Thank you, Mr. Chair. I am submitting the agenda abstract and supporting documents into the official record of the town. The first item before you tonight is REZ 202510. It's a resoning requested by Wayne Molden of Molden Win Surveying, PA at 1517 North Main Street, pin number 066791767. This resoning is a total of 1.243 acres from the office and institutional zoning district to the corridor commercial conditional zoning district. Staff recommends approval of the proposed zoning map amendment as it is reasonable and in the best interest of the public for the following reasons. Number one, the requested zoning map amendment is consistent with the 2040 community vision land use plan classification of suburban commercial. Number two, the requested zoning district supports the LUP's policy 2.1, encourage infill development and redevelopment inside town limits. Number three, the requested zoning district supports the LUP's policy 2.6, encouraged commercial development. Number four, the requested zoning district supports the LUP's policy 4.1, manage future growth and development in accordance with the priority infrastructure investments areas map. And number five, the proposed conditions offered as a part of the petition align with the goals of the 2040 lang plan and effectively plan for the site's future development potential. I'm Wayne Molden with Molden Watkins surveying at I believe it's 139 North Main Street across the road. Uh we put the resoning together here you have tonight. Uh basically this is an area that was reszoned overnight back under the old zoning. Uh the tenants now or the owners have a tenant that wants to move in little brick house and put in a salon and found out that a salon was not allowed under the current zoning. So we're just asking to change the zoning. So that it would allow for a salon in that in that area. Any of you have any questions? I'll be glad to try to answer.

Uh they have some interest of some commercial people that have called them and talked to them and they're at retirement age and they are almost or just about finished with a house at the beach. It's a resoning requested by Wayne Malden of Maltton Watkins Surveying, PA at 7509 Perfoy Road. pin number 0667704228. This resoning is a total of 0.799 acres from the corridor commercial conditional zoning district to the general commercial conditional zoning district. A land use plan amendment has also been requested from the neighborhood commercial to the suburban commercial classification. Staff recommends approval of the proposed zoning map amendment as it is reasonable and in the best interest of the public for the following reasons. Number one, although the requested zoning map amendment is not consistent with the 2040 community vision land use plan classification of neighborhood commercial, the petitioner has opted to request a change of the land use plan to suburban commercial, which is compatible with the property's current use and proposed zoning. Number two, the requested zoning district supports the LUP's policy 2.1, encourage infill development and redevelopment inside town limits. Number three, the requested zoning district supports the LUP's policy 2.6, Six, encourage commercial development. All right, this time we will open up the public hearing and invite the petitioner up to speak. Wayne, I believe me, you and we're doing all the talking. Down. We're going to make it quick. Yeah, right. Uh we did this Wayne Malden with Malden working surveying 139 North Main Street here in Fugquway. Uh basically, this resoning is coming before you tonight. Uh, as all of you know, this is the Milano's Pizza site. He's been doing maintenance and upgrades for almost a year or longer now. Uh, at the present time, it is a live work unit. Is that the right term? That's correct.

Uh, as they're remodeling downstairs is going to grow and the use is going to change. upstairs is a fairly large livable area and he wishes to split it in half and make two smaller apartments up there instead of one big one. So to do two live units or two apartments, we had to change the zoning because it's not allowed in the current zoning. And that's the only reason it's being reszoned is to allow for two smaller rental apartments upstairs. Anybody has any questions? I'll be glad to try to answer them. Any questions for petitioner? Sure. A a live work unit is intended for the the person working in the commercial property on the first floor to be living above. So it's one one business, one residence. Um technically by making two now it becomes a vertical mixeduse building. Commercial on the bottom with apartments on top. So um vertical mixed use is allowed in the general commercial zoning district. Live work units are allowed in the quarter commercial. So currently is quarter commercial. This is an old house that has been encapsulated over time. Um, so this is kind of an adjustment to fit the definitions. Yeah, does seem like a general commercial fits better given that the driveway is off of an internal subdivision and not off a pervoy. So it's not really a corridor. Okay, thank you for that.

U, we were hoping that Ed could join us tonight, but he is not able to. He has moved to Florence, South Carolina to be near his grandchildren. So, we are excited for him this next chapter of his life. We will miss him. He has um served not only as a planning board member, but also as a town commissioner here for the town of Fugway Verina. But as far as the planning board, he's been with us for 10 years um from 2016 to 2021. He actually served as chairman and he's been a member since then. Um in addition, he has served on multiple stakeholders groups and been um really critical to some of our development of of a lot of the ordinances we use every day from the hazard mitigation plan. Um he participated in the census, our um big LDO um update back in 2016 where we came up with the formbbased standards. Um he was integral in that. So really appreciate the time and energy that he put and gave to the town. Um, not only serving in the planning board, but also helping us to shape that vision of of what we hope to see the town looking like in the future. So, um, we have a plaque we'll be mailing him. Um, but just wanted to publicly recognize his service.

I would say Ed definitely did his public service for sure. The city of Florence or town of Florence's planning board meetings are probably about to get longer. Watch out. You right in there. All right, we'll move on to item 6A, planning staff report. The purpose of this agenda item is to receive information on the disposition of the planning board's recommendations to the town board of commissioners since the August 18th, 2025 planning board meeting. Um, any questions? Um, I know it's been a while since August, but looks like we're still batting a thousand. So, we continue to be aligned with town board, which is always good.
