All right, we're going to call to order the regular city council meeting on May 13th, 2026 at 6 p.m. We'll start with a moment of silence. Rise if you are willing and able. All right. Thank you all. will go towards the budgets there on the screen if you need to flag the United States of America for it stand. We need to work on that next time we were off. You might notice something new this evening. The public, you all now have a screen up there. Uh, council has a screen up there as needed and then we will be projecting our agendas up here so you can follow along. Um, so we're going to start out with our proclamations and presentations. Um, I have roll call. Sorry, I'm skipping my own agenda here. We're going to do the roll call and establish a quorum.

Great. All right, now the proclamations. Um, it's with great honor that I get to name May 2026, Military Appreciation Month in the city of Wood Creek. Thank you to all the men and women in active duty now and those who have served and those who have perished serving. This country is forever in their debt and we in the city of Wood Creek are grateful to you all and want to recognize this tremendous sacrifice. So King for that honors them. Um first up we actually have somewhat of a service member here. We have our case county possible Don Bonigu who's going to give us a brief presentation. If you're ready sir you can sit if you'd prefer or that you do have the podium there. may just stand over here while I can speak to whatever I like to disc and any questions you've got. But usually the first question I get is what's the difference between a constable and a sheriff? And I can definitely tell you because I've been both
primarily all of our officers are peace officers and we back up the sheriff's office on calls, but our primary constitutional duties are to the JP court bathing and serving uh civil process serving warrants. But we're a little different out here uh here and dripping too. There's no police department. So, it's a sheriff's office and us. And but we mainly work days because we take care of the schools and the judge's office. And so, Monday through Friday, we do 10 hour shifts. And on Mondays, if nobody's out, we have four own uh teaching 2:30 there's nine of us. And on Friday, there's five of us. And we we started getting more complaints on traffic, particularly speeding. We developed a a motorcycle unit. And when I did that in the late 90s at the sheriff's office acre subdivisions and small county roads for you to come back through terms. So we've got a lot of those around here and you have them also. So we we do work traffic. Uh but primarily I like and it's worked for me at the sheriff's office is just do patrols and be seen and not there's no gauge for any burgies or crimes that we prevented by just being seen. So that's another thing that we try to do. We work very closely with the sheriff's office. We stay in line with our constitutional duties, but we're law enforcement officers and we take that pledge to the state to hold those folic. and y'all got any questions?
Yes, ma'am. When we call 911, who do we get? You get the sheriff's office. And I would suggest that anytime if you got a feeling here, call them because when that call goes out, we hear it.
And if you would call our office and there's a bad situation, we're going to take head your way. But we went to sheriff's office. so they can put it out and everybody else can hear it also. And I know there was a time that a lot of calls went to the conference office and it took me close to two years explaining to people you're not bothering anybody at North two weeks and I came in and there were nine auto burglary calls from Wood Creek on our insurance machine to 911 and been paged out. I can't say that you have prevented a lot of that. You had officers on the sitting because these murders took place on my own.
So, it's extremely important. You're not bothering anybody. I've spoken to a lot of senior citizens groups. Well, I just I didn't want to call. It won't bother anybody. That's not the case. They have at least 10 on duty down there for that very reason. So, don't hesitate. Don't say well this will be not listen to you take care so is there a good way to just sort of regularly touch base I mean like meet with the city administrator or just a call or does that make any sense
yes it does if you want to set it up then if you'd like to give me a call have an administrator give me a call uh we can do that once a month or it may be on a basis that you need additional advice about. Yeah, cuz I think you know I mean we we hire our duty sheriff to help with some traffic thing. I know you seeing them and and assisted on on that. Um but uh you know you see things that they don't or we see things that maybe you could I'd be happy to keep an eye on
once a month is good. One of the things even though it's rather sparsely populated when you get on out 23 25 and rock and back up kind of road to 20 and some of those but the size of this precinct geographically is about 45% of the size of H County. You get on the east side with San Marcus and Kyle Bu and and D's the same thing as us, but those those are they're smaller precincts but have a whole lot more people. But they each have their own police off. So out here I together I've been that way a whole lot.
I wouldn't be here if I didn't and make you know that we were close. Your guys take a lot more years a lot more to cover. But, uh, if anybody walks up to the office and getting your license plates and want to come down and say hello, I have a lot of people that do that. If I'm there, the door is open. We'll come on in and go visit. So, we're here for you, but we just need to know. Yeah. Any other questions? Did the public have any questions for him? I just you were talking about the smash and grab on the cars
and uh was it last week that we had four cars right down in the middle of Wimberly across from the fitness place that four windows were broken out and people were robbed of their 49.
I just was curious if you had any comments. And it's just crazy that there was a a piece of like cardboard or something over the license plate. They weren't able to some guy description. We hit it. We try to match that up. And um I know it well because my CPA is right next door to talk to Jennifer to see if her title got hit. But I mean, I just can't imagine somebody doing something that you're referencing this smash and grab stuff. Would it truly be a detriment to them if nothing is visible inside your car? Not anything at all.
I personally like it that way and you're right, but a lot of times with these new cars, even with the factory tents, you can't sit in. So, I'm not I'm just guessing. Maybe they smash and grab thinking hopefully there's something in the seat I can take. But you're 100% right. Any of your valuables, bill foss and put it in a console and the back usually the back is a little bit darker if you have to carry something back there. But but you made a very good point. Can I ask you a rather silly question? Okay. In 1953, I can remember them talking and saying when we were coming up here as kids that there was only one constable for all of Hayes County. Do you know if that was true?
I don't know. I was strong interesting either. He
was very afraid of the movie compound because they had his machine guns. I I can tell you when I went to work on Jackson patrol in 1967 and I work H County sometimes there was only one deputy sheriff in each like C views and some office and then that group of sheriff's office in 87 there were only 17 I was put to our county a day but having just one one con are set up by precincts and and they they don't have to you don't have to have constip. So back then you may not have had one for precinct. You may have had one for the whole county.
Well, that's what they they were you could hear people talk about because of the Moody compound and and what they did did up there back in the 50s.
So uh which is long gone now. It's a church community church now. And then and the population back back then actually up until the late 70s you see population signs in one and K uh and they were all less than 400 people and not one of them was incorporated. They just bet you plenty of people were there and and they weren't. And I can tell you this when I ran for office in 1996 five there 5,000 people in Ps County and they were pushing 300,000 a lot.
I think there were only 100 area. Okay. Uh thank you Mr. Mon. Does anyone else have any questions related to the service to the city of Wood Creek and the difference between sheriff and constable um today? No. Um so thank you for being here again. I know the last time we had you come out was about five years ago and so hopefully we don't wait so long again. Um I know for me personally it was really helpful to learn the difference between the sheriffs and the constipals and the services you provide our citizens. Um and so I just appreciate you taking that time. Well, you're welcome. And if you just sitting down here would like your call. All three of I'll be happy to meet in the morning
in a morning after I get through with our school songs and hopefully whatever. Yeah. Thank you'all so much for the work you do at the schools too keeping them safe. That's really important. That is one quick point. There's a lot of times we'll get traffic complaints and people going to work and people coming home but between Dan for high school J well we are in the middle of when people are going to work. So if it's really bad situation, we get one of the deputies on duty to help us just communicate with us. We will right. Thank you very much.
All right. Our next presentation is from Mr. Mike Jones. He's the county coordinator for emergency services among many other things in wine bar owner. Appreciate that. Thank y'all for having me here tonight, too. Um, and so so the agenda said we're talking about third wildfire early warning systems. I'm going to take it in reverse here and start with early warning systems. You may have heard that we put an early warning system is a fair weather system out there in Jacob's Whale area. And this particular system is designed for the Jacob's Well, folks that are there with a thunderstorm blowing in that only hit out about 6 t of a mile. Okay. But on a good day, you might hear over me here,
right? Uh I'm gonna see what I can do in order to give the mayor. We'll say that we're in regards to who's in office, you'll have that early warning system here where you be able to communicate because there's a new software downloads coming system that gives us tornado, severe weather, straight line winds, hail as well as a soft turn for lightning, too. And I've got a set up right now where it gives us lightning. It's within five miles of the swimming hole.
The uh we also have one up in D Springs and we're putting two others. One central kit right across the river and also down at the new sports county put in dele. You're familiar with that area too. Uh we do have a grant that we've submitted to the grant general ends and that grant is a tuning grant. unallocated funds from the 2015 flux which as you all know we called back with that and they've had that application since November 24 I haven't heard in no I've been told by GLO that if you have not heard of no they're still in the process of potential funding so I they know me by name by first I call them a lot of client time to talk about where we have direct process uh and they have other areas We're looking at some some dynamics there that we also be there to to assist our our neighbors. And when I'm talking about neighbors, I'm talking about this this neighborhood here, Wood Creek and and uh the course side area. The another warning system we use currently using is called war central texas.org. So just a show of hands, how many of you have registered for one texas.org for emergency alerts? One, two, three, four, five.
Right. So, let me explain what this is. This is something that's put out by the capital area council of governance and it covers 10 counties and you opt in your address, which means you can also opt in your work address. So, something that's going to be occurring is going to affect that address. They're going to notify you on your cell phone.
They'll call you. that's in your text and also send an email to Tuesday as well. So that way you follow information and let's say you get notified about your something bad going on there from the storm severe storm standpoint. You go to kazininformed.com and you click on to our flood monitoring flood monitoring tab there and it will show all the flood monitoring systems that are in the entire county. And any flood monitoring system that's yellow or red, it's the one you want to avoid. And if it surrounds you, you just stay home, right? Just call in. I'm I'm staying here because you're not going to get out. On top of that, if you'll go when you go to that flood monitoring page, you'll see there's a data section that's on the top left hand, and you click on that data, and you'll be able to see rainfall amounts.
Oh, wow. Wow. Within a couple hours, last five minutes. So, play around with that website. We put a lot of time and effort in this to to communicate this to our residents in Hayes County. So, you're not relying on just the National Weather Service, which by the way, we have the best National Weather Service office in the state of Texas in New Bronals. And those guys have been fantastic. They call me up and let me know exactly when stuff is coming down our pike. And I get that. So, remember the tornado last last spring? I knew about it long before the sirens went off and and the warnings came off. They said, "Look, we're seeing some surgery action going on out there. So, we were able to get our folks together and get get prepared." National Weather Service can have a warning. See the warning immediately after that. But point is you get that I don't inidate you with additional warnings. National Weather Service does a good job using the integrated public alert warning system. And what that is is bipol and that system they poly on the area they want to communicate to. So they had every cell phone if you're here from from out of out of state out of town you're going to get that early that going system that I bought. We didn't have that that dynamic we got 15. We had code red, we had another system if you're familiar working with you and national weather service things out too, but we were all kind of the same thing. We're all trying to get better and when you inundate a system like that, you break it. Okay? So, we have protocols now. If it's weather related, the National Weather Service sends it out. If it's fire related, I send it out. We're texting into wildfires. and we work closely with all our fire chiefs within the county. Uh the emergency service districts you have Chris is your fire chief here for the neat thing about our fire chiefs as well as our law enforcement community throughout the entire county. We all get along.
We don't believe in victims. We don't believe in the my way to highway. We believe in coordination, collaboration. whatever these guys and gals in need when it comes to emergency services. If I have it, I I'll send it to them. If they don't have it, I go next door to coal county and I steal it. If I can't steal it, I'll send in a request to the state. We just call it that assistance request. That's a star and we get the needs to be. So, yeah, as you all noticed, this is why you live here. You've got beautiful trees tiny nearby. So, so there's some things you can do to help harden your homes. What I call a fencable space if you go on to our website again. So, I don't have this information by the way. Go on.com.

