Seeing none, let's move on to recognition which is presentation of police unit accommodation award. Uh, Commander Sitin will introduce the members of our commercial crime unit who are receiving the department's unit commendation award. Good.
Good evening, Commander. Mr. Mayor, Council, you Here we go. Fix the chair real quick. Um, you guys just going to stand behind me?
That's nice. Okay. That's not intimidating. Um, Mr. Mayor, council, is my honor tonight to present the unit accommodation award to our commercial crimes unit. Uh, Detective Sergeant Dan Swain, Detective Jordan Welch, Detective Nelson Massie, and Detective Kyle Henderson comprise our commercial crimes unit. The award tonight is for commendable achievement that went above and beyond their normal assigned work duties or responsibilities that brought great credit to the department and the law enforcement profession. The commercial crimes unit simultaneously investigated two serial burglaries that were complex and affected both the business and residential Tiger communities. The investigations required numerous hours of surveillance, followup, search warrants, and coordination with countless law enforcement agencies across the Pacific Northwest region. At one point, the commercial crimes unit synchronized three different tactical teams along with several other search warrant executions spread out over hundreds of miles to safely take the suspects into custody and gather evidence of the crimes under investigation. Tens of thousands of dollars of stolen property was recovered and returned to the victims. The suspects were ultimately indicted on numerous felony charges, including burglaries, kidnappings, robberies, and racketeering. This commendation acknowledges the hard work and tenacity displayed by them all. Their actions exemplify the Tiger Police Department's core values of attitude, leadership, integrity, service, and teamwork. So, I have a certificate for each one of you, sir, and unit accommodation pins. And I'm sure the council wants to maybe take a picture with everybody.
Well, congratulation again to our all detectives and thank you for your service. Uh let's move on to uh next section uh item on our agenda which is public comment. Public comment period provides an opportunity for members of the public to address the city council. While it is not a dialogue, either I or staff will follow up to address the issues brought forward in these comments. The calling number is 503-9664101 and those wishing to comment should call now to get into the queue. Anyone present wanting to comment should sign up on the public comment form at the front of the room. Those call calling in for agenda items number six or number seven should wait until that item is announced and then call in. First uh is public uh written comment. Um there were three written public comments received by the Monday noon deadline about funding for full-time park ranger precision concerns with camping ordinance enforcement and a request for utility bill fund size to be increased. Hi there. I'm Matt Ratski. I live here in Tigard. uh just off McDonald's Street here. Um and I'm calling coming here about the uh home situation over at the water district. Um for it seems like things were going great there for like until like maybe a couple months ago. Um and it looks like I mean I work right across the street from there. So I was able to see that the police were going out there every morning around 9:00 in the morning enforcing and make sure everything got cleaned up. Um at least for the most part of it. Um, but then ever since then, um, for some reason there just hasn't been a force at all anymore. And garbage is all over the sidewalks. People can't walk by. Um, I'm sure it's not doing great things for the uh, resale I mean uh, real estate values around here. And uh, it's just like for some reason the police have not been taking care of this situation. And when I called them, I've called them like three times already and they they either said, "Oh, yeah. We'll we'll tell take a look at it." And I don't think any anything's ever been done. And uh last time I called, they said, "Well, you should need to go talk to the city council because for some reason uh they're just allowing this to happen and we can't do anything about it." It's just like, "Okay." I mean, I thought that was a police enforcement type thing. So, basically, I'm just curious about what why it's not being enforced. I mean, I'm sure that sidewalks are not supposed to be cluttered like that, so people can't walk by. Um, I mean, I'm all for this the rule, the laws that say they can camp there overnight. I think that's great because they're right there. I mean, you know, if anything goes wrong, you know, there's no they can't do fires. I mean, people can watch what they're doing basically. So, they're out in the open. So, I think that's great. I think the law is awesome. But when it's not being enforced and they're not cleaning things up in the morning like they're supposed to be, that's where I'm like been having a sit a little issue with the the situation. So just curious to find out what can be done about that. Maybe if there's anything else that needs to be enacted or uh something else to be to be done. So

Uh thank you, Mr. Van. Uh let's move on to the next item on the agenda which is city manager report. Act act acting city manager rigger will give a brief report. Good evening.
