Good evening, councillors. Rich Russell, American history teacher residing at 34 Cross Street. First question, when was the Massachusetts Constitution adopted? If you said 1780, you're correct. Second question, when was the US Constitution adopted? If you said 1788, you're correct. Article 48 of the Massachusetts Constitution covers ballot questions. Just about five months ago, all of you, like I did three years ago, swore to uphold a variety of things, including the mass constitution and that political pain in the neck, Article 48, which allows for ballot questions, which allowed the ballot question number one in November of 24 election to pass. In late March or early April of this year, I put an item on the agenda requesting this body craft a resolution letting the political bigwigs on Beacon Hill know that a majority of the Lawrence voters voted for it and want this question to become the law of the Commonwealth. In its first appearance before the council, it was referred to the city attorney for his take. Last Tuesday's ordinance committee meeting, the committee chairman tried to take it off the table for some sort of action to be performed upon it. What action was performed on it? The agenda item was returned to the city attorney for his further perusal. After it was all over, I thought I was watching a remake of the movie, Animal House. Remember, when things got bad, Bluto would yell, road trip, road trip. Well, I'm sorry if some of the councils consider my comments sarcastic, but it appears my only hope in getting action on this item. I know this will aggravate some on the council who are fond of handing out resolutions to everybody in sight. But I must ask this question. Did those resolutions make the trip to the city attorney's office to be approved? If not, where do I get a form to file a politically influenced discrimination complaint regarding agenda item 143.26? As always, I thank you for the time to bring this issue to the entire council.

The Lawrence Square Project resumes again this week. William R. Higgins Square is at the intersection of the corner of Fritz, Myrtle, and Trenton Street, and it's at 4 p.m. William Higgins served a brief amount of time in World War I, lived, but was an amazing athlete in the city of Lawrence. He was an amazing athlete and coach, and he... HAD QUITE AN ASTOUNDING RECORD OF ACHIEVEMENT AT LAWRENCE HIGH SCHOOL. BUT ODDLY HE WASN'T MADE A BASEBALL COACH BECAUSE HE COULDN'T GET PASSAGE FROM THE SCHOOL COMMITTEE BACK IN THE DAY. SO HE DECIDED TO BE VERY INVOLVED IN OUR PARKS AND OUR RECREATION FACILITIES. WHEN HE FINALLY GOT THE SCHOOL COMMITTEE VOTE, THE YEAR THAT HE, I FIGURE WHAT YEAR THAT HE PASSED AWAY NOW, BUT But within right before the baseball season started before he can coach his first game he died And they and the city decided to name this corner at the Fritz Myrtle and Trenton Street after him Next week. We don't have a City Council meeting for two more weeks But on June the 11th at 4 p.m. At the corner of Hampshire and commissary where the post office is We're going to be remembering Private First Class David Buck Lee Square. He was in the Army. He died in World War II. He was in a tank, and his claim to fame was he was the first Chinese American in our city, and I think maybe even in the Commonwealth, to die in battle. And you can still see his sign at the intersection. IF GIVEN THE CHANCE, ONE OF THE MOST REMARKABLE PIECES OF RESOLUTIONS, SPEAKING OF RESOLUTIONS, THAT WE'VE EVER RECEIVED AS A CITY COUNCIL IS THE RESOLUTION SIGNED BY MEMBERS OF THE BUSINESS COMMUNITY WHO WANTED TO SEE THAT CORNER NAMED AFRICAN BECAUSE HIS FAMILY WAS IN THE LAUNDROMAT BUSINESS AND THERE WAS A LAUNDROMAT NEARBY. If we can get that out of the archives again, it is truly a remark. It's, what's the right word, calligraphy with different colors. And it's like almost in parchment and it's rolled out. And it's just an amazing resolution. So hopefully, I'm going to ask the clerk if she can find that again and pull that out for all of us to see. It's amazing. And last thing, I've got maybe 10 seconds left. The trip that I had to Europe was very good. And I just came back last night. They went to the three cemeteries. Remember 919 servicemen who have passed away. And it's just a remarkable opportunity. Thank you. Remarkable opportunity to pay tribute to those who died in our nation's battles, who never returned. And so it's very touching. And I would encourage you as the last bit, If you ever have a chance to travel internationally, in Europe especially, we do have cemeteries there. Take a moment of your time, if you have a vacation or a trip, just to see what it's like to be in one of those facilities. It'll make you proud to be an American when you're there. Thank you.

