You want to go ahead and Yep. These first few are where they need to be. So, yeah.
Okay. Um, it's been brought to our attention that a neighbor two doors down would like to start a bee farm, honey bee farm. Um, and my concern with that, I don't know what the ordinance says or if there is one, but my concern is our son, um, is severely allergic to honey bees especially, and he has great epipen already, and honey bees are known to travel up to three miles, so it could easily come in our backyard. Um, so I guess I would be against it. Um I'm not sure what the ordinate says, but that's my concern.
We um we had a gentleman in here um our neighbor. We're neighbors. So um and he expressed interest in starting one. Uh I didn't see anything in our ordinances about honeybees, everything else. Um, and um, of course I was I was also concerned because we have grandchildren that go back to the malberry tree there to pick malberries and they like to be around that too. Uh, so we haven't really there's nothing on the books. Um, and it hasn't been he hasn't come back and and said anything. Um we're aware of it and um you have anything else?
Wasn't there a discussion about domestic use as versus commercial selling the honey? Um, I'm looking at my my notes from the last name. Looking at the statute. Right. There's no there's no specific reference. I would need some time to look back through it. I don't think I get
I don't you know reading it before I didn't see anything either but I I thought we talked about if you're going to sell it uh it's different. So the way it is right now he hasn't said any more about it. Um I don't know time comes we'll we'll definitely discuss it again but I understand your concern definitely.
Yeah. I don't know if you've reached out to your name. There's a certain amount of risk he's taking if he's bringing bees to the neighborhood. um that it might perhaps you sent him a letter saying, you know, he's understand our son is allergic, right? And um that may change his mind to do it or at least he understands the risk that he's taking if something were to happen. Yeah, that makes sense. Yeah.
And u so that made a big difference for him. understanding that, hey, look, you know, my son's very allergic to meas and are you bringing this hazard to the neighborhood? And then the only other thing is I think as we discussed last time was another person talking about other types of animals to raise to sell the meat.
And the statute about the difference between raising a domestic animal and raising animals for commercial use to sell the meat which would be against our regulations. Okay. Well, that would include honey or would it or we don't know? It wouldn't include it because it's not specifically stating how Okay. Yeah. That's not in our ordinance. Okay.
So, that's something we have to take a look at. Definitely. You do have a prohibition against uh someone harboring or keeping an animal that uh injures a person. Now, the verbs used in that don't include stinging. They're biting, scratching, you know, everything else. And then it says or otherwise injures a person. Um, and if if concerned property owners on their own sent a letter to the person who wants to do it, uh, there there's the effect of having legal notice that it may do that kind of a thing. And that could be that could be enough of a deterrent where they don't want to take the the risk of liability.

Particularly part B. Uh certainly seems like it would be a if the if the sting occurred I think then that's a violation 9547 B. So hopefully that gives you some ammunition to Yeah.

Um yeah, Cindy is present here tonight. um this last um water uh billing cycle, they had a um toilet issue at their house that has since been fixed um since they've lived here. She's never uh requested a an adjustment. Um so I provided you with um the amount to adjust the water, the tax, and the wastewater based on her six-month um normal average consumption. I don't see a problem with a motion. Motion that um we approve the uh water sewer billing request by Cindy and Michael Malot as presented. to you. All in favor?
I Well, I'll do an adjustment and call you just to let you know what your outstanding balance is. Even when the guys going to come down, we had a water. So, they will be down tomorrow. I mean, well, depending on what your schedule looks like. Our day didn't go like it was when I hung up the phone today. You come after in the afternoon. My husband gets home around three. Okay, you can do that sometime after that. Yep, I can do that.

