Fine. Thank you. Just kidding. You were. So welcome to the architectural view board meeting for Wednesday, April 22.

0:23 – 1:110

Calling the meeting to order. Let's go ahead and do the pledge. Okay. So we are going to move on to the approval of minutes. So we have ARB-three 90 approval of 03/25/2026 Architectural View Board meeting minutes.

1:131

I'd like to make a motion to approve, the meeting

1:152

minutes. I'll second. Okay.

1:24 – 1:490

Thank you. Any discussion? No? Hearing none, all those in favor of approving the minutes say aye. Aye. All opposed? Hearing none, motion carries. Are there any additions or deletions or any reordering of the agenda? No. Okay. So it might be reordering.

1:493

We might be reordered if the representative from Maidstone doesn't come.

1:530

Okay. Do you wanna go ahead and since we have Sure. Someone here, do swear in.

2:00 – 2:123

Sure. Just please raise your right hand. It's just to swear you in. Do you swear to tell the truth, the whole truth, and nothing but the truth? I do. You're sworn in. Thank you.

2:124

Thank you.

2:140

Any ex parte communication?

2:181

Nope. None. None?

2:200

No. Okay. Moving on to new business. Am I just still going in order, Kelly?

2:273

Yeah. Draft horse.

2:28 – 2:400

It's just with draft horse. Yeah. So we're gonna look here at ARBDash388. Petition number 2026Dash0012DashARB. 14924DraftHorseLaneAlternativeDesign.

2:41 – 3:123

K. So the owner is William Wilson, and the agent is Bartley Builder Group. The property is 2.39 acres, and it's located within Paddock Park 2 in the Equestrian Overlay zoning district. And it's requesting an approval for an alternative design for a 70 by 30 shade structure to cover a sports court. The property was purchased in 2023, and it consists of a single family residence, pool, and sports court.

3:12 – 3:513

And they went, the property underwent major renovations since the new owner purchased the property. They applied to relocate the the sports court and to put a, shade cover over it, but it was returned because it did not match the principal structure. This is the front of the property from inside the hedge, because there's a six foot hedge all along or a pretty actually, it's very high. I think it's about five feet. Gonna be taller than five feet most likely, around the entire property.

3:51 – 4:213

And then there's Eureka Palms lining the back. The sports court that's uncovered is on the lower right, side of the screen. So you can see that it's surrounded by the ricas on all sides, and it's pushed back pretty far from paddock. This is the proposed sports court. It's 30 by 70, and it angles from 14 feet on one side to about 17 feet on the highest point.

4:24 – 4:573

It would not be of interest to the neighborhood as it is located directly behind the house, and it has thick landscaping around the entire perimeter. It's the minimum alternative needed. And similar structures do exist throughout Paddock Park. It may not be over sports court, but they are covered arenas that are made of the same material that are ag exempt, don't have to look like the structure, and they don't have to get they don't have to meet zoning requirements. And it does meet all setback requirements.

4:58 – 5:263

So if the ARB decides to approve the application tonight, these are the conditions of approval that staff is requesting to be included, which is our normal conditions that we include for these shade structures. And this concludes my presentation. And the agent here, we have the agent here to answer any questions.

5:260

Okay. Thank you. I

5:292

If you can come to the do

5:303

you wanna add anything?

5:312

That I have the pictures in large Okay. For the property.

5:341

I guess she's the

5:350

I think are those the same pictures we have?

5:363

Yeah. They got they have a picture in in their packet.

5:400

These are you talking the pictures

5:420

Of the property?

5:423

Yeah. I'll Yeah. It's

5:471

I'm sorry. Just to clarify, the agent as in the agent representing Yeah.

5:522

You can

5:521

The owner's rep. Got it.

5:543

Okay. We can hear.

5:560

And if you could just state your name, please. Brooks. Thank you.

6:022

Really just adding that I have the pictures enlarged. That's it. The photos that are I think there's four of them on one sheet.

6:08 – 6:202

Think of them bigger. Just so that it was clearer to see what we're we're proposing it going, that it's not impeding the the architecture of overall build up of the community. It's not.

6:201

Ms. Chanel, if I may, what what's the structure for? What kind of sports?

6:232

It's covering a tennis court.

