Town Council - Regular Meeting

Welcome, it is 7 o'clock. Thank you for joining us on this rainy Tuesday. I am going to call the Pendleton Town Council meeting on August 4th, 2026 to order. Please stand for the Pledge of Allegiance.

I pledge allegiance to the flag of the United States of America and to the republic for which it stands, one nation, under God, indivisible, with liberty and justice for all.

Normally, I begin our town council meetings with Pendleton history, but here in Pendleton, in our town, we don't just honor our history, we make history. And so our first order of business is to present a proclamation to Team South Carolina. Our very own Pendleton Recreation Association. We are so incredibly proud of you. I love baseball and I feel like selfishly, I went to the University of Oklahoma and we won the College World Series and now our town is Team South Carolina. Like this is my year. Come on, White Sox, right? So anyway, Babe Ruth said, it's hard to beat a person who never quits. And I think that is this team. You never quit. You showed up for this town. You showed up for each other. You reminded us how special sport is and Nelson Mandela said that sport has the power to change the world. And you reminded us that by just bringing us together and we are so proud of you. So it is our honor tonight to present Team South Carolina from Pendleton with a proclamation honoring all of your accomplishments. um and council um i also want to say that there's no one that is a bigger champion of the pra than um than than jeff andre like this man i mean we talk nearly every day well weekdays and sometimes on saturdays And it's always about the PRA and serving the PRA and Veterans Park. And so I have asked Jeff to read off all of your names individually because we want to acknowledge you as individuals and as Team South Carolina.

All right, moving on to council. I had to give them permission. I am a teacher, right? Anyway, I have to go back. Okay, see you later. All right, so moving on to council updates. I kind of wanted to start with my council updates and I want to begin by saying how proud I am of this council. I don't know if members of our community know, but you all are everywhere. Like I show up to every event and there's, someone from council there i'm walking around town there's someone from council there um and so i just want to begin by thanking every member of this council for showing up for this community i understand how um this is not a full-time job and i know that it's you didn't know that nancy It's not a full time job. And I just want to acknowledge that. I also want to start by saying that this month has just been a really special month. I had the opportunity to do some things that I absolutely have loved. Miss Barbara and I went to the, was it the 156th anniversary of? of king's chapel and that was one of the coolest things i've done um since being mayor so thank you to king's chapel for inviting me i also um while we're giving council updates i want to acknowledge jay the green just looks fabulous jay um thank you it looks so good And not a day goes by that I don't get a text about how wonderful our Public Works team is. So I just want to acknowledge you and Jay and yeah, between Kings Chapel and Team South Carolina, it's just been a really, a really special month. So that's kind of my updates. And then we'll start with Ward 1. Lynn, any updates on branding?

We're still working. We've got two more meetings before we'll have a draft of the council review.

Thank you. Barbara, updates on the fire department.

Yes, we do not have a report tonight on the fire department because town staff and the leadership of our fire department are in the midst of working through the draft of our annual agreement. And once that agreement has been chosen, finalized, voted on, put through the ringer, then we'll get back into having our annual reports. Now, also, since this is my time, I am the Anderson Bicentennial Parade float person for the town of Hamilton. I will be in contact with nonprofits in the coming weeks and schools and whatever to get people to work with us on this float. We do have our concept already, thanks to Lindsay. I don't know when, you know, she's got a baby, so she don't need to sleep. Anyway, so she's up all night, you know, between taking care of whoever's yelling and screaming and crying, coming up with ideas. And we really do appreciate it. We do have a working idea. So anybody who is wanting to work on that, that is fine. Also, now that my friend from Poland is back in town, you'll be hearing from us because we are trying to bring the South Carolina Humanities Festival here to the town of Pendleton. Again, I'll be in touch with nonprofits. We do have a working outline for the grant and it is a $10,000 operational grant that we can get. That's all, thank you.

Nancy wrote a book. sorry it is so you wrote a book so anyway i do want to acknowledge you for your book and i'm so incredibly proud i mean how many people have written a book and um so congratulations on on your book nancy that's just really cool and you are an asset to this town i love it when we're in meetings with engineering firms and you ask all these questions and i'm yeah it's great thank you nancy thanks sir and it's an academic book but it has a lot of pictures

But I tell you what, being a former history teacher, this is fascinating what she's put together here. It's for a wide range of people to be very interested in that. So I don't know exactly when it is coming out in the hard.

We've been working with... The Pendleton Pride of Motion, we're getting ready for our day of service at the end of September, and that's coming along really well. We're coordinating with a lot of different volunteers to make that be successful. Pat Zingale and I are going to work with the, through Pendleton Pride of Motion to establish a nonprofit council. So our goal is to bring all the nonprofits in Pendleton together a couple of times a year to get a shared calendar. So we're not stepping on each other. And so we can share resources as we need to, and that will be kicking off when we decide September, September, so thank you.

Yes, as our summer adult leagues conclude, practice for our fall sports programs are officially kicking off across all divisions. We also had the All-Star achievements, our 12 and under World Series baseball run, who made history as the first Pendleton team in 26 years to punch their ticket to the World Series. While the team ultimately lost out in competitive matchups against a strong Florida and Mississippi roster, we're incredibly proud of their grit, hard work, and representation of Pendleton on a national stage. Fall sports transition summer wrap-up adult tennis baseball. Our summer adult tennis baseball league wraps up next Tuesday. It's been a great run. We appreciate being able to offer adult recreation options when capacity allows. Tackle football. Fall tackle football is fully underway with practices and conditioning. Soccer, and we appreciate Anderson for helping with facilities there. Soccer and all remaining fall sports programs officially begin practices this coming Monday. the Thor guard lightning system update. Actually, I got a better update because Matt Carter was writing this up right before the meeting out at the press box and it went off. The lightning guard system. Anyways, repairs to the Thor guard system at Veterans Park are complete. The secondary horn was attached to fix the volume issue and the strobe light now functions properly. throughout alerts. The roof mounted sensor measures electrostatic energy directly above Veterans Park to predict lightning risk before a strike occurs, rather than relying on delayed regional radar. Facilities and field maintenance, field two scoreboard, work on the permanent scoreboard from field two remains in progress. We are targeting completion in time for the spring season. Park upkeep, we continue to utilize the town provided drag machine and utility cart for routine field maintenance. We are also continuing to coordinate behind the scenes with town staff regarding remaining park deeds, including necessary repairs to aging bleachers to ensure spectator areas stay safe. The PRA is entirely volunteer run. Managing these leagues, facilities and logistics requires significant time and energy from our board, coaches and parent volunteers. We sincerely thank the mayor, council and town administration for your continued support of our mission to keep youth sports accessible in Pendleton. It really does take a village.