Um this is um every two years we sign an agreement for their assistance to do the Paser rating for our roads um which is required to submit to LTAP for us to be able to apply for CCMG grants. So it's our analysis that the guys use then to determine which roads to pave next and such. So, um, the prices remain consistent from that standpoint. Um, and Bruce, if he's still the guy, he does a great job of helping me make sure the files are correct to upload to. So, um, so if you'd still like for us to continue the use of their services, superintendent, are you good with that? I got this today. Um I did get a message and I want to make sure how you guys feel. Guess it doesn't matter, but um Chris Moore house that runs the community center. I guess the date that we have our proposed garage sale um they already have the facility booked and I guess people utilize that. So, she's looking at holding one in April and she didn't know if that would affect our garage sale. I really don't think so. I mean, if she wants to try to have something at the community center in April, I think by all means, like a little swap meet or something. Huh? She does a what? Garage sale. No, usually people I think rent the facility like to set up their garage sales inside that day that like maybe don't live in town. Um, you're saying she's booked already.
So, she's already booked on that date, but she was asking if we had a problem with her having in April. I I don't, but I just thought like to me, have at it. I don't think it's going to deter our 28th or whatever annual wide garage sale that we've had. Um, so quick
outstanding warrants. Oh, man. Well, that's um No, that's the write offs. I know. Okay. Yeah. Um, so on the list without seeing any warrant, they've had over two years to cash this check. It's my last one. And after that to date, all my checks are cleaned up and cashed appropriately. If it's not within 6 weeks, I'm calling get that done. No.
Well, that clears up from 2022. Yes. And then to current date, everything's clear. Okay. So, like this is the last I only have one outstanding check. Okay. That meets the requirements. But then as of current date, I do not have any outstanding checks other than the ones I've written between December 1st and now. So you need to make a motion. All right. Okay. Um, and as far as these um, individuals go, they are all um, the classic transient renters and with the wonderful state statute, we can no longer hold the landlord accountable for any outstanding balances. So, we have exhausted our resources and trying to obtain these outstanding and honestly trying to find where the next address is to try to go after this kind of in my opinion minuscule amount. It's just kind of easier. When
last time you up the uh, deposit? It's never since I've been here. It's been $100 since I've been here. Um, I think that might be a viable and I think you can even do it depending on if you're a homeowner versus a renter. They can have you can have different deposits.
Yes. Thank you. Um, I think it might be something for us to consider. Um because right now used to when I came in what the water bill rates were cuz you and then that's speaking of the minimum it was under $50. So if they were at minimum bill they were past due and then they had their other one before shut off it was usually under the hundred bucks. So it covered that we are now where at least it would more than likely need to be 150 bucks or two billing cycles to be covered if they're at that minimum usage. So, um something something else
I mean a Baker Tilly probably would be my contact for that or you what do you think on that Indie? Is that something I can I can research that as an issue the deposit to see what you can research I could research that bring you back something next month but I think that would be ideal. If you do, whatever you guys are doing, if if they're to maintain that on the account, that's fine. If you're wanting to proceed with the write off, I would make a motion that we proceed to the right off.

I just wanted to just add one thing. I did have the uh will show cause hearing for Abbott this morning. So, you might recall that was the utility thing. We had to take the small claims. Um there is now uh I'm an agreement um submitted to the court uh for her to pay $250 bi-weekly. uh until that is paid off. So, we'll see. Was that good? Yes. Okay. So, that's that's all I had for you. Yeah. So, if if all goes well, the last of that payment should be sometime in late June.
Exactly. And then they miss a payment, bring them back. I mean, I'm just I didn't know what the next step was. If I do another I do another we'll show off because we already have a committed payment schedule. So So will the clerk's office just collect it all and then once it's all paid off issue a check for that outstanding balance? The court really should send those as they come in. Okay. Uh, you should have my report in front of you. Um, in collaboration between Thomas Excavating and the town, we've been attempting to pressure test the new main down there, and we've tried it twice, and it has cracked twice. Now, that's not just like normal operating pressure. Like, they put it through the ringer. Like, they stress it. Um, but they don't usually have them break either. So, we don't really know what's going on. Um, last I knew they dug down. They were working on fixing it, and I haven't heard anything since then. Um, I think the cold and the snow and all that fun stuff um is slowing them down now, but um yeah, so I guess we just wait and see and keep pressure testing it and see what happens. Um what else? The new skid loader snow plow is in. Um oh, discussion about the alleyway between gas station. Yes. So, right there where the alleyway is before it gets to the ramp, there are a bunch of pretty thick cracks in that concrete and whenever it rains or we have snow melt off, it gets down in those cracks and goes right into the basement of delies. Um, which is not a big deal now, but it will become a problem, a big problem. Um, so we reached out to um, Law Lawson or Law, however you say that, Lawson Incorporated.
