be on. Okay. It is just a few minutes after 5:00. We'll go ahead and call the board of works and public safety meeting to order. February 9th, 2026 here in the council chambers of city hall. Uh first we will start with roll call. Dan, would you lead us? Dan Libkkey, board of public works and safety. Jake Vissing, city attorney. Justin Green, mayor. Salah Hano, city clerk, treasurer. Warren Jones, board of works and safety.
Okay, we are all here tonight uh present and accounted for. So, we will start uh the agenda. Please uh if you will look, we don't have a lot tonight, but we will be efficient with our time and uh make all the necessary votes count. So, let's start with the minutes from January 12th on pages one and two. I will make a motion to accept the minutes of January 12, 2026. Dan makes a motion to approve. I'll second. Warren seconds. I. Post. Same sign. Okay. Um, we'll jump to mayor's comments. A few things, guys. I want to point out some obvious things. Um, our South Main, our federal highway project is progressing. Uh, there has been a little snow and cold weather if you hadn't noticed. Uh you guys are pretty observant though on my side.
Is that right? Okay. Well, anyway, so there's been a few delays. Um and as we dig trenches and think of safety and uh what needs to be done appropriately, yeah, we probably need to let the weather break. And so, uh those crews did take a little bit of a hiatus, a little pause, uh back on it. And to that point, uh we're actually going to have some aggressive work in the next today through week, 10 days. uh probably run some multiple crews and so uh you're likely to see a little more action down uh up and down that section. Again, it's the south gate of the square to the uh north abutman of the bridge there. So, uh th that's the parameters. Those those crew members are going to be busy uh right now. Again, the thrust of it is storm sewer. That is what needs to be in first and that's what's uh being addressed is those pipes for new storm sewer. So um that will continue. Uh again there'll be no south main closures so the road stays open. Uh there is a possibility um that we'll have to do a closure at Cherry uh and Maine. Uh so both Chief Day, Chief Mills, um there is uh that potential that that intersection of of Cherry and Maine, there may be something on the east side uh for a day or two, but otherwise South Maine stays open. So, uh that goes on. Uh as I said, uh hey, we we've had a snow event. Nobody's um uh surprised. You know, we had a lot to deal with. Uh again, thank you to our street department, our emergency services, uh everybody that jumped in. Uh there's a lot to do when we have that much accumulation. Appreciate everybody's patience and uh safety first and I think we did a good job. So, um it's still here and as it melts, uh we'll have to watch a few problem spots
by chance of early hours, but uh nonetheless, um did pretty well. All departments reported in and uh I don't believe we missed a beat. So, That was good. Uh kudos to anybody and and I empathize if anybody's had any sickness here of late. Uh there's been quite a bit going around and you sound a little bit today. Um I'm one of those participants. So uh there's been some change of uh plans and some change of itineraries in the last couple weeks. So anyways, I hope uh everybody's getting over it. I know I I'm on the up side. I'm on the better side of it. So anyways can empathize if you're doing that going through that. Uh lastly I want to mention uh this Saturday February 14th um Saturday the 14th is Valentine's Day but it also uh is a anniversary. Our local radio WSLM is celebrating their 70th 73rd that's pardon me it's hard to say 73rd uh anniversary and I'm doing a little uh event in conjunction with the station. We're having a food drive 9 to 12 uh at Walmart Salem. Uh food drive is is a benefactor to the food bank. our local food bank certainly um goes year round and uh I want to give kudos to the law enforcement uh through the county and the city and the and and whoever participates in Cra the Cruiser in December. That's that's great. Um this is not to step on anybody's toes. It's certainly to supplement. Um we've had a a again a rash of cold weather and I think their shelves have got hit pretty hard and so we're going to do a cram the van Saturday 9 to 12. So, uh, anybody that's in that vicinity on the east side of town, please come visit us. Non-p perishable items, uh, we will, uh, be
