Excellent. All right, welcome, everyone. The matters that we do have, we'll tend to take in the numerical order that they appear on the agenda, so we'll start that way. When we call your case, we'll bring it forward. And we'll have you sworn in, and you can make your presentation. The first matter that I've got is BZA 2026-12, Donald Sedlock and Haley Burke at 3747 Chesterfield Drive in the City of Green. I hear the appellants, Donald Sedlock and Haley Burke, at that address in Green are requesting a variance to allow a driveway that is a width of 26 feet. within 10 feet of the road right away to remain as constructed. This does not comply with Green Codified Ordinance Chapter 157 of the Planning and Development Code. Specifically there were 157.134.7B.3B, which specifies that a maximum driveway width of 24 feet within 10 feet of the right of way. So the applicants are requesting a two-foot variance to permit the 26-foot driveway to remain. Specifically stated the variance request before the board, There's a two-foot variance to permit a 26-foot-wide driveway within 10 feet of the road right-of-way, which has already been installed. Okay, so since we're kind of already drifting towards that presentation, absolutely. And you'll see that there is a camera above you, a little white dot or X on there. That'll grab whatever you've got down below it. And if you would just share that mic, that'd be awesome. So we've got our zoning matter before us, the appeal. What happened here and why did we need the extra?
Yeah, thank you. First, thank you for hearing us and our apologies for being here after the fact with a request for a variance. Absolutely not what we were hoping to do or the order that we would want to do things in. We did a home renovation and we did a garage addition we worked with a builder and architect to get this all squared away and designed and built during that process in those conversations we were operating with the understanding that all of the permitting was going to be handled by the builder and we believed that that uh... included the work with the driveway uh... it wasn't until after the fact that i had reached out to uh... the city for some other matters that we realize this was incorrect so we're here today to remedy this hopefully and uh... make it make this right but what happened is uh... As we built this garage addition, which is kind of reflected with this square here, that was permitted. And then the blue piece here is an overhang. We went from a house that had a double front door down to one with the garage addition. And during that process, after the garage was built and we had everything kind of starting to come to shape and look real, it became time to do the excavating for the driveway. At that point in time, we decided we wanted to make it 26 foot wide to give us a few different options. One, we have some folks in our family who require some accessibility needs, and we thought it would be a good time to do that. There's no step or anything going into the house and this was a way to give a little extra space for us to make that possible. We also thought it was just, it looked aesthetically kind of in place with the way the house came together. We did like a sort of a mid-century modern, I guess you call that maybe a gable, where this side is longer and kind of comes over. So we just sort of naturally, I think, brought the driveway out. We did not know at the time when we were doing this and making these decisions that it was something that needed to be appropriately permitted, though we did go through the permitting process for the garage addition. Somehow it was missed. And so we've built this beautiful driveway and renovated this house. It's really our hope that we can keep it. It would be a shame to lose it, but we understand that we broke the rule unintentionally. We did talk to the builder about this. He was not aware. of the need to have a right-of-way permit. I think he was, he looked around the neighborhood and he saw other driveways that had the same or bigger width, and I think we just made assumptions. So that is, that's what we're here for tonight, to respectfully request the two-foot variance there, allowing us to keep that driveway at its current constructed width.

So a spec originally, it essentially was a U driveway, wasn't it? Correct.
It had a U, and when we kind of got into this, it was a one-car garage, and we wanted to have at least two cars, so we added on this two-car garage. So it's essentially now a three-car garage, though the back garage is like tools and things like that. So really, instead of two curb cuts down to your main drag, we're really down just to the one curb cut, which is just... And I don't have the original measurements on each of those cuts. I didn't think of it.
That's okay. The documents that you provided us clearly show that. And so we're down to one. and a two-foot variance. Okay, questions, additional questions from the board? Thank you for these materials.
You're welcome. Did the drawings for the zoning permit, what did they indicate, if I could ask? The zoning permit that you would have obtained before the Summit County Building Department permit.
I believe I have those here. It's really very, very difficult to read. Let me see if I can... If I can do some justice here. Yeah.
I think you might be referring to what would have been similar to the document that I passed out. So we don't have that printed out right now. If my memory serves me right, I'm not even sure that we had the driveway indicated in that because the variance was for how close the garage was going to be to the street and didn't at that point have anything to do with the driveway. But we could certainly find that in what we submitted before and send it if we need to.
So right now, for the U-shaped driveway, the original one, right now, basically, it was replaced with grass in most part, and you got rid of that curb cut for both ones. Because that picture, that's how it looks like. Yeah, that's all right.