Good evening mayor and council. Uh as we move into the month of April, I want to highlight a vital community initiative led by the Tiger Police Department. April marks child abuse prevention month, a time dedicated to the safety and well-being of our youngest community members. To honor this, you will see a display of blue pin wheels. You saw them when you walked in here uh out along the city hall lawn and along the drive there. Uh these serve as a visual reminder that preventing child abuse is a proactive communitywide effort. Our officers work year round with schools and local partners to identify risks and support families, ensuring every child in Tigert has a safe environment to learn and grow. By staying aware of work and working together, we are building a healthier future for all of our children. I'd also like to highlight a few board and committee openings. Specifically, there are vacancies on the budget committee, planning commission, and library board. Uh we're seeking volunteers to apply to serve on these boards by Sunday, April 12th. More information can be found at tiger-.gov/vacy. Uh the last thing on my list tonight, Mr. mayor is uh uh to talk about the an update regarding the houseless camping at the public works lawn. Uh everyone has noticed that over the last several weeks the number of campers has increased and in many cases large amounts of uh personal belongings are there during the daytime staged on the sidewalk along Hall Boulevard. So there are some changes uh that were in the works and are in the works regarding managing the situation. So there's three things I'll report on tonight. First uh
the police department has begun a more intensive enforcement effort. U specifically all officers have been instructed to um pull over and address issues if they notice that there is a violation there and they see it. uh they need to pull over and and address it. Uh before that, there were really two officers dedicated to that and the bandwidth just wasn't there for them to see all things all throughout the day. So that's that's one um one change. And I would say probably the more common offense is the blocking the sidewalk. they need they need to leave open 48 in of clear space to allow for people to walk by or a wheelchair to to roll through there. Uh that's one of the one of the challenges out there. So coupled with the additional enforcement there will be more li a more liberal approach to in um exclusions from the camp site. Finally, on that on this point, uh you will soon see a proposed change to the time, place, and manner code uh related to the storage of personal belongings and uh on city property and in the ride ofway uh during the daytime. So, that should be coming your way uh for the April 21st meeting. So, with that, that's the end of my report.

The consent agenda is used for routine items. Information on each item is available on the city's website in the packet for this meeting. Mr. Mayor, uh, tonight I brought our executive assistant, Liz Upton, who's basically going to give you the report on the alarm system. So, go ahead.
Um, our current alarm system has uh is outdated software. We worked with the city to uh get the EPL software, the current software that we use for permitting for um uh uh permitting for other locations and planning and whatnot. Um so we've implemented that and in that we needed to update the ordinance to align with the new system. Um and then uh we also updated the language. It hadn't been updated since 2014 and there was uh some new technology and modernization in the language. And then we added an appeal process uh which matches other agencies and jurisdictions in this area to have an official appeal process for false alarm calls.

Yes. Would you mind introducing yourself to the council and the tiger community? Well, thank you, mayor, for the opportunity to visit with you. Uh, good evening, uh, council and staff and community members there in the room or or who may be watching. My name is Cliff Moore. I am a consultant with Profund, the executive recruiting firm, working with the city of Tigard on the recruitment for your next city administrator. Uh, just as a brief background, I'm a former city manager myself. I was city manager in Yakama, Washington. I was also county manager in Thirstston County, Washington, where the state capital Olympia is and a longtime department director in Thirstston County as well in community development. So, a lot of years in the business. Um, I'm pleased to be able to work with Tigard on this important recruitment. Uh in the last week or so, I've had a chance to visit with almost all of the council members individually, with several uh staff members, the count the city attorney and the chief of police, and then also uh with the uh a group depart a group of department directors as well. So, I'm getting well schooled in in Tigert and the things that you're looking for in your next city administrator. Uh we've provided a schedule uh for the for the process and and I'm happy to to go over that or or answer any questions you may have. Yeah, thank you. It was a pleasure talk talking with you last week and I I know you talk with all Yeah, as you mentioned, you talk most of our city council oneonone. So, and here comes our HR director Gomez. Um, good evening, Mayor and Council. For the record, my name is Laura Gomez and I am the city's HR director. I'm here tonight to continue the discussion um let me catch my breath that was initiated during council's meeting on February 10th regarding the process for hiring a new city manager. The me uh meeting resulted in council creating a subcommittee to select a recruitment firm and the committee um selected Brothman company. So, you've met Cliff. Yes.
