Okay, I'm here.

0:07 – 0:22GABRIEL FERNANDEZ

Good evening, ladies and gentlemen. Welcome to the regular council meeting. Today is January 15th. We will call to order at 631. Can we please rise for the invocation led by Elizabeth Taylor Martinez and the Pledge of Allegiance.

0:25 – 1:28ELIZABETH TAYLOR-MARTINEZ

Heavenly Father, as always, we thank you for the many blessings of our lives. for our families, for our friends, our neighbors, for our community, for everything that we enjoy in this country. We also ask that you send your angels to be with those who have suffered a loss in the passing of Councilmember Richard Black, and to watch over his wife, Esther Black, and his children and grandchildren. We ask, too, that you watch over our police, our firefighters, our EMTs, and our servicemen and women as they labor around the world. We ask for this and more in the name of your Son, our Savior, Jesus Christ. Amen. I pledge allegiance to the flag of the United States of America and to the republic for which it stands, one nation, under God, indivisible, with liberty and justice for all. Amen.

1:32 – 2:30GABRIEL FERNANDEZ

Okay, Madam Clerk, can we please do a roll call? On to meeting notices, nothing to report. There's no presentations to report. Do we have any citizens' comments? On to the next, announcements of amendments, corrections to the agenda, nothing to report. Next, we have the regular council meeting, approval of the minutes for the regular council meeting that was held November 20th, 2020. So moved. We have a motion on the floor by Councilman Arcee and a second by Councilwoman Conover. Any other discussion? All those in favor say aye. Aye. All those opposed? Motion passes. On to Mayor's report. Mr. Mayor?

2:30 – 3:46FRED SPENCER DENO IV

Thank you, Council President. So the first item I have on agenda is Mommy Day Days in Tallahassee. It's scheduled for February 10th and 11th. So if you are planning on going, let Rich know. She'll probably be doing it here real soon, signing everybody up. The second item I do have, normally I bring this up under good and welfare, but something we're going to be discussing here in a minute. But before I get on to that, our condolences to the Howard family. And, you know, we lost a few good ones in the last – A month or so. So, the Tower of Harkin-Dolem. It was a fixture here for many years. So the second one I have is Compton Block. Another fixture that we've had here for many, many years. Wrong paper. Do you have the paperwork for the resignation? Okay, so I did receive his resignation about a month and a half ago. I wanted to accept it. I didn't even open the envelope until I think it was, I don't even know what day it was. The day of the soccer banquet, Monday. Was it Monday? Monday. So I'll wait for Wednesday.

4:06 – 5:26Speaker 1

From Richard Block to Mayor Spencer Dino, subject resignation from office, Councilman. Dear Spencer, I write this letter to inform you of my intention to resign from my elected position as Councilman when health conditions make it impossible for me to fulfill my duties. I expect this to be by the end of the year or sooner. I want to let you, George Arcee, Deborah Conover, Gabriel Fernandez, Elizabeth Tilla Martinez, Maritza Fernandez, Macbeth Araque, Loyla Losarcos, Guillermo Cuadra, Chief Ray Hernandez, and all of the other employees of our village of my heartfelt thanks for making me a member of our village family over all these years. I know sometimes over the years that I have been over the top with my pronouncements, yet all these things were overlooked and responded by your kindness and love. For that I am ever grateful. I have been blessed by our Creator for having you all surround me with your kindness. I know all of you will keep the village going in the right direction. Forever grateful, Richard Block, Councilman, Virginia Gardens.

5:28 – 5:43FRED SPENCER DENO IV

Okay, thank you. And, yeah, we're going to miss him up here, that's for sure. His service will be on Thursday at 11 a.m. at the Methodist Church, the Poinsettia Methodist Church on Royal Poinsettia there.

5:55Speaker 6

Take your time.

5:58 – 6:12JORGE ARCE

Remember, he told us to buckle up. What was the name that he told me? Put your big black pants on. Yeah, I kissed him by and I started crying. I started crying. That's what he said to me. Big breath. Yeah.

6:12 – 6:26ELIZABETH TAYLOR-MARTINEZ

Right to the end. Right to the end. So yeah, we knew it was coming.

6:26 – 6:49FRED SPENCER DENO IV

It's just rough trying to talk about it. But we'll have a celebration of life here afterwards. So when we're done with the service, the family will be here. We invited everybody else to come up here to City Hall. And we'll do our celebration of life here at City Hall for our Councilman Richard Block. Other than that, Definitely going to miss having that little feisty guy over here.

