it's a big item. All right, so some announcements. Got one birthday. Councelor Ronald Miller yesterday, I believe. Is that correct? Paid her taxes and had a birthday. That's really great. All right. Uh, April 17th in the afternoon, academic excellence celebration at the student center down at Keen State College. If you're in the area, feel free to go in and visit there. April 25th is Greenup Day in Keen. Supplies are still available from 8:00 a.m. to noon at the Keen Public Works Department. And on May 3rd through May 9th, is National Small Business Week. Sunday, May 3rd, Old Man of the Mountain Day. That's a fairly new holiday, but it's a Sunday. So, and then Tuesday, May 7th is teacher appreciation day. A reminder that the budget process is about to begin for the city. The proposed operating budgets for FY2627 will be distributed in council mailboxes on Friday, May 1st. The budget resolution will be presented at the first city council meeting in May and will be referred to finance organization and personnel. FL will conduct special budget review meetings on May 12th, 19 and 19th which will start at 5:30 in council chambers and the regular FOP meetings of May 14th and May 28th will start early at 5:30 p.m. for budget review as well. Public hearing on the operating budget will be conducted at the regular city council meeting on June 4th at 700 p.m. So, we have one proclamation.
Mayor Lane, want to join me up here, please? This evening we have a proclamation uh for the friends of the Keen public library. They play an important role in supporting the city of Keen Library and the library staff in areas not funded by the Keen city budget. Whereas the efforts of the friends of the Keen public library include sponsorship of many enriching programs and special events open to the community, purchase of library equipment, furniture, and passes to New England museums for use by individuals and families as well as volunteer staffing to improve services. And whereas this year the friends are celebrating 43 years of book sales at the Keen Public Library. And whereas their semianual book sale at the Keen Public Library sponsored by the Friends since 1983 have helped to provide funding for these many activities with all purchases dictated by the wishes of the library staff. And whereas the springbook sale to be held Friday, April 24th is from 10:00 a.m. to 6:00 p.m. Saturday, April 25th from 10:00 a.m. to 5:00 p.m. and Sunday, April 26 from 10:00 a.m. to 2 p.m. and will allow the public to enjoy good quality used hard hardback paperback titles at bargain prices. And whereas this Sunday, April 26, 2026, the friends are offering a special sale on bag day. Just buy a bag for $5 and fill it to the brim with all the books that it will fit. Now therefore, be it resolved on behalf of JV Khan, mayor of
the city of Keen, I do hereby proclaim April 24th through April 26 as friends of the public library days and do urge citizens of the Mananak region to visit the spring sale book sale at the public library in support of continued excellent library programs and facilities. Thank you, your honor. Please know, now that I'm retired, I don't have to wear a tie anymore. Sorry, guys. Uh, the book sale is really important for the library. Every year we have two book sales and they provide an opportunity to support the library to buy supplies to put to buy services to to pay for items at the library that the taxpayers don't have to pay. And let me just say the last two book sales have both set records for the amount of funds that have been raised at the book sale. There are tremendous opportunity for people to get access to books. I much prefer books to to devices anyway, but they they provide the members of the public a tremendous opportunity to come in and get all kinds. There are new titles. There's fiction, there's non-fiction, there's biography, the there's cookbooks, the the there's there's books in large print, there are art books, there there are multitude of types of books that are available. And I encourage anybody that has any interest whatsoever to come into the library. And on Sunday for $ five dollar, you bring a bag, you fill it up, and that's all it takes. So that the book sale is a tremendous opportunity for the community. It's a tremendous benefit to the community, and I s strongly encourage people to take advantage of it. Thank you, Tom. All right, we have uh no elections, nominations or appointments and moving on to communications and we're going to take the first four communications
together. Certainly, we have four communications uh all of which are making recommendations related to the previously approved project for construction of a parking lot at the skate park. The first is from Sandra and Robert Hal. The second from Barbara and Frank Richter. The third in support of the RTOR's letter is from Vicky Morton. And finally, the fourth letter was submitted by Tom Dustin. I want to recognize the city manager for a few comments.
Thank you. Um so this project, many of the letters actually reference the design as a proposed design. It's actually well beyond the proposal stage. Um we have a design for this project that has evolved. Um and the reason that there is need for a parking lot or pavement in this location is there is um soil that's contaminated uh under the ground. Therefore, we cannot use impervious type materials and we do need to keep the the pavement there. Now, having said that, there can be a discussion about what we can do on the pavement. It can be a lot more than parking. There's all sorts of opportunities of things that can happen. And so that's what I'm anticipating this conversation will be at the next MSFI meeting.
Thank you. And with that, we'll be referring these to Municipal Services, Facilities, and Infrastructure Committee. We have another communication.
Yes. Our next communication is also from Vicky Morton. Uh, this is a request for the city to consider repurposing some granite pieces that are on Island Street for use at the skate park property. And thank you. And we're going to refer that to the city manager. Next uh next two items will be taken together. And these are our last two communications and uh they are putting on record opposition to the review of the land development code amendments that were codified with the adoption of ordinance 0202515A. The first communication was received from Tom Julius and Angela Pape of the Manadnock Interfaith Project and the second was submitted by councelor Brutle Miller.
And these communications are in reference to a pending item on the planning license and development committee agenda and will be filed into the record asformational. And with that moving on to council committees.
So our first Yes. Our first item is a planning licenses and development committee report relative to the request by Copper Cannon Distillery to participate in the Keen Farmers Market. And on a vote of 5 to zero, the planning, licenses, and development committee recommends that the city council grant permission to Copper Cannon Distillery to sell alcohol and provide individual product samples to patrons at the 2026 Keen Farmers Market on city property licensed to the Keen Farmers Market in accordance with the requirements of the state liquor commission. Said permission is contingent on the following. Submittal of a signed letter of permission from the Keen Farmers Market, obtainment of all necessary permits and licenses, and compliance with all laws.

