Okay. Okie dokie. Welcome to the August 26, 2026 Planning Commission meeting. First item on the agenda tonight is roll call. Judy.

Current copy of the Opens Meeting Act of the State of Nebraska is available in the back of the room in that black binder. You're welcome to refer to it at any time. Item number two on the agenda is approval of the minutes of the meeting held July 28, 2026. I trust you've all studied them intently, as I know you always do. Motion by Bain, seconded by Whirl to approve the minutes as presented. Any discussion on that matter? Michelle, please. Somebody got your little doodads. And the minutes are approved as presented. Item number three, file number SU26-016, discuss and consider action on an application by the City of North Platte for Industrial Park Subdivision 10th Re-Platte located south of East Francis Street between Devco Avenue and Bicentennial Avenue and described as Block 4, Lot 2, Industrial Park, 6th Replat of Block 5, Lot 2, Industrial Park, 6th Replat and Lot 3, Industrial Park, 3rd Subdivision, North Platte, Lincoln County, Nebraska. Judy.
Okay, and you should have all received a copy of the review comments attached to that as a preliminary and final flat. Um, the subdivision will reconfigure to existing lots and create 5 additional lots. The lots will have access to city water and sewer and planning staff has no objections to the subdivision. essentially this is where the new East Francis is going through between Devco and Bicentennial the lots are city-owned lots so the two lots on the north it would be the Northeast so right-hand side those will have a portion of a little bit added to that from the north side of that street and then also What else is interesting in here? We put some easements in there to make sure that the lots on the south side had street access. If you have any questions, I'm happy to help. Again, these are city-owned lots.
And they're extending the industrial park?
Yeah. As far as, is it part of the industrial park? Yes. Right now it's zoned like a, no, we zoned all of that PR3, I believe. Nope, it is zoned, no. It is zoned PR3. That way you can do the smaller size lots, but these are pretty decent size lots anyway. But right now it's zoned PR3.
Was that is that Francis that basically goes right through the middle of that right there?
Yes.
Okay. And then access to those back areas would be from an easement through those easements that are going straight north and south. Yeah. All right.
Um, I would just note to, um, there is a redevelopment plan that's in place that covers this property. And so, um, That was partially what we were going for with the subdivision as well was to kind of mirror some of the planned redevelopment of this area. So that's where some of the north south easements kind of near what the proposed roads would be the developer would put in there okay.

I move to make a recommendation to approve file number SU 26-016, preliminary and final approval of Industrial Park 10-3 plat.

Item number four discussion, consider action to vacate Cody Avenue between West rodeo road and West 13th street located between 2401 and 2405 rodeo road. Judy.
Okay and again you should have all received a copy of the review comments attached to that is a city street map showing the street and then a request by one of the property owners and then a couple of site plans location maps that were provided by the property owner. City of North Platte will retain a 10-foot utility easement on the east side if that vacation of the street is approved. Planning staff has no objection to the street vacation. Cody Avenue is an unimproved street that runs between Rodeo Road and 13th Street with no other street connection. Cody Avenue extending north of 13th Street was vacated years ago. so there's really no interconnection purpose of that road um and if you look at kind of the aerial photograph you can pretty much see that there really isn't a road in there on paper there's a road but in reality there's not The neighboring property owner to the east that abuts this was actually in my office today. He said he has no problem with it. Okay. Because he gets his half. That's what he said.

So our plan there is to keep the billboard as long as. It's not being maintained by us is kind of my idea to that whoever's currently maintaining it. We hope. Continues to maintain it, but it falls right in line with the spirit of Buffalo bill. The apartments are going to be named Buffalo bills hideaway. So it's kind of cool to have. The Nebraska land days theme always right there on those billboards or plat native. I've always looked at them. They're cool. So. We'd like to keep them. We would benefit basically in the vacation by moving our garages to the property line and keeping the land that we would gain for a green space. So basically no changes, just for ASTMO. But yep, I think that's kind of where we're going.

Well, that's a great question.
Um, that is a great question.
In my previous life, I did a lot of research on that subject because Nebraska Land Days is displayed on one of the two halves. The Lincoln County Historical Museum owns the other half. I'm not sure anybody really knows who owns it, but Nebraska Land Days and the museum have kind of shared maintenance of that structure throughout its existence. And I believe now they're currently... Uh, wrapping that with rather than. Putting painted billboards up there, which fade over time. You can change a wrap fairly simply. And I think actually the didn't you guys donate your portion for dusty's pumpkin patch this year? To kind of help promote that as well. So it gets used for a lot of community tourist benefit out in that corridor. Does that answer your question adequately?

