Just a minute. The property in this application is located on the north side of West 27th Street between West 2nd Avenue and West 3rd Avenue. The lot contains approximately 6,450 square feet or 0.15 acres, according to Miami-Dade County property appraisals records. The property was originally plotted in 1924 as a 50-foot wide by 129-foot depth lot, as recorded in Platte Book 34, page 42, and was improved with a 1,877-square-foot single-family residence in 1939, establishing the residential use of the subject property. The subject property is designated kennels, on the city's future land use map. The surrounding future land uses designation consists of canals and industrials to the north, east, and south, and industrial to the west. The applicant is requesting a small-scale future land use map amendment to change the property land use designation from kennel to industrial. The property is currently zone M1, industrial district. Therefore, the existing land use designation and zoning classification are not consistent with one another. The proposed amendment will establish consistency between the future land use map and the existing zoning classification and allow for future development or redevelopment of the property for industrial uses. At this time, the property owner does not have a proposed redevelopment plant. The existing residents may remain subject to the applicable regulations governing the legal non-conforming uses. Any future redevelopment shall comply with the regulations of the M1 zoning districts and will require the demolition of the existing residents through the appropriate demolition permit process, therefore ceasing the residential use established in the subject property. The proposed amendment is consistent with Objective 1.1, Land Development Policy 1.1.1, Land Use Categories, and Policy 1.1.4, Zoning Districts, which promotes coordination between future land uses, surrounding land uses, and zoning classification. The request is also consistent with objective 1.5 land use compatibility and policy 1.5.1 inconsistencies, which require future development to be consistent with the future land use map and require proposed land use amendments to be consistent with the character of the community and adjacent future land uses. The site is served by Pump Station PS 04-056, which is currently operating in OK status, indicating that adequate sanitary sewer capacity is available to serve future redevelopment at this time. Since no redevelopment is currently proposed, final concurrency and availability of future facilities and services will be evaluated by appropriate city departments and reviewing agencies during the site plan and concurrency review process once a development proposal is submitted. Based on the analysis, staff finds that the proposed amendment from canals to industrial is consistent with the City of Hialeah comprehensive plan and the existing land use pattern in the surrounding area. The amendment will also resolve the existing inconsistencies between the property land use the property future land use designation and M1 zoning classification and establish the appropriate land use framework for any future industrial redevelopment of the property. Therefore, staff recommends approval of the requested small-scale future land use map amendment from kennels to industrial. And also you have a copy of the future land use map with a 500 feet land use radius around the property. Recommendation approval.

The property in this application is located on the south side of West 44 Place between West 10th Court and West 10th Avenue. The lot contains approximately 3,951 square feet or 0.09 acres. The subject property is improved with a $1,098 1,298 square foot and one-story single-family residence originally constructed in 1988, according to the Miami-Dade County Proprietary Appraisal's record. The subject property is designated low density residential on the city's future land use map and is zoned R1, one-family district, which is consistent with the future land use map designation. The subject property was plotted through a subdivision recorded in Platte Book 130, page 96, in 1987, resulting in a lot with a 43-foot frontage and a total lot area of 3,951 square feet. As such, this subject property is considered a substandard lot because it does not meet the minimum R1 zoning district requirements of 75 feet of lot frontage and 7,500 square feet of lot area. A review of the city's microphone records indicate that the residence was originally constructed as a three-bedroom, two-bedroom residence under permit number 1987-4409. A roofing permit was subsequently issued under permit number 1988-2028. The water heater was also replaced under permit number 1997-4458. and a concrete slab was installed under permit number 1997-3419. Most recently, the windows and doors were replaced under permit number 2022-645. In March 2026, the property owner was issued a building without a permit violation under code case number BWOP-001560-2026 for failure to obtain a building permit for an existing aluminum roof at the rear of the residence. Subsequently, the owner applied for a building permit to legalize the aluminum roof structure under permit number BLDR-006775-2026. During the zoning review process, staff determined that the existing aluminum roof terrace does not comply with the minimum rear and street side setback requirements. As a result, this request is being presented for consideration today. The