Good evening. This is just a contract that provides for our emergency medical services director. So any agency that provides emergency medical care in the state has to operate under the direction of a a physician. Our current physician is retiring after ten years with the city, and we conducted a a interview process and and settled on doctor DeLury. He's a phenomenal person. He's really invested in the community, and I think he's gonna be really good for the agency. It is required by state statute that we have the contract. The funds that are outlined in the contract, do have available in the budget to cover those going forward. Any questions, I'm happy to answer them. Yes.

Yeah. This is a little bit different in a couple of ways. First of all, that the claim is coming to the finance committee. I talked with Joe Shiro this afternoon about that and I I would like to have claims for damages come to the finance committee before they go up to counsel. It just seems like the appropriate committee to handle it.

So that's why you're seeing that here. This is a claim for damages. It's unusual in the sense that I am recommending allowance of it just to show that we don't always automatically disallow claims for damages. As you know, the standard for these kinds of things is whether the city had notice in advance that there might be some hazard, whether it's a defect in a road or whatever. In this case, it's a limb falling out of a tree.

So when these claims come in, I do a little bit of investigation. In this case, that consisted in calling up Aaron Lehnert, our city forester, and asking if he was aware of this. And it turns out, yeah, what happened in this case was it was a tree that was known to be a diseased. It was marked for removal, but we just didn't get around to removing it before this incident happened. So if if mister Salinas was to pursue this claim, we of course would have to say yes, we were aware that this tree was a problem and it was slated for removal.

So in this case, I am recommending allowance of this claim in the amount of $661.50.

Well, that's when we pay any claim, the claimant signs a release in exchange for it. A receipt and release in which case that release is going to say that this is full and final payment of everything that was claimed and that you cannot come back to the city for more if you change your mind in the future. So I it's not really necessary for you to include that in the motion.

That's exactly what it is. They're they're they're just not able to deal with the volume of work that they have with the crews that they have in time. And you'll see this happen occasionally in other other areas too where, you know, we may be aware of a clog in a sewer or who knows what. And it's it's known, but it takes, you know, sometimes a day or two or whatever for a crew to get out there and address it. And in this case, it just was bad timing.

I got oh, sorry, Jeff. So, I guess I'll go over quickly for some people who haven't been here for industrial revenue bonds. What they are is a mechanism that industrial users can use to have to use the city's bonding authority and our tax exempt bonding authority to finance their projects. So in this case, the city only acts as a conduit. We're not lending any money. We're not on the hook for the money. They're just using our bonding. They put it on the open market and they use the proceeds from those bond sales to finance their project while repaying the investors, which is the people who bought the bonds. So in this case, the money has already been out there. The building production services company is actually another parent company for Oberlin Filter.

So this was to finance their facility that is up on Silvernail Road that was opened in 2016. So really what happened is the bank that had issued the bonds was bought out by another bank and then there's been some regulatory changes. So really what they're doing is changing some language to bring it up to date with the regulatory language and to change the way interest rate indexing works. So it's not changing the amount of the bond, the term of the bond, it's just the adjustable interest rate for these bonds. So it's kind of something that has to go through city approval, but really has no impact on the city. Just we're here because we're the middleman and the of pass through for that.

Yes. So this was approved back in 2015. As part of that project results. So a tax incremental finance district that we've already closed for that project as well because the site had a bunch of cleanup that needed to happen. This allowed them to move from their current this is now their third location in Waukesha. They started here. They were on Pilot Court for several years. They did addition on Pilot Court and then outgrew that space, but we want to stay in the city and they want to stay in the city. So that's the reason why we had the industrial revenue bonds partnered with the tax incremental finance district to make sure that they stayed here, the job stayed here, and the tax revenue stayed here.
