That ends off being referred to PCO. That concludes our selected correspondence. Additions to the public. I don't have anybody that signed in. Is anybody here that would like to address council? Hearing none, report of the mayor. Mayor?

6:12 – 6:473

A very short report but it is an important one because we are conducting spring cleanup days beginning on Monday. It should last about two weeks. This gives individuals the opportunity to rake their leaves onto their tree lawn and we will be picking them up. Another important aspect of the spring is we are selling leaf humus and wood chips. Those sales will begin also on Monday the twentieth. And then the Westlake Kiwanis Club is having their pancake breakfast, but it's not this Sunday. It's April 26.

6:48 – 7:200

Thank you. Reports of administrative officials. I know I've asked, and we're usually getting reports during committee of the hall, but is there anything additional anyone wishes to add? No? Thank you. Reports of standing committees. Our committee of the whole meeting met this evening. We convened at at 07:30. Present were council members Greenspan, Nenari, Del Ragneaux, Leveque, Havelka, and Getsay. Also present were mayor Kluff, law director Maloney, director Stoom, Smallick Shaw, Horner Bedell, Serber, Steibel, Graham, Gad, chiefs Beeloser, Moran, and clerk Rosenbaum.

7:21 – 7:420

Discussed for agenda items, selected correspondence, planning commission report, as well as the following items. We have two Eagle Scout proclamations. We will present them at a future date. We're trying to coordinate that with the troop and the two scouts. We received a construction projects update and committee meetings to discuss charter amendments, compensation study were also discussed.

7:42 – 8:110

Two committee meetings were scheduled. The committee of the whole has been scheduled for April 28 at 7PM to discuss possible charter amendments, compensation study, and e bikes. And a PZL meeting has been scheduled for the twenty first at 06:45PM. There are nine items, including a a matter regarding waste pickup times. That meeting inside committee of the hall, we did go to executive session that convened at 07:49PM.

8:11 – 8:390

Council member Todd Leveque moved, seconded by Nick Nenari. This purpose was to discuss collective bargaining real estate and real estate. The motion was unanimous to go into executive session. Also present was were the mayor, finance director, law director, and planning director. That meeting convened at 08:09, and the committee of the and the committee of the hall convened at 08:10. Moving to reports of other boards and commissions. Planning Commission, mister Beadell.

8:39 – 9:042

You, mister president. So we Planning Commission met on four six, and several items were are on tonight's second reading. We're just gonna kinda read through them. Mister Biddell is going to show them on the screen, and we'll talk about them at the second reading. Ordinance twenty six nineteen, conditional use permit for senior service use, Westbrook Nursing LLC.

9:087

Yes. So this, changes, this facility from, its existing skilled nursing home to assisted living, and this does require a new conditional use permit.

9:202

Item ordinance twenty twenty six twenty five. I'm going to refer to mister Bodell on this one. There's some cuts.

9:28 – 10:017

So this one is not on the agenda tonight. Reason being, PZL recommended that the properties be assembled so that it would be a singular campus. And Planning Commission agreed to it. Unfortunately, this creates a catch 22 situation because in that zone, preschools are supposed to be on their own parcel and the only use in the building. So in order to move forward with the conditional use permit, it requires a text amendment to and by the way, this is the only zone that's like this for preschools.

10:01 – 10:207

So they would be able to do this vibrate in in residential zones, for example. So it does require a zoning text. And again, it permits preschool to share a parcel with a place of worship and also to be located within the same building as a school when located in the shopping center zone.

10:210

And that item, just as a point of reference, is ordinance two thousand twenty six fifty two on the agenda, which is being referred to PZL.

10:29 – 10:402

Ordinance twenty twenty six twenty six, the conditional use permit for training school 26945 Westwood Road. It's on for second reading tonight.

10:40 – 11:007

Yes. LifeBridge Care. They're a certified provider with the state of Ohio for individuals with develop developmental disabilities where they provide life training and skills training, and this does require a conditional use permit in the office building zone.

11:012

Ordinance twenty twenty six dash 27, condition of use permit for fitness center, 27100 Detroit Road.

11:10 – 11:257

Yes. This is for Forward Fitness. It's a small fitness center for just one on one training and small group training. And regrettably for them and the general business zone, this does require a conditional use permit.