Um so, um pretty self-explanatory as as the city clerk said. The first one is just a request from uh Carb Cannon to uh be at the Keen Farmers Market which we all know we love and support and we voted uh unanimously to approve it and we hope the full council will also.

And the next item is a planning, licenses, and development committee report relative to a discharge of fireworks by the Keen Swamp Bats on July 3rd. And on a vote of 5 to zero, the planning licenses and development committee recommends the city council grant a revocable license to the Keen Swamp Bats for the discharge of fireworks on Friday, July 3rd, 2026 at Alumni Field with a rain date to be determined in conjunction with city staff subject to the licensing requirements identified in the staff report. All permissions granted herein are subject to compliance with the city approved safety protocol document which becomes a part of this license.

And on a vote of five to zero, the planning licenses and development committee recommends that the city council grant a revocable license to the Keen Young Professionals Network to use downtown city rights of way to conduct the Taste of Keen food festival on Saturday, June 6th, 2026, subject to the licensing requirements identified in the staff report, including associated road closures and authorization of free parking. All permissions granted herein are subject to compliance with the city approved safety protocol document which becomes a part of this license.

I will point out we're saving a lot of time already with the new motions, but I hear you.
Go ahead. Yeah, to answer that, one of the reasons we haven't to this point because sometimes road closures and and things aren't copycatted, so there's differences on some of them. So that's why we broke them out separately, but as we did this past week, we we're definitely shrinking down the amount of things that have to be said. Subject to the licensing requirements identified in the staff report, including associated road closures and authorization of free parking, all permissions granted herein are subject to compliance with the city approved safety protocol document which becomes a part of this license.

Okay. We have a final planning, licenses, and development committee report. This one relates to the Keen Pride Festival request to use city property in September. And on a vote of five to zero, the planning, licenses, and development committee recommends that the city council grant a revocable license to Keen Pride to use downtown city rights of way to conduct the Keen Pride Festival on Sunday, September 20th, 2026, subject to the licensing requirements identified in the staff report, including associated road closures and authorization of free parking. All permissions granted herein are subject to compliance with the city approved safety protocol document which becomes a part of this license.

And number five out of five of the good news coming from PLLD. Um once again a fairly new downtown event. Um it started off very small. has become very large and very successful and it's a very positive um downtown event that put Keen's on the map that a lot of communities don't take on. So, you know, I applaud Keen Pride for doing this and I applaud the citizens of Keen for making this so successful. Committee voted unanimously to pass this. I'm sorry at uh we are now at uh finance organization and personnel committee reports and the first is related to the acceptance of a donation and on a vote of 5 to zero the finance organization and personnel committee recommends that the city manager be authorized to do all things necessary to accept a donation of $20,000 from the Manadnock Conservancy and that the money be allocated for the transport Transportation Heritage Trail Phase One.

So, this is a continuing project. Um, we actually have former counselor Redford here who's been a very important uh intricate part of this vision. Um the transportation heritage trail is we're going to improve 0.9 miles of the Cheshire Rail Trail, excuse me, between Eastern A and Route 101. It'll the project will create a 10 foot wide paved trail along with improvements to the existing trail head parking and connections to Chapman Road and Marvel Street. The funding is in addition to federal grants. Um, we've received a federal grant of $394,800 and a transportation alternative grant in the amount of 1,164 394.06. So, um, the federal grants will cover up to 80% of the project. Uh, so I hope you support this.
Thank you. Comments? Yes, ma'am. I'd like to publicly acknowledge and say thank you again to the Manand Conservancy. This is the second grant that they have given us free of charge to help our community and I just think that's a fabulous addition to the other work that they do in our region. Thank you. Thank you.

