Okay. I'm going to call to order this meeting the Montgomery County Board of Supervisors on Monday, April 27th. Our first order of business tonight is to go into close meeting. Be it resolved, the Montgomery County Board of Supervisors of Montgomery County, Virginia, hereby enters into close meeting for the purpose of discussing the following. Section 2.2-3711. Discussion, consideration, or interviews of prospective candidates for employment, assignment, appointment, promotion, performance, demotion, salaries, disciplining or resignation of specific officers, appointees, or employees of any public body. Thank you, Angie. All right, the next item on our agenda tonight is a 2027 reassessment update uh from John Atkinson with Vision Government Solutions. And I apologize, I don't know both of your names. Welcome.
Gary En is Oh, yes. I should have known that. I apologize. Thank you very much. Can you hear me? Okay. Yes.
Okay. Thank you very much. My name is John Atinson. I'm with vision and Gary Ang my counterpart is here as well. We're just going to walk you through an update on where we are in the in the reassessment project. So, uh just a quick overview. Uh in 2025, the county awarded through a competitive RFP an agreement with vision to conduct uh the reassessment. Um, as part of that, the major milestones we're going to be doing is obviously data collection in the field, updating your canvas system, developing new values, handling all the appeals, both informal and formal, that come through that process. Uh, the goal is to be fair and equitable and accurate and to be close to 100% of value on all the properties. Uh, just a little bit about Vision. Uh, Vision as a company has made a substantial commitment to the state of Virginia. Uh right now we handle uh over the last five years we work with about 85 of the 133 jurisdictions and we have over 60 jurisdictions on our software. Uh so we are heavily invested in the state. Uh we currently have over 70 employees based here in the state. Uh as part of our process we did some things that are a little bit different than the last time you did a reassessment. uh there's a big push to give as much information to the taxpayers as possible and try to be as proactive in the information. So to that end, we work with county leadership and your public relations group um to put together a website where the public can go and get information about the reassessment. So it'll give them the details on the timeline and specifics of the things that that we're doing that can be accessed on the county site through the reassessment page. Um the major phases of the project here right now we're currently in field work. The goal for us is to have all field work, sales studies, land values and so
forth done by October of this year. Change notices will go out on the uh by the 14th and we will start the informal appeal process uh the 1st of December. That is so that will commence after the Thanksgiving holidays. Um once that closes, we'll do second change of value notices for folks that had anything that came up in the informal appeal process. Then the land values and the board of equalization would would take place in 2023. Um we do encourage the the taxpayers to participate in the informal appeal process. That is their opportunity to be heard, ask questions, uh come in and see us in that process. And we do encourage them. So, if you're approached by that, please have them contact us to set up an appointment to come in when we do those. Um, our current process, uh, overall right now, we're about 40% in the completion of the, uh, of the field work. Um, we had a few challenges this year. The weather kept us out of the field. We weren't quite out as much as we thought. We've got six months left to go. We feel pretty confident we're going to stay on that time frame. So, we're not concerned at this point that we're a little behind. So we talked a little bit about the informal appeals and I think this is uh something we feel strongly about that the public has a right to be heard. They have a right to have their questions answers about that. So uh what will happen is the change of value notice will go out showing that the new value that we've established for the properties. Um there will be a twoe period and then we'll open up the informal appeals to allow them to set up with us. uh it is their opportunity to ask questions. I personally don't like the term informal appeal because a lot of what we get are just questions about what we have on the property record card, questions about the process. There's a lot of that that goes on, but that is their opportunity to give us
feedback and ask those questions. Um we are going to do a variety of options for folks at the taxpayers's discretion. They have the ability to schedule in in-person meetings virtual. We can do it through phone calls. We can do it through emails. So, uh the electronic measures have become more popular, but we are set up to do the in person as well. We are committed to that when they come in. Um we are not going to be able to give them a formal declaration during that meeting because we have to take the information and feedback we get. We have to research it and then we have to to make adjustments. So, uh, any change notice that needs to come, if we have a correction on something we've done, we'll send out a notice, but any taxpayer that has an informal appeal will also get a notice even if it doesn't change what we have. Um, some other things that that we've added is this is a public website. Again, it accessible through the link on the county's reassessment page. This is a way for the public to interact with the data that we've collected and what they have. So, right now, the information that's posted today is going to be the current property record card information. Uh, once we get later in the process, we'll start to update this information that they'll be able to see it. Uh, if we were live on the site, you could see it, but it has the values. It has all the characteristics of the property. Pictures uh that we derive from Eagle View imagery are included. Uh the other nice feature is this has a sales stack functionality. So the public can go to this site and they can see the sales that have occurred in the county. Uh the default on this is a 5-year time frame, but they can filter it down to as little as 3 months depending on what they see. As you look at this screen, uh it's it's a lot of data and as you scan out on the map, it'll pick up more sales
in the county, but as you zoom in, you can get it more localized as well. But this is live sales data that has been recorded in the county's camo system. And again, it's it's designed to help the public understand what we're looking at, and they help to answer their questions as well. So, it's been a popular question about what could potentially be the increase here. Quite frankly, we're not far enough in the work right now to be able to give you any type of prediction on it. So, what we pulled down, this is surrounding counties that and cities that are on a four-year cycle just like McGomery County and these are the increases that they had in 2025 2026. Um, we have seen the market continue to grow and escalate a little bit. I think the report we saw from the uh New River Realtors Association that the fourth quarter there was about an 8% increase in values in Montgomery County. Um, the average that we've seen here is about 45%. So uh and we are prepared that will generate a lot more appeals and a lot more questions for the public and we are prepared to help with that in that process. So again if the public approaches and has questions please send them to us so that we can answer and review what questions they have. And that that concludes the update.