6:50Speaker 6

That's for sure.

6:52 – 7:04FRED SPENCER DENO IV

I think he apologized more than anybody else I know. He would say things, and then an hour later, he'd call me up. I'm sorry. I should have talked to you before that.

7:06 – 7:17FRED SPENCER DENO IV

And the older he got, the more, I wouldn't say feistier, but I heard a video last night. I think the mayor of Homestead said he was – He wasn't, he didn't, what was it, politically?

7:18Speaker 6

No, it was, he didn't speak.

7:21GABRIEL FERNANDEZ

Yeah, he spoke his mind.

7:23FRED SPENCER DENO IV

Spoke his mind. He didn't sugarcoat it. He didn't go around the bush. He didn't sugarcoat things. Yeah. Sometimes a little bit too much, but it's okay.

7:31ELIZABETH TAYLOR-MARTINEZ

Yeah, but you had to consider before. Yeah.

7:34 – 8:12FRED SPENCER DENO IV

So we'll definitely miss him. You know, my neighbor also, my wife moved in my house, my parents' house. My neighbor actually, when I moved in, to my house. She was 106 years old. She just passed away two weeks ago. Lola. Yeah, Lola passed away. And my wife, every once in a while now, she would say, you know what? Why is she still alive? I mean, 106 years old. So a week before she passed, right before Christmas, my wife texted me. She goes, you're not going to leave this house. I just left. I just left Lola's house. She was in there for about 20 minutes. Or my daughter. There was another feisty one. Yeah, she was.

8:13JORGE ARCE

I've seen her walking. She used to walk up and down the street.

8:16FRED SPENCER DENO IV

Yeah, I think she's the oldest person. She's definitely the oldest person alive in Virginia Gardens, that's for sure. And I think we still have a 103-year-old, right?

8:32FRED SPENCER DENO IV

No, no, you weren't even listening.

8:33ELIZABETH TAYLOR-MARTINEZ

You weren't listening.

8:36 – 8:57FRED SPENCER DENO IV

I love them. Yeah. She's 103, right? So we got some longevity inside this village here, that's for sure. So if you want to live a long life, come move to the village. It's not advertised that way. And don't get on the council.

8:58JORGE ARCE

I want to break that record. I really do. 106?

9:06GABRIEL FERNANDEZ

So Richard did ask me to ask a question at the meeting, where are we with the app?

9:12FRED SPENCER DENO IV

That's all he wanted to know. Are you serious? We're working on it. We're working. Still working on it? Yeah, we're working.

9:17GABRIEL FERNANDEZ

All right. Just want to make sure it's still ball rolling.

9:20FRED SPENCER DENO IV

We've got to get that one back up.

9:22Speaker 4

We've got to get it up.

9:24 – 9:51FRED SPENCER DENO IV

And I know Hector will be up in a few minutes, but I would like to thank the Village Hardware Store. They've donated gift certificates for our winners for the Christmas, which Hector will be presenting here in a few minutes. So thank you to the Village Hardware Store as well. been doing a lot of work. The new owners over there trying to bring in business, keep the business going. It's a young couple who took over from Steve, who was with us for 50 plus years.

9:53 – 10:08JORGE ARCE

Other than that, why don't you explain in a nutshell what this thing that you wanted to update it with? The app? The app. Oh. So these people know what we're talking about. I don't think they really know.

10:08 – 10:57FRED SPENCER DENO IV

Well, you want an app so residents can go online and see a pothole or to report their neighbors or something else. And it's just not feasible for the village. We looked at it. We've had, you know, we're such a small village. You can call City Hall and you don't get transferred to Miami-Dade County from 9 to 5. You go straight to Village Hall. and you get a live person. Yeah, more of a personal touch. Yeah, more of a personal touch. And, you know, just going to work out right now. Maybe one day it will. You know, we did have a meeting about a year and a half ago. I know McBeth, I think, was on the call with me. And, you know, just the upkeep alone and the money we would cost, it wasn't feasible. So he'd bug me every damn month, at least every month, about a nap.

11:00 – 11:15FRED SPENCER DENO IV

That's about it. I think that's all I have. Our Soccer Awards Banquet. We had our Soccer Awards Banquet on Monday. We had a great turnout. I mean, a huge turnout. It hasn't rained in a month, and it rained all around us. But not here. Luckily, it didn't rain. It was like a light mist almost.