And our next report is from the finance organization and personnel committee and it relates to the execution of an engineering services agreement for the Robin Hood improvements design project. And on a vote of 5 to zero, the finance organization and personnel committee recommends that the city manager be authorized to do all things necessary to execute an agreement with CHA Consulting, Inc. for the Robin Hood Improvements Design Project for an amount not to exceed $300,000.

Excuse me. Uh so the city um as part of the Robin Hood Park Improvement Project applied for and was awarded a land and water conservation fund grant in the amount of $500,000. The project includes two phases of construction. The first phase consists of rehabil rehabilitation and renovation of the existing pool. Um phase two includes improvements to recreational equipment as well as enhancements to circulation and accessibility within the park. So, I hope that you support this councelor.
Yeah. Thank you, Mr. Chair. Just real briefly, I'll be voting in support of this and as I'm sure the rest of my colleagues will be, I just want to say thank you. I've shared this privately back with staff, but want to make sure to do it publicly and and thank staff for the level of information and background that they included in this report um in the the kind of this was the most recent or the report that followed on um immediately succeeding the presentation from uh staff around how we select contractors, what that scoring process looks like. And I appreciate this background being in there. I know that it speaks for me to the relationship that staff are trying to build with council in terms of collaboration and transparency. and I know that my constituents appreciate being able to find some additional information about how these decisions are made as well. So, thank you.

Yeah, thank you, your honor. Um, it is, uh, this is a great project. These are the kind of things that make Keen special and will continue to make us special going into the future. Um, I would ask that, uh, city staff, parks and wrecks, uh, really ramp up the communications on this project. Um, we've learned a lot as we just mentioned about the the skatepark parking lot thing where not everybody is paying as much attention as we are. And it would be awesome if we had displays or or meetings in the park itself on site where we could communicate exactly what the plans are being explored and to be able to differentiate between that's a great idea, that's a bad idea, and what actually might end up being done. Um, too often people are confused because they don't go to every meeting or read every communication. So, I look forward to helping with that effort of improving the communication staff. Thank you.
So, thank you for that suggestion. Communication, communication. It's really that's always the crux of the issue. Um, so I we'll definitely be able to communicate more. Those were good suggestions. I do believe the design is also done for this project. Um so we can at least start the communication as to what work is planned to be done and when. Further discussion all in favor? No one's opposed. Uh the next report is from finance organization and personnel committee and this is related to construction services for the wastewater treatment plant tank repair project phase one. And on a vote of five to zero, the finance organization and personnel committee recommends that the manager be authorized to do all things necessary to negotiate and execute a sole source professional services contract with Weston and Samson Engineers, Inc. for construction phase services for the wastewater treatment plant tank repair project phase 1 for an amount not to exceed $104,000. Second. So, Weston and Samson Engineers was chosen and that's um an engineering firm that the city has used for other projects in addition to this one. The project funds concrete repairs and new coating systems for two primary clarifiers, three septic septage tanks, and the top of the sludge storage tank at the wastewater treatment plant. Um so, we hope you support this Thank you. Discussion, members of the council, short. Yes, ma'am.
Thank you, Mr. Chair. Um, I went with my family to the wastewater treatment plant today at their open house and um they gave us an outstanding tour and the person that we spoke with was so knowledgeable. We all really enjoyed it. My husband was very surprised at how interested how interested he was. So, I think that they're they're doing such a great job there. And um I just wanted to say thank you to the wonderful wastewater treatment staff. Councelor,
thank you your honor. I can't miss this opportunity to re-emphasize an issue that came up last summer that was uh one of those churning issues uh other than barking dogs. Um the the people using the roadway to the wastewater treatment plant. Apparently, there's still difficulties with their behavior down there. So, I would encourage all of us to help enforce staying out of the road, not parking your cars in the middle of the road or other uh bad habits because the trucks go through there and there's some turns in there where it's hard to see where people are around the turn. And we don't want to lose this uh as as a beautiful place uh to go for uh wildlife observation and just nature itself. But um from talking with the folks at wastewater treatment, it's not been good. So let's get back on it now that it's summertime.

