14:54 – 16:360

Good evening everyone and welcome to the Mount Juliet Board of Commissioners. It is February 23rd and I'll call this meeting to order. We have all five members of the board of commissioners here so we have a quorum and we can conduct the business of the city. So, the first item that is on our agenda is to set our agenda. So, if you don't have copies of the agenda, they're in the wire baskets by the doors if you'd like to follow along. It's also available online if you'd like to follow along there. Before we set the agenda, we have an ordinance that's been um provided to us here at the table. And and I'm going to read the header, which is an ordinance amending the fiscal year 2025 2026 budget ordinance 202535 to appropriate funds for debris removal, disposal, and debris monitoring services from the January ice storm. Uh if there's no uh objections, I would like to slide that in as part of our consent under number 8P. Okay. Hearing none, we'll add that as item number 8P to the agenda. And I have to mark it so I don't lose place. I'd also propose under items under section 10 moving item number 10 A, 10 D, 10 E, 10 F, 10 G, and 10H to the consent agenda.

16:380

So, we need to pull that one from the agenda so it can be corrected. Okay. So we can remove 10 D from the agenda.

16:51 – 17:300

Yes. No. Maybe 10D which is the surplus. Oh, there's an amendment to make. I follow you. So um we have some changes to make to 10D. I'm going to remove that is D is in dog. So that's 10 A then E F G H. Is there any objections to moving those? But

17:26 – 18:030

I didn't say anything [laughter] D. Yeah, B, C, and D, I guess, would remain. All right, Miss Melia. So, if I wanted to be added as a co-sponsor on an item, would I do it now or when the item comes up? We can do it now. Which item would you like to pick? Yeah, that's fine. 10B. 10B as in boy. Yes.

18:00 – 18:450

Okay. There any objections to that? And Commissioner Mle is a co-sponsor to 10B. Not hearing none. So any objections to moving the 10 A, E, F, G, and H to consent? I'm hearing none on that. So we'll set the agenda adding number 8 P, which is the the ice storm debrisze 10 A, 10 E, 10 F, 10 G, 10H to the consent agenda. Are there any other changes to the agenda? All right. All in favor of the agenda, please signify by saying I.

18:44 – 19:270

I. Any opposed? All right. Our agenda is set for the evening. Our next item on that agenda is our invocation and pledge of allegiance. Mr. Martin, would you please lead us in that? Yes, sir. Mayor, every bow, bow your head with me, please. Dear Lord, I pray that you guide us always. satisfy the needs that need to be met during this meeting. Strengthen us as we make tough decisions. Jesus Christ's name we pray. Amen. Amen. [snorts] To the flag of the United States of America and to the stands one indivisible.

19:29 – 20:080

Thank you, sir. Well, we have two sets of of minutes. We have a set from February 9th, which is the regular meeting, and then we had the work session also on February 9th. Are there any changes? All right. Any objections to adopting the minutes as published? All right. Hearing none, we'll adopt both sets of those. Next item is citizen comments. If you would like to address the board of commissioners, I would invite you to come forward. Give your name and address for the record. You'll be recognized for three minutes.

20:16 – 20:280

Name and address, please. Hello. Yeah, my name my address 423 Willis Pass, Mount Juliet.

20:24 – 22:220

Thank you. My name is Sally Robertson [snorts] and my comment is I just want to to let you guys know about a project that I'm working on. Been working on it for a bit. I've talked to the Bpack about it. Anyway, it's a story ride. So, it's a bike ride. The whole distance is like about 19 miles. But my sole purpose of this story that I've written is to promote small businesses and a bit of history in Mount Juliet. So because I've talked to all the businesses um most of the small ones the small you know shop local theme um you know TAS free biscuits and those kind of village anyway those business are in there and some history like I'm a history major in college anyway I like history so like Sprouts where Sprouts is now used to be an old house with a horse racetrack where people moving And you people don't know that. So my question is the name of name of the ride is Jingle's Christmas Ride with Rudolph Rain Bike. So it's about to actually be published. Like I didn't go into this to make money. I'll probably make zero money on this thing. But my sle purpose and the person the reason I wanted to let you guys know is what I'm doing kind of let you know. I've talked to Kenny before any of these signs go up. Obviously, the signs would have to be approved by this body. I guess planning some moonlight and anyway, they need to be the right kind of signs. I don't want just laminated signs that are going to blow away and be littered all over the place. So, and then I need help funding.

