This project came in as a minor site plan, but needs PC approval due to the conditional use permit from the board of zoning appeals that it was um assigned. The applicant has been working with staff to meet those added requirements and there's only one minor note correction that's needed. Can I can I ask a question? Of course.

If you could just kind of coordinate with him on how you when you do that, how you do it so he can communicate with his constituents, that'd be great.

The board of zoning appeals granted a cut fill balance variance to the floodplane overlay requirements in October of 2009. A condition of that variance was that planning commission approved a grading plan for this site. That's why it's in front of you today. A type C landscape buffer is required between the CG and RD9 properties that above this property. The buffer needs to be shown on the plan and installed prior to a grading permit being issued for this site and not explain.

The properties to the north are indicated as medical office, to the east and west as commercial mixeduse, and the south as mixed housing on the future land use plan. This property is indicated as commercial mixeduse on the future land use plan which would support this resoning request. This is a recommendation to city council. The expected city council reading for this and all subsequent ordinances on the agenda are as follows. First reading and public hearing February 3rd and second reading February 17th. This is a request to annex the remaining ride ofway on Martha Levil Road from the current city limits north to the city limits along Highway 109 north. Road improvements are being made as part of the Waverly development and an agreement for the city to maintain the stretch has already been reached with the county road commission. The county road commission has requested the city to annex territory to avoid any confusion in the future and this is a recommendation to city council.

Subrakes just as a reminder do not go to city council. This is just a planning commission item. So, this is just removing any of the conflicts for that.