submitted survey indicates that the existing aluminum roof terrace is constructed up to the south property line with an interior size setback of zero feet. However, the submitted site plan indicates that the aluminum roof terrace will be modified to follow the existing principal building envelope and comply with the required five foot interior south side setback. The proposed aluminum roof terrace will contain approximately 370 square feet. The plan further indicate that an existing accessory shed consisting of approximately 80 square feet is located on the north side of the property. A review of the city records indicate that no building permit was issued for the construction of the existing shed. Additionally, the structure encroaches into the required 15-foot street-side setback. Therefore, the shed shall either be removed or relocated to comply with the minimum required street-side setback. Should the applicant choose to retain the shed, the appropriate building permit shall be obtained and the structure shall be brought up into compliance with all applicable provisions of the City of Hialeah Code of Ordinance. Lastly, the proposed site plan provides approximately 1,551 square feet or 39% of the pervious area, which exceeds the minimum pervious area requirement. Accordingly, the applicant is requesting approval to allow the existing aluminum roof terrace to maintain a street-sized setback of 13 feet, where a minimum setback of 15 feet is required, and a rear setback of 3 feet, where a minimum setback of 5 feet is required, pursuant to Section 98-2087B2 of the City of Hialeah Code of Ordinance, to legalize the existing structure. A staff finds that the request may be approved as the subject property is legally created substandard lot with a frontage of 43 feet and a total area of 3,951 square feet making it difficult to accommodate improvements while complying with the minimum setback requirements of our R1 zoning district. The proposed modifications will eliminate the existing encroachment into the adjacent property to the south and ensure that rainwater runoff remains onto the subject property. Additionally, the reduced setback will not significantly obstruct light, air circulation, or visibility, and the structure will remain entirely within the subject's property's boundary. Therefore, the request is compatible with the surrounding residential area and does not appear to create any adverse impacts on neighboring properties. The staff recommends approval of the request subject to the following conditions. Number one, the existing aluminum roof terrace shall be modified in substantial accordance with the proposed plans prepared by Fernando Marquez PE, signed and sealed June 12, 2026, as reviewed by staff. Two, the aluminum roof terrace shall remain open on all sides and shall not be enclosed. And three, the existing accessory shed located on the north side of the property shall either be removed or relocated to comply with the required 15-foot street side setback. Should the applicant elect to retain the shed, the appropriate building permit shall be obtained. And the structure shall be brought into compliance with all applicable provisions of the City of Hialeah Code of Ordinance. And four, the property shall maintain the minimum pervious area, which is the green area. in accordance with the approved site plan. And five, the property owner shall proceed with the building permit BLDR-006-775-2026 and obtain all required approvals, permitted issuance, and final inspection approval following the approval of the final decision. So the staff recommends approval with all those conditions.

The lots are the second and third parcels from the West 5th Avenue and contains approximately 3,520 feet or 0.08 acres, according to Miami-Dade County property appraisal records. The properties were originally plotted in 1924 as a 20-foot wide by 88-foot deep lot under Blood Book 9, and page 154 and have remained vacant since that time. The site is designated as low density residential on the city's future land use map and is currently zone C1, restricted retail commercial district, which is not consistent with the future land use designation. Therefore, this application seeks to address and resolve that inconsistency. The surrounding land use designations and zoning classification are as follows. To the north, low-density residential, medium-density residential, zone R2, one and two-family residential districts, and R3, multifamily district. To the east, low-density residential and medium-density residential, zone C1, R33, multifamily districts. To the south, recreation open space, zone C1. And to the west, low density residential and high density residential, zone R2, R3, 4, and C1. The applicant is before the city requesting a rezoning of the subject properties from C1 to R2 in order to allow the construction of a duplex throughout two substandard lots. In addition, the applicant is requesting variances to permit a total lot width of 40 feet where 75 feet are required, a lot area of 3,520 square feet where 7,500 square feet are required, an interior east side setback of 6 feet where 7.5 feet is required, an interior west side setback of 6.58 feet, where 7.5 feet is required, and the rear setback of 5.16 feet, where a minimum of 25 feet is required, and a log coverage of 32%, where a maximum log coverage of 30% is permitted. According to the submitted plans, the proposed project consists of a two-story