Bob, do you have any other Intel on that? I. Yeah, I did a lot of research on this thing about five years ago.
So it is being maintained. Yes.
Yeah, it's being maintained. And I believe the museum likes their spot on it as well. I wouldn't speak for Jim, but I think I think they see benefit in it. And I think the festival sees benefit in it. And certainly I think Dusty sees benefit in it as well.

Yeah, so generally speaking, when a new wrap gets put on, whoever orders the wrap is responsible for the cost of the wrap, they're responsible for the installation of it, and they're responsible for the backing that is maintained to make sure it looks nice. Any other questions?

File number CU26-006, discussion, consider action on application by North Platte Opportunity Center for a conditional use permit to allow for an office space for the North Platte Opportunity Center in an R3 dwelling district located at 1205 South Tabor Avenue on property described as Lot 1, Opportunity Subdivision, North Platte, Lincoln County, Nebraska. Judy.
Okay, and you should have all received a copy of the review comments attached to that as the justification, a site plan, and then a couple of location maps, um, 1, showing the general location and the other 1, um, showing the zoning in the area. As stated, the applicant is requesting to use this property as office space for the North flat opportunity center to provide services to individuals that are developmentally disabled. No new buildings will be required and the area does have similar uses. Planning staff has no objections to the conditional use application. The area has a mixture of commercial and higher density residential properties. Any traffic increase will not be a detriment to the surrounding property owners. I do believe the applicant is in the audience. If you have any questions for them or I would be glad to help also.

They're just going to essentially turn it into office space versus a residential property. If you look on the zoning map, you can kind of see, you know, definitely a lot of multifamily residential uses over there. We did approve right there on that Linda Court just to the north just recently a conditional use for Lutheran Family Services to do kind of a similar thing, kind of more of a office and clinic type thing. So
and that's on on this map would be on six correct right there to the east of it number up north number three okay all right yeah i couldn't remember if that was on six or three yeah three got it but the character of what's going on right in that neighborhood yeah
No, were you about to start that you go ahead that we find the request for conditional use permit to allow an office space for North opportunity center located at 1205 South Tabor Avenue meets the minimum standards stated in the North flat code of ordinances section 156.322 and approve the grant and the conditional. Use permit requested with the condition that all elements of the application are applied with. Based on the following factual findings, I have to read all those 1, you shall conform to all applicable ordinances, laws and regulations of any governmental jurisdiction to the, you shall have adequate water sewer and drainage facilities. 3, ingress and egress shall be so designated as to minimize traffic congestion and the public in the public streets. 4. The use shall, in all other respects, conform to the applicable regulations of the district in which it is located. 5. The use shall be in harmony with the character of the area and the most appropriate use of the land.

Item number six, is it also a public hearing? File number Z26-008, discuss and consider action on application by Robert and Sally Forbes to rezone certain lands from an R3 dwelling district to a B1 neighborhood commercial district located at 820 South Walnut on property described as Lot 1, Shannon Administrative Subdivision, North Platte Link County, Nebraska. Judy.
and again you should have all received a copy of the review comments attached to that is the justification a zoning map showing the area and then a site plan um so as stated by the applicant they would like to rezone this property to be used for a site for possibly three future business businesses such as an office space or small boutique There is a lot of development occurring on East Francis and East Phillip, and this property will be improved and will create 3 more spaces for the community to grow. No new structures are anticipated. The current structure will simply be repurposed. Um, planning staff has no objections to the rezoning. The property is surrounded by commercial properties and is currently being used as a daycare facility. Um, be 1 neighborhood commercial district is the least intensive commercial district and office space would be a great fit for this location. There are no, there is no anticipated increase in traffic. This is a high traffic area and can easily support any additional traffic. Um, and in case anyone is asking, um, a daycare would still be allowed in that district. So.

Um, so it was a conditional use permit when we 1st started, um, when they changed it to a, a child care center. So they did a conditional use permit versus rezoning. Um, but now. Possible new owner, so yeah, they just thought they would rezone it just in case. wanted to have something future in there and that just seemed like the best fit to be one because b1 allows the current use which is there and that would give them some flexibility for something else in the future sounds good makes sense looks yeah at this point