11:15ELIZABETH TAYLOR-MARTINEZ

If it had been colder, we would have had a very light turnout.

11:19 – 11:42FRED SPENCER DENO IV

Yeah, it was like a mist, and it worked out great. The weather was fantastic. And, of course, Tuesday it rained almost all day, at least a drizzle. Even at 630, I went to Milam's for a minute, picked something up. I got home, and it was actually coming down a little bit. I was like, thank God. It worked out really well. It was a nice turnout. So that's all I have, Council President.

11:42GABRIEL FERNANDEZ

On to administration, nothing to report.

11:44FRED SPENCER DENO IV

Beautification, Mr. Hector Martinez.

11:50Speaker 6

Good evening, Mayor and Council.

11:51GABRIEL FERNANDEZ

Good evening. You should have two sets of minutes.

11:54Speaker 6

The first one is the December minutes. Any questions on that?

12:03FRED SPENCER DENO IV

It's Free City USA. That's already been sent in?

12:06 – 12:58Speaker 6

No, no. It's in progress. I already went online and started it. I already spoke with with the receipts. No questions there? That first one, We've been going back and forth with the first man there for several months. It actually goes back to April. I already trimmed the tree. The neighbor called me about trimming the tree. It was over his yard. So I trimmed the tree. I'm not just going to trim the branch over his yard. I did the whole tree. So the month later, he calls me. He wants the tree trimmed. Then he calls a month later. He says, let's tree out. Oh, he wanted the tree down 15 feet. And he keeps on calling. Now he wants the tree trimmed. So I'm going to trim it. I'm going to go look at it and see what he wants.

12:59 – 13:46FRED SPENCER DENO IV

Okay. Nothing else? You know, I know a while back we talked about removing, especially black olive trees, like six a year. And it was a big ordeal because when we started removing trees, you had to go through DERM. It was a big mess. But now if we have a certified arborist in a day, agrees the tree needs to be removed, we can go ahead and remove them. So we might need to go back and revisit that. We don't want to take six out on one block, but maybe one on the east side, one in the central, one on the west, and move it around and start planning some new ones. I know we applied for a tree grant recently, and there was like 26 trees or something we were looking for. So we should receive that grant. I hope so. Do we have a list going for people that want trees?

13:46Speaker 6

Yeah, I already turned it in.

13:47FRED SPENCER DENO IV

Okay. That was part of the tree, part of the grant review plan. Okay.

13:53Speaker 6

Yeah, we bought extra trees regardless of the list. We have a few extras. Perfect. You know, people still show up and we have spots we could throw some in.

14:02GABRIEL FERNANDEZ

Perfect. No, the worst case scenario, if we have extras, if we take out other trees, we can just put those right in the same spot.

14:08FRED SPENCER DENO IV

Yeah, exactly. And it worked out great with... Kenilwood Sweets, they donated those black olive trees to us, and we replanted them along the canal bank.

14:16Speaker 6

Yeah, they're doing well.

14:17FRED SPENCER DENO IV

They're doing really well.

14:18Speaker 6

And we still have one that we got donated from .

14:25Speaker 6

That's going to come over soon.

14:29GABRIEL FERNANDEZ

So that was the Christmas holiday displays.

14:31 – 14:42Speaker 6

Next set of minutes is my winners for my Christmas display. First place is Lillian Venegas of 63-42. Northwest 38th Terrace.

14:45FRED SPENCER DENO IV

So besides... Come on up, come on up, come on up.

14:50Speaker 6

Besides our city gift card, Village Hardware decided to donate this year also. So they're gonna receive two gift cards.

14:59 – 15:17FRED SPENCER DENO IV

Okay, nice. And letter holder certificate. Yes. And Village Hardware. So the village donated gift cards as well and the village card.

15:17Speaker 6

They donated like a voucher.

15:19FRED SPENCER DENO IV

Voucher. Used in the store.

15:21Speaker 6

So that's right.

15:29FRED SPENCER DENO IV

Second place. Stay there, Joel. Stay there. Thank you.

15:31 – 15:42Speaker 6

Congratulations. Second place is Robert. Thank you, Kathy. Gonzalez of 66-55, Northwest 39th Street.

15:48FRED SPENCER DENO IV

And Rob, you almost got it, Rob. You almost got it. Next year, next year, your year. Maybe next year.