So, one of the things I was trying to keep up with was the commercial evaluation is we do all of it. So, we're doing residential, commercial, a little bit of everything because the commercial has seemed to be off from what the sales are. And granted, I understand there's always going to be a difference, but there's been a significant difference in the evaluation of the commercial. How is that in relation to the data that you have in relation to residential? So, are we going to be able to separate the two to be able to see? That shouldn't be that shouldn't be an issue in terms of segregating out the the commercial properties. Uh keep in mind the the numbers we showed you here are
combined total residential and commercial for these these communities and yes as they uh zoom in to those areas like Ron Oak Street or whatever those sales should uh populate because from the sales prices to what is evaluated at again understand there's going to be a difference but it's it's been pretty significant like uh just ballparking over 50 so it's been over what has but for the residential. So I'd be interested to see how that if that could be sifted other than selecting specifics.
So on this particular site that I'm showing you now, if you were to go to this site and hit uh the filter button, I believe it should allow you to filter by residential or by commercial if you wanted to see that. So you can play with the data and and sort of see what what the numbers look like. But valuing the commercial properties is a part of the reassessment, not just the residential. Um, when you talk about being available and you you gave all the different ways, virtual, in-person, phone calls, emails, what kind of time frame are you talking about? Like, is it only during the workday? Are there going to be some evening times? Are there going to be some weekend times? Because we always get complaints about, well, I can't take off work and do that. You know, talk to the person. like what what do you foresee with that? So, we're set up to go a little longer into the evening and we're going to be set up to do weekends if that's what they need. Uh if somebody has I and and I know it's a little hard if they want to talk directly to us.
Uh but they always have the option to email us and we would respond that way. So if there is somebody who just is not available during the day, it's not available in in the hours we're doing it, if they want to send us an email overnight, we can we can address it through that as well. But we we are obligated to offer a you know, I think it's still 7:00 at night and in that time frame that we had, that was one of the stipulations that we have weekend to be able to do some of that. If we need to do a Saturday, we can do that. Yeah. Because I worry about folks that have different work schedules. I worry about folks that don't email, don't have a computer, don't have the internet. Yeah. You know,
and that's why we're offering in person as well as the the other options because there are going to be people again, we want to communicate to everybody and some people don't just does not have access or is not comfortable in that manner. Um, but that's why we're giving them so many options and I Okay. And I assume that Angie will be giving us all your phone numbers so we can direct people to she can find us. Yes, ma'am. Okay. I appreciate you guys giving us the update. Um kind of going back to what you said, you know, there referencing the realtors association and, you know, some kind of local hotspots of appreciation, things like that. When when did you start the assessment like the 40% that's done now? Field field field work started roughly six months ago.
Six months ago. Okay. I'm just like and and and the question I'm teeing up is, you know, how how do those, you know, small but maybe significant changes throughout the course of the assessment affect, you know, a property that was that was evaluated early on in the process versus one that gets done closer to the end of the process. So, the field inspections, what we're doing is picking up characteristics on the property. Okay.
Right. We are in the process of a sales study now and that sales study will also be updated at closer to the end of the project. So that the sales studies establishes the values of those characteristics. So if we inspected you say for example in December of last year 25 those characteristics are still current. Mh. It'll be ba and then then it will be uh mathematically it'll be linked to the sales studies and the and the new values and that will that'll create the total value for the property if that makes sense. Yeah. Yeah. I'd like what I want to make sure is that it I guess it's not determined like kind of statically in at at each kind of step.