Um, is there any sort of documentation that's happening when these instances occur? Um, just I'm I' I've not believe that it's happening. I'm sure it is, but I also am not sure. Yeah, I can I can get more information for you on that. I'm not sure how they're tracking it. Um, if it's anecdotally or whether or not they're actually keeping track. Um, I'm I'm going to guess they're keeping track because we had a very long conversation about closing this area and um and if this continued to be an issue that they would be back. our next report is from the finance organization and personnel committee and it's relating to the execution of a change order for construction services for the city hall parking garage project. And on a vote of five to zero, the finance organization and personnel committee recommends authorizing the city manager to do all things necessary to negotiate and execute a contract change order with structural preservation systems LLC for an amount not to exceed $120,000 for the city hall parking garage rehab project. Second. So, um, this is in reference to the, uh, parking garage outside of city hall in the back. And we're going to be making repairs or this will enable them to make repairs to the deck. Um, and with these repairs, we'll, it is anticipated that the, um, uh, service life would be about 8 to 10 years, which is a significant improvement over what's there right now. Uh and it'll also provide um more protection of the uh or for the concrete. That's it.

Thank you. So, the great thing about having the deputy city manager in the back of the room is if you say something that's not correct, they let you know. Um, so, um, so I do need to tune up my comments from earlier. There are still some design decisions to be made related to the Robin Hood Park. And so, we do have the opportunity for some additional outreach and there probably will be a committee similar to what was used during the Pat Russell Park. There are some things that are pretty well decided like the pool and what we're going to do with the pool. Um there was a lot of um input on that as to whether or not to have one. Did we need a new one? Do we rehab this one? And so that is pretty much set, but there's still opportunity for some other changes in the park. So I just wanted to start with that correction for councelor Hos and the public. Um and also I wanted to let you know if you haven't seen open gov is gone live. It's It's live right now. Yes, Paul, our community development director, is cheering in the back. That has been a big undertaking, and I think the public is going to really enjoy it. It's um it's a great portal um that makes it easier for residences, businesses, and contractors to work and interact with city staff. I've used it myself. Um and um it does make things a lot easier. Um, and I want to specifically recognize both our fire marshall and building official Rick Wood and our community development director Paul Andress and their teams for leading this effort and helping to bring departments together around a one city approach. I think it's the more that we can do a one city approach, I think the better off we all are. Um, then this was quite an undertaking. Like every project we do, we'll continue to fine-tune it as we get uh feedback, but we will be looking for ways to incorporate it more
throughout the organization. Um, this initiative is not just about improving our technology. It also reflects our approach to customer service. And I would like to share some kudos for our community development department that we received this week in an email from a contractor working uh with New England Clean Energy. and I quote, he said, "I have been doing this for almost 20 years and I can't say I have ever seen a more responsive department." That's huge to get that kind of feedback. It really, really is. So, kudos to them.
And just one more shout out to the team um that worked on that permit. Emily Dusso uh as our city planner, Rob Burns our planning technician, and John Hislop our building inspector. Just really great to see them taking these initiatives to really engage and try to be more responsive um and be more problem solvers. It's been it's been really wonderful. Um you probably also saw a press release go out this week for Arbor Day Foundation. We've been participating for 50 years. So 2025 was our 50th year. And this year for Arbor Day, our activities will be on Friday, April 24th at 11:00 a.m. Every year we plant a tree, usually with a bunch of students from a school. Um that's going to happen again. So the mayor will read a proclamation and visit with students. And if you're interested in attending, uh if you have an interest in attending, it's uh it's on School Street towards the Court Street end. Um, so you'll you won't miss them. You'll see a public works truck and a tree and a pre-dug hole and a bunch of kids hanging out. So if you're interested uh in attending, um, also just mark your calendars now because we've set the night for community night. It's August 18th. Um, typically it runs from 4 to 7. Um this year we're moving the festivities a little bit further down the parking lot towards uh public works to mitigate some of the impacts we saw last year to Keen Ice. We get a great crowd that comes out and we tend to take over that space with all of our equipment. Um and to be respectful to Keen Ice and the the users of that facility, we're going to just try to adjust a little bit and move down. We will have the usual touch a truck, which is always really something the kids enjoy, including my grandson. He loves it. Um, there will be fire apparatus,
police cruisers, snow plows, excavators, and fleet vehicles. Kids also love getting in and out of the police department vehicles. That's something that they find a lot of fun. And we give out free food. So, we give out free hot dogs, burgers, and ice cream. The public works does a fabulous job doing all the cooking. Um and so hopefully we have another great uh crowd this year. Thank you. So we are now at reports city officers and departments. Uh councelor filio for a motion please. Um uh this is a report that came out of the planning department or the community development department from the senior planner Mary Bruner. Uh she's putting on record the emailed resignation of uh Katie Kinsula who was a member of the conservation commission. Move to accept the resignation with gratitude for service. So we have one more time report. Uh this is from the planning licenses and development committee and it's a request for more time related to the request to review recent amendments to the land development code that were codified with the adoption of ordinance 0 202515A. Thank you. Um, obviously we've heard a lot of chatter about this the last couple weeks. Some accurate, some not accurate. Um, the main reason for PLLD requesting more time is honestly simple. is to allow further input from concerned citizens that have asked during my 27 years as a city councelor here. Not once, ever, never have we refused a council committee to grant more time. Ever. Not once. I went through the history to see if any time that I've been here we refused a committee more time so citizens would have more input that they wanted to offer. Never have we stopped that. Um, you know, once again, the the reason for more time here, the biggest reason is to allow more public input from those that wanted to speak. To be clear, this this is not about opposing additional housing units. Every one of us knows we need more housing. I know we need more housing. Everybody on the committee knows we need more housing. That's not the issue. There were some issues with the ordinance that some of the neighbors after the fact saw and wanted to know how it would affect their neighborhood. They've asked for that. We owe them that right. It's not to say it's going to go to committee and come back totally different. Might come back be the same ordinance that went in, but we owe it to our citizens that want to speak a chance to speak. And we talk about more time. Um, you'll remember just a few months ago when some of you were here, some of you were involved with it, there was an issue at the MSFI committee about a small green space down the Church Street. I know as vice chair of MSFI at the time, we voted unanimously that we were going to sell that piece of land to win a butter 5 nothing. We were ready to go. Why didn't we? neighbors, some city councilors, mainly neighbors
from that neighborhood said, "Look, we know you've made up your mind, but we would like a second chance to speak about this." So, even though MS5 committee had had a five nothing recommendation to move forward to sell that piece of property, we listened to the neighbors, let them come forth, went on more time. It went on more time for a couple of months. In the end, the MSFI committee reversed the five nothing decision went with the neighbors request and that green space is now being handled by the neighbors. Some of those same neighbors that requested that, some of the same neighbors that have contacted me asking for more time because once again, they feel it's going to affect their neighborhood because now they're asking if several units in a row say go to six units, does that mean they're going to lose their green space that's there to parking? can't give them the honest answer at this point. That's why I said, you know what, we'll put it on more time and get those questions answered. So, you know, above all the issues by this council, it's imperative that we allow input requested by our constituents. Now, some of us here can say, "We've heard enough. We don't need to hear more. We've heard enough." No, we haven't. If a handful of constituents have said, "We still have something to say," who are we to say, "We've heard enough. We are elected to listen to everybody." The reason for this going to more time is simple. So our constituents have a second chance to bring us up, just like they did to the MSFI committee. Now, it may come back, like I said, it may come back the way the original ordinance was. So be it. I'm not falling on the sword for this one. I'm kind of in the middle on this one, to be honest with you. have seen both sides have valid input, but the constituents have called me have not had their input yet. And for us to say we know better, we do not. We're elected to listen, and that's what we

