This portion of the citizen comments are comments made other than the public hearing items we have on the agenda tonight. The purpose of this meeting is to hold all pertinent testimony of those in support of and opposition of the applications before the commission. Tonight is the first of two public hearings required to approve a change in zoning. The procedure for public hearing items will be followed tonight. The public hearing will be open and testimony will be heard in the following order. First, staff. Second, the applicant. Third, the general public, those in support of and in opposition to this request. If you're a part of a large group with a common interest, we ask that you appoint a spokesperson rather than having each individual restate the same information. When addressing the commission, please begin by stating your name. Try to limit your comments to five minutes. Excuse me. When all sides have spoken, the public hearing on the matter will be closed and no further public discussion will be entertained. After each public hearing is closed, the commission will vote on the request. Zoning requests and the planning of zoning commission's recommendations will go forward to the second public hearing, which will be conducted by the city council on June 11, 2026. We're requesting a rezone from heavy commercial to single family five zoning district for approximately .378, 37 acres of abstract two AR Johnson survey tracked 81 section six located on the Northeast corner of MLK Boulevard and Ira drive. So the applicant is requesting to rezone this property seen here on the zoning map highlighted in the green from heavy commercial zoning district to single family five zoning district here at the northeast corner of MLK and Ira Drive. The applicant is proposing the rezone request in order to build single family homes on this property. Staff finds that the proposed zoning change is consistent with surrounding uses. My name is Teresa Finley. I stay on the address at 709 Iowa Drive. I'm actually opposed to it simply because our neighborhood is a very quiet, senior friendly, veteran friendly atmosphere and we think that certain Housing types will actually bring more chaos to our neighborhood than we will actually want to experience I said if you notice on the map I said in lot by the empty field and I actually see a lot of activity that comes through there there are people that don't know that is an empty field there and We've been having a lot of activities. People that are not part of the neighborhood, mainly because of drug use on the next street over, try to access the field in order to access those areas that we are not. you know part of so we will actually like if there any if any zoning changes as far as housing conditions senior families we prefer a certain type of housing because we do not want to track a necessary unwanted company we're a fairly quiet neighborhood and we want to keep it that way okay thank you thank you appreciate it all right anybody else would like to speak in opposition to this request

The applicant is requesting to rezone this property seen here on the zoning map in the green from a planned development, which was a planned development for garden home patio homes. The applicant is requesting to rezone this property in order to subdivide it into two lots and build one additional single-family home on this lot. Staff finds the proposed zoning change is consistent with our future land use map and surrounding uses. Therefore, it does not constitute spot zoning. My name is Shirley Edwards and I am the person who sold property to Mr. Curry Shaw. Uh, my neighbors received a letter from the city of Longview requesting his re he wants to request that it be rezoned, which is fine, but we also have a concern and I just like to read to you a letter that was put together and signed by that community and the community consists of elderly people. I'm 75 going on 76. We are retired people in veterans in that neighborhood. It's a quiet cover sack area, and we're trying to make sure we keep it that way. To the City of Longview Planning and Zoning Commission, this letter is to inform the City of Longview Planning and Zoning Commission that the residents of Ira Drive and Eva Circle, located in proximity to Abstract 2A, Ira Johnson Survey Track 81, Section 6, agreed that the request to rezone property stated in this petition be granted only under specific conditions met by property owner Cory Shaw. These specific conditions are no low-income houses shall be constructed, Houses are single-family SF-5 brick homes requested. Below are signatures of residents located in the community of Ira Drive and Eva Circle that agree to these specific conditions pertaining to the application submitted for rezoning property abstract to a Ira Johnson survey Track 81, Section 6, located on the northeast corner of MLK Boulevard and Ira Drive. This petition has been signed by 12 people that live in this community. We are just concerned that we don't pick up rowdy people. It's a calm neighborhood. As a matter of fact, a police officer came out with one of the Longview workers maybe two months ago. He said he didn't even know that that community was there because they never get any calls out there. It was so quiet. So we are trying to keep it that way. If you all would consider that.

So under the current zoning, they could put in a nightclub. They could put in a bunch of stuff that I think would be more disruptive

to the local you know community and it will be sf5 which has certain restrictions that i'm sure angela can can tell you more so for single family five um you know we we cannot regulate who they rent to whether they rent to anybody um and we cannot unfortunately uh by state law we cannot regulate facades unless it's a historic structure so we cannot tell anybody whether it has to be a brick home or not but we what we can do is we regulate it is zoned it will be zoned sf5 if approved and there are minimum home sizes within the sf5 zoning district sf5 i remember off the top of my head i want to say i think it was bear with me i'm so sorry i don't have this pulled up but Oh, here we go. So SF five zoning district, the minimum home size, and this is not what he's building. I believe he's gonna be building bigger, but the code requires 800 square feet. Each lot needs to be at least 5,000 square feet. If Mr. Shaw, which I believe he is participating in what we call the SLIP program, which is the South Longview Incentive Program, I believe he's participating in that program. Through that program, these do have to be single family owner occupied homes. If he rents these homes, he will be required to pay those fees that the city has waived back to the city. And so I believe he is participating in the SLIP program with this development.

But when we purchased the property, it was in order to help someone else. We didn't need the property. So the applicant is requesting to rezone the property seen here on the preliminary plans from agricultural to single family for zoning district the applicant is wanting to build a single family subdivision When property is annexed into the city, it is automatically assigned an agricultural zoning designation. And then when somebody wants to come and develop, that necessitates a rezone request. The applicant is requesting this rezone. It is the neighborhood directly to the south is zoned single family 4. Staff finds that the proposed zoning change is consistent with our future land use map and surrounding uses. Therefore, it does not constitute spot zoning.