Thank you. And I wanted to just piggyback off of that and provide a brief update on Veterans Park, simply because we get asked about Veterans Park a lot. So as you probably, most of you know, Ko is in the budget process, in the CMAR process. Council recently approved a CMAR project in which we are looking at investing more than a million dollars into Veterans Park. We have begun meeting with the architects and we have begun meeting with the general contractor. We are waiting for them. And I said waiting, we literally just met with them. So we're not, haven't been waiting that long. We'll still have that tomorrow. We were waiting on them to come up with a drawing and then we are going to have public hearings to get public input on what our community would like to see in Veterans Park and where we can best support put our resources. With that, we've also asked the contractor to price out everything because you would not believe how much things are costing. And we think it's really important that our community and our taxpayers understand that a light pole is $75,000. Yeah, I know. It really is that expensive. So we wanna make sure that you all know and it is very transparent and your input matters. And so hopefully we will have those meetings in the fall and we're really excited to get going on Veterans Park. That is definitely, I think something that everyone on council feels is a priority. All right, moving on to number four, the approval of minutes. on the consideration of minutes from prior meetings town council meeting on june 30th town council meeting on july 7th town council meeting on july 13th do i have a motion second second all in favor motion carries public comments We would love to hear from you. If you are a resident, a business owner, or a town property owner, you have three minutes. We just ask that you state your name and your address for the record.

Mr. Dvorsky.

My name is Alex Szymborski. I live at 1200 Cherry Street Extension. I wasn't able to interject about minutes, but there's a statement in there where I think Nancy was misquoted. Her motion to proceed with alternate number two, recommended by the contract or the civil engineer, The civil engineer recommended alternate number one. Nancy probably meant that she was recommending alternate number two as described by the report. Now, I don't know if I'm correct or not. Somebody please tell me for God's sake. Are we gonna correct the minutes?

We will check into that. I do know that Nancy's motion, if I remember, was to recommend what the engineer recommended. I thought it was number two, but to be honest, I do not know. But we will check and make sure that Nancy's motion was the correct one for what was recommended. Am I misspeaking, Nancy?

It seems counter indicative since the cheapest one was the one that the contractor have listed as number one and the town was going to choose number two twice as expensive. So clarify for me, please.

I can't during public comments. I literally can't. I'm sorry.

At the last meeting in July, I asked for four questions of mine to be seriously considered by the town council and to provide a response. I've had to add some other thoughts to those and this today, is a formal request for the town council to provide a written response to 10 issues that I'm not going to present. Would you pass that to Mayor Serra? And I can test these three minute comment periods where I have five issues I want to discuss on forthcoming topics, but you're going to come to those and you will have forgotten everything I said by then. Does anybody else here think that's a bit ridiculous? All right, the other topic I was gonna go into is the motion to exclude the use of eminent domain. And speaking for my wife, she wanted to express gratitude to whoever proposed that motion. I'd like to do the same. The last issue I have on my list is the Cosleric firm is proposed as to be the town attorney. And I have severe questions as to their qualifications. The mayor understands. And for the benefit of council persons, I've iterated those four issues on this list. I'm getting tired of talking about this CPG lawsuit. I think it's time for town council and the planning commission to put their big boy pants back on and take care of this before it becomes another bold black eye for Pendleton, just like Pendleton station wants. Are you going to let it get so far as when the state intervenes and says, guys, You don't deserve that charter you got. I don't care what history you have behind you. Own up and act like big people. Thank you.

Thank you, Mr. Zimborski. Other public comments? seeing no further public comments i am going to close public comments and we are going to move on to number six reports beginning with the planning department owen good evening mayor and council um in the month of july the town our planning department issued 23 permits

including in those was five homes. One of those was Morton Farms. Two were in Sunrise and two were in Lawton Ridge. There was a new business that came and asked for an interior renovation permit. That was Hood Family Dental. They'll be at 1001 South Mechanic Street. It's off there when you're coming off of 76. We issued two electrical upgrades, three renovations, three resurveys. we had two building additions two signs we had one subdivision of land that was for a parcel located opposite and drive splitting the two pieces we issued two encroachment permits we have one accessory structure and we had one rezoning application and that was for the property located off the corner of cherry and broad on july 16th the planning commission conducted a work session review items from resolution 03 2026 which proposes amendments to the current zoning ordinance. Some of that stuff included was lighting regulations, sidewalk interconnectivity standards, and repairing buffers ordinance. The components presented on the sidewalk lighting and public tree ordinance were from the draft of the UDO. The design standards evaluated during the session were drawn from the Village Hills Overlay District, which has already been passed. They were just modified to align with the town's current zoning ordinance and be applied townwide. Under this proposal, land disturbance will be restricted with the riparian buffers from would be restricted from 50 feet from a water of the state. So if you're going to be grading or clearing a piece of property that's next to a larger stream that's declared a water of the state, you have to be at least 50 feet. If you're doing 50 acres and then it goes up to 100 feet, you're doing 100 acres more. The commission members were also provided with a draft historic overlay map that highlighted several of Pendleton's historic properties, as well as I gave them the town square overlay standards as like a historic reference document that we have them to review. They'll get back to me on that, see if there's anything from the town square overlay standards that we have now we can implement into historic overlay. So yeah, that was pretty much what they discussed. In the next month, code enforcement received three new complaints this month. I'm currently working on addressing those. Next month, or the month of August, we have a planning commission. We'll hold that public hearing on the rezoning at the corner of Cherry and Broad. And if we have a chance, we'll also resume work session on the resolution 03-2026. I have on here the design review board is going to meet on August 31st for the lighting requests by the decoration committee. But it's been told that's going to be moved at a later date. The board of zoning appeals won't be meeting this month. But next month, they have several applications that I've received. the baptist church is requesting a grant for the number of signs they want to have another church go into their property and they need an additional sign from them so they're requesting a variance for that the regional housing authority office central road is asked to build an accessory structure in the front yard of their property they're having dish issues placing a basically it's a storage maintenance building where they put supplies and stuff like that for the property. They can't really work out a way to put it in their rear yard due to the sewer lines and also just access with the driveway and stuff. I think it's become unfeasible and expensive for them to place it anywhere else other than there. So we'll have to get a variance for that. And then a 74 acre off of Lebanon roads requested a variance from the table of uses to allow an open storage of materials. The property zone agricultural forest directionality doesn't permit know the ability to be able to just store raw materials out there which i think they're just planning on doing mulch from what i've been told by them and then uh currently working with their national property maintenance board members to establish a meeting and so they can pick a chair and vice chair and i'm just going to go over their duties and responsibilities with them that is all i have for you all tonight do you have any questions for me it's not a question just over here please okay um

And this I see is being a problem not only here, but other municipalities, because it's already a problem in other municipalities. Collection of rainwater, especially large barrels. Right now, the way the law is written, we own that water. that means the town the state can come in and tell you what to do with that rain water even charge you for the use of that rain water so we need to look and see what we need to do to make sure that people aren't punished for being conservative most people are using this water for watering their lawns and things like that but municipalities feel that if they can charge that water, they don't charge that water. Right now, as it's seen, as it's written nationally, God don't own the rain once it hits the ground. There's a municipality. So we need to check it.

I have a couple questions. I think I got a call actually regarding business licenses and people going around and checking on business licenses. And one of my neighbors had a contractor that didn't have a town of Pendleton business license, but had a business license elsewhere. And she didn't know if you were a scammer. So I was wondering if you could talk a little bit about, which is, I mean, a good, I'm like, you know, I mean, you never know, right? Like, I mean.

Yeah, that's gone through my head when I've stopped people.

