My name is Thomas and I'm the case planner on the project before you today. The project is a request for a conditional use permit for the installation, operation, and maintenance of a new wireless communication facility for a 10-year time period. As a reminder for those who are watching on Zoom who wish to speak, please press the raise hand button now and you'll be connected at the appropriate time. This morning I will be giving a quick overview of the project location, project history and description, environmental review, findings and consistency analysis and recommended actions. Please allow me to give a quick overview of the project location. The project location is in the unincorporated area of Ventura County between the cities of Oxnard and Ventura near the intersection of Victoria Avenue and Gonzalez Road. The project site is currently developed as Oxnard High School and the facility is proposed on the rear parcel near the ground mounted solar panels. The subject location has both a zoning and general plan designation as agricultural and the site is surrounded by parcels which are also zoned agricultural. I will now go over the history and project description. Uh the reason this project is before your commission today is the Ventura County non-coastal zoning ordinance specifies that any stealth facility which is over 80 feet in height or lower

is a planning director level public hearing. Stealth facilities which exceed 80 ft in height need to be approved by your commission. The request before you today is for a 100ft tall stealth facility. The applicant requests a conditional use permit for the installation, operation, and maintenance of a new wireless communication facility for a 10-year time period. The new facility will be designed as a 100 foot tall fake eucalyptus tree. The facility would include 10 m 10 panel antennas, one microwave dish, and ground mounted equipment within a 2500 ft lease area. The entire facility would be surrounded by a 6ft high chain link fence with fake vines attached. Shown here are the elevations of the proposed facility. The facility would be designed to accommodate three additional carriers, allowing the facility to be used for collocation, helping reduce the number of facilities needed in the area. Attached is a site photo from the nearest public viewpoint which is North Patterson Road and looking west towards the proposed facility. As shown, it will blend in with the existing wind row surrounding the school. Shown here is an additional site photo from another public viewpoint. This was from Doris Avenue looking north at the site location. staff determined that the project qualifies for a class 3 categorical exemption for new construction or conversion of small structures. Staff has determined that the project is consistent with both the 2040 general plan and the non- coastal zoning ordinance. The project meets all required standards for approval, including concealment and compatibility, location, setbacks, colors and materials, noise, and security.

Uh hello commissioners. My name is Bill Lewis with Assurance Development representing the applicant vertical bridge. Um I have a short presentation um to uh go over the overview of the project and and the need for for the um for the facility. Um so as stated by staff, the proposal is for a 100 foot uh mono uh eucalyptus wireless facility. The facility will allow T-Mobile to fill a service need by providing inbuilding wireless coverage to the city of Oxnard along West Gonzalez Road and including River Ridge Golf Club and Windsor North uh River Ridge. The facility will allow uh T-Mobile to provide more reliable uh wireless service and improve access to additional wireless services for the benefit of residents, businesses, visitors, and first responders. This includes uh emergency 911 services. Um the facility has been designed to support additional wireless providers without the need for additional freestanding towers in the area. Um discussing the importance of T-Mobile's network, uh demand for wireless data is expected to grow by 20% per year through 2028. 97% of Americans have a cell phone and 85% own a smartphone. 72% of households rely on wireless as their only means of uh telephone communication. Over 81% of children live in wireless only households and over 85% of renters live in wireless only households. Um 240 million calls are made uh to 911 every year and in many areas 80% or more from a wireless device. Um this page uh shows the existing coverage of T-Mobile's network. On the

left hand side um green equals good coverage, yellow is fair, red is poor coverage. On the right hand side this is the uh proposed project. you can see a significant increase in the green coverage. Um, and it's estimated that over 20,000 residents will uh directly benefit from the additional coverage in the area. Um, as discussed, this is going to be a 100 foot uh faux uh eucalyptus tree. Um, on the left hand side is the elevation view. Um you can see that uh faux vines are also added to the equipment area to better screen it. And then on the right hand side is the uh plan overview. Uh these are uh photo simulations from the public rightway. This one is from West Gonzalez Road looking south. Um this is from West Patterson Road looking west. And you can see on the right hand side um where the facility is. Uh this is from Doris Avenue looking north and this is from uh North Victoria Avenue looking northeast. Um part of the application we did look for alternative sites. Um this is a um a brief overview, but we actually did look at additional 10 other facilities outside of the search area. Um the main coverage objective is the residences to the north and to the to the east. Um, so this project um kind of in a perfect location in terms of far enough away

from residences um so it won't be visually impactful yet still close enough to provide the uh much needed service in the area. Um we did run an EM report um based off the findings uh this project will comply with FCC guidelines with EM emissions. Um and the report showed that we would be um 28% of the maximum allowed by the FCC. So much lower than what is uh allowed by by the federal government. Um with the recommended actions, we uh request that county staff um county staff recommends approval of the proposed telecommunication facility subject to the conditions. Uh Vertical Bridge accepts uh the proposed conditions of approval. Uh the telecommunications facility meets all county code requirements, is consistent with the general plan, and will fill a significant gap in T-Mobile's um coverage. Um applicant shows has shown that the project will comply with FCC regulations for EM emissions. Um and based on the foregoing, we respectfully request approval today. Um that the commission find that this project is categorically exempt from SQA. um make the required findings to grant the requested CUP um and grant uh CUP case number PL25-000041 subject to the conditions of approval. I'm here to answer any specific questions.

