Here's a property at Chandler Road map 76 parcel 8, the property being located within the city's urban growth boundary and approve the plan of services. The second is an ordinance to rezone and adopt preliminary master development plan for approximately 14 and a half acres of property on Chandler Road map 76 parcel 8 from Wilson County R1 to RS 20 PUD. The third is an ordinance to rezone the property located at 10555 Lebanon Road, approximately 1.5 acres, map 54, parcel 24, from RS40 low-density residential to CRC commercial retail center. The next is an ordinance to annex into the corporate boundaries of the city of Mount Juliet approximately 175.52 acres of property on central map 99, parcel 14, the property being located within the city's urban growth boundary. and to approve the plan of services. The next is an ordinance to rezone and adopt the preliminary master development plan for approximately 175.52 acres of property on Central Pike, Map 99, Parcel 14 from Wilson County R1 to RS20 PUD. The next is an ordinance to amend the ordinance 2013. excuse me, 2023-14 for McFarland, located at 5238-5266-5404 and 0011 Dirt Road, Map 77, Parcel 23, 22, 22.01, and 22.03 by removing Public Works Condition 10C. the next is an ordinance to amend the city of mount julia code of ordinances chapter 28 traffic and vehicles regarding u-turns and authorize the city engineer our public works to designate a sign location where u-turns are prohibited and the last is an ordinance to amend the fiscal year 2026 2027 budget ordinance 2026 48 to appropriate funds for the stormwater fund for the emergency repair of a roadway if anybody would like to comment on these 10 items I'd invite you to come forward, give your name and address for the record, and the board will hear your comments. Last time around, it was like after something was heard, so I didn't know which. uh you i think you're referring to the planning commission so i'm here from griff akins um in the normandy heights subdivision about the proposed subdivision that's coming across from that um first question is the last time this was brought up at the planning hearing it was um they they removed because they there was some flooding concerns and the developer agreed to uh basically wait to another day so first question is did that go back to planning because it was originally removed from boat and and we haven't heard anything since also a traffic study was waived like to know exactly why I know you guys probably hear that more than any of us that about traffic that's a tiny two-lane road where two school buses can't meet also if a school bus meets a giant truck one of them has to pull over it's also about to be a detour area because of the Central Pike widening program and also they'll live in dirt road ALSO LAST TIME THE WASTEWATER, IT EXCEEDED THE WASTEWATER. THEY SAID THEY WOULD MAKE IT WORK. KIND OF LIKE CLARIFICATION, MAINLY IF THAT'S GOING TO BE PAID FOR BY THE DEVELOPER. or us the the flooding is the number one because that's the reason why they went backwards and said we'll come back in another day a neighbor pointed out that this was under a cave system and he had dealt with flooding for 20 years and basically this would create a huge liability because if his property flooded And if we approve it, the city approves it, that puts us up for liability. And finally, the lighted walking trail. We wanted clarification of that because that was going to be right on the road. And normally those kind of lights are line of sight. We'd like to get clarification on the height on those. Also, they had discussed, because the neighbors had a concern that that was going to be right on their property and it was discussed that they were going to build a giant um a blocking wall i want to make sure that was up to code but the main issue is is that this got pulled i'm assuming it should have gone back to planning and we never got a notification that that happened so thank you all right thank you sir

Yes, my name is Brian Bose. I live at 130 Normandy Drive in Normandy Heights as well. I was here in May as well and heard some of the conversations. And when the traffic issue was brought up, I believe somebody did mention it back at that time as well, that it's not just. the people that live on Chandler that use that road. It's the only cut off between Old Lebanon Dirt Road and Central Pike that heads over to the elementary school. So a lot of parents morning and afternoon come up Old Lebanon Dirt Road and cut through on Chandler and the traffic will back up at Central Pike and also at Old Lebanon Dirt Road back and forth when they talked about the traffic in the prior meeting, they talked about it's really not an issue because of the intersection being where Normandy Heights development is. But nobody discussed the two other ends, primary ends, and the fact that that is literally for Mount Juliet, the only cut between Central Pike and Old Lebanon Dirt Road on west, sorry, yeah, west of Mount Juliet Road. So that obviously is a concern. Second of all, I noticed also at the prior meeting that there were a lot of waivers being done, whether it was for sewer, they talked about having the main entrance and then adding two additional driveways so they could get X number of houses in there because there were only a number allowed in the development so they were going to add a couple more driveways it just seems like you're there are so many waivers being granted to me that's just kind of a red flag i wonder why so many waivers are being granted based on city code and development codes if what's the point in having them if so many waivers can be granted for one single development in a small area like that um Anyway, those are my primary concerns. Obviously, I did hear about the flooding as well, the resurging spring in that location. And again, we never heard back on whether a study was done on that to mitigate that situation as well. So those are my primary observations at this time. Thank you.

