We have one case before us today. DP 2024-14 represented by Steve Sizzen. Cosmo Midnight Stables 1480 North 500 East Michigan City, Indiana 46360 in Pine Township. Zoning is A1 Agricultural. Today's request is a development plan approval from the BRC from the construction of new stable and associated uses prepared before this board and various other boards to get zoning and variances. So hopefully this is your last step. So, why don't you uh introduce yourselves and ask what you're here for for today? My name is Steve Som. I live at 4354 West 500 North 750 right 750 north in Michigan City. Uh we're looking to build and develop a uh stable in town. Um my name is Cali. 435457. And they recap for the DRC members uh information. Um I think the last appeared you got a special use exception. The the last appearance we get from the commissioners. We got a uh a special exception to have living quarters um and live at the stable which was limited to family members. Limited to family members, no renting. Um, it's just going to be just the family running the the establishment. So, and we're going to stay there on site. Very good.
So, we'll go around David. Uh, yes. Uh, the applicant was represented by Paul PLI who uh we went through a three-year review process uh prior to them receiving that informance letter on October 18th, 2024 written by myself. the um there were some it was an appearive inform letter. So there were some outstanding issues that needed to be addressed which have since been uh addressed with another resident both digital and hard copies uh that were received by our department on November 8th, 2024. So all prior uh comments related to the storm counts have been resolved are now resolved. Anything else? No sir. Yeah. Um, yeah, they've, uh, got inspect from the state. They've already done their plan, their site plan. We've already reviewed it, very issued permit on it. Um, just a reminder. I mean, I don't know if you have someone lined up to accept it yet or anything. Um, but, you know, that'll have to be installed once the weather is better. You can't put it in when the ground is frozen. You can't put it in when it's wet. So, it's got to dry out and everything. So, just as a reminder, um, but if you're going to get someone lined up to install it, um, this year is probably the time to like start talking to people and getting bids. Oh, yeah. We've got we've gotten two bids. Okay. Um, and still looking for a couple more just to see they're all Yeah. I mean, that's that's uh Yeah, just just as a reminder, you know, they'll have to wait until the weather's better, but um cuz I know you haven't been wanting to get going on this. They submit through you then. I mean, so what they'll do is once you've hired someone, they'll con, you know, and that's what you that's who you're going to go with. They'll start the job when the weather's right and then they'll call us for inspections. So, okay. All right. All right. That's all I have.

Um so the only item that I saw was um for the use of this property I think that a commercial turning radius on the drive by approach would be appropriate. The uh vehicles that are be swimming those trailers that 10t radius on there is a little shy for that and they're be going over the possibly driving over the cul. So I think expanding that driveway at the roadway edge to accommodate a width wise you mean? So the width would increase because the radius turns I think on our driveway sorry but I think on our driveway permit um I initially had it at 24T wide at the road in so far. Um probably we're planning on putting an electric gate up um to control the people coming in and out of the property. Um from from the road I'm hoping I I I thought that the permit it was from the road to the gate we wanted 24 ft um to be able to turn in and out with a large trailer. Okay. And also farm equipment cuz we're going to have uh I have somebody else do our hay. So they need they need 24 foot at the road to get their equipment in. So what I'm saying is with the swing of a trailer coming in coming in, it's not so much the width. It's more that radius that tapers out from the width of the back. So do you already have a trailer permit for this? I do. Okay. I do. But I mean if we need to adjust anything like the last thing I want is a trailer. Yeah. Okay. Um I'll I'll deal with you then. Um the waste management plan we have we're going to put a slab up um behind manure management or like trashure management. You want to you know that um we're going to compost. It'll be three bays. Um there's a slab. There's like a small square um behind the hay barn. Um but concrete fl with um concrete walls and compost and turn it with the gear and then once it fully compost it spread it on either the pastures. And then it's I think Dan you answered this one said was has the central field been reviewed by the state for this commercial site subsurface drain drain be required. I believe there is subsurface drain and we reviewed it and we've issued a permit on it. So it all the rules and stuff for for that.