There's no uh there there's no advantage or penalty to be inspected early versus being inspected later. Perfect. Yep. That's a good question. Thank you. Okay. Any other questions? Okay. Oh, Vice Chair Fijicowski, I didn't know if this was I don't or I do. Everybody asked all the tough ones, so I just got the easy one. Where are you headquartered at?
So, um, Vision as a company is headquartered in Massachusetts. Uh, as a company, uh, we do business in about 15 states right now, both on software and on, uh, reappraisal work as well as our geospatial stuff. Uh, but we do have, like I said, we have 70 folks here. Gary's based here in Virginia. I'm based here in Virginia. So, we have a we have a significant presence even though our corporate headquarters is a mass in mass. And just this comment, I'm I'm glad you're making it a priority for the uh the informal um
interviews because I think that was an area in the past that people were kind of concerned about. So uh I appreciate everything you can do for those informal uh interviews.
Yeah, we really do want to encourage people to participate in that process. That is that is the easiest opportunity they have. It's the easiest on them. You know, when they go to the board of equalization, there's more effort that they have to put in. And if they decide to go to the to the courts, it would be even more effort and expense. So taking advantage of the opportunity to ask questions and participate, we encourage that. Um, and like I said, if if if you get approached, we always ask, please direct them back to us because there is a process for us to manage that and we will get them answers. Um, and we have access to the information that you won't have access at that point. So, please have them refer back to us for that.
Well, I'm sure that'll depend on whether it's single digits or double digits uh on the increases. So, thank you very much. Um, and I'll just echo that, um, I know that during the contracting phase when we were talking with you, um, that our staff impressed how very important it was to our board that citizens have access. So, I'm delighted to see that it's not only in person, but virtual phone, email. I think that that's a great accommodation for a variety of citizen needs and and even limitations. um a question maybe more appropriate for staff. I don't know if you'll have the answer to it. Um so the timeline for reassessment, so the reassessment is completed and then after that the board of supervisors sets a tax rate based on the reassessment. So
that's right. Okay. So this process happens and the informal hearings are are done and then the um notices are sent out for people who have requested those hearings and then the board of equalization will be appointed by the um they're appointed by the court, right? The board. Yeah. Yeah.
Okay. And then um so there will be another round of formal hearings with that um board and then while we're going through that'll happen early in the calendar year and as we're going through that process then we'll also be evaluating the budget and the tax rate will be set after that. So, it's important for people to remember, for citizens to remember that it is a two-part equation. And while you've shown us what average increases have been recently, there is the tax rate. And the code of Virginia requires that the um county determine what a revenue neutral rate is, a revenue neutral real estate rate is. And if the board uh wants to adopt a rate higher than the revenue neutral rate, it has to be advertised as a rate increase. And I know we talk about that each time reassessment comes around. Um and it causes a lot of stress. And so just getting the message out early and often um as we did last time we had a reassessment. We'll do that again this time. I appreciate it. Thank you. Thank you. Thank you. Okay. All right. So, next on our agenda is a public hearing. This is for a reasonzoning request um to reszone 6359 acres of a 15.790 acre par parcel from manufacturing to agricultural. Welcome, Justin.
Good evening. Just a moment, get this started here. Good evening, board. It's good to be with you this evening. Um, we have a pretty straightforward reasoning request for you this evening. I'm going to run through it and then take any questions that you have. Um, so just to orient you, the property is located in the northeastern portion of the county just outside the town of Blackburg off of Panorama Way. Uh this is Panorama here and that intersects with Mount Taber Road. An aerial view of the property. Uh you can see it's mostly agricultural. Here on the zoning map, we do have that small portion that 6 acres that was reszoned to M1 Manufacturing. On the aerial map here, you can see that there are several buildings on that southwestern corner of the property. I'll show you some close-up images of those buildings in a moment, but a bit of background for you. In 1998, the board of supervisors reszoned that 6.6359 acre parcel from A1 to M1. There was one profered condition that was placed on that resoning and it limited the use to the contractor storage yard. The use also required a special use permit for that contractor storage yard in 1998. The property is no longer being used as commercial and that use has ceased for a period of over two years, which means the special use permit is void. The owner's nephew approached staff looking to subdivide the parcel to create a new lot. Um, our practice is not to create a split zone parcel. So, we worked with the applicant on the downzoning request. There is a single wide manufactured home on the property that is not habitable and the owner's nephew, Mr. Ratcliffe, plans to replace that in the future. So, here are images of the buildings that are located on the property. on the left there's the garage that was used for the contractor's storage yard and that's now being used for private storage. Um the fence line here denotes the edge of the property and this access easement uh services a residence that's
uh located on the rear portion of the property as well as an a service a substation and then again on the aerial you can see that access road runs back to service the property here and then another access to service the substation again the garage here and then the uh single wide mobile home is here uh some images where we posted signs on the property. This sign was posted at the end of Panorama Drive which is private. Uh and this sign was posted at the intersection of Mount Taber and Panorama. So evaluating the impacts that rideway would stay in use to service 1216 Panorama Drive in the adjacent parcel with the substation. The site is served by private well and septic so there's no public utilities. Any future traffic or infrastructure impacts would be evaluated during the plat review process when we receive that subdivision request and there are no additional changes or improvements proposed for the property. Looking at the comprehensive plan, the future land use map denotes this as resource stewardship. Those are denoted as areas with high soil value, environmentally sensitive areas or other unique characteristics. Um the partial is not located in an agriculture and forestal district but others uh are in the nearby area and it is consistent with the future land use map as preferred land uses and resource stewardship are primarily agricultural in use. So in our analysis the downzoning does meet the zoning regulations as well as creates fewer impacts than the manufacturing zoning that is currently on that piece of property. uh it is significantly more consistent with our future land use map and our goals for that area of the county and it eliminates that split zone parcel and returns the parcel to a land use that's more reflective of the surrounding land uses. So really we're viewing this as just a cleanup of something that was
