle Beach, but our Route 17 route, which currently operates every 2 hours between Myrtle Beach and North Myrtle Beach, it's one of the fastest growing ridership uh routes in our system, will be going to 60-minute service, so effectively doubling the service into uh uh North Myrtle Beach, and it does provide quite a good circulation within the city um uh along Ocean Boulevard and to and from Barefoot uh Landing and and other. Uh we were not able to get over to Seacoast, which was uh disappointing. I wanted to try to get some service over to Seacoast as soon as we can, um but we're going to try to get that in the next round of uh services, which will happen hopefully in the spring. And with that, I'll be happy to answer any questions. Are there any questions by council? I would just like to say thank you for your service cuz it is an added benefit to our community and our workforce. Appreciate it. If we can get if we can get that service added to Seacoast, it will really benefit the hospital as far as getting their employees there. Hopefully. Yes, ma'am. I appreciate you coming to City Hall to meet with us a couple weeks ago, believe we did, and then having the public input meeting today. Thank you for being here tonight. Well, and and we're we're still listening. I mean, there may be a few changes that you know, tweaks that we make between now and June, um but I certainly welcome anyone's input. Are there any announcements by council? I I just want to say thanks to the employees, um our first responders, and um any volunteers that helped during some of the events we had this weekend. We had the opening of the uh farmers market on Friday, um and then we also had the Easter egg hunt on Saturday. So, anybody that had to work or help out um over the weekend over Easter weekend, I really appreciate that. Any other comments? Okay, we'll move into consent agenda. Item A is a resolution memorandum of understanding between the City of North Myrtle Beach Police Department and Horry County Sheriff's Office office. Is there a motion to approve? Motion. Second.

So, basically, this is a mutual aid agreement. I mean, it it it means that we will help each other, our police departments will help each other in case of some emergency. Could be hurricane or on civil arrest or, you know, anything that could happen that where we need uh where we need each other. It's so it's just something that we do every year. And pretty much speaks for itself. Is there any comments by council? Are there any comments by the public? Hearing none, we'll take our vote. All in favor favor say I. I. All against? I's have it. We'll move into item B, which is a resolution to reappoint Dean Meridew as the North Myrtle Beach Municipal Judge for a 2-year term. Do I have a motion to approve? So moved. Second. We'll move into item C is a motion to appoint three opponents and two reap- or two three appointments and two reappointments to the Accommodation Tax Committee. Is there a motion to approve? The only thing that I I wanted to just say is if Ryan or somebody could kind of explain to um the public what they do and what their responsibilities are so they understand what a tax accommodation committee actually does. Um yeah, I'll be happy to. So, A Tax Committee really uh their main function is I'm not to get too in the weeds on it, but uh state accommodations tax, which is 2% of
all accommodations on anyone who stays overnight, whether that's a Airbnb or a hotel room, um that 2% is remitted to the state. They hold it, and then they give they remit it back to the the city, and 30% of those funds have to be spent on uh tourism tourism-related expenses or promotion of tourism, which the chamber acts as our uh designated marketing organization, so they handle all of that. Uh and then um there's about 65% left over, and of that 65% um the city makes it uh available to outside agencies to um you know, if they have like a um a festival or some sort of um business or something that would benefit the city uh from the viewpoint of tourism, uh then those funds are made available. People can uh apply for grants, and then the A Tax Committee uh is the committee that is tasked with hearing all of these um requests for for funds, and then they make a uh recommendation to council uh where they think those funds should go. And that's something that you guys get every year during budget retreat, and most of the time uh council goes with what is the recommendation of council, but it is just a recommendation, so council could certainly um change course there. And to make that clear, too, the the uh three reap- or three new appointments include Susan Platt, Robert Roman, and Wayne White. And then the two reappointments include Tina Cockran and Peyton Henley. Thank you. Are there any other comments by council? Are there any comments by the public? Hearing none, we'll take our vote. We'll move into item A under unfinished business ordinance second reading, petition for annexation and zoning designation for 64.46 acres on Cyclone Highway 90. Is there a motion to approve? Uh we thoroughly went through this on the first reading, and it looks like this developer has done