So this area here to the left, I'll use my pen here. Well, you can see up here, this would have been kind of where the driveway, like the house comes down and there's like a row of mailboxes here, and the driveway used to come there and kind of out here. So it was just kind of a tight U. It was nice, but it didn't really work with the garage addition. This picture...
like the two foot is somewhere in like that vicinity there yeah um and yes there there was grass and there was a little bit more landscaping um that we've somewhat moved to the back we kept the nice ornamental tree right there um and then grass which as you can see was just recently planted so it will look better than that once it finishes growing in it looks quite nice
So I guess my question is more for the city to help us understand the logic for the ordinance as it is and what the complications might be if we were to vote to allow this to remain.
So just an FYI to the board, we are working on our code and we're updating it based on the new need of the community. Nowadays people have two or three car garages and Moving forward, probably they need more driveway area. So we are changing our code that can allow the driveways to go above the 24 feet. It's not written in our code yet, but this is our consideration. So we are working on it. At this point, we are thinking about something between 30 to 36 feet. So just to keep that in mind that the two feet of this driveway doesn't really make any big change. Gotcha. Yeah. Okay. Thank you. Thank you.

Next matter, BZA 26-13, translucent LLC, 4442, broadly circled in green, where the appellant translucent LLC in Cleveland is requesting on behalf of the homeowner at the broadly circled address a 12-foot rear setback variance. to permit a residential addition, a covered deck in this instance, to be constructed which would leave 28 feet rear setback and 40s required by code. So this does not comply with green codified ordinance code table 157.101-1 of the residential site development standards and specifically stated in this instance the variance request is a 12 foot rear setback variance to permit a residential addition to be constructed which would leave a 28-foot side setback where 40 is required. Okay, all right, so we have your materials. However you'd like to present your project and why we're having trouble complying with the code.
Yeah, just basically with the uniqueness of the plot here and the way the home is laid out on the plot, it's on a roundabout. The ask for 40 feet is basically up to the house, so building anything additionally to the back of the house is going to require a variance. so we're just requesting we're doing a very minimal patio cover it's very not um it's a 12 by 10 120 square feet we're attaching it to the back of the home it's just going to be a roof line very minimal 4x4 post other than that we're just asking for that variance for the 12 feet of that cover
Yeah, so you're running 12 feet long and basically nine to eight feet. It changes a little bit there, but you got a nine to eight foot depth and then 12 feet rolling, huh? Yeah. All right.
The post line's gonna be roughly, if I can show it.
And you do, as you noted, you're on a cul-de-sac, right, a little bit there, right?
Yeah, it's not very visible to any.
So you have your pie-shaped property and that's got a property line that's gonna cut you right down the side there, make it a little difficult as well. We did, just for the record, I think all the members of the board would have received from Chris and Danielle Bellis on Broadly Circle that they are aware of the plan and that they have no objections to it and think it would be nice. So that is just a matter of our record. We'll keep that email as part of it too. And I would certainly welcome questions from the board.

Here the appellant, Mr. Domenico, at that address, 3849 Heron Watch Drive, is requesting a 10-foot rear setback variance to permit a residential addition, a deck in this instance, to be constructed which would leave a 10-foot rear setback and 20 is required. This does not comply with Green Codified Ordinance Table 157.101-1 again. and that's a residential site development standards. So in our situation in this matter, the variance request specifically stated is a 10-foot rear setback variance to permit a residential addition to be constructed, which would leave a 10-foot side setback where 20 is required. Okay, welcome, sir. The nature of the project and where we're located, and tell me a little bit about the parcel.

