Uh, as you know, um, I've been, uh, one of the projects I've been on since I've been on the council for the last eight years, six years, I forget now. Um, is to really remember those Thank you. military men and women who have died in our in our our nation's wars and many of them never return home. they're buried uh overseas and um one of the things that I've tried to do is to go to those cemeteries where they are and represent us, represent the city. These people have been forgotten over the course of time and so this May I'll be going to three different cemeteries. Uh I'll be going to the Arden Cemetery, uh the Netherlands American Cemetery and the Cambridge American Cemetery. Uh what I would like to do is and this is a resolution that I would like to take with me to give to the American Battle Monuments Commission's cemetery directors. There are directors who are in charge of these cemeteries. They're beautiful. They're beautifully laid out. They're very patriotic and very touching to go to. And uh and these are the individuals that make sure that the remains of our soldiers from our city are kept in a very pristine, beautiful place, a place of uh that's solemn and a place of remembrance. And um and so I like to give them a a pretty much a thank you uh for for doing that work. Uh what I would like to do this evening is just read the names and counselors. Uh I've not done this before, but the the individuals their pictures I've given you a pictures of of all the individuals um who have who died in these wars who I'm going to remember and I they're in no particular order but if you I'm not sure which is the which is the first one of the on the document. Is it Ardens? Is

Thank you. buried at the Netherlands American Cemetery, our Private First Class Carl Emoroso, Private Mario Benardini, Private Firstclass Oscar Voucher, Private Frank Grill, Private Harry Roach, Sergeant Leonard Rauski and PI Private First Class Thomas Ryan. Mr. Foucher and Ryan were both awarded the bronze star medal for their extraordinary bravery, meritorious service in combat. And so with that, I would ask that this board send up to the full council with the favorable recommendation this resolution remembering these individuals. And I give that to the cemetery directors. please? Next one is the um is Cambridge American Cemetery and this is in England. Those who are buried there are S1C and I don't the Navy guys I can never get a full handle on. It's harder for me. I think it's seaman first class Maurice demurs first lieutenant Norman Drewan Druan Sergeant Paul Luc Yk Lusk um there's a gentleman uh from the Coast Guard Bruno Powski second lieutenant Robert Simmons also at this cemetery there were three individuals one who are on the wall of the missing, which means that their bodies were never found and they're presumed dead. And that was Sergeant Michael Granovichas, AD3 Ernest Libby, and First Lieutenant James O'Neal Jr. So, I'd like to see that this committee would set up to the full council with favorable recommendation that we adopt this uh resolution for the men that are buried at the Cambridge American Cemetery. And finally is the Ardans American Cemetery. The the individuals who are buried from Lawrence who are there are Private First Class Edward Dumont, Sergeant Joseph Harrian, Private First Class George Corey, and Staff Sergeant Leopoldo Turra, Private First Class Edward Dumont and George Corey were awarded the Bronstar and Sergeant Joseph Harrian was awarded the Distinguished Flying Cross. Out of all the individuals, and there are 19 of them that we're doing this evening, out of all 19, one of those have got a corner named after them. Leopoldo Tortora has got a corner named
after him here in our city. But I'd also ask that we send those up to the full council with a favorable recommendation. And that's it for my three. Thank you to your chair. Um chairwoman and vice president of the council. Um my fellow colleagues, I believe Teresa put a vanilla folder within your binders with um additional documentations, but specifically item well this and the next four the next three items are the recipients of the 2025 exchange club um honores awardees. Last year we had the privilege to recognize the 2025 um awardees and honores at the council level. So I'm looking to do the same this year for the 2025 ones. Um and for the firefighter of the year was Pat Driscoll. From what I have learned is that Pat has served over 37 years in the fire department. He is very well respected. um has served as the a former union president as well. And what I found the And you have this language in your I don't know if you want me to read. Oh, I'm sorry. Counselor Stephanie Infante. I live at 226 Malveron Street, Lawrence, Mass. Uh resolution honoring fighter fighter Patrick Driscoll, 2025 Exchange Club fighter fighter of the year. Whereas firefighter Pat Patrick Driscoll has served 37 years of exemplary service to the city of Lawrence, a tenture defined by profound integrity, professional excellence, and a deepseated commitment to the safety of our residents. hand. Whereas throughout nearly nearly four decades of service, fighter fighter Disco has consistently prioritized the needs of the community and his fellow fighter fighters above his own, serving as a pillar of strength on on the fire ground within the firehouse and as a former union president. And whereas Patrick Driscoll has demonstrated exceptional leadership rooted in the character rooted in character rather than rank proving a calm presence and sound judgment that has earned him the enduring respect of his peers, supervisors, and the public. And whereas as a dedicated advocate for the well-being of his colleagues, fighter fighter Discoll has been a leading voice for firefighters health and safety, championing awarenesses and prevention regarding the long-term occupational risk inherit to to the fire service. And whereas his career embodies the highest ideals of the Lawrence Fire Department, reminding us that public safety is a calling that requires not only physical cou courage, but also humility, compassion, and a and a resolute sense of responsibility towards others. Now there be therefore be it resolved that the Lawrence City Council on behalf of the residents of the city of of the city of Lawrence hereby extends its highest com commendation to the to fighter fighter Pat Driscoll on the occasion of his nomination as the exchange club fighter fighter of the
