Okay, let's pray. Our heavenly father, we thank you so much for this opportunity that we have this evening for our council to meet and to make important decisions. We thank you for the many blessings that come our way. Just uh first off, the blessing of cooler weather and fall, and we give you praise for that. We also uh I'm new here in town, but I want to thank you for what I have heard and seen and experienced so far in Mallister. and we thank you that we have a what seems to be a really good place to live and to raise a family and to be a part of it and we give you thanks tonight. I just pray that as our council makes decisions that you'll guide them and you'll help them to have uh compassion and a caring about the things that they decide and bless each one with with clarity and also with courage uh to make decisions that need to be made. Again, we just uh praise you for your goodness and may the work done today be that which would honor not only our community but also would honor you. In Jesus name we pray.

here and we have a quorum on to recognitions and awards and have our land acknowledgement. Uh the Chakaw Nation reservation is located within the original homelands of the Kado and Witchah peoples. The Pane and Aricara have ancestrial ties here. The Shauni and Quapa established settlements in this region during the 1700s and early 1800s while the Oage and Kaiwa visited the area. Qua tribe seated this land by treaty to the United States before it was later seated to the Chuckaw nation. Shortly after being the first to endure the Trail of Tears and death, the Chakaw people arrived here, followed by the Chickasaw who lived among them before moving further west. Through this acknowledgement, we remember those who came before us to honor the sovereignty and traditions of the native peoples who remain connected to this land and commit ourselves to the respect and partnership with indigenous communities past, present, and future. Um I had submitted three nominations to the Oklahoma chapter of the American Planning Association and Mallister was selected for awards and recognition for um outstanding public project for the strong boulevard sidewalk project which uh spanned over several years and then also um great public spaces which was Hunter Park and then also for citizen planner which was uh Lacy S. So, I'm really excited for these awards and recognitions for Mallister and appreciate all the help from everybody that contributed to all these projects. So, absolutely. Thank you.

Honorable mayor, members of the council, this is an ordinance that the mayor asked that we produce regarding the creation of community advisory board. It does create a 13 member board to help advise the city council on matters affecting the community and those the well-being of those residing here. Uh we do ask for approval with one addition. Did uh did we get the changes? This still says 11 members and and then section 241B on the uh the rolling terms for 13 members instead of 11. It appears the corrected version did not make it into the packet, but the only changes as I understand them were the from 11 members to 13 members. Yeah. Well, it's just more of an advisory board, but also I think they'll bring lots of good ideas.

Yeah, it it was tough trying to keep it small, but but also didn't want to get one-sided where you take all the care services and then you ignore the business owners. And so we wanted to make sure and get business owners. the way people show up now. You probably really need that cuz half of they won't show up for meetings the way they tough getting quum sometimes. So on the core, you know, you've got 13 people, but it only takes three for qu that was in a previous version where we had originally had five. So it'll be a m it'll be a majority of six or seven. Uh handouts are good for you know one time you know some big disaster or maybe a government shutdown people are not getting paid you know but if you

truly pick a radical example like that [laughter] never but um it's it's just a proven thing that that if you can help people get up to to move up and instead of just providing for them and just giving them stuff, that's that's kind of toxic. It's not good for their families and so forth. It's okay to get them on their feet, give them stuff for a while, but I I think if we can if we can focus this to help to help people take those opportunities that are here. We got new businesses coming. We've got houses coming. We've got We've got help. We got some amazing uh charities and nonprofits here. Um we can just kind of be like a distribution, you know, hey, go over here, that's what you need, this that or the other.