It's also on our website at the end. Yes, it can be at the end. And we go to the ready set go page there that tells you doesn't tell you but it states exactly what you need to do in order to create that individual space as in trim the branches off your housetop and keep the branches so you don't have ladder fuels the bottom up about six feet. That way if a fire comes through real quick burning the grass no big deal. Y'all remember the Herosa fire a couple years ago? Not a single structure was lost. Now that's also due to the fact he has some really good first responders fire department up there and they come up there in a task force. So during wildfire season, they're all ready. They're spun up. They're leaning forward. And as soon as some sparks up there, they're there immediately. I get a call from Chris. He's out here and next thing you know, I'm going up. Whatever they need, I'm going their direction. And in that process, just go back and look at Ready, set, go. And also have your supple kit. People think you might need to evacuate. The reality is amazing books. And you need at least one gallon of water per person per day. You're going to need some food. You're going to need water, right? Shelter, travel, communication, all five basic needs. Your sixth place is supposed to be medical. So make sure you have all those things at hand in in a bag. So in case you need to leave in a hurry, then you can. And where you got to go if you leave in a hurry? Well, it's up to you, right? But my point is, if you're going to go somewhere and you watch yourself travel like we did back in 2015, then have that communication plan with your family so everybody knows this is where we're going to go. I can't get a hold of my daughter or my son or my grandma or whoever. This is where we're going to go. We're going to rally up here. Now,
there's lots of good places that you can rally up around here. There's a ranch branch wine wine place over there. No, no, no. There's my voice. But have a plan is what I'm saying. Just have the plan to make it easy. That way, you know, take the stress out of it. So, I was going to say one thing real quick, Mike. We have them at our office and I'll bring them to you, put on the website, and we put it together for the emergency preparedness fairs that we have here in the spring. But it's it's what you need for 72 hours.
Okay. and tier of the tire list that came from FEMA that we uh designed more for our community. And uh if you're around our office, we keep them there, but it probably be a whole lot easier for me to next day or the first week we drop that off here and y'all can scan it, put it on these lab. So that's great. Thank you.
Thank you. And don't get that and go back to the website. We got to list the other two. Um you talk about prayer service. We have one here every every spring. We also have one during preparedness month in Kyle, Texas. And it's the second Saturday of September. It's always the second Saturday of September. We bring we bring out every apparatus in the county. We're all different. We bring out about 67 that are all kind of ready preparedness as well as candles and other things. We're not going for Christmas things like that. If there's going to be a clean event, it should be fun. Right.
Right. So with the with the gun, we also have a chica. That chilica benefits our fire chief association because all of our first responders, we need to get you a team this year. They all compete against each other for the top dog chili trophy first responders, but it's also a sanctioned chili cook off. So the international chili society since it's ICS, uh that international chili society, the winner there will go to nationals. So three three different three different makes of chili. We got red green and then the one I never eat is beans. Okay. So we'll have cook out there after all three of the events in in hopes they're going to win at least one of them. So we the first place winner get a $300 check as well as the first place trophy. So I would encourage you all to put that on your calendar to come out there because you can get really into the details of preparing this and we'll have a book out there as well. You can have one out there bringing vehicles out there on the motor units and show all and hopefully kind of use that as a recruiting tool. That's what should be a lot of keyboard community here. And then you'll see our surfers out there and they're in the chartreuse show. You probably seen them out there several times. You've seen them out there and been out there. You can't miss them. I That's why I got the chart shirt. So you just got to stand out and then they'll certainly just go through a an eight module training takes it takes a 24 hours 24 hours
and they'll learn organization. preparedness, possession preparedness, two modules of medical operations to include stop and CPR and how to use the AED. In addition to that, we'll have good psychology, fire safety, how to use a fire extinguisher. We're going to show you how to use the pass system, which is going to pull, aim, squeeze, and sweep. And then life search and rescue. So in case you need to get your name out of the house because a tree fell walk in the door teach you how to do those kind of things as well as terrorism and disaster psychology. Yes.
So we learn all those things plus citizen response and active shooter events. So if you happen to be downtown and something happen happens, you'll know exactly what we'll do. You wrap all that up in a nice little tidy package and then you graduate from that class and if you want to stay in our merry band of marry then you can join our team and every time something happens in the area you can come out with that. If you want to do more than that and we all we we don't hold you back. Okay. We have over 450 members that are active in our ser.
So that said, I would encourage you all and you can find that again on hazone.com. We can also go to Hayes County Circle and and find the same information. We have a class that's currently uh currently up here in Barney. Okay. So, I'd encourage you all to get involved with that. If anything, you just learn what life needs to look like for disaster response so you take care of your neighbors and your family. That way, we don't deploy one of his folks to come out here for something that's not life-threatening. then that's important that is life thriving because you'll take care of yourself. The city has advertised that class. So if you if you want to find out more, there's also city communications backlog about it too.
And I'm glad you bought communication thing up there because y'all are there's a reason why you don't have a lot of active traffic and such. Well, message boards at your key entrances can do a lot of things for you when it comes to wildfire preparedness, evacuation. Every piece of that you have going on here, it's easy cuz here's my feelings about mission boards. The grid goes down. Guess what's still running? That mission board is still communicating mission. And you can actually with my message boards I can actually get on computer and I can change the message right there to send signal to the message board and it changes right then her I don't have to go out there like the old day if you have cover to lock off and such. So I don't that's something you guys know on your agenda right
it is. Yeah. Phil, that's a fantastic consideration because you get more you get a lot of return on investment with commission boards during peace time and then when you have a disasters that's just one more thing in your toolbox it's going to save lives. There any questions? Yes, mayor. Um the you mentioned the one texas.org and it has a call feature a call out feature. Does it do they call out if you're notified to evacuate? Does it do that?
It sure does. When you opt into that warning for Texas.org, we you'll get a notification if you need to evacuate. But more importantly, if we need you to evacuate, we're going to polygon out your area and you're going to get it from us directly. And it's going to be IPOS. So that's not something you opt in. That's going to be an emergency. I want you out of here. Any other questions? All right, Mr. Jones. Great.

I do like that they take them off inside though. Some some people don't do that anymore. All right y'all. Uh we are going to move into the public comment portion of the evening. Um we have a small stack of written in comments and we do have some people in person. We'll start with those here in person. Uh we'll start with Miss Tormo who signed up first. Well, it's only what I have to say with what Mr. Jones was saying, which is opposed to what I'm saying. Um, it's not releds that I want to speak. There's been a lot of public out on that. Um, like somebody said, um, on social media, I doubt if there's a an emergency if I'm going to get in the car and ride down there and look at the light. So, I can start with that. Uh, this controversy um, illustrates an ongoing problem with our city government. We've lived here for four years and um it seems like with this council whenever they get or the leadership of the council anyway when they get in their heads that they want to do something it really doesn't matter what the the people say it really doesn't matter uh there doesn't matter how loud we are how many there are that oppose a certain project they're going to do it anyway they're just going to figure out a different strategy to do it Um, it's not the only the light of science is not the only thing that this refers to, but it's a perfect example of it. Um, I'm thinking that it would be more thoughtful for the council to ask the citizens how they feel about these issues before they go and spend a lot of
time and money uh researching them instead of after the fact. Um, and if they receive a lot of uh outrage against their ideas, then they tend to just ignore it and and make minor changes and push forward anyway like they have on the signs. Um, they change the cost or they change the design and they act to see if that change will um change the mind of the citizens. But we don't want a lighted sign in my opinion. Um the people have spoken and told you the reasons they don't want to sign uh like this. Um they told you the cost is probably the design. The lights are a big problem. The traffic in the area it's hard to read the signs when you come in. Uh and you know there's parks behind you and such. Uh there's a limited number of people that see the signs because there's three entrances to our little community. Um, but the one factor that seems to stick out the most to me is um that it's out of character for our community to have a line of susp um you just don't like the looks of it or um is it just too much trouble to change the lettering? How many employees do we have that work for us that are on our payroll? Um are they too overworked to to change the letters on the sign? They'd rather just click a few places on the computer on computer and um have it be more convenient for them. Don't mean to criticize the the the people who work for us, but surely somebody could have
that duty and it not be do not be too overworked. Um, that is the end of your comment. Thank you so much. If you think it would look that thing,

Written comments. This policy has been um somewhat in question recently. Uh we're going to make sure it's very clear moving forward. Written comments sent to Wood Creek at Wood Creek Tax South and designated to be read during the public meeting will be read out loud, but this must occur for it to be read out loud into record during the meeting and they are due by noon the day before the meeting. They should also include your name, address, and the item number if if it's applicable. Um, so I just wanted to review our public comment policy. This will be on the slides from here on out. yes, this artwork. And I brought some of these and be welcome to take one. Um, I have cleared all the legal issues in terms of any rights to that artwork. So, it's free to put on a booth if you all choose to move forward with that. Um, I think it's pretty nice art that has the side benefit of being informative about offers, our particular offers. Um, so I I want to not just support this, but I want to put our money where our mouth is. After learning Monday morning that this was on your agenda, I emailed my board. Uh like you all, we don't have a lot of spare change sitting around, especially after we pay all our legal stuff. But they agreed with me unanimously that I can stand up here tonight and pledge $1,000
toward the cost of this item should you go forward with it. And I've spoken with Lynn Jones, who's here. She runs that beautiful booty program. only had a chance to have a couple phone calls, but I'm going to tell you I am very confident and optimistic. Uh I will raise money for this and I am really really confident that I can get you at least half that. So that's my pledge to you u and in support of this. Uh that's what I came to say.

