Hello, my name is David DeRoney. I'm from DeRoney True Value Hardware on Nine Mile. Good evening, members of the council, city manager. A few weeks back, Darren, the head of the DPW, stopped by the hardware store to fill me in on a proposed change that could be happening to the parking out in front of our store. And currently we have 11 parking places out front, and he said it could be reduced, as this blueprint shows, reduced down to six parking places. The tough thing for us in this situation trying times to keep a retail establishment going. We employ 33 people at this location, at our store. The majority of them reside here in East Point. Amazon is our biggest competition these days, and they are extremely easy and convenient to do business with. For us to lose five parking spaces in front of our store, that's a 45% reduction in that would impact us not only is it losing five spots it's also as Darren described to me and as the blueprint shows we would not it would only be usable parking spaces for vehicles traveling from the east because it would be a curb cut in Right now, we have an approach at each end, and cars can come from the west or come from the east. When Darren and I walked out front and walked along to look at things, I said, well, here's a customer that's parked right out in front here. And Darren said, oh, that's me. He says, I love parking out in front here. And I said, well, there you go. While we were out front, another customer had pulled up, Al, a regular customer, and he gets out with his dog. And we're a dog-friendly store. We let people come in with their pets. And he likes parking there because he doesn't like to park on the side where cars park next to him. He's worried about hoarding in somebody when he's getting his dog out to bring his dog into the hardware store. So again, having those parking spots out in front is huge for us. The East Point police love having a radar officer out in front of our store, which I love that too, on different days they're parked out front there. And they can, again, travel up from one end and out the other way. So to have a curb cut-in for us, again, a 45% reduction, again, That would be detrimental to our business 30 seconds in 1990 the City Council approved and I'm hoping that somebody on the council will make a motion that we still be grandfathered in in 1990 the city We received a letter from West McCallister. This is to my dad saying it's a pleasure for me to advise you that the East Detroit City Council at a regular meeting held on Tuesday June 26, 1990, approve your request to continue to use the right-of-way adjacent to Nine Mile and on Cortland and on Almond. I'm hoping that somebody makes a motion that we, again, being grandfathered in, be allowed to use those spots. I could give you each copies of this letter. You can hand it to Randy at the end. Good evening, Mayor, Council. Walter Kubiak, East Point resident. My wife and I, we watch the meeting at home if I can't make it. And last week, I heard Jennifer say something about a median that was going to be placed into Nine Mile between Kelly and I-94. Please. Please. That's been open for the last hundred years. There's no need to change that. People don't like change. Remember that meeting that was over here by the court? Somebody says, let's put something there to protect the people crossing the road. Nothing had ever been there for the past 100 years. So they put that in there. I was just talking to Chief today. Hundreds of cars ran into that. Brilliant idea. Let's be safe. And then they put a light on it. And people still ran into it. If you put a median over there with only one access to either side, you're going to have people driving right over the top of it. And then when the snow flies, how do you clean that? You know, have somebody take a long look at that before they go ahead and do that. That is one of the dumbest things I've heard, except for the three lanes on nine miles. Sorry, Mike. But don't touch that. Leave it flat. Let people use the left-hand lane to make left-hand turns. Jennifer Nicholas East Point resident couple of things in today's McComb daily there was a notice of public hearing that will be held at the Thursday August 6 planning commission meeting this is regarding adding a proposed amendment to our city ordinances regarding inoperable vehicles. The ordinance amendment would not only affect vehicles that are parked on the street, it would also affect vehicles that are parked in residents' driveways or backyards. This would include vehicles that residents may not be able to afford to repair immediately. The way the amendment is worded, after a total of 30 days, a resident could be fined an initial $200 with penalties escalating to a $400 fine or possibly impounding the vehicle. Again, the public hearing is Thursday, August 6th, 7 p.m. here at City Hall. Everyone's welcome to attend and give three minutes worth of comments. And I was wondering, Mr. Mattis, if it's possible to have the public hearing notice and actually all public hearing notices posted on the city website or the city's Facebook page, maybe somewhere in City Hall so people that don't get the newspaper are aware of it. At the June 16th City Council meeting, Mayor Kleinfeld asked if AEW could provide a design for Phase 3 of Nine Mile Road to be posted in City Hall. On June 24th, Mr. Mattis stated in an email to me that they were working on on posting plans in city hall. As of today, I do not see design plans posted in city hall. At the last city council meeting, Councilman Curley asked if AEW at one of the next meetings could give a short presentation on phase three of Nine Mile since residents and businesses have not had the opportunity to see the design plans. I've spoken to a few of the businesses on nine mile between Kelly and I-94. They have no idea that there are plans for a median in this area. And when I showed them a copy of the design, most of them had concerns about traffic safety as well as accessibility to their businesses. Additionally, throughout all of phase three, to me, it looks like some businesses are going to lose some parking. Mr. Doroney's store is an example of that. This was a problem in phase two. AEW created a design that would have decreased parking for businesses like East Detroit Bakery, and they actually eliminated all parking for Rosita's Hair Braiding, all of which was completely unnecessary. To me, the biggest issue is that plans are being designed without notification to businesses, let alone any input from businesses. And it seems like when businesses do try to give input, it is disregarded. All of City Council has stated that our businesses are vital to our city. Our business owners have stated that ample parking is vital to their business. So wouldn't ensuring that our businesses have the parking they want and need be a top priority to city council and administration? And I'm telling you, if you take five spaces away from Daroni's Hardware, that's just, that's not going to fly with people. Thank you. Thank you.

