And they're just now starting their third generation ownership under the Johnson name, which I'm not sure how long they've been there, 55 years at least. since he graduates from high school. But, and probably about 99% of the buildings that have been built in the last 78 years have come out, concrete's come out of that plant. It's pretty cool. Yeah, and they could use it. They need a little more room to maneuver around. I hauled out of there. I've got work for them down there on that thing, and then fire goes flying by and in and around and everything. But all I got to say on this, you know, they've been good drops all the company for 78 years. And that.

Yes, actually. Just as a matter of practice, our parliamentarian has reminded us that a first review is not really an approval of the ordinance, right? This is just the introduction of the ordinance to the council. There is time to edit and change things between the first and second reviews. This may or may not be the final version, right? So the motion that I think we have to make is to forward the recommended ordinance reading rather than an approval of the first reading. And I know that sounds very semantic-y, non-issue, but just to make sure that we're correct. Do I have that right, Chelsea? Yeah. So just to make sure we're clear, this is not an approval of final ordinance. This is just introducing the ordinance to the legislative body. The legislative body can mold, mend, or whatever, which we're not looking or trying to propose anything in this case, right? It's just as we get to the next one, that'll be more relevant.

I know that they don't care if everyone is provided with a special exchange of issues. It's actually all out there in the first year. It's going to be the second discussion. Question. Question.

Yes. Ordinance number 2026-04, an ordinance providing for the partial street vacation of the 60-foot portion of Elm Avenue between 1st Street and 1st Street in Section 25AC and 25AD of Blocks 5 in Town of Lincoln, now Tillamook, Tillamook County, Oregon.

Thank you. Next is ordinance number 2026-03, which was called First Reading of Ordinance, amending portion of Chapter 72 of the Potomac Municipal Code relating to downtown Perth.

Okay, so this is not the first time you guys have seen this. We saw this at your last meet. And since then, we've worked out some some things. But the other thing that I want to remind you about ordinances, especially when you get into changes, I've been in local government for close to 20 years now. I've yet to find the code change that was a thousand percent perfect the first time I got presented. No matter what we do, no matter how well we get this tweaked the way we want it, six months from now, we're still going to find something that, gosh, we wish we would have done that different, and we'll have to come back and do that. So the code is a living dog. It's never finished. And one of the things that I've started since I've been here in the last year is we want to go through our entire municipal code and update and fix things as we go. It's a slow process. which is why we're trying to take care of high priority things. One of the priority things that we were given was downtown parking. And so that's where we find ourselves tonight. Last time we met on this, there was discussion about penalties and concerns about aggregating penalties and such. As we went back, we talked to the attorneys, and what we reminded ourselves that I did not present well at the last meeting was that these penalties or any citation issued under this is a citation for that day. That day, the next citation can come in. There's the citation language that talks about whatever the price the council wants to set for the citation fee. say we call $50 for the purpose of the argument tonight. If we have $50, that citation can be anywhere between 50 and the $1,000 limit that the state puts on us for these types of violations. The next citation can be 50 up to 1,000. These citations are not cumulative in the sense that this one doesn't build on this one, and then once you hit 1,000, you don't have to do it, or 750, then you lose it. They are each individual created as individual citations within that window, right? So... The extra part of that is we have currently a three strikes type mechanism where you don't get towed until you've issued a written warning and then a ticket and multiple tickets and then the city can tow you for that. We find that to be a little bit problematic in this instance, especially on the tier one style permits, because, and Justin, I'll use you, just because I like using you as my examples. If Justin buys a permit for one of the 27 spots that is by permit only, and you were to come in and find that there was not a spot available, some of those parts inappropriate that he or doesn't have their permit displayed, then rightfully, he's gonna say, well, I paid for this permit, I need that person's vote right away. And under current code, we wouldn't be able to do that. We'd have to go through a written warning, multiple citations before we could do that. So we needed to make a couple of changes to the end. And this is changes that I will discuss with you tonight, but I don't have, so I'm not sure, Chelsea had some changes for me, but they were not in the patent. specifically for the reading. This is why I mentioned earlier that between first and second reading, we have opportunity to discuss and to change and do things. So, one of the things that we would like to do is add some language that allows authority to toe on the Tier 1 permits at a first But we want to give the opportunity to tow more flavor. The other things, there are a couple of tech sets that we've made in a couple of the areas that are non-substantial. But one that was substantial was in 72.087. where we've changed some stuff because we've talked about the storage of vehicles. Remember, we're changing 72 twice. The first one was for the storage of boats, trailers, RVs, and whatever. So we took motor vehicles out of the storage in the sense that we want people to park their cars on the street instead of the boats and parks. But in here, we needed to add motor vehicles back in to make sure that it was part of the code for the downtown parking restrictions and making sure that we had the ability to, that we couldn't force on cars, right? So it's those types of tweaks that we tried to make and that we will make in the coming, before this comes back to you as a second read. And then again, for 72085. And then in your packet, we did restructure 72.999 so that we added those violations for parking specifically back in. So it wasn't just one violation of $250. It was, we had a separate line item for parking, which is very similar to the way that it was before we started tinkering with it. So that's basically the update. What I recommend today is I've described what these are to you. I'd like us to get past the first reading, and then we can bring more edits back. The process that we have is you open up for a first reading. We can have second reading. We can have third or fourth readings. You're not limited to two. You just have to get to it, right? And so we can tweak this and massage it as much as we want. I would like to get to the first reading to keep on our timeline for October, because then we can bring it back with a second reading with some of these tweaks that I've described tonight, along with a couple of others, and back to your next meeting. And that's kind of where we'd like to go with it. But I'll leave it to the Council for distinction.

