It is now 7:12 p.m. Welcome to tonight's Planning and Zoning Commission meeting of Monday, January 5th, 2026. Members of the Planning and Zoning Commission and public may participate in the public hearing. All participants will be able to speak when called upon. At this time, I would like to explain the procedures to be followed during the meeting. The commission has both a consent agenda and an agenda for consideration of individual items. Items listed on the consent agenda are considered to be routine and non-contested. Item number one on our agenda is citizen comments. This provides the opportunity for members of the public to address the commission on items that are listed on the consent agenda. Each speaker will be limited to three minutes and the secretary will let you know when one minute is left. For all plats and plans conditionally approved or disapproved by the commission, the applicant has provided a written statement of the conditions for the conditional approval or the reasons for disapproval. These conditions or reasons are not arbitrary. They are directly related to the

requirements of local government code chapter 212 and include citations to the law that is the basis for the conditional approval or disapproval. For individual consideration items, I will call the applicant or his or her representative to present the case. The applicant will have up to five minutes to present the case, which includes all persons representing the application. Then those wishing to speak in favor and those wishing to speak in opposition will have up to five minutes each to present his or her comments. The applicant will have five minutes to answer questions and provide rebuttal if there is opposition. Prior to speaking, please give your name and city of residence. Remember to speak directly into the microphone as this hearing is recorded for the public record. Any handouts you wish to be to provide should be given to staff, typically Kenneth Bloom on our right. Applicants are not required to stay for the entire duration of the meeting and may leave once their item has been heard. Um um here the um uh the building pad um along with the um uh the the required parking spaces uh for the customers. Um as uh Mr. um uh Kenneth mentioned in the workshop um that it would be uh just uh for customers, nothing stay in overnight. Uh he does not he he's not intending to uh do a car sale on that uh business. Um that's going to be a three bay and the storefront. Uh it's um on the other side on um let's say that the shared ax is uh going east. Uh um you know every business depends on how b how busy it is. It's a for uh Mr. Edgar it's a family business. He has his daughter a mechanic. His uh uh his son is a mechanic and he himself a master mechanic. Um that's what they do on um on their uh current shop. um for operating um this type of business. U so they will probably be supervising uh if uh for oil change for uh these quick simple tasks that's uh they are intending to open on that uh uh place that uh they will uh probably need at least four or five people to operate. Um, so yes, so they're going to be leasing out this property to someone who will be operating it and they are going to have at least five employees. Um I would say so if it's the busiest uh um well if it's if the three bays are busy for oil change every b every bay need one person on a full capacity and one person to take care of the uh storefront. So I would assume this total four on a full capacity.

Um, sort of on that, my understanding was this did not involve any variances on parking. So that that they're meeting the requirements under the ordinance for parking for this kind of use. Is did I misunderstand that? I mean,

so this is they're this what they're proposing. While it's a reduction in what was the old site plan, it still meets the minimum requirements under our ordinance for for parking. So, we're not being asked to do a variance as to any parking requirements. We're just t allow, you know, we would be recommending or not recommending a change in the site plan, but it would still comply with the parking requirements under our ordinance. I mean, maybe that's not enough. I don't know. But Oh, thank you. No, no, this is a great question and something want they want to consider, but but I just wanted to make sure that I was understanding the case correctly.

Absolutely. And if you allow me to build on that, uh, Mr. Gerald, um, uh, now these are two businesses with one owner. Um, between these uh, two properties, we have a setback and we have easements. Um uh there is uh there is a utility easement which is 10T um uh plus the setback which is give us 16. Um uh we grading this area in a way to be sufficient for um you know environmental uh uh safety. uh if we can utilize this area for these parking that would be that we be something great to to consider for this business.

So I'm I'm going through this process and hopefully I I'm able to build a home so I can go in there and move in. It's certainly an administrative process.

Uh, my father originally created this restaurant here in town, which is now the officially the oldest Italian and/or restaurant in town, Angelo's Spaghetti and Pizza. my operating manager back here, Cliff Beckoy, uh has decided that it might be a good idea for us to sell liquor at the location to give people the same options that they get north of in North Irving because we've always tried to take good care of our customers and that's part of the reason for the the change. We we are looking to have better options for our customers. I being the land owner uh am giving a variance for this parking which was the only consideration I believe was the problem in that particular deal because I own the building behind Angela's also which is affordable self storage. So in that particular instance uh he'll have more than enough parking to take care of the things as he needs to.

Um we have the two different proposals before us. The one the original one and the one with the disability provision added in. Um you know one of the aspects of the ordinance is that it gives only one way of getting these sorts of approvals through this process. If it still allowed for exceptional cases to come through PNZ or go to council or something like that, I'd say maybe the disability provision didn't need to be in there because then we could have dealt with it through our through a different process. But because these have to go through this one process, I think it would be best to include the the provision um for the disability uh in order to have the ability for that the um the carports to be approved in that case. I agree with Commissioner Skinner that we should uh uh pass the planning and zoning request uh to include disabilities and for people to be able to uh present their hardships um as needed to be able to get in and out of their homes and access their cars. Well, and I'll if I could just add to the comments. Um, if I had if I had one concern about this, it it is the removal of some discretion uh for, you know, ultimately city council to approve or or not approve these requests. But I think uh most of us have seen these cases uh for at least a year or two, if not more. And I think these factors generally align with the cases we've seen that appear to be appropriate for various neighborhoods. And um and so for that reason, I can support it and and would recommend the uh provision with the disability consideration.
