ones. Uh, what you have before you, Mr. Chairman, is a final plat for Tillery Estates. The applicant actually came to us a little while ago and these tracks were set up in prior to our code in 1998. So, they're they're nonconforming, but what they want to do was combine a couple lots. Uh they also wanted to sell a tract that was upfront. So, they wanted to actually make three three tracks out of all these these locations here. And they're all under one ownership at this time. and I advise them and they also need to have an access easement for lot three and we also show Waverly as a arterial on our land use map. So we want to get some rightway dedicated and felt like encouraged them highly to encourage them to just do a final plat. So all the information is on one document at one place. And so they went ahead and hired a land surveyor and got all the information put into place. And have what you have before you is three lots. And of course lot two in the back is actually a non-conforming lot. doesn't have the frontage required, but as I'd mentioned, it actually had a house on it at one time, and it is a non-conforming existing use. And actually, that's where they want to build their house. They want to sell a lot up front um to help pay for the house that's uh they're going to be building. So, with that, actually, it's lot one's the one in the back. Lot two is the one that they want to sell. So, what you have before you is a final plat. We've gone through our typical review and procedures. Joe Johnson's looked at this. I've reviewed it and now the plat is for the planning

commission for approval. And then it will go to city council for acceptance of the rightway along Waverly. So, with that, I will stand for any questions you may have. Questions for Brad? I guess all the water line and everything goes down through the access easement. or well the water water lines along Waverly so okay but when they but they've got actually they do have a water line I don't know if the meter's been taken out but there's a water line cuz like I said lot one there used to be a home back there okay and then lot two they're going to sell or lot two yeah lot two is the one they want to sell sorry three sorry three all right well let me look at this again I'm getting my eyesight is Yeah, lot two is the one they want to sell. Lot three has an existing home on it. Oh, okay. And so that's why we've got the shared access easement for to allow for because right now there isn't an easement or any way actually lot three is landlocked, but right now all three pieces are under one ownership. So felt it was an appropriate time to get that shared access easement for lot three and if sometime in the future that one gets sold off as well I'll be able to do that. But answered your question is that's a shared access easement the shared water line. Yeah that's utilities. I guess that's kind of what I was asking. Are the utilities for lot one all going to be going down through the access easement? That I don't know. I'll have to check with that and see where they're at. But, uh, is that part of the plat requirement? We typically require easements. Well, these are service lines. And yes, we do often on the outside boundaries, sometimes the five or 10 foot, sometimes even 15t easements, but there isn't any

sewer or anything actually. Well, there is sewer farther to the to the west, but really everything on these lots are going to go towards Waverly as far as water, electricity, and they're really service lines at that point because the meters are typically in the rightway.