I think it's suggested in terms of the last meeting, the parking permit, the instructions, and the cost time that we debate and need to be discussed. So to me, this is psychology, this is what we're for. We get $65, which I think is, Is there a requirement that it has to have written warning first?

No. In fact, we've taken that out of the parking, or we plan to take that out of the... That will be coming up? Yeah. That's one of the changes that I just described a while ago that we wanted to make before the second reading is take out the requirement for written warning. So that, you know, we can just go straight and take it. We always, whenever we do enforcement, we want to educate the workers, right? But sometimes you just have to give a ticket. And so we want to give that flexibility to our people who are enforcing the ticket.

And what you're saying is we need to do a first meeting tonight and give you all some more time.

Well, the more time is your next meeting is when we help you during it.

It'll be about the first week of October.

Don't give us exactly October 1 because it's not 30 days. But we're not stretching into November. Anybody else?

All right. First will be the YMCA public art mural. I want that again.

This is for each other. This is the front of the building there. I believe it's 15 feet tall or 65 feet wide. The mural will look somewhat like this. It's just a sketch, but he also is the chart of what happened in Liberty School. So along the city lines. The mural is to represent the youth in the YMCA and the spirit of the occupation that they bring, which is a very similar nature, I would say, to the school. It's just saccharified. And the mayor will often see us through those four yellow lines, you know, these skyline. I mean, they need to be like, no one's concerned. It should be fine. Indeed, it's open. They ought to be speediest. There were no public comments received. So not public notice. We unified the site. We posted the site. No comments were received. And then, according to the P.O. 1 of the New York Public Health Guidelines, they vote, they will have to follow that resolution C-17. I found to applaud everything, everything is good. I just had three, I had five conditions that I just went by that really had it. Two were quite good, I had a very good BS, but it was in the important event. The applicant shall make his name according to Section 2C or the resolution. It has to remain in place for a period of, a minimum period of five years, and they are responsible for the needs, you know. And then any future marketing of those to promote the annual exhibit must follow the guidelines in the Resolution 1678 and the top of that box, so. That's the way that I found it to be able to follow the criteria.

Is that code that it has to be named for finders?

Yeah. Yeah, there's a map. There's a picture.

