Authorization to Contract with Hancock Estabrook, LLP for On-Demand Labor and Employment Legal Services

WHEREAS, the County requires outside labor and employment legal counsel services to advise and assist on labor and employment matters on an occasional, as-needed basis; and WHEREAS, Hancock Estabrook, LLC continues to provide ongoing legal counsel on behalf of the County for employment and PERB related matters; now, therefore be it RESOLVED, that the Wayne County Board of Supervisors is hereby authorized to execute a contract on behalf of the County of Wayne, subject to the County Attorney's approval as to form and content, with Hancock Estabrook, LLC for the period January 1, 2026 – December 31, 2026 for the provision of legal counsel on behalf of the County for employment and PERB related matters.

Authorization to Enter into a Memorandum of Agreement Between the County of Wayne and Civil Service Employees Association, Inc. CSEA Local 859 General and Supervisory Units

WHEREAS, Wayne County Nursing Home ("Nursing Home") continues to face difficulty recruiting experienced employees to fill vacancies; and WHEREAS, Resolution 638-22 helped to alleviate this ongoing problem by allowing experienced RN's, LPN's, and CNA's be hired at the Nursing Home at an advanced placement within the appropriate CSEA salary pay grades depending on years of experience from previous employment; and WHEREAS, the County has met with CSEA representatives in both the General and Supervisory Units and agreed to implement certain provisions aimed at improving the County's ability to expand this provision to other positions within the Nursing Home; and WHEREAS, both parties have agreed to implement this same experience-based provision to the titles of Supervising Nurse, LPN Supervisor, Physical Therapist, Physical Therapy Assistant, Occupational Therapist, Occupational Therapy Assistant, and Speech Language Pathologist all within the Wayne County Nursing Home location; now therefore be it RESOLVED, that the Chairperson of the Wayne County Board of Supervisors is hereby authorized and directed to execute a Memorandum of Agreement (MOA) with CSEA Local 859 General and Supervisory Units to include the following provisions, to be effective beginning the first payroll immediately after the March Board of Supervisors meeting in regards to grade level and step placement within the bargaining agreement: Supervising Nurse, LPN Supervisor, Physical Therapist, Physical Therapy Assistant, Occupational Therapist, Occupational Therapy Assistant, and Speech Language Pathologist within the Wayne County Nursing Home: Three (3) years of previous experience in their respective professions at time of appointment shall start at job rate. Two (2) years of previous experience in their respective professions at time of appointment shall start at Midpoint 2 rate. One (1) years of previous experience in their respective professions at time of appointment shall start at Midpoint 1 rate. Zero (0) years of experience in their respective professions at time of appointment shall start at hire rate. This agreement does not set any precedent or establish a practice or custom that binds either party beyond its stated terms.
