City-County Council - Regular Meeting

Good evening, I will now call to order the City-County Council meeting for Monday, September 14, 2026. We'll begin with a prayer and pledge of allegiance led by Madam Chair McCormick.

Hi, good evening. Tonight, I'm pleased to welcome Pastor Tim Lindsay to offer our opening prayer. Pastor Lindsay is our council chaplain, and he also serves as the senior pastor of Lifeline Baptist Church on the southwest side. But the best part about Pastor Lindsay is he is a proud resident of District 16, and so thank you, Pastor Lindsay, for coming here tonight.

Heavenly Father, what a joy it is to be here in the public assembly room tonight. What an honor to stand with them and pray for them. But even greater than that, we have the awesome privilege to boldly enter your throne room. So it's amazing that you hear us and you answer our prayers. I lift up their families. I ask you to encourage them and protect them. I pray for their staff, the volunteers, the media, and all those who work so hard to see our city succeed. I pray that you strengthen our counselors as they strive to improve lives, to support the weak, And protect the vulnerable. Help us all to love like Jesus and serve like him today. The book of Proverbs proclaims that most men will proclaim everyone his own goodness. But a faithful man who can find. Today I pray these public servants be faithful. Faithful to their calling. More importantly, may they be faithful to you. May the words of their mouth and meditation of their hearts be acceptable in thy sight. In your name we pray. Amen.

Thank you, Madam President. Counselors, tonight I'm once again moving to amend the agenda to use one of the powers that we have as a council. That power is to remove metropolitan development commissioners that report to us who have not served our constituents or the guidelines we have set out for the commission. Constituents have been growing louder and more insistent that as counselors we use every power at our disposal to help the people who pay our salaries. Tonight we have once again an opportunity to do so. As such, Madam President, I move to amend the agenda to insert proposal number 304, 2026 for consideration under special orders final adoption. Copies of the proposal have been distributed to each counselor in their agenda packets for this evening. It's the last page, and the proposal reads as follows. City council resolution number 304, 2026, a council resolution invoking Indiana code title 36, article 7, chapter 4, section 218G. Be it resolved by the City-County Council of the City of Indianapolis and of Marion County, Indiana. Section 1, Greg West, shall be removed as a Metropolitan Development Commissioner. Section 2, Brandon Herget, shall be removed as a Metropolitan Development Commissioner. Section 3, each question is to be decided by roll call vote. Section 4, per the requirements of IC 36-7-4-218G, I ask that a formal letter be mailed to each removed commissioner's residence address, indicating that they are removed effective immediately. Thank you, Madam President. As we move to the public comment portion of debate for these proposals, we would like to remind council members and the public of a few ground rules. In order for everyone to have a fair chance to speak and be heard, it is important that we each observe the following rules. First, each person will be limited to two minutes. Second, any public comments must reasonably relate to the agenda item under consideration. third speakers who stray from the item under consideration or become unduly repetitious may be asked to move on to their next point or conclude their comments finally attendees who cause disruptions that prevent the council from proceeding through today's agenda in a reasonably efficient manner will be removed please remember that some types of threatening speech or incitement to violence are not protected by the First Amendment we will deal with those issues if they come up but we don't think they will now madam president if someone will adopt these by consent we can move forward

Thank you, Madam President. Proposal 245 authorizes insurance appropriations of one or more revenue bonds, anticipated notes and maximum principles exceeding, not exceeding $35 million. The bonds proposed providing funds and refunds, refund, construction of approximately 300 car garage, and a 1,000 car garage located at the Indiana Marion County Justice Campus provides payment in such bonds legally available to the City of Indianapolis, provides the safeguards for the interests and the owners of the said bonds, and approves and authorizes the actions there have. Passed that on Committee 9-0, I so move.

As a member of this committee, my colleagues and even yourself may recall when Director Glass from the bond bank presented on this in the following proposal, there were several questions and I looked in my email and as of 7-21 did not get any feedback or follow up on those questions. I don't want to move to a postpone if someone did get that information, but I'll be a no vote if I can't get that information and don't want to delay the meeting, Madam President. Thank you. uh thank you very much uh madam president and just wanted to say i appreciate uh council cfo candace harris for answering a bunch of follow-up questions i had after reviewing the committee meeting as well not a topic for this vote but i would just encourage us to think about how we could encourage more development uh specifically for evening and weekend hours since we are now after this uh build transfer finance operate agreement um gonna be the owners of 1300 parking spaces which you know as far as i know nothing near twin air needs that parking in the evening or weekends um you know we've already committed ourselves and so i'll be voting yes on this tonight um but wherever we could get new revenue from parking um at a facility that we already own i would just encourage the city to consider that thanks thank you council brown additional comments

