CONTINUED PUBLIC HEARINGItem 2

DRAFT ORDINANCE FOR A ZONE CODE AMENDMENT ("ZCA") TO MODIFY MONTEBELLO MUNICIPAL CODE ("MMC") CHAPTER 17 AND ESTABLISH A VIEWSHED PRESERVATION OVERLAY

RECOMMENDATION: It is recommended that the Planning Commission conduct a public hearing and take the following action: - ADOPT Resolution No. 08-25 recommending the City Council approve Zone Code Amendment (Case No. PC-2025-0006-ZCA) amending Chapter 17 of the Montebello Municipal Code adding Chapter 17.41 - Viewshed Preservation Overlay to protect and preserve significant public and private views; and - DETERMINE AND FIND that the project is exempt from the California Environmental Quality Act ("CEQA") pursuant to the "Common Sense" exemption set forth under Section 15061(b)(3), which provides that CEQA applies only to projects which have the potential for causing a significant effect on the environment, considering that it can be seen with certainty that there is no possibility that adding a viewshed preservation overlay will have a significant effect on the environment and pursuant to CEQA Section 15303 related to construction and location of limited numbers of new, small facilities or structures, and the conversion of existing small structures that are consistent with the City's general plan policies and zoning regulations.

MODIFICATION TO CONDITIONAL USE PERMIT ("CUP") NO. 07-71 TO AUTHORIZE THE RECONFIGURATION OF THE EXISTING FORD OF MONTEBELLO AUTOMOBILE DEALERSHIP LOCATED AT 2747 VIA CAMPO, INCLUDING THE CONSTRUCTION OF AN APPROXIMATELY 21,850 SQUARE FOOT FIRST FLOOR ADDITION CONSISTING OF APPROXIMATELY 30 NEW INDOOR SERVICE BAYS, A VEHICLE DISPLAY AREA, RESTROOMS, A LUNCH ROOM, AN ELEVATOR, AND AN EQUIPMENT ROOM FOR THE ELEVATOR, AS WELL AS AN APPROXIMATELY 29,300 SQUARE FOOT ROOF TOP PARKING AREA CONSISTING OF 57 STANDARD PARKING SPACES AND A SEPARATE INVENTORY PARKING AREA ("PROPOSED PROJECT")

RECOMMENDATION: It is recommended that the Planning Commission conduct a public hearing and take the following action: - ADOPT Resolution No. 09-25 conditionally approving the construction of approximately 30 new indoor service bays and related appurtenant structures within a new 21,850 square foot first floor addition along with an approximately 29,300 square foot roof top parking and inventory area for the property located at 2747 Via Campo, and make related findings that the Proposed Project is consistent with the Montebello General Plan; and - DETERMINE and FIND that the foregoing actions will not include substantial changes and/or cause significant effects to the environment as described in Section 15162 of the California Environmental Quality Act ("CEQA") Guidelines, nor result in any new impacts or increase the significance of environmental impacts beyond those identified in the previously approved Initial Study/Mitigated Negative Declaration ("IS/MND") (Case No. CUP 07-71, MOD 02-16), and therefore approval of the attached Addendum to the MND is appropriate.
