One announcement tonight from our long-range planning division, there's an upcoming meeting on Thursday this week on the 30th for the Hartsville Pike study that's been ongoing. It'll be held at First Baptist Church starting at 6:00, so if you're interested in being a part of that meeting, we encourage you to attend. It'll be a kind of a workshop style meeting, so it'll be very very interactive. But if you have any comments, come to that meeting. Otherwise, you can find out more information about the meeting and the study itself on our website. We have one public hearing tonight and it's on the proposed amendment to the future land use plan of about 0.82 acres at 690 Franklin Road from residential two units per acre to residential public institutional in Ward 4. Consent agenda item number two is a request by SB Barton Village LLC for preliminary plat amendment approval for Barton Village Commercial Roads, a four-lot subdivision on about 21.87 acres at an unaddressed property on South Hartman Drive, zoned Barton Village North Specific Plan in Ward 3. Consent agenda item number three is a request by Clayton Properties Group Inc. for final plat approval for The Preserve at Bell Point Phase 2, a 127-lot conservation subdivision on about 6.6 acres at an unaddressed property on Fiona Drive, zoned RS12 PUD in Ward 6. New business item number one is a request by Horizon Development for preliminary plat approval for Bethlehem Road subdivision, a 178-lot conservation subdivision on about 111 acres at 225 and unaddressed property on Bethlehem Road. It's zoned RS20 in Ward 5. There is minor corrections that are needed. There's two outstanding items that have variance requests. For front-loaded lots, there's a required 10-ft side setback minimum to allow for parking. An alternative side setback for side-loaded units has been proposed, a 5 ft on one side that does not have the driveway. And staff recommends approval of this variance for lots with side-loaded units. And number two, 10% of the site needs to be usable open space. The trails and adjacent land to the trails shown on the plan do not meet those requirements. But staff recommends approval of this variance with the inclusion of an additional nature trail through the steep slopes on the west side of the site connecting Bethlehem Road to the two greens on that side of the site. This item was removed from the agenda last month by staff and will need to be voted on this month unless the applicant takes further action. Staff recommends approval of the plat with both variances conditioned with staff comments. I'd like to speak to this item. Mr. Chairman, Kevin Gangwer, CSDG, engineer for the project. Just here to ask for your approval, answer any questions. Do have one kind of I guess on the floor question that I would like to ask if appropriate.

Of course. So, Josh has been super helpful in helping us work out the open space on this. He suggested and recommended the pre-planning commission meeting last week, the orange line that you see on the screen there. That will access the steep slopes which are to the left of that orange line. That will be a nature trail and that will allow us to use the steep slopes as part of the usable open space. And so, thank you so much for that. Our our request that's in front of you was to ask for the blue line the blue areas which are about 11 acres. I think I've got that right. To be used as usable open space. Well, thank you to Josh for because we can use the steep slopes, we don't need all of that blue area to get to the usable open space that we have. So, we only need a portion of it. And so, what we're showing is a trail system that runs through there to get access to those meadows. There's a lot of open space available to be used, played in, you know, hunted, you know, kind of explored, I guess in there. So, we provided a trail system to be able to access and get through there. Our request on the floor today is as we're doing the nature trail on the orange side, could some of these trails be nature trails instead of paved trails? Because we we initially were asking can we use all the blue space for open space, but because we don't need all the blue space per se, but we do want to be able to access that with trails for the residents who live in this area. But could they be some of those be nature trails instead of paved trails? Is that is the question on the floor. Who's commenting on it? And this is new to Josh, by the way, so.

I mean, if you they're requesting a variance, so if you want to include in your variance that they can be unpaved, that's fine. On the plans right now, I believe it calls it out as a 5-ft sidewalk typical. So, we assumed that meant it was a paved trail. We have not reviewed it as a nature trail. I know some of that longest stream I don't know if it gets into the buffers where the trail shown or not, so that might depend on whether it can be paved or not. Instruction documents, if you just want want staff to handle this and then use our judgment, that's fine. And we can work it out with the applicant just to see, you know, some of it may be paved, some of it may be not just depending on where where it is. But if you want to make some of it be able to be nature trail, that that's fine if if you just want us to work that out. But when we vote on that variance, it needs to specify that we will delegate this to staff.

I mean, I like that idea. I guess the only question that I would have at some point is just about maintenance that you all work that out with staff cuz at some point over time that could be an issue, so. New business item number two is a request by Joe Adams for preliminary site approval site plan approval for Dutch Bros, a non-residential development on about 0.78 acres at 506 South Cumberland Street. It's owned interchange commercial in ward three. There's two outstanding comments with variances. Number one, a minimum of 20% transparency is needed on all facades facing a public street.

On the side facing 231, they have a covered pavilion or covered patio area for their patrons to use and and come up to my place their orders. So, we think this covers the that need instead of providing windows, it's just an open space. So, we think that is acceptable alternative. So, staff recommends approval of this variance with the inclusion of that covered outdoor patio space. And number two, a primary pedestrian entrance is needed facing a street. They do not have one shown, but similar to variance one, this outdoor patio space is where patrons will be interacting with the business anyway. So, we think having that facing the street meets that intent. So, staff recommends approval of that variance with the inclusion of the covered outdoor patio area. Staff recommends approval of the site plan with both variances conditioned on those staff comments. May I speak? If not, we'll bring it to the planning commission. Mr. Chairman, I'll make a motion to approve with both variances being approved with the staff recommendations. Second. New business items number five and six are request by Deborah Bow for future land use plan amendment approval for residential two units per acre to residential public institutional and rezoning approval for about 0.82 acres at 690 Franklin Road from RD9 to Bow Aviation Youth Education Center text specific plan in ward four. This is a request to rezone the subject

property from RD9 duplex residential 9,000 square foot to text specific plan for an Aviation Youth Education Center. The reference zoning district is being called out as RPI. A future land use plan amendment has been requested to support this request. This request is to replicate the use of the Aviation Hall of Fame and Museum across the street with one additional use and that use is overnight room and board for aviation camps. The existing house will remain and serve this purpose. Staff recommends approval as the desired use of the property along with the affiliated Aviation Hall of Fame and Museum provides a unique educational experience for this community. So, question.