everything those neighborhoods have asked them to do. So, I'm good with it. Yeah, and we'll talk about some of the changes in when we get to develop developers' agreement in the next item. Coming up. Are there any comments by the public? Please give your name and address. You know the speaker. Shelly Poplin, 3506 Turner Avenue. I just wonder if we're voting backwards. Should the development agreement be agreed on before the annexation because would the citizens like to have a comment? I do have some concerns about the development agreement prior to annexation. I think annexation is the desired, but the development agreement is what they're supposed to agree to in order to make sure that the annexation is not a mistake. I'm just confused that we're giving them annexation prior to voting on the development agreement. I'll ask the city attorney to respond to that. Chris, could you get that microphone, please? So, Procedurally, the annexation um of the property will have to come before the development agreement. So, the development the act to development agreement can be applied to property that's been annexed into the city. Okay. So, who just out of curiosity and this may be for the next one and I can ask that after. Who's responsible for making sure the development agreement is followed? Because we annexed and I think Chef even made comment about the
property across the street which was not in its highest and best use and highly undesirable, especially supporting the sports complex. I don't believe a car wash and a storage facility will end up being one of the benefits that that sports complex was built to accommodate. So, who's in charge of accommodate or at least overseeing that the development agreement is followed? Cuz there are a number of things in the development agreement that will be conditional at the point that we're voting on it, but could be amended, which is kind of a common practice here in North Myrtle Beach to get an agreement decided upon and then to BZA it to change. So,
we're going to cover that when we go to the next item in the development agreement. And if not, please come back on that. Okay, perfect. Thank you so much. [clears throat]

We'll move into item B, unfinished business, ordinance second reading, development agreement for Champions Boulevard commercial and to authorize the city manager to sign the document on behalf of the city. Is there a motion to approve? So moved. Second. Is there any comment by council? And I will bring this up now since we talked about this. So, the and and maybe Yeah, Chris is already up here. So, I think, you know, in the development agreement we had um included language that's included in here that would exclude certain usages and we also have language that would uh talk about what we can do in case somebody did not abide with this agreement. Correct. And I'm going to go over those changes.
much. And I'll go ahead and get into that. Um council, um what I'm going to go over with you are changes that were made to the development agreement since um first reading um a couple of weeks ago. Um section 12D, the intersection improvements at Champions Boulevard and Park Point Avenue, the developer agrees as a public benefit that the developer shall contribute to the city on or before the second anniversary, the effective date of this agreement, the sum of $250,000, representing a portion of the cost incurred by the city for the installation of a future pedestrian and/or vehicular improvements near the intersection of Champions Boulevard, Park Point Avenue, and Citizens Circle. Um regarding section 12E, um full function intersection improvements, developer agrees to install as a public benefit at the developer's expense a full function traffic signalization at the intersection of Champions Boulevard, Sander Boulevard, and the primary access point to the project as um shown on exhibit L, which also includes signalized pedestrian movements, the specifications which are included in exhibit L attached here too. The location of the improvements described above are also shown on the offsite improvements location um on exhibit Uh I'm sorry, on the offsite improvements location exhibit. Further improvements set forth shall be subject to um one, the approval of the city engineer, two, the approval um to the extent required, the South Carolina Department of Transportation, and following the completion of such improvements and and acceptance by the city and the SCDOT respectively, such improvements shall be deemed to have been completed in accordance with the terms of the agreement. The cost of platting, dedicating, conveying, and recording such offsite roadway roadway improvements shall be the sole expense of the developer. Section 12O, um developments of regional significance, the developer acknowledges