22:20 – 22:580

I've thought about things like working in partnerships with possibly civic organizations, rotaries, Lions Club, possibly even high school students, volunteer hours for them to get these signs produced. So that's basically my comment. But then my dedication is to small businesses in Montil that they may prosper and thrive. So that's my whole purpose in doing this thing. and I just wanted you guys to know what I'm doing. So that's it. Thank you. All right. Thank you, ma'am, for your comments.

23:07 – 24:330

Hello, my name is Robin Eekes. I live at 56 West Cwell. First of all, I want to thank several of the commissioners for some help that we've had to have over the past month, two, whatever. I have lost track, but I want to tell you thank you. I also want to thank, believe it or not, Pleo in the city. They've been very, very helpful, and I just want to let y'all know that. With that said, um it's no secret about the project that I'm talking about. Um, we do not like the apartment type thing. That's neither here nor there, but we'll see what happens. But, um, first of all, I would like to know, [sighs] I come to all these meetings and I watch and see what goes on. And I'm in zone one and I would like to know why my commissioner has either abstained or got up and left before voting on the apartments. And I would one of them was a mortorium thing that was brought I believe it was last week maybe I mean last meeting maybe the month before but I'd like to know the reason why he's not voting because that's very important to our neighborhood because that's probably what's going to happen to us next. Thank you.

24:34 – 24:580

Thank you for your comments. Is there anyone else for comments for the commission? All right, seeing none, we will close citizen comments and move to commissioner comments and reports. Commissioner Giles, you're recognized for five minutes. Sir,

24:54 – 26:530

I wanted to um say how much I appreciate police chief Tyler Chandler for coordinating the meeting recently. We've had some obviously most everybody knows about the um the crime over at the boat in City Creek. And so uh he coordinate this with [clears throat] all the entities involved. We had the fire and PD and just uh the boat do. It was it was fantastic. I felt like it was very productive. I think that we're going to get some um some very positive results from this and hopefully curtail some some future crime over there that we need to to do. So, thank you again for what you've done. And then also, I'm a member of the Wilson County Health Council and so every year they uh they sponsor an event called Walk Across Wilson. Some of you participate in it. If you look at the screen, it's up there. We've got the kickoff party on Saturday morning and uh we're meeting at First United Methodist Church in Lebanon. And if you've got grandkids, if you've got nieces and nephews or children in some of the elementary schools, a lot of them are listed and if you will walk and get those minutes that it's a it's like a contest. And so there's monetary uh rewards for that uh given at the end of the event if um if you come into you know first or second or third or fourth place. Uh, also if you don't want to contribute your minutes to one of the elementary schools, there are plenty of nonprofit organizations that you can do that. Um, I appreciate the people who have supported us in this through the years as far as friends of Mount Juliet BPAC and we have a lot of people lined up this time. Again, thank you for those

26:51 – 27:340

and uh, pick one and get out. You know, every year about this time and it kick off on on like I say on Saturday, I think about and so many times I'm thinking, "Okay, I'm gonna start I'm gonna walk tonight and start getting in shape this fall this spring and then it's so cold." Well, every year I'm out in my parking lot walking or on the street, I'm thinking it is so cold, but it makes me do it because I know I'm going to turn those minutes in and it's something it goes to something good. So, let me encourage you to get out and walk. Um, and um, it's a good cause. So, thank you. And mayor, that concludes my comments.

27:310

Thank you, sir. Next, we'll recognize uh, Vice Mayor Tvette for his comments.

27:36 – 29:360

Thank you, Mayor. And, uh, thanks for the folks that are came out tonight as well as the folks that are online. Um, not going to steal the thunder because I wasn't there, but want to do give a shout out to the Chamber of Commerce and our awesome mayor for the uh the state of the city address. I was not there this year, but uh I missed you. I was I I watched it online and uh what a great job and uh thank you for representing our city. Um it just amazes me uh on how well we're doing with such a I'll say we are big city but a small city in some people's eyes, I guess. But, uh, we're very blessed. Um, also the fire station, I was talking to our chief over here, uh, before the meeting. March 6 at 11:00 a.m. is the decoupling, I think is what we're calling it, not the ribbon cutting, but I know, uh, we'll get some other folks probably bring it up tonight. But, uh, what a great accomp accomplishment, excuse me, for our city. We're very blessed. Um, it just, you know, once again, it just shows for the citizens um, of Mount Juliet, safety is first. um our our our our commission up here, our mayor, um our city manager, and each department uh takes safety very importantly and uh it's always first. So, I appreciate uh our uh fire chief and the rest of them uh taking care of that. And also, uh just to highlight um for the folks that may not be on social media, uh but we do get the reports. I'll tell you, it is great to see all of the police work that our first responders are doing, cleaning up our streets, uh for the residents that are not a part of our city. Um it's just every time I see it, it's just like another car got pulled over for just being proactive and magically they find tons of drugs, uh weapons, and just a lot of things that, you know, that we don't need in our city. So to the staff back there and to the ones that are on the road today, tonight, tomorrow, thank you men and women uh that are doing a great job. Keep it up. And uh you've got our support up here. So um one last thing, folks, uh as our uh commissioner

