Good evening. I'd like to call to order the December 3rd, 2025 meeting of the Titusville Planning and Zoning Commission. Uh let's stand for the pledge, please. flag of America and to the stands indivisible with liberty and justice for all.

Alternate member Troutman here. All right, we have a quorum. Uh, next item of business is approval of the minutes of November 19th, 2025. Do we have any discussion or anyone care to make a motion? Vice Chairman Childs, make a motion that we approve the minutes as written. I have a second. I second.

Yes. During the public hearing portion of this meeting, anyone wishing to speak on a quasi judicial item must first sign public a public hearing agenda card and sign the oath contained thereon. These cards are located on the table in front of the uh council chambers. Those speaking in favor of the quest will be heard first. Those opposed will be heard second, and those who wish to make a public comment on the item will speak third. The applicant may make a brief rebuttal if necessary. Witnesses may be cross-examined by the applicant council staff representatives and other representatives as authorized by the commission. If you have photographs, sketches or documents that you desire for the city uh for the council PNZ commission to consider, they must be submitted into evidence and will be retained by the city. Please submit such exhibits to the city clerk. City clerk, have you gotten any cards?

Thank you. Uh next item on the agenda is petitions and requests from the public present. Uh, anyone care to speak on an item that's not on the agenda this evening? Dr. Kathleen Oor, professor emeritus department of epidemiology and bioatistics at the University of South Florida, vice president of Royal Oak Neighbors LLC and 3525 Palmer Drive. Um, I wanted before I began to speak to recognize how many people have come here in support of what we want to say. I understand that attorney Rosena plans to table the Gemini Lakes proposal and delay the vote into January to gather more citizen input.
Excuse me, ma'am. Again, something that's not on the agenda. Let me say one more sentence and you can decide. Okay. Before I continue, I want to be very clear. It's not my purpose today to discuss the pros and cons of the development itself. This is a totally different issue. Okay.
Okay. Give me a little more time if I run out. All right. That discussion belongs in a future hearing once the proposal is formally before you. While I could easily raise detailed concerns, doing so now would be inappropriate as the item is tabled. My purpose today is simply to ensure the city is aware of the misleading marketing campaign the applicant has already launched. Meaningful public input is impossible when materials being distributed to the residents are not truthful. Unfortunately, most of the information provided by culture to date has not been accurate and that should concern all of us. Residents received a postcard directing them to the Gemini Likes website. Curiously, many members of the Royal Oak Neighborhood Board, those best positioned to mobilize genuine citizen input, were left off that mailing list. And the website itself presents a polished but misleading picture of the project. The images of mature trees, lakes, and large homes appear unaccompanied by a disclaimer that is nearly invisible, almost as it was not meant to be seen. But the most serious issue is not the imagery. It's the statement on that site, many of which are presented as fact, even though they are not true. When an applicant begins its outreach with misinformation, it damages trust, not only in the project, but in the entire public process. If a developer cannot be honest in its initial communication, how can residents and commissioners reasonably trust anything that follows? This is not a misunderstanding. It's misrepresentation and concern anybody responsible for protecting the integrity of the process. I also take issue with the dismissive attitude shown by this out ofstate developer Tulon has behaved as though Titusville residents are naive or easily persuaded. We are not. We are informed, educated, and deeply invested in the future of our community. [snorts] It's also worth noting that this is not the
first time this developer has faced serious questions. When Coulter's representative Josh Long met with the Royal Oak Neighbor board at my home, I shared the news coverage of the 2016 construction defects lawsuit in West Palm Beach, a lawsuit Coulter settled for $22.5 million. I would just finish because I took a minute. This history raises legitimate concerns about whether the applicant is the right steward for one of Titusville's most sensitive properties. Given the extent of the misinformation already circulated, I respectfully request that Gemini Lakes website be taken down immediately until every stating has been verified by city staff and corrected. The public cannot provide informed input when they're misled. Um, thank you for your time. On behalf of Royal Oak Neighbors and all these people, I respectfully request that this statement be entered into the official record and I have copies for all of you. And I would also like to say thank you to all of you for volunteering to serve on the commission. I am thankful for all of you volunteering because you all are brave and confident to volunteer. Without volunteers, we would not be able to ensure the people have a voice in planning for our city. I'm so happy to be able to be here. Thank you. Any questions? [laughter]

Thank you, chairman. Good evening, commissioners. Item 9A, comprehensive plan amendment number two, 2025, Gemini Lakes, begins on page seven of 410 of tonight's agenda packet. On page seven under summary explanation, um you'll see that the city staff received word from the applicant that they requested the hearing be continued to the January 7th regular commission meeting. Uh unfortunately, the advertising and public notification cards had already been mailed out. And so that's the purpose of this meeting is so that people didn't attend them uh show up at city council uh city hall, excuse me, and find that there was no meeting that it had been cancelled. So, um the purpose of tonight's meeting is um to host the meeting so that the uh the applicant can present their request to have the meeting table to January 7th.
All right. Um anyone up here in the day have any comments or questions about that? If not, I'll entertain a motion to um applicant needs to come up and do the request. Yeah. All right. Yeah. Thank you.
Good evening, chairman, members of the commission. My name is Kim Rosena with Lacy Rosena in Melbourne, Florida. I'm here on behalf of the owner Tulon and also the developer of Culture Homes. Um we are here to ask for a continuence to January 7th. Uh as you know we've changed from high density residential to low density residential future land request which is all this is but we've also changed the um preliminary development plan which you're going to hear about during the comp plan uh review anyway. So we do want to have another community meeting. We've been asked to have another committee meeting by um several of the city council members and so we intend to do that tenatively set for January 5th. Cards will go out to the over a thousand members within 500 ft of this uh zoning, maybe even more than that, but I know there's over a thousand cards that will go out. Um I did hear the concerns of the lady that spoke about the uh the website and um hopefully we'll reach out to her and find out. There have been community meetings, there have been individual meetings and uh so we do want to get anything corrected that seems to be misleading or that is inaccurate. So with that we would request a continuence till January 7th.

I think generally speaking um the public hearings aren't entertained but again if the public wants to say something I it's up to the uh commission if they'll want to entertain that. I don't think there's any restriction on not the med the technically the uh proceedings have started for it to be continued. So if the board so wishes they can um hear if the public wants to but again there will be no actions taken. the applicants asking for it to be continued.
Okay. Um, yeah, I I think in fairness to everybody, the the the best plan of action would be to go ahead and and do the continuence and allow the public meetings, the website to be corrected and all of that and then um to uh proceed as if um under under normal circumstances on the 7th. Uh does anyone have any comments or disagree on the commission? Uh member Gar.

I have one question and the attorney you mentioned that in continuence sorry the applicants attorney uh it seemed like the u residents concerns or bullet pointed as to where there were conflicts with information and you said you were going to address it. I think it would be helpful given the presentation you initially did if you would address those bullet points and then submit to staff whatever that addressing was. However you responded is your response but at least that the bullet points that were provided here tonight we listen to or at least discussed whether it changes or whether it's informative. It would be helpful to know that you've addressed those. Would you be willing to do that?

I love the um the the energy that you guys are bringing tonight, but please look downstairs and and look for a spot to um continue your participation and supporting the city running for office.