Yeah, they were like, yeah, Sarah, like, is this a scam? I was like, no. So can you talk, which is a sad world we live in where everyone's worried they're getting scammed. Can you talk a little bit about that process and kind of explain the thought behind that? why people should have a Pendleton business license, why it's important to have one if you're doing business in the town of Pendleton, because I think there's this perception of, oh, well, my company is based out of Greer. I have a business license in Greer. I don't need to have a business license elsewhere. Can you kind of talk about that a little bit?

All right. So the business license law is established by the state. If you're a county or municipality, you can choose to adopt that. And the point of that is an additional fee collection for the County or municipality, um, form of taxes. So it's not just a, you know, like, no, you gotta go to work here. You gotta make, you know, pay or whatever kind of thing. There's a reason for it. And I think part of that's if you own a business in town, you're paying property taxes. It's kind of not fair. If you're coming into town, you're making 20 grand two days, you know, you got somebody else over here. You're not really paying anything to be fairness to the other business businesses that are there currently. So, That's the point of it. Anybody working in town has to get a business license. If you're for profit, if you're a nonprofit organization, you're going door to door. Obviously you're not making money for yourself. You don't need to get a business license, but if you're operating for profit and you're going to be making money in town, you have to get a business license. It's just a tax.

So this does this apply to like, I have a, a, a home insurance, whole house, and they, I will call them and they will send a contract. Does that contractor need to have a business license?

If he's coming to make money at your house, you'll need a business license if you're in town. A good majority of the municipalities in the state do business license. There's about maybe five or six counties that do business license, but pretty much every city or town does them.

I think it was the guy that I'm imagining called...

And I was walking out today and no one was walking in. I asked him what he's doing. He said, I haven't gone talking to someone about a business license. And I asked him about the exact same questions you were asking, but I don't know if you want to share how much we actually get from

I do. And simply the answer is because people, you know, are like, well, why this doesn't make sense. But I think to me, in my personal, I think it makes absolute sense. And I think that it also provides the town with, if something were to go wrong, you know, and they don't have a business license, we can't help. But if they do have a business license, I feel like there's something, you know, like maybe I'm making that up, but I just feel like it's an additional protection on the consumers.

from a zoning standpoint as well, it's helpful because when people come up here and apply for one, we know where they're at. Like if you have a house or something in the middle of residential area and you've applied for a business license to do spray painting, you know, that's going to affect your neighbors. So it's one thing we also monitor that with zoning to make sure that's compliant. But in 2025, for license fees of people that I caught while I was driving around town, I got about It's between 18,000 and 19,000. I can't remember the exact number, but that was just people that I caught or called up that were, that I knew had worked in town that didn't have a license at that time. So I think total for the year, we usually collect about 250, give or take around that number. So.

So landscapers.

They all need a business license.

They what?

They all need a business license. They're usually the most difficult for me to keep track of who's working. Yeah. because they'll come and work at somebody's house, you know, maybe three or four times a summer. And then they'll tell me like, oh, I'm only here for 15 minutes, three times a year. You know, like you're in town now, so you got to get one. Yeah.

Appreciate it. And then my last question before I turn it over to Nancy is any updates on the UDO?

So we were working on the resolution to amend the current zoning ordinance at our previous meeting. With the UDO right now, we've gone back and changed the the newer zoning districts that were in that document with our current ones that we have now so it's we don't have to do a mass rezoning of the town we don't have to notify every single property owner let them know i think also it's just easier with the table of uses as well trying to flip and change that so that's where we're at with the udo document and then we'll come back to the ud once we finish with this resolution which will hopefully be within the next two months so i'm also working with the planning commission on setting up an additional work session to help speed up that process

That's it for me. And I just want to thank you for all of your work. I many, I don't know if our constituents know that you are a one man show holding down the fort and we do not have a town planner. We do not have a town administrator and we are very grateful to you. So thank you. Thank you, Owen. Nancy.

So had rain in the last three days, hadn't had rain for a long period of time. What's becoming evident are the silt fences on the infill lots. So, are people filing those complaints through the report it, or are you seeing it as you drive around?

Usually I would see it when I was driving around and they're supposed to, SCDS is supposed to come and check that whenever they put up the soap fence to make sure there's a certain point where they have to scoop it out pretty much to get the erosion off the property. I should drive around more and check on that contact DS, SCDS. So yeah.

There's queen and broad's pretty dirty.

That's usually going to happen when you have the 24 hour storm events really going to wash away stuff. Usually we try to advise them also lay down straw in some of the weaker areas to help prevent a lot of the erosion. So it is, unfortunately, it's going to happen. It's just figuring out a good way to mitigate how much comes off is also a challenge.

I understand. I have a couple of questions. The riparian buffer that you're considering, putting that a separate ordinance or you're putting that in the UDO? I wasn't clear.

That's going to amend our current zoning ordinance and then also be a part of the UDO as well. So our grading section in the land development regulations, I think it's only, we just do what the county requires right now, which I think is less than 30 feet or just 30 feet, which is, I think it's SEDS. So that's what we have now. So when you put the 50 feet in there, it's an additional 20 feet that you can prevent soil or, you know, erosion. We're just talking about getting into a stream and eventually getting to the lake.

So do you think that ordinance will come to us soon?

I think it will come to you very soon with the rest of the current zoning amendments.

Okay. And then the other thing is we have put a lot of new people on all of the boards. Is there any training plan for these new members or new and existing members?

So I send them out a list of meetings that they have to attend for the new training, and then they coordinate with, ACOG, I wanted to attend that. So I had the three new planning commission members are attending the training. I'm going with one of them at the beginning of next month because I also, as a planning staff, have to go. And then I'm still working on getting the new BOZA members to attend as well. So they are attending them.

Can I jump in real quick, Lynn? One of the things that Owen and I have talked about, and I think you have as well as Mayor Pro Tem, but we would like to do, we were going to wait until we had a town administrator hired, but we would like to do a meeting with council and all of our citizens that are on our boards just to talk about kind of the role of the boards and how everything works and i was actually going to invite um our regional rep from the municipal association to to come and meet so hopefully that will happen in august or september like i said we were planning on having it as soon as we got the town manager hired and that's um a little bit delayed thank you thank you next up chief nice to see you and before you start i'm gonna i'm gonna uh ruin one of the things you're gonna say by telling you and lindsay how awesome the school supplies were that also was one of my favorite things i've done since being mayor it was so cool to see our community and i can't wait for you to tell us how many things were collected, but the pictures and I went out there and I would just, you know, I hand out popsicles and they wanted four popsicles and, you know, I'm an aunt, not a mom. So I was like, you can have as many popsicles as you want. And, um, but I, I did, I was like, you know, as many popsicles as you want. I'm an aunt. Um, but I had the best time. So I just want to thank you and you and Lindsay and your officers, um, for that project. It was, uh, It was really, it was really special.