File number Z26-009, discuss and consider action on an application by Randy and Cheryl Betger to rezone certain land from an R3 dwelling district to a B2 highway commercial district located at 820 and 818 South Bailey Avenue on property described as Lots 1 and 2, Block 13, Taylor's Addition to North Platte Lincoln County, Nebraska. Judy.
Okay, and you should have all received a copy of the review comments. Attached to that is... zoning map the justification and a site plan as stated by the applicant that would like to rezone this property to allow construction of a new commercial business the existing structure will be taken down and a new car wash building will be constructed traffic will increase from a motel to an express car wash but should not negatively affect the neighboring properties Tommy's Express automated car wash will be a great replacement for an older motel and will be a great service for the community of North Platte. Neighboring properties are zoned commercial and the business will work well with surrounding businesses. Tommy's Express offers state-of-the-art technology that allows us to wash cars extremely fast and efficiently and can serve over 150 cars per hour. The project will be a great redevelopment opportunity to continue to update commercial corridor along Dewey Street. Planning staff has no objections to the rezoning. The property is surrounded by commercial properties, and this property is under the same ownership as the existing commercially zoned property to the west. Dewey Street and East Phillip are high traffic areas. The increased traffic should not be a detriment to surrounding properties, and the proposed redevelopment will be an improvement to the area. If you look at the zoning map on that second page, just right across the alley to the west so right to the left of this parcel that's going to be rezoned or is proposed to be rezoned they own those lots also it's under the same ownership so um what the intent is is to possibly vacate that alley and do a lot consolidation and then do the construction um we do have the applicant on teams And we do have several in the audience, it looks like.

Hi, Ben Conover, 2403 Timber Meadows Lane in Norfolk, Nebraska. I have Matt Preister, my business partner, and then Tanner Branch, who's on our development team, is on the call as well. But no, we have four of the other territories in Nebraska, namely Columbus, Norfolk, Grand Island, and Kearney. So we wash a lot of North Platte cars, mostly in Kearney and Grand Island. But yeah, excited to be part of the North Platte community. It's just kind of a different deal. It's hard to imagine. I know us getting into the car wash industry, imagine 150 to 200 cars an hour going through these. Every 20 seconds, we can wash a car. So the stacking is very good. The flow is excellent. I think we're on a state highway for every territory we have. So Columbus is on a state highway. Norfolk, Grand Island, Kearney are all on state highways. So I know Tanner's been instrumental in working with the Nebraska DOT being on the state highway and the access and everything too. Yeah, excited to be part of North Platte and happy to answer any questions you have.

Well, I was going to ask, how many cars do you feel like will go through it daily based on your...
Mayor Mrakas, So grand islands are busiest location i'm if I had to make an educated guess i'm going to say it's probably going to be similar to what we have in North working carny which would probably be about 800 a day. Mayor Mrakas, You know, on peak days, you know, which would be your your nice days after after a snowstorm you know, probably upwards of like we had a few days in North work that we did 1500 cars.
Okay, so will traffic. Go back on Philip here. We'll traffic back up until it possibly or I won't back up on Philip.
So, um, inside of our stack and again, it's. If anybody's been through our carny or grand island locations, or if you're in town, stop by and stop by and say, Ben said, we could have a free car wash, but incarnate as an example, I'll use that just because it's probably the most familiar to the folks in the room. Um, we have, you know, 3 pay lanes. Left to pay lanes here in North flat, you know, even if we're doing 1500 cars a day, 1200 cars a day, never very seldom ever do we have more than 2 or 3 cars in line. So, um, the only time we, we may get close to the street would be like, our 1st week or 2 open because we watch cars for free. And it's really easy to sell free car washes. Um, and also the, the, the people in the community are getting used to the car wash and we're very, you know, very gentle and we're loading far apart, you know, versus grant Allen, where they're loading 2 feet apart just because everybody's trained. So that first month will be a little challenging but after that it's Even thinking back to the North Fork. I don't think any time in the last two and a half years We've had it even halfway back to the street just because we wash cars so efficiently So the entrance to the car wash is on Bailey and maybe this was explained so I'm sorry if I missed it But Dewey's right here Sorry

This will be for us. This will be preferable from North. So like, I think about Norfolk's Norfolk's on 13th street, which is highway 81, which is a super, super busy highway. And so we only have one entrance and one exit. We're here, we have two. And when they come out of Norfolk, they can go either way, right? So during rush hour, you have people turning across traffic, which is a mess. It still works fine, but this will be nice where it's the one way that'll actually make it much more convenient for people to leave. Because they're just coming out and turning right, coming out and turning right. So yeah, I wouldn't anticipate this should be one of our better ingress, egress sites.