He is joining me this evening. Um um and staff request council's adoption of the hiring standards criteria and process for city manager. Um the purpose of the evening's public hearing is to present the scope of services, the workflow and proposed schedule and solicit input from council and the community. Adoption of these items is the next step in beginning the formal recruitment process. Um, so provided for you ahead of time and to assist with council's decision-making was the scope of work, the job description, and a workflow process. Staff recommends proceeding with um the city manager recruitment as described in the workflow process and would like a point of contact from council for input as we move through that workflow.
Any questions? Yeah. So council members uh you you all have received documentation relating to the you know scope and of work and and timeline etc. Any questions or comments for HR director KZ? No I'll go after Oh go ahead councelor Schwack.
Thank you mayor and um thank you Director Gomez and good to see you again Cliff. I'm very excited to uh begin this process and I had an excellent one-on-one with you both to talk about some of the things I'm interested in looking for for Tiger's next city manager. Um two points um regarding um section 3.2 in the um personal services contract which is the candidate presentation says we would select the top two to five candidates to be selected. I'd prefer to just bump that up to three to five and just have some more options of folks that we can meet in person just based on uh previous experiences I've had on the council. I want to make sure that we have uh a good amount of options moving through each one. So, minor point there. And then um regarding the point of contact request, I would suggest that Mayor Hoo be the point of contact. He is engaging in um one-on- ones with every council member every two weeks at this point. He's very in the loop on the process, and I think it just structurally makes sense that he be the single point of contact since we're all able to provide him with feedback that we have on a regular basis, one-on-one. I think that makes sense for efficiency purposes and we have been meeting with the mayor so he's quite in tune with uh our preferences and um I'm fine with the top three to five. I thought two is fine just because we've had a lot of candidates in the past which I'm hopeful we'll have many more. Uh but I'm fine with three to five and just want to echo my thanks to both um both the acting city manager Ryer, city attorney Rahal, our HR director Gomez and also um Cliff for just all the hard work you've done. I my question is just a clarifying question um on when we get to the finalists on the background checks. We talked about um that decision and I noticed in the timeline it might be prothman or the city of Tiger doing that finalist review. Is that a decision we determine later on or is that something that okay doesn't have to be done tonight. Okay, that was my question. I added that in to the contract. It wasn't originally there, but we um they were Prof was very generous to let us offer that option to council when we reached that point.

Take a deep take a deep breath. All right. So, next item is review policy for acting city acting city and elected officials. and it's a request by councelor Schlack and myself and city attorney Rihala and I will le this item along with our HR director Gomez. So HR yeah so start we start with two policies. So which one would you like to start?
So we'll start with the um reporting policy. So, the city of Tigert is committed to providing employees and volunteers with an environment that encourages and enables reporting of known or suspected improper public officer and public official conduct. The city is also committed to ensuring people who report their concerns are protected from retaliation. A documented policy and procedure that establishes clear reporting procedures and ensures persons who report are free from retaliation would foster and promote a safe and respectful and professional environment. Council requested a documented process for reporting the improper public officer or public official conduct. Um, additionally, council was provided a memo approved by a council subcommittee regarding the compensation and administration and process for the city manager, city attorney, and municipal court judge positions. In May of 2025, council expressed desire to clarify the compensation process for the position of the assistant city manager that is not considered a city officer when serving in the role of the acting city manager. So the first action that we're requesting regarding the policy for reporting improper public official conduct um is that council requested this and because of this policy applies to members of council as well as employees who report directly to council. The request is for the city council to approve the public officer reporting policy as opposed to the city manager who would normally approve this policy. Are there any questions about that policy?
So, we're talking about the public public officer reporting policy. Any questions or comments?
Go ahead, Council Gusi. Thank you, Mayor. Um, I want to start by acknowledging the intent behind the policy and I love everything that we're trying to create the safe, transparent environment in order to allow the reporting of concerns. Um, one concern slash question that I have about the way that the policy is currently structured, um, is whether this sort of conflicts with the city charter to a certain extent. I know that we're trying to have that sort of separation of powers and having the city council report to HR. Um, we may be unintentionally delegating some of the responsibilities that the charter reserves for council overall. Councelor Gudes, I'm not sure I entirely understand the conflict. I don't have a copy of the charter, but I was reading it over and one of the things in it was talking about some of the reporting policies for council and trying to have council basically within ourselves if there are any issues and concerns address that.