and agrees that the project that the project is to be developed um on the subject property is intended to be a development of regional significance un- significance under section 23 -129.5 of the code of ordinances and that to the extent design principles and standards or applicability of section 23 -129.5 are amended prior to the first anniversary of the recording of this agreement, the subject property shall be required to comply with all amended design principle and standards or applicability. Now, this last section requires a little bit of background information, so I'm going to go into that first. Um in beginning the background explanation, additional edit edits were made today that relate to the restrictive covenants that that the developer will be obligated to comply with. Um as council is aware, the property is being annexed into the city with a zoning designation of highway commercial. Highway commercial district typically allows for the following types of uses within highway commercial. And those uses are adult entertainment businesses, cemeteries, crematoriums, and building heights of up to 50 ft and in some instances building heights of up to 70 ft. However, in this instance and in the development agreement, the developer has agreed that the property will not be used for adult entertainment businesses, cemeteries, or crematoriums, or buildings of a height of more than 35 ft in the area depicted on exhibit I. And that area is an area that backs up to I believe the Park Point neighborhood and it's depicted on the on the exhibit. And these restrictions will be included in the recorded covenants, conditions, and restrictions or the CCRs. As section 12 um P on page 13 of the development agreement provides that neighboring property owners or property
owners association within Park Point and Park Ridge shall be deemed third-party beneficiaries of the covenants, conditions, and restrictions and shall have the independent right, but not the obligation, to enforce those specific restrictions in the event the developer violates those specific CCRs. The city um um as well as provided for in section 17, restrictive covenants of the agreement, can enforce those as well. And those are the um the basic changes that were made since first reading. I understand. Thank you so much. Yes, sir. I believe we covered and the developer did everything that our residents asked and and the council asked as far as I can tell. Is there any other comments by council? Are there any comments by the public? Selena again. Uh I just wondered if there was a maximum square footage in the development agreement. I didn't see that. I do not, but there is it's a straight zoning, so it's zoned highway commercial, so there's not
would be able to do as large Anything that's allowed in highway commercial. Other than what was excluded in the developer agreement. Right. So, we know what's not allowed, but we don't know what is actually going to be in there. You you do not. And it's straight
not a maximum square footage because we see with Alley Oops, that's a giant building on a very small piece of land. I don't know if you've been by, it's pretty atrocious. So, if there's not a maximum square footage, are we at risk of having something that doesn't fit? Yeah, I mean, you actually do have a maximum square footage and one as the footprint For the 65 acres, yeah. But, it's also defined by by setbacks, front setback, side setbacks. And then there's a certain there's some other factors that consider in there on the site development as far as you know, automobile circulation, pedestrian circulation, landscape requirements. So, you don't you know, car blanche say that it's 100,000 sq ft or 50,000 sq ft, but you're it's governed by the per- piece of property, very much like is in residential is is you're in. Yeah, well, Alley Oops is probably a lot bigger and probably not going to have enough parking, so I'm still a little confused how that all happened, but I know that doesn't apply here. My question is the 8-ft cinder block wall, did you not get that? Did you Have you seen Alley Oops? Have you been by Alley Oops? Okay, I just I just wondered what that was all about. I just wanted to ask. It fits within the zoning. It's atrocious.
It's highway commercial. 8-ft cinder block wall is going to go between the development and the and the um the housing development. Who's maintaining that 8-ft wall? Um Will that be for in perpetuity? I mean, I just know from Barefoot's experience, they had a you know, a wall that went in and it's had issues. I think that's a different kind of wall. This is not a wall like it's at Barefoot. This is a concrete cinder block wall, I'm assuming Shayla.
I'm not I'm not saying that they're similar, I'm just saying who maintains it so that you don't end up in a problem with that. So, the developer would maintain it in perpetuity? Sure. Uh if you remember during our initial conversations, that was one of the things that happened is the wall is actually located on the development property rather than the HOA property. So, the developer has to maintain it. So, it will be maintained by the developer in perpetuity. The question then comes down to if that ownership is not all contiguous, then what happens? And that's where Chris was explaining that we'd have covenants and restrictions so that everybody in the development would have to contribute to that. I understand. I will. And then so management. I didn't Did I miss that? Do we have a storm water storm water management plan?