They're breaking the rules by letting him do this that the other I think the East rules are Way overbearing just like it is with this gentleman's store. You need to get the heck out of businesses way and let them It's a very as as mr. Girone. He said it's a very tough time for business And a nine-mile I've driven nine-mile quite a few times. It looks terrible. The most terrible thing is there's never any activity on it. All this stuff is tore up, and there's barrels, and where are the workers? I don't know who you contracted to get this done, but we only get their leftover labor? Is that it? We get labor when they want to give it to us? I mean, how long are you going to drag this out? That road is in terrible shape. It's an accident waiting to happen, the whole road. That parking amendment, you just split it in two. You let the police get... you let the police get the cars off the street because that's what needs to be done for EMT for fire and police. And you just strip the second half of it right out. You don't need it. You're, you're, you're overbearing again there. And for that, that's all I got for now.

on July 7th at approximately 9.15 PM. A cop stood at my front room window, shining his flashlight into my eyes when I exercised my legal right to not answer the door. I had not broken any laws. There were no exigent circumstances. I pointed towards the street for both cops to leave. The cop continued to move his flashlight in different directions and patterns throughout my front room, scaring the hell out of my rabbit. This is a violation of my Fourth Amendment rights. his actions conducting a warrantless search the other cop paced up and down my driveway the shift supervisor was allegedly not available and the combative PSA refused to tell them to leave even though I told her no laws were broken I was safe inside my home and I wanted them to leave I have a right to tell them to leave and when they remain on my property that further violates my rights Chief Haines you have not responded to my email and Mr. Albright I reject your responses since one issue was inadequately investigated and with your response that proves no investigation was ever conducted. These nuisance tenants next door on Saturday made a frivolous phone call to the East Point police because, how dare I tell them, they had 30 minutes until 11.45 a.m. to clean up the mess they made on my driveway and mowing the lawn. This is after a combative tenant refused to give me a time frame. You know what? There's no law broken there in telling somebody they have to clean up the mess they left on your driveway. Olefsky has a history of unprofessional conduct and his bias towards me. All he had to do was tell them to clean it up. Instead, he chose to harass me and continue to demonstrate his bias against me. There is no reason for this. And I have zero confidence that the East Point Police Department will do a thorough and proper neutral investigation against his badge. hate to think about how these poor rabbits suffered during the wildfire smoke due to your inadequate copied and pasted dog ordinance you've proven time and again it's not that you don't understand proper rabbit care I've talked about it extensively you just prove continuously you don't care you just turn a blind eye to these vulnerable rabbits and could care less about animal neglect thank you very much I'll finish during my second period thank you

