All right. Are we are we ready in the booth back there? All right. Thank you. All right. It is 6:30. It is April 7th. This is I'm calling to order the planning the meeting of the planning and zoning commission again for Tuesday, April 7th. Hi everybody. We have a roll call. Mr. Hagerty here. Miss Austin here.
Mr. Montiel is not here. Uh Mr. Ruddle is not online. Mr. Adams here. Miss Hubka here. Mr. Renen here. Mr. Kaplan here. Miss Cesario is not here. Chair Martinez present. A quorum is present.
All right. Thank you. First uh item on the agenda is the approval of minutes uh from March 17th. I hope everybody got a chance to look at those minutes that were provided in your packet. Um do we have any discussion prior to approving? Anybody have any additions, corrections? All right. Can I get a motion for approval? So moved. Second. Vote. Uh, Miss Austin. I, Mr. Adams. I, Miss Hubka. I, Mr. Renson.
Yes. Mr. Kaplan. I uh chair Martinez Martinez and then sorry Mr. Hagerty. Yes. Motion passes. All right. Thank you. Next item on the agenda is another approval of the findings of fact. Um you're here for this meeting and um have reviewed the findings uh the finding of fact that's been attached to the packet. Um, any discussion? Just confirm. I believe I can still vote because I listen. You can still vote if you listened and Yep. Yep. Just wanted you noted. I just want to make sure I wasn't messing something up. Nope. Okay.
Um, uh, Miss Cesario's last name is spelled incorrectly on Yes, she pointed that out to me and I've already corrected that. So, thank you. Anything else? uh ADUs have been regulated and changed and it's getting really ridiculous. We we need to get some kind of a firm uh regulation on those and just let it go.
I appreciate the input certainly. I think the vote here is whether the findings of fact as presented uh are accurate. Oh, good point. All right, let's uh get a motion. Motion to approve findings of fact. I'll make a motion that we approve the findings of fact. Thank you, Brenda. I'll second. Thank you. No. All right, Mr. Hagerty. Yes. Miss Austin? Yes. Mr. Adams, yes. Miss Hubka, yes. Mr. Renson,
yes. Mr. Kaplan, yes. And Chair Martinez, I motion passes. Thank you. Cruising right through this agenda here. Public forum. Anybody uh sign up online? I don't see anybody in the room. All right, we will cruise right through that. Uh staff's choice. Ryan, you have anything for us?
Um, let's see. In two weeks, we should have another discussion about um conservation overlay, another study session on that. Um, and then this action item that we um brought the public hearing from last two weeks ago, we'll have a followup. Um we're working with getting some notification out to the uh folks in the neighborhood preservation early overlay to discuss whether they want to pull um ADUs off their prohibited list. I think we'll probably touched on that last week. Um so we'll be reaching out to them to schedule some discussions with folks in that group to bring hopefully bring uh that other piece forward if they if that's what they desire. But other than that, that's that's all I've got for right now.
Great. Thanks, Brian. And then I just would remind you all about the joint session with city council on Monday evening. Uh if you want a a link to attend virtually, please email me. All right. Attorney's choice. Uh nothing for me tonight. Thank you. Thank you. Uh commissioner's choice. Uh let's start down on this side with Col.
Uh nothing. Thank you. Um, yeah. So, I wasn't here last time and I just wanted to say I I did watch and I appreciated the discussion that uh everybody had. Um, fully in support of the uh uh reelection of our our chair and and Eric as the vice chair. That's um you know, great to see. Um and uh really looking forward to the other state laws coming forward. glad that this one finally is through this stage and and ready to go for that final approval and hoping we can get the other uh state law changes uh back in front of us for uh formal action soon.
Thank you, Noah. I have an item here. Um this was actually brought uh Brenda brought this up to me a few weeks ago. Um we've had um Mrs. Ario joining pretty faithfully as an alternate uh on the committee or on the commission. Um, and about a year ago, we sort of deferred doing Stephen, Mr. Steven Rutle's been um, joining remotely. He's been on a contract assignment in California. Um, and I just reached out to Stephen to see if he would be willing to maybe swap those positions since Amy has been here in person. Um, has, um, consistently had things to contribute to the conversation. Um, and I asked Stephen if he would consider, um, converting to an alternate and allowing Amy to be, um, promoted, uh, to a full commission member. Um, Steven was in complete agreement with this and um, he I have the email in front of me that he's happy to move into an alternate uh, position. Um, he says he's sorry that his travel and current consulting work has caused some headaches but want to continue to support our great city where he owns a home in any capacity he can. So, I really appreciate Steven's faithfulness and joining us um, remotely um, and um, he is going to continue to do that as an alternate capacity. Um, so Nancy, I'm not sure if we need to take a vote on that or um,
we do. Okay. If you could make a motion. Okay. So, I would like to make a motion. Um, two I I don't know if this is two motions. I guess advant to advance uh, or to promote Mrs. to a full um, commission member and to convert Steve Steven Rutles um, position to the alternate.
