Heavenly Father, thank you for this day. Thank you for uh this new year and a great 2025. We ask that you be with us and staff and the residents here in Winterh Haven. We ask these things in your name. Amen. I aliance to the flag of the United States of America and to the republic for which it stands. One nation under God, indivisible, with liberty and justice for all. Has everybody had a chance to review the previous minutes? If so, we'll entertain a motion. I'll make a motion to approve the meeting minutes from December. Second.

All oppose, same sign. Okay. [snorts] All right. I'll move into a brief explanation how the hearing will go. Cases will be read into the record. City staff will provide a presentation. Uh and then commissioners will have an opportunity to ask questions of staff. Once those questions have been asked, we will close the planning portion of the hearing and open the public portion of the hearing. Anyone wishing to speak for or against a case, starting with the applicant may do so. And we ask that you limit your comments to five minutes. Once everyone has had an opportunity to speak, we will close the public portion of the hearing and reopen the planning portion of the hearing where we can ask additional questions or entertain a uh motion. Um, anyone from the public that thinks they may speak for or against a case, if you would please stand and Jordan will swear you in.

All right, new business. Uh, case number P-26-05, request by Timothy F. Campbell to reszone a portion of a parcel from plan unit development PD zoning district to commercial highway C3 and conservation CN zoning district. General location, the southern portion of a parcel generally located at the southwest corner of the intersection of Cypress Gardens Boulevard and US Highway 27. The area covered by this request is 26.64 plus or minus acres. All right, Heather Reutder, senior planner for the record. Uh before you on the screen is the future land use map. The subject property there is in the hatched. It does have two designations of regional mixeduse hub as well as conservation for the Peace Creek. Um the Carlton Arms apartment complex is to the west um which has neighborhood suburban but the rest in the area is regional mixeduse hub. As you look at the zoning again, it is um a part of a plan unit development um located there on US 27. This is the aerial map and I have also hatched over the the pro proposed zoning map. So you can see where the two different designations would be located. The upland area would be C3 and obviously the Peace Creek Canal area would be conservation. This is a view looking at the subject property. Uh this is over to the east across 27 uh to the south and I guess I missed the north. Sorry about that. All right. Timothy Campbell is the petitioner and he requests the city reszone a portion of a parcel from plan unit development PD zoning district to commercial highway C3 and conservation CN zoning districts. The property subject to this request is the southern portion of a parcel generally located at the southwest corner of the intersection of Cypress Garns Boulevard and US Highway 27. The undeveloped property contains approximately 26.64 plus or minus acres and consists of uplands about 20.43
acres and the Peace Creek about 6.21 acres. The 2035 future land use map designates the upland area of the subject parcel as regional mixeduse hub and designates conservation along the Peace Creek Canal. Current PUD ordinance 0223 permits up to 313 multifamily residential units on the subject property. The northern portion of the paral was subject to a PUD amendment in July of 2025 and is now subject to PUD ordinance 02519 which generally follows the C3 zoning district for both uses and development intensities. Through discussion with staff, the petitioner has indicated an automotive dealership and accessory service department intends to relocate to this property. At this time, the petitioner has not identified any other C3 zoning permitted uses for site development. Staff's review and of this leads to the following conclusion. The removal of the plan unit development zoning, which allows for multifamily residential to C3 and CN zoning designations is compatible with the property's location along an arterial highway corridor. The proposed changes are consistent with the development pattern in the area and of that contemplated by the regional mixeduse hub future land use designation. Therefore, staff does recommend that the planning commission recommend approval of this request and its forwarding to the city commission for final action. I stand for any questions as you may have.

For purposes of your record, my name is Tim Campbell with Clark Campbell Lancaster Workman and Air 500 South Florida Avenue in Lakeland. Uh here representing the applicant and I'll just give you a brief description and and am glad to answer any questions you have. So, I've been involved in this project. The the portion north of this, which we've been before you before, and we did get the PUB modification in mid middle of last year. Um, that was under contract for a period of time. Uh, it it is not presently under contract, but fortunately, those uh the the tenants who were lining up to go on that site remain interested and so the property owner is dealing with that. Um, but that is that's entitled appropriately. So hopefully that moves forward without further u modification of the approval for this southern portion. Um and there's a just just below the the northern end is um there you can see a curb cut on US 27. There's actually the property owners worked with the engineers and the Florida Department of Transportation for the allowance of a signal at that location um when when they meet warrants and then they can install it. That's important because the access to the north on Cypress Gardens Boulevard is very restricted because of its proximity to the intersection with Highway 27 and uh that lens lends for a southern entrance to this overall property. The access will be interconnected. Um but for this parcel, there's an automo build dealership looking to locate on the southern end of this and then they they're talking to several different um
commercial retail out parcels or users for the out parcels. Um and so that's the present use. As you are well aware and and I've been involved in many of them, there's a kind of a a glut of new multifamily residential units in Winter Haven. And so there's really not the the need that there was for additional units and this commercial retail use will actually generate less impacts especially traffic uh in this area. Uh just a couple wrap things wrap up from late last year. Um we had several items on our December agenda. Um each of those is moving forward to the city commission for final action this month. Um those included the uh small amendment to the Lake Ashton PUD, the update to the city's 5-year capital improvement schedule, the new platting process, and the language we require to adopt for certified recovery residences. Uh so again, those will wrap up later this month. The last thing is I want to remind you is um February is our election annual election of officers month.