bar campbell i live at 401 south court in normandy heights thank you sir um something else i wanted to bring up um the distance between the driveways to the entrance of the new subdivision are going to be very very close like four feet and not really sure that's going to be doable for the folks that are living there as it relates to entering and exiting the neighborhood It's going to make it pretty tight. Just wanted to bring that up and make sure that that was looked at a little bit more closely. It seems like it's pretty tight. All right.

Yeah, I want to thank you all for being here tonight. I also want to thank those who came out for the Greenway walk, our annual walk. It was Thursday before last, and it was a little hot, and so we didn't. We didn't have as many, but I think those who, who came out and we're going to reevaluate that for next year, as far as the annual Greenway walk. But one thing was, was good and positive. There was some, um, there were some people who hasn't been on one of our walks before. So that was really good. We got to meet some new citizens and, uh, we had a, we had a great time. I also want to think, um, and I don't think no one mentioned this on the last meeting, but, um, the, um, stephen whitehouse golf tournament that was conducted on july the 24th it's called sw and friends they gave 83 000 for uh the leo land which is the ada portion of charlie daniels park and i think there was a uh picture on Facebook for you know accepting the check from the city accepting the check but I really appreciate that and hope and encourage some other nonprofits to to think about contributing to this good cause over there to continue to complete that section of the park I think it was a hundred and And someone can correct me, $164,000 for the whole thing. And so that was $83,000. And so hopefully, again, some other nonprofits can step up and donate to it. So that concludes my comments, Mayor. Thank you.