Um, the Whitel fellas. Yes. Um, if we if you want us to get more quotes, I'm more than happy to. The only reason we went with just this one is because he's done work there before. He done the ramp side and repairing that wall and working in the basement of Dillies before.
Um, so we got a quote through him and we I I think it's a really good price for the work he's wanting to do. Um, tearing out the concrete, putting new concrete back, sealing the outside of the wall. Um but like I said because when we get more numbers I'll get more number well I think that the history of building it's kind of thought and we've kind of gone away from him a little bit and like haven't been impressed with some work that we have done um he's going
yeah I think he was speaking like in title or something too right like yeah you mentioned putting French drain in there too. Water from it. Okay. Um, there's a possibility. I mean, there's nothing in concrete yet.
It is our alley. But yeah, we also found out through all of this that is that is our alley. And we didn't think it was. We never maintained it. I always thought it was Mike Stevens. I thought it was either the gas station or Billy's. So, it But yeah, before the the the drainage deal becomes a worse issue with Billies and we should nip it in the bud. And he said it would a day if everything goes right. Yeah, he said it take and now and they could drive on it with a day. So like couple days is all it would be out of service was pretty

If he gets into this being a bigger mess because like anything else and underground and if he has to spray adhesive or do some other work, are we good with him continuing to perform the necessary work and him submitting an additional proposal if that has to be done? I mean we the the fe the fe the is getting down there in that wall being in shape there could be yeah and there's no way to
make that assessment that but I don't know that it's going to be like a lot more but I'm just saying like how do you want to approach that really we really can't approve uh a dollar we get another quote that has verbiage not city and might be to do that. Okay. I don't I don't like to fine. We can do that. Okay. I mean, we have a special we can either call a special meeting to I I guess that was my biggest thing. This snow wasn't a large amount. There's not a huge melt off. I mean, I don't know what other and and that came from that 12 in of all that snow melt off and then rain after that. My concern is, yeah, we're trying to repair a road that's stop water filtration. We're not responsible for their foundation wall. We would be we would not be.
But if it's right Yeah. Yeah. And if it's infiltrating because our road is in poor shape or not maintained, which is I think what the case is here, our our section of it has some pretty wide gaps and and we were there and you could you could see the water running into it and going away. So that's okay. Um they may not exceed 12,000 and then have come back. You need another that gives you some business again.
I mean got option to listen you know. So again I'm not familiar with what he told you about the scope of the project. So if you think interesting proceed and if it comes different then we'll address it at the time I guess. Yeah. I mean, I I got a feel it'll be more than 12,000. Think closer to 14.
Well, I I don't know. I mean, realistically, I mean, that's take the concrete out and put it back in. I just There was only some like I don't know, material or something that would maybe have to be done if it say you guys are dead or he found it caught us. What were we doing? got a phone call or something, James. Yeah. Yeah. And we went down there and it was coming in that baking pretty good.