I I have to I have a question. I'm very glad to reach out to him because that is what I asked you to do. That that's great. I didn't have his phone number. But here's here's where I'm confused is that planning and zoning committee matters can't change the rules of our um you know bicar what what would you call them? I'm just drawing a blank. Um we can't actually we're supposed to attend then we can't change that attendance. We didn't vote on that to begin with by the way. We never voted that Steven would be able to attend remotely and but I didn't see that in in the rules that we were even allowed to attend remotely. So, are we legally allowed to then change an alternate to a permanent member?
I'm looking right now to make sure I have the citation, but yes, we are able to do that because the function of the alternate would be to fill in for someone who's unable to fill that role the way they're intended. And because Mr. Steven agreed. Commissioner Steven agreed. Um there's no reason we can't have her fill the full-time role. And he stepped down to the alternate position. I just want to make sure that was and then just to add to what Jackson said, it's it council amended their polic policy to allow that as long as the board or the commission agreed to to replace the alternate like you couldn't remove Steven. That's a council action, but you can move up the alternates and and do that. Okay. Very good. Thank you. That's a recent change. So,
I'm sorry. That was my question is because we're appointed by city council. So, this doesn't have to go to council either. Okay. Amy was already appointed and just filling the alter. But she was appointed as an alternate, not as a Yeah, that's what my question. So, okay. Um, I've got a question. I think maybe this is for you, Brian. Um, what's the correct forum to ask about sight triangles as far as a safety concern on a corner? Um, I asked because there was a car accident at the end of my block today and there's where it's a lot of elementary school traffic, so it gets really busy at two times the day and fortunately I'm not usually driving, you know, at those times, but
I'm sorry. Just just I have a motion on the table and then we'll get Oh, I'm sorry. Yeah, I'm sorry. Just that out and then we'll we'll get you. Sorry. No, it's okay. I just need a second. I'll second the motion. Thank you, Colin. Yeah. Yeah. I just need a second to the I second. Oh, thank you. All right. So, we'll just take a double vote voting for both uh motions. Uh Mr. Hagerty, yes. Miss Austin, yes. Uh Mr. Adams, yes. Miss Hubka, yes. Mr. Renson, yes. Mr. Kaplan, yes. and Chair Martinez. Yes, both motion passes. Thank you.
Sorry about that, D. Brenda, my bad, David. We'll go down the line. I'm good. Thank you. Go ahead, Dave.
Sorry about that. Um, so I'm just curious, Brian, from your take. Um, I I looked at the rule. I believe it's something like 10 ft away from the corner of the intersection between 2 and 1/2 ft and 8 and 1/2 ft. You can't have, you know, obstructing plantings. I've not gone out there with a tape measure, but even if it does somehow just barely meet those requirements, it's I think objectively kind of an unsafe condition because it's, you know, one block from Downing and sometimes people come cruising through there pretty quick. So, I'm just curious since fortunately it looked like everybody was okay this morning in that accident, but it's a spot where I'm surprised I haven't seen more and I'm just curious what the correct form would be to ask about that. Um what we would do is connect you with our public works group um and start from there. So if you want we can forward your question to them if you want to meet up. Uh what was the address and I'll go ahead and do that now.
Um or the intersection. Yeah, intersection is South Marian and Floyd and it's the northwest corner of that intersection. They've just got some big I think like lilacs or some some other pretty dense um tall bushes, but it just makes it really challenging to when you pull up to that stop sign to look to your right when you're driving south. So, if you're leaving uh Charles Haye Elementary um and I I didn't see it happen, but I wouldn't be surprised if Sure. that was part of the cause. The South Marian and what was the other street? South Marian and Floyd. Floyd. And it's the northwest corner on that or the the house on the northwest corner of that intersection. Okay, I will forward it to them. Thank you,
Michelle. No, no, I'm not the task master. You guys make me happy. No, your turn for commissioner's choice. I have nothing. Thank you, Carl. Uh, nothing for me. All right, with that, I think that brings us to the uh end of our agenda. This is a record uh 12minute meeting this evening. So, thank you everybody. Thanks for being here. Appreciate it. 15 minutes. Do Do we have a minimum time we got to be here? In order to get paid, we have to be here 15. That's why I got us out of here in 12.
