Test test.

6:18 – 6:370

Yes, I think we can go ahead and start the meeting. We don't have a chair or vice chair, so if one of you would like to volunteer to run the meeting this evening, commission.

6:47 – 7:250

Correct. No one's on Zoom. Do you have your microphone turned on, Rex? Now I um Okay. So, those present are and Rex Miller. Um, is there any Alicia Lund? Yeah, thank you. Is there any public comment at this time? There's no public comment. Okay. Um, since we um can't make a decision on anything, but it would be nice to hear what's um I'd like to hear what's on the agenda. So, let's jump to the public hearing um which is public.

7:24 – 7:580

So, I don't think we can actually open the public hearing. Um, but can they can they provide an overview of the project or do we just have to defer it? Sure. Right. So, could we get just kind of an overview of of the project? Okay. And then what we'll have to do is we'll have to defer the hearing to city council, which will likely be scheduled for next week.

7:55 – 8:140

So, Okay. Well, is there anyone in the audience that would like to speak towards um towards this? Absolutely. Do you want to do a little pream?

8:12 – 10:020

Um well, I could go ahead and give a brief overview and then if you wanted to to jump in, that's fine. Um, so the proposal is for a conditional use permit to allow for the renovation and remodel of the former JC Penny building at 181 West Anderson. Um, the proposed use is an indoor participant sport and recreation facility. Um, the existing structure is approximately 29,000 square ft. Um, it was originally developed, like I said, as a three-story J Penney building. Uh the most recent use was a call center uh which discontinued use in November of 2022. Um I have all my notes here to go through all the requirements for the procedure for the hearing, but since we're new not doing that piece um today, I mean, we sent out the public notice. We haven't received any comments in opposition um or um in support of the proposal. We haven't received any. We do have some staff comments of course like building permits required, flood plane permit required. Um, public works does want to see a technical memo from a qualified professional about the sanitary sewage flows just to make sure they're going to be adequate. Um, and then really just obtaining any other required permits. Um and it supports our um comprehensive plan, several goals, providing an indoor recreation facility, supporting economic development and revitalization of an existing structure. So, seems like a pretty pretty straightforward uh conditional use application. So, Joe, if you wanted to forward. All right, Joe, state your name and your address.

10:11 – 11:110

The owner to be in the middle of that transaction. We were engaged two months ago. Some of the first things we did kind of did structural we did we did analysis to see if we did a code reviewed a couple times otherwise but that's all good. Um and the work that we're doing building pretty pretty fundamental. Not really anything on the exterior with the exception of some windows. West side

11:17 – 13:100

has three floors 29 huge 29 on all three floors. One of the issues with the top floor We have a really good set of construction that top floor one needs. So the biggest bunch of construction we're doing is creating a stair tower to get down the street. That's kind of physical stuff to see. It has a fully covered system in it, but it's been modified abandoned doesn't function. We got to reond the front the front door main entry that's on that comp. The other exit on the second street side is compant. We're okay with that. And then interior finishes. There's a elevator that's abandoned service elevator abandoned

13:14 – 13:310

roof. Okay. Shape roof. appreciate the city for today. I mean, we had preapp meeting.

13:40 – 14:040

So, in layman's terms, Joe, what um what what what is the conditional change of use? It was retail. Is is this retail? Well, no. In all fairness, it actually the description of the recreational sports facility indoor recreation facility. I mean, that's pretty accurate. And right there in the table,

14:080

I was there was a there's a permitted out.

14:22 – 14:440

Okay. So, so it' be like like a gym or something? Yeah. It's training for student athletes, wrestling mats, a lot of wrestling mats. There's also some softball cages

14:40 – 15:160

and some simul That's a quick rundown. Sounds like I'll do this again. I'll clean up my next question. No,

15:14 – 15:500

you can excuse me if this is not an acceptable question. So, I read through everything. Traffic, excuse me, parking wasn't an issue. Um, it sounds like you're already starting to think about traffic. I'm just thinking about loading zone drop off areas and congestion. So, I don't know if you need to if that's already been accounted for in those uh proposed changes at the entrance or if that's something that needs to be considered. It wasn't specifically called out in the anything that I read either from the code or from the design. So, wondering how people are going to get dropped.

15:49 – 17:330

Yeah. like are we creating a congestion problem on second street or on Anderson was there is an 88 down east on there pushing a little bit trash. We don't really anticipate generating enough trash. So just garbage can way back when that space. It looks like it's not reception for the owner. We would second street second street. It seems like we don't need to bother.

17:42 – 18:090

My dad plumbed that building. and he said he he remembered cutting through stumps and logs to get the sewer stuff um through. It was just a mess underneath, but uh but they ran all their pipes. So, yeah. Oh, yeah. That was the only place to go. The hub or pennies. Yeah. Thank you. You bet. Thanks, Joe.

18:12 – 18:400

Well, you have to add comments. Okay. Well, planning commissions, comments. Lisa, do you have anything? Um, no. I just the additional clarification that was the only thing I could think of that wasn't explicitly identified. And did you were able to find a resolve on the property ownership or what the decision is on that?

18:36 – 19:190

So, we hadn't um gotten a response from the applicants or the representatives before the hearing. Um I think it would be um you know council they can impose a condition that they remedy that issue and get reactivated with the state um or iron out that that ownership. Yeah, I don't have anything. What about staff comments? Where are all our commissioners tonight? Good question. So that is a bummer. Um otherwise I don't think I have anything. So, but thank you for being here and participating.

19:17 – 19:330

Well, okay. With that, I guess we will adjourn. Okay. Is it