All right, good evening, Mayor and Council. I hope that the rare movie in the park is still happening. I heard some rain earlier. I hope they are having a wicked good time. Good luck. A couple events coming up. We have the summer concert series. We have concerts the next three Thursdays in a row here at City Hall. The flyer is on the table at the back for more information. We also have several projects that are getting going. So you'll see paving happening on Nine Mile in the next couple of weeks. There's reconstruction happening on Lexington. Phlox is underway from Ten Mile to Haas. The Hayes Concrete Repair Program is going. The The splash pad has been an adventure in Eagle and permitting and things like that so we're awaiting some more touch points with Eagle it'll be a couple more weeks until we get that open the basketball courts are almost there on 10 mile Harvey we're waiting on some hardware and some paint. And then we had our first pre-construction meeting for the new court and police building last week. The fence is going to be going up next week. That is a very big project that's getting going. You'll start seeing some dirt moving in the next couple of days even. So we're very excited about that. We have been updating lots of processes and reviewing contracts and things. A special thanks to Assistant City Manager Kim Homan on that. She has been leading the charge on lots of our reviews and processes, which is fantastic. Early voting starts Saturday for the August 4th election. So just a reminder, early voting starts on Saturday the 25th. We'll run through the following Sunday, which will be August 2nd. That's right here in Council Chambers here at City Hall. You can find more information on the table at the back or talk to Deputy Clerk Underwood, who can give you all the details about early voting. We look forward to having you cast your vote on August 4th in that election. Because of the August 4th election, a reminder that our next council meeting is bumped to the following week. Sure, all public hearings, all special meetings, all regular meetings are all posted in the normal ways. We follow the state law on that. The Open Meetings Act speaks to how we post and notice those things. The city charter and council bylaws dictate as well. So you'll find all meeting... public hearing notices etc. Our newspaper of record the Macomb daily contains many of those. Everything that' s required to be posted in the newspaper is shared there and shared on the city website and shared on documents on demand is where you' ll find those on the city website the front door has those as well. We try to make that as available as we can there' s several ways we are required to share those notices and we try to meet or exceed those expectations.

So they're both done a lot of signatures and paperwork and back and forth, but we're done with both of them now The one we will draw on as we spend it the other one The police court with the money is deposited into our account today, and it will be earning interest until we spend it I did want to say on that one the bond was sold at a premium So we will be receiving ten million one hundred ninety one thousand and change and only have to pay back ten million So that extra money will go towards the project. And that's all I have.

It was just a reminder that for everyone that the proposed inoperable vehicle ordinance will be the subject of a public hearing in front of the Planning Commission at its first meeting in August I encourage as many people as possible to show up for that meeting and express their concerns and make comments about the proposed ordinance the Planning Commission will then make a decision which will include a recommendation to the City Council that'll be at either the next meeting in August Ryan would that be the second meeting I think just how they're gonna fall now Right. We're scheduled for August 11th and 18th. Okay. So it'll either be August or September meeting of the city council and then the council, of course, will then take into consideration the planning commission's recommendation and ultimately make a decision as to how that ordinance is going to move forward. I'll start us off, yeah. Probably the city manager would answer the question. I've got to have directed questions to him. First of all simplest question on my list is why are we even considering? Reducing the amount of parking spaces there Mr. Mattis if you have a response sure the

The 11 spots that are there currently are not of the same size and specs that MDOT requires on a road where the traffic travels as fast as it does. So given the space limitations, the two roads that enter Nine Mile there, six is the number of spots that fit the space and character of the road.

Paul was talking about was written in 1990 by one of our former city managers, Wes McAllister, when he said that all the parking would be taken, the Roney could use those parking. So I'm saying, so that was 2019 and this is 2000. So that's 36 years ago. And now we saying it was not safe. So what happened in the last 36 years? Uh, people just didn't care when I said the people, the administration didn't care or they didn't, that wasn't a priority. But now 36 years later, they're concerned that people can't park safely.