That there again, like storm water, when they submit their design, just like the buildings like Mr. Coin said, they have to meet all the conditions, the parking requirements, etc. The same thing would be true with the storm water. They have to submit a storm water plan and it would have to meet a lot of criteria both on the city level as well as the state. So, what phase should the citizens pay attention to to make sure that that When they submit their plans, when they as they come to us and start submitting their master plan, cuz they'll have to do a master plan so that we as we approve things. So, in that master plan they'll have to do a preliminary whether they do it in phases or they do it in one big chunk. If they do a phase there again, engineering will have to go back and calculate the calculations on what that particular phase would impact be. If they do another phase, they'll have to do the same thing. Now, whether this developer comes in and does one big blanket, which I'm hoping that's what happens and we can To me, it's simpler if they do the bigger phase and you can maybe catch some loopholes. And so, I understand they have 10 years. Is there a phase for which each part is starting, finishing? Is there any kind of performance bond on any of that? No. No. So, they can start and finish whenever as long as it's within the 10 years. And so, we could have some of it done and some of it not done.
But, the thing is under the uh under this development agreement just like right now, that this particular individual doesn't own these parcels. These are three different parcels or four different parcels. But, they have it under contract. But, these owners that currently own this property, they've agreed to subject themselves to this development agreement. So if this developer starts it and for some reason he goes bust or he can't perform that property is restricted to this development agreement. So, that let's say we have like in 2007 when we had our big crash, a lot of projects didn't get get done. And but they were still those projects were restricted by the development agreement. So, it's when the things did rebound, you do have some control over it. Will the public safety, fire and rescue, all of that be part of the the plans as they go along or has that been like has there been a traffic study on the increase in traffic and then how public safety will support
Yeah, when they submit When they submit those plans they will circulate through the different departments of the just like the police department and the fire and rescue, well they'll have give their two cents worth. We did at one time, but it kind of didn't have any activity so, it went away, but we need to have it and it deals with floods and certain things that the BZA can't address. So, we need to put a board in place and we have some applicants for that board.

That's what we all heard you say during your campaign that we'd have some new faces. I'm excited to hear that Travis is actually qualified by being a 39-year-old resident. He holds a bachelor's degree in science and forestry management. So, he'll be serving on the tree board. Can you please tell me why Northfleet at 83 years old is the only person we could appoint when you had several great candidates? None of them were called or interviewed. So, if you could help me out cuz it's really the BZA is the most critical board we have. It's the one that makes decisions that affect our city. Northfleet is also serving on sanitation and according to your ordinances, he cannot serve on two boards. So, is he going to resign from sanitation? The museum and I think he was also on tax, but I don't think he got reappointed. Can you help me here? Yes. Uh he is resigning from solid waste. So, he won't be doing that anymore. And he has petitioned as we have a lot of great great candidates and we've got a man even though he's 83 years old. I don't hold that against him being 83. That's um very uh community oriented. What are his qualifications for BZA? His long-term a lot of First of all, he's 83 years old. He's been through a lot of stuff. So, he knows a lot. And his qualifications are just as good as your qualifications or my qualifications. What are they? He's been a businessman forever and ever. You know, for a very long time in the city. You you made a point on the tax commission to identify what their qualifications were. You made a point to
identify what Travis's qualifications were. You did not on Northfleet. I actually believe this is the same shell game. These are the same people. This is friends and family. We've seen enough and I think it's a really great opportunity of this the city to show the citizens of North Myrtle Beach that when they say it's new blood time, it's new blood time. Okay. I appreciate I appreciate your comments on that, but personally Mr. Northfleet has done a excellent job in our city and in my opinion, he has a certain as a right just like and just like the other people. Solid waste, serving solid waste, serving tax and he's on the museum as well. That's also a city business. So, I think it would be a conflict. And so, unless he's going to resign from everything, but it's also not new blood and you all said you want new people. You want new faces. There's a lot of very qualified people and we get the same people. I know Northfleet did a lot during the elections. So, is this something we're doing a little payback or his wife's in the women's club? Is this I mean, I'm I'm serious. I'm super tired.