Yeah, my when I looked at this, my primary concern was.
Dave Kuntz, Do we get we've seen other openings should we've had pizza places that have backed up into dewey street as they've opened but. Dave Kuntz, that's a state highway, and that was my primary concern, which is separate from the zoning discussion but it's it's a concern we'd probably need to just talk through I mean, how do you manage to, how do you manage that initial.
Dave Kuntz, The initial yeah. So, the, the, the grand opening, which, I mean, I would say just the 1st week, you know, for those of us in our room. So what we do, you know, lane 1 will be the challenge, right? Because everybody's signing up. Nobody's on the platform. Nobody's got their license plates on the platform. So, it's nice now that we have 4 sites and, you know, a lot of different staff at all of our locations. So, as an example, when we open carny, we had probably 15 of our season staff from all of our sites that have been with us for several years. Um, come to the site iPads out in the lanes, you know, we're signing up 4 or 5, 6 people at a time. It's it's all hands on deck.
So it's.
Yeah, we, we have people pull around to the backs, use the vacuums, the spots there. So it's just the onboarding process. But again, we don't anticipate it back and up into the streets. We'd have to be pretty busy for that, but. It'll be all hands on deck for sure.
The 1st week similar to. Chick-fil-A, when they opened, they were on E3, and they had...
They had uniformed police officers trying to manage the traffic out there when that happened. I remember that. I mean, we'll do a lot in this town for a chicken sandwich. I mean, you just got to imagine what's going to happen for a free car wash, okay?
Well, for what it's worth, I hope we're that busy.
This one, though, a little bit different. It could back up into an intersection, a major intersection.
Yeah. And that was another part of my concern is that that intersection is kind of busy already. Yeah. And if you get cars and traffic that back up into that highway, it could be a real mess.
Because it's already tough to sometimes just go.
That's a lot of vehicles. A lot of vehicles can sit off the street all the way to the entrance on the other end on Bailey. Yeah.
Grant Allen, when we opened Grant Allen, that was the busiest car wash in the country for Tommy's. It's third in the country right now. Even when we opened that one, I think we did 2,100 cars that one free wash day, and we didn't back up into the street. So I'm not saying we won't. I hope we do for what it's, you know, but I don't think we probably will.
Yeah. One other thing, too, in talking with the DOT, they were wanting us to move the entrance up to the north a little bit to line us up.

Well, they both are. Yeah, it's a dual. You can enter on both sides and exit on both sides. So it's a dual.

I mean, you and I talked about this earlier today on this subject. I mean, do you have any lingering concerns about the traffic pattern in and out of this area?
Since you asked the question earlier, I like jumping into the numbers a little bit. Northbound Dewey is about 11,000 vehicles a day. Peak hour is around 1,100 vehicles a day. So if they're looking at 150 cars an hour, more than, you're going to have to be 15% of the cars northbound are going to have to go into the wash. More than that, just to kind of give you a perspective and I don't think we have any business that takes 15%. Of now, maybe for a peak. Special something you could maybe get to that direction, but I think as a regular, um. regular day-to-day operations i don't think we'll have that one thing with car wash technology there's lots of different kinds and you might if you look at some of the ones we have in town there's some that take you'll sit for five minutes while the car in front of it does its thing then you have some that it's more of a assembly line that you'll run through and it's how fast can they stack the cars which there's a lot of variables is the bottom line so with them looking at 150 to 200 an hour I mean, I think you mentioned it. I think of two chicken places that we had police presence for a week or two. We had Cane's and Chick-fil-A. That's right. Pizza Hut, I got calls when it reopened at B and Jeffers from NDOT called about cars stopped to go into Pizza Hut. So there's a little bit. We have a track record of when we have something new and exciting.
That's what happens.
Exactly. So, I mean... It keeps going so, I mean, there's a little bit, I think, long term, I don't see an issue and I don't even the highway system is the best capable. We have 3, 1 way. Lanes northbound to handle the traffic moving it further north was a discussion we had with the driveway. That gets it away from Jeff or the. The Phillip intersection, which is a little bit can get a little bit busy as well. Another factor in the big, big picture is I was out Francis all today. They're paving. That and we're probably going to have that done. They'll have it done this fall. And that's going to create a difference on how Philip is used as well.
That is true.
There's going to be a fair amount of people that are going to start. To go from the ones to Newberry on Francis. I would, I mean, depending on where you want to go, because right now the only way to go to Newberry from town is. Bill up for 4 street, or I guess 12 street. So that's another factor. So, yes, that those were the thoughts that I had looking at it. Um, with the, you know, the 1100 in an hour, they could handle 150 an hour. I don't see 50. I mean, I'm sure they wish it would be 150 all the time if they could. But I don't see that as far as that being a backup and then looking at their queue length. They'll be able to get probably. Um, 20, some cars, and there may be a little bit more. If they adjusted around, so some of the queue length is when things aren't going right. Something breaks. That they have a little bit of time and I think. To me, I think it makes sense. They have different technology and all those considerations.