29:34 – 30:130

here was talking about uh with the weather getting nice, it was great to see the kids out um over the last couple days enjoying this beautiful weather. Please slow down. I can't tell the folks enough. I don't care if you're rushing to whatever appointment you're trying to get to. Kids are starting to enjoy this weather. Slow down. Last thing you want to do is is ruin your day as well as ruin a family by uh not paying attention. So, slow down. Um if not, uh our first responders are hoping uh I don't know, maybe we can get them out there to help out and slow you guys down if we have to. So, uh Mayor, that concludes my report. Thank you.

30:11 – 32:090

All right. Thank you, sir. Commissioner Heapner, you're recognized for five minutes. Thanks, Mayor. Appreciate everybody coming out this evening and those watching online. Um, also want to uh thank uh director of finance Dana Hire. I don't know if she's still here or not, but appreciate we had a budget um workshop midyear review on the financials. Um so I appreciate all the time and effort that went into that. Um very very enlightening and um could say it's going to be another I'm sure another tough budget season as we uh as we start rolling into that later on uh this year with uncertainty going on the economy and the tariffs and what the effect that's going to have or not have. Um I'm encouraged by the building permits um that uh that are starting to um jump up compared to last year. So that's very encouraging uh sign leading indicator the economy's turnaround. Um so all in all very good presentation and appreciate all the insight and u review of those financials. Um also want to thank the mayor outstanding job um for uh state of the city address. Uh that was uh last week sometime. Um truly blessed to live in Mount Juliet, truly blessed to live in this country. Um, so I do appreciate your efforts on that, uh, and all you do. Um, and speaking of blessed to live in in this country, is that not the best ending to the Winter Olympics, [laughter] the US hockey team, and and I don't want to I'd be remiss if I didn't mention the women's hockey team. Both both teams beating the Canadians. Um, check on your Canadian friends, make sure they're okay, [laughter] make sure they're safe. But, uh, um, no, it was just just great. Uh just I love the Olympics and looking forward to uh 2028. They're going to summer Olympics are going to be here in the United States. Uh host city is LA. So I don't

32:07 – 32:210

know that I'll go to LA, but certainly watch it on TV. Um and with that, that concludes my report. Thank you, Mayor. Thank you, sir. Commissioner Mley, you were recognized for five minutes.

32:18 – 33:410

All right. Um just one more thing on the walk across Wilson. It's not just uh walking, it's physical activity. So, you could run or, you know, any kind of physical activity. For me, it's pickle ball. So, it's it's not just walking. So, I want you to know that. Uh, see, and I mentioned this the last time, I'll mention it again. Coming up this Saturday at the Mount Juliet Community Center is a fundraiser for the animal shelter. Um the from 11 to 2 the uh it's it's a fundraiser. It's called Spaghetti and uh so Southern Rhythm Cattle Company will be catering it. Uh so bring the family come hungry. It's for a great cause. Every plate served equals life-saving care for shelter animals. Tickets help fund uh spaying and neutering of the animals in their care, surgeries, medical care, and second chances for the animals. So, uh if you could help support that, it's it's a great um our Mount Juliet Animal Care Center is um amazing. So, if you can come out and support that. Thank you. That's all.

33:390

Well, thank you for your comments. Mr. Mr. Martin, you're recognized for 10 minutes, sir.