6:250

Oh. Yeah.

6:271

So it almost in the photo looks like it has a bit of a slant, but that's probably just so that the water can come down. And so how high again is the structure?

6:373

It's 14 feet on the lowest point and then it angles up to 17. 17 feet.

6:442

And that's going to be

6:453

a tennis court underneath

6:475

the eye.

6:471

14 feet is enough to clear because I play tennis. Tennis? Well, I just And I hit the ball pretty hard. Sometimes it doesn't go in the right direction.

6:562

Yeah. It's like 14 feet.

6:573

These must be skilled tennis players. They must be playing

7:002

tennis. Don't know that you're only going to play tennis but I know that it does have the outline for a tennis court. It might be

7:071

Pickleball or something to that

7:090

the picture I saw basketball, I thought it were I thought it was saying over basketball Yeah. In that other image.

7:143

Think it was it used to be a basketball court and then they relocated it or

7:19 – 7:462

He does have a basketball basket on there as well. But that's the term sports. So it's Everything. I have to tell you, to me, this looks like a structure to house toys. Oh. Boats, jet skis, that kind of thing pull up under it. This is not a sports court. That's Well,

7:463

it's just a cover.

7:48 – 8:142

Right. You're saying like quads and stuff like that. I I get what you're saying. There's no access back there for that. Could you pull the microphone up? There's no access to that area for vehicles. He'd be driving over his storm systems and landscaping to get back there. But this just does not, to me, in any way look like a sports court.

8:181

Kelly, does it matter if the usage is Okay. Does it matter Oh, if sorry, John.

8:242

This is what we saw. I apologize,

8:275

guys. My agenda says 07:00.

8:323

Now I know where everyone is. I'm sorry. I don't know why it says that because it's pre done in the system.

8:370

It's it's been I was gonna say it had

8:393

been. It had been?

8:400

But I knew we changed it to 06:30.

8:423

So okay. Yeah. I'll let the clerk's office know because it's something that you generate. You press a button and it generates.

8:485

Yep. I apologize.

8:501

Kelly, is it a necessity that it is used for what we're disapproving the design. How it's used?

8:583

Yeah. How it's

8:590

used is

8:593

not something that we

9:001

And it is covered from screen from all the roads, and it meets setback requirements. So really

9:072

This is what they wanna put over Yeah. This.

9:110

For the tennis court. Right. It's for tennis. Well, but it's For whatever else is

9:162

a basketball. This is not a sports court.

9:205

Well, you've only got 14 feet or 17 feet, depending on the pitch. So I don't know what activities would be taking place.

9:262

Nor does it fall under our

9:301

jurisdiction of what it's for. Basically are we finding it

9:332

Aesthetically.

9:34 – 9:461

Aesthetically since it's kind of out of view is it really something that's a problem? Correct. I don't have a problem with it.

10:020

Is that the pic one of the pictures she provided? Yeah. It's blown up. Some better some better photos. Right now, we are just doing discussion.

10:115

Okay. I mean, looks like it shielded from view from the road.

10:151

Yes. Thank you so much for that.

10:22 – 10:493

And like I said, it's a typical throughout Paddock Park, a lot of you'll see a lot of buildings, a lot of covered arenas throughout the neighborhood that don't match the the principal structure and that are much larger. Usually, those are about 200 by 75. And those are all billed ag exempt. So that is why they don't come here. That is why they don't look like the principal structure.

10:533

And this structure is not eligible for that.

10:561

Does anybody else have an issue with the

10:580

They're just looking through.

10:595

So the images that were presented looks like it's currently being used as a basketball court, correct?

11:043

Yes. It's it will be used as a basketball court and then possibly a tennis court, pickleball court. Versatile.

11:135

I mean, look, it's not for me to play in, but I don't know how you'd play any of those sports with a 14 foot ceiling.

11:230

Hopscotch. Maybe they plan on doing something else with it.

11:285

Yeah. I mean, is there some other intent? Because it just logically, I don't see how this is a cover for a sports court based on the sports that were mentioned.

11:36 – 11:503

I mean, they they pulled a permit to relocate it there, so it was in a different location, and it and they pulled a a building permit to move it. And it was permitted as sports court. So I don't know if they would have

11:515

I mean, it really doesn't matter. I mean, whether it's a patio or anything else, it's the cover that's really in question. Yeah. So I guess we really shouldn't be bothered by what's the use below Yeah.