Okay. So we have nine minutes to Miss Bernett. You are up. Thank you. Thanks very much. I'm gonna hand out some handouts to the council and if you can follow me. If not, it's pretty self-explanatory and therefore here. So, thank you. Um, so I put in the public records act request and this all has to do with uh the site that I live at at two champion circle becoming your number one issue with respect to drainage. And I asked the staff for the past records that showed what was put into the city newsletter that there had been citizen complaints about the location. and I came in and I reviewed over 13,000 items that had been pulled for me to look at. I want to thank the staff. They were actually really wonderful for helping me to do that. Um because I had to do that here at the city because there's reduction issues that had to happen, which was all just fine. What I found was there were actually only really two items that were related to my property. And the good thing was I learned a whole lot about drainage by doing so, which you know I know you all care about a lot. There's a lot there. And so what you're going to find attached if you open what I gave you behind the three of the letter is item one and two. The item from 2019 was the prior owner of my site and um speaking to someone and saying that there were flight issues. The second item is a is a letter that he submitted regarding his fence. But what he says in the letter, if you go down a few paragraphs, is that as everyone is aware, there are some water issues to be
dealt with at Chadian Circle and Creek. And we at our site there for them have excavated and terrace part of our back property in order to flow water away from our home and dredged a dry rivered and covered in river ball. Now if you look at the date on that was 2003. So between 2019 and 2003 he managed the water on his site. So when I read that there was a problem on my site which I hadn't seen when arranging them it now kind of all makes sense. At some point in time he did complain but then he did something about it himself and I don't have a problem with a lot of uh recite. So that again is just I'm not sure why but you know I know that things take on a life of their own and you get on a list and maybe you need to come off. So what I also found out in the 13,000 documents are there's a lot of property here that's really impacted by Rhode Island and there's tons of photographs that people have sent in and Brook Hollow Park tree spalding circle um to Wilson Circle Wood Creek Drive all of these owners are coming to you and asking for help and some of them are saying when roof projects are done in the city. This is really what's causing the added runoff to my site. I worked a lot in the public works sector. I can see how this can happen. They put a contractor out to do something. It's hot out. He's got all this asphalt. What is he going to do with it if you don't have a construction inspector there with all the time minute by minute? Oh, we'll lay a little here. We'll lay a little bit because he's got to pay to get rid of it. So, I know that that can happen. It's not anybody's bad or good or
anything like that. It's just how life goes. But people are reaching out to you and they're saying, "We have a lot of damage and we need some help." And frequently in the record, what's there is, well, we can't really help because that's private property. And I really think that that should maybe be rethought a little bit. So, again, I just want to say 71 is not a problem. Let's not spend $800,000. We're going to say a little bit more about that. If you go on in the packet I gave you, you're you're going to go past a reading with Jesse Warren who flooded Elvis talking to you. And I had posted these pictures up on next door. I don't know if you had a chance to see them, but if you look in here, the drains that are on the city property, they are are have debris, a lot of debris. That 10-in drain flows across. There's, you can look at the ruler. There's 10 in 9 in of debris right there. I took that picture before the last rain. If you turn the page, you're going to see Deerfield. What the Deerfield project did was it ran water from Deerfield right across Wood Creek Drive. You can see it flowing in that photo to that corner where it goes right onto the city property drain. Turn the page and you're going to see what happens. It's a mud filbert. So, when everybody says, "Oh my gosh, there's so much water there." It's a lot of work to do storm drain properly. It's a lot of work to clean stuff out. But the way the water comes down and the amount of debris that comes down, it's really got to be done frequently in the city if you're going to avoid water backing up. But turn the page. What
happens when water bucks up there? It does slow downhill. How do I know that? Because you cannot have a pond unless water flows downhill. It goes right down to the tension area. And there it is. The next day, which is the picture right next to it, the water is gone in that area. Given the amount of limestone we have or whatever all this white rock is around here, it was supposed to guide it to the ground, which is wonderful because we need it in the groundwater basin really badly. And our area is working to contribute to that. Now, when you look at those pictures of Deerfield, if you look at item five, what I want you to know is that this was talked about by the engineers. These are the emails that are in the record. I think one of the council people somehow had word of that. It's reflected in an email, but the engineers knew it. And that is attached here for you to take a look at and marked as item five. It just it's not unclear to me. Drainage toward the roadway of Wood Creek Drive needs to be discussed and determined by facilitating either managed drainage or non-managed drainage. When we look at that amount of water coming across Wood Creek, it doesn't look like it really got worked out. And again, these things happen. And then we have to figure out, okay, what do we do next? Item six, and this is really where I want to go with this, and this ties into your agenda item, your last agenda item. What should we do about the city property? It is the perfect site for the watershed roots to come in and help us put in a retention basin that'll clean the water of the hydrocarbons that come
off the street and the fertilizers and from an environmental perspective, turn it into the type of place that our councilman talked about for the developer requirements at one of your meetings. the city should do exactly the same thing. And in the record, there are grant monies available for that. It's there's a proposal that's being put together by a watershed group. They This is what they do and what they love. All right, my last comments. There's a lot of animosity in this city. I'm so surprised. It's such a nice place. We all need to turn the temperature way down. We need to listen to each other. We need to not have made up our minds when someone says please come and talk to me. I invited all of you. I want to thank Miss Bailey. She was the only one who responded to me. I don't have fangs. I don't you know I'm not evil. I just think that my council people if I'm a citizen and I say can I please re can I please speak to you but I have a few minutes of your time because I could have told you all of this and you could have stood on my property and looked at what is uphill and what is downhill and what is going on the drains and we would just all be better to make a decision. My last point, you all got to get on that audit. You cannot spend money when you do not know how much money you have. You're acting on your assets, your liabilities, and how much you have.