Um, just for the record, and the audience that may be here for the sider. This is not a kind of decision time for this. I was asked the city manager prior meeting to bring this item up on future agenda. And before we had any substantial discussion, I want to provide the mayor and council with as complete a history as I could. And so we put together a 30 page. back and forth, basically, the history. The Reader's Digest version includes the Chronological Council Actions, and that overtakes us, So, but the, the big 1 is on September 7th, 2018. There was an approval of a motion that closed 2nd street, possibly traffic and retain as a positive only. The vote was 3 to 3 in May or whatever, pass the tie breaking vote in favor, resulting in 4 to 3 approval. And you can see that in an exhibit and that we have provided for you. The big thing here is. Frankly, the plaza is somewhat of a double-edged sword for us. As we saw earlier tonight, we vacated, the council chose to vacate or start the process of the vacation of Elm between 1st and 3rd. 2nd Street, where the plaza sits, has never been vacated. That is still a public roadway. There is some. Question about. The question really becomes, does it want to be a closed pedestrian. For lack of better word or. Or parkway that is just your foot traffic only with rare exceptions. Or is it a street that allows traffic all the time? There was a question earlier. About, um. The titles in there were designed in such a way to mimic parking stalls at an angle. Those parking stalls do conform to our standards. They would not conform to our ADA standards. So if there was a proposal to make it open and make that ADA stalls recurrent, go against the decorative nature of the papers that are already there. We're already starting to see the impacts of weight of vehicles on those as many of the papers are wrapped and some heavy equipment has been brought in. It's also a, from a management perspective, it's somewhat of a headache because every time somebody asks us for that to be opened or closed, we send out a public works employee either from on call or whatever to open and close the bonds, right? Which takes that time and can happen 7 a.m., 6 p.m., you know, all day. We're paying out some overtime just for turning the key. As a city manager, I really don't have a preference. If the council wants it to be a street, let it be a street. If they want it to be a street that's only closed for festivals, let's do that. If we want it to be a plaza that's only open for certain instances, let's do that. What I want to get to is some sort of final resolution and something where we can get out of this middle ground we seem to have been in last year. Um, and which is why it's important. The council council made the initial decisions. It's not a city manager decisions. It's not a policy direction. I'll follow whatever the council wants. I really don't have strong feelings either way. I just wanted to make sure council had. The full information, so it wasn't a. I remember we talked about this, or I thought we talked about that. YOU'VE GOT THE MINUTES, YOU'VE GOT THE DOCUMENTS HERE FROM EVERYTHING ON WHAT IT WAS, INCLUDING AN E-MAIL FROM COUNCILMEMBER OXFELMEYER SAYING IT SHOULD BE CLOSED. SO THAT'S WHERE I STAND ON IT. I'M HERE FOR DISCUSSION, BUT REMEMBER, WE'RE NOT MAKING A FINAL ACTION TONIGHT.

ANYBODY WANT TO GO FIRST?

I didn't know I was there were a few of us that were there for it I know there was a lot of talk about what the plaza could be what it was hopefully it could be covers over a triangle shape really cool looking shaded things because it was going to be used all the time as a plaza but how many years ago that was How many times does it get used? That's that. How many events do we have there? The thought was, if I recall correctly, safety-wise, because it was gonna be events all the time, you didn't want people driving through and we didn't want all that. Well, I think history has shown that it's not a lot of use like we thought it was, or the talk was. So I don't know. I was just reading that too. Just, you know, at the time we'll talk about, you know, the cause is not that, I mean, you've seen it for events based on the U.S.

And so that's where a lot of you guys just take those. I think that there's one of the dark, you know, the biggest possible brought up access, but that is still a road. If you put in your GPS to be trying to get to the left at all. You know, from the South, you go to turn and having a mother or one's a store on that order. She was like, you're in no idea on people turning that up. And I didn't even bring up. She's like, what is wrong with this? So, I mean, there's, you know, sounds right, but we have to, you know, decision wise, we have to make a decision because that means the currently registered as a screen for people um i i think that you know really feel downtown over the years there's great politics spaces as we go and there's a lot of positive things There's an opportunity for us to address the lack of BVU spaces in 9L. There's zero threshold curbs from when it's not BVU spaces to sidewalk. And so Well, that was what my question was. How many could you? Because I think if you rank, you know, there's a lot of fans. They were thinking, I'm not sure. I think it would be comfortable. um there's not a one way on the end so first i'd like to see this building as a security um i've talked with sean rj about uh opportunities for Curve stops that are in the poly, so they're easy to lift out. I saw a design in another space that was an open space where they actually put slaves in the ground. And the drop stops had small slaves that were in them. And so they could actually just come up and come down. And when we came out, there wasn't really much that came out. So part of the whole thing is when it's flushed. So I think there's a lot of opportunity here. And I would like to see, I'd like to see it in one of the chapters. We're the worst of both.

I'll say with having my mom in a wheelchair, it makes a big difference. So it limits where she can go. Not all handicapped spaces in town are accessible by the wheelchair and stuff. So it would be nice. I don't know. Like I said, three, four, whatever we can do. It would be nice. We have people park at our shop with wheelchairs just to go down because it's easy. So I think it would be nice.

I sat through a really good discussion about it for years the other day. And I kept waiting for the really strong advice on why I should not do it all the time. And it just shut up. And there never was.

So the whole time that this came up then and now, I distracted myself and said, We'll see if I also, it's finally a study. Also, I would like to use a locker and some of my students. That would be great. I am not perfect, but we may find out. We'll also get businesses on there now. But I guess we'll discuss that three years ago when I was in the council. You know, you have to know where the guns are.

