And I'm here tonight recommending that you consider an amendment to the city's code for the mixed-use district. And I would first like to explain why I think The amendment is a good thing for the city as a whole. And then explain my particular reason for advocating it.

OK. This is the particular section of the code right now. It requires a minimum of 25 acres. Under certain circumstances, it can be less than 25 acres. And I'm just recommending that we change it to be 10 acres. Understanding that for someone to have a mixed use district, they would have to come to you and get a zoning approval for a mixed use district. And as a planned district, they would have criteria requirements, design criteria, improvements required with it. So you would have a full opportunity when any project comes before you to consider it and condition it. Nothing about that changes except that now a parcel of 10 acres could ask for that.

Okay. Right now, there are very few properties left in the district that could use mixed use, because 25 acres is a very large parcel, given the land areas that are left. Also, a mixed use district is an ideal district for the redevelopment of your older shopping centers, because you can come up with planned criteria that allow you to address the unique features of these older shopping centers that often can't be addressed by standard zoning. I keep forgetting whether I go. This kind of mixed-use district and availability to a variety of properties in the city is a common planning tool, actually, throughout Broward County. And we gave you some examples. In Miramar, they only require three. Plantation has no minimum acreage for a mixed-use district. And Fort Lauderdale has rack. districts, and all of those districts have no minimum size. So having just 0 to 10 and 25 and above isn't really consistent with planning that's being done. And I keep going backwards. The reason my client is interested in this is that they own property. on 145th Avenue, and this would facilitate the redevelopment of that site to allow residential use. This is the property, and I'll just explain the situation to you. an office building on the north and an office building on the south. Originally, these two office buildings were part of a planned commercial development. The office building to the south was zoned into a mixed-use district. that includes the Baptist Health Facility and another residential development to the south. My client has now acquired the office building to the south. And in order to redevelop what you see as a massive parking lot, that's not attractive along 145th Avenue and is essentially a heat island, we would need to bring the office building on the south into our NXT. Where the residential would eventually be is in the middle. It straddles both of those parcels. So there's no way to leave the office building to the south and the property that's part of that in the current MXD. We have to move it into ours. And if we do that, the other MXD will be less than 25 acres. And so they would be harmed. By this amendment, both of our parcels will meet the minimum requirement. Now, this is not a vote here tonight, of course, on whether you want the MXD that I will be bringing to you. It's a vote only on the amendment. And regardless of our situation, I believe this amendment makes sense for the city. I think the staff is in support of it for exactly that reason. They see more redevelopment coming in the city and giving them a tool that they can work with for the properties that fall between 10 acres and 25 acres. That concludes my presentation. My name is Jeffrey Rodriguez, and I'm speaking on behalf of Mindset Connect. for their application concerning the property located at 1700 Northwest 98th Avenue. This property is owned by Faith Presbyterian Church and is operated under a DBA of Hope Community Church. Mindset Connect proposes to establish a structured faith-based homeschool support program on the existing church campus. The program will serve students from kindergarten through 12th grade of varying learning abilities with a maximum enrollment of 120 students. Mindset Connect is requesting approval of three related items. Item number eight is a variance from the four acre minimum lot size requirement for this use. And item 10 is a special exception permitting K through 12 educational facility on the site and the corresponding site plan approval. As part of their application, there are no new buildings being proposed, nor any expansion of the existing buildings on the footprint of the property. Mindset Connect will use the existing classrooms, parking areas, and facilities on the site, which the church and or previous tenants have used as preschool or daycare programming for over 41 years. Students of Mind Second Ed will be transported to the school by their parents or guardians. There will be no bus transportation. And given the homeschool support structure of the program, drop off and pick up times are varied as and when the students feel they need the support. Although the code generally requires the four acres for this use, this property contains approximately two and a half acres and The site already has the facilities, parking, and circulation necessary to accommodate the program. Importantly, the applicant is not seeking relief from any operational or safety requirements required by the code and will be installing the required eight-foot fence along the canal adjacent to the property. This application satisfies the applicable criteria for the approval of the variance, special exception, and site plan approval, as the property can safely and adequately accommodate the proposed programming, and the requested approvals are consistent with the historical use of this property. For the reasons presented in the application and consistent with the city staff's recommendation for approval, we request that the board approve the variance, special exception, and site plan subject to the conditions recommended by staff. Good evening, Chairman Gonzales, members, Craig McDonald with Corporate Property Services on behalf of Dutch Brothers Coffee. We've got three items on here. I assume we should probably do the presentation raw and then you've got to vote on them individually. Is that OK with everyone? OK, good. All right, so this is the Dutch Brothers, 85, proposed Dutch Brothers, 8579 Pine Boulevard. This is the abandoned checkers that's there in rundown checkers right now. So we're requesting three variances. They're going to propose to demolish the existing abandoned Checkers restaurant with a drive-through and construct a new 986 square foot coffee restaurant featuring a side-by-side drive-through. We're requesting a variance to reduce the setback of the required 30 foot side setback along Northwest 86 Ave to by now the trash enclosure. So it would be a 21 foot setback there. We're also requesting a variance to reduce the minimum floor area required as 1,500 square feet to 986 square feet. And the third variance, we're requesting a variance to reduce the required 40-foot Pines Boulevard corridor landscape buffer to 20.6 feet or 21 feet. Here's the aerial. We're right on the northeast corner here of Pines and Northwest 86th Avenue. Right next to us is the Chipotle. And then the shopping center is to go further east.