done back in 1998. And in talking with Marty, we can't figure out why it was done that way in 1998. Um when we took this to the planning commission, they recommended approval unanimously. Uh that public hearing was held on April the 15th. We had no speakers that night during the public hearing and staff has received no public comment on this resoning request. We did advertise in Cardinal News. We placed those signs on the property. Uh and as I mentioned, we received no comments, but we may have someone here this evening to speak. And with that, I will take any questions that you have.

We did have a sheet in the hallway for people to sign up to speak on this uh reasonzoning. I didn't have anybody um sign up to speak to this issue completely or entirely. Um I'm going to go ahead and read the guidelines though for public hearing. These will also apply to public address. So for the um for any comments, a public signup sheet will be available outside the meeting room. Speakers are requested to provide their name, address, and phone number and list the subject matter on the signup sheet. Following the names on the signup sheet, other speakers will be allowed. Each speaker has four minutes whether speaking as an individual representative. And all comments must be directed to the chair and other supervisors from the speakers lectern at the front of the room. Please begin by stating your name and where in the county you reside. Accepted etiquette is to not applaud or make loud responses. So, as I said, we didn't have anybody sign up for this public hearing for this uh reasonzoning. Good evening. My name is Cletus Bohan. Live at 6210 Yellow Finch Lane in Ellison. Uh I'm here to follow up about the train crossings being blocked. Um I brought the original letter that we sent the email and this the U signature pages along with the letter. Thank y'all for your responses. I've got a couple of responses. I appreciate that. Um, one of them said that yes, this has been a problem for decades, and we all know that, I think. Um, I'm glad it's finally getting some light after this 15-hour blockage in Oldtown. Um, so it's uh I'm sure more people would have signed that if we'd had a little extra time to get more signatures. It was just hard to get out to get everybody to sign. But I think everybody that lives up in that area have been affected by this. Um, not only Cove Hollow, but the other areas that have been blocked, too. Um, it has been a problem for a long time, but I've lived up there for 36 years and the last few years it's getting to be a a lot worse problem. So, we do appreciate some attention to it. Um there's been many times where people have missed work or one woman in particular had to get a motel room one night because she couldn't get home. And um one pretty scary incident was when a train um school bus let some children off on the 460 side and they crossed under or over the train to get to their parents waiting on the other side. So, this is a real issue and um I think there was mention about some grant money maybe that you're looking into uh for a
bridge over the crossing which would be a tremendous help. That would be really good as far as everybody's concerned. Um, one other thought one of the constituents had was um, if you're familiar with where the um, the old sausage plant was, the Green Hill sausage plant, the there's a trussle over the river there and under that trussle is a little single lane road that goes back into a field that joins the property where uh, Mountain Valley Pipeline is proposing to put the compressor station and there's a stretch of woods. It's I think it's close to 1,200 ft through there that would connect with the other road that comes from Cove Holla side. So if if we could get some engineers from the county or something to look into this. I know it's a single lane road underneath that trussle, but it would u I think it would leave relieve a lot of the pressure for residents trying to get in and out. I don't know if it's going to be feasible for uh emergency services like firet trucks and stuff, but it's a possibility if we could just connect those that field with the other side just uh cut some trees and I'm pretty sure that's probably on MVP property. I haven't um studied the map close enough to know for sure, but one of the uh constituents brought that up. So, I thought that was a very good idea. And uh somebody else wanted to know maybe if if you have some meetings with uh Norfick Southern if one of the county members, constituents or something could could sit in on that. I don't know if there's any way to do that or not. And um or maybe even have a town hall with
some of the folks down that section just kind of fill us all in because everybody doesn't have email and stuff. So, that's just another thought from one of the constituents, but uh appreciate y'all's time and help on this. Y'all have a good evening. Thank you. Thank you. Yeah, I remember we did another one several meetings ago and now this one I was wondering how close we were getting for that. So, and interest is still acrewing on those funds. Welcome sir. Thank you for being here. Good evening. There's actually two. This is a second one that formed after the first one and this one is actually more significant. It's more toward the Blackburg Middle School side and it's actually in a drainage basin area. So, uh, we need to address that one as well. Do you anticipate having a third? I hope not. There's no indications of a third, but
you know, we live in a very cared geographic area and limestone and water don't don't get along very well. But um we had a meeting on the first one this afternoon uh with our geotechnical engineer and I think we have a good fix for that one. We're we're waiting on some results for the second one to get to get uh remediation steps in place for that. So we will we'll move forward on that. Let us know how that goes. Let's just when I hear sinkholes, I just think of the old Blackburg High School. So yeah, correct. Thank you. Are there any other questions? Sure. Go ahead.