And that's honestly that's really a lot of focus. This is just an advisory board. There's no money tied to it. But what we were afraid of is we have so many organizations that are willing to help one. We want to make sure and keep them connected. But we didn't want to go one way or another. And so,

like you said, you can you can go one way and it's like, well, they're just down on their luck. We're trying to help them. But then you have somebody downtown going, but they're sleeping in front of my door every night and they're running their customers off. So, how do you balance policy with what we're trying to do with being compassionate and helping someone up, but then helping businesses stay, keeping the community clean at the same time? So, that's what we just wanted to bring business members and community members and service members all together and and try to help us advise with policy. Yeah, it was four and five that kind of picked my interest here, you know, where we're actually doing some budget stuff and things to help with the uh different

But we wanted it to be broad enough that we're going to have other community issues, okay, that we're going to need help on. We just we just don't want it to become a great big giveaway because then we'll have we'll have people moving in everywhere. I think we can take a look at our city budget. No, that's not going to happen. I think this is more a forum for discussion, data sharing,

one of the things I thought was really interesting, it's probably been a year and a half or so ago. Uh we had a big town hall and u somebody would get up and they would go, "Hey, I'm with so and so service." And literally they would be interrupted by someone else saying, "I have some items I can help you with. You need clothes for kids. I have clothes for kids. I have all kinds of socks. You need socks for kids. I need to get your phone number." And it was every time someone would stand up. It was another service that was kind of interrupting going, "We need to get connected. Please don't leave this meeting without talking to me." And that's one hope we have here. here if we can continue to connect those up services. Wish we had a list on our website. I just it almost echoes what you're saying, mayor. Um, so I just wanted to say that during our comprehensive plan many years ago, starting in 2017ish, 2019, when we were pulling together stakeholders, we didn't have housing um, associations. And so it was an idea to bring together our nonprofits. And I think it was one of the first times that many of them have been in the same room together not recognizing all the efforts within the community of what is out there to serve our our citizens and the the services that they offered. And so um we did then carry that on into leadership Mallister and we get them together for a panel also and just help educating the community. But I think that this is a valuable thing to be able to bring all of them together and all of them in the same room and maybe like you say, you know, um recognize what each of them are doing and they can help each other. I don't think that so much as a a handout as it is just recognizing what we have in our community with all the nonprofits and what they're doing. Um they also have a pretty good pulse on our community and knowing what our citizens and our public, you know, what their needs are. And I think that they um could pro provide some valuable input there to us as we're writing different policy and everything. Um code enforcement, we often connect people um to some of the nonprofits and the community services available in the community as well. And so we definitely see um a positive in this as well. So I just want to let you all know that.

Item number three, discussion of possible action to approve an ordinance of the city of Macaster Oklahoma amending chapter 30 courts and jail article 2 municipal court not of record division one general generally section 30-32 cost upon judgments of conviction by adding incarceration cost fee to be paid upon conviction and amending chapter 48 fees charges and service rates by adding fees for incarceration cost fee providing for cification repealer severability and declaring an emergency. Good evening, council. [laughter] So, tonight uh well, a couple of meetings ago, um Chief Herd brought you um an a contract with Pittsburgh County to amend uh increasing that cost um per the jail fees for incarceration and all that. You guys agreed to approve or approve that. Um this is kind of piggybacks on that uh particular contract where because currently the court does not have the means of um charging a a person uh for that or recouping that cost that we pay out. And the city of Mallister right now is paying uh an average of 27,000 uh $632 in the past five years um for that going out to the county um which I have is you know $2,300 per month um for this and there's no way for us to offset that cost going out. So with this $50 it matches um that contract exactly. So it's a give and here and we've not had this um ordinance in the past. So, Mr. Hammonds was kind enough to help us write this one to put in place.

So, for this ordinance or this presentation, I'm going to give this one over to Cara. She has a lot of information that she might be able to answer questions on that can help us along with this one. Good evening, council members. So, the purpose of this is to put into an ordinance what we are are already practicing. In the past, leak adjustments have been in a resolution and pool adjustments have been a policy. We've had some issues come up that this needs to be law. Um, so what is changing as we are adding into the ordinance a couple paragraphs? Um, and one of the big things that we are changing is how we calculate leak adjustments. Pool adjustments are going to be calculated the same. It just needs to be in an ordinance, not just a policy. But leak adjustments are going to change. Um, we're going to calculate water adjustments one way and sewer adjustments another way. In the past, we've taken the like a high bill and we deduct the average and then we split that with a customer. If it's if it's a leak like a a busted pipe or something like that, if it's a leak based on a city issue, uh we didn't install a meter right or a faulty meter, that calculation is different. But if it's for an actual leak, um water is still going to be split with the customer because that is treated water. sewer will be written off based on uh sub subtracting out their average. So in the past we've taken the full bill, gotten an average, divided it by two. So we're going to separate water and sewer and calculate those differently.

