Okay, great. Want to welcome everyone this evening uh both in attendance and online again to the April 13th planning commission meeting. Uh we're going to go ahead and start right off with announcements to staff. Do we have anything this evening? Uh no announcements. Okay. No presentations. Uh any agenda changes?

Um not since the revised agenda came out, but I'll just bring to everyone's attention. Um the revised agenda did uh have two actually three item changes. Of course, um some building elevations uh for Kurabas that were withdrawn by staff. it was realized that uh it was not required uh the land a landscape plan for 1601 Moa Drive uh they were not ready so they postponed and because those two dropped off we added uh building elevations uh for ARY at 222 City Circle. So we'll be hearing that tonight.

Um, so before we before I actually turn it over to staff, u just want to remind everyone this evening that uh this is not a public hearing. Um, so there will not be any public comments for this. Um it'll be a presentation by staff and then the applicant uh with commissioners then um making comments and asking questions and then finally coming up with the decision um on the item. So with that want to go ahead and turn it over to staff.

All right. Good evening commissioners, audience members. Um, just to give you a recap, this plaque came before you in a workshop uh January 6th, then was officially presented for uh your uh for a decision on March 9th. The commission chose to defer the vote until tonight's meeting due to some pending concerns, which I will review in a moment. To summarize the project, the property is located at 2011 Sumner Road. Here you go. Sumar Road comes up right here at the bottom of the uh aerial map. And then this is the zoning map over here. Uh the uh proposed development contains 58 single family residential lots that will be developed in two phases. Property is zoned R43 and has the following requirements. Uh, front setbacks 50 feet, side setbacks 15, rear setbacks 30 feet, minimum lot size of 1 acre, and a minimum floor area per dwelling unit of,500 square ft. While uh the plan presented at the March 9th meeting satisfied the zoning requirements and development standards for Peach Tree City, the commission uh requested made the following requests of the applicant. One to provide a gated entrance at Sims Road. Two, to provide a multi-use path connection around that gate. Three, provide a construction traffic management plan. Four, consider an internal path system. and five provide an existing traffic study that was prepared for a nearby commercial project for the commissioners to review. So the applicant has made some revisions based on these requests.

We'll move to the revised plan. Uh there were some internal discussions uh with city staff and they it was determined that the city would prefer to construct and maintain control of an access gate. Uh if built and the city requests that Sims Road extension be paved to meet emergency vehicle standards and the HOA would maintain ownership and grant an accessed maintenance easement to the city. uh that and there should about should be no other vehicular access to the neighborhood from Sims Road. So that has been shown here on the plat uh with a note. I believe the proposed easement is a 30 foot 30 foot uh depth of 50 believe it's a 50ft ride ofway. So the full ride ofway and 30 ft deep. Uh let's see number two. The developer has agreed to provide a multi-use path connection around that emergency gate. Three, the applicant has added notes to the plan outlining the construction management plan. It's very it's hard to read down here, but I'll read it to you. Traffic for all phases of development, all construction traffic for all phases of development and construction shall access the property from the Sumar Road entrance. Care shall be taken to notify and advise all contractors, subcontractors, visitors, etc. to use this entrance. Traffic management plans per MUTCD shall be provided as necessary.

Uh so um it'll be noted PE contractors will be notified and signage will be placed as needed. Uh four, after some internal discussions, again, city with city staff, the city prefers to make the decision about whether to construct paths if warranted in the future. The developer shall provide an access easement across the rear of lot 26 to facilitate that potential future path construction and maintenance uh on the city controlled green belts throughout the subdivision. Uh and the proper placement of that easement would be uh uh decided they would coordinate with the city engineer to determine the best location for that. Let's see where's lot 26. This one. This is lot This is lot 26. Um and these will be these green belts on either side will be uh dedicated to the city for storm water. Uh finally the existing traffic study that was mentioned at the previous meeting was supplied to staff and distributed to the commissioners for review. uh in your packet I did include some additional comments from nearby property owners that uh had come to us since the last meeting. So staff feels that the concept plat process has been followed per the ordinance and that the proposed plat satisfies the zoning requirements and development standards and is ready for a decision should the planning commission approve the conceptual plat for Bradshaw Estates. Staff recommends the following