Thank you, mayor and commissioner. You're right on those numbers. It was right around that close, but for a great calls, um, I actually got a chance to go out there for the first phase. It was beautiful to see, uh, just the ADA access for those kids and being able to still have fun with the rest of them. So, uh, with that, uh, thank you all for being in the audience as well as the folks that are online over the last couple of weeks. Uh, I believe I've been answering all the emails. So if I missed anybody, I might, my apologies been traveling a little bit for work, but, uh, I do believe I'm caught up with that. Actually, it's actually my granddaughter, first granddaughter's birthday today. So she's a big number one. So I'd be in trouble if I didn't wish her a happy birthday. Not that she's going to recognize that grandpa said happy birthday to her, but she can look back and recognize that I did do it for her first birthday. So also... Heard it was a great turnout. I know we had some hiccups there with the fair. Hopefully those folks are okay with that accident out there. But with that also just, you know, we give a shout out with all these emails that I've gotten over the last couple weeks with MJPD folks. You know, it's interesting to see the reports that we have of folks that come into our city. And I know there's a lot of conversations with these flock cameras as well as just all the technology that we have. it's impressive that our mjpd is doing such a great job at proactive approach they use the data i will emphasize this right here our chief of police is so transparent this whole city is transparent when it comes to documentation i ask anyone that has questions about what other cities are doing other states other municipalities go on our city website go look and see what our code rules regulations are for some of these uh action items you know that everybody was reaching out to me the last couple weeks for you know uh reach out to our city manager reach out to myself or your other commissioners but they are very transparent when it comes down to the data that we are tracking and what we're not tracking compared compared to other cities and other states so this chief of police Our Chief Chandler, he's doing everything that I can see right, and I know he's being held accountable as well as he's holding his department accountable. So I'm impressed just to hear all of the different things. And every time I have a question from one of the residents, I reach out to him directly. Actually, I think he took my call Saturday night even just because I wanted to make sure I put it in a text form. And sure enough, he called me back that night just so we can close up some action items. So Just very happy for Mount Joliet Police on what they're doing on the technology as well as the approach and making sure our city stays safe for all of our residents and the folks that are passing through. One more thing, obviously, when it comes down to our parks, there's a lot of cool things that are happening from Friday night, from our movie in the parks to our community yard sale that's coming up September 12th from 8 a.m. to 12 p.m. uh registries uh it's still open until september 9th for that there's so many different things that our city's doing when it comes to bringing our residents together take an opportunity to get on the website and see what your schedule is available for you to uh to plug in and meet your neighbors so um one more thing uh just thank you to all the residents when it comes out to the safety i know we're back to school all the school buses are out there and i haven't heard a whole lot of uh complaints when it comes down to our residents following all the state guidelines as well as the traffic requirements. Thank you. All right. Got a couple of graphics here. Okay, so whether you play pickleball or not, or if you know someone who does, please spread the word. This is our fourth annual Pickles for Pups Pickleball Tournament, and it's a fundraiser. It's on October 3rd. It's on a Saturday. It starts at 8 o'clock. The featured sponsor is First Financial Bank, but they are looking for other smaller sponsors. For example, if you want to do a yard sign or put up a banner on the fence, they definitely could use your help there. All the proceeds go to benefit the animals in the care of the Mount Juliet Animal Control, because we do not budget veterinarian expenses for those animals. So this is a fundraiser for that. So please help spread the word. The other one, I don't know if anybody's going to mention this or not, but as you might know, on November 3rd, we're putting on the ballot for your decision to decide whether we continue with the Home Rules Charter or go back to the general that we had prior to that. We have announced for the five public meetings, they're there, one in each district and then one citywide. The one in my district is on September 22nd. It's on a Tuesday at 630 for one hour at Providence Church. And again, if you can't make the one in your own district, please feel free to pick another one that's convenient with you and bring your questions. I have answered a lot of questions so far. So if there's any other questions you have, please come out to one of these meetings and bring your questions and I like to collect the questions prior to so we can prepare answers. That's just what I like to do. So let's see. Ava Splash Pad, there's two weekends left, and the last day is September 6th. That would be closing for the season. There's two other fundraisers, Spud and Butter, over here beside Local Joe's. They're doing a fundraiser now through the end of September, September 30th. They are helping two nonprofits on desserts. So if you go there and you order a brownie, you benefit the Mount Juliet Animal Shelter. If you order a banana pudding, you benefit the Mount Juliet Help Center. So please help out Spud and Butter and support them as well as the two nonprofits. And that, I think, was, yeah. Oh, I just want to brag. Went to the fair. I love this fair. I haven't entered anything in quite a while. So I won three ribbons plus a People's Choice Top Ten. And I didn't know that until yesterday when I went to pick up my pieces and it One of my paintings was oil painting was it had that on there that that was the people's choice top 10. So that just made my day. So I just wanted to brag.

Well, I did not know that you were a new graphics designer. I didn't know you were an artist as well. So many, many talents. I just want to say, I want to start off by saying I want to thank everybody who's reached out and the prayers for dad. After 12 days in the hospital, he's back home. All's well with that situation. Since her last meeting, I made two trips to Johnson City, one for my oldest daughter's induction or white coat ceremony into pharmacy school. So proud of her. And then the dreaded trip this last weekend, which was to take the youngest back to East Tennessee State. So back to being an empty nester. I'm a terrible empty nester. Wasn't meant to be an empty nester. It's just unnatural and all those things. So always tough. But anyway, I say thank you and welcome to Mount Juliet thing. And we'll recognize our city manager and he'll move on because I'm stumbling all over my words.

As a father, Mayor, we totally understand. You love your kiddos. There's no doubt about that whatsoever. And I want to take just a moment and ask for our community to give some prayers to Ms. Trish Mundy. If everybody knows Ms. Trish Mundy, she is the widow of Jerry Mundy, who was one of the police officers killed here in the city of Mount Tulip many years ago, 2003. Her dad passed a few years ago, and unfortunately, her mom passed this weekend. And so we'll just send prayers and thoughts their way and uh i talked to her a little bit today and she appreciates the city and everything the city's done for her and her family for so many many years in particular the police department and just say if you just keep her in your thoughts and prayers and anybody else that's going through tough times in our community sadly we lose wonderful residents every every day that have made lots of wonderful contributions to our community and we're very thankful for that so just uh hate to start with that but i felt like it was fair we we owed that to her and her family and uh commissioner on a different note could you explain how pickleball came about getting its name the pickle i think people might find that interesting if you didn't know

Well, it was back in the 60s. There was this family trying to think of some games to play in the backyard. And they kind of developed this game. They were just playing in the yard with this little wiffle-type ball. And their dog was named Pickle. And so that's where it came from.