12:043

They have good aim. They don't go higher than 14 feet.

12:075

Like I said, I'm not playing in it.

12:112

Do you see this, Ray? Yeah.

12:22 – 12:330

Okay. So at this time, I will go ahead and motion to open to the public. If anyone in the public has any kind of comments or anything that they would like to share on this.

12:335

Second the motion.

12:350

Hearing no comments from the public, I will close the motion. Do you guys have any discussion?

12:44 – 12:552

I still don't any right, no discussion. Okay. She got the seven

12:553

I apologize.

12:565

Sorry about the same agenda again.

12:57 – 13:083

The agenda said seven. It was at 06:30, and I didn't realize that it said seven on there. My no. My apologies. Good. I wondered why there was nobody here. So sorry.

13:095

Just got here myself. So

13:112

You're good.

13:124

And my my packet was delivered to

13:153

A different house.

13:160

Neighbor Okay.

13:174

For the second.

13:173

We'll time. We'll figure that out as well.

13:201

Yes, please.

13:213

Sorry about that.

13:224

My apologies. My apologies.

13:240

worries. So we'll give you a second to look in that. We are going over, if Maria can show you where we're at.

13:332

Sure. This is what it looks like now. They may converted to a tennis court.

13:40 – 13:562

This is the palettes shaded, protected. Mhmm. And then this is what they would put on top of it. Yes. I saw that. So I'm 14 foot height. At the

13:560

highest point? The high. 17.

13:583

No. 17 at the highest, 14 at the lowest. Oh. It's angled.

14:01 – 14:150

Mhmm. Then you. Then we discussed where it's located. You've got the eureka hedges And that are on two of the sides. And then, what is it? The ficus on the other side?

14:153

Yeah. I think it's Calusia.

14:160

Calusia? Yeah.

14:193

But it's pretty

14:202

much But it's covered.

14:216

Correct? You can't see

14:222

it from the street?

14:223

It's so far back. It's over a 100 feet back from the right of place.

14:27 – 14:430

Okay. I mean, one side is gonna have the five foot that are there now, the bushes, but it's so far back. So and right now, Sal, we're just at board discussion. So if you would like to discuss. If not,

14:432

we will

14:440

we'll just give you a second.

14:454

No HOA there or anything like that?

14:482

No. Neighbor issues? Not that I've heard of.

14:524

No complaints from neighbors? Thank you. You're welcome.

14:570

We'll go ahead. Would anyone like to make a motion?

15:001

I'll make a motion to approve Petition 2026Dash0012ARBDraftHorseLane based on staff's findings.

15:11 – 15:230

Their recommendations? Okay. Do we have a second? I'll second that. Thank you. Any objections to the motion? All those in favor, aye.

15:230

All opposed?

15:280

Okay. Thank you. Motion carries.

15:323

K. We'll send you a letter tomorrow, and so, your building permit should be approved right after. Okay?

15:380

Thank you.

15:381

Thank you for your time.

15:390

Thank you. Bet. Do you

15:412

want your pictures back?

15:433

Are you here for Maidstone?

15:442

Do you want your pictures?

15:473

Okay. You

15:482

can come over here.

15:486

We have

15:501

to swear.

15:505

Thank you.

15:513

Sorry. I'm so sorry.

15:521

We have to swear them into

15:540

Yeah. Yeah. Thank you.

16:072

If you could just,

16:083

we're just gonna swear you in before we do anything. Put your right hand up. Do you swear to tell the truth, nothing but the truth?

16:17 – 16:340

Thank you. Awesome. Thank you. So we are on, still under new business, ARBDash389. Petition number 2026Dash0014DashARB 11928 Maidstone Drive Alternative Design.

16:35 – 17:083

K. So this property is located within Palm Beach Polo. It is a half an acre residential sealant use, and they're requesting a 15 by 16 solid flat roof detached pergola. The property was purchased by the owner in 2025, and it consists of a single family residence pool and another detached accessory structure. They applied for a permit for a pergola, but it was returned for corrections as it did not match the structure.