So it was a great event. Sorry to things I'll bring up in the report. So, but thank you for that. So in the summertime, we're always getting a little bit busier. So during the month of July, we answered over a thousand calls, 1,042 calls for service. 31 of those reports were taken, 17 of which were cleared by an arrest or in a warrant. Additionally, 144 warning tickets were issued in 77 states. Let me try it again. 77 state citations were issued. We've got a couple of cases that we're working on now that are really kind of involved that have some really in-depth investigations to it. So we're really spending some time on some of those, which I'll tell you about next month. But we're just working through those as we get through it. During the month, officers responded to a burglary in progress involving two suspects. This was the second burglary that we've had within two months. Again, our officers were able to safely apprehend both suspects and recover the goods that were stolen from the house. So just a great job by our officers who are very, very patient and they know what they're doing and they know what they're looking for. So I really commend them for what they do. Our officers conducted dedicated traffic stops on stop sign enforcement at various intersections in town. We're still doing the intersections at PF Meet, Broad Street. We're also doing the intersections and speeding through Falls of Meehan development. So we are there. So please, when you come to the stop sign, stop for it or you will meet either me or one of my officers. and we'll help you remind to stop for those things. During one of those stops, Corporal Bishop did observe a vehicle disregard a stop sign, which led to the detection and arrest of an intoxicated driver. So we were able to get a DUI driver off the road because we were sitting on these stop signs. Officers attended the fireworks for firefighters events at the beginning of the month. This is another great event that was put on and we had a good time going out there. It was hot, but it was a lot of fun and they did a really good job putting that together. We also assisted the Pendleton Area Business Association with their Dog Days of Summer. This would have been a really great event. We had a lot of things set up. We had things to give out. Unfortunately, it kind of rained on us and kind of put a little damper on it, but it was still fun to get together and kind of show what we had. We also assisted with a visit from Dr. Annie Andrews, who visited, who was a candidate for U.S. Senate. She brought a large crowd to town with her. We have no incidents to report. It was a good time hanging out and just doing that event. So this was the event that I was excited about. So not only is our baseball team all-stars, as I know you guys know, our community is full of all-stars. I was sitting there and I thought, what can we do this month to try and help out? And I said, we know it's school time coming up. Let's do a book drive and see what we can do. So I sent Lindsay a text on a Friday. And for some reason, she hasn't blocked my number yet. And she answered it. And I said, I got an idea. She said, what do you want to do? I said, let's do a pack your backpack. So Monday we came to work and she put this thing out. And then a week and a half, we collected enough stuff to pack 70 bags. of books and notepads and pencils and crayons. And I know more about crayons now than I want to know.

And those school supply lists aren't short.

No, we were getting Amazon packages here. They were just sending them to us. And we had a tremendous amount of stuff here. So I really want to say, you guys, every one of you came out and helped us pack or help us. We took over the mayor's office and it was just slam packed. So it was huge response that we had in a week and a half and I just can't thank our citizens enough in our community for what they did and the dedication they showed to our kids and they will remember that. Those kids were so much fun Yes, they like those popsicles, but those book bags and the stickers and those are the things that mean a lot. So I really appreciate that. Hannah at Food Lion, they gave us all the bags. They just partnered with us. They put a thing up at every one of those out registers and they passed it through and we just packed up a bunch. So our plan is to sit at Pimleton Elementary School as well as Tri-County, which are the two schools that are in city limits. But as I roll through, we will be roaming around and checking 187 to make sure we don't have any issues over there. So we will keep an eye on it. Thank you very much.

We have a pond on the green right now. So now I get to talk about all the bad stuff. David talked about all the good stuff. So we're continuing to coordinate with multiple projects. The green, we've done the final walkthrough punch list with capstone. We've got a few spots that we want to address, and we're going to do another roll on it just to flatten it out again. We're going to adjust some of the irrigation heads. And for those who see some of the grass growing on the edge, it's called nutsedge. We've already addressed it. it will die out during the winter and it will be treated by uh plant and tree solutions the company who's taking care of the green for us so please don't pull it because every time you pull one two come back up um eight inch line buddies are well that uh the 18 mile creek bridge by buddy durham's auto sales so that line was repaired completely today that has been a process for folks who don't know we had an eight inch transmission line burst twice so that has been a nightmare in itself so today it was repaired and on the other side the pickens county side we installed a two inch blow off So we can isolate that bridge completely if this happens again, which we hope it does not because we put what I would call a dead man's vault in the ground today where we actually concreted that pipe in and then rotted it into the flange. So we should not ever in our lifetime move again. What happened is the blocking failed on that eight-inch line by the riverbank. and shifted the whole eight inch line and compromised the flange where it hooks under the bridge so we lost entire head pressure on the tank and the whole town lost water pressure for probably a couple hours until we got it cut off so we should not see that issue again central road pump station we have got that figured out xylem has got a put bigger inlet valves on the pumps. So that will be closing out pretty soon. No issues. It actually looks pretty good. We are going to plant some trees around it to make it look a little nicer and more curbside appealing. Sanitation. I know we had a lot of people upset or wondering about recycling. I still have a truck down. I hope to have it next week. This has been a process. We've had two trucks go down simultaneously. So we've, switched back and forth from greenville to spartanburg getting them in and out of the shops as we could so we can at least still get sanitation trash picked up um but as of right now i think that is where we are I do want to mention one other thing. Cars. Please, when sanitation trucks are coming through the neighborhoods, please don't park your cars in the middle of the streets beside each other. We literally can't get these trucks through the streets. We're not going to be able to get your trash because we are going, beginning next year, when we start running sanitation, there's going to be one man in this truck. If he can't get to your cans, we're going to have to bypass you. And that's going to probably be some heartache with some folks, but I don't know any other way to do it. You please don't block these trucks.

I just want to say that I have told you to not pick up people's trash who are parked by them. So, uh, you out of the kind of you and your team out of the kindness of your heart is doing that under I'm a teacher. I'm sorry. You don't follow the directions. You don't get rewarded. Um, so you people need to know that is all you, um, and your team. My kind of question is, can you talk a little bit about speaking of Buddy Durham?

Can you talk a little bit about where we are on the Buddy Durham wall? Um, and kind of that, that process.

So we have a proposal from CEC and what they're recommending is cantilever walls, which is basically a vertical stem with a heel and a toe. uh we just need to move forward on it if we want them to actually do the engineering and the cost i mean we're probably looking 100 to 150 000 on that wall it is going to be astronomically high to look at it you wouldn't think because it's just block wall there's a ton of utilities behind that wall in the alley so when that wall comes down we do have to be concerned about that compromising everything in the ground back there and a lot of that's new infrastructure that's part of the bruise parking lot was moved for 102 and 104 for their remodel as well so we're going to have to do some testing back there with engineers some geotechnical testing just to make sure what type of soil we do have to have a specific soil type for the cantilever walls to even work So we're just in a position now, if we're ready to move forward, CEC can start the process and then give us a cost opinion. But currently we're probably looking $150,000 on that wall.

Is there a way that we could take kind of the front part that's like crumbling down? Just, I'm really concerned. I mean, you know, cause I think I, every time I walk by that wall, you get a text from me, which is frequent because I do yoga right across the street.