duplex with one dwelling unit located on the ground floor and the second dwelling unit located on the second floor. Each unit will contain approximately 1,115 square feet of living area and will consist of three bedrooms and two bathrooms. The project provides tandem parking accommodated a total of four off-street parking spaces, thereby meeting the minimum parking requirements. The proposed development complies with the required front setback. However, it does not comply with the required east and west interior side setback or the rear setback, for which variances are being requested. Additionally, the plans provide approximately 1,655 square feet or 47% of pervious area, exceeding the minimum required of 30%. The proposed pervious area will contribute to improving the site drainage while enhancing the overall aesthetics and environmental quality of the property. Also, the submitted site plan proposes a driveway approach along West 24th Street to provide access to the proposed parking area. The proposed approach shall be reviewed and approved by the City's Street Division during the site plan and concurrency review process, and any required revision shall be reflected on the final site plan. The requested rezoning from C1 to R2 will bring the subject property into consistency with the city's future land use map and allow for a residential use that is compatible with the surrounding neighborhood, which include a mix of one and two family and multifamily residential development. Approval of the rezoning will facilitate the appropriate development of a long vacant infield lot in a matter that supports orderly growth and is consistent with established residential character of the area. With respect to the requested variances, the property was plotted prior to the adoption of the current minimum lot width and the lot area requirements for an R2 zoning classification and is therefore considered a substandard in size. A stat finds that this minor increase in log coverage will not negatively impact the surrounding properties. The proposed interior size setbacks are also minor reductions that are necessary due to the narrow 40-foot width of the property. Adequate separation will remain between the proposed duplex and adjacent properties, and the reduced setbacks are not expected to negatively impact the neighboring residents. The requested rear setback of 5.16 feet, where 20 feet is required, is adjacent to an existing 12-foot alley, which provide additional separation between the proposed duplex and the properties to the rear. Existing FPL and utility facilities are located within the alley. Therefore, approval of the reduced rear setback shall be conditioned upon confirmation that the proposed development will not interfere with the alley, existing utility facilities, or require utility access. The proposal was submitted to Miami-Dade County Public School Concurrency Management System to ensure that adequate school capacity is available to accommodate the students anticipated to be generated by the proposed residential development. The proposal is currently under review. The site is also served by pump station PS04-102, which is currently operated under unconditional fill-in allocation allowed status. indicating that several locations may be approved by this time. However, due to current operation conditions, the pump station status shall continue to be monitored during the development review process to ensure an adequate capacity remains available. Given the substandard size and width of the property, the nature of the requested setback reduction, the additional separation provided by the existing alley and the residential character of the surrounding areas, staff finds that the requested variances are reasonable and will allow for the long-term vacant property to be developed with a residential use that is compatible with the surrounding neighborhood. Based on the applicant request, staff recommends approval with the following condition. Number one, the property shall be developed in substantial accordance with the plans prepared by Oscar J. Gonzalez, AR, sign and seal on May 13, 2026. And two, following hearing approval, the applicant shall submit two sets of architectural plans with landscaping plans to the planning and zoning division to initiate and finalize the site plan and concurrency review process. And three, The proposed driveway approach along West 24th Street shall be reviewed and approved by the City Street Division during the site plan and concurrency review process. Any required modification shall be reflected on the final site plan. And three, prior to final site plan and concurrency approval, the applicant shall provide confirmation that the proposed development and reduced rear setback will not interfere with existing 12-foot alley, existing FPL facilities, utility easement, or required utility access. Any required approvals or releases from FPL and any other applicable utility provider shall be obtained. And number five, the applicant shall obtain approval from Miami-Dade County Public School concurrency management system as applicable prior to final site plan and concurrency approval. And number six, the availability and status of pump station PS04-102 shall be verified during the site plan and concurrency review process, and the applicant shall obtain all required sewer capacities and allocation approvals prior to the development. Staff recommends approval with those conditions.