Yes, proposal 245. Please state your name, sir. 25, another municipal bond issue at 15%. What's happening, ladies and gentlemen, when they collect on these bonds or issue them, the money actually goes into the general fund. that way it can be directed by the chief executive it can go anywhere he wants to i would uh... just tell people that are watching at home to go over on uh... capital avenue where the old pan am plaza is there's another uh... hotel that is being built there and it has stopped work orders all over the place because they can't afford to actually uh... pay to keep the construction going i'm suggesting anyway that uh... they don't have any kind of uh... thing to show the bond bank that they can support the revenues off to support the dividends to be paid on these bonds and when they default the city's going to be in a lot of trouble so i just uh think we're being awful careless in this city when we issue revenue bonds that we can't back up we've already had to pay a hundred dollars extra on iraq on our uh... registration and so forth the nickel and diamond is the death and what they're building is what i call more for occasion mills operating on a failed model people are sick and tired of entertainment ladies and gentlemen this city is based their whole future their whole future on place and uh... Greasy spoons, booze joints, and fornication mills. That's all you see downtown, and it's failing us. We should not be issuing the credit of this city to build these places. You spent $40 million on an actual program with the public health and safety. Never accounted for. Why don't they use that? Anyway, I've been over to the Justice Center. That's where I live in that neighborhood, and there's no need for any parking spaces in that area.

Proposal 246 makes a preliminary determination to authorize the sale of general obligation bonds to the Consolidated City to provide funding for the applied costs and financing portions of the new police station on North District in Consolidated City. together related with improvements with the equipment incidental expenses connection with there within aggregated principal amounts not to exceed twelve million five hundred thousand dollars the maximum interest rate is six and a half percent passed out of committee nine zero I so move there must have been properly moving second it other comments from counselors counselor Gibson

Larry Bond, please. One after another, we are issuing bonds. I don't know whether people understand what it is when you issue bond debts, especially revenue bonds off the municipal cash that's available in the city. My question is, what are we doing with the money that we're paying actual taxes? We pay so many taxes in this city. Where's the money going? I mean, is the money being used to actually fund our public safety and so forth? Because every issue that comes through this council, and I've been watching it the whole year, nobody have come up with this uh... a proposal that is actually paid for out of the taxes that they're collecting on us always a revenue bond always on a contingency that's double dipping because when you get the money when you issue have a bond issue you enjoy that money that comes off that issue when you promise to pay the dividends they're on but what's happening now is that money with the bond issues is going into the general fund That's a setup I remember when it came through over at the Statehouse. The city of Indianapolis is the only one that conducts their business this way on bonds and future revenues that we can't even classify what they are unless we increase another taxes. This city is operating on bond day. That's very bad. Other cities have done the same thing. And when you have a look at these cities that are failing, they're all Democrat cities. All the principals are African Americans. So I don't know whether we want to take a good close look at that and see that we need to stop issuing all these bonds. I think the limit is 2% of the assessed value of property within this county. We've far exceeded that. We have over $20 billion in bonds, municipal bonds and otherwise, that we have actually incorporated into the functions of this city. What's going to happen when the bond bank says no more? Proposal 275 approves an additional appropriation totaling $19 million in the 2026 budget of the Office of Mayor, Office of Finance, Management, Parks and Recreation, Department of Metropolitan Development, Department of Public Works, Public Vendors, and the Election Board and various other city county agencies. This passed out of committee, 10-0. I so move.

Thank you, Madam President. I actually would like to propose a division of the question on this proposal. Specifically, I would like to separate out section two of the proposal, which appropriates money into character three for the mayor's office. According to testimony committee, character three funding from the OEI within the mayor's office budget. was used by Mayor Hogshead in order to fund the ILEA and IPEC, which my district considers unaccountable and undemocratic organizations, badly damaging public schools in my district. I can't vote for any fiscal bill that gives any money to character three of the mayor's office, and I'd prefer not to need to vote against all the other very worthy appropriations tonight. So thank you to my peers for considering.

larry vaughn please just like i said every proposal that's coming through tonight it's all on bond issues it's never pay pay up front or pay with the tax revenues that they're already getting a lot of cities have went down i've seen them go down detroit gary all these cities that have went down using the same principle ladies and gentlemen That they take the revenues that we give them and try to do some development, but it ends up failing and then we stuck with all the bond debt. And then when they have to collect and call for these principles, then that's when they go to the treasury and you have to have a warrant to collect that money right off the bat all at one time. It's just amazing to watch what goes on in this room, all of it at gunpoint, all of the taxes that you force us to pay at gunpoint, all of everything that you do, your votes, and everything you do in this room is very serious because it's a consequence to the people that you're supposed to represent, and you're putting them at gunpoint, taking their money, and spending it on foolishness.