No, we built the house and we told the contractor that we were going to add a deck and you can probably see the steps are like, it's like 36 inches down. And the reason we built this house, we were right in the same Heron Watch development, which is right off of South Main across from Sandy Beach, was because we were on a three-story one, and we fell going up and down the steps. So we said, we've got to get to a flat spot. So we enjoyed the neighborhood so what we did was we're hopefully the house will be in next Thursday It's been nine months to build it. It's been a long haul but this here on this side is From looking at it from Main Street going back. That's the back of the house From the back of the house you can see straight through to Main Street and what's what we're trying to what we're applying for is to get the deck and so that we can have some room in there. Otherwise, I think with the setback, we were like a 10-foot deck to try to cover from two different entrances. So what I included here was a north view from the property line up, and you can see it's pretty clear our neighbors on that side are well within compliance. The south view, you'll notice that our neighbor had a variance done when they had their house built. So what we're looking for is a variance that we can put the deck together, which I think will leave probably 12 or 14 feet From the property line, if I measured it properly. Excuse me. Which will be right to where the neighbor's house is. That's right. It'll be the end of ours, so it's kind of like.
Yeah, that's the way it appears, huh? You'll come right to where that house with the variance is going to land, and you get a nice straight shot line there.

This does not comply with green codified ordinance... Chapter 157 of the Planning and Development Code, specifically here, 157.0872I, accessory uses. And that would be specifically stated as a four-foot right side variance, setback variance, I'm sorry, to permit a residential accessory to be constructed which would leave a one-foot side setback where five feet is required. Sure. We always wanted to put a shed, so finally decided to do so. Again, we are very mindful where we are located by a golf course. So we just want to make sure whatever we're going to put up is going to be aesthetically nice, just out of respect for all our neighbors, even across from the golf course. So although this rendering of the home, it's not ours, the previous lot owner, but it's very, very similar. Just our house, if you turn it counterclockwise facing north, that's how our house is situated on the land. The neighbor next to us worked with him. Again, out of respect for him not to lose the view to the golf course, we decided to move it up closer to the house. Again, it's a 16 by 10, and we chose to put a four-foot patio on it. Just aesthetically looks much nicer. And if you want to... So basically, this is what's going to look like. Aesthetically, much, much nicer. But being not that wide, it's just going to be way too far into our yard in front of the house. So since our neighbor doesn't mind going against the fence, and I think you have a letter... What I'm asking is a foot from the platform we're going to be sitting on, and the shed will be two feet from the line, the property line.