And then we went out. He took us outside and we went out there and right up against the wall there's a crack in our concrete and there was water there at that time and it was it was actually going in there. He tried to divert it. He put something he tried to tried to push it away or sweep it away but it I mean it was it was coming down in there. So yeah, it was Yeah. I don't Sorry. more complicated. I will do whatever you guys want me to do. I will get another quote that says do not exceed. I will tell them to go ahead and move forward with it and we'll deal with it later if it's more. I I hate to say this because you never know obviously, but I don't think it's an extremely dire thing that has to happen immediately. Like there's basements all over town that get wet. That's just my like sealer that you can pour in the crack on the surface. Well, that's going to do that. He said, "Well, I'll fix it right now. I'll come in here and put this stuff in there and I'll put this foam in there." You might run the risk of more damage if it's
if he's put some expanding foam in it. I I'm the same as Jake. unless it is one of those massive rains or now obviously we didn't do a full assessment of the basement downstairs. We saw water and went up and looked
you know um so we didn't really inspect that interior wall and see if there was a lot of stuff falling out of it or or you know um but I'm kind of in the same boat. I don't think it's it's dire or dire. Um, but also I mean if like do you have to vote on it as presented here or is it something that you can say we will accept this up to 15,000 or whatever whatever you think it might be not to exceed that and and and do it today. I don't know. I mean Andy's not here. She got his number right. But
but it's not dire. I don't feel like he does either since it's not a dire situation. Um maybe he can maybe Wom can give us a little more. That's fine. Do you just want him to beef it up? I mean if he's saying that this it I would just say if he anticipates there could be any additional work underneath there include it all on this proposal and then not to exceed. And then if he doesn't have to do that additional work that he has ran into historically then Yeah. Yeah. Yeah. We can do that. and we meet on the 5th and we meet on the 9th. So, I mean, and he has history with that building, too. So,
I mean, he done that before, I think, from what he was telling us. Yeah, that's fine. He'll be quick with it, too. Yeah. Didn't take long to do this one. It won't take him long. If he needs to come back to town and, you know, he can talk to them separately.
Um, so we got the Jedi back. Um, and we've used it and it's working really good. Um, they gave us a list of um, what that they think needs done on it or that they know needs done on it, needs addressed. Um, but some of the problems are really minor. Anthony and I could do them oursel. Um, the full list of work that they think needs done was $18,000. We need to go through and like go through it. We haven't gone through it yet. Um, but he I thought Adam said that like $11,000 of that was the boom. Correct.
Yeah. The the m the major the main problem with it from what they told us is like the bearings in that big boom on top that swings around the bearings and stuff are going out on it. And to fix that is the bulk of that $18,000 like $11,000. Um, a lot of the stuff or not a lot, but some of the stuff on it I think you can I can knock out pretty easily. There are some seals and there is a lot there's like they they do this multi-point headto toe inspection and there's lights on there. There's a couple of other other things that yeah we could take care. I mean the bulk of it is that that big the big thing but
but when we go through with the fine tooth comb present it to you and okay just wanted to give you an update on it back and $18,000 compared to a new one. Exactly. That's the thing. And that's so so the the reasoning for it being so expensive, they don't they don't produce the parts for those anymore. Those have to be special made by a machine shop. They have somebody that does all that does all that. And um and they guarantee that work and it's it's they dued them before for it and stuff. So Newman's want oh what eight years ago is 100,000 right? I think they're probably reaching about a half million dollars now at this point. I mean I would I would assume
I I would I would assume so. And it's it really is in great shape and and from what from what they've said up on equipment that's it's not uncommon. I mean, obviously, they worked with people to address those issues and stuff and and and there's just slop in it and it's not it's not something that we went out and used it tomorrow or I mean, as a matter of fact, we used it this, you know, past week, this past week and and it you can see the you can see the slop in it, but it's not at risk of pussing it out. Yes. And and they assured us of that, too. So, they were they were thorough in their assessment of everything. and has been serviced though and other stuff's been fixed on.
Um, and the last thing I have on the report is the tornado siren over on the south end of town is not working. Um, JK came and looked at it last week or came and tried to look at it last week and we can't find a key to get into the thing. So, we're going to have to drill the key out and pry our way in there and then try replacing a little battery in there. He said he told us like if you need us, call us, but try replacing the battery first. So, I guess there's a I didn't know there's a battery in there. I don't I don't know anything about it, but we're going to get it open, try replacing the battery in it, and we'll see.