I'm super serious. You may like disagree with who's appointed on to a mission or commission and you have your own judgment of that and that's certainly up your opinion and your you know, however you want to judge that, but to judge and ask us to talk about somebody individually about their credibility But the qualifications, that's all I'm That's unworthy. The qualifications are listed in his resume that he submitted to the city. not on the seat. It's public information. But this was this was these three, the tax and the tree and the BZA were issued by the city to the citizens. In two of the three, their qualifications for that board were listed. Northfleet's were not. So, it's either an exception that you've chose not to follow or you're not being forthcoming and I just don't think it's necessary to single out Northfleet, but you you did it by issuing these three reports differently. One is different. So, I did not see the difference in the reports. We received a application from each applicant with their resume attached to it. But each one identifies why they're being selected for the committee. Okay. I'll I'd have to look into that. I'm not sure about that. I'm not sure why his are not listed there. Okay. They were listed with his application. I just think it's time for new people and there were a lot of people that applied and I think it's very unfortunate that once again, we're picking some of the same people. Same names, same friends, same family. I don't think Northfleet served on a board for us, but I'm not sure about that.

Um Mr. Mayor, members of council, city staff has advertised an amendment to section 23-157 to correct language that is inconsistent regarding the number of members on the board so that the revised code section is consistent that the Board of Zoning Appeals is comprised of seven members and that three of the seven members shall be appointed for four-year terms ending on December 15th of 2028 and that four of the seven members shall be appointed for four-year terms ending on December 15th of 2026. The referenced amendment will ensure the
board members' terms are properly staggered and the appointments will fill a vacancy on the board or expressly for the unexpired term of the member whose seat is being filled. Before section 23-157 can be amended, it must first be advertised for a period of 15 days before before it is presented to the Planning Commission for recommendation to City Council followed by submittal to City Council as an ordinance for two readings. The attached resolution resets the terms of the members of the Board of Zoning Appeals consistent with the edits made to section 23-157 that will be presented to Council. Um recommended action is to um adopt the resolution resetting the terms. Um so, the resetting of the terms will be Mendel Bell, um a four-year term um through December 15th of 2026. Andy Thomas, a four-year term through December 15th of 2026. Wyman Wise, a four-year term through December 15th of 2026. Northfleet Jones, for a four-year term through December 15th of 2026. I do want to ask one question and I did read it. When they come off the beach if they want to smoke and they're in an access alleyway, can they smoke in that alleyway or they where do they going to go to smoke? All right. So, we discussed it and we felt that if you're going to include the beaches, I mean you should include the public beach access ways and the the parking lots themselves that are public land and to say everyone that you can smoke in the public access ways then everyone's just going to flood to a choke point and there'll be a bottleneck and then people will be forced to walk through a wave of smoke every time they go to the beach which just defeats the purpose. So, um, it does include the the beach accesses and the the walkways. And that does help with the pollution of the beach as well keeping the cigarette butts off the dunes and off the sand. Yeah, that's the biggest thing right there. That's probably the most disturbing part is people with the cigarette butts and the trying to clean the beach every day. Well, that's a great question and uh you know, most like things like this or and that that's one reason this kind of got stalled for years about being brought up. tremendous amount of people that will you know, that will abide by or or would not abide by. You're going to curtail a lot of More people are going to abide by the law. There's no way we can add somebody to go up and down the beach and we're not going to do that, but that was something that we struggled with years ago, but still it's the right thing to do and I think it will curtail and it will be probably complaint driven more than anything. If somebody has a complaint which a lot of our laws