I don't have it. I don't have it. I'm sorry. I think this is dealing with employee who have issue with council not council member have problem with. Got it. That was my then I miss. So this is an employee having an issue with a counselor. Is that the intent of this? Then I misunderstood disregard.
So the ground rules I think is what you're thinking. So the charter authorizes the ground rules and the ground rules are what provide for the current uh process about how conflicts are handled. So council always has the ability to amend the ground rules without touching the charter. And this is separate from both of those things. and is intended to address potential issues of a city officer or an elected official. Got it. Thank you for the clarification. Certainly. Oh, councelor Robbins.
Thank you. Um my question is this this is for the reporting like we just clarified of employees or volunteers. An employee, public officer, public official or volunteer who reasonably believes can report. What about just a regular person from the public? What did they do? So, it would depend on what the the allegation was. So, um, like in the situation of the city manager, city attorney, if the allegation was a potential tort, like the city manager assaulted somebody or the city attorney assaulted somebody, um, that would be through a legal process, uh, or that would be both either through a criminal or a tort claim legal process. Um, if it was something about um, rudeness, that doesn't need an official ch channel necessarily. That would be something that anybody could come to council about. Um, so I guess it depends on what the specific charge would be. There isn't a specific process built in. It's broad enough that uh, it would depend on the specific situation.
Okay. Thank you. And for council member member of public have problem with us they can vote us out I guess. So I was more wondering like one of them one of the examples is like gross misuse of funds. So, say I took that trip to Denmark to learn about transit, right? And then somebody from the public felt that that was inappropriate, which you know, whether or not it is, would they I guess just write a letter to council or Yeah, I mean, we we they city manager and city attorney directly report to us. So, it's our responsibility too, right? So, to to make sure those uh issues are addressed. So,
right. And if it was a if it was like that example, there's always the ethics commission that would oversee those types of things. Police obviously for criminal matters, elections division for election violations. So those state entities also maintain their roles. That makes sense. Thank you.
Yeah, this this meant this is meant as a another way for city employee feel comfortable to report any concern they have about elected and and and city officers. So all right so any other question about this policy none see now let's move on to the um compensation um addendum about uh are there any more presentation or or okay so all right so uh so the the addendum was dated April 7th it talk about um assistant city manager job duty include acting as city manager but Um the three member subcommittee could award supplemental pay time of up to 40 hours uh when the acting city manager uh finish his or her duty. And then if a city employee other than assistant city manager is asked to serve in the role acting city manager then a three member subcommittee will also be able to form a subcommittee to determine out of class compensation for amount not to ex exceed 5% of employing base salary. So, any comments or questions about that particular addendum? Council person Wolf, please.
Um, thank you, Mayor. Um, yeah, my only comment, I appreciate all the work that's gone into this process, is um I do disagree somewhat on the assistant city manager's job duties, um, for I I mean, like the two weeks for being out of class. I totally understand that, but I wonder if it's an extended period. let's say it's beyond 2 months or 3 months. I do think that that um is a range that maybe requires, you know, um an additional thought on compensation. Um and because part of me feels like as acting city manager, you aren't necessarily directly managing council and managing um the department heads. So I do my opinion is I do feel that there is an added layer of responsibility and I think that it should be a while but if for the circumstance goes beyond a quarter or whatever that time is that seems justified in my opinion. So
I was going to I appreciate the the comment and the clarifying question. I'll take it as a clarifying question. Um and looking at this uh addendum, there are different sources that we were considering. Um and those are pay practices, policies, uh what current city policies we have, what is an equitable process. Um and what I would like to say is I did some math. Um I thought this might be asked but in the event that the acting um assist the assistant city manager is in the acting role as the city manager even for three months up to 40 hours of uh PTO time or that extra hours is more than a 5% um base.
