1:40 – 8:57Speaker 18

good morning good morning thank you so much thank you all for having me again it's an honor to be here with you this morning so let me get started with these few moments that i have and so uh again thank you uh good morning to our commissioners leaders and all of those who serve the people of dekalb county today i simply came to encourage you with this thought good work gets heavy I said good work, it gets heavy. Galatians 6 and 9 says, and let us not be weary in well doing for in due season we shall reap if we faint not. Leadership is rewarding but leadership is also weighty. It can get heavy. Serving people is meaningful, but serving people can also become exhausting. Carrying vision, responsibility, and the concerns of an entire community is not light work. And sometimes the hardest work is not starting the work, it's continuing the work. I say it is continuing the work. That's why Galatians 6 and 9 is so important. Paul says, let us not be weary in well-doing. That tells us something very powerful. Even good people doing good work can become weary. You can love what you do and still get tired. You can be called to serve and still feel pressure. you can deeply, you can care deeply and still feel overwhelmed. How many of you are feeling overwhelmed right now? Yeah, I feel overwhelmed. But scripture reminds us not to faint, not to quit, not to lose heart. And I'm a preacher, so I like preaching with points. Is that all right with y'all this morning? Okay, number one, the pressure of purpose. Good work comes with pressure because purpose always carry responsibilities. God promises pressure. John 16 and 33 says it this way, these things have I spoken unto you. that in me you may have peace he wants us to have peace he told us in one of his words peace i give unto you and peace i leave unto you and that peace is a peace that always stay he said these things have i spoken unto you that you may have peace but in the world You shall have tribulation. That word shall is a promise. You shall have tribulation, which is in the original text is thalipsis. Can somebody say thalipsis? Thalipsis. Now you have some Greek under your belt. Thalipsis, which means pressure. You will have pressure. Can you say pressure? Pressure. The greater the assignment, the heavier the weight. Every decision we make affects family, community, businesses, seniors, students, and future generations. Pressure is often the evidence that what you carry matters. I said what you carry, it matters. If nobody cares, there would be no pressure. If the work had no value, there would be no weight. But because your work matters, it gets heavy. I said it gets heavy. And I want to encourage you today, do not allow the pressure of purpose to make you abandon your assignment. And then secondly, the power of persistence. There is power in continuing. I know you get tired. I know you want to throw in the towel and then there are days you want to bless somebody out till you're out of breath. You do. The real strength of leadership is not just how you start, it's how you continue. Showing up again matters. Serving again, it matters. Trying matters. Believing again, it matters. Persistent is power because somebody is depending on your consistency. Many people will never fully know the meaning or knowing meetings that you attend, the sacrifices, the stress, or the emotional weight that leaders require. But your willingness to keep moving creates stability and hope for others. And sometimes the greatest victory is simply is refusing to stop because winners never quit. but quitters never win thirdly the promise of the harvest galatians gives us this promise promise in due season you shall reap if you faint not the meaning uh the that means your labor is not in vain every seed of compassion every act of service every difficult conversation every sacrifice Every effort to improve this county, it all matters. Some harvests are immediate, others take time. But faithful work always produce fruitful fruit eventually. you may not see every result today but your labor is helping shape your strongest future for tomorrow and so commissioners thank you for carrying in the weight of this county thank you for continuing to serve with the work when the work is difficult. Thank you for continuing to show up, that's just half the battle, when the work gets heavy. And may you always remember this, good work gets heavy, but heavy work still produce harvest. I want to say it one more time. Good work gets heavy, but heavy work still produce harvest. Because again, in due season you shall reap if you faint not. Can we pray? Lord, I thank you for an incredible day that is so full of purpose, promise, and possibility. Bless your people and help us all to continue the good work. And when we get weak, we understand that you are strong. Help us all to endure this journey as good soldiers in Jesus' name. God bless you all.

9:03 – 9:15Speaker 11

Thank you, Pastor Hall. If you'll stick around after presentations, I'd love to give you a pin. Thank you. Next, we will have the Pledge of Allegiance led by Commissioner Ted Terry, and then we'll go down for presentations.

9:19 – 9:31Speaker 31

Pledge allegiance to the flag of the United States of America and to the Republic for which it stands, one nation under God, indivisible, with liberty and justice for all.

good morning colleagues planning staff community leaders preservation advocates and members of the public my name is michelle long spears i serve as a district 2 commissioner here in dekalb county today we pause to recognize something deeply important to the identity of dekalb county the places stories and neighborhoods that connect us to our history and help us shape our future DeKalb is home to a rich collection of historic communities that reflect the cultural, architectural, and civic legacy of generations past. From the historic downtown districts of Decatur, Lithonia, and Tucker, to beloved neighborhoods such as Druid Hills, Stone Mountain, Brookhaven, and Avondale Estates. These places tell the story of who we are as a community. They preserve the character, craftsmanship, and traditions that make DeKalb County incredibly unique in our region. Historic preservation is about more than protecting just old buildings. It's about honoring our shared heritage, strengthening neighborhoods, supporting economic development, encouraging heritage tourism, and creating vibrant communities. generations can experience and appreciate the history that surrounds them every single day. For nearly three decades, the DeKalb County Historic Preservation Commission, referred to as HPC, has worked to safeguard these important cultural assets. And I will say on a personal note, in my district, District 2, the Druid Hills neighborhood is a historic community, and we continue to strive to maintain that cultural richness in that community. Historic Preservation Month gives us an opportunity to celebrate the people, organizations, and neighborhoods that continue the important work, and to recognize that preserving our history is truly an investment in our future. At this time, it is my honor to present the proclamation declaring May 2026 as Historic Preservation Month in DeKalb. Now, if our planning staff, any members of the Druid Hills Civic Association, or anyone else who would like to come forward, please do as the clerk reads the proclamation into the record.

12:31 – 14:35Speaker 10

Whereas the National Trust for Historic Preservation established Historic Preservation Month in 1973 to celebrate the nation's historic places. promote heritage, tourism, and highlight the cultural, educational, social, and economic benefits of preserving our shared history. 16:58 – 19:29Speaker 11

it is my distinct honor as your district 4 commissioner and presiding officer to introduce a proclamation that truly hits close to home for all of us here in dekalb county we often hear the phrase health is wealth and today we are reminded just how true those words are a healthy community is a thriving community when our residents have the opportunity to live active, balanced, and healthy lives, our families become stronger, our neighborhoods become safer, and our county becomes more resilient for generations to come. That is why DeKalb County government remains deeply committed to ensuring that every single resident, regardless of age, background, ability, or zip code has access to safe, accessible, and convenient places to walk, run, bike, exercise, and simply enjoy the outdoors. From our parks and recreation centers to our sidewalks, trails, and green spaces, we understand that creating opportunities for movement is not just about fitness, it is about equity, quality of life, and public health. We also recognize that too many communities continue to face significant health disparities and barriers to wellness. That is why partnerships and initiatives like DeKalb Public Health's LEAD initiative are so important. Through education, outreach, and community engagement, this work is helping to break down barriers, encourage healthier lifestyles, and empower residents to take charge of their well-being. These efforts are building not only healthier individuals, but a healthier and more connected DeKalb County. Today's proclamation is more than just words on paper, it is a call to action. It is a reminder that small steps, literally and figuratively, can lead to transformational change. Whether it is taking a walk with your family, joining a fitness class, using one of our beautiful trails, participating in a community wellness event, or simply making time for movement each day, every effort matters. With the support of Madam CEO and DeKalb County Board of Commissioners, we are proud to officially designate today as Active People Health DeKalb Month. As we move forward together, let us continue investing in the health of our residents, supporting one another, and creating a culture where wellness is accessible to all. So today, I encourage everyone, lace up your sneakers, visit our parks and trails, support local wellness initiatives, and make your health a priority, not just this month, but every day. Together we can build a stronger, healthier, and more vibrant DeKalb County. And if Dr. Spivey is here, if she'd come forward, and Madam Clerk, if you'll read in the proclamation.

19:30 – 22:38Speaker 10

Whereas DeKalb County government recognizes the importance of providing access to safe and convenient places to be physically active for people regardless of age, race, income, socioeconomic status, disability, and geographic location. And whereas approximately one in five children and two in five adults in the United States have obesity, and one in two adults lives with a chronic disease. And whereas the physical activity guidelines for Americans recommend that children ages six to 17 years engage in at least 60 minutes of moderate to vigorous intensity physical activity each day. and adults ages 18 years and older engage in at least 150 minutes of moderate intensity activity each week. And whereas only half of adults and one quarter of youth receive the recommended amount of aerobic physical activity needed to reduce the risk of chronic disease. And whereas physically active individuals generally live longer and are at a lower risk of serious health conditions, such as obesity, heart disease, type 2 diabetes, and certain cancers. And for people living with chronic disease, physical activity can help manage these conditions and their complications. And whereas the Centers of Disease Control and Prevention is leading Active People, Healthy Nation, a national initiative to help 27 million Americans become more physically active by 2027. And whereas individual effort alone is insufficient to improve opportunities for physical activity and significant policy systems and environmental changes are needed to support and sustain healthier choices for all residents. And whereas the cab public health through its local efforts towards addressing disparities in the cab initiative is expanding physical activity opportunities for African Americans and Latin residents with support from the CDC's racial and ethnic approaches to community health reach program. And whereas sidewalks trails, bicycle lanes, parks and public transit routes to everyday destinations provide safe and convenient opportunities for physical activity and healthy living for all residents. Now, therefore, be it proclaimed that we, Presiding Officer Commissioner Shakira Johnson and the Governing Authority, celebrate May as the Active People, Healthy DeKalb Month and affirm our commitment to encouraging all who live, work, and play in DeKalb County to prioritize physical activity through exercise, sports, recreation, and to healthier lifestyles for individuals, stronger families, and a more vibrant community. proclaimed this 28th day of May, 2026. Okay.

22:39Speaker 11

And at this time we will have someone from the health department come up and speak.

22:47 – 24:09Speaker 19

Good morning. I'm Stephanie Carter. I'm the director for community health at DeKalb public health. At DeKalb Public Health, we recognize that health disparities continue to impact many of our communities. Too many residents still face barriers to safe and convenient opportunities for physical activity. What we know is concerning, one in five children and two in five adults are still living with obesity. One in two adults is also living with chronic diseases and too few adults and youth are not meeting recommended activity levels. The numbers are unacceptable, and we are taking action. Through our Lead to Cab initiative, supported by CDC Reach, we are expanding physical activity opportunities across the county, particularly in African American and Latinx communities. Our efforts continue to support the Active People, Healthy Nation initiative, a nationwide movement. TODAY, WE ARE PROUD TO RECOGNIZE MAY AS ACTIVE PEOPLE, HEALTHY DECAT MONTH, AND LAUNCH OUR WALK IT OUT, WOW, WALK IT OUT ON WEDNESDAY PROGRAM. OUR GOAL IS TO HAVE 5,000 RESIDENTS WALK 10,000 STEPS EVERY WEDNESDAY. NO EXCUSES, NO BARRIERS, NO EXCEPTIONS. ANY PACE, ANY PLACE, JUST WALK. WE WANT TO THANK THE COMMISSION FOR SUPPORTING OUR EFFORTS. THANK YOU.

24:15 – 27:18Speaker 11

picture real quick. Pastor Hall, if you come up, I'd love to give you a pin. Thank you, everybody. We will continue with the agenda. Excuse me. Next up, we have comments from the public. Madam Clerk.

27:19 – 29:10Speaker 10

The purpose of public comment is to allow the public to voice county-related requests, concerns, or opinions during the Commission meeting. Speakers will only have the opportunity for one public comment per meeting. Each speaker must please complete a speaker card and present it to the clerk before the beginning of the public comment portion of the meeting. Cards turned into the clerk from the time the general meeting is convened, generally 9 a.m., and by the beginning of public comment portion generally following presentations on the agenda. The clerk will accept cards on a first-come, first-served basis. Prior to the clerk's call for public comment, speakers who are residents of DeKalb County shall be allowed to speak before residents of other counties are allowed to speak. Speakers will be allowed to speak for three minutes each and public comments shall not exceed 30 minutes in length. When the buzzer sounds to indicate that time has run out, the speaker will be expected to immediately see speaking and to yield the podium. Those who submitted speaker cards but did not speak because of the time allotment will be allowed to speak first at the next regularly scheduled commission meeting without regard to residents. Speakers should always talk directly into the microphone and begin by stating their name, full address, and the name of any organization they represent. Abusive, profane, or derogatory language, holding up signs, clapping, yelling, standing, or laying in the aisles to show support for or opposition to a speaker will not be permitted. But a show of hands or quietly standing in place will be permitted to show support for or opposition to a speaker's position.

29:13Speaker 11

All right. Who is our first speaker, ma'am?

29:15 – 29:42Speaker 10

We have some people that did not speak at our last meeting and I'd like to call those names at this time. Joan Monroe. Ms. Monroe. Okay. Heidi Lopez. Ms. Lopez. Hannah Davis.

29:43Speaker 11

Hannah Davis.

29:48 – 29:59Speaker 10

Jordan Moses. Jordan Moses. Emily Diffenderfer.

29:59Speaker 11

There she is. Good morning, ma'am.

30:10 – 30:33Speaker 7

Good morning. My name is Emily Diffenderfer. I'm from District 7, and I'm representing myself. that one of the commissioner's jobs is to regulate land use, to relate reasonably to the public health, safety, morality, and general welfare of the county and its citizens. So I'm here a couple weeks later to talk about AI data centers again.