Item 8426, the acceptance of a new layout plan of public ways for part of Short Street, Maple Street, Courier Street, and Urban Avenue. This was sent up with a favorable recommendation, and I submit that to you in the form of a motion. Second.

There's a motion on the table. Properly second. Discussion? THIS IS NOT AN ACCEPTANCE ACTUALLY. ACTUALLY. It is just a set of plan to record the actual intersection that is a public way for years, correct?

That's correct. Could I ask Mr. McCarthy, so just can you expand on that a little bit more? What are we trying to accomplish with this?

So these streets that are involved, Streets involved in this ordinance request is a part of a project for the replacement of the bridge over the Spicker River. The James Majewicz Bridge, or we call it the Short Street Bridge, And these are the four streets that surround this. So one of the requirements of the Department of Public Transportation is that all the plans, the surrounding roads that are part of the project need to be included as part of the public way layout in the registry of deeds. the engineering corporation that is working for us reviewed the went into the registry to look for the plans couldn't find these streets listed and as a requirement we need to file these plans with a registry so once they are accepted by this COUNCIL. I WILL THEN RECORD THEM WITH THE REGISTRATED DEEDS. ARE THESE CONSIDERED PAPER STREETS? THEY ARE NOT. THEY WERE PART OF AS FAR AS WE CAN TELL BECAUSE THEY ARE PART OF THE RECONSTRUCTION PORTION OF THE LAWRENCE DEVELOPMENT AREA. THIS WAS AN AREA THAT THE STREETS WERE LAID OUT BACK IN THE 1800s. And we went back in the 1970s and 1980s and redeveloped that area as part of that, tore down a lot of houses. And the plans did not appear to be recorded. So they need to be recorded now.

So it sounds like a ministerial error or omission where they were supposed to have this and they never did it. But right now, if you're living in that area, it's a public-owned street. There's paid it is plowed you have. That's correct all that's going on in these particular that is correct.

So what we we had a a land surveyor go out there can any check the meters and measure them out and create this plan using the existing elements in the street.

And just because you're in front and we went through these very quickly this evening, which I don't have a problem with, there was a previous item with the name of a bridge. I just want to make sure that, there goes the clerk, that we had the right name of that bridge down for Document 229. Was it the Bedoul Bridge? Is that the name of the bridge? The Theodore and Padua Bridge? Theodore, yeah.

That's correct.

We refer to it most commonly as the Daisy Street Bridge. Right, so we should have on our official documents, and we went through this very quickly, but we should have on Document 229, that should be in there. Is that okay? Yes, that's fine. And I would just, without us having to redo that, I would just ask that we just make sure the documentation has the proper name for that bridge. Thank you. I went back a little bit because we went really quick, which I don't have a problem with, but we went really quick and he wanted to come up and make that clarification and didn't have a chance. So I'm just asking the clerk, if you were here, to make sure the document would have that.

The document do not have that specifically on the document. But the intent of this item is to recognize the plan that they put together when it comes to the intersections. and record those for the purpose of designing a potential infrastructure project in the future, correct? So no changes are being made.

There'll be no changes. There'll be no physical changes to the street layout. There will actually be, the only change will be to Short Street on the bridge. The bridge will be widened when it's replaced. But these are the existing conditions currently on the public way, and they're not gonna change.