dropping off to the, uh, food bank. So, uh, and that's rain or shine. So, come on out, please. Uh, that's all I had, uh, on those items. So, we'll go ahead and get back on the agenda. Uh, please, our reports from departments. Uh, wastewater. Brandon, please. We had a pretty busy month last month. Um, as I'd said in the last meeting, our VFD had quit working on the 12th on December 15th. I mean, we had ordered a new one. We were waiting on it to show up and in the meantime, we had a filter plug up on our blower, which caused our blower to burn up because we didn't have any overcurren protection, which is our VFD. Um, we were able to switch our backup blower. We replaced all the belts, the oil, all the filters before just to make sure we could get through on blower two. Um, the VFD showed up. Um, and we got it installed and did the startup. Um, it we got it we got it installed on the 7th, January 7th. They did the startup on the 9th. Um, we are back to normal operation on it now. um new blow or the new VFD is working flawlessly. It's got a lot more features than our old one did. We were able to see a lot more on that and protect for a lot more. On January 5th, we did a point repair on a sewer tap at 304 West Windy Lane. It had been bored through when they did the light poles. Um we just dug it with a shovel and it was just on their 4inch line. Um, we got that repaired and back in working order there. On January 13th, we replaced the tap at 200 South High Street. Um, we replaced it from the city main to the curb. Due to the tap being full of
roots, the local plumber found it, notified us, and we were able to get that taken care of. Um, on January 14th, Mark was doing his routine checks on our lift station and found pump one at Standard Street was not pumping. Uh we went and did troubleshooting, determined that pump one from what we understood had a broken shaft. So the pump was the motor was spinning but the pump wasn't pumping. We uh went ahead and scheduled a crane to pull it on the 15th. Um so we pulled pump one on the morning of January 15th. On the evening of January 15th, the other pump went out. It is only a duplex station. So that mean there's only two pumps there. So we worked late that night. We used our pump truck to pump it down so we could pull our other one because the broken shaft, due to the broken shaft, they couldn't get that back to us real quick. So, we had to pull the other motor. We got that down there that night and uh they rushed it and uh we got it back on the 17th. But, uh on the 15th was a Thursday night. On the 16th when we came in, we were able to set up our Thompson bypass pump and it pumps automatically. So, you don't have to go out there and actually turn it on or anything. It works like it's like it should. We did check on it throughout the night just to make sure we didn't have any hose issues or anything like that. Nothing leaking, nothing ruptured. Um, but on the 17th, we got pump two back in and uh got it working back on auto. Everything's working good. On the 22nd, the other pump returned. We got it installed. Um, on January 20th, uh, we installed a new cooling fan on the BFD blower blower cabinet. Um, we had noticed that the BFD was not or the blower was not working to cool the BFD, which isn't an issue this time of year, but during the summer it is. Um, BL Anderson, they had one that they weren't using that they donated to us because it was in a cabinet that had been dropped. So, they just replaced it.
They gave it to us. So, we got that installed. So, we're ready for summer on the new VFD, too. On January 23rd, we replaced the heater inside the cabinet and the enclosure at Southway Villa. Uh trying to be ahead of the game for this extreme cold weather that you were talking about. On January 27th, there was a sewer back up at 409 West Walnut Street. We checked the manhole above it, above the house, and below the house. Didn't see any issues due to the house being so far below the road level. We decided we'd go ahead and jet it to make sure still didn't hit any obstructions and determine the issue to be on the homeowner. And that is all I got.
Busy him up. It was a rough rough month. Yeah. But luckily this happened before all the cold weather. It really did. Yeah. Because we we picked up we we that Saturday night we got that pump set. We put our Thompson pump up because we were worried about the freezing. So, I mean, it was right at the head of that cold front coming in, but we got very lucky on that. And you did this with um one person having some illness and was out. Oh, yeah. So, you were a little short, too. Oh, yeah. Very short-handed. Yeah. So, any questions of Brandon? Okay. Thank you.