I do feel comfortable that we could get that end piece down. We did talk with Dixie Concrete about maybe cutting the wall at the grade level in the alley. they won't touch it. They're afraid it will compromise the wall and it will come on down if they start cutting it. So we're kind of in a position to leave it where it's at. And I am concerned if we take down that end piece that's cracked that I'd hate to see the whole thing come down because of that. yes so what do we need to do to move forward on this because the problem is going to be that it's you know a hundred and some thousand now and if we keep pushing it off it'll be a million the next time we come around sign off on the engineering proposal that we've got just if if you're willing to go that way that's the only thing we can do because as far as a contractor nobody wants to touch it without an engineer going through that is that eligible for a cmar by chance don't see why not it probably could be so i mean i and and did they then we were told that the study was going to cost what 20 28 000 for the engineering for the engineering study that's the engineering on it or just this is the engineering that's the engineering and they'll give the cost opinion and everything that needs to be done in that study and will they give us more options than just the cantilever wall they will they just think that's probably going to be the best option but there will there'll be some other options we need to be looking at whatever the best long-term option best long-term cantilever i mean let's like but they're but they would look at that and give us some because i mean it depends on if we can even put one there i'm not sure i mean they'll probably look at pile and lagging walls uh or a pour in place or there's some options there's options long term cantilever is the best option if But it is a higher cost option.

If it can be done there. Yes.

It's a big if. Amber and I have been talking a lot about where this money is going to come from because $150,000 is still $150,000. We'll hopefully next month talk about how we can use our hospitality tax to go about that.

We're looking worst case scenario. I don't want to

low volume then you come in a 50 75 000 over and be like jay what's your problem any other questions for jay all right i have a question on the tonnage change so we've gone to self-service recycling essentially since the truck is down completely understandable and one of the things that happens with recycling isn't so much that the material that we're recycling is goes to some a place where we can sell it, what happens is we're taking the recyclable materials out of our waste stream, which then saves us money because then we don't have a tipping charge because that load has been taken off our sanitary trucks. So when we take it down to the landfill, we're not charged for the tonnage that would have been in the recycling. And similarly with the cardboard boxes, the reason we want those is they take up so much space in our sanitary trucks. So that's kind of what we're looking at. Curious if we have any indication with the recycling truck being down, is the self-service recycling, how much tonnage has gone that route versus the curbside recycling? Do we know? Is there some way to run those numbers?

I have a loose idea. I was looking at those numbers today and the last loads that were taken for June in recycling was 10 tons for that month. To put that in perspective, we pick up 10 tons per day. It's a landfill. As far as what's being collected at 600, I could probably reach out to Greg down at Anderson County Solid Waste and maybe get some numbers, but I don't know how many stops that truck in particular may go to.

Yeah, I looked at that as well, and he makes several stops. So I was thinking that the only way we can tell it is the reduction in tonnage from us, not the pick up, he does. So the other question along that line is that, and I guess it's not our issue really, because the county chooses to not put covered cardboard dumpsters out there. If it rains, the cardboard gets ruined, but it's no longer our issue because it's the county's recycling center.

It is. Now there are covers on it, but most people just keep them flipped back because they are.

So I was fortunate enough to talk to Greg. He was so wonderful last last Friday about a lot of these issues that are trucks down, that they've seen an increase. And what I didn't know is they actually come about every day to pick up different, like one day they pick up plastics, one day they pick up glass, one day they pick up aluminum, one day they pick up cardboard. and i suggested that i said you know we would like you to put in a covered cardboard with a slit so people know to break down their boxes because the problem is that people aren't breaking down their boxes and so therefore we can't close the lid so hopefully they can't get an individual tonnage for us because of the way they pick up right right but that was something i talked about sorry unfortunately on weekends 600 east queen turns into a

And then what is your plan to do? Do you have any plans? There's a lot of reports I'm getting of brown water, tan water, and I know what the maybe a Municipal Monday would be to show people how to drain their, use their outside tap, but that isn't always fixing. I'm wondering if we need to be thinking about another town-wide flush.

Well, we do flush, and that's what we'll try to do if we get reports of that. We'll flush hydrants, but typically the first thing you should do is run your cold water for at least 10 minutes.

Don't turn your hot water on.

Don't get it in your hot water heater, but run cold water for 10 minutes. Now, if you're in what we call a run, like several homes and it's just one, it's more than likely in their service line and they just need to run the water. Now, if you're at the end of the line, yeah, we'll probably get there in and blow that off you know open it up and let that water get out and most of our dead ends do have blow offs and we're in the process of putting automated blow offs on now so it will just come on at certain times to keep that water fresh in the line so it didn't sit there and get stagnant it shouldn't be but i'm just That's just in case we get caught up on something and we didn't get that area flushed. It'll be on a timer. It'll flush the lines out automatically.

And that's part of the routine maintenance you're doing on all of the water lines is adding those facilities.

We are. It's a process. It is. And we've got some that are manual. Hamburg's a prime example. Hamburg, it is a manual. It stays on a trickle all the time because it's a dead end. And it's a small...

line and if we don't have that on that water will get it'll get brown it'll get dirty thank you well thank you jay we really appreciate it i know we'll have more questions when we get to talk about recycling and a couple agenda items i thought i'd give you a break amber um Well, before you get started on your report, I just want to tell you, I think you're doing such an amazing job as our town administrator. I appreciate that. So positive. We're going to start positive, too, because, you know, Jay's department started off with a boil water advisory this morning for Hillandale and Brickyard. So not the whole town this time. But not only does Jay have to deal with that, but so do the CSRs. They take phone calls as soon as it starts when people do not have their water. So we do thank our customer service staff for jumping in and making sure they have the information to share with our citizens. I think they knew what was going on this morning before I knew what was going on this morning. So with that, I'm going to read a little email that I got today. Hi, Amber. I meant to email you last week, but it unfortunately slipped my mind until now when I just received the new boil water advisory email. I'm so sorry you are all having to deal with this issue today. On the evening of Tuesday, July 28th, I noticed my water was very dark brown while I was cleaning berries and preparing a bath for my daughter. That's a good combination. I immediately called the non-emergency number to file a report. Since Mayor Sarah was aware that I have experienced this issue before outside of Boil Water Advisories, she had asked me to keep her informed. She immediately contacted Jay Lockaby. Jay then called me to discuss the situation in more depth and advised me to run my cold water to flush the system. During that time, Paul from Public Works Team texted me and arrived within minutes to flush the system for us. I wanted to make you aware of how wonderful our town employees are and give a big shout out to the town staff, specifically Public Works. This is not the first time Paul has come to our rescue and he is always incredibly helpful. I hope you're having a great week, Ingrid. So, um, good job, Public Works, because we don't always get those. Good job to all staff. And I think police department gets a hand for that too, because this morning were you not out there on somebody was out there on 76 while y'all were dealing with that um water line break so good job all right so this month um staff process except oh wait i did want to say this real quick i may or may not been told today that the administrator report goes last because it's the most boring report So as I start to read out numbers, I'm sorry, I'm gonna make it quick because I know we have a lot to do. And I'll let you read a lot of the other numbers. So we did process 669 in-house transitions totaling $1,434,896. Of course, that does include the city of Clemson and Anderson County share of our wastewater treatment plan upgrade. Staff also processed 1,345 online transactions totaling $138,606. That includes 125 transactions submitted through open forms in the Newtown website. And that totaled almost $30,000. So that does show you that that option is getting a lot of traffic. And it has added work, of course, to staff, but I think we actually really enjoy it, don't we? We've enjoyed a lot of that features it had with it. So for comparison with that, July 2025, the town processed 1320 online transactions at 163,297. So we are up from that. and we'll just keep a track on that when we start doing our yearly report we'll share what we've done for the year since we have gone online all right the favorite news for me is and thankfully we learned this at the masc meeting and i was able to reach out to the county and the county didn't know anything about it yet so it reached back out to masc and beginning january 1st of next year we do not have to have a municipal election commission We are under 10,000 population. Therefore, we will no longer have that commission and Anderson County will be conducting our elections. Of course, we do have to pay for those, but that's going to keep a lot of confusion down and it's just going to streamline the process and it's really going to be wonderful for everybody. All right. So staff has held several meetings related to the town's tax increment financing district. We've got a lot of decisions to make on how we move forward with that. And as you heard already from the mayor, we are starting the CMAR process and beginning to look at the process, the projects that we'll be bringing to council. We have also submitted our budget to our financial advisors so that they can update the pro forma so that we can start moving forward and using that. And let's see. Okay. All right. Wastewater treatment plant expansion. You see the update on that final completion data set for this December. I think Maverick is going to be happy to have the plant back. We have exceeded our phosphorus. However, that's going to be expected with the changing we're making in some of the treatment process. So Maverick has worked with that and has that under control. Village Hills Pump Station, you see we're still working on that. Amy and I attended the SRF seminar for that so that we know how to start doing the reporting and know what we've got to have in place before we actually can start that project. Village Hills Infrastructure Project, Sarrar Street, sewer work is complete. I think Jay commented a little bit on some of the work out there. The next work's going to be Miller Street, Thomas Street, and the apartments, getting the apartments online, right? Okay. All right. So SCDOT has contacted us. I don't have a date. I asked for a date, but they are getting ready to come into town to turn the always the stop sign into the always stop. They have all their signs in place or in-house and they're ready to go. And I said, please let us know. So stay tuned for when that comes. So community engagement, of course, has been working behind the scenes with fall, winter, and probably even some stuff for next year. We had the juries for the Chris Kendall Market today. And I think every spot for all weekends are full. So we're looking forward to that. I think they have some great vendors to choose from. And as Lynn stated earlier, the culture identity team has continued to meet. We're going to be at meeting with council next as we move that forward. You have your billing comparisons from last month to this month on water and sewer. You will see though that we decreased our gallons. However, we increased our dollars. How did we do that? Okay. We had a rate increase as of July 1st. So we have a automatic rate increase every July 1st until 2028. And then that will be the next time council looks at their rate increases. And that is all I have.

