Pursuant to government code section 36512B, the city council must consider whether to appoint a member of the public to fill the vacant city council seat or fill the seat by election. Rachel?

Thank you, Mayor. Since July, we've had a vacancy on the City Council. Government Code Section 36512B establishes two courses of action for the Council. Either the Council can hold a special election. Of course, there are time constraints for a special election that would put this vacancy being filled after the actual November regular election. The remaining course of action is to appoint a member of the public to sit on this seat.

So it's whether or not we fill it technically, according to the government code, we are supposed to. But there does seem to be some question as to whether or not anyone would care if we left it open.

Yeah, I just don't see a reason for it since we're literally three months away from it being filled through the election that way and we have no contentious items that town is hanging on to vote for. In my opinion, I don't think it's worth it.

I personally would like to see it filled, and this might be getting a little ahead of my skis, but I would like to see it filled by someone that is not running so that we aren't putting one person, like giving them an edge in the election. I think it's a good taste. Someone can get a taste of what it's like and then maybe they would run in a future election.

That is true. There will be future elections.

And just also to that point, I'm against anybody else filling it because they were not elected.

I'm against anybody being appointed because they weren't elected. In my opinion, if you weren't elected, you don't get to sit up here. Because now half a town, what, two-thirds of town, if we appoint somebody, we're like, I didn't vote for that guy. Why does he get to choose? Or lady, excuse me.

Microphone. Yeah, I have pretty strong feelings about giving people advantage in the election. And originally I felt pretty strongly about not bothering about doing this. But now that we're here, taking the applications and holding this meeting to to make a decision, I guess I'll go along with the process. It's six meetings that this person will be involved with, two in September, two in October, and two in November. That's it. So I guess I will go with the process that we have started, although originally I was not interested.

I'm of two minds. I think Council Member Redmond makes a good point that there are people in the public eye that would be unhappy about it having not voted for it. However, it is California law, and as best as we can, given our resources at certain times, we certainly do try to follow the law. And I actually didn't think about your point as to... I do like the idea of having somebody not on the ballot. I mean, I think... it's fine if the most qualified person is on the ballot, then they fill a, but given the idea of not, of having people not vote for somebody and also not having the appearance of giving a certain candidate an edge and with the idea that who knows, maybe a qualified person comes out and runs in two years, I do also like that as well. And I do hope that somebody gets a taste for it and comes out to, yeah, exactly. So anybody watching out there, be real nice if someone does get appointed. Be really nice to them. But I am of a mind to appoint somebody as well. So I think at that point, I think, let's see, do we need to make a, there's no resolution.

I think everyone knows the background, but the resignation of Jeffrey Collings on July 28th, 2026 has left the city council with a vacant seat. The city has received applications from several members of the public who would be willing to fill the vacant council seat until such a time as the duly elected city council member can assume office following the November 3rd, 2026 election. These applicants include Rosalind McCoy and Wendy Warnick, who are candidates for the November 3rd, 2026 city council election, as well as Todd Anthes and... Robert Neville, thank you, their applications have been attached in alphabetical order according to first name. What are we doing here now? Questions about each one? I just have a clarifying question.

Earlier today there were some questions that Kim rose about whether some of the addresses were PO Box or whatever. Have those been cleared and is everyone within city limits that we're looking at today?

So there were two separate concerns that were raised. The first was that one of the applicants whose application had been included in the agenda packet lived outside of city limits. And that was true, that was my fault. He lived within the sphere of influence but outside of city limits and I shouldn't have accepted his application. So his application has been swapped out in the packet for a different applicant who is within city limits. One of the applicants who does live within city limits included a PO box rather than a physical address. So if that applicant is selected, the physical address will have to be provided.

And they live within city limits? That's right. Okay, thank you.

Well, I'm happy to answer any questions. I guess, like I said before, I think to make sure that we didn't have the appearance that city council is endorsing a candidate, that it would be better not to appoint a current candidate, but. Saying that, if you want to go forward with this, I can't find any legal restriction from allowing this. So I'm here.

I just have one question that I'll ask everyone, which is what do you hope to bring to the current council in the next six meetings?

What I would hope is that I could help do the research on some of the details of the projects that are coming before City Council. I am retired and so I have a lot of time that I can dedicate to do research and that's one of the things I enjoy is researching. detailed issues and looking at things if they are legal or not and being able to bring details that maybe staff don't have the time to research or other city council members and being one of the five Stepping on to city council and say, well, I'm going to put a chicken in every pot is not really where we're at, but to be a good city council member and providing all the skills that I can to help the other city council members here.