11:26 – 11:382

And ordinance twenty twenty six dash 32 rezone 29707 Center Ridge from office building district to R Dash 1 F 80 single family district.

11:38 – 11:597

Yes. So the purpose of this is to allow the developer to construct an 11 lot single family residential subdivision, And a schematic layout of that was, supplied and it does meet the code requirements. And if this moves forward, eventually you will actually see the preliminary plan and final plat for it.

12:00 – 12:272

All of those will have public hearing, on 05/07. 05/07 meeting. The last item would be the Cleveland Water Tower site improvement. I'm needing need a motion for this one. I'm gonna make a motion to approve the Cleveland Water Tower site improvement temporary cell tower due to repaint painting of water tower with the modifications listed in the report of 04/06/2026 planning commission.

12:270

There's been a motion. Is there a second? Second. Motion's being seconded. Discussion on the motion? You wanna add anything?

12:35 – 13:187

Yeah. I can go through the slides if you'd like to learn more about it. This is a a temporary cell tower. And as mentioned, it's it's at our water tower is going to be painted. We're not exactly sure until today. I actually thought it was gonna be repainted this summer. It may actually go into next summer. But it does require removing all that equipment that you see on top that is by T Mobile, Verizon, and AT and T and removing it for a month and a half, three months, whatever it takes for them to do the painting when that actually begins. So in order to do that, they will have a temporary ballasted pole, which just means it's a pole that's not on a foundation. It's weighted on the bottom.

13:18 – 14:017

The weights are not shown in this drawing. Big concrete blocks will keep it from blowing over. And it's really only temporary. It's not a structure that can be up for years. They're not designed that way. The one item with it that does require modification has to do with the distance from the lot line. Per our code, it's supposed to be one foot a one to one ratio from the distance of the top of the tower to the lot line. And our water tower currently doesn't meet that requirement. The water tower itself is only 48 feet away, and that's about what is it? A 140 foot tower.

14:01 – 14:407

So that does require modification to allow this temporary ballasted monopole to be closer to the lot line than what code would actually allow. And again, as I mentioned, the tower itself, this is our lot line right here. So in order for this to actually meet current code standards, the lot line would have to be way out here somewhere probably. So Planning Commission did recommend approval. And it's really a necessity because without this, there's no no cellular service in that part of the city for Verizon, T Mobile, or AT and T.

14:430

Further discussion?

14:448

Yes. A couple of questions. Do you have a, like, a preliminary of the colors that they're painting it and stuff?

14:52 – 15:067

is Thank you for bringing that up. Yes. So I've been in talks with the Cleveland Water Department, and they have not finalized that yet. They're going to be working with the city. We're we're very concerned, obviously.

15:06 – 15:437

It's pretty iconic being green and white. They understand that we would like it to continue with those colors that we we would also like to also read Westlake. If there's any other anything else that they would like to add to it, their own logo, for example, which we we think that might be something they're considering. Well, would require Planning Commission approval as new signage, And they are aware that they they have to come to the city first before they make these decisions. Also, as a temporary tower, we will be approving a new let's see. Is it a lease agreement? Is that what it is, mister Malone? Yeah.

15:434

It is.

15:447

Yeah. So so it's a temporary tower lease agreement, and that will be coming your way in the next month or two. It's right now, the the lawyers are massaging it.

15:548

No. I'm glad you answered because I want to make sure that it's green and white and I hope somebody's pushing for that. Yes,

16:047

we're very concerned about how this is going to look when it's painted. It Who sounds like

16:098

owns that property? Is it Cleveland Water or us?

16:12 – 16:257

We it's actually City of Westlake. Okay. I'm not exactly sure how this works. I guess they Cleveland Water must own the tower, but we I I don't know how that was worked out. It's before my time mayor. Do you know?

16:263

This one, I don't know. The water tower was here before me.

16:297

What? No. What? There's

16:314

a first. Oh, there you go.

16:320

I'm not sure about that.

16:348

But mister Maloney, can we find out the legalities? Or is there a lease agreement between us and Cleveland Water?

16:424

Cleveland owns the tower. We own the land.

16:440

Yes. Okay.

16:454

But, yeah, there's an agreement somewhere, some dusty old drawer somewhere. Have to find it.

16:503

I wonder if it's part of our water agreement that we've never signed.

16:534

That's true.

16:560

Well, that's an inside thought. There's currently a motion. Any further discussion?

17:018