That's part of it. Uh, vehicles are bigger and that requirements are different. Um, the, the existing conditions are changing. With the project on Nine Mile, the conditions are changing. And just like with when your garage burns down, at the time of a change like that, it is the time to make a change to the built infrastructure that exists. So this is the first time we've done a project of this magnitude on that stretch, and it's time to make that change, to make it safer for the next 36 years.

Hello, David Duroni from Duroni Hardware. As Harvey pointed out, 36 years we've been using that parking. We haven't had an incident out front. We haven't had a crash. We haven't had a fatality out in front of our store. Prior to us, Morley Candy used that parking for decades, the way it was. We were grandfathered in because at the time, The city had told us, for the square footage that we have, we have to have X number of parking spots. Ryan, when we last spoke, you were going to check and see what the building department had for parameters on that, and I didn't hear back from you, but we had to have every possible parking spot. Now, Morley Candy moved out. Our sales floor is actually larger than when Morley Candy was there. We need all our parking spots. There is room, Ryan, out front. Cars, yes, can pull in from east-west. They can park head-to-head. But there's a passing lane. And our parking spots aren't out on the road. So as far as them having to comply with DOT or MDOT regulations, I can see that, yes, if there's a curb cut in, those spots would have to be whatever length. Because you're on the street. When cars pull up now, they're off of nine miles. So they pull in. They don't have to zip in and out. They can... They can pull up, take their time to park, so we have 11 spots out in front there. You said cars are bigger nowadays, which I disagree with that because one of our guys drives a Mini Cooper, and I see these little smart cars running around town and people with their Spyder motorcycles. There's a fair amount of customers that drive those, and they like parking those out in front. Those don't take up much space at all, so I don't. I don't see that vehicles on the whole are bigger. Back 36 years ago, when you had a – you could have a – I owned one at one time. It was my auto shop project. But I had a Thunderbird that was a two-door car. It was longer than my – than a Suburban that I once had. So you had cars that were just boats on wheels. And cars are smaller now. Uh, but again, I'm hoping that the council will at some point make a motion that we'd be allowed to grandfather in our parking the way it's been. There's been precedence set with East Detroit bakery being allowed to utilize parking across the street from each Detroit bakery. You got Frank Fozzie. He was allowed to get, you know, on street parking, which deviated from the plan. Um, I wish early on that this plan that thankfully Jennifer was able to finally get would have been AEW would have told us or come to businesses and there would have been some communication ahead of time to say, this is what could happen. You have 30 seconds instead of coming kind of late in the game. I'm glad that Darren stopped in to tell me to let me know. And he, Darren said, don't shoot the messenger, you know, but this is a proposal that could potentially affect you guys. You know, we had the public forum, the section between Kelly and 94. We were told don't pay attention to that right now. We're not talking about that right now. We're talking about the other part of nine miles. So none of this has ever been presented or explained. And it is concerning because I do think that there are a lot of changes with driveways and parking spaces. And... And I know I've asked for it since last fall. I've asked for it at least once a month to get some clarification from AEW to see what's coming. And this is where we are right now. Again, the same thing. And I would want to know from MDOT, I would want to make really sure that we know what MDOT's criteria is because we kind of went through this before with the other parking. MDOT says this, city ordinance says that, back and forth and back and forth. And you, better be a hundred percent sure that MDOT is providing us with the correct information as far as Mr. Droney's parking and any other parking that's being taken away because I disagree I don't feel that it's a safety issue I think there are ways to work around it for some reason AEW doesn't want to work around it I know MDOT approved this five lane plan but again that Didn't actually come through council in a clear explanation You know that was kind of all done at the same time with the public forum, you know NEPA approved this median Nobody ever talked about a median here and NEPA is going ahead and approving it. So there is Some camouflage, that's a good word. Non-transparency, that's another good word that's happened with this. Councilwoman Peshadlik, I'm not sure what your issue is with Mr. Daroni and his parking. You have fought for other businesses, East Detroit Bakery, the Chichinis, other people with their Rositas. You know, you've been very clear about... our businesses and their parking. And