15:53 – 16:19Speaker 6

So here's from our city hall. And third place is Erasmo and Teresa Rodriguez of 6610 Northwest 40th Street.

16:34FRED SPENCER DENO IV

And there you go. Thank you.

16:37Speaker 6

And all three of them had a beautiful... Yeah.

16:39FRED SPENCER DENO IV

That was some tough competition this year, that's for sure. It really was.

16:47Speaker 6

Next set of minutes is January.

16:53FRED SPENCER DENO IV

Oh, I guess I didn't go far enough.

16:55Speaker 6

Any questions there?

16:55FRED SPENCER DENO IV

Next one. Next one. Holy cow. You got a lot of stuff going on here. Yeah.

17:01Speaker 6

Yeah, the phone never stops.

17:02FRED SPENCER DENO IV

Didn't we already do this one? Oh, it's the same guy, okay.

17:05Speaker 6

Yeah, it's the same guy.

17:09 – 17:24Speaker 6

It's funny because it's like, please call him. He said he called you. I'm like, he's never called me. But okay, I'll call him. I'll go by and see him. Yes, yes, yeah.

17:27Speaker 6

The same guy, yeah. He wants to meet with you.

17:35 – 17:48Speaker 6

And number five there, I think when she called me and I spoke to her, I vaguely remember her calling me a year or two ago with that same issue.

17:50 – 18:10FRED SPENCER DENO IV

Unfortunately, the trees in the neighbor's yard, and let me tell you, those trees are beautiful. But when they start dropping their leaves, it's like snow. Not just the leaves, the flowers. Anything hanging on her side, she can trim. But if it's on private property, we can't do anything about it. No, I know.

18:11Speaker 6

Outside on the soil is a green buttonwood that really doesn't look in good shape.

18:16Speaker 6

I might just take it out and put it in.

18:20FRED SPENCER DENO IV

Well, what's the answer? There's nothing we can do with that.

18:22Speaker 6

I can't, no. It's inside his front yard. Anything else?

18:29GABRIEL FERNANDEZ

No. Thank you very much. On to planning and zoning. No meeting for the month of December.

18:36 – 19:15FRED SPENCER DENO IV

I do have two more things to bring up here. I completely forgot. Oh, of course. Of course you did. We need to schedule a special meeting for next week. We have two items. One is our ball field contractor. We've had some issues out there over the last, ever since they turned it over to us. with some sinkholes. They come back to repair it. Other areas, we have quite a few areas that they've had to come back to repair. And after all my emails I've sent recently and text messages, they kind of stopped responding to me. So we might need to pursue litigation with that company.

19:16GABRIEL FERNANDEZ

I was just going to say.

19:17 – 19:37FRED SPENCER DENO IV

It's not a little company. I mean, you go to their website, Land Tech, right now. They're the ones who did it here in Miami. They've done... all the stadiums of the Northeast area, New York, they're from New York, Florida, all the way down to Florida. So it's time that we, we already sent the first letter about a month ago, I'd say.

19:37Speaker 2

A little more than a month ago.

19:39 – 19:50FRED SPENCER DENO IV

A little more than a month. They weren't responsive. The second letter went out yesterday. So now it's time to pursue our legal action, so we're

19:53JORGE ARCE

These bumps that you see out here, are they safe? I mean, are we going to have any issues with somebody getting hurt?

20:00 – 20:31FRED SPENCER DENO IV

I mean, they came back and repaired it, but it's like buying a brand new car. It always has kinks. It's got a little kink in it, and the kink is not new anymore. So we need to make sure we... They need to come out and make it right as far as it's good. It's not like we designed the project. We did drainage or engineering. They had it from scratch. They had the project from day one. They did engineering. They did design, engineering, the work, and we're having some issues out there.

20:32JORGE ARCE

And if I remember correctly, they were ahead of time, right, finishing it and everything?

20:37 – 20:49FRED SPENCER DENO IV

I don't even know about that, to be honest. It was on time. It was normal. So, I mean, there's a lot of theories as to why it's not working, but either way. They didn't make it right.

20:50GABRIEL FERNANDEZ

So we're going to be having a special meeting to select a new contractor?

20:53FRED SPENCER DENO IV

No. Oh. Discuss litigation. Got it.

20:57Speaker 2

Mr. President?

20:59 – 21:16Speaker 2

To that end, Mr. Mayor, we would need to do that in an executive session, so I'll coordinate that with the clerk. But what we do need to do now is basically set a time and date for that executive session if we are to discuss litigation.