Discussion. Councilor LaPla? Is there anything, I think that Council President actually asked us earlier, is there anything that you can mention now that we don't need to go to an executive session for? because you'd be as candid as we can regarding any of this.

This is the matter that- Oh, no, I can, the part that doesn't have to go in executive session is I'm looking for transfer of funds to pay. As you know, because of the way we budget, we don't put money into my account for litigation, for settlements. So I have to ask money to be transferred from one section to the other. So here- What I'm asking is because I'm going to have bills until the end of the year, I'm asking that from the litigation reserve, I want $1 million to be transferred. From free cash, the amount of $1 million to be transferred, they're going to be transferred into legal services in the amount of $450,000 and into the court judgments in the amount of $1,550,000. So that's the main purpose of tonight is to transfer funds because I can't pay anything until it's in the appropriate funds. Okay.

So before you continue, Mr. LaPlante, let me just clarify a few things here.

We have an underlying motion that is motion to approve.

So as soon as we get out of the table matters, we have that on the line motion, which is motion to approve.

But I can explain, as Councillor has said, if you want me to explain anything, I can explain in open session, that's what I can do.

Yes, so let's open that, since we have an on the line motion, explain everything that you can, an open section. If Councillor have any specific questions related to the transfer. Correct. And then we can discuss it now. So Councillor Blank, you have the floor.

Yeah, so again, this is only because of the limit, and we understand this. We have a very limited litigation judgment section in our budget, legal services account budget, and that there may be questions by the council on updates on particular legal matters. That is what we can't talk about. And the underlying.

Why a particular amount?

The settlement numbers and what we may want to settle and what that amount would be. That's the stuff that we can't talk about publicly because we want to show our cards when the folks who we are opposing are watching this meeting and listening to this.

And also the other transfer is for legal services, which regarding outstanding cases, and I believe that they... I BELIEVE THAT THE COUNCIL WANTS ME TO KIND OF GIVE LIKE WHAT ARE THE OUTSTANDING CASES, WHERE ARE WE ON THEM, AND WHAT'S THE LATEST.

The future. Thank you to you. It's your turn is already publicly show up. This is from that this 1.5 is going to the settlement that is already out there it's public right we can talk about that right because it's already out in the public or not.

Well, it's out in public. It has not been, there is no agreement.

Okay. So can you elaborate how many communities are into this lawsuit? Because the public out there believe that it's just us when it comes to that, and it's not just us. It's different communities. Okay.

I hate to be specific, but this lawsuit only involves us because these people, Lawrence Police only sued us. Are other police departments suing their communities? Yes. As you can see.

For the same reason, correct? Exactly, same reason. That's what I wanted to do.

Multiple communities. And I'm surprised the ones that haven't been hit right now, which I'm surprised is the city of Boston, but I don't know the facts in their case. Okay. Yeah, but... It's a universal, as I did in a memo, this is a result of an appeals court case of Daniel LaCorte versus the town of Brewster. So it started with the town of Brewster. They did not pay their police officers a full police wage. and just so we can say again, I disagree with the results of this case. I strongly disagree with it, but it is law, so it doesn't matter what I think. We have to follow what the precedent is. And they said that paying police recruits is not appropriate. You have to pay them as though they were brand-new officers, and the difference is what they call it.

How far back does this go?

It goes three years. There's a three-year statute of limitations from the date they filed that goes to the Wage Act case, and then under a theory of common law, under contract, there's a six-year statute. So if there were someone that this happened to seven years ago, they were out of. They're not included in the case. Okay.

So four of the councilors are gonna be already here on the budget hearings. this Wednesday coming up. This Thursday coming up. I'm sorry, June 4th. And we hope that anyone else that can make it, please make it at 745 just to order that specific public hearing for the budget. So special meeting for June 4th at 745 p.m. The other special meeting that we are announcing today is going to be the proposed fiscal year 2027 and that's going to be for Monday, June 15 at 7 p.m. That's going to be the day that we expected to discuss the budget of fiscal year 2027.