for some reason, it's very clear tonight that I don't know if it's a personal issue, but I would. ask you to maybe put that aside and treat all businesses fairly. I'd like to give credit where credit is due about these residents not going to be charged to repair the my client felt brought that idea to us the rest of us voted yes so you want to give credit to anybody give it credit to the mayor for doing that so thank you mayor for that i uh i'm going to be like a really mean watchdog on AEW. Not the council or the mayor or the administration, but the AEW. They're the ones that put in there that parking should be eliminated. Council tonight pretty much voted not to eliminate any of the parking. So we probably didn't do exactly the way you wanted to, Dave, but the bottom line is still we agreed with that. So I'm going to keep track of that, and by golly, they better show up on the 14th ready to answer questions from our residents and to give a presentation, and we want to make sure that We find out or ask, are there other places where they want to limit parking? You know, maybe I'm getting senile, maybe I'm getting old, but I don't know why the hell you have to eliminate any parking anywhere. Go around it. build around it. And so there's a couple of things that Walter brought up too that I'm gonna check in the median for instance, you know, but it's not too late to change those things. I'd like to congratulate Cloverleaf. They won the meatball contest at the Festa Italiano this past weekend. Kudos to them. Again, a local business that we like to support and recognize. Thank you to Angelina, Janelle, and Vicki for volunteering to be on our beautification commission. I know Vicki Coleman regularly cleans 8 Mile Road. She's always very much advocating for cleaning our city and keeping it beautiful. So I think she's going to be wonderful on there. I'm very grateful to Angelina and Janelle also for volunteering and for all our volunteers on our commissions. It's a labor of love and I do appreciate all the work that they do on our commissions. I'd also, in that spirit of thanking, I'd also like to thank Veronica Kleinfeld for obtaining so much funding for our city and She has obtained a lot of the funding for our new court and police department, the building, as well as Nine Mile Roads and funding for Ten Mile Roads. It's kind of a shame that we haven't recognized her, but I would like to thank her for all the hard work and diligence that she does on our behalf, and to let her know that I appreciate her. As for the Daroni parking situation, Here's the thing, Jennifer. It was slapped on the agenda last minute. I don't really have any information. I'm not trying to say that Mr. Daroni is giving us false information, but I don't actually know. I don't have AEW here. I'm kind of at a disadvantage when something's slapped on the agenda and we're asked to make a decision right then and there. I would prefer to have information prior. I would prefer to have you know, AEW here to answer questions about it, that type of thing. So that's why I did what I did. I know people are thinking that it's a personal situation. It truly is not. I do try to support our local businesses. I have said it before and I'll say it again. When the nine mile situation came up, I specifically asked AEW and I know Ryan had answered this question. I said, is it a, rip out and replace and he said no it's not and I said will it affect parking for some of our businesses and the answer was yes it could potentially affect some of those businesses and we've taken them one-on-one but again those businesses were put on the agenda we had information prior to the hearing on the agenda so just want to clarify that don't want to seem like it's a personal issue with Mr. Doroney I'm Grateful to him for having his business here in our communities. Been here for many years, and I am very familiar with the parking situation over there. So just want to clear that air. And then lastly, oh, wanted to mention music in the park this Thursday. So if you'll come here to City Hall, we have music outside. It'd be nice to join us. And lastly, one of the other reasons I'm voting no On the August 11th is that I will be absent. I had made plans to go up north and scheduled it the week of the 11th. So I won't be here. I had previously seen the schedule when I booked a cottage that, you know, it was the fourth, so it was no problem. But with it being changed, I will not be present. So I just wanted to let everybody know.

On Saturday, I had the opportunity to go to the East Point Baby Shower at Gianna's house. I was able to volunteer there, bring a couple packs of diapers and wipes for the newly expecting mothers and the residents at Gianna's house. I thought it was really amazing what Gianna House does for the community and the mothers in the metropolitan area who need assistance with their families. So I just wanted to go ahead and kind of let you guys know that it's wonderful and to have Gianna House in the city of East Point. is a gem that we all should be taking a look at and seeing if we have any time to kind of donate to assist those parents, those newly expecting mothers with some of their needs.