Speaking of batteries, this one sign. Yeah. I don't know. Uh, the last I knew, Justin did get down the one that was at the barn or one that um and I think he was working to get things out of it and I don't know that I mean obviously he's not got it in there, but I think he was going to see if that was compatible. If not, he was working to get a replacement battery ordered since it started working and then it's not working anymore. So, we're pretty convinced it is a battery issue. But, um, that was the last thing he and I discussed. So, uh, and also appreciate you guys getting the link back back out and yeah, glad really appreciate that. So,
I'm glad we did. I know it was there was nothing, you know, we we had planned it a week ago, but then everything got covered up again and I mean, a while. There was a load and half out. There's more out than I thought there would be. So, I'm glad we went out and did it. Well, there's only a couple people that have put piles out since then because they think we're doing it again. Yeah. It was just funny that the whole time we were out there were like, "We're sucking leaves on January 7th." Crazy. You know, but we were able to get everything went to bed, cleaned up, and yeah, tucked off and tucked away. Well, thanks for doing that. Absolutely. Anything else? That is it. Um, can I just do one thing real quick since you're here? Um, the guys and I met also with White Tools this morning. Um, I know I can talk to people about this, but um, with the CCMG, we can do our local sidewalks within the grant. Um, the state roads are under INDOT's jurisdiction. Um, so we can't use grant funding to do those sidewalks. Anyway, we do have a meeting scheduled with INDOT um to discuss if there's different avenues of going about getting that done with their um assistance financially. Put a little skin in the game. Putting that on the record. You ever hear that, Jim? Pretty sure our governor said that. Um he did.
So, um put that out there. But anyway, we met with Whitils um kind of went over all the different areas to focus on and I wanted to get an estimate from them just as a private contractor to do the work because sometimes when you get into federal grants and all of that stuff and requirements, it really could shoot up the price and it would maybe be more beneficial for the town to proceed with that on their own with a private contractor than jumping through all those hoops. So, um, and I asked him if we could have that back before we met with INDOT, so we kind of have an idea of maybe how we want to proceed. But that's literally I feel like the other hanging fruit after the CCMG project is getting those sidewalks done and we'll have a lot of stuff then from that side of infrastructure done.
And we tried and I will say this, we've tried the 5050 and there were people that took advantage of it. Um, and now I think people I mean it is what it is, but after we've done this grant, it's not cost people internally anything with the use of the grants. Um, it's kind of really hard. So, I don't know. I think it would be great to get just to get it done. Um, and Sam even said Jake Jake said if we proceed with this depending on how it was um to try to have things done by the 4th of July or don't. and they said like they could prioritize pray route first and then do the other sections that don't necessarily have the foot traffic um and then we did add um into it for them to extend the sidewalk all the way to Dollar General um as well just to see because it's not that much. I mean it's just right in front of the one home so there would be an extension there down. So, um I don't know, but just so at least, you know, we're trying to have some information,
so we're ahead of the game. Um but no, I I mean, I just wanted to make sure we addressed that. So, and then I have a couple more things, but it it doesn't involve them. So, well, thank you. You can watch it if you want to later. Um have a good evening. Thanks. say uh you want
yeah I mean if you're good before we do dockets and then we can so um you see that I provided a copy of a journal entry so last I mean I was due the transfer appropriations at the end of the year um with this new program that I'm still getting adjusted to um there was a few of the payroll items that ended up in negative and so I realistically don't need your approval to transfer within the same budget class, but I just for transparency would like for you guys to see the ones that I made and sign off on them. Um, I mean, it's literally the FICA, Medicare, the Perf, and then also just from the super to the assistant superintendent to cover that salary. So, total of $9644 um that I made. But so, there's that.
You can if you want. I don't care. Motion to approve um the transfer of negative appropriations uh to clear up year end uh budget issues as presented. Second it all favored.
Okay. And then the last one I just want it on the record. So our water bond that we have with Old National Bank that's due January 1st. Um, I cut a check and I sent it USPS mail on the 10th of December, which should have been adequate time for it to be received. Um, they reached out um the Friday before the holiday I mean before year end. I don't even know what day it was. The 26th. No, actually they reached out the 23. Anyway, they reached out that week before it was due and said they hadn't received it yet. Reminder that it's due by the 1st or you'll be penalized. And I said, "Mailed that out." Like should be I mean I had been watching to see what checks had cleared and still hadn't. And so they basically said
it had not cleared yet.