Thank you, Chair. Good morning, Chair Kesley. Um, members of the planning commission and members of the public, my name is John Kesler, and I'm a planner with the Resource Management Agency. The next item on the agenda for today is item 6B. This is a conditional use permit for the First Samoan Congregational Church and the case number is PL150195. Here's the Zoom link for today's public hearing uh pro uh provided here. This presentation will provide an overview of the project including the project location, the history and description, findings and consistency analysis, environmental review, and I'll conclude with the recommended actions. And I'll now share the project location. project is located at 250 East Collins Street in the community of El Rio just north and east of the city of Oxnard city limits. The aerial image on the right identifies the project site outlined in yellow. It is near the intersection of Jordan Street and Collins Street. And for additional context, we have the Albert Solis Library and the Roger Jones Community Center adjacent to the church. The site is designated in the general plan as very low density residential. It's zoned rule exclusive 20,000 square foot minimum lot size and is designated urban residential 1 to2 dwelling acres per unit uh dwelling units per acre in the El Rio Delorte area plan. And we

have commercial uses uh and designations to the north and west of the site along Jordan Street and Vineyard Avenue. I'll now briefly explain the his the history in the project description. In 1972, the county first approved a conditional use permit to convert the single family dwelling into a church. In 1983, county issued a 5-year extension of the cup and legally converted the garage into the community center. 1994, the county granted another 5-year extension of the cup, expiring in 1999. In 2014, we issued a notice of violation uh when we determined that the church had continued to operate under an expired cup. However, in 2018, the applicant entered into a compliance agreement which established the milestones to address the violation without of operating without a valid CUP and it also allowed the church to remain open while the cup the current cup application is being processed. That leads me to the project description for today. The applicant is requesting approval of a cup to authorize the continued use and operation of the church for an additional 30-year period. along with minor site improvements which will bring the site into compliance with the development standards of the non-coastal zoning ordinance which I'll now show. The project is requesting continuation of all existing on-site structures including the chapel, the Parson's home, and the community center. Proposed improvements include site landscaping shown on the slide in green. Construction of a new six foot high wood fence shown with a dashed red line along the perimeter of the site and repair and restriping of the parking lot to the rear providing 41 spaces all which are

uh required development standards of our zoning ordinance. Operational hours are proposed to remain as previously approved from 7:00 a.m. to 8:00 p.m. 7 days a week. Here are some site photos. uh a few photos of the chapel itself which may accommodate up to 112 seats although per the applicant the size of the current congregation is about 50 members total. Additional photos uh the wind row of trees would is proposed to remain along the property boundary which will provide uh existing visual screening to the neighboring residential uses to the east. The project as mentioned uh would include repairing and restriping of the parking lot at the rear of the site and the photos on the right show the community center. Inside the building is where the youth group meets, the church um meetings are held and additional occasional meals are served to the community. I'll now discuss the findings and consistency. staff has determined that the project is consistent with the 2040 general plan, the El Rio del Norte area plan, and the non- coastal zoning ordinance. All CUP findings can be made as detailed in section E of the staff report and the entire record, including that the continued operation of the church will not be detrimental to the public health, safety, or welfare and would remain compatible with surrounding as and resident surrounding residential and commercial uses. Staff also determined that the project is categorically exempt from SQA pursuant to section 15301 of the SQA guidelines and there that no exceptions set forth in section 15300.2 to preclude the use of the exemption.

And therefore, staff recommends that your commission approve the project uh based on the findings of the cup being met and find that the project is categorically exempt from SQA. For those of you who don't know me, my name is John Novi. I'm the manager for the commercial and industrial permit section here with the county planning division. And I wanted to take this opportunity before we start this presentation to introduce our newest planner to the team, Eric Gasa. Uh he joined us as an assistant planner in January of this year and this is his first item going to the planning commission. So with that, I will turn it over to Mr. Gaska for making the presentation. Thank you. Um, good morning, Chair Kesley, members of the planning commission, county council, and members of the public. My name is Eric Gaza, and I'm the planner with the County of Ventura Resource Management Agency. The next item on today's agenda is item 6C, a condition use permit for the Ventura Regional Sanitation District, Operations and Maintenance Center, case number PL 24-0119. On this presentation, I will provide an overview of the project location, history, and project description, findings, and consistency analysis, environmental review, and recommended actions. I'll start by giving you a quick overview of the project location.