17:09 – 17:513

This is the pictures from inside the property of where the pergola will be located. And this is the survey of showing where it's going to be located with the rendering. It is white aluminum with a off white oat color canvas or not canvas, just an awning. The pergola is located directly behind the house, and there is a CVS wall, that is around the entire perimeter, so it won't be visible from any point of the neighborhood. It meets the setbacks.

17:51 – 18:173

And if it was attached to the house, it would be permitted, and they have received HOA approval for this structure. And these are the, same conditions that we applied to the last one and that we can have consistently applied to all the pergolas. So if ARB decides to approve it, then staff recommends adding these conditions. And that's all I have.

18:170

Okay? Thank you.

18:192

Did you want

18:203

to add anything? We have the samples if you want to see it.

18:255

Yes, please, actually.

18:261

Sure. That would

18:263

be great.

18:275

Kelly, a question for staff. If this was attached to the house, the exact materials that are being presented tonight would not require

18:34 – 18:513

Yes. All these pergolas that you see, most of them, if they were just attached to the house, we would consider it just a flat roof attachment, like insulated roof, flat roof, that we would approve by building permit.

18:515

And so because they're detached, typically they would have to be the same roof, same materials as the primary Yes. Structure?

18:573

And so the next item when we talk about the language for the zoning text amendment, this will alleviate that.

19:030

Okay. So

19:076

in this particular

19:080

case If you could just state your name.

19:096

Oh, great. I'm Wendy.

19:100

Hi, Hi, Wendy. Thank you.

19:125

They probably want you back behind that microphone.

19:143

Yeah. They're gonna

19:152

the he's gonna be

19:165

knocking Sorry.

19:182

I was like ringing it out.

19:190

Thank you.

19:20 – 19:486

It does have a more traditional design than what we've done in other properties details in the columns to kind of go with the house. The client also, the owner of the house, wanted something as traditional as possible, considering it is an aluminum pergola. It has the details. It has the rafters. It has the tips. The samples help.

19:492

So I see you've

19:50 – 20:045

got HOA approval contingent upon permits. I don't see anything from the POA. And their architectural review board from the Property Owners Association reviewed that? Do you have that document?

20:046

Yes, I think it should have been submitted between

20:103

Yes, it's the last page.

20:125

That's just the HOA.

20:156

The POA was also submitted in October.

20:195

So within Palm Beach Polar, there's two.

20:21 – 20:333

Okay. Well, I mean, I mean, that was just provided as backup. Building permit doesn't look at the HOA approval. I guess I didn't realize there were two of them that they have to provide.

20:33 – 20:445

This is a separate architectural review board for the POA, which is the sort of the master association. And so they would review BERNANKE. Anything architectural, and this would sort of fall under that.

20:443

Oh, okay. Gotcha. CHRISTIAN

20:48 – 21:005

I mean, if you have it, great. Otherwise, I mean, you know, I don't have a problem with it. I would just make that part of the condition. But we're not there yet.

21:053

Heavy? Is it like a weight?

21:061

No. Feels actually I want one.

21:164

Thank you

21:161

for bringing

21:170

this by

21:181

the way. Thank you.

21:235

Right. I don't think we have to worry about it right now.

21:263

No, either way, we wouldn't ask for the HOA approval.

21:290

I was going say, don't think that would that matters

21:303

But, to I mean, yeah, it's on them.

21:33 – 21:575

But considering this is not something that would normally be part of a simple approval and that's got to come to a board for review, I look at it saying, I want to make sure that everybody who's involved from a community standpoint, neighbors, that the POA felt like neighbors are adversely impacted by a design modification. I just want to make sure that everybody's happy.

22:015

I trust you. Perfect.

22:090

Okay. Just go through the motion. Motion to open to the public.

22:175

Second.

22:200

Hearing no comments from the public. I'll close the motion. Any discussion, Board? Further discussion?

22:324

I came.

22:330

We appreciate it.

22:354

I'm good.

22:35 – 22:535

If there's no further discussion, I would make a motion to approve Edition 20 six-fourteen ARB with staff's conditions. And I will also add that the POA approval from their Architectural Review Board be part of this approval. I'll

22:531

second.