30:34Speaker 8

We've seen painted wells,

30:37 – 33:13Speaker 7

water and eminent domain seizures in Fayette County and a General Assembly that doesn't mind sanctioning the theft of our shared utilities while forcing residents and small businesses to foot the bill. What else have we learned lately? Countless corporations carry a tax burden that's lower than the average American citizen. Some 10% of Fortune 500 pays zero in federal taxes. Can we actually bet on a corporation to pay their fair share here in Georgia? The Georgia Department of Audits reported that we gave tax exemptions to data centers in 2024 that forfeited $472 million in tax revenue. And the labor and economic boon that they said we would get, they delivered less than half of what they promised, 60% lower than targets. Hesitate to guess how a data center would affect Georgians property values and ultimately your tax base But ask yourself if you toured an otherwise great home that was cited as your setback guidelines Indicate just one and a half football fields away from a loud hot windowless box would you buy that home at fair market value and what's 40% of that and So what can we do to improve this ordinance so that it reasonably relates to residents' welfare? First, the amendment provides definitions and requirements for large and hyperscale data centers, but why? DeKalb residents deserve a county commission that says no to any data center. At minimum, this board should support citizens' health and welfare by prohibiting any data center that's larger than 20,000 square feet or that requires a substation. Second, it must clearly identify these things, safe benchmarks for soil and water testing, resource caps for energy and water consumption month over month, TESTING REQUIREMENTS AND SCHEDULES, AND MOST IMPORTANT, LANGUAGE ABOUT FINES, PENALTIES, AND OTHER PUNISHMENTS FOR WHEN THOSE THINGS ARE IGNORED. AND FINALLY, WE CAN ADDRESS LICENSING AND TAXATION WITH THIS BODY IS MY UNDERSTANDING. Companies must earn tax exemptions and abatements, and they can prove their partnership by adhering to those new requirements that we'll draw up. TLDR, we have to revisit this amendment. We cannot give away land, resources, and revenue that would otherwise positively support our communities for our health, safety, morality, and general welfare. Thank you.

33:13Speaker 11

Thank you. Next speaker. Steven Benny. Mr. Benny, good morning.

33:28 – 36:34Speaker 13

Good morning, Commissioners. There will be a District 3 runoff election on June 16th, and I encourage all District 3 voters to please vote. The battle will be between Nicole Messiah and Kiana Moore, but the war is between Commissioner Messiah and Commissioner Terry. I normally stay out of races, not in my district, but this one involves my favorite con man in races, Ryan Millsap, and my favorite unopened park, Entrenchment Creek. Millsap sent a draft, MOU, memorandum of understanding to Nicole in August 2025 seeking approval for a data center. The proposed agreement promised $2.5 million in PERC funding, conditioned on the starting of construction of a two-story data center. This is $1 million more than he promised to pay after the original land swap was made in 2021. but to this date has not paid to the county. After he sells the land to the data center developer, what will stop him from doing so again? That's why he is inserting, or he is insisting on a written contract. Apparently he made some oral agreements during the first land swap that were not in the written agreement and they are giving him problems. A good con man will not make the same mistake twice. the agreement also called on the county to provide unconditional zoning approval and reaffirm a zoning certification letter from february 2024 which is well before the work on data center zoning regulations began so the data center deal could be grandfathered in The cherry on top was that DeKalb County would drop any litigation related to the land swap and that DeKalb County shall release Blackhall from all obligations related to the real estate exchange agreement dated January 29th, 2021. All we have from you, Ms. Messiah, is a non-denial denial, but the document does exist. Your first and only response should have been hell no, and then have sent the MOU directly to the CEO, the COO, and the county lawyers. Apparently you did not, as a few months later the CEO sent an email to you stating that she had become aware you were engaging in conversation with Blackhall Studios and our Millsap and his attorneys. sought to understand the nature of your conversations and express my concerns. Note the S implying more than one conversation. She reminded you that as a commissioner, you don't have the authority to engage in conversations that would bind to Cab County. As a lawyer, you should also know that direct contact with an individual or his agents with whom the law department is actively engaging to buy back the land. that was conveyed during the land exchange is problematic on its face. You truly are the queen of data centers, but remember, although you try to blame others, remember in the words of Glenn Frey, we are all just prisoners here of our own device. Thank you very much.

36:34 – 36:48Speaker 11

Takiyah Tinsley. Yes, and can we double check on that buzzer, because the buzzer didn't sound. Thank you. Ms. Tinsley. Okay, I don't see them. Go ahead, ma'am. Okay.

36:54Speaker 10

Continue. Austin Carl.

37:15Speaker 10

These are all of our citizens from last meeting.

37:21Speaker 10

Our first citizen tonight today is Roslyn McIntyre. Good morning, Ms. McIntyre.

37:28 – 40:09Speaker 12

Good morning, and I'm representing myself. Commissioners, I would like to emphasize your constituents' frustrations with the initial and subsequent iterations of the data center text amendments. There are no clear, enforceable, and defensible compliance standards, which is a missed opportunity to protect DeKalb communities. We would like the planning and sustainability staff to turn a vague policy into a regulation with genuine bite, one with legally binding mechanisms with enforceable objective parameters to be written directly into the amendment's text, covering development, operation, complaint resolution, and noncompliance. instead of drafting a permissive document designed to green light as it is alluded to in a previously agreed specific project as reported in a recent Decatur-ish article. Examples of specific mechanisms written directly into zoning text include dedicated compliance points of contact for 24-7-365 access, escalation and law protocols submitted quarterly, performance bonds insured to mitigate operator defaults, revocation of penalties, certificate of occupancy held or revoked, Approving this amendment without clear enforceable compliance standards is an irreversible abdication of local control and an abdication of your responsibility to protect the health, safety, and financial security of DeKalb County. Once these rights are vested to the developer, it will legally be impossible to retroactively implement the safeguards our communities require. The only way to lessen the impact of any data center development is to limit the size to small or medium, location not near centered people communities, and extend the distance between data centers to prevent clustering one mile. And also, we need to have a data center moratorium until the full requirements of the consent decree have been met. Pushing a completion date out to 2037 is a glaring red flag that the leadership in DeKalb County and utility providers are fully aware that the current infrastructure cannot support this development. And yet, you consider adding to an already compromised foundation. And to the Planning and Sustainability Department, this current text amendment is very similar to those in areas that are now being sued for community relief. Thank you for completely ignoring the clearly aired precedent set by jurisdictions. Your refusal to learn from their documented failures is truly remarkable.

40:10Speaker 11

Thank you. Next speaker. Gina Mangum. Good morning.

40:15 – 43:18Speaker 24

Good morning. Gina Mangum. I live in Districts 5 and 7 in unincorporated DeKalb. Commissioners, who do you serve? The developers or your constituents? Isn't that really what this all boils down to? We acknowledge the need for a data center text amendment so developers can't just build them by right. But the ordinance does not have to include all types of data centers. We don't want large-scale, hyperscale data centers or campuses in DeKalb. Yet no matter which way you slice it, the text amendment looks more and more like an ordinance to benefit developers, not to cab citizens. As currently written, the data center categories in the current text amendment are misleading. Major, medium, minor, they're meaningless when considered in context. There's no real distinction between major and campus because they're both large scale or hyperscale, which we oppose. Furthermore, a developer could effectively build a data center campus by clustering any number of minor, medium, or major data centers together. We need to use terminology that accurately describes the size, scope, and nature of each development. The DeKalb Citizens Coalition proposal would allow only small-scale data centers and industrial zones. Our proposal meets the reasonable data processing needs for everyday commerce, rather than feeding the speculative desires of big tech companies to compete in AI development at our expense. At the same time, our proposal significantly limits the negative impact on our water, power, environment, health, property values, and overall quality of life. So we have to ask you, is the text amendment really being written to allow development of the proposed shadow box and black hole data centers? Last week, it was revealed that District 3 Commissioner Nicole Messiah has already been negotiating with Ryan Millsap. It begs the question, are there other discussions taking place that are actually driving this process? What would motivate ShadowBox Chief Development Officer Jeff Weber to confidently pronounce the coming of the ShadowBox Data Center? Last year, Commissioner Long-Spears wisely asked, what good is the ordinance without compliance? So where's the compliance plan? Do we really expect Donald Trump's EPA, gutted EPA, to help us when they're already imposing millions of dollars in penalties and fines on our continued failure to fix our water system under the consent decree? And the state EPD lacks the resources. You see that. by what's happened in Dalton and Conyers with the Biolab fire. The overwhelming majority of DeKalb residents would prefer no data centers at all. But if we have to have data centers, they should be small and away from neighborhoods. 500 feet is not enough.

43:18Speaker 11

Thank you, ma'am.

43:20Speaker 24

Jan Dunaway.

43:21Speaker 11

And accept our proposal. Thank you, ma'am. Your time has expired. Ms. Dunaway.

43:25Speaker 24

I understand. I just wanted to finish my sentence.

43:31Speaker 11

Good morning.

43:32 – 46:33Speaker 29

Good morning. Jan Dunaway, District 4, DeKalb County Soil and Water Conservation District Supervisor. Let me be clear. We need a data center text amendment, but the current version, which hadn't been updated since January 22nd of 26, will not offer the citizens enough protection. DeKalb County is under a consent order with EPA, EPD, and DOJ since 2011 due to our broken water, sewer, and stormwater systems that are polluting our soil, streams, and the South River. Should something happen to the Scott Candler Water Treatment Plant, our only source of drinking water, like what happened in the city of Atlanta last week, DeKalb citizens only have three hours of drinking water as backup. The city of Atlanta has 30 days. Can we afford to give our drinking water to the multiple data centers proposed in South Cab? We are concerned not only about the drinking water, but also about the disposal of chemically infused cooling water. Even closed loop systems have to be purged on a regular basis. Can our broken water and sewer system handle that amount of poison water? Will it overflow into our yards and streams? These chemicals cannot be removed by our water treatment plant before being discharged into the South River. A year ago, water was an issue for the development department, and then like magic, It's no longer a concern. Why? We understand there is a water plan, so make it available to the public. Better yet, extend the moratorium until we meet all aspects of the consent order. Georgia is experiencing the worst drought in 20 years. Our recent rainfall will not wipe out the drought. Data centers want to be considered critical infrastructure, putting them before the citizens. You have increased our water and sewer rates by 10% year over year for 10 years, causing many not to be able to afford water, something we all must have to survive. Now you want to do the same thing to our stormwater utility fee. When will the citizens receive a report on the progress? There is no compliance plan in the text amendment that protects water, soil, and streams, and the citizens What is included is vague at best. Who will ensure compliance? We cannot depend on our federal agencies with the administration that is pro data centers. A new concern, dark fiber inline amplifiers that boost the fiber optic signal to get it quickly to these data centers and better connect them. They have the same setup on a smaller scale, short of water. with many of the same negative impacts on our citizens. Developers are looking for cheap land than locating in poorer black and brown communities. You are in charge of protecting the citizens of DeKalb.

46:34Speaker 11

Thank you, ma'am. Tatiana Pematel. Good morning.

46:46 – 48:19Speaker 32

Good morning. Well, I come in to talk about Whitehall Forest and all the problems we have in there. I think everybody knows already, but I'm begging here to somebody do something. We have a fraudulent HOA in place. Is no voting, is no books, is no meetings. The water bill is $5.1 million. Sanitation is 24,000 behind. No lights in public areas at night. burst pipes, waste water, illegal dump, rooming house, invasion of homeless, drug dealers. We need help. On top of all, the fraudulent HOA want foreclosure, my property, because I complained, because I called enforcement. then I don't know, I'm not a politician, but you guys have the power to do something. Then please do. Well, Mr., do you want to say anything?

48:20Speaker 11

And can we get your address, ma'am?

48:23Speaker 32

1909 Whitehall Forest. Thank you. You're welcome. Thank you for listening, and please do something.

48:31Speaker 11

Yes, someone will be in touch. Thank you.

48:34Speaker 32

Thank you. Beverly Dabney.

48:40 – 51:35Speaker 9

Good morning, Ms. Dabney. Good morning. Beverly Dabney, Dunn Drive, Decatur, Georgia. I come here today to share thoughts. Last week, I was reading Decatur in which Ted Terry had shared meeting notes from their executive committee. I grew up in all of the boards that I served on. When you have an executive committee, that that is among yourself. We have a lot of issues going on in your district as well as others. We wouldn't be here today having to talk about the data center if the land that had been identified that you had shared some dollars so that that land could be acquired by the community. Economic development is a key issue in District 3 as well as your district. Right now, what happens over and over again, in a lot of our districts, we're not have access to the economic development that goes on in other areas. We spend too much time going back and forth on such issues as opposed to working together if you cover not only District 3, but as well as District 7. We have never had the opportunity of a small business forum. Where people could be invited in and developers shown what could be possible in DeKalb County. The first thing before I had an opportunity, I guess, to meet who you had identified to run in District 3. The first thing that was shared with me was that we did not need a CEO. We definitely need a CEO because the CEO is identifying opportunities for us throughout DeKalb County. District three. needs help from not only you, but everyone. We must work together as a team and not identify the weakness in this area, but identify some strengths as well. Continue to work with us to identify land before outside investors identify this land and see what can be done with the land. I have lived in the county in this area for over 40-some years. We don't need to air our dirty laundry, or if we're going to air our dirty laundry, let's have an opportunity for everyone to have an opportunity to say what is true and what is not true. Thank you very much.

51:36Speaker 11

Thank you, ma'am. Next speaker. Pat Cole. Pat, good morning, ma'am. Good morning.

51:45 – 54:34Speaker 20

My name is Pat Culp, and I reside at 3577 Boulder Crest Road, Ellenwood, Georgia. I'm here to express my concerns about a letter that was sent to the caterers on May the 17th involving Commissioner McCall Visaya. As a resident, we should expect fairness and complete facts in the public concluding when you're sending out information about an elected official. We should also ask who sent the letter and why it was sent two days before the election and why it was released at this particular time. Residents have a right and they have to question the timing and release of information that's going to damage somebody or ambush somebody's campaign. This question should be answered along with many other information questions that who released this to the caterers. And I was told that it was Commissioner Ted Terra. I don't know what went down, but I can tell you as a resident, it is not right. We have to have complete facts. about what went down and what is going on with Commissioner Messiah. I have worked with Commissioner Messiah. I'm not on a campaign. I don't campaign for her. But I do know that she's an honest person. I met with her in my capacity as the president of the City Grove Association. I'm not here representing them either. I'm just sensitive saying she's a lawyer. She's a broker. She's a business person and a community representative. She cares about our community. I've worked with her. And what really disturbed me so much too is that I was at the CID 10th anniversary meeting and she took a picture with some of these guys that we're talking about, about the data center. And then I get an email or a text saying, oh, we're going to circle her and she's dealing with the data center people. That simply was a lie because I was sitting in that meeting and it was made to be a lie and was sent out. What I'm trying to say to you is this. I want to say I want transparency from Ted Terra, from anyone. I am not against his opponent, somebody from his office that he decided he wants to run. I'm not against her. It is that tell me the truth in terms of what we're doing in our communities. This affects everyone, all seniors. And I have seniors in our community that I do represent. They are upset as well. And I said to them I would speak out in this manner. I also bring greetings from Senator Nadine Thomas, who we are working together to make sure the right information gets out. And I asked, did the caterers give you an opportunity to respond? I didn't get that answer. Because you know what? When you don't respond, that means you're ambushing somebody's campaign. I don't like that kind of thing. I don't even like being up here. But it's not right. And I say to you all, it's power. Commissioner Messiah, I say to you, stand, sister. Because at the end of the day, you got 42% of District 3. And 42% tells me that somebody wants you in this position. Thank you.