Hello. My name's Todd Anthes, and I own Shasta Inn, Strawberry Valley Inn, and Harvest Restaurant. And I'm looking to be an interim council member because I think I can bring a lot to the council as far as my experience in tourism. I was a developer since 86, brokering hotels, building hotels, and operating hotels since 84. So I know tourism. I know this market. My offices were in Redding for 25 years. I've been up here since 2013 running the hotels. I did the books for most of these hotels except Best Western. since 99. So I know the ebb and flow. I know how this market works. And I think bringing a little more experience on the tourism side to the council will be really beneficial, also on the development side with some of these projects that are upcoming. I do have opinions, and I'd like to discuss them with you and the public.

Please, go ahead. You answered my question. But if this goes well, would you be interested in running for a full term?

I think so. Yeah. Great. Yeah.

I actually did have a question. And actually, I realized I had a question for Rosalind. So maybe we'll circle back to that one if we can. But I do have a question. I'm just curious why you chose to do this but not run for council. Just given the timing of it, they are kind of close.

You know, it's real simple. I was at my office, and Rachel sent an email last day, and I replied to it. Rochelle or Rachel, I'm not sure what it is there. But anyways, I replied to that email and said, you know what, it's probably time. My son took the reins at the hotels. I have more time now. So I'm getting more involved in the community, and I'm going to share some of my knowledge and learn from you guys about your industries as well.

Sure. You mentioned we have numerous projects, things going on, ballot measures coming up this fall. May I ask where you fall with respect to certain ballot measures that we might have, which we are attempting to present a unified front for the most part?

Yeah, that is a good question. I would have to look into it a little more, honestly, before I comment on it. and put my foot in my mouth. Good answer.

Can we at least count on you to not send a letter of opposition on the official ballot?

I am not that type of person. I'm pro-growth as long as it's smart growth, and I'm anti-sprawl. Like I said, I'm from Redding, California. I watched what happened to that community. It was tight-knit. Sprawl took over, and we saw a lot of blight, and I want to avoid that here in Mount Shasta.

Thank you for the opportunity to address you tonight. I am very dedicated to work hard and become a council member in November. I'd love to be appointed in the interim. I understand the difficulty in how that looks and appreciate and honor whatever decision you make with regard to how you're going to go about the appointment. If you did decide that those of us who are running for council could be appointed, for me it would really help to get feet on the ground and start to get really involved into the details of things before the November election. I feel that I have a really rounded out skill set from a background of decades in real estate development and primarily in developing affordable housing and senior care communities and doing fundraising in the ultra thin strata of the ultra rich, which developed really great personal skills to deal with people. and also doing affordable housing. So, as you know, I ran two years ago and lost to Casey by a pretty thin margin, but I'm glad I did because he's done an excellent job and I feel I'm really grounded in the issues and how things are moving ahead and what needs to happen and I feel with the vast experience I have that I could lend my skills to towards where we all feel this beautiful town of ours needs to go in terms of smart growth, maintaining a small town feel and really fostering new businesses to bring themselves here. In addition, like augmenting what we already have here and building on the tourism that we get in both the spiritual travelers and the mountaineering community and the families and all of it. And, of course, I'm very excited about what the possibilities are with the landing and with the daylighting of Castle Creek. So big picture and small picture and short-term goals and medium goals. Which of our current issues or opportunities that we have right now do you feel you're best suited for in lending your expertise?

Good question. Well, I would say really looking into a more flushed-out concept of affordable housing to really be able to bring some things to development and fulfillment that houses our working community, that the tiny home community Endeavor is incredible, they've done a fantastic job, and it's a piece, so I think that would be really helpful, and I'd really like to look at how we might look for additional grants and things that I know everybody does an amazing job on, but sometimes new eyes bring a little bit more to what's under a rock, right? And so just offering fresh blood and energy to see what we could do to bring some funds in that would be helpful. But, you know, I'm a team player. I would really do anything that was most helpful and supportive and in the role of priorities of what needs to happen.

No, I really have looked at it carefully, and I really support the measure, so.

And you're speaking of Measure H?

I was indeed.