22:550

Thank you. Any

22:564

objections Does to the the POA approval have to coincide with the approval here or just the notification to their

23:050

It doesn't POA maybe? Have to. But since he made it in his motion

23:093

We'll just include it for the record when they get the letter, we'll include

23:120

it for our record.

23:134

Okay. Got it. Good. I'm good. All

23:190

those in favor say aye. Aye. All opposed? Hearing none, the motion carries.

23:273

You just send me that letter tomorrow and then I'll send you a letter back with approval. Okay? You're all set.

23:321

Thank you for your time.

23:335

Thank you.

23:331

You so much.

23:372

Okay. I'm out of

23:383

here. Right? We're still running.

23:460

Yeah. Yeah.

23:485

Thank you. Bye

23:51 – 24:030

bye. Moving on to discussion ARB dash three nine one. Discussion of proposed zoning text amendment for accessory straight shade structures.

24:04 – 24:413

Yeah. So at the last meeting, as you know, we've had, multiple requests for pergolas. We've had 13 since 2023, that that ARB has seen and has approved all of them. So there was interest at last meeting to come up with some language, for council to approve to have for them to be approved administratively. So, essentially this language is mimicking pretty much what has gotten approved where that they meet the setbacks of the principal structure.

24:43 – 25:053

They They need to be completely screened from the right of way, which all of them that we've seen have, either being located right behind the structure. And then the maximum height is 12. So the one that was 14 would still have to come here. Because on average, they're about nine feet, nine to 10.

25:053

So we wanted to give them a little bit of leeway because sometimes they may be taller on some occasions. But the larger one that came earlier would have to come back.

25:14 – 25:383

And then the ones that have like, the last one that came, on Maidstone did have siding on the one side. We just request that they would have some sort of screening on that side. And that's pretty much what consistent to what we've all said for all the applications. Mhmm. They've either had a fence, they've had a wall, or they've had some sort of hedging that they installed.

25:38 – 26:273

So that's pretty much what 64,288, it says. And then 64,485, the underlying text says, is just stating that attached and detached structures cannot exceed 30% flat roof structures cannot exceed 30% of the principal structure roofed area. So you can't have say your building is 1,000 square feet, you can't have 400 square feet of flat roof structures on your property, whether it be an attached insulated aluminum roof where people extend their screen enclosure. Plus you have a pergola that's 200 square feet. You can't have all that.

26:27 – 26:553

It can only be 30% of the size. So this is consistent with pretty much all of the pergolas that we've approved. So we're just looking for your feedback to see if you wanna change anything. And if not, the we it does have to go to PZAB and counsel. It is scheduled for PZAB in May. So we're just going to finalize and button up the language and then continue forward.

26:55 – 27:075

So of those 13, and I beat them you probably don't have them all in front of you, 120 square feet seems small. Like 10 by 12, I would have thought that a lot of those that we looked at were substantially larger than that.

27:07 – 27:313

Well, so a is what the code kinda says now, is that, anything a 120 square feet or less doesn't have to look like the house. So that's what the code says now. So whenever we tell people, if don't want to go to ARB, you have to keep it at a 120. And then anything above that, above a 120 square feet, has to match, Roman numeral I through four or one through four.

27:335

So if they're larger than that and then meet those other standards, that still would not come to ARB?

27:393

Correct. But the large one on draft horse, because it was taller, would have to come.

27:445

Right. Although the height requirement alone was Yeah. Okay.

27:50 – 28:074

Kelly, is any only because I had this in Mercy a couple of times, and people were going back and forth. Does it matter? Should it matter? Will it matter whether or not there are footings with these pergolas? Or should it matter?

28:073

Most of them do have footings.

28:084

Right. What about the ones that don't have a footing? Are they going to be considered the same as those that do?

28:163

The footings, I think, matter if they have to get building permit requirements, like get a building permit. But they still have to meet zoning requirements.

28:264

Some yeah, bolted into the or a lot of them are these large tiki huts

28:554

That that that don't have, you know, any footings to them. Mhmm. Will most likely blow away in a major hurry game, but they

Depending on where they're made. If they're authentic, traditional, made on a reservation or something, they do have some control.

29:14 – 29:313

29:311

Do we have to make a motion for this or is it simply a discussion?

29:35 – 29:503

29:511

Any more discussion?