Okay.

Yeah, funny, kind of funny.

I thought that was cute. Apparently the ball went into the bushes and they said, go get it, Pickle, and there you go. You never know sometimes how things come about. The second thing is, or third thing actually, is just ask people to continue to shop local and especially with your mom and pop businesses here in the community because that's a driving force with our economic engine. we got new businesses open every day and speaking of a mom-and-pop business we'll have a business opening labor day weekend i've been looking for something fun to do for yourself and your kids and your grandkids there's a place here called good clean fun arcade and family entertainment center they'll be going in valley center it's 28 000 square feet and nothing but fun and this is a local family investing lots and lots of money into that business hoping that you'll come out and uh patronize their business. Parents and families have been asking for something like this for years. And hopefully this time next year, it should be open. If not before then, we'll be Slick City, another place. And we encourage you to look online for both these businesses and try to bring some fun to our community so that people don't have to travel to other places. So we're very thankful for the investment that our business is making our community and especially the mom and pop businesses. And then last but not least, I'd like to ask the vice mayor to join me at the podium. just more proper up here, I guess you'd say. Mayor, can you hear me okay? It's unique. You can't hear yourself as well over there, but this is our vice mayor, Mr. Bill Trivett. Mr. Bill Trivett has served the city for five years. And one of the things that doesn't get mentioned is like what the mayor was mentioning, is the people you see up here, our elected body, 365 days a year, they're basically on call 24-7. Our citizens are reaching out to them either via email, phone call, in the grocery store, wherever it may be that you're there. And sometimes you ask yourselves, why would somebody run for political office? It's because of the desire to want to serve and help others. And I know the sacrifices they make because I work with these people daily and so does staff. But what a lot of people don't realize is our elected body, they have children, they have families, and they also have full-time careers. elected officials here are supposed to be part-time but they're not really part-time they're full-time and then they have a whole other commitment which is their full-time job to support their families and sometimes that goes by the wayside and and we fail sometimes to uh to thank you daily but we have a small token that for every five years of service we take the opportunity to recognize our elected officials and it is a very small token we can't thank you enough for what you do and we have an annual banquet every year where we recognize employees for 5 10 15 20 25 30 35 and nobody's made 40 yet you know most of most of them by then you know they retire and move on to greener pastures or retirement but um unfortunately our vice mayor wasn't able to make it this year because he had a work commitment and he wasn't able to be there i think he may have even been out of the state and uh but we love it commissioner malaylee was there and she always comes out and supports that and uh We love our employees and we love our elected body. So I'd like to take the opportunity on behalf of the city of Mount DeWitt, the citizens, and in particular, our elected body and staff to recognize you for five years of service. Five years of service in elected body can feel like 10. So here's your certificate for five years of service. Here's a pin with a little motto from the city. And then here's your trophy, which I didn't take out because I was afraid if I dropped it, it would break. Thank you. Thank you, Vice Mayor, for your service. Mayor, that concludes my report. All right. I think I have made a mistake. I imagine these were put up here to make an announcement. And then on October 13th, if you're still having trouble sleeping at the Mount Juliet Middle School, I will be doing one to finish you off. Welcome to come out with any of these things and we'll welcome questions and just want to get out there. Also wanted to let the board know we got a letter today from the state comptroller's office. Our budget that we passed has been accepted and no issue cited. So congratulations to each and every one of you and of course staff and all the work that went into getting that done. Just a couple of things. I wanted to address the traffic study. If it's under a certain number of trips, it doesn't warrant a traffic study. So that was the answer on that. And as far as each end of the road, that's you want to speak yeah commissioner do you have anything else i'll turn the floor over todd yes i wanted to invite him up to explain that all right todd serban city's traffic engineer uh

So in small subdivisions such as this, 50 units and under, we typically don't require a traffic study, well, a traffic analysis. We do require safety and multimodal analysis. In this case, I, as our staff member, looked at it. There were no crashes along the frontage. So the total study was waived because there was nothing to study. As far as the trips generated by it and why we're not looking at the bookends to the site, and on subdivision this small, offsite improvements like that are generally considered outside of the reasonable expectation as far as contributions go. They would be unlikely to trip any term lane warrant that's not already installed, and a signal would be well above your, your typical contribution per lot, I guess, from a development like this.