That is for customers that are on Mallister water and the ones that we share water responsibilities with like rural water and KBS water, some of those that have overlap. Oh, so one of the reasons this came up is because we have a sewer only we have several accounts that are sewer only and based on our resolution um because the argument was the sewer ran down the there was a busted pipe and that their sewer only and it did not go through our sewer system but we could still only we basically split it with them and so sewer does need to be calculated differently. So this is going to be any customer um water water customers will they'll have an adjustment based on water and sewer and this allows the sewer only customers to have

I mean now I it wasn't an emergency so that's why we didn't put this on there although I've been working on this since January um so I'm glad it's finally on here. So, I would say as soon as possible. Um, we're still calculating our leak adjustments the old way until this gets approved. So, and because that that is what's in the resolution. So, once this is approved, it's going to change how we calculate it. I actually have a folder on my desk with leak adjustments that need to be approved. So, as soon as it's approved, we're going to change [clears throat] the way we do that. What would the situation be where somebody's just paying a sewer bill?

We have some rural water um customers that they're they have they get a water bill from the rural water district, but they're on our sewer lines. We have quite a few customers that are like that. Really? Yes. part of the the situation that happens if they had a different water supplier. It's almost since we don't have a mechanism to cut the sewer bill all the way. They're be we're being held accountable to only take away half of that sewer bill based on another provider's performance. And so it kind of it gets into a kind of a weird situation.

We don't sell craft any water, do we? We don't sell Krebs water, but we do have Krebs water customers on our sewer lines. Okay. And so, uh, the Oklahoma has industrial access grant and that's what this is all about. We're going to go see if we can go after that money and get as much of that to get this project started. The bank is seeking a assignment or essentially a lean on the tiff rights the developer received under our development agreement that is if for any reason this development fails and the bank has to foreclose on the property they also want the tiff rights to go with it. We do recommend approval as it's a critical part of financing. Haven't answered any question

And so they are even excited about us getting to present the new um format to you guys because they have helped us gather a lot of this information and helped make it a little bit easier for us because a lot of the data that we bring in especially when it comes to sales tax is a a lot of information. So going through that it takes some time and we obviously want to meet our deadlines in order to present to you guys and then also meet you know our our needs for you know just presenting the um having the report in a timely manner. So um so let's start on the general fund um performance um for the month of September um with 25% of the fiscal year complete. The general fund collected 4.2 million in revenue representing 23.7% of the annual budget. Expenditures were at 4.1 million um or 22.83% 83% of the budget after accounting for an estimated tiff payment of 280,000 and with the monthly fund rate I was going to say fundraisers fund transfers um the general fund shows a deficit approximately of 114,000. So that first piece of that you've you've seen before this has been on your reports in the past actually this whole document right here. So the revenues as you can see the 23.70 and the expenditures at 22.83 83 and below that shows that same graph that you for our

customers in. So the next um sheet is our tax report. So sales tax performance. Um again um the remittance is made up of primarily of actual collections for the last half of of July and estimated collections for the first half of August. Um along with the smaller amounts for corrections or reconciling amounts from the prior estimates collections for September exceeded both projections and the and the figures from the same month of last year be before allocating to other funds. 90% of the tiff district totals are deducted from this piece. So this one below down here is what you've seen before but how we have identified September with the fiscal year the projection the difference and the percent of of the change. So [snorts] I hope and then it breaks it down into where those funds are going to with the general fund, NPWA, uh infrastructure, cancer center, the early childhood safe safe rooms, waterline projects, the tip district and the total then of course the total sales tax. So your next sheets on the neck, let's see the sales tax um comparable cities. So although Mallister is ranked 30th in the population, among Oklahoma cities, it ranks 20th in taxes. Mallister has a higher rank tax ranking than the two cities directly above and below uh in its population. Durant is ranked at 25 in population. ADA being ranked at 33 in population. um which we've talked about those sister cities in all of our reports in the past because we you know being close in proximity for us.