54:35Speaker 11

Thank you, ma'am. Next speaker.

54:37Speaker 20

Warren Mosby.

54:39Speaker 11

Good morning, sir.

54:42 – 57:42Speaker 27

Good morning. Good morning, commissioners. My name is Warren Mosby. My address is 2457 Habersham Drive. I'm representing myself. I've been a resident of District 3 and District 6 for over 50 years. I'm a semi-retired political consultant and a former electrical engineer. Go Jackets. I am here today to deliver a direct public comment to Commissioner Edward Ted Terry. Ted, I have known you for 15 years. Even as a young man, you've been a force in Georgia politics, leading the charge for equity, fairness, and strong communities. Your path to greatness was crystal clear. And frankly, people genuinely like you. I always believed you had the vision to be the next CEO of this great county. I never once doubted your future in politics, until now. Ted, your political career is unraveling at the seams, because you are representing the worst mistakes of DeKalb's past. To expand your own territory, you are actively working to destroy a Democratic colleague, a newcomer who hasn't had the time to learn the operational lessons you spent a decade of mastering. Let me be clear about what's happening. You are weaponizing a local issue, taking an overnight opposition faking an overnight opposition to data centers purely to tear down a colleague and clear a path for your former staff member. Everyone in this room knows your actual record. You have consistently supported the smart, regulated deployment of data centers with community input. This sudden flip-flop isn't about policy, it's a political hit job. This is unconscionable. It is beneath your talent, beneath your potential, and entirely contrary to the core beliefs you used to challenge. Because you chose a public knife fight instead of a private conversation, you have made this a community-wide issue. Why are you adopting the toxic tactics of your predecessors, dragging DeKalb through the mud and making us the laughing stock of the region once again? There is no way to sling mud without getting dirty yourself. Why revive the error when a judge rightly labeled DeKalb's leaders as the poster children of corruption? The stain will ultimately attach to you, and make no mistake, it will attach permanently. I was here 15 years ago when past commissioners tried to publicly cannibalize their colleagues. It didn't turn out well for them. It didn't improve the lives of the citizens of this county. There is time to stop. I'm begging you. Return to your roots. Be a builder, not a destroyer. When Democrats fight Democrats for raw power, the community loses. You are not MAGA. Act like it. As a former boss once told me, I now tell you, Mr. Terry, mind your own business. Protect your job. Thank you.

57:43Speaker 11

Thank you. Next speaker.

57:44Speaker 16

Deborah Wallace.

57:45Speaker 11

Ms. Wallace, good morning.

57:51 – 58:46Speaker 16

I live in the North Shore subdivision. I represent the Rockbridge Coalition. I'm here for I feel like minor stuff compared to the data center. But between South Deshawn and 124 Rockbridge Road is getting torn up because of the trucks from the Amazon distribution center. Now, we've already had a fire truck fall in a hole. We've had a couple of cars have a lot of accidents over there. And I think you guys need to do something about making a moratorium as far as trucks rolling down that one little two lane. Because now at night, my house shakes. And that is kind of scary, considering that now I'm watching my grandbaby. Point number two. 9-1-1. It is horrible. I had smoke and fire in my house, and I get a text message that I need to respond to in order to have 9-1-1 call me back.

58:47Speaker 1

That is crazy. How?

58:49 – 59:46Speaker 16

How? If I was getting choked or having an asthma attack or having cardiac arrest, I would have to find my text message, text one, to get 9-1-1 to respond to me? You know, we watch a TV show called 9-1-1 on TV. They sound beautiful. They respond quickly. They're there on the moment. We, in DeKalb County, have to answer a text message? That is terrible. 9-1-1 is there to help and support and serve the public. It is not a child text message machine. It is to help. I have asthma. I have people in my neighborhood that are seniors. What if that truck has to come down and it takes 20 minutes for somebody to answer a text message? You guys have got to fix the 911 call center. It is the lifeline to some people's health. Serious deaths can occur because of that, along with the road on Rockbridge Road. And let's get rid of them data centers. Thank you.

59:47Speaker 10

Thank you, ma'am. Next speaker. That is the last citizens we can hear at this time. All right. Thank you.

59:55Speaker 11

So before we enter into public hearing, Madam Deputy Presiding Officer does have a motion to make.

1:00:03 – 1:00:29Speaker 21

yes ma'am thank you madam presiding officer at this time i move to limit the time for discussion on each of the matters in today's meeting only to allow five minutes the first time a commissioner speaks and three minutes the second time for a total of eight minutes on any individual item second motion and a second do we need to hit the machine so by show a hand all in favor

1:00:30 – 1:00:47Speaker 11

That is unanimous. And again, that is for us as commissioners to limit our speaking time. We also have an agenda item pursuant to changing our blue book later in the discussion. And that will be our second and final read when we get to that item. All right, Madam Clerk, if you'll read the instructions for the public hearing.

1:00:48 – 1:03:06Speaker 10

Citizens may speak for or against an item that is considered by law to be a zoning ordinance, and each side will have 10 minutes to present its case. Citizens may also speak for or against an item that is placed on the public hearing agenda, but it's not a zoning ordinance. In that case, each side will have five minutes to present its case. In the event there is more than one speaker per side, Speakers must divide their time in order to complete their full presentation within the 10 minute time allotment or the five minute time allotment. When the buzzer sounds to indicate that time has run out, the speaker will be expected to immediately see speaking and to leave the podium area. Prior to speaking, a speaker should complete a speaker card and present it when approaching the podium. If a speaker has any documents for the commissioners, The speaker shall provide 10 copies when approaching the podium. Seven copies are for the commissioners, and the remaining copies are for the planning director, the county attorney, and the clerk. In all zoning ordinance and traffic common cases, staff shall make their recommendation for action to the commission, first followed by applicants or citizens speaking in favor of the item. Applicants in zoning ordinance cases, shall have the right to reserve time for rebuttal. Opponents of the zoning ordinance item shall have no right of rebuttal. For all other items placed on the public hearing agenda, applicants or citizens speaking in favor of the item shall speak first, followed by the opponents of the item. Once the citizens have finished speaking, staff should make a recommendation for action to the commission. At this point, citizens are no longer allowed to speak unless called to the podium by an individual commissioner to answer questions or provide information. Speakers should always talk directly into the microphone and begin by stating their name, address, and the name of any organization they represent. Abusive, profane, or derogatory language will not be permitted. Holding up signs, clapping, yelling, standing, or laying in the aisles to show support for or opposition to a speaker will not be permitted. but a show of hands or quietly standing in place will be permitted to show support for or opposition to a speaker's position.

1:03:07 – 1:03:28Speaker 11

Thank you, ma'am. First item is under planning and sustainability. Item 2026-0887, all commission districts, application of the director of planning and sustainability for the DeKalb County Board of Commissioners to hold a public hearing to consider and review whether to extend a moratorium on adult entertainment and devices. Good morning, Director Bragg.

1:03:29 – 1:04:09Speaker 14

Good morning, commissioners. Rachel Bragg, deputy director of planning and sustainability. This item is to extend the current moratorium on adult entertainment establishments and adult device retailers. It would extend the moratorium through September 3rd, 2026. is currently set to expire on June 11. Planning department and law have been working on the updates to the ordinance, which had not been updated in over 20 years. So we are in that process. But we are about to be finalized with those updates. So we ask for an extension of the current moratorium. So we would recommend approval of this item.

1:04:09 – 1:04:29Speaker 11

Thank you, ma'am. Thank you. Is anyone here in the public to speak in favor of this item? Is there anyone in the public to speak in favor of this item? Anyone in opposition to this item? Well, Mr. Binning.

1:04:36 – 1:05:37Speaker 13

Steven Benny, 1083 Seville Drive, Clarkston, Georgia. I know that one particular commissioner has a deep interest in this. But as a general rule, I think that the moratorium should be lifted until you're working on another ordinance and a rewrite of it. I just don't see why it takes as long to rewrite a sex shop ordinance as it does to rewrite a data center. It's time to get something done on this, if you really want to do it. I mean, people use sex shops in all parts of the county, even District 1, 2, 3, 4, and 5. So I think this is kind of pointless, but that's just my opinion. Thank you very much.

1:05:37 – 1:05:49Speaker 11

Thank you, Mr. Benny. Anyone else to speak in opposition to this item? Seeing no one else coming to speak in opposition, Deputy Director Bragg, if you'll come back up.

1:05:53Speaker 14

The staff recommendation is for approval.

1:05:55 – 1:06:16Speaker 11

Thank you. Is there a motion? Yes. Second. Seconded by Commissioner Robert Patrick. Commissioner Terry has requested to speak.

1:06:16Speaker 31

Yes. Mm-hmm. Mm-hmm.

1:06:35Speaker 11

Commissioner Terry, could you get closer to your mic? Thank you.

1:06:39 – 1:07:06Speaker 14

We do currently have a draft that we're working through internally with staff. The goal is just to have a final draft soon that would then be available to discuss at committee. However... Yeah, let me get with law and see what they think the best course will be on that. But happy to discuss it in the committee.

1:07:09 – 1:07:41Speaker 11

Thank you, Commissioner Terry. Seeing no one else requesting to speak, please open the machine for the vote. Mm-hmm. That motion carries. Thank you. Next item is top of page 3 under Public Works and Transportation, item 2026-0818, Commission Districts 3 and 6, Streetlight Special Tax District for Flat Shoals Parkway. Good morning, Director Gordon.

1:07:42 – 1:08:04Speaker 3

1:08:28Speaker 3

Staff recommends it's for approval.

1:08:30Speaker 11

Thank you. Is there a motion?

1:08:34Speaker 22

1:08:44 – 1:09:02Speaker 31

Thank you, Madam Chair. Director Wharton or Zach or CJ, is this tax separate rate? It's the existing rate.

1:09:03Speaker 5

And we're not bringing, we're not going to be bringing forward an adjustment to that rate until next year.

1:09:10Speaker 31

Yes, the tax district will cover it.

1:09:23 – 1:09:48Speaker 5

overall right right and so and we've done a study we just haven't we just haven't gotten the results yet and the timing I don't think is going to allow us to bring forward the adjustment so our intent would be to bring it at the conclusion of the study which will be It won't be in time for this year's tax bills.

1:09:59 – 1:10:19Speaker 5

We believe, we hope so. We're still waiting for the results of an audit from... We're still waiting for results of auditing how much will be generated. So we're hoping that it will cover. But we do know that at some point, we're going to need to increase that millage rate.

1:10:20 – 1:10:33Speaker 31

OK. Why don't we just in the FAB committee at a future meeting, let's just present those findings. And let's just get an example of how we pay in taxes or recharge in taxes or whatever.

1:10:33 – 1:10:56Speaker 5

Absolutely. hopefully by july commissioner we can bring back the study conducted by mgt and they'll be able to you know advise on a myriad of items that they looked at including that it just won't be ready until probably july time frame all right understood thank you thank you commissioner terry seeing no one else requesting to speak please open the machine for the vote

Motion carries. On to the next one. Item 2026-0820, Commission Districts 3 and 7, Streetlight Special Tax District for Paxton Place, Kalem Court, Axle Ridge, and Arcadia Drive. Director Gordon.

1:11:18 – 1:11:30Speaker 3

Yes, ma'am. And we do recommend this for approval. It's the same situation. It's a special task which is required from the code and development. It's just a standard process.

1:11:30 – 1:11:57Speaker 11

Thank you, sir. It is public hearing. Is there anyone in the public wishing to speak in favor of this item? Anyone wishing to speak in favor? Seeing no one, anyone here to speak in opposition of this item? Seeing no one in opposition, Director Gordon, can you restate your recommendation?

1:11:57Speaker 3

Yes, we recommend this for approval.

1:11:59Speaker 11

Thank you. Is there a motion?

1:12:04Speaker 21

I move to approve item 20260820. Is there a second?

1:12:15Speaker 11

Second. Okay. There's a motion by Commissioner Bolton, seconded by Commissioner Messiah. Commissioner Bolton has requested to speak. You have the floor, ma'am.

1:12:27 – 1:12:47Speaker 21

For the sake of those who might be watching or want a little bit more clarity, are there any changes associated with this public hearing item, or is there an extension or any – Any difference in what has been done previously?

1:12:48Speaker 3

None that I'm aware of, no.

1:12:50Speaker 21

Okay. So this is just a continuation of what has already been in place for Paxton, Column, and Axel in Arcadia?

1:12:59Speaker 3

That's the way I understand it.

1:13:01Speaker 21

Okay. Thank you.

1:13:01 – 1:13:35Speaker 11

I yield back. Thank you, Commissioner Bolton. Seeing no further requests to speak, please open the machine for the vote. Motion carries. Thank you. Cost to the county, $97,505. Address is 3327 Woodstock Road. Director Gordon.

1:13:40 – 1:14:11Speaker 3

yes substitution just to correct an error by the scrivener it was requested by the common nation attorney this condemnation is for 0.179 acres of land added to the title This action is needed due to the lack of response by the owner of 18 phone calls, four agent visits to the house, and two regular mail letters, six certified mail letters. Thank you. Is there anyone in the public to speak in favor of this item? Please come to the microphone, sir. Director Gordon. Can you scoot up?

1:16:04 – 1:16:29Speaker 2

Ladies and gentlemen, thank you for the opportunity to be heard. I do appreciate the approval of this item. It's going to be benefiting that corner. I am a party of interest to the parcel that DeKalb County had what I consider a floating right away. Now it's going to be determined, and it will be very pristine development. Thank you very much for that.

1:16:29Speaker 11

And can you state your name and address for the record, sir?

1:16:31Speaker 2

Yes, ma'am. My name is Golam Kademi. I'm known as Sean Kademi as well.

1:16:36Speaker 11

Thank you. Is there a motion?