The property in this application is located on the south side of West 31st Street between West 7th Avenue and West 8th Avenue. The lot is approximately 10,425 square feet or 0.24 acres. The site is improved with a 2,222 square foot single family home originally built in 1950, according to Miami-Dade County property appraisal records. The property was originally planted in 1932 as a 60-foot wide by 139-foot deep lot, as recorded in Platte Book 34, page 26. In 2017, the property owner to the west of the subject property forfeited approximately 15 feet of land, as documented in a quick-claim deed recorded in Official Records Book 30790, page 26. 1366-1371. As a result, the subject property increased to approximately 75 feet in width. Consequently, the existing single-family home became legally nonconforming with respect to the applicable site setback requirements, as the required site setback increased from 6 feet to 7.5 feet due to the increased lot width. Therefore, any proposed addition or expansion to the principal structure that maintains or extends the existing non-conforming setback requires a variance approval for the expansion of the legal non-conforming structure. The property is designated low density residential on the City's Future Land Use Map and its own R1 One Family District, which is consistent with the Future Land Use designation. The properties to the north, east, south, and west are also designated low density residential and zone R1, one-family district, and R2, one- and two-family residential district. The current property owner purchased the property in 2025. During the reoccupancy review conducted under application number RO-009886-125, it was determined that an existing terrace and an addition located at the rear of the residence had not been properly permitted and required legalization. To satisfy the conditions of the reoccupancy approval, the property owner subsequently submitted a building permit number BLDR-011897-2025 to legalize the existing terrace and addition. During the zoning review of the building permit, staff determined that approximately 170 square foot addition does not comply with the required 7.5 foot interior west side setback. As a result, variance approval is required to allow the expansion of the existing legal nonconforming structure. The variance presently under consideration is intended to allow the property owner to proceed with the legalization of the existing addition through the building permit process. The submitted site plan demonstrates that the existing residents comply with the required front, interior east side, and rear setback. According to the submitted survey and site plan, the property also complies with a minimum of 30% purpose area requirement established by the City of Hialeah Landscape Emanuel. The submitted site plan also depicts an approximately 96 square foot shed for which staff has not identified an approved building permit. Therefore, the property owner will be required to submit a separate building permit application to the building division and obtain all applicable approvals necessary to legalize the existing shed. In addition, The legalization of the existing improvements, the property owner has submitted a change of use permit under BLDR-005215-2026 to convert the existing single-family residence into an assisted living facility, LAF, with a maximum capacity of six beds. The submitted floor plan identified approximately a 170-square-foot addition as a multipurpose room. the addition does not provide interior access or connectivity to the remainder of the residence. As a condition of approval, the floor plan shall be revised to identify this area as a storage or provide a revised interior floor plan connecting all the interior spaces to the main house. Therefore, the addition may be utilized for storage only or be interiorly connected to the main residence with no direct exterior access. A staff finds that the request variance can be approved to facilitate the legalization of the existing addition identified during the reoccupancy process and to allow the property owner to satisfy the outstanding conditions. The addition remains entirely within the boundaries of the subject property and does not appear to create a negative impact on the surrounding residential properties. The addition does not adversely affect light, air, visibility, or access to the adjacent properties. Furthermore, the applicant has two options to select from for the use of such addition. Approval of these variants, however, does not constitute final approval of the proposed assisted living facility. The existing shed or any of the improvements require separate permits of approval. Such improvements and uses shall comply with all applicable city permitting, licensing, and regulatory requirements. Based on the analysis, the staff finds that the requested variants will not adversely affect the surrounding properties or the established residential character of the area. Therefore, staff recommends approval of the request subject to the following conditions. Number one. building permit number BLDR-011897-2025, which was submitted for the legalization of the existing terrace and addition, shall be completed and finalized, including all required reviews, approval, and inspections, and that the floor plan associated with that building permit, BLD-011897-2025, shall be revised. to change the approximately 170 