year honoring a lifetime of distinguished service and his lasting impact on the strength and unity of the Lawrence fire department. counselors, there is uh a section missing uh that's usually added by the clerk, as you know, that includes the seal and the date that it it is printed on, which is usually the same date as the full council meeting, but that would be added um once the this committee sends it up to the full council. Um the next two we have uh the resolution honoring the 2025 police officer of the year which we have officer Janelli Bonet and um Sergeant Arikea Southworth. And these two um individuals from what I've learned well first it started with Officer Bone. She answered an emergency call pertaining to a uh one of our residents in active labor. And when she got there, um this resident was already in labor. And um she called for backup for help and um um Sergeant uh Southworth joined. And when they got there, they noticed that the umbilical cord was was wrapped around the baby. the baby was was born um on our sidewalk, but the the there was an issue with the umbilical cord. So, they worked together to ensure not only the safety of the mom, but the safety and the well-being of that newborn. And now today, mom and baby are doing well. So, and that is why they are officers of the year for 2025 um through the exchange club. And then lastly, I actually do not have um the supporting document yet for the EMT of the year, Paul Brennan. I'm waiting for his supervisors to respond back to me as to um the background as to why he he is the the EMT of the year so that I can draft it into um resolution language. chair, but we could we can also send them up pending those documentation and and by the time that it comes in, we'll just put them all together if that's okay with you. I know as many of you know Roombo is a newspaper that has been running for the last 30 years. is a bilingual uh newspaper and it's been given to us you know always information about our community our city and without practically at the same time without asking anything to anyone and um on May 15 is going to be the 30 year and there going to be a big celebration and we as a council would like to do a resolution and present it to to her uh um Dalia and Alberto who are the co-owner of this uh newspaper that is being in the city of Lawrence for many many year. I have item one. Every 127 12726. It's a home rule petition. Uh this is for credible service for the Lawrence police uh officer submitted by councelor Stephanie.
Yes. Um as you may recall um counselors last last cycle I proposed a home rule petition to provide a option for credible service or time buyback not just for one officer but there were multiple police officers and also I added the f um some firefighters as well. However, um once the discussion happened at the committee level was it was referred to the um committee of the whole there was concern regarding cost to the city and years and that's definitely something that was understandable and I and we heard throughout those those discussions that uh myself and and my supporting partners on this on this um uh doc or agenda item, we wanted to make sure that it was feasible for the city and not and not something that that is a um a dent. Um as you also you may recall and councelor Miguel this is new for you but you may recall from last year that this a home rule petition like this was done in another municipality and do you remember which

Quincy so it was it it was proposed in Quinsey by their city council and it was passed by the house and the senate um for one individual. So now I'm bringing it down to one. I just from those groups of individuals I had one um petition and here I am in hopes to to get this um to to get this done. I do want to remind there was also a concern about the work during the M MBTA you've worked for. Right. I do want to remind this committee and also um if it gets sent up to the full council eventually. I know there's a process but the MBTA is also part of our community and they serve our community. So technically it is also um a job and a service for our community. Uh with that being said, I'm now going to pass it on to my um supportive colleague here uh for this item uh for for further u discussion and I'll be here for questions. I'm not leaving. Good evening, counselors. My name is Ael Kano, 94 Maple Street, uh resident and also uh city employee. I'm here to um request for the document 127-26 uh for home rule petition to be uh placed forward in order to have credible service buyback of two years of service. um for my time. I was looking for more time, but as time has been acrewing, I've been actually working the time uh out of the five, I'm now in in that gap of the five years. And so I'm looking just for two years at this point of service.