1:17:11Speaker 15

Motion to defer to the June 23rd BOC with the stop and pecks on the 9th.

1:17:17Speaker 11

We have a motion and a second to defer. Commissioner Masai has requested a speak. You have the floor, ma'am.

1:17:23 – 1:17:51Speaker 15

Okay, just wanting to be able to get more details and have a more robust discussion with regards to this particular exchange. I'm seeing the importance of digging into the details when it comes to exchanges and wanting to do that with the time allotted through PEC's committee. So if you just be prepared, get with Shannon to be able to present, give us more detail, then that would be fantastic. Okay. All right, thank you so much.

1:17:52 – 1:18:12Speaker 11

All right, seeing no further requests to speak, please open the machine for the vote. That motion carries. Commissioner Masai, you need to clarify your motion on item 2026.0875? I do, Madam Chair. Do I get a motion to reconsider?

1:18:13Speaker 15

Motion to reconsider.

1:18:17 – 1:18:49Speaker 11

Can you hit your buttons again? Thank you. Please open the machine for the vote on that reconsideration of 2026-0875. Motion to reconsider carries. Go ahead. So let me read it out again. Item 2026-0875, Commission Districts 3 and 6, resolution, order, and declaration of taking required temporary easement for Constitution Road Freight Corridor Improvement with the cost of the county of $97,505.

1:18:51 – 1:19:06Speaker 15

So my motion is just going to change in terms of the dates, because one of the dates was a CAO meeting. So my motion is to defer to the June 23 BOC with the stop at PEX on June 9. Thank you. Is there a second?

1:19:06 – 1:19:30Speaker 11

Thank you, Commissioner Terry. Seeing no request to speak, please open the machine for the vote. Motion carries. Thank you, Director Gordon. Our next one is under Watershed Management, item 2026-0778, Commission Districts 1 and 6, Partial Easement Abandonment at Repose Drive. Good morning, ma'am.

1:19:33 – 1:19:57Speaker 22

Good morning, commissioners. Good morning. DeKalb Watershed received a petition from an owner who would like the county to abandon a portion of its easement on the property. The property was vacant when purchase construction caused for the sewer line to be rerouted. And so because the sewer line has been rerouted, the owner would like that portion of the easement abandoned.

1:19:58Speaker 11

Thank you, ma'am. And your recommendation?

1:20:00Speaker 22

The recommendation from staff is to approve. Thank you.

1:20:03 – 1:20:28Speaker 11

There's still a public hearing item. Is there anyone in the public to speak in favor of this item? Anyone to speak in favor of this item? Seeing no one, is there anyone here to speak in opposition of this item? Final call, anyone in opposition of this item? Seeing none, if you can restate the staff recommendation.

1:20:29Speaker 22

Staff recommendation is for approval. Thank you.

1:20:32Speaker 11

Is there a motion?

1:20:36Speaker 6

For purposes of conversation, motion to defer for two weeks.

1:20:42Speaker 11

Okay. We have a motion and a second to defer for two weeks. And Commissioner Patrick has requested to speak. You have the floor.

1:20:50Speaker 6

Thank you, Madam Chair. Can you tell us what the land was used as a sewer easement? What is the acreage?

1:20:59Speaker 6

What's the acreage of the land? How big is the land?

1:21:02Speaker 22

How big is the lot?

1:21:03Speaker 6

Land. The land where the easement is. How big is that?

1:21:07Speaker 22

Oh, how many? I'll have to get that for you, Commissioner.

1:21:10Speaker 6

OK. And then is there other development activity that's happening around this property?

1:21:16Speaker 22

Not that I'm aware of.

1:21:17Speaker 6

OK. And have you had a chance to confirm with City of Chambly if there's any activity going over there? We have not checked with the City of Chambly. OK. All right. Those are my questions for now. Thank you.

1:21:27Speaker 11

Thank you, Commissioner Patrick. There is a motion on the floor to defer. Please open the machine for the vote.

1:21:37Speaker 5

It's 992 square feet.

1:21:42Speaker 22

Commissioner, we've just confirmed that it's 992 square feet. Oh. Yeah, it's pretty small.

1:21:49Speaker 6

OK. And you're saying that, to your knowledge, there's no development activity happening on that?

1:21:56Speaker 22

The land has already been developed where the easement is going to be abandoned.

1:22:01Speaker 11

OK. Would you like to reconsider?

1:22:04Speaker 6

Commissioner Terry, any insights?

1:22:09 – 1:22:22Speaker 31

I think if we just had two weeks, we could just make sure we're not missing anything. And then I don't think it's a huge hurry. Is there someone, are they like trying to do something right now? Like we can wait two weeks, right? They can wait two weeks. Okay. All right. Like double check. Okay.

1:22:22Speaker 10

Madam Presiding Officer, is this being deferred for public hearing? No.

1:22:27Speaker 11

Decision only or public? Decision only.

1:22:28Speaker 10

Decision only.

1:22:29 – 1:23:48Speaker 11

Yeah. Decision only. Yes, ma'am. Thank you for getting that clarification. Thank you. OK. Thank you. So that motion to defer did carry. And that concludes our public hearing section. 1:29:43 – 1:32:25Speaker 11

Dr. Bolton. Thank you, commissioners. And if we can just correct that last name for the record. All right. Please open the machines for the vote. Oh, you're right. I'm sorry. I did need a vote. 1:33:36Speaker 6

Yes, on behalf of the Ops Committee, motion, excuse me, move for action.

1:33:42 – 1:33:53Speaker 11

Move for action, yes, sir. Well, the next item is actually... PWI.

1:33:53Speaker 6

PWI, yeah, yeah. Motion to approve.

1:34:02 – 1:35:07Speaker 11

All right. We have a motion to approve. I see no request to speak. Please open the machine for a vote. Motion carries. Thank you. Now, on top of page 9, item 2026-0474, all commission districts, approval of amendment number 1 to contract number 2000186, operational and performance assessment services, purchasing policy exemption awarded to Malden and Jenkins LLC, amount not to exceed $116,530. Motion to approve. Is there a second? This is a PWI item. Second. Thank you. Seeing no request to speak, please open the machine for the vote. Motion to approve carries. Thank you. Now we are on item 2026-0926. And we do have a substitute for this item to adopt tentative 2026 millage rates. Is there a motion?

1:35:10Speaker 31

Motion to approve. I have a quick question.

1:35:12Speaker 11

If you hit the request to speak. And is there a second?

1:35:17Speaker 21

Second for purpose of discussion.

1:35:20Speaker 11

All right. Commissioner Terry, you have the floor.

1:35:22Speaker 31

Thank you. Zach, just for- A little closer.

1:35:25Speaker 11

It's a little quiet today. Sorry. Thank you.

1:35:27 – 1:35:41Speaker 31

Zach, just for clarity. So this is just the adoption of the tentative rates. Correct. And then what is the- It allows for advertising. Exactly. Yes. And so what is the final date for approval of the millage rate again?

1:35:41Speaker 5

I want to say July 7th.

1:35:44 – 1:36:09Speaker 31

Yes, July 7th. July 7th. Okay. And then I know y'all are planning, I think we're working on sort of the sanitation stormwater rate town hall. Would there be another town hall or information sessions on the millage rate in particular and how it's aligning with the budget?

1:36:10 – 1:36:26Speaker 5

So, yes. During the millage rate process, there are three public hearings, one at night, one at night. So there are those opportunities where we go through the presentation of what we're doing, why we're proposing it, and so forth.

1:36:26Speaker 31

OK. And in the past, I believe two of the public hearings have been here. Correct. But the night one, will that be in a special location?

1:36:36Speaker 5

That's also here. That's also here.

1:36:39Speaker 31

OK. Is that the only thing that's on?

1:36:43 – 1:37:02Speaker 21

it be the only thing on the agenda or is it part of it yes that's the only thing on the agenda okay okay thanks thank you commissioner terry commissioner bolton thank you and for record can you please state the dates for those public hearings and can we thank you everybody

1:37:03 – 1:37:22Speaker 26

Yes, so the first two public hearings will be on June 23rd. So one will be at 10 a.m. at the regular public hearing during the Board of Commissioners meeting. The second one is at 6 p.m., same location, so here in this room. And then the third will be at 10 a.m. on July 7th, right before the vote to adopt the millage rates.

1:37:25Speaker 21

And that was June 23rd at 10 a.m. and 6 p.m. I believe so.

1:37:29 – 1:37:44Speaker 26

Let me just verify that I have my date right. But it's the second meeting in June. Yes, 23rd.

1:37:45Speaker 21

Okay. Thank you. I yield back.

1:37:47 – 1:38:04Speaker 8

Thank you. Commissioner long Spears. Thank you very much. Madam PO TJ, just to make sure I am crystal clear on this one. Um, so the vote today is simply to advertise the hearings that you just announced the dates for. Correct.

1:38:04Speaker 26

Right. That's correct.

1:38:06Speaker 8

So there's no assumption of approval from any of us of that, uh, rate increase.

1:38:11 – 1:38:35Speaker 26

Correct. So the ads we have to run say that the board has tentatively adopted such and such millage rate, and this is just the first step in that process. But it doesn't bind the commission at all to vote for a final millage rate. Only thing it does is it doesn't allow adoption of a millage rate higher than what's advertised without having to go back through the advertisement and public hearing process.

1:38:36 – 1:39:01Speaker 8

OK, so it does not bind us to our vote, to the millage rate. The only exclusion is that we can't go higher than what's advertised. That's correct. OK, very good. My second question is, on May 21 of this year, so last week, was a brief presentation about the millage rate. And today, I guess, is considered the second reading. Is that right?

1:39:02 – 1:39:19Speaker 26

So I wouldn't say exactly. It's just that based on when we received the digest, that's the timing that worked out. So we did the presentation, and we're asking for approval of this at this meeting today, though, so we can meet the advertising schedule for the publications.

1:39:20 – 1:39:42Speaker 8

If the county attorney could please come forward for a brief question. Thank you, TJ. So there is no issues in your opinion about us proceeding with this item officially only read into the record once at this business meeting? Because the Cal meeting is not a business meeting of the commission. Or we take action.

1:39:42Speaker 30

I understand this is just to set up your advertising. So you're OK, Commissioner.

1:39:46Speaker 8

We are OK, per your pen. OK, fantastic. Thank you very much. Appreciate you, TJ. You're back. Thank you, Commissioner Masaya.

1:39:52 – 1:40:19Speaker 15

Thank you so much. And so then just going into the language where it says to adopt tentatively so that we may potentially adopt it, wouldn't it be best to say to possibly adopt a proposed 2026 millage rate so that it's clear in terms of this verbiage that we are not tentatively adopting what's presented, but we are considering what's been presented.

1:40:21 – 1:40:34Speaker 26

I mean, I believe the tentative implies that it is not the final rates, that this is just preparing in advance to advertise those rates for consideration.

1:40:35 – 1:41:17Speaker 15

Right. So the tentative says that this is what's actually on the table presently. So tentative is in waiting. So this is saying we're adopting this in waiting. Just again, my thoughts is to be clear that a possible possible rates opposed to that they are tentative. Tentative means impending and they could potentially be unexpected to manifest into not definitively but still suggestive of the same. So that their proposed millage rates to be tentatively adopted.

1:41:20 – 1:41:44Speaker 30

Madam, Madam, Presiding Officer, Commissioner Messiah, we would ask that we leave the language as is. We've used this language previously, and the language is designed to put the public on notice that this is a possibility. And you are correct, as you stated, Commissioner Messiah. By no means is this a guarantee that this will happen, but for advertising purposes, it properly puts the public on notice.

1:41:44Speaker 15

All right, fair enough. Thank you. You're back, Team NPO.

1:41:47 – 1:42:01Speaker 11

Thank you. Seeing no further requests to speak, please open the machine for the vote. Motion to approve carries, middle of page nine.

1:42:01Speaker 30

Substitute. The substitute.

1:42:02 – 1:42:27Speaker 11

Motion to approve the substitute carries. Middle of page 9, under Executive Assistant Chief Operating Office, item 20260632, all commission districts authorizing proposed rate increase for parking at the DeKalb County Courthouse parking deck, Maloof Building parking lot, and Camp Circle parking lots. This is an ops item.

1:42:28Speaker 6

Thank you, Madam Presiding Officer. Based on the recommendation of the Ops Committee, motion to approve.

1:42:35Speaker 11

Second. We have a motion and a second to approve. Commissioner Terry has requested to speak. You have the floor, sir.

1:42:44 – 1:43:39Speaker 31

Thank you, Madam Chair. Zach, just something that we talked about in committee was something, I think, sort of in the future. But when we're back at the Maloot Auditorium having our public meetings, some sort of parking validation um for folks who I guess you know would be public commenters or really just anyone attending the meeting um would make sense to me so we'll see what we're just I guess like for McCain like logistically if we validate someone's parking we usually like give them like or something like scan, basically. I don't know how it works over at that parking deck. But do we still pay for their parking? Or can we work out in this contract where that just is a $0 and no one's paying for other people's parking? It's just a free parking for public comment for the meetings that we validate for them. And if you don't have all the details, it's fine. No, here's what I would do.

1:43:39 – 1:44:07Speaker 5

Yes, and we definitely were prepared to have the conversation with the vendor, with Universal Parking Management. And I almost hate to say, but my instinct tells me, Commissioner, that by the time we're prepared to have that conversation, we'll be seeking... to renew, we'll be up for contract renewal. So I think it'll be around the same time in that January time frame.

1:44:08Speaker 31

OK. So in the meantime, you can determine if there's a validation system.

1:44:10Speaker 5

Yeah, we'll definitely have the conversation to see if we can develop that prior to us getting to that point. OK.

1:44:27Speaker 11

Commissioner Terry, Commissioner Bolton had kind of a response to that discussion. Okay.

1:44:33 – 1:45:01Speaker 21

And this is for you to consider also, Zach, as opposed to having vouchers or creating an environment where we have to add new tools, consider just from that 8.30 to 10.30 period just having the gate open, since we know folks will be coming in for either public comment or public hearing from 8.30 to 10.30. They'll be here any time after that. We don't have to worry about it.

1:45:02 – 1:45:28Speaker 5

Yes, thank you. Commissioner, the lot that the public will be parking in, they will park on the street or they will park probably at the courthouse. The gated, you know, where the employees park will be gated for employees only until 5 o'clock. I got you. Yeah, but we'll work through what makes the most sense and understand on the street, that's the city of Decatur. So we'll figure it out. Okay.