All right, here's the kind of the site plan laid out.

I know that's down the road, but this kind of gives you an idea of what we're talking about here. In the center, you've got the coffee building. We've got a side-by-side drive-through and then a bypass lane that all circulate in front of the building and back out. We've got parking adjacent to the building. And in the rear, we've got employee parking back there and then the trash enclosures located in the rear back there. I'll run you guys through each of the variances real briefly and then answer any questions you might have. So for the per section 155.431C, a 30-foot side setback is required adjacent to Northwest 86th Avenue and Dutch Brothers is proposing a 21-foot setback for the trash enclosure. The site's irregular with an extremely small width of 114 feet, as you can see here. So there's not a lot of width to the property. In order to locate the trash enclosure away from the intersection of Pines Boulevard and Northwest 86th Avenue, Dutch Brothers has located the trash enclosure at the rear of the property, adjacent to the employee parking. In order to provide both the dumpster and employee parking, a 21-foot setback is the largest setback possible to achieve both. The hardship is not self-imposed, but a function of the narrow parcel width. The grand variance will not be incompatible with public policy and will not adversely affect the adjacent property owners while allowing employees to park and safely access the restaurant. There's a pedestrian path that leads to the dumpster for employees taking out trash, as well as people parking back there so they can safely access. The trash enclosure will be surrounded by hedging material, which will eventually conceal the dumpster walls from Northwest 86th Avenue, and the nine-foot setback variance request will not even be noticeable. With the dumpster located outside of the drive-thru compared to where it is today for checkers, the trash company has to get into the drive-thru depending on when they access it. So Dutch Brothers will improve the operational efficiency for the trash pickup while allowing employees to park on site and safely access the restaurant. The minimum floor variance is the next one per section 155.611C. 1,500 square feet is required in the zoning district, and Dutch Brothers is providing 986 square feet. The site's irregular with an extremely small width of 114 feet. In order to provide the side-by-side drive-through, the bypass lane, the restaurant building, and the walk-up canopy, the minimum floor area of 1,500 square feet cannot be achieved due to the narrow width of the site. The hardship's not self-imposed, but a function of the parcel size. The grant of variance will not be incompatible with the public policy and will not adversely affect adjacent property owners and will allow the small, irregular infill site to be positively redeveloped and eliminate the current eyesore. The third and last variance is the buffer variance along Pines Boulevard. Per Section 155.633, a 40-foot landscape buffer is required adjacent to Pines Boulevard and Dutch Brothers proposing 21 feet. Again, the site's irregular with a small width of 114 feet. In order to provide the side-by-side and adequate queuing and staffing to accommodate Dust Brothers customers, as well as to provide a bypass lane, which is convenient afforded to the customers to leave at the site after receiving their order while others are waiting, the width of the landscape buffer has been reduced. The hardship's not in self-imposed, but a function of the narrow parcel. Currently, if you've been out there at this site, We're going to provide, as you can see, and you'll see that in the site plan, but plenty of stacking. They're pretty busy here, but right now that checker says from the inside menu board, three cars stacking, where five's required by code, and the outside only has one. So we're going to be more than satisfied with those requirements. The granting of the middle variance will not be incompatible with public policy and will not adversely affect the adjacent property owners while providing improved operational efficiency, convenience, and safety for its customers, employees, as well as Chipotle's customers next door because the queuing won't spill out into the dry valve that they both share because it's very narrow out there. On the proposed 21-foot landscape buffer, we'll meter exceed the code required landscaping that will be placed in the 40-foot landscape buffer. Also, if you go to the parcels immediately adjacent to the east, they've got about 29 to 30 feet, so they're not providing 40 either. So we're close, but we're about seven to eight feet shy of those folks. The safe site efficiency achieved by the proposed site plan far exceeds the impact of the decreased right-of-way landscape buffer. And in closing, the variance requests are minimum necessary to redevelop the infill site, infill abandoned site. The variance requests are consistent with the authority and purpose of the code as it provides the ability for a code deviation, which will address the evolving need for restaurants to provide the greatest efficiency and safe site circulation for its customers and the residents of Pembroke Pines. The variance approval will have a positive effect on the community and the surrounding businesses and will eliminate a vacant eyesore of a site. The improved operational efficiency gained by the proposed site plan will have a positive impact on Dutch Brothers customers as well as the community. And finally, the approval of the variance will foster the infill site development of a small parcel and bring a new vibrant look to the property and surrounding parcels and roadways. With that, I'd be happy to answer any questions you all might have.

