be here to uh take that up and do it in February instead of tonight so can I have a motion the agenda second okay any discussion seeing none all in favor signify by saying IO the same sign we're going to move into Community Development Gwen all right we've got an update of part 13 of the city building code related defines and penalties and bridges can be coming up uh to discuss that with us many already looked ofal devel Department civiles with the Mr and the felonies there is a different level of evidence and requirement we have found the Civil offense mechanism to be the most effective and using civil fines um it was brought to my attention because I actually was looking in for that we actually had not changed the actual building code to civil offenses we still had criminales in there um and so we for example if somebody builds a deck and we go by and check they don't have the permit uh we spend a warning and tell them it's a civil offense well it turned out it actually was a misor some with so I went through that building code and um changed it to match the language that we used for our rental licensing program of property maintenance so that everything is consistent I will tell you L back next month because I did notice some other things in this ch uh that need to be addressed one is that the property maintenance code was actually its own chapter 14 back in about 2010 and the former law director at that time had not stricken the property maintenance code sections that were under the building um Department I mean the building code I did not do that

this time because some of the language and some of it I want to make sure that we have what is in um that our property maintenance code under includes all of the same language so until I'm sure I I wanted to hold off on that I also want to mention and I know that this has been for heid will remember and Mike and some of those others we have a chapter for uh registration of vacant properties that chapter was not written by the Law Department nor staff it was written by a member of council and his name was Eric Benta great guy it was his it was his office before he moved and left Council um and the books and we have literally not been able to implement it this includes during the housing mortgage crisis when we did have vacant properties it's got subjectivity in it and issues I can tell you theer vacer other mechanisms which I'll go into detail next month but I'm probably going to come back and ask for that chap taken out as well so today I'm just asking for civil off the penalty the entire build toil so that we can consistent and all right thanks Bridget uh questions from Council yeah I yes Roger I'm just curious Bridget can a can a civil offense ever become a criminal offense if you notice the wording in there actually allows us to use other legal mechanisms Eric's refrigerator caught on fire this week so I have not met with him we do have we do have three cases where we've been using civil offenses one is actually for a uh garage that had caught on fire that needs to be demolished and the GLE continues to pay the fin um so I we are going to seek um basically we're going to go for injunctive relief in the court basically ask for that and we have a contempt on a rental licensing inspection that will also be going so we can and do uh do that but we do find that we get further