So wastewater treatment plant, we're coming to your completion. I mean, one of the things I think that helped Senator Lindsey Graham was very influential in getting us that $60 million. So this plant, there's only one of three in the United States. I mean, people are coming to look at it. It's very, it's a high tech. It's a big deal. And so is there the possibility of an open house? Not that everybody wants to go to a wastewater treatment plant. But I think. Our citizens would be fascinated to go visit this place. I've been out there a couple of times and it's a pretty interesting place.

And it's probably now time to start talking about that with our partners. Yes, that's a great idea to start the conversation.

Are we going to get the annual meeting for MASC? Are they going to send us the

output from those meetings so like when we attended a meeting they didn't have handouts they said they would yeah do they send that stuff to you so typically what they do is they upload it on their website under that meeting so yeah that's right they don't individually send it but you can access it from their site yeah okay any other questions for amber thank you amber

All right, discussion items. Discussion of the 7A, discussion of the proposed Bailey bill ordinance and direction to staff regarding the adoption process. I will open it up for discussion. Wasn't on the packet.

well i assumed it was only because i've i've read it several times with owen and the so my question is this applies to properties that are on the national historic register the whole town is on that so what are we doing how do we know if your property

There is a, in that packet, there's a list of contributing structures from that historic register submission. There is a list that I provided in the packet. That's the ultimate point. But you'll see the buildings that they put on there that contributed to the register. So what people have to do is they have to come to town council. and asked to be officially recognized by the town, even though they already are on there, that's just what they approve. They'll say, hey, I'm here on the register or on the comprehensive plan as a historic property, kind of have a designation of being a historic property. So then once they get that from the town council, they'll go to the design report to actually start the process of being on the Bailey bill.

Yeah, but when you, but you know, to me, my question is this, if the whole town is recognized and the Bailey bill basically, allow structures that are on this register to receive a tax rate that is up to you know 20 percent between up to 20 years so who's to decide because there are a lot of people whose buildings may not fit what you consider or this town considers a historic property that is a historic property when you look at the age of the structure so they have the option before they come to town council

to go to the design review board and stake their case and say, hey, I have a 50 year old property, I have contributing architectural, agricultural significance on my property, and I have a historic property. And they'll make their case to the design review board, and they'll get approved by the design review board, they'll come to the town council for the official designation of historic property, and then they'll come back to the design.

Well, I think if we pass this Bailey Bill, we need to make all citizens aware of this, of the process, because there are a lot of people who don't feel they have historic properties when they do.

So that's always the option they have is to come make your case to the design board and council. So that's the only good point is letting everybody know that they have options.

So the Bailey bill, does it give specific boilerplate language for what Barbara's talking about in regards to what exactly is acceptable under this? Or do we as a town have to write our own version of the Bailey?

so i'll kind of jump in so i'm sorry i thought that it was attached i have owen and i have been working on this so um a couple months ago council looked at the first reading of the bailey bill which included things that you know barbara brought up because i'm with you like if a house is and i think the language is if your house is over 50 years old like if you do these things you can qualify to use this bill um because we wanna make sure that it is accessible. And unlike other Bailey bills, there is not a value threshold attached to it. Correct me if I'm wrong, but it's like a very equitable bill. Like your house doesn't have to be a million dollar house for you to be able to use it. And there are some historic preservation bills that have a dollar amount to them. So anyway, but Owen and I have been working together with another guy who wrote a bunch of Bailey bills And one of the things that he actually said is, I think this town has drafted a very generous version of the bill and I hope it will encourage significant investment in Pendleton. I also hope you will share your version with the county and encourage them to use your bill in their model. So it's a very, like, can you make sure that council's emailed that and we need to put it in the packet for next time so our citizens can see it.

yeah i was wondering why there's no public comments on the baileyville that's that's that's i saw david in here and i was fully expecting david to say something about the baileyville um anyway that makes a lot of sense so look at it yeah baileyville will to me is very um business friendly for pelman because that allows the business owners of the buildings to be able to remodel and update their their properties to make them more appealing for people to come and rent them out.

So I have a, I mean, is this in the material? I mean, obviously we're, I'm running blind here, so I have no idea, but there was a, in one version of the Bailey bill, you had to monitor the expenditures. And I was wondering, do we base ours on net improvement or do we base it on amount of money put in?

It was the amount of initial investment. So it was 20%. I still left it as that. That was the only questions I had for you guys. larger so just an example if you have a historic property and it's valued at 350 000 you'll have to show during your application that you're going to invest at least 70 000 to be granted so i mean the so the um that's going to vary widely across the town's landscape those base values because you're using the assessed value i assume the latest assessed value which has a cap on it

Right? So a property that's been occupied by the same owner is going to be much lower than a building that has just been purchased. So, I mean, there's some things to think about. As Sarah says, I'm too deep in the details, but it's the details that make a bill work, right? And then, so have you addressed that though in the thing?