Yeah, so if you see on here, obviously we used to the north of us behind the top of the site plan right there. That's the main access into and out of the shopping center for Northwest 86th Avenue. You come in and you head to the south. There's a shared driveway between Chipotle and the proposed Dutch Brothers. In the middle, you see kind of the middle island there. That's where there's two lanes that you can go enter into and place your orders. We meet the minimum required, I think five or six from each one back. And then somewhere to come Chick-fil-A, they have people taking your orders out there. And then as your coffee or if you have a smaller item, not as complex, they bring you yours. We're providing a bypass so those folks can get around the cars that are waiting, exit the site conveniently. But when you do this and you provide the proper staffing and everything, that checkers building doesn't. It has to slide forward on the site plan to make it all happen, which is why we're reducing the landscape buffer up front a little bit.

The building itself right now is a four-story building We're not adding any square footage for the building other than the elevator core that we have there and a very small lobby for the entrance to the elevator, which is meant to serve people waiting for, you know, either going to the tax collector or the Department of Motor Vehicles. This is a project of the existing building here. And the scope, as you can see, all we're doing is a very small addition in this area. which basically consists of the elevator core and then a little lobby to receive the people going into the building. This is the existing condition of the building and the main purpose of the new elevator core is because our client is leasing two levels right now to other tenants as well as parts of the third and fourth level. So what they're trying to do is minimize the disruption to any users that are already there and that don't have to do anything with the tenants that are going to occupy a portion of the third and fourth floor. And it's meant to alleviate, you know, the unnecessary interaction between existing tenants and the new ones. and also to provide very good ease of, you know, overflow to people that are just going to the tax collector's office. So the area where we're looking at putting the elevator is actually on the rear of the building, and the reason for that location is because the entire east side of the building is the parking area that's going to be allocated for the users of the tax collector's office. whereas on the east side of the property, the front and part of the rear is for the existing tenants. The proposed building, the addition, is basically taking place in this area here, where we have a small lobby. Again, it's meant to have people have really good guidance into the space, so they can really easily identify where they're meant to go into the building. And then the elevator core is basically a What we're providing here is, again, this is the lobby area, very small. The entire footprint of the, including the elevator core as well as the lobby, is 269 square feet. We have all the parking that we need. In addition to that, our client has a, an agreement with the Lot to the South, which is a community church where they use the parking during weekdays if necessary. But again, there's plenty of parking spaces based on the requirements that we have. We're really not adding any users because the use is the same. It's just a convenience of that elevator for the project. This is just a couple of shots we added for the presentation. Again, this is the lobby intended to capture people's attentions going there. And then the signage that we have for the building is we deleted all the pylon signs and everything from our thing. So in essence, what we did is In essence, what we did is the only signs on the building is the tax collector's logo here, which were within the square footage permitted. But we were addressing that question before by creating a very small monument sign in this portion of the building. But again, for your questions, this is assigned parking here. And then all the parking here is going to be on the east side of the property. On the back there's going to be shared parking because there's plenty of parking for for the use I'm not I'm just sorry.

Also, there's going to be a dedicated security guard, which is part of the deal with the Broward Collector's Office, guiding people for the property. So that's part of their agreement, that there's going to be people guarding the property, so it's going to be extremely safe. And the main reason to answer your question is that we have Again, it's the number of users. It's not that they're going to be there a long time, because a lot of implementations have happened where you get a driver's license much quicker, you see your taxes much quicker. They've done a great job with that. But it's just, again, to prevent the commingling of people that are their own use, and also to basically, by the creation of the lobby here, which we agreed to do for our client, on behalf of the Broward County's collector's office, is that people are being cued. First, they have a little lobby. They understand where they're going. And then they hoist it away to the third and fourth level. So right now, this elevator doesn't stop at the second. I'm sorry, at either the first or the second floor. It doesn't have a connector. And it's intended, basically, to help the flow really quick with the users.