Two foot or one. I got you. We got you a request here as a one foot, and I'll say several different things, as you noted. Your neighbors, you've kind of reviewed with them. They did submit. I'll just matter for the record, and it will certainly be submitted part. They're in support of it, and you've worked with them. You've maintained the property nicely indicated, and they like where you've agreed to kind of put it. We do show it as a one foot, you know, which would give you that option. Okay. If you're not all the way up to one foot and you end up two, great. Okay. If you go with two and you ended up at one, well then we'd have you back. So let's not do that. As far as matters before the board this evening, we have one additional, BZA 2026-16, James and Laura Brott at 3526 Mayfair Road here in the City of Green. where the appellants James and Laura brought at that address are requesting a variance to permit an accessory structure in the accessory structure of the attached garage to be constructed in the front yard where an accessory structures are required to be in the rear yard and that does not comply with green codified ordinance chapter 157 of the planning and development code specifically here 157.087-1 and allowed accessory uses, and a second variance request in this project to permit a 10-foot accessory structure height variance, permitting a detached garage to be 28 feet in height, where 18 feet is the maximum height allowed. Now, this is not compliant with Green Codified Ordinance Chapter 157. The Planning and Development Code specifically here is 157.0872F, And I've got two specific variance requests that, as the board knows, we could entertain individually. We'll have you present both of them. But as far as motions go, we can entertain one or both by way of a single or multiple motions. So specifically stated, we have first, variance request to permit an accessory structure to be constructed in the front yard. Excellent, welcome. Okay, so the nature, you can present both of them. We have two variances, and sometimes they can get split. But how did we have trouble coming up with, first off, you know, the location of it, right? The location is an issue, and then the height is an issue.
Yes, okay, so for the location, okay, Sad story for you, gentlemen. 2007, a giant tree microburst fell in my garage in one of our bedrooms and it took out my garage. And the boss said, no more garage for you. I'm making a master bathroom bedroom. So since 2007, we haven't had a garage. I was all for the project. But we really need a garage, especially as we're getting older, wanting the cars in for wintertime, other stuff in the storage space. I want to get rid of that shed that we've had for 19 years. There's all the other houses, if you go down, everybody's got a garage, but we do not have a garage. We need it, I think, for the house value and everything else. As far as the placement, the verbiage there says front yard. I would call it more the side yard. If you can see this picture that I'm showing you here, this is facing towards Mayfair Road, and this is our master bedroom. And this is where we're proposing to put the garage. Okay, so it's more the side yard because you've also got shrubs and other stuff blocking that from the road. Okay, all right. The reason we need the variance for that is we can't put it behind the house. We have our septic, well, I guess you got the well issue here, which I have marked up here. Sorry, I keep turning away from the microphone. I put in a drip line irrigation garden, which really is pretty nice in the summertime. But also the septic is here. There's the two 1,500 or 1,000 gallon tanks. And then you have the leach field. I think they call that a lift station. And that goes to here. So there is no way on my property to be able to put it behind the house. From there, the golf course is on the south side of us and there's no room there either. So that's about why the placement, ladies and gentlemen.
AND MAYBE I APOLOGIZE. SUMMIT COUNTY HEALTH IS OUT THERE TAKING A LOOK AT THAT AND THEY'RE GOOD WITH WHERE YOU'RE PUTTING IT.

WE DO. WE DO. THANK YOU. So when we get to, and I'll get those into the record, but when we get to the heights, how do we end it? We're looking at a second story on that?
Is that why? Yes. When I first did this, this was just all my thinking and talking to a contractor, and we were looking at 40 by 26, and I was talking to Tom Fazio, 40 by 30. But then we dealt with some professionals, and they said, well, you can make it look smaller. We still want the two-story, but you can make it look smaller if we went 36 wide by only 32 deep. Because originally, the 40-foot wide was going to be shed dormers on the east and west side, so one facing Mayfair, one facing the back of our yard. And we're being told by these design professionals that it'll look more aesthetically pleasing and smaller if you kind of reverse that and you put the storm dormers, am I saying that right maybe? Shed dormers on the north and south side. So the dimensions that we're actually looking at now at this time are 36 wide by 32 depth to make it appear smaller. the second floor is just purely for hey you're building it and i have a lot of garden supplies everything sits outside over the winter or whatever and i might be able to even do some of my plants in there in the winter time and i just like would like the space sure sure and strictly residential purposes no businesses or anything of that nature that you run out of that property no sorry okay Oh, and I can keep showing you more, I'm sorry.

Great question. So what we're looking at is to try to tie it in. We feel that it's time for us to put a new roof on our main house. So we're working with this company called Country Roofing, and we're looking at a metal roof with a decorative, and we're looking at putting that both on the house and on the garage. And then also a picture of... our house. Boy, as soon as you pull this away, you lose it. Sorry. Okay. So they're going to match, what's this called? The shakes. The shakes. The cheater's shakes are going to match that on the garage. Here's kind of a picture of the, what it, is that turned the right way? Okay. What it would look like from the front with the, go ahead.
We would do vinyl on the bottom siding and then the shakes are at the top on the dormers and Would we would like wood garage doors?