Thank you, Mr. Mayor. Acting Mr. mayor. Um, wow. I don't know where to begin with all that. Um, I did have a very lengthy um, response um, drafted, but I'm going to try to keep it brief and just make several points because um, reviewing PLLD's meeting last night um, almost everything that needs to be said was said then. Um, first and foremost, I'm surprised this even went to committee. Um, I was shocked that it was authored by three members of the PLLD committee. And we can debate on whether or not that what the fine line is. It had one signature, but three people's names. And in my opinion, that was authored by three people. I don't buy the reasoning that was given at uh PLLD for how that got through and submitted as an original communication and not picked up a second time before it went to PLLD. So for that reason alone I think we are beating a dead horse. But more importantly, as councelor filio pointed out um and what points that were made at PLLD, even if we suspend that argument, there's no re reason for this ordinance to be revisited at this time. There have been no new developments. We heard from the public at length many times back in the fall before we voted on this. I heard um question about confusion and counselors being confused. For the record, I was not confused then. I am not confused now.
Um and it's interesting to note that as a whole, the council had not received any correspondence from the community about this since it passed last fall. And as councelor Rutle Miller pointed out at PLLD, as a member of the PLLD committee, she had not received any correspondence from constituents regarding this issue. And to point out at PLLD, the people who spoke came and was in support of the ordinance. Um, so those members who may have been contacting councelor Filio um in opposition of the ordinance, they had their opportunity last week at PLLD to come forward and make that known. Um, so for those reasons I stated, um, I'm moving to amend the motion to instead accept this commun communication that was signed by councelor Filio and written by councilors Filio, Jones, and Hos asformational. And I hope I have a second.