Police enforcement that would if somebody complained about it, that's Yeah, sure. Okay. All right. Thank you. Hopefully people most people will abide. And what we hope to is the chamber is going to help us put out notification to tourists that are coming into town. They're going to market it for us as well that we are a no smoking beach. Good evening. Randy Gardner, 626 Bay Street. Uh, first of all, I want to say I appreciate the chance to be able to speak freely on this here. Um, live down here for a long time. Been on the beach long time. Never really can't see where this really complaint is coming from and I'm kind of shocked that I can go out here to a designated smoking area and I can smoke, but in December when there's nobody on the beach somebody can't smoke. Now, I don't smoke. I'm just looking this common sense wise here. The same thing with the dogs, you know, during the winter we let the dogs go out there and stuff. We're a tourism related area and we're putting more and more restrictions on the tourist, but it is a fact that smoking and the use of smoking products is slowly decreasing within the public. You know, are we pushing everybody to go down to Myrtle Beach, up to North Carolina beaches and everything else as we put more and more restrictions out? I just want to think about that a little bit is some common sense here. Um, I could see if we want to make maybe some maybe no smoking designated areas on the beach and stuff, but I don't see a lot of law enforcement. I feel so sorry for them now. They can't even enforce the illegal use of cannabis on the beach and if anything smells horrible, I'll go along with that if you know what I mean. Um, but if people are putting up with that, they've obviously been putting up with the smoking. So, but again, thank you very much for the opportunity to be able to let you know my feelings. Your email addresses are on the website. If you're not going to respond to citizens and taxpayers, then you maybe should remove it. I would respectfully suggest that at least when you get an email saying,
"Thank you for your email. I referred it to staff." And uh, then at least the constituent would know that got your ear and you're doing something about it. I did post my concern on concern uh, citizens of North Myrtle Beach and Mayor, thank you for seeing that and responding and Councilwoman Woeber, thank you for responding. Uh, I just want to again respectfully suggest that you take your job of being constituent representative seriously and respond to them. Uh, I'm appreciative that Terra Greenwood has reached out to me and been very helpful and look forward to working with her in the future. So, I I always respond to all my emails and I may have failed to do it on this one, but look, sometimes they can pass by.
Yeah. You can miss them. I get tons of emails. It's amazing. I have to look through there and I make sure, but I always respond and I forward them to staff, but we've been talking about that a lot of times because sometimes when I forward the email to staff that I get and I'm expecting a response, sometimes that response is not really as quick as I would like it for it to be. Right. And so, we've discussed this that now I've changed my system where I respond back and let you know that I've sent it to staff. Um, and then that way if you wait cuz sometimes we get like an email and it's a lot of questions and and it we don't have the answers.
Right. So, we got to go through a lot of different departments to try to come up with the right answer and we want to make sure we give you a correct accurate answer. So, I apologize and I'm sorry. Um For those don't know me, I'm in kind of a newer subdivision and we've had some problems out there with the developer and the builders and we've had some really great city inspectors out there helping out us homeowners and we're getting ready to have a bunch of property turned over, a lot of storm water management, big rec center and just any extra inspectors you can afford, they would be very welcome and I just wanted to pass that on cuz we could certainly use them when this important infrastructure is being finished. Thank you, too. Hey, Ed McWilliams, 1223 Tri Sail Lane, Tidewater. I want to go back to the matter of enforcement in the city here. Um I've lived here 10 years. I spend a lot of time at the beach. I spend a lot of time in McLean Park. Um it seems like the disparity in the enforcement of the ordinances that you have is is very shaky to me. Um I can be down at the beach in the middle of January with my dog playing in the water. Nobody on 2-300 yards on either side of me. A police officer will come down and say, "Your dog got to be on a leash." Yet yet every sign at every beach access says, "No alcoholic beverages, no pets off the leash." You're going to enforce one but not enforce the other. Okay? I go down Ocean Boulevard and I see the signs that say, "No golf carts." Golf carts up and down Ocean Boulevard. Now, you can specify LIV or something, but the sign just says, "No golf carts." Okay? And you go in McLean Park and there's a sign in there that says, "No bikes, no scooters." There's kids over there riding through there on electric bikes. There's a guy with a dog training his dog chasing the ducks in the lake. I see I've never seen an officer over there walking in the park. It's a city park. You get a mixture of tourists from the beach and people from the city, seniors walking on the on the path with their dogs. Okay?