conditions. Number one, per section 706 of the land development ordinance, all new residential developments shall connect to the city path system. The developer shall construct a multi-use path southward and parallel to Sumner Road from the neighborhood entrance to the existing path. Uh the path shall be located in a 50 foot wide green belt to be dedicated to the city for future maintenance of the path. The developer shall coordinate with the city engineer to determine the best location for that path. Number two, the developer shall construct a multi-use path through green belt number two, which is down here near the entrance on the east side of the entrance road separate from vehicular and create a crossing separate from the vehicular traffic to the opposite side of Sumar Road. And that crossing shall connect to the path that will be constructed southward along Summer Road. So this way any any cart path traffic that would be on the road here would jump off the road into the green belt on a path and have a separate crossing point from the vehicular access. Number three, developers shall provide a multi-use path easement a minimum of 20 feet wide across the rear of lot 26 for the potential development of a future multi-use path. The developer shall coordinate with the city engineer to determine the best location for this easement. And again, we talked about lot 26 over here. Number four, the neighborhood homeowners association shall retain ownership of the section of Sims Road on the north end of the subdivision and grant an access maintenance easement to the city for the construction and maintenance of

an emergency access gate. And number five, the developer shall construct a multi-use path around the emergency access gate at the north end of the subdivision to connect the development to Atoria Lane. Good evening. Rick Lindsay uh represent Chad Wick Holmes. This is as the planning commission knows a continuation of the presentation that we had a month a little over a month ago. Um, as Laura said, and she said it, I think very clearly, uh, the planning commission when they made a motion to defer this item, um, had four things that they wanted from the from the applicant, uh, the gate at Sims Road, which Laura has discussed, um, the cart path connection around the gate, the construction management plan, the multi-use paths uh within the development, and sending a copy of that traffic study that was for the commercial development that's nearby this location. The client and city staff, including the city manager and city attorney, did meet and discuss the remaining items. Um, and as Laura said, the gate at Sims Road, the the applicant agrees with with the proposal. And what's going to happen there, it'll just be a kind of a narrow uh stretch of Sims Road that will remain private, and that's where the gate will go over. Uh, that will remain uh property of the HOA. uh the HOA will grant or the developer will grant an easement permanent easement to the city for the uh construction, erection and maintenance of that gate. The gate will only be accessible by first responders. Uh and so the city will maintain control of that. Uh but the property over which it'll um be located will be owned by the HOA and that's just to comply with city ordinances dealing with gated uh communities. So that'll stop any through traffic, vehicular traffic. Uh the uh city had requested as did the planning commission that we have a multi-use or cart path around uh the gate. That is perfectly fine. Uh with with the uh with

the applicant. So that'll be constructed um and we will have access that way for car paths and for bicycles and people walking. uh the construction management plan. That's fine, but really it's not needed anymore. We we have it on the um on the conceptual site plan and we'll certainly put the notices out there, but now since there's only a connection to Sumar Road, uh not going to have any construction vehicles that will be able to access this location through uh through Historial Lane or Sims Road, but we'll still comply with the construction management plan. that's kind of like belts and and suspenders on that. Um the we did have discussions with the uh staff dealing with the internal multi-use path. Um there are a couple of easements that are here for uh the green belt and then the green belts themselves. And uh if uh if the city uh desires to construct internal uh car paths down the road, they'll have the ability to do that. The one easement that was discussed by Laura is on lot 26 which again is over there at the end of that one culde-sac. Um the exact location as Laura said will be determined in in conjunction with the city engineer where to place that if if the internal path is ever uh requested by the city. Uh there is the cart path that is with green belt number two which is the uh next to the entrance on Sumar Road, but as the city wants to do now is to pull cart path traffic off of the vehicular traffic. So it'll be a little bit to the east and then the uh the applicant has agreed to construct about a thousand feet of car path to get the uh connect this uh this development with the existing car path which is south on

on some road. Um Laura, the only thing that I'm not sure of in the conditions you have that the 50 foot wide green belt to be dedicated. We believe it's already been dedicated. We're not certain about that, but we believe it's already the green belt's already city property, but we will construct the um the cart path whenever if the city doesn't own it yet when it does own it. So that's not a problem. But it just said to be dedicated and we weren't sure of the status of that. So the has u complied with all the requests of the planning commission made at the last meeting uh and I believe has satisfied all the conditions and and uh again discussed this fully with staff and for that we'd ask that the site plan be approved tonight. Okay, commissioners, we're going to go ahead and start off with questions um for staff or the applicant and once we go through all the commissioners with questions, then we'll come up back around for any comments. So, Commissioner Gant like to start with you. I just have one question regarding the the cart path uh that will be connected at SA road and the new road to be constructed. Um it's going to connect to existing golf cart path. Is that correct? Where is that located?