It was still fair market value of the property. So whatever it was.

So it's fair market established by whom? So the county listed a fair market value. Uncapped or capped? I don't know. And then is there any requirement for them to have historical preservation of an improvement? So if I come in and say, hey, Owen, you need to protect my house because it has bluebird gutters. And that's historic for some reason. Do I then have to preserve those bluebird gutters as part of my improvements? Is that a requirement?

You'll have to at least have the same type of material and design for the improvement. The intent's that you're not really, you're just getting it made to go, you're just gonna completely remodel it to be, you know, advanced or modern. You still have to retain the same character and design styles.

So it's a one-time expenditure, but then they can get a 20-year tax break.

That was one of the questions I had. That one was too large. I had this new version, I slowed it down to 12 years, because that seemed to go about. or we could also do what Anderson County's copy has based off fee and then also the amount of time that you're allowed to add. So that was one of the questions I had, but if you wanted to adopt that.

Is there any maintenance rules if we're giving them a tax break, do we have the ability to make sure they're maintaining it to the standard they originally intended for that building?

If I recall, I think there is something in there that says that if you get the Bailey bill, then it comes back and you just demolish the property or done something to it. then you'll be repealed by the county tax break anymore.

So is the repeal retroactive or it's going day forward?

Basically, if you get the final certification for the project and then three years later you do something else, it's gone downhill or you've destroyed it or done something to it, then you'll repeal and then there'll be permanent repeal afterwards. And I don't think I put anything in there you can reapply.

And then after it got excluded, right? Tornado, for example, hurricane. If it's damaged by that, it says excluded. So you get a second investment. You get a second chance at the bat if a natural disaster destroys your home. It's a detail. I know. Everybody knows.

So what is the... My goal is to have this in front of council and to a vote before the end of the year. So what is the process, Amber?

Item 8C is for the consideration of our resolution of the town council of the town of Pendleton, South Carolina to adapt a sanitation service transit plan. to eliminate curbside recycling service, to eliminate bulk commercial container service, to implement an abbreviated cardboard recycling schedule through a new Friday route, and to provide for customer notice implementation and related matters. I have a lot of things to say, but I'll open it up for discussion to others before I speak.

The first question just on the commercial container service is, Was there any communication with our local businesses about that and what was their reaction to this?

There will be once this resolution is passed. They have had an opportunity to speak during the public hearing when we put that information out. But if this resolution is passed, it approves that communication plan and the first thing we start doing is notifying the businesses of withdrawal contractors.

How many roll carts are we going to give the businesses that currently have a bulk container?

This would strictly be residential.

What do you mean?

Unless the business absolutely could not have a bulk container, then as part of the ordinance amendment, council would have to decide that. Right now it is two.

So like when I owned a business, I could get two roll carts as part of that business and when they were picked up twice a week, is that still the deal? So if I currently have a bulk container, I can get two roll carts picked up twice a week, is that correct?

If that is the way council wants to amend the ordinance, yes.

But the bulk containers are generally at places that do food. But they're at churches.

If it's a food product, it should. To me, if you have a restaurant, that to me is something you should have and not put it in a roll cart.

I'm just saying, you know, you said businesses. I wasn't thinking along the lines of like churches or dental offices or something like that. I was thinking like what normally uses these big.

Yeah, I was thinking more of the small. You're right. I was thinking of non-food, non-food service businesses. I'm good with that. So we would continue to provide roll carts to the non-food service businesses and churches. Okay.

As long as they don't have a dumpster now, yes ma'am.

No, but if they do have a dumpster now, they do have a bulk, is that called a bulk? If they do have a dumpster now, we take that dumpster away. Now they're going to fall back to a roll cart.

Then they would have to contract with a private company for a dumpster.

How do they appeal that to come back? I've had several people reach out to me about it. They get rid of these are finalists getting rid of them, but how can we make a, how can a church get on the list to get a roll cart? They don't serve food. They don't aren't putting food waste in it. We're charging them for a bulk container. We're going to take that bulk container away. Now they just need roll carts. So we're going to just charge them for roll carts all of a sudden. I mean, what are we going to do?

if that's how you want to write your ordinance that's your choice i think we don't look at that so there currently there's no way to go from one to the other i mean how is that ever established yeah how is it established how do you go back it's what it's really that business's choice but if they can't put their attraction in the two try and the two roll cards that's when they get a dumpster and pay more okay but it would be up to them But if they're overflowing the two roll cars, then you would be notifying them to say...

But we would give them an opportunity. We would say, hey, we're going to replace this with two roll cars, but you need to be aware of the fact that if you overflow them, we're going to start fining you or charging you differently.

That is how we write the ordinance and then the ordinance, yeah.

So my big thing in this is what I'm trying to understand the thought behind offering a route on Friday to collect cardboard. I guess in my opinion is if we are going to tell our citizens that we are eliminating curbside recycling which in my opinion is exactly what we should do no one around us offers curbside recycling to my calculations we have we have wasted over a hundred thousand dollars so far this year on curbside recycling that has gone to a landfill and um i if it was up to me i would have no more recycling effective today but that's not what this ordinance says it's starting in the new year but I guess from what I'm keep getting told is that cardboard is contaminated. People aren't breaking down their cardboard. Um, so what is the thought process behind offering a curbside pickup and B, I just think this sends a lot of mixed messages to our residents.

If we're going to ask, yeah, like a Friday.

And I, cause my thing is if we're going to ask her, tell our residents, We're ceasing curbside recycling. If you want to recycle, please take your recyclables to 600 recyclables and include a, you know, your cardboard boxes, which we have all of our recyclables at our house and cardboard boxes that we then, I guess, I think this is, this is a mess and I kind of want to understand the thought process behind it.

That goes, I mean, if you want me to comment real quick, Jay, because that even goes back to 4J, that goes back to a prior public works director. that when this conversation first began on eliminating recycling said, you gotta do something with cardboard. We have so much cardboard that we're gonna have to do something with cardboard. And they recommended an abbreviated route for cardboard. Do you have to go that route? You do not have to go that route. And then I'll let Jay pick up with anything he'd like to add to that. But that's where the Friday route

and i would also like to know your opinion on it jay because in in my and i want your honest opinion i value it in my honest opinion um we came to this conversation because I and council is repeatedly told we don't have enough manpower. Our employees are our biggest resource and we are not utilizing them to how they should be utilized. And to me, this is just a complete, like, what does this say? And if we really need more manpower and now we're doing Friday cardboard, sorry, help me understand, Jay. I think historically that's been the thought process

Cardboard is still going to be an issue.

But if we're doing away from dumpsters and we're asking the local businesses to look for a private service, they can do that with cardboard as well.

And we can get completely out of cardboard.

I think it's just been a historical thought process that it's just so much like a post office. Some of the electronics just produce a lot of cardboard.