And you have these local kids flying through there on e-bikes. I never see any enforcement on that. So, it's like it goes back to an old adage. Say what you mean, mean what you say. Okay? If you have an ordinance, enforce it. If you're not going to enforce it, get rid of it. Just like the alcohol on the beach. Why do you have it if you're not going to enforce it? Okay? The signs just they spell it out verbatim. Okay? And and that's the way it should be. Mean what you say, say what you mean. Thank you. Thank you. Are there any other comments by the public? My name is Bob Hutton. I live at 5208 Windy Pines Drive. More importantly, I come to you this evening as in my role as the founder of Keep Watertower Road Beautiful group. Uh we are making a difference along that roadway. We have changed our tactics recently. Uh I used to have large groups a few times a year and now we're sort of making squads to uh keep an eye on certain areas. Right now, there's I almost have to say there's a gravitational pull in some particular areas. But I'm also talking to the developers along there and I've heard more than once, "Oh, that's not our stuff." The white tar paper that blows off and of course the wind is their friend because, "Oh, it's not on our property." But I said, "Look over in the woods over there." And it's all the same stuff. But we're we're making uh super progress over there. But you know, as my brief interchange with the chief said, I have to bring some comic relief to these meetings. Uh our two new council members, welcome. Congratulations. But please be aware. Your counterparts will tell you that should we find certain items during our pickups, we do DNA tests on them. I'm not pointing any fingers, but just be aware there you know, we're going to be watching to see what is dropped along the side of Watertower Road. Um my last point, Watertower Road is a constantly evolving as we know it. To some extent, it is a primary artery of our city. It's no longer that farm road back there that it used to be.
I would like Watertower Road to receive the same mowing attention that some of our city's some of our city's other streets get. Um it just has to get on a regular schedule and I'll certainly coordinate that with anybody because as we know one piece of paper or a piece of litter cut by a lawn mower creates a lot of other pieces of paper. Uh but we're there to help and to coordinate with the city because I have found uh my requests of your department heads, of our employees of the city have been always well received and I have gotten information timely information in return. So, I'd like to thank them for that. Uh so, ladies, beware of where you throw things and gentlemen also, you know, it's not uh we just you know, as the men will say, we we have found uh you know, pregnancy tests out there and so forth. And on that note, I'll leave.

Well, accountability to me is the issue here. Uh except for the two new ladies, most of y'all have been uh in the city government for several several years and you've let things just go by without taking any action whatsoever. Uh one of them is a financial audit. You're almost 2 years behind. Okay? Uh somebody in the city had to be responsible for for submitting that financial audit. And we don't hear anything about it about who's you know, to me, somebody has to be responsible. The same thing with these uh commissions that you have and they're exceeding their terms. I mean, how how does that happen? Now you're doing housecleaning. I get it. You're trying to make it right, but how's it going on for so long with none of y'all saying anything about it or addressing any of this? So, y'all are all accountable. And I hope the ladies step up and do the right thing and watch what's going on with the city. Thank you. Look, and I did talk to you about the audit and I'll let our city manager talk about that, but I told you exactly what was going about that. So, you asked me and I told you and we've got it, you know, I mean, I get it. We had to make some changes in our uh accounting system. We had to bring up things up to speed and we knew we were going to be behind, but we're not going to lose anything. It's just delayed. And then as far as what was your other
question you you brought up uh About the uh you've had people on these commissions Yeah, so and and we just we we've not had people that were not on there and I think I explained this to you, too, when you came here and met me at City Hall, I'm pretty sure, but if not, look, we we did not have people that were over their thing. I think what happened was in some cases, they didn't get reappointed when their time was up and that was brought to my attention a lady in this audience here and we fixed it. Um I did not know it and council can't be aware of everybody. We have a lot of commissions. We count on staff to tell us that and back in the past somewhere, it kind of got dropped a little bit and we missed a few things and once it was brought to our attention, we fixed it and we fixed it tonight. And Brian, you want to talk about the audit just so we got that clear on there. Yeah, so I mean, we're