It takes away from the beauty of the entrance and the nap natural habitat of the surrounding area. I think our tax dollars can be better put to much better use than a digital sign that not necessary. This is from Ed Harvey. This comment should not have been read. Again, we are making exceptions due to the issues of communications about how these comments go. I won't be accused of censoring people, but we have to get this straight moving forward. Can we please give this up? There is no need for this and I am highly opposed to it. There is no need to try making Wood Creek like a neighborhood in Austin. That's why we moved here. Thanks, Mary and Hannah. Again, this comment was not properly documented. I am writing to express my strong opposition to the proposed digital sign at the entrance to our city and I urge the council to abandon this plan entirely. It is the idea of a digital sign that I am opposed to not just being opposed to the previous design. Our city's entrance is not a billboard corridor. It is the face of our community. A glaring constantly changing digital sign will be a visual that flashes of everything that makes this town worth living in. It sends exactly the wrong message to residents and visitors alike that we are willing to sacrifice the community's identity and aesthetic for a flashy out ofplace fixture that belongs on a commercial highway, not the gateway to our home. Once the character of a place is damaged is very difficult to restore, I'm deeply concerned that this decision is being considered that out of good regard unintentionally would change the veil of our interest and by extension our community as a whole. Residents choose to live here because the kind of place this is and proposals like this erode that piece by piece. I strongly urge the council to reject this proposal and instead invest in entrance improvements that honor enhance our town's existing character, thoughtful landscaping, quality materials and signage that reflects who we are actually are. I believe we should keep the wood and nature of Wood Creek and the sign is the opposite of what we should stand for. We can get alerts the way we already do, weatherful, weather for weather, events, or anything else. There are plenty of avenues to get these alerts through text, email, next door, the city website, Facebook, and more. Also, the science is proposed is very ugly. I am opposed to the proposed digital sign at the entrance of Wood Creek Drive. This is unnecessary at best. Residents who care about our community's natural beauty and shared pride don't want their tax dollars wasted as it undermines their collective identity. Not only is it wasteful but an eyesore. Sun does not belong in a dark side community where preserving natural beauty is essential. Woody Creek with the exception of very few stands stays informed via social media and cell phones. Our city does not need additional means of communication. I recommend we work together to preserve what our comm what makes our community special and ensure resources or use responsibility for everybody's benefit now just a few fisher submitted. No on any kind of digital sign. I should not have read this because this person presented a public comment today. I appreciate the thought that this went into this presentation, but what I don't don't address to see is the problem it is answering. Do you have any data on how many calls per day, week, month that you receive asking for information? While I understand it's less than ideal to have to answer questions that are posted on our sandwich board, that is particularly partially the administrative role of the office. In addition, do you have any data on how many citizens this would capture coming into this area? For instance, we never use the front entrance. So, if we were people who felt that we did not know information, this would not alleviate the problem. Do you know how many people you're not capturing by just having one sign? In addition, do you have examples of where this type of sign is being used in a residential capacity? It would be nice to see examples of this in action, not in a commercial way like a church or a school, but at the front of a neighborhood. Because this information has not been shared to the public. I am unsure of the specific data-driven problem we are trying to address. We also still feel that this will lower the aesthetic of our neighborhood. I'm in opposition to the sign. Sheriff's report. You can see he had nine written citations and running his stop sign. All of his violations force was pretty light. Sean's been doing a real good job. Came on top of everything. They have a loose dog and his sanitation is west and those are wrapped up. Just a quick engineering update. Don't want to steal a whole lot of thunder from uh Melody, but just an update on Western Wood Creek. The survey is completed. The design has been processed. Plans and bid documents anticipated by the end of May. Bid to come in fact end of July. Targeting constructions to begin in August. Um city hall updates. The audit is ongoing. Um Charles and I are working diligently and Taffy and the rest of staff too. Um the AIP is not giving me a time frame that we're hopefully on the tail end of it. So hopefully that'll be done ready to be presented soon. Um just going to go over a list of some projects that we've completed. Champions Court turnarounds completed. City Hall updates are completed with the exception of these two doors. Um um rather than adjust them, we um we're looking at possibly getting some new doors, windows shine in people's faces, and they're very hot in the summer. So other than that, we're done. Um the 88 parking lot out here, as you can see, is complete. We got new striping. Um we're done there. Uh the 88 park parking um is all is completed at all three parks now. All the speed cushions are in. All the radar signs are in. The signs have come with the speed cushions. Also, uh the digital improvements, we've got two cameras installed creek side where the others are on order. Uh council
chambers, as you can see, we got a little activity in here. Um the other equipment's ordered should be in the next day or two. I hope that I hope to have all that complete about for the junior. That's what I got. All right, we're going to move into the regular agenda. We have a presentation for uh Greenland Turk for item one. This is on the plans for the five initial site selected from the drainage master plan. We need to strike the word final there. I apologize. Um there was a little bit of a miscommunication. All right, I'm going do some quick background because this process has been going on for quite a while now. So, this comes after doing an open house for the master claim, reviewing a bunch of previous range information we received. Um after we incorporated and reviewed a lot of information, we narrowed this down to 10 preliminary areas of concern. BC AOC what that stands for and we brought those 10 areas um to the July city council and uh presented that then and we took those to the December city council with updated budgetary cost. Council narrowed those down to the five AFC's once we narrowed them to go out. So they went on the ground picked up everything. So we had better data for property lines, elevations, existing fences, that sort of information. So we took all of that and did an updated analysis for each of those five areas. And the main priority is the updated cost for all of those. So recap on the final five. You can see those on the screen. Um site one was creek drive, Champion Circle to Rancho 12. Site four, Brook Holler Drive, and Westwood Drive. Site five is Stream Trace and Champion Circle. Site nine, Wilson Circle and Spalding Circle. and site 10 McGregor Circle and Spalding Circle. So, next slides and we'll go through these site by site. Um, just to note if anyone saw my last presentation, these are the same photos. I have not updated anything there. So, site one, you can see some photos there of ponding at the culverts. Um, so for this one, once we got the updated information, these culverts for each of these sites are sized for the 10ear storm event. Um, so less flow than you'll see for the 100redyear, which is kind of when you're looking at flood plane events. Um, so this go for here improved the channel from Champion Circle to Ranch Road 12 with the additional small culvert under Champion Circle and then two much larger culverts across Wood Creek and across Ranch Road 12. So if you see blue lines on the screens, that's underground pipes for culverts and the green lines are channels. Um, so the total cost for this is about $800,000. I will note the bulk of that is for the culverts across Wood
Creek and Ranch Road 12, particularly with the culverts across Ranch Road 12. Um on this site we did include a drainage easement acquisition. It would be through the city owned lot so that we would foresee that being a pretty easy process. Um the main piece to not on this one would be a lot of coordination efforts with both Haze County and Tex. Um that lot on the bottom right corner is owned by Haze County where all the flow discharges to and rancher 12 is owned and maintained by text. Um so the main thing on there is the increased budget. Um, when we first did this, we included it as basically open cutting street where you open cut trench drip through that asphalt pavement, install the cover, and pave back over it. We updated that to where it's now a board across Ranch Road 12, which is where they leave the pavement alone, basically push that pipe under the street. Um, just based on past experience with text, it's highly unlikely they'll let us open cut that just with the amount of traffic across Ranch Road 12. So, that was the main increase for budget. And once we go through all these sites, there's an updated table at the end from when we brought these back last time up to now with all the updated information from our survey site four hollow and westwood. So I think some photos there kind of showing sediment and debris across the roadway and a lot of bonding in the golf course property lot there. Um so for this one same thing added right across wood for the size for the tenure storm event and also improve the channel from the west to the golf course property. Again, green is kind of above ground channels. Blue is underground pulverts. U main thing here is where that crosses Brook Hollow downstream. There's a blue and then there's a red. So, at this stage, we have not done any sort of coordination with property owners or with the golf course ownership team. So, the main thing would be if this one did form any next steps, coordination, because we would need drainage easements and to coordinate on how the discharge might work. So, several things that would still need to be worked out on that end. Um, an updated total cost for this one is about 246,000. And I will note, I didn't say that at the beginning. I apologize. Total cost is construction, engineering fees, and
easement acquisition all included. And this would
Yes. Yeah. Split out side by side. Um, and this one would include drainage, easement acquisition with either property owner, golf course as needed. Site five, Tmont Trace, and Champion Circle. So again, you'll see some sediment across the roadway and some potting in those culberts. Um same thing upsize these culberts to be sized for the 10ear storm event. Um regraded between the street culberts to the driveway covers kind of red the channel and also redo the um culberts underneath the driveway and repay the driveway as needed just to get everything to drain properly. Um, so total cost is about 151,000. And this one you look at having some temporary and permanent drainage easement acquisition. So basically permanent for all of the new cohorts that get installed and then some temporary access to basically regrid the driveways and get everything tied back in correctly and just allow construction access through there.
Quick question regarding the map there. Um, which is which which street? this up street
that loopy driveway is traumat is off of traumat trace let's uh if we can try to reserve questions and comments till the end and we can come back question labels probably would have been helpful I think I don't know that their future presentations excellent um Wilson circle and spolding circle um this is where there's the concrete low water crossing that's shown in the picture to the right and some ponding across the intersection there. Um, so for this one, the approach was to remove that concrete low water crossing and add a cover underneath there. And also, if you see at the top two squares there, proposing to add in four-way inlets, which is basically just if you see a rectangular top and there's flow that comes in on the sides there. Um, all of that would then go underground into the blue covers, repave that area with all asphalt. Um, the total cost would be about 197,000. And this one all work in the right way. No easy map position. Um site 10, McGregor circle and scalding circle. Again, some pictures showing a little ponding in there. Um for this one, we changed up this design a little bit once we got survey back. Um it was flatter than we thought just based off of preliminary looking at it. So for this one, um basically proposing to add what pilot channel is in here. So if you'll see most of the streets, they're either crowned to where the water drains off to the side. Some places are crossled where it goes to one side. The way we'd be proposing here is to what do what we call an inverted crown. So where your the center of your street is a low point and then you have a small concrete pilot channel that then drains outward.
So reason for that is just how flat these street areas were. So you have some larger kind of concrete transition at the up and downstream and some regrading of some driveways in there just to get everything to get sloped correctly. Um total cost is about 188,000 and we have included some temporary easement acquisition to get the driveways to tie in correctly within private property there. All right. So cost comparison from the preliminary work to the final. So this was included all the updates that we got from the survey and also updating the boring to ranch bro 12. Um I won't go through all those numbers in detail but feel free to take a look. So the total increase about $350,000. The main increase was in site one for the boring and then also site two as well. Everything else kind of fluctuated a little bit. All right. So family recommendation this was ranked for priority and just a general cost benefit. Um it's the same rankings that we had before how we initially numbered the sites. So for rating on site number one is really just the fact it's a main entrance um to Wood Creek and then after that it is also just kind of looking after cost benefit um for drainage impact and benefits to residents there. All right. So next steps and we'll definitely be happy to answer any questions on this. So for this scope of work this was our drainage master plan. So the next step would be for council to go ahead and approve approve the drainage master plan. there was an entire 70page report with a lot more engineering words and details and this was a brief overview. Um after that for implementation we would move forward into final design on any sites that got selected. Um some of these need a little bit of additional survey work just because once we got surveyed back and this is in particular to site number four as well um depending on if we went into golf course property or private property needing to know how far to go to make that water actually drain out. So most of it's already complete but there might be some additional um step number two would be property owner
coordination where needed um especially to kind of give a heads up as to where we can drain water to easement acquisition kind of talks through there and talks with the golf course where needed as well. Um step number three is utility coordination. Um several of these sites there's most of the sewer is not within the right on the streets but there is water and a lot of underground telecommunication. So whenever you're putting in pipes deeper down, we're likely going to have some contests there. So they're coordinator utilities. Um depending on the utility, most of them will accomplish the work within the right of way.
But what we need to do is also get what we call like top folding where they go do some test holes to know how deep data goes just to make sure we don't have any conflicts with utilities before you go and get your contractor started working. Um step number four would be easement acquisition. Um again dependent on site for what's needed. A lot of them had permanent and some had some temporary construction ements as well. Um, next would be your permitting efforts. So, the majority of the sites is limited permitting efforts just going through the steps with the city to get that all papered up correctly. Um, site number one would definitely have the heaviest permitting effort between Haste County and particularly textile per. Um, after that, wrap up plans. Get all that ready to go in a nice pretty bid package. Send that out. get your contractor's bids in and recommend reward for lowest responsible bidder and then go into construction. I didn't go into depth on any construction timeline because it's very dependent on each site.
Yes. Is that the end of your presentation? Okay. Yes. Um first question is to city administrator. Um, could you give us what to date the a what was previously known as the ARPA fund balances what that balance is? Roughly uh 358,000. Okay. Cuz last time it was at 366. So some of the work that's just been done in So give me that number. 3 It's about 358,000.
358. Um the totals that you have are previously we had the whole discussion like there was 158,000 approximately of additional engineering to happen. Have you taken the numbers we now see is that been broken into each category where it says total cost? Yes. If it says total cost and not construction cost yes that includes an estimate on engineering fees not tied down to that. definitely still look at before we go into that round. And then some some of our best guess are ease of acquisition which is shot in the dog for us. It's not our deal.
So council has previously discussed where you've laid it out as we're going to bids and awards and all that stuff where council has already discussed the idea of let's go to grants first. So would these plans that we have done thus far be enough for grants? Do you think? depends on a lot of this I think is enough information depending on the grant funding to at least get that process started and then before it goes to construction it needs all the other pieces. Yes. Okay. Um, also I I wanted to clarify because the words were final drainage master plan that was like, oh, so because how I see this going forward
and something that I would support because there had kind of not comfortable working on Hayes County Roads and our small little budget being used to improve their property. um that at this point how I'm seeing it is we take out site one and we move forward with grants and implementation on the remaining side. That is something council correct at this point.
Either way, this is the our final effort for the drainage master plan is all of this information. It's just not final plans ready to go for bid construction. So that's that's kind of the idea I'm trying to ask which is when we accept the master plan we're just accepting that you've done this work you've done this correct that doesn't mean we're going to do anything with it correct you just get this information to take with you take what you want to apply for different funding opportunities or yeah depending on how that is in the future so I think it's going to be an important distinction for the citizens to understand at least from my perspective
no this is not none of these are ready to go construction today. It is just our final effort to get it to a certain point which I'd say is a little bit farther than a 50% design. We've gotten some survey. We've detailed out some costs a little bit better. Have a better idea especially where property lines are and where they might need to be missed. And also the previous discussion has always been about the well there's a chance that we'll just take one piece at a time. And just because we're accepting the drainage master plan as a whole, that doesn't mean we're going to suddenly do it all at once, right? because that's a whole other part of the process I understand. Yes. I guess yeah and this is just approving the work you've done at this point.
It's take out for funding opportunities will be correct. Should you raise your hand first? Okay. Yes. I I think that is extremely important because there there have already been some I don't want to say misunderstanding some very questions about this plan and it's been looked on by many people as what we're adopting that we're going to do and that that just can't be made any clearer. I mean it has to be made clear in my opinion. Um,