square feet addition currently labeled as multipurpose room to a storage room only, or provide a revised floor plan reflecting the interior layout of the addition to connect to the main residence and change the existing addition exterior door to a window. And three, the proposed assisted living facility shall be limited to a maximum capacity of six beds and shall be subject to the approval and finalization of a change of use permit under permit number BLDR-005215-2026, as well as the other applicable city and county and state requirements. And four, approximately... The approximately 96 square feet shed depicted on the submitted site plan shall be legalized under a separate building permit. The subject property shall maintain a minimum of 30% pervious area in accordance with the City of Hialeah landscaping, and any future modifications, expansions, or change in the purviews of the addition shall be required review and approval by the Planning and Stoning Division and any other applicable city departments. Some of you may remember this site from our entitlement process last year. This subject property is approximately 18.2 acres and located within the Hialeah Heights annex area of the city. It's located just east of West 36th Avenue at 3500 West 92nd Street and abutting a number of residential subdivisions, including Aragon to the south and Vontara, Bellagio, and Aquabella to the north. Last year, this project, known as Security Estates, was approved for 178 townhome units to be developed by Lenar Homes. Next slide, please. This property has a land use of low medium density and per the reference 2025 approvals was rezoned to RH 3M multiple family district. Next slide, please. As such, we're here tonight to support the request that will provide technical updates to those RH-3M code provisions. Based on our 2025 entitlement process, the RH-3M code certainly provided for the high level elements of this townhome project, but as we began to formulate and prepare our site plan and concurrency packages, we quickly realized that there was not a lot of specificity or guidance to a townhome project as this co-provision is more geared towards multifamily development. So our proposals seek to provide that additional detail for townhome developments in the RH3M district, for example, lot sizes, minimum floor area setbacks, and more importantly, the fee simple ownership structure that was so desired by the council at the time of the approval we're also proposing the implementation of a pattern book to maintain design compliance throughout the life cycle of the residential subdivision next slide please We should note that this proposal does not impact any of the significant elements of the previously approved site plan, which encompassed 178 rear-loaded townhomes. This is truly a cleanup proposal to provide further guidance in the City Code with respect to the development standards. As pro-offered during the 2025 approval process, this will be a for sale townhome product by Lennar that will enhance the attractiveness and visual appeal of the surrounding neighborhood. It will encompass a meticulously landscaped perimeter, signature entrance plazas along West 36th Avenue and West 92nd Street, pedestrian walking paths, bicycle racks, and a tot lot. These design elements and requirements will also now be encompassed as part of the pattern book that we're proposing. This pattern book will serve to control a number of design elements from fencing design, accessory structures, approved planting selections, color schemes for exterior paint, as well as operational requirements such as resident parking and front yard aesthetic standards for residents. Next slide, please. As set forth in this slide, and again, per the 2025 approvals, the project will also include over 370,000 square feet of unencumbered green space throughout the project, including a walking path around the existing 2.89 acre lake. The project will also provide off-street parking spaces well in excess of the city requirements. At the time, we were approved for 453 spaces where 392 spaces are required. Next slide, please. Ultimately, this proposed townhome is consistent with the pattern of development in the area and the existing residential neighborhoods of Aragon, Montero, Bellagio, and Aquabella. Next slide. This slide provides an example of the rear-loaded townhome product where two-car garages are located at the back of the unit, providing a much more welcoming front yard environment as you enter the front door. Next slide. As you can see here, this is the rear condition of the units with garages hidden from street view and accessed by private drives between the townhome clusters. Next slide. As approved in 2025, the project will also incorporate luxury amenities as well, including a private cabana and a pool facility for residents to enjoy. Next slide. That's just another view of the clubhouse and the pool. Next slide, please. Ultimately, these requests are truly cleanup updates to the code, which will serve to provide greater detail for the requirements of a townhome development within the RH-3M, including the pattern book to ensure design and operational compliance throughout the life of this project. It does not serve to modify any of the key development program approvals from 2025. such as density, open space, the amenities, and will ultimately serve to provide fee-simple ownership in the City of Hialeah.