All right. Thank you. Please, your water department report. Jennifer, regulatory and compliance and water quality. All our uh required January monitoring samples were analyzed and approved. The facility remains in full compliance with all state and federal federal regulations. Quarterly calibrations. We completed mandatory quarterly inspections and calibrations on all lab equipment, DR3900 scales, lab oven, and online hawk instrumentation connected to the SCADA. Uh maintenance and infrastructure repairs, preventative maintenance was performed on chemical pumps, including changing heads, tubes, rollers as needed, grease, clarifier chains, bearings, and mounting plates. System inspections, water towers, and booster stations were physically inspected twice weekly. um equipment updates, installed a new motor and mechanical seal at the west booster station. Uh we replaced a turbidity analyzer booster for pump filter number four and currently performing maintenance on an intake pump number three, including a new sill and pump shaft. Um distribution, we had a crew respond and repair several main water breaks throughout the system during January freeze and thaw cycle. We had sludge disposal of 55,900 gallons in 5 days of operation. Project milestones, we had construction of a new algicide injection point located three miles upstream is nearing completion and will be fully operational for the upcoming spring season. Um the project was a major success thanks to the hard work of distribution and Brandon Gates and the wastewater department for their um team effort and their collaboration in the new injection point and was essential to getting the
system ready for the high demands this summer. Uh again equally busy uh distribution's had um lower than we thought number of calls for leaks. So, uh, hey, that's a blessing and knock on wood and all that same time. We'll talk about something else before we jinx it. But, uh, yeah, uh, some of our neighbors not so hot and they've we've had a lot of in in the whole state. Gosh. So, we we've done pretty well with breaks. Mhm. So, good deal. Um, everything else going good though? Yeah, everything's good. Okay. Any questions of Jennifer?

Council, I've got a few updates tonight. Um first and foremost, uh I want to give some empathy and some recognition. Neimi has been sick. There's been a lot of illness. I happen to be one of those that are finally rounding the corner. It's knocking on three plus weeks. Jake said he was one of those participants. So, anybody else I I hate that because it has not been a a fun time. U anyway, I know a lot of people have had it. So, we're all dealing with it. And so, it's made a a long three weeks, I can tell you, on my uh end of this observation. So, hopefully we're all going to get better. Uh Chief Dave was whining and crying about it, too. So, I I'm glad I wasn't alone.

Yeah. Yes, you were. We both were. Uh I don't know how, but uh we we both did. Um so, uh let's just go ahead. Um yes, the federal highway project would be the one I want to start with on South Main Street. Uh council, uh if you have not been aware that there were some uh snow days and and a little bit of inclement weather. Uh so there was some delay in a few days work. And hey, safety first. probably is best that we did uh let a little bit of the weather break. Uh I think I shared with you last month, so pardon me if this is a repeat. There was a Midwest natural gas line uncovered and and was unaware of in one of the conflicts with the storm sewer. So, hey, our friends at Midwest had an extra job to tend to. So, that took a few days of work out of the um scope of the storm sewer. Got the uh gas line moved. uh relocated uh to prevent any other conflicts. And so uh that that corrected itself and then uh as work goes we are proceeding in a northward direction with the storm sewer.
Uh in that work uh now that weather is breaking uh this week uh next week by chance. So there's a good 10 12 days here of decent weather. Uh the crew is going to amp up a little bit because uh they are working under a time restraint as well for a substantial completion date. And so we're going to uh add a third crew, pardon me, two and three crews because there's been one primarily. So we're going to be two and three crews in that corridor simultaneously. Uh but first and foremost, I will tell you the lanes stay open. So northbound southbound does not close. Uh there may be some lane diversion, maybe a little bit of uh hugging one curve curb or the other, but uh lanes will not close. There is uh a a chance at Cherry and Maine, and I've talked to both Chief Day, Chief Mills, they know uh from emergency services standpoint, uh the intersection on the uh east side of Maine at Cherry may have to have a day day or two closure to get that in