Okay. Well, I'll ask them all at once. Uh, on your site number one, the notes said that the selection based on the content, but I went through every bit of the comp plan. The only thing that we found was they said we have limited drains uh that well here's what it says dam created the storm water retention system. Um studies show that traditional gray infrastructure or concrete like culberts do not do well with limestone car features. Then I looked up limestone car features and so when I was wondering when your pictures been taken because when I took pictures um most of these strains were more than half full of sediment.
Yeah. And I believe that's what they're talking about. But what you are talking about doing is increasing more concrete uh cylinders rather than other types. they're not so subject to deterioration. So that I just wondered if well that's my question where did the references comes from because a lot of people don't remember this site being particularly uh vulnerable. Um when did you visit this site? Can I answer one question before I forget your phone?
So I think these pictures and I can look it up. It's probably close to a year. It was after there was a pretty heavy rain event because I remember the um little water crossing on the other side of Wood Creek Drive being closed at that point. I don't know the exact date, but it was last year sometime. It's been a bit for sure. That was last spring because they are extremely they're really quite clean compared to the pictures that are taken more recently. And I wonder if there should have been a piece of your consideration of um covert planning that you've addressed this already. Okay. Now, cleaning definitely helps maintain gives better flow. Also, just when you get the bigger pipe sizes, um less prone to sediment getting clogged up in there, just want a bigger opening.
All right. And as y'all said in December that your plans, I'm answering your question as she said in December, the covert cleaning would not impact what you're proposing because it's not about the culvert to being full. That's what you said in December. They're still Yeah. the current golds, all of these are unders sized for the 10 year storm events. They're smaller than they should be for a textile only sizes up to a 10 year. I mean, that's different criteria for different jurisdictions. Okay.
Usually the main sizing is a 10ear minimum and all of these are below that. So, cleaning really good maintenance. It helps the flow. Definitely makes everything work better. Um, we're not really looking at that from a maintenance standpoint. Just looking at upsizing as a general improvement to get more flow underneath the streets. um on your pictures. Where was this picture taken? I think that is great. Go back one more time. Is that picture? Go back or go forward right there. So that's a crossroad. Well, yeah. It's not even anyone. Yeah. And so why why was that included?
Uh we were just looking at this intersection. So this intersection, all the forwards are oversized. So the entire intersection, all of this flow comes down to here. So when this backs up, that creates issues going upstream. So you really need to look at making sure your downstream flow can get out or else it just keeps continuing to back up. If that makes some sense, try not to do too much engineering. Okay. Oh, let's see. And on the costs uh do cost comparison why did Brookala Westwood go up 42%. It went from 151 to 215.
Yeah. I think it was a lot to do with our survey and elevations. Um just changing slopes and sizes of pipes because before the original cost estimates when it was lower, we didn't have any survey information. So, we didn't know where exactly our elevations were at. We were going off of the wide arc, which is kind of inaccurate. So, you just get your drones flying over your elevations. So, I think it's that. And I think we also concrete spread that channel just again because it's flatter than we thought it would be. Um, and these total numbers, the 1.390, these numbers appear to be, is there an additional cost to be added? So the 702 becomes 800,000 somewhere.
So right here these are just construction cost that is purely construction right there. And what are the add-ons? How how much engineering fees and easement acquisition which table is in the presentation. If it's not it's in the full report for sure. Do you have an estimate of what? So engineering fees are hard to estimate especially on something like this because we've already done a lot of preliminary effort and survey work. Oh, I know the before. I know. One of them went from 702 to 800,000. That's 100,000. Oh, you're looking at the construction cost and the total cost. Yeah.
Yes. Um, a lot of that was for ease and acquisition and engineering fees. So, trying to stay conservative, just looking at it from a budgetary budgetary perspective. I'm trying to tell y'all a little bit too much and it's lower versus call you lower in what I'm trying to figure out is one 1 million390,000 is the final DMP but what is the estimated with engineering and acquisition? It's a report. Yeah. On each slide.
Yeah, that's in the larger report. Yeah. So 1,582,000 rightly.
Are you finished? I had a couple questions if we don't have another council member Ron to speak right now. Um on site one, can we go back to that slide there? It's more of a statement of clarification because there seems to be some ongoing confusion about what site one is addressing. It looks like it's only the city- owned property including those easements you address that are across the street, but it has nothing to do with the other lot across the street. Correct. What you're proposing the flow crossing the street there underneath in the right way. Correct. Nothing going on on the house the property on two champions. Not unless that contributes to the ride ofway issue, but not simply.
So you don't have any work currently proposed through there. Correct. That's what I assume. Um, so when it comes to the things going on with Ranch Road 12 in the county, obviously the ideal scenario is we work with them and potentially even they help pay for this, right? We form like an ILA agreement, right? So that total cost isn't necessarily the the I almost said the United States the city of Wood Creek um out of pocket, right? it could be a partnership and we could negotiate that. What What is the idea of what if we don't touch those coverts over there? You know, we just kind of really address the the grading on our property and how because it's backflowing into the culvert and then it's also not flowing to areas that are better adapt to deal with that kind of water and so it's creating a marsh land over there, right? Mosquito breeding central. Um and that backflow is also what's making that culvert so full of sediment often, right? And we did do a covert cleaning this year and we're working on a schedule for more regular culvert cleaning which we I have to get y'all second to bring to you. But um so what is the reality like if we just didn't try to do the rancher at home stuff? What you know could we take that chunk and create a nice difference for us in our city? Like is that possible or you know
just on still on the side but just on sitting on property? Yeah. and not try to address rain on top. Like would we be creating a really big mess kind of channeling the water that's supposed to be going that into it? It's already going there. It's going to make it there somehow. It just makes it more effective to get to that forward. So, especially if you can keep the range 12 forward, which is more of a textile transition than anything lean, that helps the conveyance go downstream. Okay. So, that seems like something we need to take up with the county in the state potentially.
Okay. Um I didn't sorry I didn't have a lot of um additional questions on any of these sites. Um I do think it's really important that we restate kind of this concept but you know these are our drainage plans. There was only one of these sites that council has selected to possibly formed with. Right. Okay. So just so everyone's clear and we'll get into that later in the meeting. Um council member Bremer you had your hand up first. Also you haven't spoken your second time. So this would be your second round. Uh so the question kind of going off of what mayor was talking about regarding site one,
do we need to I know this is terrible to bounce it back and forth and back and forth, but do we need to h in order to accept the drainage master plan and and our goal was to only deal with site one of what lands in Wood Creek. Would that be something we'd bounce back to is we get different numbers or I mean I we would have these plans which I like because then we have something to communicate to Tasot with. I'm just wondering like if we wanted to go okay Tex's not going to deal with it for another five years but we want to deal with it sooner. We have our own little sector and our own little budget.
Couple points of clarification if I can. um us just splitting out the cost estimate but kind of the same design and just looking at the piece um under Champion Circle potentially for ranch 12 for the city property just breaking out that cost so it would be simple um if that's something you'd like to see I'd have no issue just kind of doing a revision to this report just to break that up separately so you have that number um with kind of our scope of work though we can't really look at too much changing of how that would work but we can just look at kind of breaking out that piece and then we just go system forward on the end as well. So that and I would recommend us not really changing the design, but we could break that out so you can just see that piece alone. Does that make sense?
Yes. And that's kind of what was kind of going to talking about because I think that is at least a a good solution for the parts that I've always been kind of uncomfortable about. Um, and I think we can as council do it as a possibility as a we accept the amendment with you making an addendum addendum to it.
Yeah. So, we can just break that cost out. So, you have that piece, but we're not making a major modification master plan. You still have all of this for feature. If you ever wanted to also take this to text dot to kind of show them, hey, this is what they were looking at. you kind of have this piece still available, but you can see the cost per account. And I like that idea. And I also like that maybe we can not have to have it come back again and do a whole new presentation. It's because you're saying it's a very simple little way. Okay. Um if I might take a moment of privilege as your mayor on a couple topics tonight we are reflecting on health and safety improvements. While we can certainly take the approach of what we have as good enough and wait for a deteriorating situation or emergency to learn and act, we can also follow the best recommendations. We could dream of what is possible and we can lay out a plan for that. My goal in this government is not to be a stone blocking the path. In regards to infrastructure, I'm going to trust the professionals on storm water management infrastructure. These needs, as they have outlined, are well documented historically, and I won't be turning a blind eye to this. Our city can and will plan for important city maintenance and infrastructure projects through thoughtful research and implementation. What we are doing now is building the foundation or framing for our house. Just like your home needs paint, this one needs roads, parks, building and water flow management. So, we are in the process of identifying these needs and outlining outlining schedules with estimated pricing. This gives us a first look at our net position and will allow us to put pen to pad on next steps. I don't want to kick the can on the road and I want to systematically move the ball down the court like a team. Is this a pass backwards sometimes or a failed layup? Yes. But we're not going to win squabbbling over this. Let's roll up our sleeves and make some decisions.