Shoot. I don't have I don't have it zoomed out enough, but it's it's way down Sar Road about as he said about a thousand feet south on Sar Road. And so the developer will build a path all the way to that connection. Is that what I understand? Yeah, if you go past the the neighborhood that's prior to to getting to that intersection at Sumar Road, it will go past that and then there's a connection just I don't know how far past that neighborhood um off of Sar Road. Yes. South of Smoke R Corners.

Um, for city staff, uh, are there any concerns about having the necessary funds to construct the multi-use paths if the city in the future deems it appropriate to do so? I wouldn't think so. So, we have right now over four million in impact fees for path for specifically for paths, not just police. So, we have construction and maintenance.

Yes. Well, so we have three separate funds and impact fees for fire, police, and PASS. PASS is the biggest one. It has over four million in it right now, which can only be used to construct new paths. That's all it can be used for. Um, so that's what it would be used for. Maintenance would go into our SPLO maintenance that we kind of do every year. Um so it would be rolled in maintenance over five to 10 years would be rolled into a SWAT but new construction would be out of impact fees. Is are any of those fees that are currently there allocated for other construction or is that to be allocated that 4 million?

Yeah, sure. Some is. Some is. So we're building we're about to build a path down Sar Road right now. Um we are in the property acquisition phase of that. Uh I think we're about to build one to connect the rest of Holly Grove Road uh to the commercial area. Uh we've used some of the funds to uh construct the path to the Mill Farm Mill Farm subdivision. Uh and we also used it to construct the path to get to the new Booth Middle School. Um but those are done. The only two right now that are taking up any of those funds are the Sumar Road path and the Holly Grove path.

Great. Great. Um next question for the applicant. Um, do you agree to all of the city conditions that are outlined in the in the staff proposal today? Yes. All right. Thank you. Okay. No further questions right now. Okay. Thank you, Commissioner Chris. Commissioner Halverson, questions. My question is for the city engineer. Um, um, for sequencing because is my understanding correct that the city would construct and own the gate? Yes, that is. So the HOA owns the road, the city owns the gate and would install the gate. Is that correct? The question is when would that gate be installed?

It most likely be installed say because you're going to go south to north. So if they're building the Sims Road connection last, we would probably come in behind them and put it up then. Um, and it would pro most likely be a pretty simple gate. Uh, from our operational standpoint, it wouldn't be powered electricity or anything like that, right? It would probably be similar to the gate we have at Crab Apple in Ketron Hills.

Not that I have any influence over this, but my recommendation would be when the road gets cut in, whenever that gets connected up there to put the gate in at that point to limit any accidental Yeah. flow through. And we would actually we would construct it inhouse. We did the crab apple one in house. Great. Um if you get more complicated with electricity and all that, we'd have to contract it out. But for what we're doing, we can do it in house. Okay. And this would be done in phase two as well, not in phase one because it won't go across the creek.

Yep. Just one question uh for city staff. It's my understanding that this would be kind of the second gate within our community that would be like this in terms of and I'm thinking about the Plantara Ridge uh gate. Um, have there been any consciate that should we should be aware about uh should be aware about and how could they apply to this situation? Trying to give you a good answer. That situation is a little different because what ended up happening with that road is the council decided uh under advisement of the attorney to sell that portion of road to them. um and the gate is theirs. So, um kind of like this situation, it would it would stay a private road and they sold that piece to Planter. Plantara built their own gate. The city would build their gate here. Um any lessons learned? I just I think it's kind of different. Even though it's similar, I think it's kind of different because you're talking about a gate that came about after the fact

and then a gate that would be there from the very beginning. And so I don't think people would have to change any habits or Planter to me was just different uh on Kelly there because people had to change habits, we had to post signage, we had to post, you know, notifications, stuff like that about traffic patterns. I don't think we would have to do any of that here. Um, no, I it it is kind of a similar situation. I get that, but I don't think from a from a learning standpoint, it's it's similar. Got it. So there's no major reservations from a city standpoint about the gate.

Um I will say from a staff standpoint I think you know we connectivity like staff we do like connectivity. Um so there's that whole thing but as far as the planning commission and what residents want and that kind of stuff is is beyond our control. Sure. Yeah. Okay. So, I think on staff we could see the benefit of not having a gate there, but um we I see for for me as a manager, I see both sides. And so, if a gate is going there, I don't think it's going to disrupt anything because nothing's there right now. So, people already can't go that way. So, I don't think it really changes anything.