Thank you, Mr. Chair. Um, I've heard several, well, two different reasons why there's a problem with this ordinance, and I feel uncomfortable that there are two different reasons going around. Um, I heard there was impropriety with the way that the ordinance was created, but the city attorney has stated there was not. Um, I have not received any communications about this and I think it's inappropriate to be questioning an ordin ordinance that was so recently passed when nothing has even um there's been nothing no proposals to even, you know, show any type of effect. So, I I don't think there's any sense in rehashing this so soon. And also, I think that if we did, I I don't know that the votes would be different. So, I I think I think if we're going to discuss this again, it should be at a later date once we've had more time, maybe a year or two to see what may happen with this ordinance.

Uh I'm in I'm in favor of this amendment. Um, in general, I have to say I'm very proud of the work we've done in housing over the past six years since I've been here. Um, and I feel like uh we shouldn't start backtracking now. And I think that's what that's what putting this on more time would do. There's a lot of there's a lot of things that are still outstanding that we need to get done. and for us to be spending city staff time uh going down this rabbit hole which we already spent quite a bit of time in this rabbit hole last year. I don't think it's it's wise to spend uh staff time on this including you know preparation for the next meeting where things have been requested as part of more time and then assuming that goes on you know step after step after step we've been through this it's not a good use of council time it's not a good use of staff time we have other priorities I know uh councelor Jones has has suggested we do something about uh commercial nodes and and figuring out how we can make uh some of the smaller commercial areas uh in our city a little more prosperous through through zoning. Um if councelor Madison were still here, he he'd remind us that we haven't done anything about short-term rentals yet. Uh and my constituents keep reminding me that um the Kingsbury property is still a big 22 acre black hole in the middle of our city. There are other priorities here and we should not be spending uh undue time revisiting issues that we've already spent quite a lot of time on. So, I would recommend that everyone vote for this amendment and we can clear it from the table and then um you know if if councelor Filio is inclined to introduce this again next year uh after some time has has happened and we've we've had a chance to see you know what what this ordinance is actually doing um we can discuss it then but I don't think I don't think now is a good time.

Yeah, thank you Mr. Chair. I I think you know compelling points as they so often are in this space have been raised on both sides of this question. I I my thinking on this vote tonight is not informed by the way that I voted on the ordinance originally. Uh nor is it informed by any arguments about the merits of the ordinance as it stands today. I keep coming back to the precedent question of what this council has done in the two years that I've been on council when the majority of a committee requests more time. Um and that has been to without incident grant more time. So my vote um against this the pending amendment and in favor of the underlying motion should the underlying motion be returned to uh is going to be based on that process and based on that precedent question. But I uh that is not necessarily an indication should not be construed as such of of how I will vote on this moving forward when we return to the underlying question of the ordinance and its merits.

Um, so just speaking to the amendment, um, since I called out in the meeting that I had not been contacted by any, um, any residents about this, I have since been contacted by a resident about this asking for us to vote against more time on this because he feels like it is wasting the city's time. Um, and that is also how I feel. And I understand that I'm a newer member of council, but I also feel like in what case will there ever not be push back from certain numbers of community members uh that are not in favor of the way certain votes have gone? And we're rarely ever going to have a situation where everybody has been in favor of something. Um, and I think it's our job as counselors to help explain what zoning changes do, what the implications are, and that we don't necessarily have to fear these changes, and we don't want to kind of encourage additional fear around these zoning changes that we're making to help um, reszone certain areas. It's like directly in our um, master plan that these are part of our goals as a city to reszone pre-existing areas, use existing housing. Um, so all that to say, I understand there's a precedent here, but I just feel like this is not in the spirit of what we're trying to do as a community.

Thank you. Um, I've thought about this a lot and um, so I agree with councelor Filio that it's important to listen to constituents and to not stop listening. I also feel like the question has since changed. We were in the process of hearing feedback about an ordinance. Now, I would expect to hear feedback about the impact of that ordinance taking effect, but it really hasn't had enough time to take effect yet. Um, it hasn't really been used. I in order to feel comfortable granting more time, I feel like I would need a couple of things. Um, and the the reason I feel that way is because since this was a recent decision that hasn't taken effect, I feel like it's disrespectful to and not an efficient use of time to go back and redo the work that was done before we have seen what has been done. And I I watched all of those discussions and I did not hear any new information presented or communicated at the last PLLD meeting. So I think new information is something I would need in order to kind of think it was worth warranting more time and a clear goal, a clear reason for the more times so that staff can do something is so that we can and I will I made a list of all of the things that over the course of the meeting I have heard that the possible uses of more time were and so I think I've heard possibly rescend
poss possibly revise. Then there was divide it into multiple ordinances. Then there was um not create ordinances but to divide it into um to break down the meaning of each step. And then I feel like I'm hearing something different here tonight, which is public input. The public input before the ordinance, now the ordinance is in effect. So if we want to have a discussion about something else, I'm not clear what this is about and that's why I'm really struggling to justify more time.