So, we're going to start with the presentation from the digital message board subcommittee of Mayor Pro Tim Jeff Rasco, council member Lana Bailey, planning and zoning commissioner Pat Rawlings, and former planning and zoning commissioner Lydia John. Hello everybody. Well, y'all formed a sub commmittee and so we decided that we go for it. We had two and we had two people that are on the road. So, it was pretty well balanced. Um, so Pat, I'll do the presentation for you. Lana did a great spreadsheet of all the concerns voiced by residents predominantly character of our city cost dark skies and why. So we read every comment and we really took them to heart. Listen to the comments. We had questions ourselves and we went back and we decided that we'd try to adjust them. The previous proposal was a 4T high sign by 7 ft long and 26 in wide. It was animated text, graphics, a bright cabinet that really didn't fit with the area, and lots of bright text and graphics. Our proposal is 3 and 1/2 ft wide by six feet long. five, excuse me, and 6 ft long, 18 in wide. No animated text or graphics, only red text, and that can be dimmed as needed, so we can time it to whatever that we need. It's redesigned to fit more aesthetically into the surrounding
area with dark green colors and natural stone. So, this was the first proposal that everyone saw. that our whole committee pretty uniformly disliked. Yes, we do. We like we dislike that a whole lot. What we worked with the sign company to get is something that was more static. It only had red lettering and again it can be dimmed at any given time. Um can I make a point about the lettering that is displayed on there? Yes.
Um, that is like the maximum amount of lettering that you would ever have on that. Usually, it would probably be just one or two lines of text. And uh, so this is, you know, as loaded as it would ever be, right? And it would be rather large. I mean, when you saw it, it it's not going to be a little they're not going to be little letters. It's going to be goodized leathers. So easier to read and not many words to read, right? Dealing with the distraction issue. Yeah, dealing with the distraction.
And it won't be animated either. It will change from one message to the next message. There won't be any blinking or moving or anything like that. No, no stars rolling around on the side, you know. Yeah.
Okay. So the cost the first proposal the previous proposal was for 27,588. Our proposal we we kept it down. We said we do not want a two there. We want a one. So $19,623 which was a cost reduction of almost $8,000 which is about a third of the cost. Just wanted to make that point. Yes.
So, dark sky compliance. This is a big thing. This is a big thing for me. I still this sign. I I focus against this sign basically on on why do we need it and the cost and stock compliance. So, the previous proposal was bright lighting, multiple colors, strolling text. It was the Las Vegas look. Our proposal is dark sky compliant. We've run it by uh Greg Webb who he's the guru for the valley I think. Okay. For the valley. Yeah.
It can be set to dim at set times late at night, particular times of year, especially bird migration and things like that. This will be more dark sky compliant than our wood group sign. Oh, well, and you have the speed zone signs that you go through. They're much brighter than this sign would be at night. So, the yellow 25 mph things are much brighter than this.
So, and we're using the red lighting, which if you go out to do anything at night looking at bats or anything like that, they give you the infrared red uh type uh lights. So that's astronomical star for these. They need red flashlights. Yes, they do.
So why? There's no need for multiple sandwich boards or signed clutter. Updates can be remotely programmed for more timely updates. The sign comes with SM Infinity, which is the critical mass alerts at no additional cost. This was something that uh Mike Jones referred to. It's the iP system. I capital I, capital P, capital A, capital W. Okay. I don't know if the S is part of it or not,
but uh it will automatically dump uh severe weather alerts to a sign. And I've heard the comment a few times about, well, what is somebody going to get out of their house and drive and look at the sign? This is not for those folks. This is for folks that are either coming or going, the sign is two-sided. So, as you're sitting at the light at ranch road 12 for a minute or two, you would have the opportunity to see the sign as you were leaving or as if you were coming back in, if there was something going on, you'd be able to know it. And uh it's it's something that you heard our search guy Mike Jones talk about as being a valuable thing. In addition, there's a lot of information that can be conveyed about what is going on and the time it takes to change the sign that a little kind of the tacky message sandwich message board we have. We heard comments about this being tacky, but I don't think anything can compete with the little message board we have. Uh the little sandwich board. Well, and and another thing that that this does is that you know, like if we're having severe weather and that low water crossing down by Cypress Point is closed,
we can put that out, you know, so somebody trying to go through on Wood Creek Drive won't attempt it. um because it'll it's closed and the sign has a cellular device in it so it can be updated from basically an iPad or someone's home computer. So even if it's in the middle of the night you hear about something, you could put that up if you needed to. And with the very reduced illumination on it, um it's not going to affect dark sky at all because I'm very dark sky sensitive. experience if they had any problem.
Another thing that it comes with that is part of the package for that 20 $20,000. Yeah, the eye just comes with it. Oh, but um it's also got that warranty. It's got a sevenyear warranty.
It's got a sevenyear parts and labor warranty. So maintenance or operation costs are really should be nothing specific. There was Oh, the other comment we were talking about driving to see the site. Um, oh, I already said that. So, basically, people that are out, they can't be looking at their phones while they're driving around, they don't have their laptop out sitting next to them. The only way they could get some of this information would be is if they saw the sign. Granted, we're not proposing one of these signs for every entrance and exit, but I think everybody here is aware that probably 75 to 80% of the traffic that comes and goes out of Wood Creek goes out of that location. And I personally have sat in line through two or three traffic lights there, especially at school times. So there's plenty of time to, you know, see the sign when you're going out. It's not just a sign when you're coming in. And if you can read the information on the sandwich board as you drive in, and I I've done it myself, and I've never had an accident doing it. Um, you can read the information on the digital sign.
It'll actually be different. Yeah. and more clear. Oh, wait. Sorry. This was the former sign. Mhm. And it was 7 ft wide. Yeah. The new one is going to be that light. I actually went up to my six foot garage door and hel my hands out. So, I know exactly. So, So, I mean, that's pretty much what we have for y'all. We had a lot of discussion in that debate. We had a lot of information.
And you were opposed. I was. And I'm, you know, I'm more comfortable with this because it's not as obtrusive as the other. Um, well, we made it green so it would blend in with the natural surroundings. The limestone base looks like 90% of the houses out here. Well, the sign in front is that kind of stone base.
So, it really is designed other than the red lettering to display it into the background. Um, but you do have to have some lettering that is visible to be able to read it. So, we figured the least obtrusive would be the red lettering. Uh, as I was driving down Range Road 12, I was looking at the LED signs on the gas stations and the green lettering is glaring and pressurized. But if you look at the red lettering, it just kind of it it's very easy on the eyes. So that's why we look that.
And really, this is kind of an old school sign for an old school neighborhood. Yeah. guy said, "You just want just a monochromatic red sign?" And I said, "Yeah, we don't want a tacky, you know, strip mall set that has animated fireworks and stuff." So, that's that's it. Thank you. Thank you so much. The next item actually for this thing.
Oh, yes, of course. Yes. I want to thank the subcommittee and let them know that you abnormally fulfill the task that council assigned you. Unfortunately, as I see it, there was specifically narrow assignment that did allow allow the subcommittee the room to fully explore all possible solutions. The sub committee was tasked with bringing back the item of a dark skies compliant digital sign at Lake Creek Drive and rural RR12 entrance at Memorial Plaza with a reduced cost Hill Country design taking into account all citizens comments. They were specifically tasked with bringing back a digital sign at this location and it left no other room for alternative ideas to be brought forward. That narrow focus did not allow the committee fuller breath of exploration is on council not on the subcommittee. I want to thank you for your work and let you know that I will be presenting alternative solutions that the subcommittee if allowed further breath and room to explore would probably arrive to a similar solution. Mr. Alex. Um, in our committee, we did discuss other sign options, even though you could perceive it as us just looking at a digital sign. So, we did look at static signs that were ones that you had to physically go and change the lettering. We looked at some signs that were submitted by some of the people that provided us with input. And we discussed the pros and cons. And yes, they might have kind of the rustic rural nature to them. They ended up not doing the job that we thought was important for the safety of our citizens and to maximize the amount of information we could give about potential hazards and for just general information about the city on an ongoing basis

Um, just to kind of give a little background on this, um, it's been two years since we last reviewed this policy. Um, policies are typically brought up and reviewed in cycles. Um, we so I do have a question for council and it's regarding a couple of items on here and we I'll we can address this in conversation, but basically we don't have a policy telling us when to bring this stuff up. So without that two years seems reasonable. So I would like some input on what cycle you would like to bring some of these policies up on a regular basis so that we can kind of have like a more distinct calendar for them. Um, with that being said, Mr. Bas or uh firm clear I can never say the title. Clear clear career clear professionals uh prepared this for us. This is not something I or staff wrote. He prepared it. Um, and so it's based on his professional opinions. U Mr. B, did you want to speak to it?
Yeah. Yeah. I mean, pretty much it was just uh really incorporating a lot of what was in Senate Bill 1173 um that raised the threshold of purchases from 50,000 to 100,000. And so uh no authorizations, you know, on that first page, you can kind of see what changed. Um there's really no authorizations that are different other than increasing the amounts that comply with that Senate bill.

um there are very technical um restraints you know the ETF FIA disclosure references and who will be will there be a separate advisor or how do these so this will be regarding our available funds how they're invested right
yeah so Yeah, when when you when you look at this document, um you know, those individuals designated um in this the mayor, the city administrator, city secretary will need to to attend the public funds investment act training as stated in the document. Um that's a mandatory requirement to be listed as an investment officer in this type of of uh engagement. um you know this what what I what I did here was was I took um the public funds investment act as well as you know the Gazsby standards and also looked at uh the GFOA government finance officers association and kind of compiled this into um just updating your your original policy um and the city does maintain a a financial advisor. They you'll typically hear from them when you guys are taking out debt, but they are also also available for questions related to investments. Most cities participate in text pool investments. Um it's it's generally the ones that are the most safe and and acceptable to cities. And so I anticipate the city would continue on that that course of investment without, you know, getting too into the weeds on on other types of investment, which you would definitely need to, you know, loop around with your your um financial advisor on.
Yeah, we um this is not really new to the city. we've had in the policy. Um, and I know that um our our past city manager um took pretty extensive competence of training, you know, sort of the mandatory thing every year. So, he kept up with it. We we rely heavily on on steel um and on Texas Regional Bank, you know, and Texas class where our investments are. So we we we've always to um to real but having the policy in place, you know, sort of just sets the parameters. So so if we get a wild hair to go get some Bitcoin. Um the investment policy said no, you really do that.
Um so so that's that's fully what it's all about. I know it's a lot of a lot of heavy language. And Mike, um I do want to say that really appreciate you being our expert on this and helping. Um and I want to I want to second what um council member Bremer said about the summaries are excellent. Those are so good. And I mean we've always tried to sort of run down what it's all about, but to have it just right there laid out was very very helpful. Thank you.

I just followed the exact language that our attorney prepared for it for that resolution. So, it should be um above board there. Council, do you all have any questions for Mr. Bay regarding the fund balance policy?
Yes, ma'am. Um when I ask about financial statements, we are as I understand this uh we we will have a fund balance not the idea will be six months operating expense and that would be based on open funds that are un undesated. Right? But how how will we determine what those funds are? I've noticed that um sometimes well in particular we had a deposit of 203,000 that was for drainage. So it was deposited into the the bank account and written out of the bank account. But we that actually should have gone in to the drainage. So, and right now we don't have the balance sheet. I know we're working on the audit for the year end um 2025, but we're eight months into the current year and I don't see that we have a place where we can go to and find the unassigned fund balances. What would be the procedure?
Yeah, I I I I'm not looking at that. I I think Jim may, you know, be able to kind of answer that question, but essentially, you know, what's in what's in the budget may not reflect exactly what's in your your bank account or in your pulled cash fund at your local bank. Um, so you should be able to grab a a statement from that in conjunction with whatever is invested in your text pool or uh municipal investment accounts. um that that's money that's also unallocated and available for usage. So all this is doing is setting the the target goal of six months but a minimum of three months in operating expenses um o over those spread across your investments and the reserve in your bank account that's not maybe allocated in the budget. So you're right it's unallocated uh funds that we're looking at here.
Right. Are we going from 500,000 to then 400,000 as our ideal? What is the current minimum fund balance? I forget what was in the last policy. Um, I don't think it had a number. I don't know that it had a dollar amount. It's generally six six months spending.
2024. It's listed in the summary. He references the previous dates and it was based on uh like he said it was based on a sixmon um sort of needs was the minimum. The policy you're referencing that was half a million is uh like five years old now. It hasn't been in place for at least four years I would guess based off the top of my head. Uh Kevin Rule actually was the person who uh updated the policy struck that from it and it was updated once at least since then if my memory right. When I went to the website tried to find it that was the only one that came up. So
yeah we typically only have like a threeyear uh lead on the website right now. Everything else is considered archived just from the the website transfer. as we continue to build with the new website that that lead time will be extended but we had to pay you know we only got a certain number of documents and things that they transferred for us. So we we selected three years everything at the bond map.
Yeah. And typically typically cities do not have like a set dollar amount because as your budget fluctuates and changes as you know either you grow as a city or you know the uh budget you know could potentially shrink it. It's difficult to maintain the dollar amount. So that's why it's usually looked at as far as operating during a period of time. And on that question, um, typical cities I understand are this is six months is actually a very healthy amount of time. Correct.
Absolutely. Mo, this is this is in compliance with, you know, GFOA and Gazby standards. So most cities have the three-month minimum with a six-month target goal. Um, and it the one the there is an option for the cedar color that we we proposed or was preferenced. So, um, after researching several different um, vendors, actually, Council Member Griller, uh, pointed this one out to me, and that that actually turned out to be the lowest price out compared to all the others. And you went through the other buy and all the all the different options. And these guys were were easily the they were one of the few that had what we wanted,
but it was also more economical than some um based on based on the triangle as a location. Making sure I get my angles here. Um, based on me walking out there and and and looking around, we've got proposed a location near the stop sign that Mark brick hollow comes down to Wood Creek. Um, being visible from both sides. Um, even though there's trees there, you can see it somewhat coming up Wood Creek, you know, from from the low water, you know, past tail
and then this is coming from the entrance. um that made the most sense and was the most visible spot. Yeah. To me to make the the biggest impact. There any questions on those floor? I will say it's also where the other signs in this area are gathered. So there's like kind of two clear sign points. Um but one of them would be, you know, it would lose everybody who breaks off. thank you. Um has the issue with the tree the has trees and parks committed to maintaining this vehicle sign?
No one would be maintaining this. It is a public sign for the public post items and remove items. So, if the public chooses not to ever approach this sign and never takes out old things, I'm going to assume staff is going to be responsed for public communication. The only people who have expressed interest in using it are the community relations committee who would be posting um you know their event signs that they produce and that where this kind of originally came from. We selected the trees and parks budget line item because can I finish answering your question?
Trees and parks have not met right because they haven't met a quorum. The staff and I administrative selected this budget line item because it had a open cost and it would be installed in a park and the CRC board suggested this budget line item as well.
Thank you for your thorough answer. Um, the other the issue I h have with this is one the the the clutter that it will attract as well as the actual location in our parks. I really think we're almost done with adding objects to our parks. We should really focus on the creating more of a peaceful sanctuary sort of space when focus on plant tree planting and landscaping. Um, I also don't like the specific location because it's you're approaching it and it actually blocks the triangle when you approach it from the main entrance. Um, for that reason, I am in the council changing the location to be at the city hall's parking lot where there was once a park bench near the little library.
Change. I don't think you can do that. That's a completely different location. Yes, that's called an amendment. I'm consulting with an attorney right now on this topic because it's a pretty significant change. It might not be German. The agenda item number 11 is narrowly tailored to at the triangle park and it's about the park. So any calendar proposal would need to come back on the future to um for open meetings compliance.