33:44 – 35:440

Thank you, mayor, vice mayor, commissioners. Thanks everybody for coming tonight from those watching at home. Mayor, great job. I've had to fill in before on the state of the city and I didn't do a very good job. It's uh can be very stressful and so mayor did a great job as always. Like to thank the chamber of commerce also in Rutland Place for hosting. It's always good to see a lot of our senior friends there. Uh they they they're excited to have us there as well. I'd also like to thank um and show some appreciation to Southern Baptist Disaster Relief. They helped serve better than 543 families after the devastating winter storm that we had here recently in Middle Tennessee area. So, I wanted to give them a shout out for anybody that's out there that might still additionally need help. Their number is 615371-7911. Again, that's 615371-7911. and just thank them for all that they do for families in in Tennessee. Really really nice. And uh also like to give a shout out and embarrass a couple ladies that's in the audience here. One of them is a Mount Jet resident. Not sure where Miss Felicia is from, but they're here from the University of Tennessee. I've spent a lot of years going through their classes and I appreciate them. And we've been trying unsuccessfully for many, many years to get the University of Tennessee to host some of these economic development classes in our community. and uh Miss Jennifer and of course Miss Felicia who's here as well and Miss 1010. Um they we hosted back I guess it was in the summer and it had a really good turnout. Mount Juliet showed out I guess you'd say which we knew we could and we hope that there's additional classes. The reason it's important is they've got people from not only all over the state of Tennessee but beyond that attending these classes and they tend to shop local and things of that nature. So we want to thank you both for all that you do for the state of Tennessee and beyond and in particular Mount JW Tennessee. That's where you get a lot of this shop local from because as the mayor likes to say everybody is economic development and everybody in this room is economic development. I was met a newcomer, new resident and gave

35:41 – 36:400

him a city challenge corn on behalf of the elected body and uh it's always nice to introduce yourself and meet your residents. I remember there wouldn't but a handful of people here. Now we got tens of thousands of people that call this place home and you're all exactly right. It is a blessed place to call home. Uh but it's only as good as the people that are here that contribute to it and shop locally. So, please shop local. Uh support your local businesses most importantly because as uh Commissioner Hector was saying earlier when Miss Hire was giving that report, you talk about the the line share of the revenues that we spend on police and fire and things of that nature comes from our local businesses and people shopping here. So, a lot of new businesses out there to shop at. Uh Commissioner Lady does a great job of putting that out in her newsletter with all the businesses coming. And probably one of the newest one is Rooms to Go. It's open now. They're doing extremely well. Please keep it up. And uh April, I believe it is Texas Roadhouse. So, God bless you all for making Mount JW what it is. And mayor, that concludes my report.

36:37 – 38:340

Motion motion and second heard on that because y'all didn't want to hear me read it again. Uh vice mayor you recognized sir. Yep. Uh just would like to get some clarification on this. Um and it may end up going back to the attorney. So, I know there was some discussion where there was some uh compliance issues that was with the county. Is that correct? And just trying to figure out was this fixed because of the complaint from the county or was this actually justified. I'm trying to get an understanding for the residents that live in that area. All I know is that we were sent a notice of cleared violation as to the commercial activity that was happening as of February 2nd, 2026. Okay. Squared away then? Yeah.

47:040

As of right now. Okay.

47:06 – 48:220

And you know, my only concern is the fact that you've got a lot of residential neighbors and if we're just going to clean this up just long enough for our code and compliance folks to be having to deal with this, that's another concern of mine. Um, you know, I mean, we have enough issues with our residents that don't want to follow, you know, the city. The city is a lot more stricter. That's the other issue. Um, and by us changing it, just going into basically what I would say more of an industrial right next to residential, it's going to be a hard time for anybody. I mean, I mean, if I live right next door to a, you know, to, you know, to my neighbors and also they go from commercial, I mean, from residential to commercial, I mean, I get it. Uh, that's what we got areas within the city that are or also the county that are considered to be um, zoned properly. So, to go from residential to this, this is why I won't be supporting it. I don't want to do that to the neighbors. Um, just because of the fact they are residential, whether if it's five acres or not. Um, and then also the fact that the county has uh my understanding reading the report, it took a long time for the county to go through this and if the residents don't want to uh support the county's code, rules, regulations, I don't see them willing to support the city. So, I would not be supporting this. Thank you, mayor.

48:21 – 49:140

All right. Thank you. Any other questions or comments? Commissioner Miley. Uh yeah, I had concerns about it too and I didn't want us to annex something that that was still pending in the county, but that's been cleared now that's been satisfied. So, um I I'm going to support it, but I really hope our codes department is stays on top of it because, you know, one of the concerns was if this was pending in the county and we annexed the county part portion goes away and I certainly didn't want that to happen. So, hopefully um because of all the trouble that the county had to go through that uh this is not going to happen in the city. So again, codes if you're listening.