assistant ml nelson thank you president lewis i apologize i missed my first go around i just wanted to highlight that money in this proposal is all money that we pass through via the spring fiscal and other cash sources so this is a cash appropriation i know we're issuing a lot of debt this evening but just wanted to clarify that and something else i wanted to point on i talked about this in committee but Part of the reason that this fiscal package is so large is because during a time when the state was suspending the gas tax, we made the tough decision not to appropriate dollars. at that time I will grateful that the state has since said they will continue to reimburse us but at that point in time we had no assurance to do that so I think it's important that the public understand that we had 10 million extra dollars that we held back strategically so in the event of the state did not reimburse us for that that all projects that are currently planned for 2026 are continue to be planned and could be executed without touching the savings account so I just want folks to be aware that that was part of what was involved in this fiscal along with the spring supplemental as well and I just think it's a good reflection of the council being responsible with the dollars that we do have thank you president Lewis thank you additional comments from councillor councillor Cahill

Thank you, Madam President. I just wanted to speak to Section 2. I certainly have been critical of continuing an APRA-era program for as long as we have, but the money in Section 2 is for Circle City readers, and while I do support and am pleased that we are either winding down or handing over to IPS, that money has been for years and will continue to go to public school children in ips and warren townships and i do support i while i support the orderly wind down and or handover i don't think it's appropriate to break it out in the middle of a school year and pull the rug out from under kids with that critical program thank you thank you additional comments from counselors counselor brown

Thank you, Madam President. Just a brief response to that. This council did not actually take any votes about spending tens of thousands of dollars of taxpayer money on Michael O'Connor's salary or any of the budget for ILEA or IPEC. We didn't need to because the mayor is authorized to re-appropriate, move money around within a character within an office and so although i have no problems with the circle city readers program and it seems like an admirable program i simply do not trust that this mayor will actually use that money the way that he says he will which is why i will be voting no thank you additional comments cnn proceed to the board for our vote

Proposal 276 proposes a resolution, Marion County Total Income Tax, to request approval of the Department of Local Income Finance to lower the levy freeze and tax rate and cast a vote for the City of Indian City County Council on such a resolution. But in any case, I'd just like to make a very important point. That I've seen with the state agencies, such as the BNB. And this concerns a very important thing, the taxes on our situation with the registration. Point of order, Madam President.

Yeah, I do have a question that I think is prudent on this subject. And it just got me thinking about if this has any, I wasn't in the committee on this, so I'm wanting to follow up with the controller. I see you're back there.

I suggest that the BMV is a state agency, and I suggest that this trap that we're getting into for the infrastructure, the state of Indiana is going to give you nothing, right? If you do collect money on this tax that you approved for registration and the state gets their hands on it they're not going to give you anything so you're going to be stuck right there so uh you're taxing people because of setups that's going on in the state house to destroy this city they're doing it right and you're helping them thank you mr vaughn counselor hart

Thank you, Madam President. So what's happening here is that we have 2.02% of our local income tax and the percentages of those are being adjusted with this. And where my question pertains is of what's being adjusted on the levy freeze, how that impacts public safety and the certified shares. If I'm reading this correctly, and I see our controllers here. So if she can correct me if I'm wrong, I'm just interested if this has had anything to do with

uh making adjustments prior to everything that happened with the wheel tax if this is still necessary or if i'm just completely reading this wrong hi good evening controller abby hansen uh if we do not take this action then money that could be spent in any other way would go to a lock box essentially a fund we can't tap into so this has nothing to do with the wheel tax this is simply to be able to spend all the dollars in the appropriate location because there are so many rules about levy freeze and how you can and cannot, well, when you can and cannot access them.

Does this adjust percentages to the certified shares portion and the public safety portions? Yes. Okay, and was the change to this prior to the gas tax being overturned? Or sorry, the wheel tax being overturned?

We have made this action for the last five years in a row, I believe. So this has just been an annual exercise that we've done to adjust our income tax rate. Because if we didn't, we would have excess levy freeze that we can't distribute to taxing units. So it just sits in this reserve fund. So by taking this action, and we are increasing both the COET rate and the public safety income tax rate, it allows us basically to use those for our budget needs instead of just holding them and waiting for the future.

Okay, that's clear. That's what I needed to hear.

Proposal 244, approves the issuance of special taxing district bonds with the metropolitan thoroughfare districts of Marion County of Indiana. aggregate principal amounts and not to exceed $15 million in a maximum interest rate of 6.5%. The purpose of the pursuing funds equips of all proportion of any Department of Public Works facility. Improvements located at 1735 West Street and approximately located city-owned property together with necessary apertures. Improvements in equipment, therefore, and other capital improvement bonds projects. The facility is owned and operated by the Department of Public Works. Passed on to Committee 9-0. I so move.