Item number eight, discussion of draft of updated City of North Platte comprehensive plan and updated City of North Platte zoning regulations and zoning map. No action will be taken on this matter tonight. It's a discussion only. For those of you who have not seen it,

This is what we've been reading since February.

And that. I think you were all provided copies via email. If you would like a hard copy, there are some here tonight to review them. Okay. The section I really want to call your attention to is this, and we can get you 1 of these. Because there are a lot easier to read than the version that's in here. This would be the what's allowed where. And how so, whether it's. Allowed by right, whether it's allowed by conditional use, whether it's not allowed. This is kind of the meat and potatoes of the planning and zoning. Section so. pay particular attention to this as you're reviewing it. There's a lot of time and energy spent going through this line by line.
When Chairman Fudge says there's a lot of time being spent, we had a committee that consisted of one planning commissioner, one city council person, multiple staff members, and we spent, what, like three days? Like three, four-hour days or three-hour days?
That's five of these on my calendar.
Going through just this. But there's a lot of things in there. When you look at the zoning regulations, hugely different format, but a lot of the things are not drastically different. They just look different. There are some things in the new updated zoning regulations that are hot topics. Data centers, obviously. We have a section of proposed regulations for data centers. Medicinal marijuana, there's a section for that. Um, that is new. Those are new. Um, we do also have a section that is a special events district, or I think that's what they call it. It's the purple. Yep. We kind of created that because we wanted to look at some of the places like Nebraska Land Days, the Buffalo Bill Arena, the Lincoln County Museum, some of those particular places where they're always coming in here to get a conditional use for. We just did one for Nebraska Land Days, a beverage thing. Well, they can't do it because it's an ag property. So we thought we would rezone some of those special events. Lincoln County Fairgrounds is another one. So that they didn't have to come back here every time they wanted to do something small on their property.
Yeah, and it's, I can tell you from having had to go through that process number of time for everything we did out there was pain. And so what we tried to do here was say, okay. In event that identify the event districts number 1, and in those within those districts, what do they need to function? So they don't have to come back here asking please every time they want to do something to develop that property. and make it better for people that are coming to visit those things. So the other section I really want you to pay particular attention to is this map in the comp plan. So this is the updated version of this. We have not touched this except for tinkering with it as applied for through this group and for city council since 2012. So a lot of thought went into this.
129 that's in the comp plan. So make sure you're in the comp plan.

And that's the future land use. So it's not necessarily the zoning map, but it's where we think we're going.
So. I'm sure this will generate a great deal of discussion. There was a lot of thought put into this, like, where are we growing? How should we be growing in those areas? What do we see developing in those areas? I mean, the area south of got a lot of attention between. The interstate and, uh, state farm road. Okay. We see that as an area where there could be some potential development down the road. Um. East got a little bit of attention as well, South and East. And then North, I mean, there's some stuff going on up in here that was not addressed in the last plan that we tried to take care to do some things on. And so those are kind of the major areas that I think you ought to focus on. Judy, do you have anything in particular besides those two?
I think those are, yeah, no, I think you pretty much hit what you really, I mean, I would hope you guys, and I know it's a lot, I would hope you would read it all at least once even though it's 200 and some odd pages per document. And if you do see something, as far as editing goes, it might reference a different town or a different thing because it's a consultant and they tend to use a lot of similar things for other communities. So if you see things like that, we want to make sure we get those cleaned up.
So timeline, um, we would kind of like to have a, a joint. Council planning commission work session, probably in September sometime. To try and talk some of this through a little more in detail after you've had a chance to go go through it. Um, I don't know that we really identified a time yet. October, we would like to be in a position to hold public hearings on this, which I'm sure will take a little time. And then in November. City Council would hold its public hearing. So October, we would plan on holding a public hearing and voting on it. And then in November, this Council would hold a public hearing and vote on it.

um nebraska planning and zoning association is going to be holding a um online little mini workshop on october 16th which is a friday um the cost to attend is a hundred dollars for as many people that want to attend so if you are interested right now i don't have a schedule of what's going to be on there but they are all plant related items as soon as I get a schedule out I will let you know and you're more than welcome to join it's a good way of getting some education for very little amount of money and in the comfort of your own home it goes from like 8 30 to 4. you can pop in and out of sessions you can attend all day you can attend one session doesn't make any difference but yep It's a pretty good little online workshop.