I like where this is going. Uh I I do like it because we have a perfect sample sitting and a as a secretary that she left for a couple of years and then she come back and now her time is all this combabulated. So I'm assuming that if we go the right direction with this this come back and benefit some people that've been here tons of years and now they don't want to put all those years together. Um, but I believe that we need we here as a body, we need legal advice and I believe we should we should we should send this to the to the city attorney and have him come back with a recommendation uh for it. Uh, if if if that's okay with you, Madam Chair, if you want to continue the discussion, that's that's okay. But I would like to place a motion to send the city attorney and wait for the legal advice. And after that, we should table this matter right here in this and in this and this committee if that's okay. I mean, I don't want to drag it. I don't want to hold it, but we do need legal advice before we move forward.
I if I may, counselor, I I agree and I I appreciate um that suggestion and um as I mentioned last year when we were going through this, this is right, this is the democratic process. So, at at the end of this, even with the city attorney's um advice, even with with the language in front of you, if the council as a whole still does not feel like this is the right direction, then we have that opportunity to vote either for it or not. And we we emphasized that last year, too. Um hopefully we we are looking for a positive outcome, but we do understand that there there are certain elements that need to be considered. and through your chair and I know we've been on this back and forth for for a long time. So hopefully we can put a rush on it for the attorney to come back and then we can resume the conversation. That's okay.
Anything else? Would it be through your sh would I excuse me counselors? Uh would I uh probably request that you uh request the uh assistance of the retirement board as last time so they can have numbers as well as uh the kafu that would be very helpful as well for helping you determine uh if this is um an option. Sure. That that way you have more than just one advice and it's coming from um you know the uh city itself that they can work together. Okay. Okay. Um, all right. 80 Oops. 8926 which is the resolution to enforce ordinance um 02.0 there's supposed to be a point between the four and the zero um 02.04.081. Uh before I do I did write up an introductory for this, but before I do that, I do want to say to this committee, I spent about four and a half hours working on this to make sure and I was here in the in the council office and our secretary can attest to this to make sure that I crossed my tees and dotted my eye my eyes to ensure that I I got this right. Um, and even before submitting to to the to the city clerk, I also got uh the city attorney's advice on it as well. Um, so tonight, as I just mentioned, I I stand now before you regarding the enforcement.