21:17FRED SPENCER DENO IV

It can't be Thursday. So is Wednesday too soon?

21:24GABRIEL FERNANDEZ

I believe it's too soon. And then we went into the following week.

21:31 – 21:59FRED SPENCER DENO IV

It would have to be the following week then. Wait, let me look at my calendar real quick here. How about Tuesday the 3rd? For the following week is the 26th through the 29th. Oh, sorry. Or the 27th of Tuesday. You'd rather do it on Monday or Tuesday? I really don't care. It don't matter to me. I'm fine.

21:59Speaker 1

I'm open the week.

22:01FRED SPENCER DENO IV

Monday the 26th. What time can you be here?

22:06GABRIEL FERNANDEZ

Can you come before this? 5.30. I might be able to come sooner.

22:12FRED SPENCER DENO IV

There's a schedule? No. Sure.

22:20FRED SPENCER DENO IV

5 o'clock. Sure. I'll figure it out. 5 o'clock. Are you okay there? Yes. Can you make it here by Walmart that soon? Take the time? Yeah.

22:28JORGE ARCE

You just leave over there by 4.

22:35ELIZABETH TAYLOR-MARTINEZ

Don't ever let this down.

22:37JORGE ARCE

So the 27th. I'm not the only one that's been late.

22:41ELIZABETH TAYLOR-MARTINEZ

No, you're not being late.

22:50 – 23:22FRED SPENCER DENO IV

So on that same day we do that special, that meeting there, I'm going to be looking at appointing somebody to the council. It's not appointing. It's my recommendation to the council, and then the council gets a vote on it. So what happens is if we had somebody that ran previously, the second place person would automatically detain them. be given the option to go in that position. Since everybody ran unopposed last time, it's my recommendation and the council gets to vote on it.

23:22ELIZABETH TAYLOR-MARTINEZ

You're in until August or November?

23:25 – 23:38FRED SPENCER DENO IV

August. Is it November? We changed it. We have elections in August, too, but it is November. You're correct. It'll be November. That person will finish out the term of

23:45JORGE ARCE

Are we going to have before the week, yes or no, any kind of information about this person, where he's been, what he's done, or her? Absolutely. Oh, it's her.

23:55FRED SPENCER DENO IV

I don't know yet. That's what we're going to decide. We've got a week. I've got a week and a half. So yeah, you will have that information.

24:03ELIZABETH TAYLOR-MARTINEZ

OK. I'll put it in my calendar.

24:07 – 24:22FRED SPENCER DENO IV

So put it in your calendar. And I think that's it. So go ahead and if you can work on getting somebody here. Does it need to be a client, like a closed-door session for that?

24:22 – 24:55Speaker 2

If litigation is going to be discussed, again, because it's litigation, it would have to be in a closed-door executive session with someone to prescribe the record, a court reporter, essentially. If the council wants to discuss options and not go into detail about litigation or litigation strategy, then you would not need a closed session. So it all depends on what the council wants to do.

24:55 – 25:11FRED SPENCER DENO IV

So there's really no options because they're not responding to any messaging from myself or you or the recreation director. So I stopped. Once you sent that letter, I stopped communicating because you already sent the letter. Yes. So there's really no options. So we are going to be discussing litigation.

25:11Speaker 2

So the closed session would be in order.

25:13FRED SPENCER DENO IV

Yeah, and that's the only thing we'd be discussing. The other part would be a meeting afterwards. Correct. So I would just say we schedule it for 5.30, 1 at 5 o'clock and 1 at 5.30.

25:24ELIZABETH TAYLOR-MARTINEZ

Have we sent the communications to them?

25:29FRED SPENCER DENO IV

I can't say it again. Certified mail.

25:34ELIZABETH TAYLOR-MARTINEZ

Did we get the proof? Of course, yes.

25:37FRED SPENCER DENO IV

We know someone at the post office.

25:40ELIZABETH TAYLOR-MARTINEZ

Well, I know that, but I'm like, I don't know.

25:41FRED SPENCER DENO IV

We have certification. We track it. We always send it tracking. Okay, good. Yeah. They receive it.

25:49GABRIEL FERNANDEZ

Any other discussion on that? On to public safety. Chief? Our attorney does have a question for you, Mr. Chief.