1:45:28Speaker 11

Thank you. Commissioner Masaya.

1:45:30 – 1:45:49Speaker 15

Thank you so much, Madam PO. I just want to share, well, I just asked, do we know that the, at the courthouse specifically, do we know that all the machines are working and things are clear for when people are coming in and able to receive a ticket and attendance?

1:45:51 – 1:46:04Speaker 5

Yes, I have. And we will double check. But I've not heard that there was any obstruction to the process. I think it's a ticket out. You pull your ticket, and then you pay on the way out or something.

1:46:04Speaker 15

All right, so just someone that would have to regularly use the courthouse parking.

1:46:10Speaker 5

I'm going to defer to you, yeah.

1:46:12 – 1:47:23Speaker 15

It is a huge concern to think that we're going to raise the rates on that parking deck, particularly with the troublesomeness of entering and exiting and the lack of parking attendants that are there. already and I understand that we've done some renovations and I'm thankful that we have and I'm sure the folks that are working in the courthouse are thankful for that as well but I would respectfully request that we look into the parking procedures particularly at the courthouse before we consider raising rates considering some of the troublesomeness of entering and exiting that parking deck so I would support Malouf and Camp Circle parking lot. I would also suggest that we look at for the same reason and particularly when people are having to go to court and it's a responsibility for them to show up and they can get penalized for not doing so. I would really suggest that we look at those parking procedures at those locations before we consider raising that.

1:47:23Speaker 20

With that, I yield back to you, Madam Pio.

1:47:25Speaker 11

Thank you, Commissioner Messiah. Commissioner Patrick.

1:47:28 – 1:48:12Speaker 6

Thank you, Madam Presiding Officer. I just wanted to add some of the discussion that we had from the Ops Committee, which essentially was we were comfortable moving forward with the rate increases, ensuring that there is sort of this 24 hours of if you're parking in DeKalb, parking structures you you're going to pay just like you would at any private organization the other idea or the notion that came from that meeting was was that chief operating officer and his team will look through and find out any of the concerns when it comes to implementation and certainly report those back to through the committee process and ultimately the board of commissioners for correction thank you very much thank you commissioner patrick commissioner long spears and the mics are a little quiet so you guys might have to be a little closer today thank you

1:48:12 – 1:48:53Speaker 8

All right. Can you hear me? Yes. Can you hear me now? Thank you, COO Williams. I am in favor of the vouchers for those that are attending our meetings. I think that is a very, very good idea. There should be no barriers to being able to be present and voice your opinion or listen to what's going on with your county government. Point two is, as you're fully aware, the City of Decatur, specifically Commissioner Dusenberry, reached out expressing concerns with the rate structure that was initially proposed, I believe, in 2024. Is that correct?

1:48:54Speaker 5

Yes, it was part of the contract award in 2024. Yes.

1:48:59 – 1:49:39Speaker 8

And what we ended up uncovering is we didn't technically vote on these rates. And so at that point is when you agreed to initiate an agenda item, which you did, so that you could observe the rights of this board per the Org Act to set rates. The concern that Commissioner Dusenberry brought forward on behalf of the City of Decatur is two of these three parking rate increases are in the City of Decatur. And what they have proposed to you was a flat rate. And it was, what, $6 or $8? I believe it was $8, correct, a day. Okay.

1:49:42 – 1:50:34Speaker 5

Yes, so I don't remember the specific rate that was discussed. But what we did find in my conversation with Council Member Dusenberry, as well as Commissioner Dusenberry, was that our rates that we're proposing are lower than the city's rates. And I think it will be about three years of rate increases until we are equal to the city's rates. And although it is in the city of Decatur, which is absolutely correct, as noted in the $12 million we just invested into that parking deck, those dollars are from essentially unincorporated funds because those were SPLOST funds. So, I mean, we feel that what we're proposing is reasonable. And I believe that the city at least came to an understanding as to where we are.

1:50:35 – 1:51:03Speaker 8

I have not had a chance to talk to Commissioner Dusenbury. I did send him a note, hoping he would get back to me. But I've not heard from him. In all fairness, it was just 30 minutes ago. But my understanding is that he had brought forward to the Decatur Commission a flat rate scenario for their parking garage that is managed by the city of Decatur. I don't know where that stands right now. So today, unless you do.

1:51:03 – 1:51:24Speaker 5

no yeah no we weren't talking about i don't know if if they moved forward with that after after my conversation with him i don't know that he was going to continue to move forward but i don't want to overstate our conversation was about three weeks ago but i do believe we came to a good understanding as to what we were proposing and that it wasn't as onerous as i think they had believed

1:51:25 – 1:51:42Speaker 8

Well, at this point, because I was under the advice that they were pursuing a flat rate to be equivalent to what they proposed to you, which was either $6 or $8 flat rate per day.

1:51:42Speaker 5

For our garage?

1:51:43 – 1:52:28Speaker 8

Correct, yes. He reached out to myself multiple times. We finally were able to loop you into that conversation. The city of Decatur expressed concern with having different parking rates throughout the city. So Commissioner Dusenberry was working behind the scenes. I know he spoke to you. And that he had proposed, I believe it was proposed maybe a couple months ago, that there be a flat rate. Again, the whole purpose is to ensure that the parking rates are consistent throughout the city of Decatur. And what you're proposing today, two out of three of them are in the city of Decatur. So before I can support this, I obviously have to hear from the city of Decatur and see where they stand on what you've proposed.

1:52:28 – 1:52:58Speaker 5

Sure, sure. And I've, you know... Right. So the rates that we're presenting are what were in the contract when adopted. In 2024. In 2024. And I believe that the city's proposed rates are higher than what we are proposing, at least in the first couple of years. So, I mean, I'm sure we would gladly adopt the city's rates, but I think we're proposing something that is less for the first couple of years.

1:52:59Speaker 8

Top of page 13, this is a FAB committee item. Item 2026-0693, change order number two to contract number 1310425, financial advisory services for use by the Department of Finance. This contract consists of providing financial advisory services and acting as the county's municipal advisor. This request seeks to increase the contract scope and extend the contract term through December 31st, 2026. We recommend award to Public Financial Management Incorporated doing business as PFM Financial Advisors LLC contract term extension only. Is there a motion?

2:04:34Speaker 31

Yes. Thank you, Madam Chair. Motion to defer this item to the June 9th BOC meeting with a stop in FAB today. And a quick question for Zach.

2:04:45Speaker 11

OK. Is there a second? Second. Thank you. Commissioner Long-Spears, you've also requested to speak. You have the floor, ma'am.

2:04:52 – 2:05:05Speaker 8

Yes, ma'am. Thank you so much. Mr. Williams, would you mind coming to the podium? I just have a couple of questions about this particular item. So the RFP was released in March of 2025, correct?

2:05:09Speaker 5

Thanks, Commissioner. Let me grab this. Thank you.

2:05:13 – 2:05:35Speaker 8

And my second question, while you're doing that, and this is the third requested extension for PFM. So question one, date of the original RFP. Number two, confirming the number of extensions. Number three, why do you continue to seek extensions?

2:05:35Speaker 5

Sure. So the original award for this item was November 2022.

2:05:41 – 2:06:08Speaker 8

november 8 2022. um the second question was i apologize well the so that's thank you for that so november 22 was the original award to pfm and then i believe that in 2025 and maybe diane can respond to this was an rfp was put out correct so march of 2025 is that correct okay all right you can go on to my second and third question

2:06:10Speaker 5

Why is it that we're extending it?

2:06:13Speaker 8

First, the number of extension requests. I believe two have already passed this board.

2:06:17 – 2:06:29Speaker 5

Right, so this would be the third extension request, and it is being done while we conclude the process for the RFP that went out last year. Ms. McNabb.

2:06:29Speaker 8

Go ahead, Ms. McNabb.

2:06:30 – 2:08:22Speaker 4

Thank you. Yes, we've already gone through the RFP process for a selection of the financial advisor, but it hasn't made its way back to you guys yet. I'm not sure exactly where it stands. I know that the user department, we've signed off on it. But as we move on through the year, we start projects. For example, the housing projects that Dr. Ferguson is working on right now. Well, those will likely have bonds issued in connection with them. So we've had to start working on that project now. We can't wait until the next project. FA, finishes the hiring process. So what we have been doing is as that RFP goes through the process, and as I said, we've already signed off on it and everything. Once we begin these new projects, we have to extend the PFM contract that they're currently working under to cover that length of that project. It would be very inefficient for us to change horses in the middle of the stream. once we get halfway down a project lifecycle, to then have to change. It'd be like changing construction managers in the middle of a project. And so that's why we've come back with a couple of extensions on this. But as I understand it, we're ready to proceed on moving forward with the proposals that have been evaluated as, again, we've signed off on the user as the user department. So that's proceeding, but at the same time, like I said, we've got to cover PFM for their extension of the current services.

2:08:24 – 2:08:54Speaker 8

All right. Thank you so much for that. A couple of follow-up questions for you, Ms. McNabb. this is unusual at least since i've been on the commission that an rfp goes out in march of last year we're almost in june of this year and then requesting an extension through december of this year so in theory the soonest that we would end up i guess addressing the contract the new contract would be in january of

2:08:54 – 2:10:44Speaker 4

2027 no ma'am we're trying to get the the fa contract resolved and on board so that the next new project that comes up we have them available to start on that project we're not we are not extending it basically what we're looking at now is we would expect to have two fas on board as the old fa finishes up the projects that began before the new fa gets on board Now, once a new FA is on board, and I'm not making any sort of our existing FA proposed just like a couple of others, but it got delayed because there was a conflict of interest debate that had to go through the ethics committee and have official sign off by the ethics board on whether one of our proponents was had a conflict that initial response from the ethics officer was that one of our proponents had a conflict of interest that had to go all the way through the ethics board and the ethics board decided that in fact they did not have a conflict of interest so we went back and made sure that they were had been included in the entire process fortunately the procurement committee had left them in the process, so we didn't have to completely redo it from scratch, but we did have to go back and include one of the previously excluded proponents from that due to them not having a conflict of interest. So that's sort of why it took so long, or one of the reasons why it took so long, just because I think services can be rather lengthy in debate. And that's basically how we ended up where we are now. Does that cover it pretty much?

2:10:45 – 2:10:57Speaker 8

I have actually exhausted my time, but I'm going to hit the request to speak for a follow-up, which gives me three minutes. And so I will don't go far. Heartbeat in my questioning. Thank you. Thank you, Commissioner Longspheres.

2:10:57Speaker 11

Commissioner Terry.

2:10:59 – 2:11:12Speaker 31

Thank you, Madam Chair. So Zach, we'll discuss this in more detail in the FAB committee today. Will PFM be available at committee to be here?

2:11:12Speaker 4

To talk about, I'm sorry.

2:11:14Speaker 31

Yeah, because the other part of this agenda is actually expanding the scope of their contract also.

2:11:20 – 2:11:59Speaker 4

Yes, that relates exclusively to our banking RFP. because they have what we have asked them to do or one of the services that they proposed have proposed from the time we've had them is to assist us in the banking RFP because it's a highly technical process and the services since we began this process they've spun off a little subsidiary underneath the PFM brand that specifically does these banking RFPs and so the revision is to include this subsidiary in their original contract.

2:11:59Speaker 31

Okay, so we can get into that more in the committee. I think that was a request from the commissioners. I'll add that, so thank you.

2:12:06Speaker 4

This is the first time I've known they were requested to be at FAB. I will call them and ask them to be there.

2:12:10 – 2:13:22Speaker 31

Yeah, I think it would be good. And then just mentioning the housing initiatives and all of the the analysis that goes into that i think it would be good because the nature of this contracts act when we first um i think brought it forward in 2022 was that pfm is the financial advisor for the county which includes the board of commissioners um but you know we haven't had any um Y'all have been having discussions about housing bonds, housing financing, but we have not had any discussions up here. So I think what I'll be looking for is with this extension, knowing that they're already working on that housing analysis, I think this would be a great time for them to present to at least a FAB committee and really any other committee that's interested on any details that are relevant for the commissioners to know and understand. So I want to get a little bit into that and FAB if we can, so if PFM is available or if you can also assist in committee, that would be great.

2:13:22 – 2:13:35Speaker 4

Okay. That's something that Dr. Ferguson will have to participate in since it's his area. I mean, I can talk all day about housing bonds and things like that, but it goes back to Dr. Ferguson to make that.

2:13:37 – 2:14:30Speaker 31

yeah and we wouldn't really be looking at it from a housing policy perspective it's more just what is pfm's role in advising the board of commissioners on things such as housing bonds so so the fab committee is really just thinking about it from the financial analysis perspective and i just want to make sure that um with pfm and this extension and any any you know, if there's a future contract, that we really just embed some level of work that engages with the commissioners in a proactive way. And maybe that's something that Chief of Staff Lee May can help us work on, just so we're, like, not responding to – because I know you all are working on it, and that's great. You're working on things behind the scenes. But just as these decisions come forward or there's, you know, new work that's being processed, bring it back to us so we're aware.

2:14:31 – 2:14:54Speaker 5

Yes, so what could be a good idea, Commissioner, is whether it's PFM and this extension or whomever in a future contract, whether it's PFM or someone else, but have a specific conversation with FAB wherein FAB lays out, here are a number of targeted areas we would like you to look at. And so that gets folded into their work plan. So I think that'll be the best approach.

2:14:57Speaker 11

All right, thank you. You yield, Commissioner Jerry. Commissioner Long-Speers for your second opportunity.

2:15:02 – 2:15:41Speaker 8

Thank you very much. OK, Ms. McNabb, so I just want to make sure I'm crystal clear. We're requesting the extension for PFM to December 31. You feel confident that you can bring forward whoever was selected in your process to serve as our financial advisor. You will, in effect, have both of them If there is more than one, if it's just PFM that was selected, PFM would continue to provide their services. If they weren't selected, you'd have this second entity engaged so they can prepare to pass the baton during a three-, four-, five-, six-month period. That's your goal with this, right?

2:15:42 – 2:16:20Speaker 4

I think that... I just want to be very specific about pass the baton. That means that as new projects come up, then the new entity would not be taking on any new projects beyond the naming of a separate FA that would be different. Any new project after that would either go directly to the new firm, or if it's something special that we think we've got to have somebody else, then it would come back to you.