Here we are. I stand now before you regarding the enforcement of or ordinance 2.04.081, which is pertaining to the temporary to temporary appointments. Um but I'm specifically drawing your attention to section D of the ordinance concerning the appointment which um section D um and this resolution is is is a request concerning the appointment of the community director community development director position within the the city of Lawrence. Um, I first want to be very clear that the resolution that I'm about to present before you is not about any personalities, is not any personal vendetta against any individual currently serving our city. Um, this is about the integrity of our governance. We are a city of laws and those laws which is our charter and our ordinances must be followed consistently regardless of who occupies an elected office or I mean elected seat or office. I want to continue with saying that our ordinances exist to provide a predictable process and to ensure legislative oversight. When we allow those processes to be bypassed, we undermine the very system we were elected to protect. When I first drafted this resolution that's before you, that was on March 4th. Now, it is March 20, I'm sorry. And when I first drafted that, it was on March 4th. and the administration at that point was 253 days past the legal 90-day limit for an acting appointment. As of today, March 24th, we are now at 270
days overdue. Section D of ordinance of ordinance 2.04.081 is not a a suggestion. It is a legal mandate. It outlines the specific procedure that the council must take when a temporary appointment exceeds its limit without a permanent com confirmation. By moving this resolution forward, we are simply fulfilling our smo our sworn duty to uphold the Lawrence City Code and ensuring that the Department of Planning and Development operates under a stable, law, lawful, and council confirmed leadership. I'm here to respectfully ask your support um in p in passing this resolution to enforce our council duty as outlining under under this ordinance. But before I do that, I do wish to go through the resolution paragraph by paragraph to allow the committee to ask me questions um of any paragraph and any clarification uh that you may need for me or or um anything else. If I may, sorry, this is a copy of the All right. So, and again, I drafted this and submitted this on March 4th. So, some of the dates and numbers throughout this is a little outdated as of today, March 24th. Resolution enforcing ordinance 2.04.081
section D regarding the appointment of the community develop community development director. Whereas the city of Lawrence adheres to a strict hierarchy of legal authority governed first by the Massachusetts general laws, followed by the Lawrence city charter, and finally by the city of Lawrence ordinances. And please stop me. I'm trying I'm going to read this slow so that we can u I know you're following along, but if if anything comes up, uh please feel free to stop me. And whereas section 4.4 Four of the city charter grants the mayor authority to make appointments and temporary appointments. Provided a certificate of appointment is filled with the city clerk certifying the appointee is quote especially fitted unquote for the role. And whereas city ordinance 2.70.030 030 section A explicitly establishes the position of community community development director mandating that the individual be quote appointed by the mayor and confirmed by the city council unquote thereby establishing clear legislative oversight requirement for this position. And whereas the city ordinance 2.04.0 081, which further regulates appointments and mandates in section A, that no person in an acting capacity shall serve for more than 90 days without an affirmative vote of the city council to extend such period. And whereas the acting community development director began their role on
or about March 20th, 2025, which is also reflected in exhibit B in your packets with an official member by an official member from Mayor Deputy dated March 26, 2025, which is also reflected in exhibit A in your packets. meaning the legal 90-day acting window expired on June 24th, 2025. And whereas as of the date of this resolution was written, which was March 4th, 2026, the administration has been in continuous violation of ordinance 2.04.081 081 for approximately 253 days since the initial 90-day expiration. And whereas despite the mand the mandatory language of the ordinance, the administration has twice submitted to the city council and has also withdrawn the appointment reflected as city council document number 342-25 and document agenda document 23-26. and further stated and further stated via an email from the mayor's senior advisor on October 27, 2025, which is reflected in exhibit E, page four in your packets that non-urgent mayoral duties will be deferred until after the November general election, a justification that does not supersede the city charter or ordinances.
And whereas every elected official in the city of Lawrence takes a solemn oath of office to quote support the Constitution of the United States, the Constitution of the Commonwealth of Massachusetts, and the charter and ordinances of the city of Lawrence. And I mean sorry unquote and whereas ordinance 2.04.081 section D explicitly states quote on the 91st day following the temporary or provisional appointment pursuant to section 4.4 4 of the city charter with no further action, temporary or provisional appointment or or fi I'm sorry, temporary or a provisional appointment or final appointment by the mayor. The city council shall authorize the personal director to post and authorize the position, receive applications, certify applications, and submit to the council for selection and appointment the five highest certified applicants. The city council shall select and employ an individual from the pool of applicants within 30 days. I'm going to stop there before the last last section. Are we are there any questions for me or should I pass?

