First order of business is the minutes from the October 6th meeting. And I believe Commissioner Taylor, you have the motion for that.
Yes. I move that the reading of the minutes for October 6, 2025 be waved and that the minutes of said meeting as prepared by staff be approved as written. Second. Moved and seconded. I. Our next item is uh continued petitions, which I'm not aware of any. So therefore, we'll move on to the next item, which is new petitions. And uh in regards to properties on Clark Street, I'll have Mr. Summers give us a staff report. Thank you, Mr. Chairman. This is a reszoning uh from R2 to B3 for a dentist office expansion. There is a single family home that that is located on the lot. It was built in 1923, but it is vacant at this time. The proposed expansion would be 5,500 square ft off the back of the building, which would encompass the three lots to the east. Um the R2 low and medium density residential zone is inappropriate for the lot because South 28th Street is a M I'm sorry is a minor arterial which forms the western boundary of the site. Further, there's medical uses including parking for Baptist Health, Medco, the existing dentist office, LabCore, Kentucky Cares, and a chiropractor office. Traffic counts were 8,893 vehicles a day in 2024 and it's on the route south 28 that links um downtown Jackson Street and Park Avenue. Uh as mentioned are two vacant lots and one single family vacant home. So there are no res residential impacts to the actual area. The church is located north of the site and the church building and associated parking lot expands further east toward downtown than the proposed dentist office would. The future land use map shows the parcel to be neighborhood conservation. However, we are recommending the reszone to B3
general business zone. So therefore uh the planning commission must find that either the existing zoning classification given to the property is inappropriate and that the proposed zoning classification is appropriate and that there have been major changes of an economic, physical or social nature within the area involved which are not anticipated in the adopted comp plan and which have substantially altered the basic character of the area. The general area of this um neighborhood is transitional in nature and as mentioned there's a lot of medical uses along the south 28 spine. The area east of the site is lowdensity residential and uh of course I had already mentioned the church across Clark Street. So therefore, Mr. Chairman, for the reasons mentioned above, staff is recommending approval, and I would like to turn it back over to you for the public hearing.
Thank you very much. This being a a change in zoning, we will hold a public hearing and uh Commissioner Benberry, I believe you have a motion to open that. Yes. I move that this commission open the public hearing for case Z205-00004 pertaining to 2706 2728 and 2730 Clark Street second moved and seconded. All in favor say I. I.

We are in public hearing regarding this. would ask anyone who would like to provide commentary regarding this petition to approach the microphone and identify yourself uh at name and address. Good evening. I'm Jason Goens with Site Works. Um the engineer here representing uh Manino Dental Care. Uh I'm also here with architects uh representative uh with PFGW. Yeah, we're here on behalf of uh Dr. Manino. His business has going well and and growing and he would like to expand his building. Uh currently it's located on 28th Street and they also own the three lots uh directly behind which front on Clark Street. So, it's just a logical and easy way for to them to expand the location that they're at. But in order to do that, would need this jump zone change to be approved from R2 to B3, which corresponds with their current office location. Now, uh the U I think you have a a copy of the site plan that kind of shows the building expansion. Uh 5,550 ft approximately. And then we've shown some a concept on what the parking might look like. They will utilize the existing entrance off of Clark Street. Be pretty minimal, not too invasive on the neighborhood. Uh and then we do have some proposed screening uh which is required for a commercial zone along that that uh joins a residential zone. So we uh have no issue with providing that as shown on the plan here to field any questions that you guys may have.

Motion carries. All right. As far as the motion for the resoning itself, Commissioner Rhodess, I believe you have that. I do to us.
I move this commission recommend approval to the board of commissioners and adopt a resolution recommending the approval thereof of the requested map amendment from R2 low and medium density residential zone to B3 general business zone for property located at 2706, 2728, and 2730 Clark Street. I further move this commission adopt the following findings of fact in support of said recommendation. One, the existing R2 zone is inappropriate for this lot. Number two, South 28th Street, a minor arterial would form the western boundary of the site. Three, the site is adjacent to a B3 zone on the west. Therefore, spot zoning is negated. Number four, the site is intended to provide additional area for dental office expansion. Number five, the requirement to change the zone classification is outlined in KRS 100.213A have been met. The general area of Paduga is mixed use transitional in nature. Traffic counts were 8893 vehicles a day in 2024 on South 28th Street. The South 28th Street spine from parking lot of Baptist Health Services serves several existing medical uses. Number nine, the church building and associated party across Clark Street extend further east than the medical office expansion would. Number 10, there's no impact to existing residents as the single family home and two lots are vacant. Number 11, landscaping would be required between the medical office expansion and the single family home to the east pursuant to the city of Paduga zoning ordinance. And number 12, South 28th Street is a major north south connector linking Jackson Street to Park Avenue. Therefore, the site is easily accessible from all of Paduka without disruption to the residential neighborhood.
Second. Moved and seconded. Commissioners, [clears throat] do you have any questions or comments? Uh we were provided an updated plat uh this evening that we can get Mr. Goowens to come back and speak to that if you have any questions.
I have one question on 28th Street. Well, the entryway I don't see it. Um on the on this is it going to be closed the current. Uh no I'm kind of confused myself. If there is one on 28th I don't know that I showed it properly on there. You didn't. We've got the one off of That's how they get in right now, right? Okay.
I just so it's it will remain. Okay. Okay. Good. Thank you. Um, I only have one concern about the plan, and it's not a big concern, but it would be nice if pine trees could be brought along Clark Street from the entrance back to the pins to cover or some screen for the for the cars on Clark Street. I I know the Church of Christ does not have any, but it it would certainly in my view make it more attractive and a little less jarring to the rest of the neighborhood.
Yeah, there there will definitely be some landscaping kind of provided around the a more detailed landscape than than just the pine trees along the east side. Just what about on the north side on there along Clark? Correct. There'll be some landscape added there too. just kind of typical landscaping that would be provided on most commercial projects like this. If there's anything in particular that you want to see, then we can certainly make that note.
I think it'd be great to have some, you know, that similar run of pine trees and have it along Clark Street up to the to the existing entrance to the parking lot off Clark. I think we just make the project look a lot better. think that would be an issue? Do you um I just I would I would be cautious about pine trees just because of uh decreasing shed view sheds from whatever kind but some some landscaping to soften that edge I think would be appropriate and and I believe the man manginos would be agreeable to that. Um just want to be aware of view sheds turning out of the parking lot up and down Clark Street.
So but but yeah I think it's certainly doable and yeah whatever y'all come up with. Okay. Thanks. Yes, sir. Any other questions or comments?