2:16:20Speaker 8

Understood. OK. And you are pursuing a three-year, multi-year agreement, correct?

2:16:25Speaker 4

With the extensions.

2:16:27Speaker 8

Thank you. All righty. I appreciate that. Yield back.

2:16:30 – 2:18:01Speaker 11

2:21:43Speaker 11

Move the motion and a second. Commissioner Long-Spears has requested to speak.

2:21:49 – 2:22:20Speaker 8

Thank you very much, Madam Presiding Officer. My question relates to item 2026-0770. This is the 2026 Good Neighbor Day Airshow. Could, I don't know if Mr. Williams or, yes, our PDK Director come to the podium. I know for years this was an annual event, and then I believe that y'all proposed doing it every other year. Is that still your track that you're on?

2:22:21 – 2:23:03Speaker 25

that is correct that's currently what we have uh been been doing a lot of it has been due to just the rising costs of putting on the air show as you know this is a it's a free event and so um there's a lot a lot of work that goes in on my staff and um you know budgeting for the air show and then um also we've had some uh the last five or six years or so, we've had a lot of projects that have been happening that have kind of caused us to have to put things off for a year. So just a combination of different things. But there's still the chance that we may get back to an annual type of show.

2:23:05Speaker 8

Very good. So the last show then would have been in 2024. That's correct. But prior to that, it was every year, 23, 22, 21? Well, we didn't have one in 23.

2:23:15Speaker 25

So in 22, 24, and now 26. All right.

2:23:19 – 2:23:50Speaker 8

So the years in which you didn't host the air show, and I do recognize that is... i go every year now every other year i think it's fantastic and y'all do a great job with it but in the alternate years do you do any type of community engagement opportunities to replace being able to host the air show due to additional projects the cost etc we do so we actually just had an event a couple weeks ago actually last last weekend uh it was the uh we called our warbird weekend

2:23:51 – 2:24:20Speaker 25

And so the commemorative air force, they bring in some, some bombers and other world war two aircraft. They come out, they display them. on our ramps, and they also provide opportunities for people to engage with those aircraft, come and tour the aircraft. There was a B-25 and a B-17 bomber. They allow people to come on, tour them, as well as purchase seats on the aircraft to go up for, you know, just a flight.

2:24:20Speaker 8

Okay. Was that well attended?

2:24:23 – 2:24:35Speaker 25

It was. It was very well attended. Yeah, we got a lot of really good feedback on that, and they had a lot of good participation, selling rides, and people coming to engage with the aircraft.

2:24:36Speaker 8

Okay, very good. Well, thank you for everything that you do. We do appreciate it, and I yield back.

2:24:41 – 2:25:36Speaker 11

Thank you, Commissioner Longspear. 2:27:11Speaker 11

Second. A motion and a second to defer. Question from Commissioner Long-Spears. You have the floor.

2:27:18 – 2:27:57Speaker 8

Yes, ma'am. Thank you so much. All right. I was looking for the SPLOST to break down, but I've not been able to find it fast enough. All right. So... tell me the cost is 3.7 million dollars of sploss 2 funds can you specifically tell me um which thank you very much mr kingsbury which line item of that sploss 2 budget the 3.7 million dollars will come from yes ma'am this was the previously approved board action from sploss 2 for the health center improvements so these are additions

2:27:59 – 2:28:12Speaker 1

The existing contracts facilities has for on-call roof repair and replacement. This just adds a splash of dollars to their contracts and not to exceed the values previously approved by the board. We can get to that breakdown again. It was about a 13-page spreadsheet.

2:28:13 – 2:28:25Speaker 8

So there is a one-page document, which I've been unable to recover quickly, that outlines the total SPLOST to approved expenditures. Yes, ma'am.

2:28:26Speaker 5

About 13.5, roughly. Yeah.

2:28:27Speaker 8

There's a line item that is specifically for mental and physical facilities.

2:28:34Speaker 8

I note that while you – And that's where this comes from. Okay, it is that line item.

2:28:40 – 2:28:58Speaker 8

All right. So just for my purposes of my understanding, all of these that you listed are health facilities to some degree. And the 3.7 will come from that overall $15 million. It was 15, correct? I just can't find it right now.

2:28:58 – 2:29:40Speaker 5

So the board approved about... two meetings ago 13 13 and a half million but it's for all of the physical and mental health facilities yeah okay very good um so why why do we have um fire rpca these other departments listed yes ma'am so this contract um is the vendor works on those facilities as well on an ongoing basis. And so what this item does is it adds more money to the vendor's contract so that they can take care of this work that you approved a couple of meetings ago.

2:29:41Speaker 8

OK. All right. Very good. Thank you so much. I'll go back. Thank you. Commissioner Terry.

2:29:47Speaker 31

Thank you. Apologies if I missed, but are we deferring this item? Okay. And what was the, I saw the recommendation was approval upon receipt of additional information.

2:29:57Speaker 5

What were we looking for? I think we were hoping for the audit to have concluded their work.

2:30:01Speaker 31

Oh, the audit. Okay.

2:30:03Speaker 31

Gotcha. Okay. Thank you.

2:30:05Speaker 11

Thank you. Seeing no further requests to speak, please. I'm sorry. Okay.

2:30:12 – 2:30:34Speaker 8

I do have a second time. Thank you so much. It just took me a second to find it. So the Of the SPLOST II project list, section D, number two, is physical and mental health facilities at $15 million. And you said $13.5 million.

2:30:35Speaker 5

Yes, $13.5 million has been allocated for these purposes.

2:30:38Speaker 8

OK, so we've already allocated $13.5 of the $15 million. Correct.

2:30:44Speaker 8

Does that include this $3.7 million?

2:30:46Speaker 5

Yes. So you approved allocating $13.5 million, and we provided a list of what needs to be done.

2:30:53Speaker 8

I remember that, yes. So $1.5 is left is really what I'm trying to get to.

2:30:55 – 2:31:08Speaker 5

And I think a portion of that is for management. Each of the line items has a management fee. So the board approved allocating the funds, but then we have to put the money on specific contracts to get the work done.

2:31:08Speaker 8

OK. So roughly $1.5 million left on that line item. Correct. OK. That's all I really was trying to get at. Thank you so much. You're back.

2:31:16 – 2:32:44Speaker 11

Thank you. Seeing no further requests to speak, please open the machine for the vote. Motion to defer carries. We are now bottom of page 16, Purchasing and Contracting for PECS Committee. Central staff needs clarification on three items that were read by Commissioner Patrick. It was 2025-1800. 2026-0317 and 2026-0423. They need to ensure that is deferred to the BOC. I think you said PWI.

2:41:52Speaker 6

I did. So let me read it out correctly. Motion to defer the following agenda items for two weeks to the June 9 BOC meeting with a prior stop at PWI. Again, 1800-0317 and 0423.

2:42:07Speaker 10

Thank you. OK.

2:43:14 – 2:43:59Speaker 11

Second. We have a motion and a second to defer. Please open machine for the vote. The motion to defer carries. 2:45:38 – 2:45:57Speaker 11

Is there a second? Thank you, Commissioner Terry. There is a second for that motion. Please open the machine for the vote. Was your motion to approve or defer?

2:46:00 – 2:46:37Speaker 11

Yeah, if that's noted that that was to be approved. Do it again. OK, cool. Thank you. We're now on top of page 22, items for decision by the board under Board of Commissioners. And this is a second read of this item. Item 2026-0801, all commission districts to amend section 2 of the Board of Commissioners standing procedural rules to establish limits on commissioner speaking time. Is there a motion?

2:46:38Speaker 21

I move to approve item 20260801. Second.

2:46:41Speaker 11

Hit your buttons, please.

2:46:45Speaker 21

The substitute? The substitute.

2:46:47 – 2:47:45Speaker 11

Thank you. And the motion is to approve the substitute. OK. So it is to approve. Thank you. If we can open the machine for the vote. Motion to approve carries. So the rules that we've been operating under for the last couple of meetings are now officially part of the Blue Book. And we won't have to make a separate motion every meeting. So I appreciate everybody on that. Moving right along, Board of Commissioners, District 2, item 2024-0842, all commission districts resolution to review and amend the Board of Commissioners standing procedural rules.

2:47:46Speaker 6

Motion to defer to the June 23 BOC with a stop in ops.

2:47:51 – 2:48:20Speaker 11

Second. Motion and a second to defer. Please open machine for the vote. Motion to defer carries. Skipping over to the top of page 25, Board of Commissioners, District 6, item 2025-0683, all commissioned districts to approve a resolution to address egregious littering and illegal dumping of scrap tires.

2:48:24Speaker 21

I move to defer item 2025-0683 for two weeks to the June 9 BOC with a prior stop in Earps.

2:48:35Speaker 11

Is there a second? And please hit the button. Second. Yeah, that's what I was just wondering. Commissioner Patrick.

2:48:44 – 2:49:40Speaker 6

It is a District 1 item. And I want to thank the staff, the administration, as well as my commissioners for getting us to this point. I hope that everybody has a copy of these proposed changes. If you don't, please reach out to central staff Mr. Marcus Allen in particular, and he will get you a copy of that immediately. Ideally speaking, if we could get this taken care of at our next meeting, that would be ideal. And the benefit to the commission is you're going to save about four pages of agenda. So there's something for everybody on this one. No, but being serious, we've looked at this, I guess, just about a year's worth of time now. I think everyone's had a crack at it, so I think everyone's more or less comfortable with it. Maybe not everybody, but I think we're getting there. And any final changes that you guys want to see, I think this is going to be the opportunity to mention them, and hopefully we can knock it out of the park. Thank you.

2:49:40 – 2:50:18Speaker 11

Thank you. And if we can get it noted that it is a District 1 item and not a District 6 item, for the record. All right, if you open machine for the vote. Motion to defer carries. So now we're at the bottom of page 26, item 2025-1506, to approve a resolution to ensure that the county's judges receive the same benefits as the judges speak today as the judges of the Superior Court of DeKalb Judicial Circuit, county employees, and judges in other counties. And this is a FAB item.

2:50:20 – 2:50:50Speaker 31

Motion to withdraw this item. I have a quick comment. there a second second thank you commissioner long spears commissioner terry you have the floor thank you madam chair we did discuss this in fab and we were waiting for the governor to sign the legislation that pretty much corrects all of the issues that we're trying to achieve in this resolution and so at this time we can move forward with the full committee recommendation to withdrawal thank you thank you seeing no further requests to speak please open machine for the vote

2:50:56 – 2:51:15Speaker 11

Motion to withdraw carries. Bottom of page 27, item 2026-0158, Super District 6 to approve a resolution to establish a DeKalb for the People AI Tech Dividend Fund and fiscal stability policy. Also a FAB item.

2:51:17 – 2:51:37Speaker 31

Yes, thank you, Madam Chair. Motion to defer this to... the July 7th BOC meeting. And I believe we're going to talk about this at the nighttime Cal. Is that in the list of items? It can be. OK. I have a quick comment.

2:51:37Speaker 11

Second. Thank you for the second, Commissioner Long-Spears. Commissioner Terry, you have the floor.

2:51:41 – 2:52:02Speaker 31

Yes, thank you, Madam Chair. I just want to acknowledge that several committee members as well as Commissioner Patrick had proposed language changes to the resolution, and so I'm working on those. We should have those available hopefully by today, actually. And then, Commissioner Patrick, you were interested in co-sponsoring, but I wanted to make sure I got all the language changes done first before I –

2:52:03 – 2:52:58Speaker 6

Absolutely. Commissioner Terry, thank you very much. I think it's a great idea. I know the focus has been on data centers, but I would encourage us to think beyond data centers. There will be some new tech thing, some new something that comes to the county which is going to make the world great, and then it does until it doesn't. And we should budget realizing that everything has the initial surge, and capture that for our reserves for what you've proposed. And then as things stabilize from the budget and the revenues that come from that, then it goes into just that normal flow of keeping the government working. And ultimately, I think your purpose, if I'm correct, is whatever the tech, whatever the industry is that has the dollars that want to do this, you're welcome in DeKalb, but you've got to help DeKalb get ahead. Yeah, you got it. Thank you. Thank you.

2:52:58 – 2:53:32Speaker 11

Thank you. Seeing no further requests to speak, please open the machine for the vote on the deferral. Motion to defer carries. Item 2026-0744, all commission districts, a resolution adjusting all DeKalb County tire tip fees to $1. It's a PWI item.

2:53:33 – 2:54:00Speaker 6

Thank you, Madam Presiding Officer. This is actually Commissioner Terry's motion. If I recall, go back here one second. So I'm going to make a motion to defer for two weeks to the June 9 BOC with a prior stop at PWI. But I think Commissioner Terry also had a notion that we were going to have this conversation during our nighttime BOC meeting. OK. Second.

2:54:01Speaker 11

I have a second. And you've requested to speak. Go ahead, Commissioner Terry.

2:54:05 – 2:55:06Speaker 31

3.50. OK. Yes. Thank you, Madam Chair. And yes, Mr. Patrick's right. So the tip fee for the tires is contemplated in the sanitation rate tip structure. However, we haven't quite outlined it exactly and what's on that agenda item and so what i'll be looking for zach is just some consensus with the committee members on what the tire tip fee ought to be i understand from mr allen and looking at the other metro jurisdictions there is a i think sort of a standard 350 per tire that's we're working to get across all metro counties at the same tire tip beam And so this dollar tip fee was really just going back to the original, but if we can reach consensus on the rate structure with, I would argue, a lower tire fee, the $350 seems reasonable, then we can withdraw this item and then just factor it into the rate agenda item yield back.

2:55:08Speaker 11

Thank you, Commissioner Terry. Commissioner Patrick.

2:55:11 – 2:55:49Speaker 6

And just following up, I realize I may have made a little bit of a confusion. The town hall on June 2nd is going to be focused primarily on data centers. Pardon me, the Committee of the Whole on June 2nd is going to be focused on data centers, and we were tentatively considering a town hall to talk about the rate increases for the sanitation for stormwater, as well as a conversation about the dollar amount for the tires that we're coming up with. Zach, have you confirmed that we can move forward with a date we've been discussing?

2:55:49Speaker 5

I think that's fine. I think it was the third is the date that we settled on. I think that was the date we settled on. That's correct.