Yes. Yeah. So it actually if it extends beyond that I would it would be closer to six months which would be not customary or out of the ordinary and I would like to remind you this is the council's decision and if council wanted to revisit revoke or revise it you're always welcome to do so but because the the timeline yes there is an expectation of two weeks three weeks I can understand that and if it does extend beyond two or three months it is still more advantageous to get 40 hours of PTO than it would be to get a 5% work out of class. Councelor Robbins,
thank you. Thank you. Um I do agree that um I think anyone taking the job is uh assistant or deputy city manager, you know, the job description says and serve for as a city manager when they're out. But I think typically the expectation would be out for vacation or sick leave sick leave or something with a defined end point. And so um and until very recently I think we we never really had to tackle anything like this. But when it when we have a longer period of time like council president Wolf said of 2 to 3 months or in this case even longer or something that kind of doesn't have an end, I do think that should be treated a little bit differently because I just don't think most people who accept the job of acting of assistant city manager would expect to be doing a higher level job for for kind of an undefined amount of time. Um, I I actually just sat down and done the math and 40 hours is
that's 2% of the whole year, not like 5% over 3 months. Okay. All right. So, I guess if I clarify the math from from what you just said, because one out of 52, that's 2% of the whole year. But then if you condense that to three months, I get I get the math that you I was Thank you. Never mind. Never mind. Um but I wonder if we shouldn't have the ability to say up to 40 hours for x amount of time or 80 hours for you know if it goes longer than three months.
Six months. Yeah. for six months we give two weeks or for nine months three weeks something like that where it's defined because 40 hours of PTO for two or three months is is great but 40 hours of PTO for nine months is not quite as attractive. I think
I was also going to offer that um in the past um when city manager Wine left the city uh Kathy Nland who was the assistant city manager was asked to um act as the interim city manager and when council appoints the interim city manager at that time uh compensation is usually renegotiated for that time frame or the duration of something that's longer and so that's also an option that council has when they appoint an interim city manager to renegotiate salary.
Okay. Yeah. And um that makes sense. And I guess just most recently we had this issue where we we chose not to appoint an interim and just had an acting. So then we were kind of stuck in this kind of limbo. Um the other question I have and is that since since this says that the assistancy manager job duties include acting city manager for this reason it said that oh when for the purposes of this discretionary compensation addendum when the assistant city manager serving in the role of acting city manager the acting city manager is not considered a city officer under the tiger municipal charter. So that sounds to me like then the acting city manager does not report to council because it's it's again it's like this weird limbo. And so I'm wondering who the acting city manager does report to because everyone should have a boss and the boss is gone, right? So now he's the acting boss. So who does he report to? Because it it just feels a little weird. So the acting city manager does report to city council. City council decides as you'll do tonight to ratify the delegation of authority to that person. So yeah, the city manager, the acting city manager does report directly to council,
but it's not a city officer, right? For purposes of the charter. So like the non-interference clause of the charter um some of the other things are slightly different but in terms of reporting authority that stays the council is the a supervisor
and does that contradict with the part of the the charter and our charge that we are not really supposed to deal with anybody except for the city officers. So some charters specifically address an acting city manager and put limitations on that person. Ours does not. Ours is silent on that. So there is that flexibility within the terms of the existing charter for council to to manage as it sees appropriate. Okay. Thank you, Councelor Shaw.

What I would hope if we have a consistent six-month period and um that an interim uh was defined, I don't know if that needs to be in language or just left open. I just I'm just trying to make sure that's tight on how we move forward. But I um have less of a concern. I should have done the kind of return on the two and I didn't think about that. Um but so I don't have as as big of a concern regarding the benefit of taking on that additional uh responsibility. So thank you.

I just wanted to um take a moment as one of the requesters of this agenda item to thank Director Gomez, City Attorney Raala and and you may for the collabor collaborative process in which this um my uh request was addressed. Um when I first requested the um compensation annual merit increase process last year, it was really to create roles, responsibilities, and timelines. so everyone understood what the process was and how it would work because it was pretty ambiguous beforehand. And I think um this addendum is in the spirit of that to make sure the council uh any uh acting city managers and um the public understand what the process is for adjusting compensation for city officials in this case. And um so um so right now I just would uh would like the council ask the council to rectify my action of delegating Brian Reager as a duty of acting city manager until further notice.