Well, I was very concerned that we're coming to our citizens again for more money without truly laying out how we're spending our money. But it's true, things are going up. I would really prefer to have it as a restricted account, but it's much too late to go that direction now. It's a tough one because with what our sewer bill just went up, another $3, and we're looking at raising the sewer again. It almost looks like maybe a 5% increase. So what, 2040, we're looking at $100 a month just for sewer. The 1% does kind of spread it to our tourists that come to town, but it does make it more difficult for citizens to buy things here. of what we really can buy. I mean, we don't have a lot of choices in socks and basic necessities, but maybe with the landing, and we'll know tomorrow with our town hall, what's being brought in. City council can't say, these are the businesses we want here, really, but those are lacking here. So compared to other people's sales tax, I don't think that it is over the top and burdensome. So I guess at this point I would say yes, but I'm, still i would like to have more details of how are we spending our money and do we have a priority do we have a set of things this is the most important and we're going to take care of these things first and then if we have the money we put it into advertisement and I question the 1% that's coming from the hotels going directly to Siskiyou Economic Development to do that advertisement that I think that could be better spent on tourism Our tourists that come to town and they need the trash cans, we need to accommodate the tourists that come here and I don't see that that 1% that all the hotels and I guess Airbnbs are paying is, I question how that's being spent. So, yes, I question, are we really having a clear priorities?

All right, moving on. All right. Moving on to item six on page 25. This is the general fund budget adjustment and contract approval for contract planning services. On July 13th, 2026, the planning director was appointed by the city council to be the acting city manager. A planning consultant is needed to backfill some of the planning director's workload. City manager? Acting city manager?

Thank you, Mayor, members of the city council. This should be fairly straightforward. This particular consultant was hired by the city in previous years to work on the general plan amendment and specifically the noise element and also noise ordinance. So it makes sense to bring back the same consultant to get this across the finish line. This is something that I took to the planning commission in July and it was continued then. So the intent is to have the same consultant pick up the work, bring it back to planning commission in September to get it approved so that we can then bring the noise ordinance back to city council after that.

Okay. All right. Questions? How confident are you that the amount laid out here will be the total amount required in order to get these particular elements across the finish line?

So this particular bid is a time and materials not to exceed. This particular consultant has already gone through and reviewed the tapes from the July meeting to know what the comments are. And so the scope of work in here is accurate to what happened at the last planning commission meeting. So I don't foresee the numbers changing at all. And if we're lucky, the consultant will be efficient and will not bill 100% of the not to exceed amount.

Question? Yeah, so after this, how many more elements of the general plan 2045 need to be completed? This project's been going on for 10 years apparently.

It depends on how you look at it. So a general plan has multiple chapters and multiple sections. Three years ago, there was a consultant hired to do the noise element, the safety element, and the land use element. Actually, there was another element. It was the housing element that was actually completed, I think, about a year or two ago. So the outstanding elements that were on city's radar would be noise, safety, and land use. And then down the road, we will also ultimately at some point have to tackle air quality, traffic, circulation, some of these other elements. So there's a... In a perfect world, the general plan update would be done all at once with environmental review by one consultant at one time. In reality, it's not as simple for smaller jurisdictions such as ours to do that. We can't afford to pay that bill all at once. So the direction a couple of years ago was to take this one element at a time. So that's what we're doing right now, and that's what we have the budget for.

I have a quick clarifying question. So the not to exceed guarantees that no matter what, other than circumstances beyond their control, that will be the top, the maximum amount that is

That is correct. So the not to exceed means that the consultant will complete everything with their scope to do. And if there are unforeseen things that come up, then we can bring that back and talk about it later.

Yeah. Okay. Because there wasn't any sort of a penalty for them if they went over time. It doesn't matter. It's not to exceed. Correct. They cannot go over the time. Yeah.

Okay, I've got one more for you tonight. This is a cleanup item. What happened was back in December 2025, city manager Todd Juhasz brought this item to the city council for review and approval, and the direction at the time was to approve WBC's contract to proceed, and there was a specific dollar amount of... 27947 in there. However, due to a typographical error, there was a shortage of $200 that was approved. The other issue was that there was never a contract attached to that staff report item. So there was never a contract that was executed. So we're in the middle bit of a cleanup exercise where we're gonna go backwards and get a contract approved on paper with WBC. We've already committed to doing the work with them. They've been doing the work. and this came to light when they invoiced us and I couldn't find a contract in which to approve the invoice under. So we're just going through a series of exercises now to clean up some things that are happening in City Hall. So this is simply just a request to reapprove 27947 for WBC to complete their work per the agreement that was discussed December 15th, 2025. To the chair? Yeah.

So if this is a budget like approval, does that mean that when we approved it in December, the budget didn't reflect that? That is correct.

There was not a dollar amount appropriated to this task in our 26-27 fiscal year budget. So that also is a request as part of tonight is to reallocate those dollars for this effort.

Any other questions? For those who are wondering, that consultant was working without a contract.

Plain English. And they've already been doing this work. In your opinion, Kim, how, I guess it doesn't matter, they're doing the work. I was going to ask the quality of the work being done so far.

We're not going back and not paying them.

We're not questioning the quality of work, actually. The consultant is doing a very good job. And I'm not questioning the invoice amount at all. I'm just trying to figure out what bucket to put it in.