2:55:55Speaker 11

Yeah, I think we had started with the third, but I thought we needed to move to the Wednesday. I think it had to be the Wednesday.

2:56:02 – 2:56:58Speaker 5

We'll double check. We'll get something in writing out. Okay. But if I could just share really briefly on the entire thing, and that conversation will be in the context of other things that we're working on that I kind of mentioned, but... just to share, we anticipate in the very near future putting on the street kind of a P3 proposal that will allow vendors to bid for providing kind of recycling type service. So if and when we move that forward and if and when we get to the point where we have a vendor who can do that, that may necessitate reducing that fee or some sort of way of driving those tires from landfill they're not landfilled but from collection at the landfill to this other location so that's just some contextual discussions thank you mr williams all right seeing no further discussion please open machine for the vote

2:57:06 – 2:57:25Speaker 11

motion to defer carries bottom of page 28 item 2026-0769 all commission districts resolution requesting the administration to establish independent civilian oversight and auditing for dekalb county's digital shield initiatives and surveillance infrastructure and this is a erps item

2:57:27 – 2:57:38Speaker 21

Yes, ma'am. On behalf of the IRPS committee, I move to defer item 20260769 for two weeks. And that's the June 9th VOC with a prior stop in IRPS.

2:57:39 – 2:58:54Speaker 11

Second. If you all hit your buttons for me. Thank you. Motion to defer on the floor. No requests to speak. Please open the machine for the vote. Motion to defer carries. Just doing a quick time check. It's 1158. We are on page 29 of 35 pages. I think we can push through this before we adjourn. Let's do it. Thank you. We're so close, yeah. Thank you. Again, on page 29, item 2026-0862, all commission districts, an amendment to agenda item 2026-0396, changing the DeKalb County Day Center venue from Peace Baptist Church to New Life Community Alliance, Inc., at 3592 Flat Shoals Road, Decatur, Georgia, 30034, and reduction in overall costs of $23,077. And this is a PECS item. Motion to approve. Second. I have a motion to approve, seconded by Commissioner Patrick. Seeing no requests, one request to speak. Yep. Commissioner Long-Spears.

2:58:54 – 2:59:24Speaker 8

Thank you very much. I appreciate that. So I just think it's important for the public to know what's happened and how this item has evolved. So the initial location was Frontline. Then that didn't work out. Then it went to Salvation Army, and then that didn't work out. And then we went to Peace Baptist Church, and that didn't work out. Then we went to New Life Community Alliance. Can you just talk about, you know, each step and what has happened?

2:59:24Speaker 5

Absolutely. And Director Mitchell will come to the podium.

2:59:26Speaker 8

He's right behind you. Okay.

2:59:27Speaker 5

The original location was Peace Baptist. The location was not Frontline.

2:59:32Speaker 8

Okay. So at Peace Baptist, but Frontline was going to run it.

2:59:36Speaker 5

That was the discussion initially, yes, ma'am.

2:59:38 – 3:00:01Speaker 8

Okay, so the initial discussion was Peace Baptist, Frontline was going to run it, and then Salvation Army. Salvation Army was going to run it at their location. No, back to Peace Baptist. Okay. Then the third is, was Peace Baptist going to manage the project at Peace Baptist? Right? No? Okay.

3:00:01Speaker 23

No, that's not correct. Go ahead. I'll take it from the top.

3:00:05 – 3:02:17Speaker 23

OK, so initially you made reference that there's some discussion about Peace Baptist being the location which we actually got approval on March 10th by the board as being the anchor location for lease. At that lease location of Peace Baptist, we initially had considered but that was altered to Salvation Army. That's what got approved on March 10th in the legislation. Subsequent to that approval, we discovered that Peace Baptist wanted to withdraw their lease location as being an alternative because of various reasons with the community, the church, the parishioners, et cetera, thinking that a day center would have an adverse effect on a project that they're trying to implement which is to duplicate the City of Refuge and the City of Atlanta. So we had to find a new venue. So we elected to take the current provider, which we approved, which was New Life, and consider whether we could use their campus to not only provide services, but also to house the leasing of the day center. And so that was the amended legislation which we brought forward to consider a new location which would be New Life, 3592 Flat Shoes Road, District 3 and 6. And to have New Life also provide the services for the day center. The algorithm was that it was seven months at their facility and subsequently additional five months to provide services at a yet to be determined location that the administration would purchase. But New Life has a 12-month contract to provide services. However, the lease term is seven months with the idea that they would transition to a new facility. And what we plan to do is fundamentally look for properties between today and the end of the year to pull that off as opposed to acquisition. You would see that proposal in executive session if we choose to buy real estate. That's the sequence.

3:02:18 – 3:02:45Speaker 8

All right, thank you so much. So executive sessions are behind closed doors. I can't comment to that. My next question is this. So right now we've landed on New Life, which is great. I know we've had a good partnership with them in the past. And you did state that we're going to be looking for land for a campus. that we would acquire. Is that what I understood?

3:02:45Speaker 23

Yes, that's what I said, exactly.

3:02:47 – 3:03:00Speaker 8

Okay, so the expectation then is New Life will set up, manage the day center between now and the end of the year, is that right? Or for how long?

3:03:00 – 3:03:19Speaker 23

They've got their contract, which, if you're approved today, that contract would be, in essence, to provide services for a one-year period. However, the location would be seven months at their facility, and the residual five months would be at a facility yet to be determined.

3:03:21Speaker 8

Okay, so we get to the end of seven months, we have not determined a new location or facility, then is there an option to extend it with new life?

3:03:31Speaker 23

Yes, we'd be back requesting your permission to extend that location.

3:03:35Speaker 8

Yeah, obviously my concern is that if we go through the seven months, we don't want to close up shop and no longer have a day center when folks begin to rely on that day center.

3:03:46Speaker 23

Yes, we would obviously engage it and be back early rather than late to get your permission to alter anything we have in place.

3:03:55 – 3:04:56Speaker 8

Fantastic. Well, I'm out of time, but I'm going to request to do a follow-up, if Madam PO will recognize that. It's just fair. verify that no one else I couldn't get the oh sure no one else wanted to speak okay go ahead thank you very much okay so have you can you disclose any of the locations that you've looked at already I would say no okay but you're actively pursuing that is correct uh... talk to me in a little bit about the notion of having a day center at saint vincent de paul that's something i've been advocating for is to have more than one day center and dekalb county uh... i happen to run into some of the statements of the pop people last week they were kind of also inquiring and i were all excited about it so can you share the details there uh... yes i i could do that uh... i met with st vincent de paul on numerous occasions and we've got uh...

3:04:57 – 3:05:36Speaker 23

A proposal currently on getting ready to put legislation in place to, in essence, do the following, which is to use existing space that they own. It has to be renovated. It's 10,000 square feet. And it will follow the same functions of a day center. Also, we would use services that we have based on this proposal, which would be a work source to provide job readiness, et cetera. We're going to tackle the behavior health discussion as well. But their proposal includes us sharing in the renovation costs for the 10,000 square feet. They've got a very nice facility. I've been there a number of times. You have too.

3:05:37 – 3:06:18Speaker 23

And we're impressed with it. And they're also getting donations of food and other items to be able to supplement the efforts that are going to be going on at that day center. So their team is very excited about it. I plan to submit the legislation hopefully at the end of this week. You'll see that come forward. The macro budget is going to be actually under $2 million. It's going to be at or about, I'll gauge it between $1.5 to $2 million, probably slightly under $2 million, the total program costs for that facility. But you'll see that fairly soon. So we're excited about that opportunity.

3:06:19Speaker 8

All right, very good. So to open the doors of the currently proposed day center at New Life, what are you shooting for?

3:06:29Speaker 23

We're shooting for 1 June to try to do that. That's the tentative date. We've got some things we have to do.

3:06:36Speaker 8

In five days?

3:06:38 – 3:06:52Speaker 23

Yeah, we're working very aggressively. It might be projected out a bit longer than that, but that's the goal. The option here is that if we get approval today, and I hope we do, we have to get with law to get the contract. It's already been drafted, but they have to do the due diligence on the contract preparations.

3:06:53Speaker 8

I'm impressed if DeKalb can pull that off in five days.

3:06:56 – 3:07:29Speaker 23

That's pretty rare. It might be challenging, but we've got it drafted. We have to get law to look at it quickly, get it routed to all the signatures, and then have to provide a notice to proceed. And that will probably take more than five days. So my definition dictates a little bit further in the tenure of being able to open with a soft opening. It was soft initially, not 100 people. But we would gradually get up to that volume. But initially, it's going to be a soft opening to be communicated with a less number of people.

3:07:30Speaker 8

All right. Thank you so much. You're back. Commissioner Terry.

3:07:34 – 3:07:45Speaker 31

Yes, thank you. Just wanted to confirm, in terms of the shower and laundry buses, does New Life Party have that on site, or are we going to do the mobile shower and laundry?

3:07:46 – 3:09:20Speaker 23

The showers are actually there. They have showers in their facility and all the other wraparound services. They have barbershops and beauty shops and things like that in the closing. They have a lot of things that are already there. The transportation mechanism we explained in a previous meeting, which connects to legislation that Commissioner Patrick put in place, which is the fast track. proposal, which is $200,000 that you approved for the purpose of transportation. And that's going to be a local stop within the continuum of transportation. So this location will be, it's already been entered into the contract. It's been a specific location that they have to pick up. uh and also deliver individuals too so we have the translation covered via our front line via the fast track contract that's been approved by the board and it's in law currently being uh developed to be signed okay great so great timing because those two things will work well together um yes yes laura's already reviewed the fast track contract and i think it's right i think it's right up for signature i know i've had discussions on that okay that's great um but just to clarify the so there's showers on site but are there any laundry services they can have the capability to do the laundry as well there's one dryer that's there washing dryer but they plan to enhance that capability but you actually can wash things at the facility there are a number of showers already there in the facility as well okay but we plan to enhance the laundry capability we're adding TVs and furniture IT components things like that they're in the plan

3:09:21 – 3:09:46Speaker 31

I feel like I heard Frontline say that they maybe acquired Hope for Soap, or I can't remember the name of the organization. It's the mobile shower and laundry bus. So just while we get laundry services sort of integrated onto the new life site, will there be any mobile laundry buses that can come in just during that interim?

3:09:47 – 3:10:11Speaker 23

We have not looked at mobile laundry. There's not a need for mobile showers because they physically have showers. Frontline's reference to showers has to do with their facility, which we're using for the shelter, which we approve. But as far as laundry, we have to enhance the laundry capability because, again, we have one set of dryers, washing dryer, but we have to enhance that a bit. And there's a way to get that done.

3:10:13 – 3:11:07Speaker 31

could be possibly mobile it could be physically taking things to a remote location but we're working on that well i remember the um the organization that does the mobile shower and they do laundry just two separate things two separate buses um i remember it being relatively affordable in terms of their their costs so is that something zach that we could just i mean it's probably a few thousand dollars for a couple weeks you know throughout the next you know several months but since there's only one washer and dryer at new life on site and we might have potentially over 100 individuals at the day center could we could you all share a plan just on getting additional laundry services maybe a couple times a week yes i'll look at that i get back to you i'll let you know what our plans are we meet every wednesday to talk about implementation and that's going to be a meeting tomorrow at 10 o'clock so i'll come back i'll make a note of that

3:11:07Speaker 23

to get back and share the laundry mechanism.

3:11:11Speaker 23

Thank you. All right.

3:11:14 – 3:11:48Speaker 11

Thank you so much. Seeing no further requests to speak, please open the machine for the vote. Motion is to approve. Commissioner Perry. Motion to approve carries. Thank you. Bottom of page 29. Thank you. Thank you, sir. Bottom of page 29, item 2025-1577, all commission districts. Resolution of the DeKalb County Governing Authority regarding the Charter Review Commission's report and recommended changes to the Organizational Act.

3:11:51 – 3:12:03Speaker 6

Thank you, Madam Presiding Officer. The recommendation coming out of Ops was to hold this in committee. So motion to defer to the June 23rd BOC with a prior stop in ops.

3:12:03Speaker 11

Second. Second. I have a motion and a second to request a speech. Commissioner Terry, you were first.

3:12:11 – 3:13:49Speaker 31

Yes. Thank you, Madam Chair. So just two things that I wanted to flag as we discussed the organizational act. We haven't quite gotten to it in the committee meetings, but I think we'll have time because we're on track basically now to have this discussed. hopefully wrapped up for the next legislative session. So I'm thinking about next legislative session and how we incorporate the recommended changes that we're working on as well as some additional things that I think have been on the table for at least the last year and a half or maybe in the past. And one of those is a small change to just remove the word part-time from the Board of Commissioners sort of job description in the Org Act. And then two, I am going to be introducing a resolution at the next meeting. business meeting to create what they call a salary commission. This is something that's been done by the city of Atlanta, Multnomah County, Prince George's County. It's a pretty common thing in the county executive form of government. world and the the idea basically commissioners is that there would be an appointed committee from the commissioners that would work you know probably over the next four months or so basically before the legislative session to make a recommendation on what the salary should be in the work act that hopefully we can wrap up with these overall changes that we're doing in the committee. So just want to give you all a heads up on that and look forward to discussing that further. Thank you.

3:13:49Speaker 11

Thank you, Commissioner Terry.

3:13:50 – 3:14:07Speaker 8

Commissioner Long-Spears. Thank you so much. As everybody knows, this has been going on for several years now. So I wondered if any member of the Ops Committee could provide some feedback. Who's on Ops that's present with us?

3:14:08 – 3:14:21Speaker 8

Oh, okay. Well, Commissioner Bolton, I'll direct the question to you then. Any idea when y'all plan to hopefully wrap up the going through the document and hearing from Charter Review Commission members?

3:14:22 – 3:15:18Speaker 21

So we have every ops meeting, we've addressed some of the issues here. We've had special call meetings as well. We have actually done a pretty good job getting through the items. We've identified what We could accomplish through home rule what would take legislative action and what are some of those things that legal thought was toting the line that we would have to address. We've gotten through all of the home rule items. We've started to address some of the others. We will definitely, I'm sure, get through all of this before the next legislative session as long as we continue to have time to get through our special call. We're supposed to have a special call today. We're going over. It's canceled. Right. So we're not going to be able to have that today. But outside of today's cancellation, we've been pretty consistent with addressing the issues that have been put forth and recommended by the commission.