26:00 – 26:12Speaker 4

But I do have, Council Mayor, Council President, I do have a new app. You do? Yes. Which app is that? The city clerk forgot to put it in the agenda.

26:13Speaker 4

Yeah. I gave it to her on Monday, but she's very busy. Are you done, sir? Are you done? Yeah, I'm done.

26:20ELIZABETH TAYLOR-MARTINEZ

I think you're overdone. Listen, we don't need no more jokes.

26:28GABRIEL FERNANDEZ

All right, Mr. Attorney, did you have a question?

26:32 – 26:51Speaker 2

Yes. More of an observation. Thank you very much. I appreciate it. Thank you. Hey, I got it. The observation is Councilman Arcee is the only one that has for water, French artisanal water sparkling on his sitting area.

26:54Speaker 4

Sir, for your information, that water was provided to him by himself. I did not put that there. He brought it. Interesting. I saw you bring it.

27:04FRED SPENCER DENO IV

Is that camera right behind you?

27:06ELIZABETH TAYLOR-MARTINEZ

Okay, I'm looking at the camera. Okay. Up there.

27:12Speaker 6

It's just too high. Leave him alone.

27:14JORGE ARCE

Come on, you guys. Leave him alone.

27:21Speaker 2

I'm expecting Pellegrino next.

27:24FRED SPENCER DENO IV

With the stats here, I will say one thing. You got somebody out there working, huh? Ricardo Bandini, 102?

27:33Speaker 4

He's a worker. He's a good worker.

27:39 – 27:51JORGE ARCE

That's a big difference. There's something about this meeting that it's just all these eye contacts supposed to be talking back and forth to each other, and I don't get it. I need some water you're drinking.

27:51Speaker 4

Welcome in, George Arce. Lázaro back there that the chief provided.

27:56JORGE ARCE

Lázaro? Yeah.

27:57Speaker 4

He's not here today. He didn't come. He was there a minute ago.

28:01 – 28:21JORGE ARCE

He's up on our public works. Oh, okay. Well, that was going to be good. The electric cars, the pickup trucks. Okay. What do you call that thing where they back into it on the ground? Parking bumper. The parking bumper shouldn't be moved back about a foot. You can't.

28:22JORGE ARCE

Yeah, you got room.

28:24Speaker 4

No, the bumper will hit the wall.

28:27JORGE ARCE

I don't think so because I checked it.

28:30GABRIEL FERNANDEZ

We can do a follow-up meeting with the two of you out there in about 20 minutes.

28:35Speaker 6

You guys could field measure the...

28:41Speaker 4

I'll talk to Laz.

28:43Speaker 2

Is it the water?

28:45JORGE ARCE

Well, anyway, they stick on the sidewalk like about a foot, so I'll leave that alone.

28:52FRED SPENCER DENO IV

But unfortunately, those vehicles are larger than what we had before. That's why. And if you look at the back bumper... It's only like freaking six.

29:01Speaker 4

Yeah, and Councilman Arce, most of the vehicles are parked, almost all of them are constantly parked at Boeing. We just bring them here to charge, and then we move them over there.

29:10JORGE ARCE

Yeah, but you don't have a charger, so they need to park here anyway.

29:15Speaker 4

Yeah, but it might be just for a couple hours. Usually I move them. On a daily basis, that space is open.

29:20FRED SPENCER DENO IV

Very well. But after the meeting, you guys can go out there and discuss it.

29:24GABRIEL FERNANDEZ

Yeah, I still think you guys can measure it. to get more clarification as to how much space you have there.

29:30FRED SPENCER DENO IV

Thank you, Chief. Appreciate it. Thank you. Thank you, Chief. Bye, dear.

29:34GABRIEL FERNANDEZ

On to Public Works.

29:42 – 31:10Speaker 7

Good evening, Mayor, Council. Good evening, sir. Just an update. As you all know, FPO is going underground. You see a lot of surveyors, a lot of people walking around. Now comes public works side where we start marking all the utilities, water, storm drain, power that belongs to us. So you're going to notice a lot of markings in the street, kind of like graffiti, right? You know about that. So, I mean, it's mandatory for us to locate, so we do have to mark. We just can't do little dots, but we have to actually mark it so they know exactly where our utility lines are at. The gas company does their own. Our end is water, storm drain, and any electrical that belongs to us, like 64, 40, 67, stuff like that. You're going to see a lot of companies in here marking their utilities. There's going to be a lot of markings. Sometimes you go to other cities and you're like, see, what are all these markings? We're going to experience that, but it's water-based. It does, to solve it, takes a little bit. With the rains and the cars, they'll start fading away. What are you doing in phases, as in one side of the village first? Right now, they're concentrating from 6-2 to 6-4, from 3-7 terrace to 40 first.