Unfortunately, this one is a shows a little bit of a shortfall for us. So the next slide is your use tax. Um this rate aligns with the sales tax rate at 4% with all the proceeds proceeds allocated to the general fund. September collections were above projections but below what was collected for the same month last year. Although collections are higher than last month, we are not meeting projections for year to date. Use tax is difficult to project due to the unpredictable its unpredictable nature.

So, uh, retail compromises the largest percentage of sales tax collections at about around 59%. The largest year-over-year category changes from September changes for September where in service in services down almost 14%. and more than 12 or [clears throat] [snorts] adds up to about 12,000. Um, see manufacturing and wholesale down 20%. And so the total sales tax collected the 1.6 million there. Retail is up, hotel and restaurants up, services being down, manufacturing hotel being down, and utilities being down.

Um so I took his you know there between him and our fleet maintenance um with information. and I had him go out, look at bids, see what, you know, what is best for the city. And then we looked at um do we just pay outright for this or do we, you know, finance it? And of course, you know, that big one 520,000 is hard hard uh amount to swallow. So, I went out to the banks, local banks like we always

In those easements, uh, there have already been some um, DEQ permits that have been issued for the water lines and the sewer lines, and those are referenced also in there. and also they've already obtained their DEQ permits for storm water. So everything seems to be in order as far as the utilities um that will be present on the site and um Cal Planning Commission met on October 21st and voted unanimously to approve this plot um that's here before you tonight. So we just recommend the approval of this final plot.

But first of all, we have an RFP that's going to go out real soon on Mullen Park improvements, which is a new bathroom near the splash pad. And then we're going to enclose the control rooms for or all the controls [clears throat] for the splash pad, a new pavilion, some patio seating around it, 88 sidewalks from the splash pad down to the track, and then also down to the street. And then we have some shade kites and some picnic tables and some other stuff. That's all part of a grant from the state that we're we're continuing with. Uh some good news for nutrition department. We have five items that we are getting into our kitchen and dining room. We're getting an ice machine water dispenser that and not going into it a lot. It is a benefit to everyone there because it does staff doesn't have to stop what they're doing to fill ice cups of ice and we fill so many when we start but then we run out. So this is going to give them direct access to an ice machine. Uh we're getting [clears throat] a new handwashing sink in there. Uh and this is all because of state inspections and health department inspections. We have to do some of these things. the ice machine's not. Uh the sink will have a be operated by your foot so you don't have to touch the that the faucet which is something that they have asked us that told us that we need to do. We're putting some stainless up in areas that we had wood that we and wood is not something that they want anywhere near a kitchen. So, we're changing a lot of stuff to stainless and also a new uh steam table that is bigger than that we serve from that's bigger than the one we have off. All of these

This is almost a $90,000 project. uh Game Time that sells the playground, they are paying for roughly 40,000 of it. We're giving given a discount of 40,000 and the Chalkaw Nation has given us a check for $46,000 that will pay for the playground and then also the the freight and stuff on that. And then we our part, we have about $4,600 for the border wall around it and the ADA ramp into it. And then we're going to have an additional $2,700 or so for concrete when we install this. And this is going to test our parks guys uh installation skills because this thing is

Speaking of that, on the 6th of November at 6 PM at Kaichi Tech, there will be a public forum for anyone who has questions about their processes, safety of the product that they're going to be handling out there. Um, they'll be on site to answer any questions that anyone might have. So, I would invite the public to come and take opportunity to ask any questions that they may have for that. uh the Amazon facility up open. Um I don't know if they've made their first delivery out there yet.

Because at eighth and eighth and oage you and on semino between fifth and sixth there's burned down houses in both places and it's a mess. Kids can really get hurt in that and if if we don't have an ordinance against that, don't they have a certain time to clean it up or mark it off?