On this supplemental on one of them, it says resolution McGomery Countyy's MCPS appropriation. It says Auburn High School Phase One HVAC system. Then on the supplemental one, it says Auburn Elementary School. Is that both schools or just one? It's elementary. It's Auburn Elementary. We're only doing one HBAC project this year and it's at the elementary school. Okay. I just seeing on that one letter we got it checked. I think there was a typo on the letter saying Auburn High School. Yeah, it's supposed to be the elementary school. I watched the presentation just to make sure. Okay. I thought that was confusing, too.

Yes, we we've received the facility assessment and um I believe it's been shared. Has it been shared? Yes, it has been shared. Um, we are actually working on the on the CIP, the capital improvement plan at this time and moving forward with that and hopefully we'll have that uh done in a in a short amount of time. Fantastic. Great. That's fantastic because we're excited to um I think have a joint meeting to discuss it. So I do have just a procedural question just so I kind of understand um because in my line of work which is real estate and development I can't capitalize small expenses. So I just want to understand procedurally there's some items on here um that are fairly low in cost in a capital expenditure and I just that's probably a good question for you Miss Bland.
Sure. Sure. Absolutely. Um and you're correct. Um, typically there's a there's a threshold put on those. Uh, what you see at this time is a certain phase of that project. So, that overall cost is is probably going to be um a little bit higher in that um, one of the items, the last one I believe for Shawsville Middle School, when you see the panel assessment, um, there's some there was there's already been one review of it. This is a second review. and um unfortunately both have have determined that yes, we do need to do the repair. Um so it's going to be part of a much larger project. Well, you can add on. April 30th, Chair Deontz will tell you what event is happening in this building that is very important to her. from 4:00 to 7:00. I hope people can come out for that. Also, on May 7th, uh there will be a village open house at Prices Fork Avocard to hand out to each of you um from 5 to 7:00 p.m. That's our last open house for um the V Village village plans. So, we would appreciate if folks can come out for that. And then on June the 10th, the planning commission will um hold a public hearing on all of the village plans and the future land use maps. And th when those drafts are finalized, they'll be available in various places. Some will be available here and in the libraries as well. And then on June 22nd, we plan to bring that to the board of supervisors for the public hearing. Um so that's exciting. I know Justin and Bri and their staff is really excited to get that all wrapped up. Um, we're also working on the um, fire and EMS study for the countywide study and uh, staff will be meeting about that in the coming days and then we plan to have a presentation to the board of supervisors on either m either meeting in May, probably on the first meeting. Um, but that is about all I have.

I cannot pass the opportunity. Uh I attended the planning commission training and thanks to Justin, it was a very and also this, you know, staff and and the regional commission. It was a well planned event. I really enjoyed the um Jeopardy. U learned a lot actually took notes because some of the answers I didn't know, but I had a good team. Um and also Baratad County um share data center. So it's another round of data center I heard about and um I attended the library board meeting as a liaison and I had a um library week lunchon with the Blackburg library staff. Uh one thing I would like to mention from the library board meeting is two staff members Carrie Copus and B Newman went to public library association national conference in Minneapolis and um 300 plus librarians in attendance and they share couple uh special programs that we are having uniquely here with with the rest of the librarians and went very well. One is the speed friending and then the other one's in sensory museum program which we have it all br in all branches. So that's all