31:10 – 31:26FRED SPENCER DENO IV

That's the first phase. Which is kind of good because we're going to have all the equipment and trucks in there. That's part of our water project, too, stormwater project. So that's one of the reasons why. They're constructing that area right now. I'm going to talk about that in a second, but go ahead.

31:26 – 31:53Speaker 7

Yeah, so that's what we're getting into now. They're starting mid-February, so you're going to see a lot of movement, a lot of contractors, a lot of directional boring, a lot of equipment. But once everything's said and done, it's going to be better. Everybody's going to be on the ground. Overhead power lines are going to disappear in some places, and everything will be good. Any questions? Good to hear.

31:54 – 32:12JORGE ARCE

I just want to make a comment. When I said that about the parking bumpers, let me tell you that when you stole them and put the Virginia Garden Police and all that, the chief took me out there. He was so proud of that job that you did that he took me out there and showed me, look, look what Lazaro did. No, not me.

32:12Speaker 7

It's team effort, not me.

32:16JORGE ARCE

Anyway, this parking, I noticed it's after the fact, but

32:20Speaker 7

You're doing a great job.

32:21 – 33:03FRED SPENCER DENO IV

Thank you, sir. Thank you. Thank you. Okay, before you go, Lars, hold on one second. So right now, I've got the dates today. I think it changed a little bit from what we talked about yesterday about the advertisement dates. So we're looking at advertising on January 28th for the Central Drainage Improvement Project. That's going to be from 64 to 62, 37 to 40th Street, which is your block, all the way down all those streets. So the advertisement will go out January 28th, the pre-bid meeting will be February 4th, and the bid due date would be, right now it says February 11th, that's a Wednesday, but I think we're going to change that to the 13th, to a Friday.

33:04Speaker 2

That's for the water project? Correct, stormwater project, yes.

33:08 – 33:35FRED SPENCER DENO IV

So by the time they get the bids, go through the bids, you're looking at awarding it, we'll be at our February council meeting, pre-construction meeting, If I coincide with this SPL project, it's going to be pretty close to it. So I might be able to hold off a month or two, but other than that, we'll be intertwined with this project. Yeah, but that SPL project is going to be how long? It's going to be a long project.

33:36GABRIEL FERNANDEZ

Phases, obviously, but they're going to be buffed up together from one phase to the next phase, and it's going to start right after.

33:43 – 33:55Speaker 7

Right. But luckily, they're starting our phase, because we've got milling and paving, so... After everything's said and done, this area is going to be completely new, you know, renovated.

33:56 – 34:11GABRIEL FERNANDEZ

The good news in my opinion about everything apart from the project itself, the fact that we're locating everything because of the FPL project, I think is going to really help us in the future. We already have all the locates of our underground infrastructure, really.

34:12FRED SPENCER DENO IV

Well, our water atlas is being GISed here.

34:16 – 34:28FRED SPENCER DENO IV

It's already in the works. We had the old water atlas. We have whatever projects we've done in the past that updated our water lines. So that's all being sent to the Cordino group, and they're going to GIS it.

34:29 – 34:46GABRIEL FERNANDEZ

But that was just some stuff. The fact that even if we can't add the other stuff onto the GIS right now, we already have the information that right now we don't have until, in a way we're being, not forced, but The good thing about that FPL project is that we're going to be able to benefit from having all these located utility lines.

34:46FRED SPENCER DENO IV

That's what I'm getting at.

34:51 – 35:04GABRIEL FERNANDEZ

Anything else? Okay. Thank you. Thank you so much. Thank you. On to recreation. We already spoke about the soccer awards ceremony on Monday, which was a great turnout. On to resolution.

35:05 – 35:22Speaker 2

Mr. Attorney. Thank you, Mr. President. Item 10G1. A resolution of the Village of Virginia Gardens, Florida adopting the general purpose financial statements and compliance section for the year ending September 30th, 2024 as prepared by Clifton, Lawrence, and Allen LLP provided for an effective date.

35:25GABRIEL FERNANDEZ

We have a motion on the floor by Councilman Arcee and a second by Councilwoman Trita Martinez. Any other discussion?