3:15:19 – 3:16:36Speaker 8

Very good. My next question just goes to more of a realistic timeline moving forward. So Ops happens on the first and third Tuesday of every month, which aligns with our Committee of the Whole meeting. No more in May. We'll have, I guess, two ops meetings, the standing ops meetings in June. And then, Madam PO, July has no Cal meetings, correct? Okay. Is there a plan to have a special called ops meeting in July? And, Commissioner Bolton, the reason I ask this question is that with that one-month recess, If you don't do a special call, we only have really two more ops meetings until the third week of August. And I was the individual that initially sponsored an item to review this a couple years ago. That really didn't happen. And so the CEO brought forward this item. But in the initial item, the way that I wrote it was to leave Q4. the opportunity for our delegation members to discuss it. And so is that something that you guys have considered in this new timeline?

3:16:38 – 3:17:01Speaker 21

So and I don't want to speak on behalf of the chair. That's fair. However, I will say we have not discussed special called during that four week recess that we are having. However, that's a discussion we can have with her because she has been very adamant about the special call. Understood. Yes.

3:17:01 – 3:18:02Speaker 8

And I'm not suggesting that it occur during the recess, but what I am suggesting is that while there is no Cal meetings in July, we're just doing two business meetings. Unfortunately, ops happens on the dates of our Cal meeting is that it might be a good idea to try to schedule that special called meeting prior to recess. So there'd be three opportunities to hopefully at least get much closer to wrapping this up. And then there is the third ops meeting in August. So that would, in effect, if you did one special call before meetings, because it would be awesome for us to be able to finalize this vote on it, continue the debate, and then be able to turn it over to our delegation members by end of September. So then they would have October, November, and December to review and provide their input and ask us questions about it. What do you think about that?

3:18:03Speaker 7

Your opinion as an ops committee member.

3:18:07Speaker 8

Are you also an ops committee member?

3:18:09Speaker 8

OK. All right.

3:18:11Speaker 6

I appreciate all the dialogue, but I think we should perhaps wait for our chair to come back. Sure. Yeah, we acknowledged that while you were out.

3:18:19 – 3:18:57Speaker 8

So I'll just make my point, is that this process has been going on for literally years now. I would love to be able to finalize it and get it to our delegation members by end of September so they have three months to review it, ask us questions, maybe they, you know, want to come to one of our CAL meetings, address us all. However they want to do it, I just think that we need to be respectful of their demands and time. and have this to them where they have several months to review before the session starts in January. Thank you, and I yield back.

3:18:58Speaker 11

Thank you. Commissioner Messiah.

3:19:00 – 3:20:18Speaker 15

Thank you so much, Madam PO, and I appreciate respect that it is best to wait for the chair in order to identify what specifically additional sessions we're going to have. But then also to that end and the timing, and this is like our constitution. And I really would suggest, because I know that we've had some conversations, some of us, with legal in terms of the proposed changes, so that we get with our central staff and have conversations with our central staff with our chief of staff and legal before we try to finalize suggestions up here on the dais. I think there's a lot of suggestions that are made while we're up here and it unfairly doesn't give an opportunity to the individuals or entities I just mentioned to really be able to talk us through those suggested changes before we suggest implementing them amongst one another here on the dais. You know, maybe some more conversations with legal central staff will get us a little further along to where we're trying to go to get this done in enough time to be able to present it to the delegates. With that, I yield back to you, Madam PO. Thank you.

3:20:18 – 3:20:45Speaker 11

Thank you, Commissioner Messiah. See, I'm getting tired, too. See, no further requests to speak. Please open the machine for the vote. Motion to defer carries. We are now moving to top of page 31, Public Works Roads and Drainage, item 2026-0587, All Commission Districts Proposed On Water Utility Fee Increase.

3:20:48 – 3:21:01Speaker 6

Yes, Madam Presiding Officer. Motion to defer two weeks to the June 9th BOC with a prior stop in PWI, and this also gets into that notion of a town hall that we're considering to talk about the two rate increases.

3:21:03 – 3:22:02Speaker 11

Thank you. Second. Thank you. Commissioner Terry got it. It is PWI item. Seeing no request to speak, please open machine for the vote. Motion to defer two weeks carries. Middle of page 31, purchasing and contracting for Ops Committee. Item 2026-0634, change order number two to contract number 1192609, Tyler Cloud Hosting Services Migration for the IAS World Software. sole source for use by the Department of Innovation and Technology to obtain three-year cloud SAAS hosting services to assess and collect property taxes seeking increase in contract funds and term through December 31st, 2029 awarded to Tyler Technologies Inc. amount not to exceed $4,094,807.88.

3:22:08 – 3:22:19Speaker 6

Yes. Based on the recommendation of the ops from May 21, the recommendation was approval, and this was supported by the audit. So motion to approve.

3:22:20 – 3:23:15Speaker 11

Thank you. Is there a second? Second. Motion and a second to approve this item. Seeing no request to speak, please open machine for the vote. Motion to approve carries. Top of page 32. We are purchasing and contracting for PECS items. Item 2026-0614, Commission Districts 3, 5, 6, and 7, change order number two to contract number 1373363, restoration and maintenance of athletic fields for use by the Department of Recreation, Parks, and Cultural Affairs. This contract consists of site restoration and maintenance of athletic fields. This request seeks to increase contract funds and extend the contract term through August 31, 2026, awarded to JMB Landscaping Inc., amount not to exceed $200,000.

3:23:15Speaker 15

Motion to approve.

3:23:19 – 3:24:14Speaker 11

Is there a second? Second. Second. Thank you. Seeing no requests to speak, the motion is to approve. Please open the machine for the vote. Motion to approve carries. Now onto PWI Purchasing and Contracting Items, middle of page 32, item 2026-0232, invitation number 2025-066-ITB, Chemicals for Odor Control, for use by the Department of Watershed Management. To obtain chemicals for odor control, recommend award to the lowest responsive and responsible bidders. Acuity Specialty Products, Inc., doing business as ZEPP sales and services. Breakthrough Solutions Janitorial Supply, Ferguson Water Works, People's Janitorial Supplies, Inc., and State Industrial Products Corp. Total amount not to exceed $494,049.15.

3:24:18Speaker 6

Thank you, Madam Presenting Officer. Based on the recommendation of PWI, motion to approve.

3:24:23 – 3:25:21Speaker 11

Is there a second? Thank you, Commissioner Terry, for the second. Seeing no requests to speak, the motion is to approve. Please open the machine for the vote. Motion to approve carries. Thank you. We're now top of page 33, and we were just handed a substitute. Item 2026-0477, invitation number 2025-123, ITB, right-of-way mowing and maintenance services. for use by public works, sanitation, and beautification to obtain mowing and lawn maintenance services at various right-of-way locations, reserves the right to transfer funds between contracts based on the needs of the county, recommend awards to the lowest responsive and responsible bidders, re-image general contractors, and Russell Landscape LLC, total amount not to exceed $719,650. Yes, Madam Presiding Officer.

3:25:29Speaker 6

The recommendation and the motion is to approve the substitute out of PWI, and I do have a comment to follow.

3:25:37Speaker 11

Okay. You second that, Commissioner Terry?

3:25:40Speaker 11

Thank you. Commissioner Terry, you've requested to speak.

3:25:44 – 3:26:33Speaker 31

Yes, thank you. I did have a chance to, we did ask the administration to provide a GIS map. The maps. Commissioner Patrick did. Yep. So I would like to have that preferably online so we can look at it. But I did, go through a couple of locations, Zach. It looks like maybe three, maybe four locations are actually in city limits. And I know we use unincorporated funds for this. So I think we just maybe, if it's possible, Mr. Chair, to bring this back to committee just for one final review. And I did notice there was one road that had previously been, I think, on a previous year's list but was removed, North Decatur, from Memorial to Scott Boulevard. So I just wanted to add those in for tweaking the list.

3:26:33 – 3:26:58Speaker 6

Commissioner Terry, to your point, my comments were going to be if this is a hot rush that we need to approve this or if we've got the time, I would like to be able to get those maps for actually both of these items to come back to us so that not just us as the PWI committee, but the whole full board can see the streets that are being contemplated, the right of ways that are being considered, and just make sure that if there's something y'all want to add to it, we add it to it. So Zach.

3:26:59 – 3:27:17Speaker 5

Absolutely. And you see, I sent an update earlier today. We did get some map, very busy map. So if the board wants to send it back to committee, that'll give us sufficient time to have not only distributed updated maps, you can react, ask whatever questions. We can double check with commissioners.

3:27:17Speaker 6

And we're not going to be putting the county any harm with having no service? There's someone there to still do whatever's going on right now?

3:27:23Speaker 5

We can make it work. OK. Even if we continue on the service. OK. All right.

3:27:29Speaker 6

If that's the case, then I'd like to make a motion to defer to the next BOC. I guess that's June 9 with a prior stop at PWI. Second.

3:27:40Speaker 11

Thank you. So you're amending your motion to defer. Your second stands. No further requests to speak. Please defer the substitute. One request.

3:27:50 – 3:28:11Speaker 6

Once we get the map, commissioners, if you would, please take a look at the maps. Our GIS team is putting them together. They are GIS maps, so we'll be able to see them web-enabled. And it will highlight the areas that are maintained and not maintained. And again, if there's concerns in your district, please, this is the time to speak up and add them in. Thank you, Madam Presiding Officer.

3:28:12Speaker 11

And I will commend GIS. That request for the maps was made on Friday. It was. Before our holiday. So the fact that you got us anything is impressive and appreciated. Thank you.

3:28:24Speaker 10

Please open the machine for the vote.

3:28:32 – 3:29:02Speaker 11

Motion to defer carries. Okay, so now we are on item 2026-0627. There is also a substitute for this item. Snapfinger Advanced Wastewater Treatment Facility Membrane Bioreactor for use by the Department of Watershed Management to ratify a down payment for an emergency purchase awarded to Covalis Separation Solutions LLC amount not to exceed $550,000.

3:29:06Speaker 6

I'm sorry officer you took my steam away.

3:29:08Speaker 11

Well I had to read the number.

3:29:11 – 3:29:49Speaker 6

Get a little bit of drama out of PWI. The original request was for $5,360,000. Our team who pays attention to public dollars very responsibly was able to reduce that down to $550,000. I don't know if Reggie is here to speak more directly to it but as I understand there were a couple of other contracts that were in place that took care of the need for such an amount of money on this particular contract. And so we were able to reduce that down again, almost $5 million. So kudos to our team for looking into that. And with that said, motion to approve the substitute.

3:29:50Speaker 11

Second for purposes of discussion. Okay. Commissioner Long-Spears, and the motion is to approve the substitute.

3:29:56 – 3:30:24Speaker 8

Thank you so much. All right. So the substitute was just distributed, and I certainly applaud Commissioner Patrick and the team that was able to reduce it down by $4.8 million. Can you just advise us what that difference looks like and That's pretty substantial when the initial was $5,360,000. Now it's down to $550,000. So I'm just trying to understand the $4.8 million gap and the service levels between the two contracts.

3:30:39 – 3:32:10Speaker 17

Good morning, Commissioners. Good morning. What we're doing under the consent decree, as you know, the courts have access to look at specific projects, and that's what we did, which is why a lot of them are being ratified now, because they did not exist until we started looking at them last year. This component is going to expand the treatment capacity at our wastewater treatment facility, Snapfinger, and what we did was we roll that into we put down an initial deposit and then strategically decided to roll it into another contract where the contractor will be responsible for getting that membrane type on site securing it and the installation of it so they will be undertaking the additional payments during the manufacturing process of the membrane. So we only did the down payment of it and we were supposed to pay the additional amount what you saw previously. The strategy has changed in that the contractor will undergo and undertake that responsibility. So the risk is more on the contractor getting everything on there. So it really benefits us, and it reduces the amount of this item.

3:32:10 – 3:32:26Speaker 8

Does that help? It does. So at the core of this is really just a change in strategy. The $550,000 is a down payment, not the $5.3 million, which would have been the whole The whole thing. Package, basically, if you will.

3:32:27Speaker 8

And you have then diverted those dollars. It's still a $5.3 million project.

3:32:32Speaker 8

OK, as long as we're clear.

3:32:33 – 3:32:44Speaker 17

But the contractor now has to manage that payment, the installment payment, getting it on site, whatever date. And they have the installation responsibility.

3:32:45Speaker 8

So the new strategies just provided us a layer of protection. Correct.

3:32:50Speaker 17

OK. From that risk.

3:32:51Speaker 8

All right, I just wanted the public to be clear that it is still a $5.3 million project. We just have a different way of approaching it. Thank you so much, and of course, we always appreciate you, Maria.

3:33:01 – 3:33:58Speaker 11

No problem. You're back. Thank you. Seeing no other requests to speak, motion is to approve a substitute. Please open the machine for the vote. Motion to approve the substitute carries. We are almost there. Top of page 34. Excuse me. Item 2026-0655, renewal of contracts number 1381670. and 1381672 Litter Removal Services for use by the Department of Public Works Sanitation and Beautification to obtain year-round litter removal services on various roadways, exit ramps, and medians, exercising second renewal option through June 30, 2027. and adding Department of Watershed Management to the contract, awarded to American Eagle LLC and Russell Landscape, total amount not to exceed $1,435,487.32.

3:34:04 – 3:34:39Speaker 6

All right, Madam Presiding Officer, this item was conditionally recommended for approval out of PWI pending the GIS map. Again, acknowledging our staff has worked quite well over the holiday but hadn't quite gotten there just yet. So I'm actually going to make a motion to defer to the June 9th BOC with a prior stop at PWI. And again, commissioners, this is an opportunity for once we have that map ready. for you all to be able to look at it. And if there's additional areas that you want taken care of in your district or feel need to be taken care of, this will be the chance to come back and get it to us at PWI and then get it formalized here through the VOC. Thank you.

3:34:40 – 3:35:06Speaker 8

thank you and there's a second commissioner long spears thank you very much and i'm not certain if this question is directed to uh commissioner patrick or someone from the administration um you know thank you to gis for what you're doing there and i look forward to receiving it if i do identify a location i think that needs to be serviced do i send it to you or to who i i would recommend sending it to mr williams zach and zach is responsible on his side of the
