All right. Minutes are approved. All right, let me move into a brief explanation how the hearing will go. Cases will be read into the record. City staff will provide a presentation. Uh once staff has uh given their presentation, planning commissioners will have an opportunity to ask questions. Um once everybody's asked their questions, we will close the uh planning portion of the hearing and open the public portion of the hearing. Anybody wishing to speak for against a case may do so. Starting with the applicant, we ask that you limit your comments to five minutes. When everybody from the public has had an opportunity to speak, we will close the public portion of the hearing and reopen the planning portion where we entertain a motion or a vote. Um, if anybody here thinks they may speak for or against a case, if you would please stand and Jordan will swear you in.

No. All right. Uh, moving on to new business. Case number P-26-10, request by Langley G to reszone two parcels from Commercial Highway C3 zoning district to mixeduse MX zoning district. General location 120 and 124 Avenue H Southeast. The area covered by this request is.3 plus or minus acres.

Heather, senior planner for the record. Uh before you is the future land use map. The two properties um are located there and outlined in black and this is all primary mixeduse hub in the area. As you look at the zoning map, you can see um they are designated C3. Immediately adjacent to the east is MX. And as you kind of look down that first street uh corridor, those front parcels that come in front and go in a little bit on each block um have kind of followed the C3 and then into MX and then into R2. So, it kind of downgrades the zoning as you move east into the more single family residential area. This is an aerial. The parcel um on the west side is vacant and the one on the east side has a single family home. This is a view looking at it from Avenue H Southeast. This is looking to the west. There's a doctor's office on the corner that fronts on First Street. Uh across the street is a salon building and then to the east of single family residential. Langley G is the petitioner and request the city reszone two parcels from commercial highway C3 zoning district to mixuse MX zoning district. The property subject to this request contains two 50 foot wide parcels totaling30 acres located at 120 and 124 Avenue H Southeast. The eastern parcel contains a single family home constructed in 1932 and the western parcel is vacant and has been for at least 20 years. A review of historical zoning maps indicates the properties had residential zoning through at least 1969. The city assigned commercial zoning at some point prior to 1999 and the current C3 zoning designation was assigned to the parals in 2000. Each lot contains approximately a 6,543 square ft, exceeding the 5,000 square foot minimum lot size requirement of the C3 zoning district. However, when C3 building setback requirements, C3 permitted uses, on-site parking

requirements, storm water requirements, and landscape buffer requirements are considered, it is highly unlikely these properties will develop with a use permitted in the C3 zoning district. The petitioner proposes to construct a duplex on the vacant parcel, which the MX zoning district permits. In addition, the single family home located at 124 Avenue H Southeast currently operates as a legal non-conforming use. Reszoning the property from C3 to MX would bring the existing single family residence into compliance as a permitted use. Uh for the record, all notification requirements for this request were met. And uh uh in conclusion, based on the developed and proposed residential uses, small lot sizes, NC3 development standards, the requested MX zoning district represents a more appropriate zoning district for these two lots. Based on the existing and proposed residential uses, the small lot dimensions, and the development requires imposed by the C3 zoning district, the requested MX zoning district represents more uh appropriate zoning district for these two parcels. The current C3 standards, including setbacks, parking requirements, storm water regulations, and buffering, significantly limit the reasonable redevelopment potential of these small lots for a viable commercial use. In contrast, the MX district better aligns with the historic residential pattern of the properties and supports reinvestment compatible with the surrounding area. Reszoning to MX will also eliminate the existing non-conformity of the single family residence and allow for development of duplex on the vacant parcel. Both of which represent lower intensity uses than those permitted under the current C3 zoning district. Therefore, staff does recommend approval recommend that approval of um case number P2610 and it's foring the city commission for final action. I stand for any questions.

Um second um we have received an opportunity for training um if you so wish um the heart of the APA heart of Florida section is going to put on a planning commissioner training. It is in Sebring on March 13th. It's an all day event. Um there is a limit of 75 people which who can attend. U biggest thing is the registration deadline is next is Monday coming up March 9th. So if anyone's interested in attending, we can we can make arrangements to have you go.