The vicinity map on the left shows the site located in the unincorporated Ventura County near North Victoria Avenue and Gonzalez Road immediately west of the city of Arsenar city limits. The arrow image on the right depicts a project site outlined in yellow and the red oval marks the project location at 4105 West Gonzalez Road. the sideline south of the Santa Clair River, west of the North Victoria Avenue and north of of West Gonzalez Road. The existing 1.7 acre project site is located on the southernmost portion of a of an 83.64 acre property. The site is surrounded by agriculture uses to the east and south, open space and agricultural uses to the west, and open space and habitat connectivity wildlife to the north. The countywide general plan land use map destination is open space. The zoning destination is open space 80 acre minimum lot size. Now we will transition to the history and project description. In 1978, conditional use permit number 3650 was approved to authorize use of the site as a landfield. In 1996, the landfield seized on-site operations after reaching its permitted capacity. In 2005, a minor modification to conditions permit number 3650 was approved to authorize the use of the existing office building and accessory structures as a field office and primary staging area for relocated district employees. In 2008, conditional use permit LU06-000031 was approved to authorize operations of an operations and maintenance center and outdoor storage yard at the site. In 2018, conditions permit LU06-0031

expired. In 2024, CO compliance issued a notice of violation for the expired conditions permit LU 06-0031 for continue operations without a valid conditioning um condition use permit entitlement. In the same year of 2024, a conditional use permit application PL24-0119 was submitted. Oh, which brings us to why we are here today. The applicant requests approval of a 40-year conditioning permit to authorize the continued use and operation of a maintenance and I'm sorry to continue use and operation of the operation and maintenance center and outdoor storage yard with no physical changes to the site staffing or services. All activities will occur within the existing development footprint. Before showing the site plan, I would like to first show you a closer aero image of the existing project location to give you a better view of all the existing on-site buildings and structures. [snorts] As you can see on the site plan, no new construction or expansion of uses is proposed. All activities will remain within the existing developed footprint. [clears throat] The image on the left is existing office and storage building. The image in the middle is existing office modular building. And the image to the right is existing employing parking lot and existing signage. Um the image to the left shows a road access to the mentor regional sanitation district site from West Gonzalez Road via an all-weather access road. Portions of the road are shared with a private business to the south. The image to the right shows the existing fire water protection that stores two 5,000galon

tanks and one 6,000galon tank connected to an on-site hydrant. Now we will transition to the findings and consistency analysis. Planning staff reviewed the project and determined that is consistent with the 2040 general plan policies and the non-coastal zoning ordinance. The proposed project was reviewed under the requirements of SQA and was determined to be categorically exempt pursuing section 15301 class one existing facility since a pro since the proposed project is a continue operation of the 16 office building and no additional structures or modifications are proposed. Finally, the recommend the recommendation action staff recommends your commission find that the project is category exempt from SQA. Make the required findings to grant the request conditionings permit and grant conditionings permit PL24-0119. And in addition, our uh consultant from CESP is here to answer any questions regarding the uh application for the cup. Then I'll just add a couple things. Um, thank you so much. Um, good morning, Madame Chair, Planning Commission. Um, thank you for your time this morning. We don't really have too much else to add to staff's presentation. I think they did a wonderful job. Um, this is one of the last stops on the road to compliance for this facility. So, this uh cup, the reinstatement of the cup will cure the violation that's on the site. Um we have been working diligently with uh county planning division um in processing this application. They've done a wonderful job um and we're happy to be at this hearing um looking forward to your discussion and we are available um as our applicant said to answer any questions if needed. You know, I can understand um a church not knowing that their conditional use permit expired, but how can the regional sanitation district um you know, not know that their cup had expired and it was expired for quite a long time?

Um so we've we've had a contact who who has retired, but I think I can kind of help fill in the blanks. um the the applicants or permites don't typically get a notification that their permit's going to expire and when there's such lengthy terms on this ups like 30 years. Um sometimes there's ch turnover and the deadline is missed. We've it's it's really not too uncommon. I mean I'm a land use consultant. A lot of the projects that come to me is because the permit expired. Um there are some permits out there like a plan development permit that doesn't expire that will kind of avoid this issue. Um, but since this is a CUP, it does have an expiration date. Um, and I know the permit will always do their best to try to keep that in mind, but I mean after 40 years or 30 years, it is sometimes the due dates are missed. I think the important thing is that when um VRC was notified that their permit had lapsed, they like very quickly engaged us for our services. I think it had taken I think the letter actually for the was dated 2024 when they were notified by the county. So then in very short order, we help them prepare all the necessary paperwork, diligently process this application, and have requested another long-term as well. Um, and we're giving them um some help so that they can uh hopefully we're all aware when when the next time the CU comes up for replacement um that the application's filed um in appropriate timing.

That item is a major modification of conditional use permit for the expansion and continued use of a large-scale commercial organics processing operation and soil amendment operation. This project is located in uh district 5. It's at 6859 Arnold Road and at Casper Road. So, that will be the item on November 20th. We are looking at the December hearing dates. So, we're likely to have one item uh coming to you in December, hopefully on the December 4th date. Fourth date. That's all I have to report out to you today. Thank you.