there. there's enough conflict there getting that storm sewer in. It's just going to be hard to keep that intersection open. But doesn't affect the main street, doesn't affect the side street, but just going in and out at that intersection. So, um, as they move forward, uh, the storm sewer does come all the way down and need to connect to the south gate within just a few feet. So, um, that's what's happening. uh with the CCMG project that's finishing on Popppler, uh there's then tie-ins there uh to get that storm sewer back down to Water Street and into the river. So, uh some of the piping is ready to go. It just has to marry up part of that project that's finishing up. Good segue, I suppose. And so, uh no broke record here, gang. Uh there is still a Duke issue that is lingering and and and our friends at Duke is that's not a cut. It's just a it's just a process. So everything is somewhat done, if you
will, into the middle of Popular Street, awaiting some um issues there that need to be rectified that we can't do at the city. That that is strictly Duke property, Duke uh decision. And so uh working through that, but that project is same as done. Matter of fact, Sally has already got closeout documents ready. So it's it's soon to be done uh and over. U Roger and I were chatting there a minute ago. So, as we move forward in the uh umbrella of CCMG, uh yes, uh Kimble then will be our next one. As I had mentioned before, when weather breaks, that's a short project. Um that uh section will be done fairly quick. And then as I made the announcement, our award there in December, very fortunate that we were uh a recipient of the latest round of funding from INDOT. And so that's section of Jackson Street. Jackson Street gets uh dissected, if you will. So, it's an area from plus or minus Elm Street going southeast. Uh, so from Elm on out uh to Bots Lane there at 160. So, uh that section uh the cool thing is if you hadn't uh heard or forgot by chance, we are uh designing this with a turn lane in that business corridor. So, uh a great safety feature, a great asset, I think, to that roadway. Uh my gosh, a lot of cars, a lot of traffic, a lot of people turning left. Uh and so anytime you're turning left, we've got a potential for confusion and so uh that'll help that area and some of our firemen will know exactly some of the wrecks that's been out through there. So hopefully alleviate some of that. So that kind of tees up CCMG as as we move forward. Pardon me. Community crossing matching grant CCMG uh as the abbreviation calls it. Um council, I want to give you that cemetery update, cemetery progress. You know, last month we took and looked at the site plans and so between our
attorney and our surveyor uh and uh what we need to do with drafting that ordinance. No, it's not on the agenda tonight, but we were going to inch towards that and get that rectified. Uh the make sense. So, you should see that in March. Excuse me. Should see that in March. Lastly, my voice is starting to give. Excuse me. U hey Saturday is Valentine's Day. Big day. uh February 14th, a celebrator for a lot of people, but it also is an anniversary for one of our local uh businesses. WSLM will celebrate 73 years on the air. Uh Mr. Martin uh and his family certainly have uh uh been a mainstay in our community. And so uh that is an anniversary. Uh ironically, it coincides with something that I wanted to do in the month of February for uh a month of giving, giving back. And so we're doing a food drive collectively together. And uh this concept certainly does not go against Cra the Cruiser. Uh sheriff's department, the police department, everybody in law enforcement that that participates in that h hands down is a great event. Hats off to them. Uh wouldn't steal their thunder for nothing. Uh but our local food bank uh certainly has been hit uh with this inclement weather. And so um there's always a need, always a demand. And so we're going to do a different version. This is uh a giving event uh on Valentine's Day. Uh Salem Walmart is our host. Uh so 9 to 12, please, if uh you're so inclined and on the east side of town, if you have any uh non-p perishable items that you could donate, uh we're going to cram the van. Uh so uh we're going to celebrate uh WSLM's anniversary and give back to the Salem Food Bank uh with the city of Salem. So please, if you're willing and want to participate, come on out and give us something. We'll get that addressed. Excuse me. Uh, one last item, uh, want to just bring up as a, uh, a notation. Uh,
Councilman Moore and I were chatting, uh, the other day about some, uh, ordinances and, uh, one of them we just talked about was pay. And so, Dylan, I I'll defer to you if you want to bring that topic back up with our 26 pay. You're going to have to remind me. I'm draw.
