The next item is an ordinance of the Village of Key Biscayne, Florida, deleting section 30-39, appearance of structures and sites under construction of the Village Code of Ordinances, providing for severability, providing for codification, providing for conflicts, and providing for an effective date.

Good evening. So this is an ordinance that essentially removes a conflict in the code that we have currently between the zoning ordinance and our property maintenance ordinance section of the code. So it's Section 30 versus Section 5. We propose to simply remove the portion of zoning ordinance and defer to the property maintenance section of the code. And so currently the zoning ordinance says a 42-inch fence. The property maintenance section says a six-foot fence. We're going to go with the six-foot fence. It is worth noting that when we were, after we edited this, we realized Section 5, there's language in there that says this applies to single and two-family homes. And what we want to do is have this apply to all zoning districts. So we will need to modify Section 5 separately. We would love to do it between first and second reading, except because it's a different section of the code and we advertise one way. we're going to have to bring it as a separate item. So, recommendation is to go ahead and proceed with this today. We'll bring a modification to a standalone item to modify Section 5 in January, and then we'll bring both items for second reading at the February meeting.

Mr. And just so everybody's comfortable as well, All of our active construction sites are in single and two-family homes, so they're all required to have a six-foot fence currently anyway.

Apart from the fence, the protections and standards are in in Chapter 5 or essentially the same correct.
Yeah, and I'd say they're they're they're fairly robust, you know, that's what requires the rock and you know by construction site standards are sites are are very good looking, I would say, compared to other municipalities. And it's something we constantly try and improve on, monitoring. But the code is there with us, behind us to enforce on it.