35:32ELIZABETH TAYLOR-MARTINEZ

Just one. We changed the group that does our... It doesn't look like the same name.

35:41 – 35:55FRED SPENCER DENO IV

Oh. Oh, this ain't. Yeah. So Worms and I forget the last name. Averitt Worms. Averitt Worms. It's the previous company bought them. They merged. Now this company bought them out. So it's the same people.

35:55GABRIEL FERNANDEZ

Any other discussion? All those in favor say aye. Aye. All those opposed? Resolution 10G1 passed. On to attorney's report.

36:05 – 36:34Speaker 2

Mr. Attorney. Thank you, Mr. President. Item 11A, an ordinance of the Village of Virginia Gardens, Florida, creating a new Article 3 of Chapter 11 of the Village Code entitled Smoke, Vape, and Tobacco-Free Village Property. Prohibiting vaping and the use of tobacco or nicotine products on village property. Prohibiting smoking in village public parks consistent with state law. Providing the required exemption for unfiltered cigars in public parks. Providing for enforcement, signage conflicts, availability, codification, and effective date.

36:35ELIZABETH TAYLOR-MARTINEZ

Do we have a motion on the floor?

36:38GABRIEL FERNANDEZ

We have a motion on the floor by Councilwoman Tilda Martinez. We have a second by Councilwoman Conover. Any other discussion? All those in favor say aye.

36:47 – 37:05GABRIEL FERNANDEZ

All those opposed? Ordinance 11A. On to old business, nothing to report. New business, nothing to report. Good and welfare. Okay. Yeah, I think we covered that.

37:05 – 38:07FRED SPENCER DENO IV

I do have one more item. Driver's license, if you need your license renewed, your car vehicle registration, what else is there? ID cards, can I remove organ donor, handicap, car registration renewal, ID original and renewal, driver's license replacement and reinstatement. We'll have a mobile unit here at the tax collector's office on January 23rd from 9 a.m. to 4 p.m. Where? Right here. Right here. So just let, you know, notices will go out. They haven't already. They did. They already went out. Yeah, they did. They got put in. They were in the vocal tribe. So anybody here that needs it, let McBeth know in the red shirt back there. She can pencil you in. And there are appointments. I'm sure there will be some walk-ups, too, available. But they'll be here at our village to save you from having to go to the DMV. Thank you for the county for that. Good job. Thank you for the county. Dario Fernandez.

38:08ELIZABETH TAYLOR-MARTINEZ

Yes, but I like our commission.

38:11GABRIEL FERNANDEZ

Well, thank you for the Tax Pleasures Office. I don't think that's ever happened before.

38:15 – 38:26FRED SPENCER DENO IV

It's never happened before. So when we met that one day, I felt like he was going around different cities. I said, you know, I'm not sure you guys are coming here too. He goes, I'll make it happen. And he is. We made it happen.

38:27 – 38:48JORGE ARCE

Good for him. Councilman? Spencer, about blocks, funeral services and all that, there's going to be a lot of people there. I mean, the legal cities and all that. He's here in Miami Springs. Are we going to have seats for us in front?

38:48 – 39:39FRED SPENCER DENO IV

I would recommend you get there early. It's not our service. That's handled by the family. So I recommend it starts at 11, get there early. That's all I can tell you. So I can't go in there and reserve. I don't feel comfortable doing that. That's a family thing that they're in charge of. We come back here, you know, we're hosting it for the family, the celebration of life. But I'm not going to. Okay. Is it going to be in the senior center? It's going to be in here. It's going to be in the senior center, our back patio. It's going to be all around. So wherever. I really don't know how many people will expect, to be honest with you. It's kind of a weird time on a Thursday at 11 a.m. So by the time we get back up here, it'll probably be 1230. I don't know. I don't know how many people are going to. But we will have burgers, hot dogs, and chicken. So chicken sandwich is here.

39:42JORGE ARCE

Spencer, you know who I got a call from that I thought he was bye-bye already? Luciano from West Miami.

39:50FRED SPENCER DENO IV

No, I just – message we talked a week ago. He wasn't there last night? That's a long drive.

39:55JORGE ARCE

No, he wanted to give me the condolences and find out where everything was going to happen. I just forwarded to him what you sent me.

40:05FRED SPENCER DENO IV

I think he said he sent it out today, so I'll just misspell it. Oh, did he? Oh, he did.

40:09GABRIEL FERNANDEZ