We eliminate all the pickup. I mean, I understand that again, we're trying to eliminate the volume and weight in the waste stream. It's not that the cardboard makes us money. It's that we're trying to get it out of our waste stream. If the cardboard gets wet, it ends up back in our waste stream. So it doesn't save us any money there. And it also is a huge volume thing because people aren't smashing down their boxes and the current recycling bins are open. So tonight everybody's cardboard got wet unless they put the recycling thing in their garage. Right. So, I mean, so unless we, I mean, I'm just thinking of this to be successful. We're going to have to have some way to have that cardboard covered in a closed in a roll cart of some sort or covered cart. Right. I mean, if we do it, if we do it right. And then, I got one other question. I mean, I don't know how to keep it from getting contaminated because it defeats the purpose. We're just picking up trash on two days instead of one day, essentially. Is that right? Then the other question I had was, can we investigate the real cost? I mean, really sharpen our pencils and sit down and look great. and get the cost of a recycling center on the west side, on the east side of town. So everybody's got to come to West Queen. I mean, I've heard a variety of numbers, but would it be possible to really push back and get some real numbers, like asphalt versus concrete, and then do we need to have it manned, un-manned, and those kind of things?

So what you're looking for, Nancy, you're wanting to have a center, recycling center, over on West Queen.

No, not in West Queen. I haven't had time to do the analysis on where it would go, but I'm kind of thinking that it needs to go on Dalton Road. We've got some property that we could put around. We've got a pump station out there that might be a room for one right there.

the biggest thing is that they're the recycling centers are run by the county is what i'm keep getting told so um and yeah and to my knowledge they are not have not shown any willingness to open up another recycling center i have i've talked to the county i know jay's talked to the county i talked to the county again two weeks ago saying we are most likely going to eliminate curbside recycling fyi what are you what are you going to do and they're like oh, well, we might be out there twice a day. So, I mean, I just think that's the reality.

So is it the county or do they have it contracted out to somebody? It's about them picking it up and them, right.

No, it's the county. They're out at 600 East Queen every week. It was their trucks picking up the recycling.

I agree with Nancy. It'd be nice to have something across 76.

so people don't have to drive all the way across town.

Was that the pump station, wasn't it? It is.

It's right there behind Piper Glen, right behind it. The advisors said it wasn't big enough to start with, and we would have to man it. They won't man it. Of course, they did give a number. I don't know how accurate it is, but it was a pretty steep number.

So they don't want to do another stuff.

So what do we need? I guess I would like to move this forward. We're wasting, you know, $163,000 a year on recycling. And to put that in perspective, that's 308. If you were to look at it in terms of how many gallons of water, it's 318,000 gallons of water is how much money that is. So I would like to come up with some sort of solution. If we're going to do this starting January 1st, I think we need some sort of action. This has been lingering since, what, January, February?

So where are we at with then eliminating the Friday cardboard slips?

I don't think we should have Friday cardboard service. Does anyone else, does anyone think we should have curbside cardboard pickup?

If we're going to eliminate recycling, eliminate recycling, we shouldn't have this pick and choose. Because just because there's a lot of people getting packages, well, I might be getting a lot of bottles. I may be emptying a lot of bottles.

So why are we picking a bottle just one Thursday? I mean, we should have fun.

maybe swamp box will allow us to have a recycling location there well i i i want to address the bulk i don't think we need to separate the bulk commercial container service from the recycling service residential i think that's a good idea and i think because i i would like some additional thought in terms of the i want to The guy at the MASC said the best way to ruin your town is to discourage your businesses. And that was one of the top 13 things he talked about. And, you know, why 13? But I think we should, I just, I'm just, I have a lingering concern about that. And that's what's holding me back on this one.

So in this resolution, the fraud, is that for the entire town or that's only business pictures?

yes but you're talking about this thursday alternate friday thing that's for recycling it's just cardboard right that's just cardboard

I think what we need to do is look at not doing things that have gone hurt businesses. Now, if businesses are already paying, you know, they're paying the town to pick up these things, they can get together and they're going to pay for these containers, these bulk containers anyway. So I just say that we amended or do what we have to just say that if you have a restaurant or a business that you're told you're going to need this bulk container, this is what you need to do. And if you can do with two roll carts to replace your bulk container. As long as you're not doing food. Yeah, as long as you're not doing food or anything that's going to be, you know, contaminating in the raccoons, going to try to get to the skunks, then I can say we, we need, we need to get off the pot on this cause we don't craft enough all over. So I'm like Nancy, I think that we need to look at how we, we provide for the businesses that aren't doing food and say, look, we already know that if, if, if somebody comes around and say, you can't be using these two cars, you've got to get, you know, cause we've noticed you always overflowing, but Like I say, the businesses now that do these big bulk things, they're paying anyway.

Can we survey the businesses as well and ask them about whether a cardboard pickup just for businesses would be helpful? I don't know whether those contenders, are they done on weight or is the issue, I mean, does this cardboard fill up the thing so they really can't get enough in there and that's creating a problem? I don't have any idea about businesses. I don't have.

I agree with you, Lynn, and I'd like to see us separate this into residential and commercial. I'd like to, could we do a little more survey of our businesses and get, make sure that our businesses are on board with this, and maybe can we do businesses next month?

I can tell you this. As long as we stay with bulk containers, we're always going to have to have a three-man crew.

Well, that's why we need to think about the conditions, Barbara. I'm not suggesting that Blue Heron has two roller carts that are picked up twice a week. They certainly are not a candidate.

What do we need to do to move this forward? What do we need to do to move forward eliminating curbside recycling for our residents? And what do we need to do to move forward ensuring our businesses are not deterred from coming to Pendleton because we're not offering bulk pickups?

you need to make a motion that you want to move forward with the elimination of curbside recycling including the elimination of the proposed friday route and you would like to look at the bulk container service separately and survey the businesses and get more information from them prior to discussing it again next month

So we Right now, the we have a master plan of the TIF district, which includes land that we do not own with property owners that do not want to that are not willing to sell their land. And so this would essentially this motion if it was made would allow us to direct staff to redraw the TIF district in accordance to the land that the town and our community partners that are working on the TIF district own.

It doesn't say that we can't continue to ask property owners to sell, but all we're asking is that the TIF district is redrawn to reflect what we can do currently today, this moment. So our developers and our partners can start moving on it.

I think that because of the uncertainty that we've had, the motion, the way it reads now is that we would ask them to revise the boundary of the, not the external boundary, but the internal boundaries of the TIF district, including the civic campus and the small area plan. So the small, my understanding is a small area plan was adopted as part of the bond. So that's why we have to have a resolution because it was part of the bond. So because of that, we have to have a go on record and ask to have the areas we had defined redefined. And that's all we're doing here. And this redefinition will take care of the fact that the original small area plan assumed we could purchase some land that we've since discovered we are not able to purchase. So we're going to ask the engineers to take that into account and to redraw the features inside of the TIF district in a way that we can begin to accomplish the tasks of getting increased tax revenue because we'll get some additional building going on in there. That's exactly correct. What are you thinking?

I know you're trying to move it forward quickly. I don't understand how I feel like this is going to create a big confusion.

i guess where i'm getting frustrated is i feel like we continue to just kick the can and this is not at this is not saying that things are going to be built tomorrow it's just saying we couldn't acquire the land in the original master plan with the land that is currently acquired what would the TIF district look like, ensuring that we're meeting the requirements for the TIF, like having commercial, having residential, having something for the whole community.