And then you said where will last I'm assuming you're I mean I I don't recall off the top of my head exactly where but it's on the plan. Um I believe it's going off into a past year of property or whatever. And then um Martin I think you address this. He said his question specifically was was there a commitment to make a twocar wide ride for at least 50 ft from the county road backing up traffic and I think the rule was that from the edge of the road to the rightway line for the loop and you're comfortable with that. Um assuming that's what's was in the front, right? What was do you remember the Let me take a look. I I remember when we initially when I when I was looking at a I wanted to go like 30 ft wide and I want to say on the permit they said as wide as I can go with the actual driveway was 24T wide. I mean, I'll go as wide as the road and my plan is to go with with gravel or whatever my driveway so wide and then have sorry and then have uh if the culver's 40t wide then I was going to put grass you know plant next to it to to make it as wide this way if anybody did pull off the driveway a little bit they didn't go straight into the ditch. Okay. Um, but I mean like I said, we can I can work with you and whatever you want to research that whatever with they would they'll let me have I'll go as white as I can at the road to be honest. Were you uh the one that submitted the permit under your name? Okay. Well, he's looking that up. Couple other questions. Um Kevin's asking a question. I think it's more like events. they do schooling. Um and I don't know, like I said, when people hear like a horse show, they think of like a rodeo and that's that's not your bed is relatively small. They're they're usually very they're small schooly shows. They're never it's no more than like six people or so other than family. I mean, we're talking maybe five or more years down the road before we even consider looking at the past. But something used to show more commercial. Please come back. Um, you're saying they didn't allow you to go up to 24. When I was reading the permit, I think it said that this as wide as you can go was was I want to say 24 ft at the road at the road or at the right way. I maybe said at the right way probably at the right way. I think the max for this use which would be adequate that would accommodate two two passing at the rightway line. The only thing that I would want is increasing that radius to widen and allow for the turning radius on the trailer that wheel path to track in um out. Was was he was Kevin asking about a pull off lane or he was saying something about making sure it's adequate with a certain distance away from the road. Kevin there would be a lot of traffic
because our goal is to have it as wide as we can for two to pass up to the gate. So if somebody's sitting at the gate, somebody can come out before somebody else goes in if that were happen. I mean, like I said, it's not nearly as busy as people envision, but um when it does happen, I want I want to be able to have two of them pass the road for sure all the way back to our electric, which will be set back beyond beyond 50 ft, I'm sure. Martin, if you're comfortable with that, if you like to make the motion and put your stipulation in there for a second. Yeah, I would like to make that motion that um you allow stacking distance under for two vehicles to be accommodated um adjacent to each other behind the gate at whatever distance that would be. So I think ended at So on the side of the gate, you mean or on the road side? So from the edge of roadway to up to the gate to accommodate two vehicles wide by trailers. So the looking at the standard uh trailers it looks like 50 ft would be adequate. [Music] Yeah would be adequate. So 50 ft wide from right away. Not wide. 50 foot in 50 foot in at least 24T wide. I mean correct. Okay. And then that's that's what we're planning anyway. So you want to add the radiuses to that and with a minimum 20 foot uh radius on those on those approaches. Just it's on the record. We gave the demon of dedication. My wife was just wondering who who now that we gave this demon dedication of 40 foot um on both sides of the property. Who who I mean we're I still kind of taking care of the the cutting and all that but as far as the ditches are concerned is that now definitely fall with the county. So you saying you dedicated right away? We had we had to give a deedation right away 40 foot on all frontage road. Okay. So that that falls and then of course the ditches fall into that. So does that mean that the county now wants the ditches? So I wouldn't have a before. So within that right area, the the county does have rights to maintain that. Um that doesn't mean they have to meet a certain aesthetic standard that you No, I mean as far as keeping drains going through there, if there's any drainage concerns, that would be going to highway department and take care of those. And then I know literally our first meeting three years ago, the one complaint people had about our property was the on the property on 1500. It floods. Well, there's a wetland literally like certified
wetland. The front of my property, I think it's like 4 acres wide. Can they do anything or I mean that was the one complaint is the water come over 1500, but I mean there was literally a wetland. Nothing disturbed. I'm not further. I can't say what needs to happen, but people were like the you know that everybody complained about that property that was there at the initial meeting when we were getting it reszone. If there's a if there's a regulated drain nearby, you can go to the storm water and register with that. If there's not, if it's just flooding in the roadway, you can come straight to the highway department. I'll let go that and then I'll be evaluated for any various concerns. Okay, perfect.