Thank you. Um there's been a dark cloud hanging over this ordinance since it was initiated and I have a list of reasons, but we're not talking about the ordinance. We're just talking about uh whether or not to put it on more time or actually we're talking about whether or not to put it asformational. Um and I just wanted to remind the council that this could be feudal because the way it was presented to the council was a slight amendment. uh it wasn't for uh and if we do that tonight and and accept it this motion, any counselor can do another amendment and send it back in two weeks. It's we can also ask for reconsideration that was never mentioned in in the original letter. So this can go on once again. So why take that effort and accept it asformational? I just don't know why we would do it when it those who want to see it addressed to the public can do it. And I just also want to add that staff told us they could use that more time because they could clarify it better and they did ask the committee for some direction as to which way they want to clarify it. And they said there's good ways they can clarify it to make it better for the public. So there's a good use of going of denyingformational and going with more time. Thank you, councelor House. Second time and hopefully the last. Um, yeah, I to take the motions separate here and talk about the motions to deny to move away from putting on more time and take it asformational strikes me as kaibashing free speech. that here's a proper motion made to look at what was done and then decide what to do with it and then there's another motion that jumped on top of it in parliamentary procedure to shut that off and that that won't look good in anybody's eyes. We won't look good as a council on that. Um the the I hope we defeat that amendment and and understand why more time is needed. It's uh at PLLD when this came up again um without debating the reasons it came up again um we didn't feel like we had the the answers to say whether we should look at it further and all we're talking about here is looking at it further. This is an ordinance. It's in already. It's done. Anybody can do anything they want under this ordinance right now. If it's going to take many more steps for this to get to the point of it becoming a change of sorts. Um what happened here is uh a couple reasons that it came up was that the original votes on this were it was 2 to2 out of committee which essentially is uh interpreted as a denial. So that's what it came out of committee at the time and then it went to council and it was only an 8 to7 pass at council on that level and that that makes us question and three of the members who voted on it at that time are not here anymore. So, um, we're not going there. We don't have a new ordinance at all, but those are the things that contribute to people wanting to re-examine it again, at least to talk
about it again and get some more understanding around it. Um, the uh, you know, the parts of it that there was four pieces, four disperate pieces bundled in one ordinance, that was unfortunate and we probably shouldn't have let that happen at the time, but so be it. and you were faced with, okay, well, I like three, but I don't like one, or I like two, or I don't like two. What do I do? Um, that's that's not how we should write audiences. Hopefully, change that in the future and be a little more specific. And there's there's a whole other reason that people are uh overriding this is people are kind of uncomfortable with the process as to what was going on with the process at the time. So, um, I the city attorney gave us some clarity on that at our last PLLD meeting, but with most things in the public eye, and it's this is similar to what I was talking about with the park before, um, there's a lag between the public hearing about it, reacting to it, and then speaking to it. So, there's always a lag to this, and it may take a couple meetings. So the idea of going one more meeting for to have this issue on more time and then if if if we vote whatever way we vote for it comes back to council and then we can do away with at that point or we'll have heard arguments that make it more reasonable. But if we do it now it looks like we're silencing people and that's what makes me incredibly uncomfortable. Thank you.