So, we we were uh, having that conversation, making sure uh, because this year has more than 26 pay. more than 26 pay. So, as I'm sure everyone has saw, um the county has just a little bit of a debacle going on with their pay um ordinance. Let's let's call it that. Um so, I was having conversation with mayor about what our ordinance looks like versus what theirs looks like. Um luckily, ours has already encompassed that and so we will be just fine moving forward. So, and Sally's done a great job of of making sure and and preparing for that. So, um that was just one of the things I wanted to get out of the way. If we were going to run into that same situation, I'd rather get it done up front, but taken care of. Thank you. I'm glad you asked and reached out and that's u u something that uh happens. Oh gosh, however random many years it is, six or seven, eight years, but uh anyways, um so our language allows it, so we're good. Um Sally's u not having any heartburn, so to speak. So, we'll be fine with 27 pays the way our ordinance reads. So,
and that's exactly what it boiled down to was an ordinance issue um at the county is the way their ordinance reads is causing is causing their issues. So, kudos to the mayor and Sally. There you go. Mayor, just a quick backup before I move forward. On page four and five, I'm assuming we had a small discussion about the cemetery plots. Pardon me. Okay. All right. We will move down to new business. uh council. Uh first item, authorization for mayor to sign receiver group development agreement. Okay, let me uh pause here. I got a few items to go over and explain. So um in the month of November, council, you uh pardon me, Rick, Ricky, you weren't here. Uh the month of November, we had a discussion uh from the redevelopment group, the redevelopment commission, and on behalf of the receiver group for the Salem Redevelopment Commission, I'm I'm going to get wordy here, pardon me, the redevelopment commission to enter into an agreement for some uh tax increment financing that allows uh the development of a housing project through the ready funds to move forward. So, the Salem Redevelopment Commission has vetted that, Dylan being a member. And so, that project is moving forward uh with the blessing of this board. You guys passed a resolution to allow uh a TIF allocation area to move forward uh to fund said project. And so, as Mr. Receiver and some of his uh legal representation as well as the Wheatley Group, come on up. Uh the Wheatly Group has been his uh Mr. Receivers's um design team uh his um somewhat um financial adviser I suppose and uh mentor in shaping Mason Manor project here in Salem uh out on East Hackberry. And so uh as we navigated uh the month of no November to get that ordinance passed that allows that allocation area to move forward and have financial dollars then reinvested into the project. Uh there was a question
that came up last oh 10 12 days ago by Mr. receivers's attorney uh doing their due diligence thinking that outside financing and by outside financing I mean not with ready funds but Mr. receiver is going to leverage some other dollars. Uh and so he has financial uh obligations and lenders that are looking at documentation. And so one thing that came up was, do we need a U development agreement that merely states um hey uh the mayor does support what the city council resolution does and that allows the mayor to continue to sign those documents in and behalf of the redevelopment commission where the redevelopment commission cannot sign. And I had no conceptual problem with that. U the Wheatly Group had no problem with that. So that's where we let the attorneys figure out what do you want? And so um Friday uh is when Sally obviously distributes the docket and the agenda for print. Uh the attorneys hadn't figured out exactly what they wanted to say. And this does not include Jake. Sorry, Jake. I should have said that up front. So the redevelopment commission attorney some of you have met is Dave Umpleby. Uh Dave says, "Well, it it needs to spell out some certain uh parameters to protect the redevelopment commission." Um and then their attorney said likewise. Well, there are some things that we we agree and we certainly uh respect that. And so there's been some back and forth and in the last 36 hours, uh there was some draft comments and finally put together draft comments that came after Sally's assembly. So uh there there's the apology. This was nothing we could control and so we almost put it off uh until this afternoon and Dave said no go ahead and we've got a representation from Wheatly Group. Uh so
please fill in the blank introduce yourself to the board. Please introduce yourself.
Hi council. How are you guys? I'm Evan Shrive with the Wheat Wheatley Group. Um we're representing Colceiver on this project just helping him through everything. Um, mayor did a great job explaining, but ultimately this document um the council and the redevelopment commission have already agreed to to help Colin out in the form of um tax increment financing and helping him with the developer purchase bond for this um project. um going through that and lining up all of our ducks in a row. When we were going through all of our documentation to get this thing closed, um we realized it would be beneficial for not only us but the city to hold off on actually um signing these bonds until the project is almost ready to be assessed. So that means the the tax increment financing district once you establish a debt instrument on it, it has 25 years. Um, with this, we're going to capture more of that. So, if we if we um issued the bond today, it start today and Colin has to go out and build it. It's got to get built. It's got to get assessed. So, there's two to three years in there that you're not going to see any increment come to you guys or come to us. So, what this does is just gives the mayor the ability to sign this when the time comes that we're all ready to close on this bond. Um, so you guys get that extra years of capture and so do we.
So Evan, is it safe to to summarize a little bit? Nothing changes in the resolution. Correct. The resolution is is solid for what you passed. So we're not changing any money or any dollars or any commitment. Um, this just puts in a notation that this gives a fluid date and allows the redevelopment commission by chance to defer signing the closing of the bonds. Correct. Correct.
And then on Mr. receivers end of the business. This gives his financial a uh uh lenders another tool to say, "Okay, we either do this June, July, August, you know, but but then the mayor's ready because it says there is an authoration in place by the common council."
Correct. Correct. So, um Colin wants to close as quickly as he can. He wants to get this thing started construction and going through that. he was meeting with his lenders and even though you guys have passed all the ordinances, everything is ready to go from your guys' standpoint.
