This is located at 2304 Crystal Street, the former military museum. As you can see from the agenda, this item has been on the agenda since last December. It's been tabled since last December. We've had no action, no movement by the petitioner to get his building or his stuff in order. So we informed Mr. Drews that we were going to dismiss this if we didn't see some noticeable progress. You've got his email there with your short staff report. Okay. He understands and he will refile when the time is appropriate. So I would ask this first one, petition 2225, be brought off the table and dismissed.

This was initially continued because we didn't have the owner here, Mr. Roger Shute. Last month, Mr. Shute hired an attorney at a late date, and the attorney asked for a continuance last month. And just in the last hour and a half, the attorney called me and said he had written down the wrong date for tonight's meeting as being next week. So he asked for a second continuance. So... Staff is fine with allowing the subsequent continuance and hearing this on July 28th. It's our next meeting.

We continued this after somewhat lengthy discussion last month. We wanted more clarification from the owner concerning any changes she was going to do to the structure to create a duplex. Sent her a lengthy list of items to bring to us. We waited, we waited, we didn't hear anything from her. Then her architect called us and asked for additional time, 30, maybe 60 days. So again, they're asking for a continuance for petition 626 so they can have more time for design of their plans for this site.

If they're never intending on building on that northern end of it, it could have turned into a different plant. That seemed to me like the way to win, to take care of what we would be concerned with. I actually did call Tyler after the meeting and suggest that to him as well. What was his response? He didn't have a problem. He said there were people who were supposed to be meeting with our staff the next day or two, but he didn't seem to have a problem with that. I don't know if he's been guided in a different way now.

I think they were just trying to match up their current zoning with the back piece that had a residential zoning. So they were just trying to coordinate things to be under the same zoning. But they've expressed the opinion that they really don't intend to do any construction back there, that everything they're wanting to do is remodel or expand the office up front so they have a little more room. And if they do double the size of the transfer station, they realize they need to go back before the Board of Zoning appeals in order for that to happen. So there are checks and balances here.