The only thing I can think of is if we're concerned about how long the traffic is going through or maybe too big a vehicle trying to get through there. That's the only thing I can think of. But that's still not enough reason to not be what I think it seems to be an organization I can think of.

We have a number of places where you can go out of the way onto a neighborhood city. They're not being held shut because of their identity.

The thing that can be found in the community, perhaps it's far more than we need, but if you impose it, even if it's a graveyard, it's not something else you would have. You just find that they're going to want more than one through several .

Well, right now, if somebody doesn't know anything from here and doesn't remember this course, it would be as if it's still . So, you know, I don't think they're changing that. They're actually investing in the .

speech question what we would do from a policy directive is if the council and there is a process here right the council cannot make a decision on it tonight um this would come back on a future agenda with a different resolution which would either have to repeal the resolution which passed in 2018 or ask for that to continue those are kind of the two decisions right um so we would have to draft the resolution repeal that which is why I'm taking the decision to not have that supported. The process that somebody would go through would be just the same as any other road closure. You have to submit a special event permit or a construction permit. We would process that generally. takes a week or so. And we require 72 hours notice before we close the road because we need to provide notice to the surrounding people and to the cars that are there that they need to move. So we've got to know parking out there, you know, so that people aren't parking there. So we don't have to move cars or tow cars when we go to close the road. So, we would give that 72 hours notice, then we could. Close the road, and it would be closed for whatever period that event would be. So that would be the practice and the policy of it is it would just fit within our existing policies for.

And currently, you see the problem. What's the process.

The same thing we require a special event for me for every for every event that goes in so so it really doesn't change anything for the end user on how to get there, other than we get out of the road, the closure piece and i'm going to turn with you. yeah. So.

The constant learning on all the websites right yeah. Now there's right on your friend step one seems to be. A stressor I don't like somebody who's we just figure out. So I think it is, I guess, so are you looking to do your motion to going back to correct.

What I recommend, Councilmember, is let's maybe, if you want to keep it, well, no, no. What I want to do is some sort of direction from the Council to bring back a resolution repealing the resolution that was passed in 2018.

So we'll go back. You can give me a

that consent, then it wouldn't have any status. Lane, I just wanted to make sure that it was all in the record that the council was directing the manager to bring this back.

I'd like to make a motion that City Council direct the City Manager to re-direct the resolution. In carrying the previous resolution of the corridor of 2nd Street with the direction that Settlement City will be re-opening, now into traffic, and those four impacts. Do you want me to get involved in any of that?

Well, I think that's, we'll have to discuss that because that's, there's money involved in that. So we can reopen it right now as it is, but to convert it to 88 Parkway, we're going to have to do some, we have to figure out, and even just opening it up

There's been some frustration on the... There is improvement possible. The contractor has to go to the project engineer. The project engineer has to approve all their stuff that they follow up on when it comes to us. We have to have it on-suite data before the meeting. And we were being told that. And there's a disconnect between the contractor and the project engineer. I don't want to get into all of the details of that.

I understand.

But that's where it is. So you'll see them as they come in on an appropriate timeline. We've told them that we don't make special runs, especially for checks that large. We will do them in the normal process that we have.

And I had to give a brief report, if you'll permission. Go for it. The big thing that came out of that we're working on their IGA and different things. One of the things that we needed to talk about as part of the IGA was a new lease on a parking lot on First and Stillwell there, or First and Highly, that they have, that Tura technically owns. Unbeknownst to me, the approach at the last meeting on whether to sort of want to deed that law to the city and if they eat that to us for us to take possession then we wouldn't have to worry about at least because we know that outright so we're going to work on what that looks like on transferring that property or how we can do that or what we can do because they seem they want to feed it to us, then we'd be happy to accept. That was a good takeaway. Thank you.

You know, so I was really, really worried. I mean, this is pretty thorough work. Really helpful for people who don't know us. I need to go back. And the last, this is a very good day. So we've been here. Never, you know, everyone, no matter what, I'm saying. Absolutely. A couple of things first. Can we get an update on when you leave failing or near-failing wallets to each other?

We have an engineering report on that. We have a conversation with Murray Mills happening this week to kind of talk about what that looks like. The interesting thing on that is that if it failed tomorrow, it could fail 100 years from now. And we kind of know The where it's at, it is a liability to the city. We have ways and designs that we could fix it. We don't have the money to fix and we're actively searching for grants. So we are, we'll be looking at ways to take care of it.