Great. Quick followup there if you don't mind, Mr. Chair. Um, absolutely. So, so if it's not going to be a powered gate, who's going to be allowed through besides, you know, emergency services? No one. No one. Okay. So, it's really just it's a closed off road except for golf carts. We would have keys. So, with similar situation of Kedron Hills, Crab Apple is kind of a swing gate. We've got locks on it. The only people who have keys are city staff and county staff also has keys because it's on the border. Um, with this situation with it only being in the city, city staff would be the only people that have keys. Got it. Okay. Actually, one more question. Absolutely. Go ahead.

So, again, this is a second gate. Again, acknowledging it's different from Antara, but does establish does this establish any sort of precedent or anything else that could impact the greater community that you'd be concerned about? No. Okay. No. every and and Ted's not here, our city attorney, but he would tell you and he always advises council of this. Every situation, every case that comes before you all council is different like you know everything has specific differences with it and so no president's not established. All right, that's it.

Okay, good. And and I do have to say that the the questions you we've we've debated this and talked about this quite a bit and had a lot of questions. So the questions that that I had were were asked by my counterparts on on the commission. So um Commissioner Hammer, I'm going to go ahead and go back to you for comments if Sure. Yeah.

Yeah. So uh I know this has been a long road to get to this point. Uh I just want to acknowledge uh both sides of this. I think that you know everybody has compromised in a really great way to make this uh plan ultimately I think address most of everybody's concerns. I don't think either side is ever going to be 100% happy with all of this, but I mean, you know, like I said just a moment ago, this is the second type of gate uh within our community like this, and that's rare uh for that. So, I think, you know, that's something to take away from all this in terms of what you're able to accomplish on this. Obviously, the developer uh as well, you guys have been very accommodating on all this. So, you guys absolutely deserve credit for that as well. Um, I guess I would just say just to wrap up my comments is again, you know, obviously you guys and in this neighborhood are incredibly well organized across a number of things over the past few years and that's a huge credit to you guys in terms of you know voicing your opinions about uh, you know, the way not just your community is but the way how city should operate on this. Uh, definitely stay involved even if it's not directly related to your community on this. I think again having more voices within our community to share ideas and opinions is really crucial on this. So, you know, come back come back to these meetings even if it's just about uh a landscape plan or whatever. You know, keep showing up. Those are real exciting conversations. Trust me. That's all I got.

Uh like I said in the first meeting, this is a difficult site um with a lot of opinions and um actions that were facilitated by the city which we appreciate. Um, I think the, um, developer has compromised to the best of their ability and the city has also worked with them to get where we needed to get to. And, um, that's that's all I have to say. Yeah, I just want to echo Ken. Um, thanks to our neighbors for for for speaking up and for voicing their concerns with this. I think this is a wonderful example of how we can get compromise uh for a good result. Um I would have liked to see phase three. I know there was a design at some point. Um would have loved to see what that was potentially going to look like, but I understand that that's just not in the mix today. I do want to commend city staff for for really hearing our our concerns and and really working hard with the developer to to figure out compromises. and I'm excited about the potential for the future development for multi-use paths to take some some congestion off of the roads uh for this new area. So, yeah, overall I think it's going to be a nice addition to the city.

I want to just commend the citizens, the neighborhood people that stood up and voiced their concerns. very much appreciated from this pitch that you've done that. And then for the developer, thank you for bending. Thank you for listening. I think you showed a great amount of concern for what the citizens actually wanted to see done. So, thank you very much for that staff. Thank you for all your help.

Thank you, Commissioner. And and I, too, I'm going to echo the comments by my fellow commissioners. Um you know when when we get into difficult situations um you know we we need to understand that you know there are both sides who who are very passionate um you know about whether it's the development or whether it's their their homes. Um and it is one thing to take into consideration that like most things we we can't get everything that we we want or or like um but we do come to a point of compromise. Um, and in this situation, um, you know, we are at that that point of compromise and and I do want to thank the residents for for all of their letters and emails coming to the meetings, um, multiple times. Um, and thank you for that. Want to thank the applicant um, and their representatives uh, for being open to to the suggestions, recommendations, and working with with city staff. Uh, and I want to thank city staff for all the hard work that they've done. um you know the discussions they've had u the feedback that they've provided not only to to the residents the applicant but also the the planning commission. Uh we we do thank you very much for that. You know when you think about it this is probably probably one of the last if not the last um residential development areas in in the city. Um this is it. Uh we have maybe one or two commercial may maybe three most um commercial properties remaining in the city. Um we are we are built out. Um so we're not going to be seeing new development like this. What we will be seeing is what I've been calling for the last several years uh revitalization of of existing properties whether they be commercial um or residential. Um, and I think probably a lot of us driving on on Route 54 um

have seen the the newer style home um going up just past the lake um and and look at that as is revitalization of of existing residences um you know in the city and I do expect we'll be seeing a lot more of that as as we go forward. So um this like I said this is this is pretty much it for residential. So again, thanks to everyone for for all of their work and all their understanding. Okay, so um look at my fellow commissioners. I'll move to approve the concept plat for Bradshaw Estates 2011 Sumar Road uh as presented by staff with all conditions represented as recommendations in the inter office memo. Okay. Any other discussion questions from the commissioners? No. Okay. So all those in favor of approving concept plant Bradshaw Estates 201 with the five conditions outlined by staff signify by stating yes. Yes. Yes.