This is a county road, so any road improvements would have to go through the Wilson County Road Commission, right? But we are asking for a turn lane?

Correct. There's potentially some small widening where we bump out the existing return taper That was created when the turn lane into Normandy Heights was created. These driveways align, so now we're going to turn that paper into a full turn lane. It'll turn into their site. There may be some widening, but nothing substantial, I'd say. But the design of that is going to be up to the Wilson County Road Commission.

Yeah. And then the comment on the driveways being too close, and I know two driveways were removed, I think.

I believe they were referring to an earlier version of the plan. The development team intended to keep their cul-de-sac under 25 units, which is in our subdivision regulations, so they've had additional units on Chandler. We've now worked out a way that we feel comfortable supporting variants for over the 25 units, still 29 on the cul-de-sac, but there will be no additional driveways on Chandler.

okay and on the flooding i know that um and by the way this did go back through uh planning because it was deferred at planning so then it had to go back through planning after the changes uh before it came here for first first reading um so the uh the flooding and before first reading i met with the developer and he he explained to me um you know the full plan of how they were gonna work out the plan i mean the flooding and all that look to me i'm no expert but it looked to me like a well thought out plan um and of course it did again go back through planning before coming here on first reading um shane would you address that shane chaminor director of engineering um

current city code states that the that a site cannot create or create runoff that exceeds the runoff the site currently has so preconditions shall match post conditions shall match pre uh this developer has gone above and beyond the city code by delineating the watershed and capturing the flows of the watershed which we term as over detaining for their site to minimize the flows of the drainage basin in addition to their own site

Okay. And then the other question I had, I think, pertains to planning. So, John, you might want to address, it was brought up the concern for the lighted walking trail and the height of that, how it would shine over into other areas.

john bachman city planner i would uh could we add something to the condition a making condition that requires down light only they have ways to mitigate spillage um that would be i'd be okay with that all right so um could we could you recommend language that i could motion for um something along the lines of uh trail lighting shall include uh fixtures um shielded in a way to direct lighting it towards the ground um something along those lines or i don't know what the best language would be um down lighting or shielded the yeah something like that

All right, and would this apply throughout? I know one concern is toward the Chandler, because that was a concern with the residents across the street.

Probably a good idea on all the trail.

The trail shall be downward lit?

Trail shall include fixtures with only downward... I don't know the language off the top of my head for that.

all right and then would this apply just to the frontage or the entire i think it's probably a good idea to put it on all the trails all of it all right you got that mayor that's my motion yeah i'll go ahead and what would could you repeat your motion repeat Okay, so.

Boss Mayor, did you have a suggestion on that, on the language?

Sure, sure. You know, I guess the motion would be to coordinate the lighting that will be directional lighting on the walking path only. And then that way it's real clean, it's simple, and I think that should make it, I think this should clear it up. Is that okay? So directional lighting for walking path only. Correct. Well, I mean, but that was the other part of it. Sorry.

Commissioner Giles. Yeah, this is just for some information. I heard one of the comments. If I'm not mistaken, when this came back to the Planning Commission, the developer of this property had a geotechnical,

survey done of this property had he not to to address the issues of of caves or whatever that that was and uh there wasn't nothing there that would hinder that and they do have number nine under planning which is in the event of a car's feature features are encountered during grading a licensed geotechnical engineer shall document the feature and the feature shall be located The feature shall be located by a licensed surveyor. If the feature is to be remedied, geotechnical engineers shall provide a remediation plan to the city for approval. Efforts will be made to minimize any remediations featuring within building envelopes. So that is noted in there about the concerns. I think it was one of them that was brought up about the cave features. another question about the sewer um the pump station and all the all the efforts that are done for the development will be paid for by the developer on those as well so thank you is there anything else anything from staff all right All in favor of the four with the one being amended three times, please signify by saying aye.