I just if I may think that um coming out of their budget um it would it is on part to part we wanted to protect staff from having to do and I think I brought it up when we talked about this in the first place and Mr. Done argue against having it all the parts consolidated into one area which you know helps but still park and now that we have a really good group of people on trees and parks um I think it's I think it's fair for them to take a look at it and discuss and bring their recommendations back to council there's no rush to put this up
you know so I just thought there'd be better to do. Can I ask a question about the amendment on I in listening to it? I didn't hear that we are we sending this packet of materials specifically to them or are we asking them to just take this item up? The wording is to send this item, right? So which version of the item would probably be the version that I'm referring to right here. Is that what you're confirming on record right now that you want to send this item to them?
Correct. Okay. Um I want to speak to and and agree with Mayor Pro Rasco. Um the reasoning also is that we have new members who are actually master naturalists and their focus is probably more plant-based and I think you know this is their budget so maybe they want to go into the business and I think we should allow that. you know, these especially these are brand new members of the Denver band on one of our boards before. So, I have to say, if I may speak again. Yes, sir.
I have to say that I'm I'm sort of torn. I see I see both sides. I mean, it's like, you know, we just we just um we didn't vote down the digital message board because we didn't get to to move it. I mean, didn't get a second, you know, and we talked about, you know, color. So there there is the science thing, there's the aesthetics thing. Um, but you know, my my thing from the time I was mayor before I was mayor is, you know, we need the city to be able to communicate to our citizens everywhere we can, you know, because they're not all on email. They're not they don't get texts, you know, they don't, you know, just we need to get it out there for them to see. There's also been forever I mean to post, you know, the lost dog things, the lost kitties, you know, and and we literally go around and and tear them off of stop signs and things when they're posted against our ordinance. Um, so this gives people a place to do that. If this isn't the exact proper place, it doesn't it doesn't defeat the need. Um there's still, you know, right now that that actually the way it's written about now, it is in our designated sign area, you know, for for the private park.
Um that's where we're supposed to and it would eliminate, you know, some of the some of the um like yard type sign and and garage stuff. And so it it but I do think that I don't think we can count on just the general public to go on a regular basis and clean it up. You know, we need we need, you know, some designated volunteers and whether that's the trees of parks board or whether it's the, you know, Wood Creekers of Wood Creek, somebody Yeah. somebody that, you know, routinely said, "Oh, you know, I want the aesthetics of the city are are important to me." Um, and yeah, we'll we'll I mean, I'll do it. I mean, I'll go down and take this side down too long.
I didn't like that in the first place, you know. So, um, so anyway, that's that's not going on. Okay. I I think I expressed this at the last meeting, but my experiences with the blood board are not good because of that reason. People put up the signs for lost never go back find the dog. You know, it's just it's just human nature not to keep those signs up was that was our experience because Chad and I ended up with that that tax. But since we did not vote to approve the message board, that leaves staff with still having to do the letters. Well, the sandwich board is fine.

Right. Second by council member Swedberg. Um so this item was uh brought to me by a citizen. She saw that boot design at one of the gates meetings and she thought that is incredibly clever and very educational. And so if you had a chance to look at it, it is essentially the aquifer that we live on in a snapshot and how it relates to other um underground water bodies in the area. Um the artist selected because this because the artwork was already present for this proposal. It is a little different than the way the beautiful process typically works. And so they requested I've already been in communication with them. They're fine with the process being different. Mr. Weber discussed how Tesco has already approved us using this and it sounds like he's willing to fund raise a pretty significant portion of this to alleviate any cost to the city, but I was challenged to find an artist who is willing to work with this design and not want to come up with their own, but keep true to the the theme. And so the artist elected is Ashley Dalton. Um, if you're not familiar with her, I just gave a little snapshot from her Instagram, but it really doesn't do her stuff. She's got artwork at Neon Armadillo. She's got artwork at the New Howdy Neighbor. She's a nationally recognized artist who um is doing really well and she captures our kind of like rustic cowboy spirit while with a little bit of a modern twist. And a little something fun about her is she's actually a previous water attorney. So she was absolutely over the moon with this design. She uh loves it. She was um you know thrilled to be invited and she felt like could keep with the actual educational centerpiece of this. Why I'm proposing the triangle park in particular is because we have created an educational base there for uh water conservation, rainwater collection, native plant installations. And so this would kind of um be an like
a an additional component of that to help people understand our aquifer and the formations of it. um because that's kind of you know the whole point of the triangle is to help people um sort of invest in this like new way of viewing our um land and our land stewardship and so this boot would complement that in my opinion um mayor. Yes sir.
Thank you. I want to thank the mayor for bringing up back up the discussion of city of Wood Creek supporting the visual arts. Over the last several decades, cities across America have taken up campaigns to help define their specific city with an object and then having that local artist paint them, then place those objects around their city. Hano, Texas has its hippos. Cincinnati, Ohio has its flying ps. Washington DC has its pandas. Pittsfield, Massachusetts has its sheep. And Wimberly, Texas has its cowards. One of the functions of the city's taking on this form of supporting the visual arts is about the city branding and tourism. It's a way for the city to announce that they support the arts. That sentence and structure of its meaning is place is placing the city's identity above the individual artists. Using Wimberly's chosen object of a cowboy boot sidelines Wood Creek's ability to define itself and allows Wood Creek to be absorbed into Wimberly's identity. Wood Creek is a separate and unique place. I think we should be thinking about Wood Creek's specific identity and what that would look like when it comes to the visual arts. Heck, a large golf ball on a tea painted by a local artist would be more fitting for Wood Creek. Though I'm not suggesting that is the direction that we should be taking here. The others I take with this kind of a good idea is that it is another discrete object placed in our parks. I really believe that our current parks are rather done when it comes to objects being placed in them. We need to start considering what is being lost with this additive mindset. At this point, I see the triangle, Pigsite Park, Augusta Park, and Memorial Park is pretty much done when it comes to objects, and we should be focusing on planting such as trees or landscaping. Let's not love our parks to death with thingies. Let's let them breathe and be sanctuaries for people and I do support the city exploring ways to support the visual arts and wood. Some of my ideas would be about public art
that is integrated into the creek's landscape and not another discrete object simply popped into a park. Moroasco had previously mentioned the idea of a naturalistic mural on the dam near Cypress Point. And that is more of what I'm thinking about the integration of visual arts into our local environment that is specific to Wood Creek. For instance, have local artists paint little libraries in the city. Things that can be interacted with. That is the thinking of what I'm thinking with Creek should explore. Art that interacts with the environment or the people or both. I also see an opportunity of considering how we could utilize the upcoming pedestrian bridge as an opportunity for public art or perhaps integrating art on the safety rails etc. Often with city infrastructure, it is common to have art elements included in the projects. Also, there tends to be more grants available to help with public art when it becomes part of these kind of projects. I think the city can explore Wood Creek's identity when it comes to the visual arts in our city and explore what ways we could show up that are not individual objects placed on our parks. For that reason, I amend that council takes this item and creates a subcommittee of mayor proton Rasco, Heather Carter, and council member Bremer to explore the creation of the unique sightspecific direction of public visual arts in Wood Creek that integrate and become part of the Wood Creek environment.
It's also a completely different item. Yeah, you can't. It's that is not what this agenda item is. It's about a boot in the triangle. So if you want to form a subcommittee to take up the boot in the triangle then that's germaine. Forming a subcommittee for a completely different topic is not
city attorney. I'm when I go to the essence of what is being proposed which is public art in the city. I can't create subcommittee to explore public art in the city. Well, there's always a concern of adequate notice of what action will be taken under the open meetings act and you need to have an item that adequately provides notice in order to take that action and the creation of a committee is substantively a whole different thing. There's also a concern about you want to make sure that a committee doesn't have a quorum and then you know um we understand that part. That's why there's only two of us. Okay.
On council. Other partners not on council. Isn't there already a subcommittee for ERS too? Yes. They're the mayor subcommittee. But well, so that's my second then. No, we were discussing whether or not this was legal and it doesn't sound like it is. There's a way to get there by bringing a separate agenda item back in the future. Okay. Uh comment council member, you have the floor at this time. Sure. Council member Bailey.
Okay. Um I think the similar to the sign the objections of the community will be that it is incompatible with our our laidback country style. If the boot had, you know, woods and creeks, it it would be very well placed in a schoolyard or somewhere for educational purposes, but one, I think it's incompatible with our environment, and two, um, I didn't have to bring it up during the dig digital sign, but I on some of our prior studies, I carefully documented what people were saying and one of the big things they say is stop spending money. Just be careful. Let's only get what we we need. People are looking at difficult economic signs and they're just going to say that's just another 10,000 out the window. So, my two objections are I don't believe the design is right for our city. Maybe right from someplace else, but not our city. and that it is an unnecessary expense.
Any other new comments? Not echoing what already exists. I will say a boot is going into Wood Creek, just by the way, DoubleJ has commissioned one. So, there will be a boot in Wood Creek already. And um the design as proposed would need filler and um Ashley would be filling it with artwork related to the area such as native plants and animals and and flora. So um because it has to wrap around it's a flat design but you know and then the test bill offered to cover a pretty substantial portion of the cost for us. That's what we Yes ma'am. I I agree that I don't see this tied to Wood Creek just generally when I look at it, but I saw of what it's about. I wish there was some us to incorporate it and would especially since I know would get the funds.