Okay. The concept plat Bradshaw Estates 201 is approved with the conditions as submitted. Okay. Okay. Um, as staff said, we had two agenda. Excuse me. I apologize for that. My paper just happened to have a mind of its own. Um, so we did have uh two original on the new agenda. Those have been uh one postponed and one withdrawn. So we have remaining the building elevation modifications area 222 city circle. And I'm going to turn that back over to staff.

Thank you. So, uh, the permit expediter for a new tenant to be located in the avenue at 222 City Circle has submitted a proposion proposal for some modifications to the exterior of their tenant space. The new space will be located in the former Jos a Bank Cloers if you remember that space. Of course, the property is located in a limited use commercial district number 13 and it's also in the Georgia 54 overlay district. Talk more about that in just a minute. So, here's a an image of the existing facade. The sign is no longer there, but uh it is unpainted red brick with a green awning. And then the proposal for modification and a representation of it is seen here. the field color they are proposing it's a winter white but they're proposing to apply a an acrylic based product that is tel applied and it's supposed to emulate natural stone uh the product is called stow signature stone uh an accent color of green field by Sherwin Williams which is a dill green here's these uh two colors right here and then the storefront glazing a pre-finished white aluminum, the storefront awning to be replaced with a a striped sunrella awning of green and white striped. And then proposed hardware is brass br with a brushed brass finish seen up here for their door hardware.

uh please disregard the signage that will be approved in a separate permitting process reviewed by staff. So to continue the um the space as I mentioned is in the highway 54 corridor overlay district uh which is subject to the design guidelines for Georgia 54 west and I will go through some of the things in that uh in those guidelines that would apply to this proposal. Uh the the design guidelines for the overlay district describe two different styles. A traditional style and what we called when we went through some of you on the panel were uh part of that revamp of the of the overlay district, we included an updated 2020 style it was called. So, one of the one of the guidelines in that 2020 style states that building design shall exhibit a sense of permanence and creative expression to create a combination of unique facades that express retail brands while utilizing materials and accents to create a thread of consistency. And how this proposal would apply is the the you can see that the storefront does express the retail brand identity while maintaining a portion of that original brick facade that is consistent throughout the retail center. Uh section 4B.4 four of the gaz of the guidelines establishes requirements for accent colors stating that no more than 15% of the total area of any single facade uh should be an accent color. There's very limited area for this proposed dill color. And it's very hard to see on this

picture, but it it's going to be right here on the sides around the frame of this white area. And then I believe it's right over top of the door frame on a little panel. So very, very limited space for the accent color. Another section shows possible material swatch swatches. And while the Stow signature finish is not among them, other materials may be approved. So the acrylic base faux finish that emulates the stone resembles uh white concrete or stucco materials that are shown in those material swatches. I'm afraid I didn't include those. I apologize. And finally uh another section states that canopies or and or awning should be canvas, wood, metal or similar material uh and in no case should be internally illuminated. So the awning proposed is canvas and no internal illumination is proposed. So that meets that requirement. Of course in addition we have the design guidelines from the land development ordinance and I'll mention some that apply to this request. Uh section 725 establishes goals for architectural design which includes compatibility with surrounding development as well as architectural innovation. Uh the proposal meets meets that requirement uh by it is a unique design. It expresses the brand identity of the retail tenant. Uh section 728 through 730 establish color requirements which state colors should be neutral or earth tones and high intensity colors metallic black or fluorescent should not be used. the winter white of this acrylic based finish. Uh winter white tends to be a neutral off-white hue having undertones of ivory, cream, or soft gray, which would make this color similar to other

storefronts that have been approved in the shopping center uh that have been painted brick with neutral whites. And I do have some slides of uh some other some other tenant spaces in the avenue. This is Souls uh on the corner just down the way from this uh tenant space that we're looking at this evening. Hobnob of course is right across the across the way from Souls uh white black market has a light color and this I don't even say that. O this OVME uh storefront also has a whitish whitish color.