49:11 – 49:430

All right, Commissioner Hefner. Um maybe planning can help me with this, but did we not just approve a a reszone similar like adjacent to this property? That is correct. This this request does match the land use correct plan. So M commissioner Tvette, how did you vote on that? Do you remember? Let me go back.

49:39 – 50:520

Well, well, I'm just pointing out, look, we've already set a precedence. You meant you brought up residential going to commercial. Um, we've already set a precedence here, but it's look, and as far as the violations, I read the letter from I think it was the county attorney, Rivia's the uh the county planner that said that the violations had been cleared. And in fact, one of the one of the claims was he didn't have a building permit, which was found to be incorrect. They only went back to 20 I think it was 2022 when they looked to see if a building permit was pulled, but in fact, he did pull a building permit in 2021 and it was approved and they did all the paperwork and he he did as he was supposed to do. Just the county failed to go back one prior year to see that actually he was in compliance. they'd already approved the permit. So, that was a claim that was that the county made that they found to be incorrect. So, um I mean those are my only two comments. And maybe if the uh representative would like to come up and and speak, he's I would welcome him to come up and do so.

50:52 – 51:320

Vice Mayor. Yeah. So, just to go back to uh to our planning department if you could I mean so my understanding when we talked about this um the way it was being zoned it was not zone commercial and I think I spoke to the attorney about this today. What was the proper term that was going to be reszoned? It was like differential or something like that. What was the proper term today? Interchange. Interchange commercial. Is that what is that anything different than what was just uh voted on from the previous uh lot that Commissioner Hefner was referring to? It would be it's the same. It's the same

51:29 – 52:060

and they'd be subject to any CI zoning requirements once they're in the city. And like Commissioner Mle mentioned, if they violate it, they're going to hear from us. They're subject to any any regulations in CI like anybody else. It's something that they will acknowledge or have to acknowledge by coming into the city that they're now subject to our zoning regulations. Okay. Thank you. Thank you for the clarification, especially for this afternoon. The terminology was different, Commissioner, when I spoke to the attorney today. So, that's what I was trying to understand.

52:05 – 52:450

Yeah, it was it's all commercial for me and it's the land. You supported it, so I was good. But any other questions or comments? All right. All in favor of 9 CDE E and F please signify by saying I. Any opposed? Any abstensions? Uh those four do pass. 10B which is an ordinance to amend the fiscal year 2025 2026 budget ordinance 202535 to appropriate funds for cost of living adjustment for city employees.

52:41 – 53:200

A motion. Is there a second? All right. There's no second for 10B. So, I'll move on to 10 C, which is a resolution approving attachment to the master agreement between the city of Mount Juliet, Tennessee, and CDM Smith Incorporated for task order number four, and authorize the mayor to sign the agreement. A motion. Motion and second. Any questions or comments on 10 C? All right. All in favor of 10 C, please signify by saying I.

53:16 – 53:320

Any opposed? 10 C does pass. 10D, which is a resolution declaring the city of Mount Juliet Police Department property as surplus to be disposed of at Gov deals auction.

53:29 – 54:130

Hear a motion and a second. And there have been some changes passed around. And under the resolution, the credenza desk apparently needs to be extended from 9 to 10. And the decorative tables needs to be reduced from 10 to nine decorative tables. And the verides can be struck out all together. That's four. It's just uh it's just a line. So we're going from three verides to four verides. So is there any objections to the changes?

54:12 – 54:520

Question. I hearing no objections to that. We will update the numbers. Uh vice mayor, you are recognized. Thank you, mayor. Um just got a quick question. Uh I guess to the department heads. Uh, do we get any validation because I know these are uh cars that are a little bit older, but is there any um we check with all the other departments if any of these cars can be repurposed? Do we have any that are already off the fleet that could be added or was this already addressed? Yes, sir. We typically address that with police chief to see if there's any vehicles could be used in other departments. Okay. Because I because I remember uh last budget, I think it was parks and uh public works was looking for a couple. So, I didn't know if that was something that was already addressed.

54:51 – 55:260

We did. In that particular case, it was a truck that we got from parks and we repurposed it to city beautiful. It's on the road now. Okay, cool. Thank you. Yes, sir. Appreciate you. Any questions or comments? All in favor of the resolution as amended once, please signify by saying I. Any uh any opposed? Any abstensions? Anything to reconsider? With that, we concluded our agenda. Uh if there's no objections, we will adjourn. Hearing none, we are adjourned.