um and their their deal it's it's not I mean it's Wimberly valley which we're a part of and we've worked really hard to build up our relationship with the city is really and the rest of the valley. Um so I I just I don't see that part of it. I mean that's it's fine with me to have a booth if that's what we want to do. Um personally it's not my favorite piece of art. Um you know go San Marcus and see the the mermaids. Yeah. Everybody does it and it's like it's like okay. Yeah.
Um you know you know what would we do if it if it wasn't? I mean I appreciate that you know the you know Wimberly arts.org and the and the Wimberly beautiful um have put so much work into into beautifying um the city. I mean I mean Councilman McGre can't get a boot
you know at at a restaurant we you know double J you know so I don't I don't have the problem with the cost. I don't have the problem you know with the with the regionality of saying well it's not big enough and I think the artist can can deal with that. Um, you know, to me it's just a question of whether a boot or something else that would work better for the city. I would say I was just I was finishing up you know one of the thing one of the reasons that I wanted to do a a subcommittee on public art um is that you know I talked to actually a few people who said you know the triangle will be a great spot like a sculpture bar you know we have you know have public art display and say, "Well, that's a great idea. We didn't get we didn't get it done." But I mean, it's not the first time it's come up. And I believe we talked about the concept of a boot as part of the subcommittee at one point. Um, and it wasn't

Essentially, it's a formality of the city allowing the watershed association to partially fund this position with the county. The goal being to increase the pay allocated to this person. Yeah. So the county is down by pay scales and they can't wiggle too much on that, but the woman they found is exceptional and she's a currently a public school teacher, but the uh county pay would have been less. And so the watershed said, "Hey, we'll we'll flip the remainder of the bill to give her a little bit of a sip to cover things like gas, etc." Um, so that's what this is. This has zero financial impact to our city. Um, yes sir.
I was going to say it was confusing reading through it because it's got the entire interlocal posted there and it's like no we're not we're not approving or disapproving the interlocal that's that's done deal. Yeah.
You know all we're doing is saying check water show association if you want to kick in 20,000 of your own money knock yourself out. I I do need to clarify that it's um the interlocal agreement does terminate this year and so we would have to um it will be brought back to us for consideration and that's actually written in this as well that um you know if the agreement is not renewed then the wershed's not committed to this payment because that position would potentially be revoked from the county but that would be up to the county to decide on that position and this person's pay Um I just wanted to clarify this is we are not approving the interlocal agreement again right now either. I move that council adopts resolution 2026-05-13-01 security camera data retention policy with the following amendment that states the six five annual surve surveillance report. The Wood Creek City Administrator or their designate shall sub submit to the city council and make available on its public website an annual surveillance report for each specific surveillance technology used by the city on or before March 15th. Section A. The annual surveillance report shall at a minimum include the following information for the previous calendar year. One, summary of how the surveillance technology was used.
Council member Gard, I'm sorry, I have to pause you again. This is not on the agenda. So this No, no. Can I please finish? The city is not installing surveillance equipment. Surveillance equipment is not in question here on the agenda tonight. Security cameras are not surveillance equipment. Additionally, this is a data retention policy update that is administratively needed. It is not a new policy regarding reporting to anyone which would have to be an additional item brought back and I would encourage you to stick towards security cameras not surveillance because we don't have surveillance equipment here completely different
city attorney. So, there's a couple of parliamentary um points to be made here. And then there's the legal question that I anticipate you're about to ask me is does item three encompass discussion of um
so if I can get your hand out. So what I would suggest is from a parliamentary procedure, it's up to the presiding officer to say that this um handout that has been placed on the DIS and left for all the members to review that for the record this can be called the additional proposed um requirements that you from what I interpret are a are asking to add to the resolution. Correct. Correct. So this is a generic a more generic agenda item because it's a consent item about a resolution. It is common for amendments to be proposed for resolutions. I I I don't think you have to read the whole thing into the record. You can just call it the required heightened uh proposed uh requirements uh to to be proposed to be added to the resolution and then perhaps make a motion to that effect if the presiding officer acknowledges this handout. Um and just do it all at once without having to go through the whole thing. That would kind of speed things up. So the goal is if I maybe I had before you interrupted me. Um so there's a security camera neighborhood detention policy surveillance security camera exact same thing
regardless of what the mayor wishes to choose and um because our security cameras are in public spaces. So what this additional part is just creating a report to council annually on what is Google what is being done with the data that's this is a data retention policy so we get it council gets a report annually on this is what happens with the data or this is what has happened over the last year with the data so it's a data it fits a data retention policy it's because it's a report about that data and that's the goal. So, if I was to correct my motion, I guess,
well, you haven't made a motion yet, but from what I take it, you're proposing to add this to the resolution. Um, and you're suggesting
I think from an open meetings act standpoint, you could make that motion. Now, there are other legal concerns. Um, this is an irregular addition to such a retention policy resolution. Um, we're talking about technology that's very common. It's as common as a ring camera. U, this is not license plate readers. This is not body cameras for law enforcement. Um this is something that um there are policy considerations that the body can discuss like you know creating new records via reporting requirements there's the public information act uh retention schedules you know effect on staff um but then you know from legally I would not recommend such an addition for this technology uh legally I would recommend it for license plate readers or something that has a database that tracks registration vehicles and ties it to individual names and kind of has a central database that can be searched. Those concerns are just not here. There's so there's a balance between privacy rights of individuals and legitimate security concerns of facilities. Um, in fact, this body has a legal duty to uh protect the city's assets and be good stewards of of taxpayer facilities. Um, and that's what this is attempting to do, which is the policy as it stands doesn't have any reporting mechanism to council on how the data has been used over the previous year. That's what this addition does. It creates
staff report annually about the data and how it has been used. Like if the police department came in and said, "Okay, we want the data from camera 7 at the Creek Side Park and they used it for a case. All it's doing is creating a report to council. Last year there was three missions of the police state of our data or and there was maybe five foyer requests for a particular camera.
I I'm I'm going to interrupt again. A this is not on the agenda. We're not talking about surveillance equipment. This is about surveillance equipment. You just heard from our legal council that this is not a recommended policy for data retention regarding security camera equipment. Additionally, it is not you're requiring public hearings, etc. This creates a pretty extensive labor add-on, and I would suggest that something like this be brought forth in a separate policy that is not what we're doing tonight, which is just an administrative need because we have to have a data retention policy. We've had security cameras at city hall for decades now with no data retention policy specific to them. When we consulted with TML, this is the only thing they said was required for us to have. Our security cameras are not being used for surveillance. And I Googled the difference and they are completely different. Security cameras focus on deterrence. They record they're generally visible to warn potential intruders and they're used for incidents, meaning you you access the footage if there's a known incident. Surveillance systems, however, are constantly monitored and observed and used to collect data. We're not doing that. This is not on the agenda. It is not administratively needed. Our legal counsel just said it's not recommended for the type of equipment we have. Do we have an actual motion related to the actual item on the agenda?

If a surveillance concern is present, that policy can be brought back at another time. I would be recommending that we are more careful with our language and I do not want to imply and I want to be on very clear on this on record that our security cameras are being used for any kind of surveillance purpose. They are being used to protect our assets for reference in the event of an insurance plane, right? uh vandalism, which we've had, and you know, basically just kind of uh crimes. If a child is kidnapped at our park, we will have a camera that could possibly reference a vehicle or move, right? That is the point of our security cameras. And I will say again that city hall has had these in place for a very long time with no surveillance policy presented in the last 5 years. So I question the point of this tonight information sir um anyone can foyer data public surveillance camera right public information act under Texas law. Yes, but the purpose of a retention policy is to for this type of technology is routine for I mean pretty much hundreds and hundreds of local governmental entities have security cameras on their buildings and those routinely automatically delete after 30, 60, 90 days, whatever it is. And uh they're not ever um pulled unless
there's a retention request. Uh that's a legal request from an attorney or from a court or or a public information request that would that would require preserving that without the automatic deletion. That's the purpose of the retention policy. So that reduces that mitigates the potential harm of privacy concerns. You don't have someone watching someone um all the time or just logging on and looking and and the other key facts here or you're talking about public spaces like if you go out in public in a park it's very likely in our modern day society that you will be filmed either by residential cameras or by public cameras. This is a very common thing. So there's a balancing of interests that have to occur between those individual privacy concerns and then the public or the government's interest in um public health and safety for both property and people. Um and so based on technology in use here based on there there's just no legal concerns for this technology as presented.
I will say in the policy talks about who the authorized personnel are for access. It st it's clearly who they are and it also states that selected content may be shared with local law enforcement or a relevant insurance agency. So the idea that anybody is going to get access to this footage for any old reason is just simply not accurate. You just said that anyone is allowed this information,
right? But a FOYA also goes through our attorney and so there are checks and balances and they won't just have access to anything either and they can't it won't necessarily be retained. Do we have any other questions or concerns about the actual security camera data retention policy as noted in our agenda and publicly noticed? Uh this is not on the agenda, but uh and I'll give I can't discuss it much, but um if you have a brief question, I'm happy to answer it, but uh possible grant application for the purpose of purchasing land in partnership with the wershed association and city of Wimberly for the purpose of water quality protection and source management. Okay, great. uh a resolution regarding policy related to regular maintenance, review of contracts, and assorted repeating city schedules and needs. This is kind of what I've referenced a few times in the meeting. It would encompass everything from Culbert cleanouts, rightway tree management to those policies that we talked about earlier. Yeah. um a license agreement would be a me recognizing the city authority to repair the road in that neighborhood building. Yeah. And uh right away parking ordinance update must be yeah regarding vehicles being able to park in a rideway specifically related to the one not in residence at the house.

Um there are support groups for dementia caregivers. We can't discuss too much. That's that's what I will bring as um an agenda item. second.
That that is also a subcommittee. So, you're all good. It's just pending business we're waiting on. So, in June, we'll probably have a few of those kind of items wrapping up business once a year as we approach the next budget season. Okay. Any other future business?
All right. Well, not uh we have city volunteer opportunities. Our planning is zoning commission needs one more commissioner or community relations committee um likely needs two more members. We have a possible resignation. We don't have it in writing though. It doesn't. You got it now. Okay. So, it will have two members. Uh trees and parks board will now only need uh two members. Yeah.
Oh, actually we have another applicant coming in June. So, that's why it says one up there. Uh May 20th is the deadline to send all budget considerations and submission requests for all of council staff and advisory bodies. This is because on ju in June we start with our preliminary budget and um a new process I'm hoping to get you all in support and actively engage in that uh we won't be placing items in our capital improvements portion of the budget without a direct vote supported by council that this is an item worthy for the next year. Um, just because I don't want to have any more of this confusion about what does an item in the capital improvements mean? Is it we're financing it moving forward? We should spend time on it or nobody actually supported this and whoopsy daisy. So, we don't want to have that accident again. So, because a lot of people wasted a lot of time this year.
