All right, good morning. We are live on the channel, so we'll go ahead and call the June 3rd, 2025 Aya Planning Commission to order. Um, roll call. Mr. Aiden, Mr. Battle present. Mr. Hubard here. Number five, no new business. Number six, uh we have old business. So, as the committee knows, we are changing the meeting dates uh from the first Tuesday of the month to the second Tuesday of month starting, I believe, in July. Uh, and that is to correspond for better correlation with city council CD. But Mr. Snowing, do you want to weigh in on that? Yeah, thank you. Through you, um, the dates uh, historically have had issues in terms of uh, coordination as you indicated with city council. So what we're doing is we're moving this to the second week to ensure that everything is properly referred by city council in case they fall on the same date. Of course, planning commission is held the day or rather earlier in the day before city council occurs. Therefore, it can't be properly referred. Uh so that's the gist of the whole thing. We have two public hearings this morning. The first one is 2025-100051. Rodney Hilton, 131 William Street and 322 Sumar Street, Liry, Ohio, requesting a reszone of parcels 0625
068, 102006 and 007 and 008, 009, 010, 011 from R-TH residential 2 household to L-IT industrial and parcels 0625010219 0625 5 068102 and 0625691020006 from HI heavy industrial to LI light industrial um committees Mr. Farcus Mr. Chair through you I will defer to Mr. Shing for the zoning report thank you Mr. showing. Thank you through you. This uh application was previously heard on April 1st, 2025. Unfortunately, there was technical errors in terms of the advertising for this uh not being compliant with the uh city code. Therefore, uh this needs to be reheard. Uh all parcels you indicated previously uh are having a request of reszoning of RTH or HI heavy industrial and RTH residential to household to the light industrial category. Uh the site is intended to house commercial asphalt vehicles and office space for the company. The applicant has indicated that no hazardous noxious chemicals or substances will be housed on the property. Uh our findings indicate that uh this would not result in a spot zoning as parcels to the west of the subject site have a zoning designation of LI uh and it fits with the spirit and intent of the zoning code. This report or rather this application was routed to several city departments including our uh engineering department, fire uh
marshall as well as the wastewater department. Um there was no issues uh no concerns from the city engineer and the fire fire marshall indicated um that any concerns will be addressed during the construction plan review phase. The wastewater department did indicate uh some concerns with this. Uh based on the information provided appears the site will be uh used exclusively for vehicle and equipment storage. uh from their perspective uh they want to ensure that sanitary discharge only uh must connect to the municipal sewer in compliance with the sewer ordinance. Uh vehicle washing. If the applicant intends to perform any on-site vehicle or equipment washing in the future, this could introduce oily or sediment uh material to the uh uh water systems. Um uh this is all indicated in the report. But in conclusion, uh we are recommending approval of the resoning based on the spirit intent of the zoning code. Uh but caution the commission that there will be no control in terms of the permitted uses under the LI zoning district. Uh and of final note here, uh there is a need for variances moving forward with this product. Uh that was uh brought forth to the applicants. Mr. Shy, thank you through you. Uh this is the final plat approval. This was uh previously approved as a preliminary subdivision plan on November 4th, 2020. Uh the area is currently zoned residential medium density um as indicated on the zoning map and the site plan provided in your staff report. U it should be of note that the cover sheet for the submitted final plat drawing indicates the property is zoned residential low density. This is the previous uh zoning district for this area. Uh that correction should be made before um any recording with the county. In terms of comments, when this was distributed to city departments, uh no comments provided uh for engineering in reference to the above uh final plat proposed, the final uh the fire bureau had no objections and there was no comments from the wastewater department. Uh we are recommending approval of this as it meets the requirements of the RMD district as well as the cluster development standards and therefore recommend approval. Thank you, Mr. Showning. Schneider? Yes, Mr. Chairman. Uh the developer has completed all the improvements as far as the city requires storm sewer, sanitary sewer, water line, uh as well as the road has been poured. The only items that aren't complete are the sidewalks and the uh uh street lights, which are typical in a subdivision, and you know, those typically come when the houses are being built.