Um, at this point, I'm kind of more apt to vote for more time because I feel like if the meeting is going to go anything like the way the PLLD meeting went where everybody showed up against removing this and the communication I have received, it seems that it tends to uh land in favor of opposing any sort of amendment. So, I guess at this point, if the question is silencing the majority of these people that most of us haven't heard from or continuing to have conversations in PLLD, I guess I'll change my vote because I just that's not the question here. That wasn't the question. There is no silencing people. People can communicate with the city and us as counselors whenever they want. That is what we're here for. But if people feel silenced, we're totally here to hear it again. So, I've changed my mind. the second time. Councelor Workman.
Thank you. Um I just want to remind folks um again this communication when it goes back to PLLD, it's going back to a committee that three of the authors sit on. So that's a majority. That's three out of five of the counselors. Um the whole thing just seems shady as all get out. the fact that again this communication even got to this point um the way that it was delivered and um again the the public had their opportunity to speak. We're not silencing anybody. Uh they had an opportunity to raise a point again back in the summer and the fall of 2025 when this was being debated and deliberated. Um, and then they had an opportunity for the last two weeks to reach out to 15 of us. Um, and we know as counselors, I've been on council since 2020. We get the mass emails. When something's really important to someone, they CC all 15 of us, the city clerk, usually the mayor. We did not receive any of that. So I I know because I didn't receive it. So I know it didn't go out as a whole to the 15 of us and the mayor like most things do when the c when the community feels strongly about it one way or another. So I just want to keep that in mind. This right now this discussion is monopolizing a majority of the council meeting. we're wasting resources and staff time right now. Um, so I hope you
again support the amendment uh and accept it asformational on the amendment on the amendment.
Yeah, the word shady I I I take offense to. This council has never been shady and the 27 years I've been on the council has never been shady. We all do the best we can for our constituents. So I take serious offense to the word shady. Um I am a stickler for the rules of order and if anybody wants to challenge me on a rule of order bring it up. Decorum and rule of order I strictly follow and I never deviate from that. When we talk the only thing we have here we all know maybe the newer councils don't realize it when something is accepted as informationational it means trash can. We all know that accepted as informationational it's gone. At least more time allows conversation. And how dare we say enough people have spoken. Who the hell are we to say that now? Yeah, you're right. They don't all call of us at once. They call of us on different things. I know councelor Chad once called me and said, "Did you hear from this person?" No, I didn't. We've all hear from different people. That's just the way city council goes. We have different connections. It happens. Not everybody sends out mass emails to all of us. Um, and the one example I've heard is, "Well, we've done this. Let's give it another year. We'll wait for it later." And I bring back the example of the green space on Church Street. We had a motion. We worked on it for a couple of months. We were at the end of it. We overturned it based on allowing more time for people that hadn't had a chance to speak yet. We could have said, "You've had three months to speak on this. We don't need to hear anymore. We're the city council. We know better." This is a perfect example of that for us to say, "You had your two months or whatever. We don't need to hear what you said. We know better." BS. We listen to this. We put it on more time. It may come back just the way it went back out, but we're going to do it by listening to the people that we represent. This goes on more time.

One thing that feels a little confusing to me is just that the letter cited the land development code, but the convers like recent changes and cited specific sections, but those didn't seem to be exactly the topic of the conversation. It seemed to be the ordinance that changed in part those couple of things. So, it also changed all of these other things and I'm that's where I'm just kind of is it about the ordinance maybe? Yes.
So, just to clarify on that question because we're talking about an item submitted by somebody to city council and it hasn't been acted on or changed in any way, you have that letter. That is the item. Um, for it to be clarified, it would it would just need to be the authors that either resubmit it or added something else to it. But um traditionally when something gets submitted in council, you take it as it comes to you. Councelor Favlliss.

I I'm not sure short of voting in favor of this motion in front of us right now there. If we don't do that, there is an unlimited number of motions that we could could continue to be offered on the floor by counselors. Here we have had a vote to not on the underlying question itself offormational, but I think essentially a proxy vote for whether or not the council wants this asformational. We also had a vote uh about more time. Neither one of those moved forward. And so we're now in a place of needing to dispense with the item in front of us. We have an item in front of us that we need to dispense with. I don't know that there is a better alternative that hasn't already been tried tonight that is going to move us forward from this item and into what I understand to be uh multiple non-publiclix and other business that this body has to get through tonight. And so I again, you know, the the vote now for me is less about what do I think about the merits of of this ordinance. It's not even really at this point about what I think about the merits of more time or not. The item needs to be dispensed with and I'm not sure there's another motion out there that is going to be able to get a majority. We could be here for quite some time. Um, just just as a point of order in general, maybe don't do that because that was a shocking statement to hear was that people would vote on something they were confused about the outcome of. It all all that we've asked for from PLLD uh is to get some more discussion about it and get some more information about it. But let's uh I hope we can table it and uh come back to it appropriately. And you know, if we come back to it and there's no more information and there's no more light to be shown on any of what went on while that went went down and the processes that we went through the 8 to7 votes, the tide votes there. We don't like tied votes here. We don't like close votes here. We shouldn't we should be more definite and be more aligned with each other. If we have that kind of ti close vote 8 to7s, those are things where maybe we need to step back and think about it a little more and see what uh we misunderstood. I I I know what uh most of the members of PLLD, nobody's got their mind made up on this as an ordinance. Um you know, it got passed. So be it. They got passed. Does is it worth thinking about again and shining some light on what went on and how the votes went? As I said, two to two out of council, out of committee, and then 8 to seven on the floor.