we're well aware of it and I can I can tell you it's it's the product of a lot of different issues. Um you've got um people that were in leadership uh roles for decades um who are no longer with us. So, you've got changeover in management. You've got uh a new auditor for the first time in 45 years, which that in itself is an issue. So, the fact that we're correcting it and having a new auditor come in and look at everything and make sure that we are where we need to be. Um that's fiscally responsible. We're not doing anything that um that we don't want to talk about, but that takes time. It's not something we're going to snap our fingers and all of a sudden all these things are going to be in place and the changes are going to be made. Um we're implementing new software to help us do it more efficiently. Um so, I mean, there's just there's a lot of reasons and um we're we're not rushing it just to get something out there. Um and it's been something I've been dealing with for my 18 months plus and and as the city manager. So, uh I take it I take it seriously and it's probably one of the things that keeps me up the most at night, but I can tell you
that we've made huge strides and we are very close to all the things that you're complaining about uh being rectified and um and in the clear. So, there's there's a reason for it and I can tell you that the people that are here now working on it are not the problem. All they're doing is working to solve the problem. So, to to kind of cast it as if there's something nefarious or wrong going on uh right now, I take uh I take objection to that. So, we're just we're doing our part to to clean it up, and that that's all that's taking place. Well, I also think that some of the things is a disservice to you council members. Uh and one of them that, you know, we talked about it, Mr. Baldwin, about the uh Chick-fil-A thing. That it came to you, and now you guys are in a bad position with that because I don't believe the planning commission did their homework, okay? All they did was recommend approval for it. They didn't really look into all the issues that were going on with that moving over there. So, now you guys are stuck with it. And it's not fair to y'all to have to be put in the position that you're in now because you didn't have all the information uh given you know, all the information wasn't given to you. Up until a few years ago, we had the offering of a seasonal rental, um that I loved. I'm right there on the beach for a reason, right? It was
$660 for the season, Memorial Day to to Labor Day. That was discontinued. The closest thing is a monthly rental, and that's $600. So, $1800 took it from something that was affordable at 660 to 1800, which is out of the reach of a lot of people. So, my ask is that you consider, maybe just for residents, um looking at the the seasonal rental. It's a it's a wonderful benefit, and it we are paying a lot in taxes, right? So, I would ask you to to reconsider that. Thank you. And we are looking into that. I've had quite a few people contact me about that, and I've had uh our rec department looking into it. There was we It's a lot of things that happened there where there were a lot of people taking advantage of that, including owners that were putting it on their rental programs, and then we were running out of chairs for not only our residents, but our visitors, and Yeah. We had to make a change, and we're we're searching now to figure out a way to do it just for our you know, permanent residents, and and so that what anyway, yeah, they got taken advantage of, and it There's a balance. If you probably ran the numbers, you weren't making anything off the 660 for the season, but I think that there's a balance of being profitable and offering a service. That wasn't the only reason, though. The main reason was is we had uh a lot of renters uh condominium owners that were offering it in their package as a and then they were basically uh taking up all the chairs and umbrellas. So, it became an issue that we had to address, and we addressed it that way first. But, look, I've had a lot of people reach out, and I thank you for reaching out. Please send me an email about it. I'd I'd appreciate that so I can forward it to the staff as well. And I'm trying to hopefully work with them to figure out a way we can bring
this back. would be, you know, we still have 6 weeks, 7 weeks before the season starts that we can look at a solution.

It is When is that going to be finished so we can get rid of all the dust and the dirt from that water that water line that's going in? What's the status on that? Dana, can you address that, please? Yes, sir. Thank you for the question. Yes, the the water line has been installed, and they're in the process of pressure testing that line. As soon as they're done with it, they're looking at starting paving. Uh you can see some paving going on as soon as the end of April is is current schedule. And then after that paving, it should be complete, right? Yes, ma'am. There'll be some punch list items, but yes, it it'll be finished then. Thank you. It's just a mess. Yes, ma'am.