Now the last section is a the call out. Now therefore be it resolved by the council that one recognition of vacancy. The city council hereby recognizes the that the temporary appointment for the position of community development director has expired by the operation of the law under ordinance 2.04.081 section C two invocation of section D. The city council pursuant to its mandatory authority under ordinance 2.04.081 081 section D hereby authorizes and directs the personnel director Carol Garcia to immediately post and advertise the position of community development director adhering to the qualifications set forth in ordinance 2.70.030 030 section C three certifications of certification of applicants. The personnel director Carol Garcia is directed by the city council to receive all applications, certify the candidates and submit the five highest certified applicants to the city council for for review per ordinance 2.04.081 section D. And lastly, number four, selection mandate. Within 30 days of receiving the certified list, the city council shall exercise its ordinance authority to select and employ a qualified individual for the position of community development director to ensure the stable and lawful operation of the department of planning and development. And then that is um the original copy
had my signature and the dates of March 5th, but I um after I submitted it to the city clerk, I did find a few grammar and date errors that I needed to fix. So, this one does not have um my signature. and the rest if the council chooses to vote um at the end in a favorable way then that's um the signature space for us to mandate and invoke section D of ordinance 0 2 04.081. Um I just want to go through in your packets as well. You do have a copy of the ordinanced um position of director of community development which was referred in this language as ordinance 2.70.030 030. And in section A within that ordinance, it clearly states position established there is est there is established the position of director of community development to be appointed by the mayor and confirmed by the city council. The next supporting document you have after that is the me is the memo from the city attorney. After I typed this, I did go myself personally to the city attorney's office and I had him read um the the drafted ordinance. Um we did discuss it. He found that this is a um that the that the that the resolution was was written. Um and we also referenced the ordinances I mean reflected back in the ordinances um that are that are referenced throughout the language. to ensure that everything was correct.
Council. Yes. So we talking about item 8926. That is the resolution to enforce resolution to enforce to enforce the ordinance 0204.01. Yes. That is what we're Yes. talking about right now.
Yep. which within that ordinance is section D that authorizes a city council to then take over the hiring process of director positions within the city. If the administration, it actually authorizes us on the 91st day. So obviously we're almost at 300 days past um the expiration date without any vote to extend an acting period. Um and I think the administration had ample time. They did send they did put that on on the agenda twice, but it was withdrawn twice. And um also as as I included in the resolution language um you did I did see um and that's also the actual emails also included in your packet as well that um the senior advisor said that the mayor will not take care of any quote unquote non-urgent matters until after the November 4th election. Just because there is an election does not mean that you stop being mayor. As we all take an oath, our oath is to respect, to follow, and to enforce the constitution of the country, the constitution of the of Massachusetts, our city charter, and our ordinances. And that is word for word um an oath that we took again in January. Um after the memo from the city attorney, you have a copy of the of the city charter. there's an X there because it's none of this is relevant to the actual subject that we have in front of us. Um but what is highlighted is section four, the executive branch and um I highlighted where I got um the language as to the mayor's um authority to appoint a person or a temporary appointment.
Rosario, as as much as I love the resolution of the ordinance, I would love to see it like like a I don't like when we point into one direction only when we can do it generally. So all position because it looks like we targeting somebody we target. I also started into I also looked into that as well counselor and and and that's what is hard for me to support because I'm not targeting anybody. I'm not targeting one position. And I think I had a conversation with you guys or uh a few days ago that we should look in general and and we should have been pointing at one particular position when this is happening the whole city around and now we actioning on it and it looks this way because we actually on one position only right
and this is what drag us drag us to this resolution which we should have done before when it was a provisional chief of police when it was a provisional we should have done it from the get-go but now and I'm going to say it I might be wrong but now because we pressure for who is in that position and we know we had that conversation before. Yeah, we need to ask at least for the minimum requirements to have somebody on certain position, not just that one minimum required in general. Even if you're going to work in a yard as a as a DPW employee, you should have the minimum requirement to be a DPW employee. But to me right now, as much as I like it, it's hard for me to support because we we only talking about one position,
right? And I actually did my homework on that as well. Count I can't I'm telling you, I came prepared for this. Um, I also met with the HR director to ask if we have any other acting roles that are past their 90-day mark. As of right now, this one's the most severe case. Um, if you are aware, maybe she didn't inform me, I don't know. But right now, this is the only situation that we have. Um, if there are others, I'm more than happy to put that on the agenda because like I said, we're we're here to to enforce our ordinance. Also um in terms of the provisional police, I was the counselor as well that took action on that when that happened and I actually was the one who who took who um petition to take out any provisional appointments from our ordinances which the council passed two years ago. So um it's not a target. Um I I I can understand why it it sees it seems like that. with other acting positions that the administration did bring to did put on the agenda to extend the 90 days. This one has not been brought down.
But once again again once again it should be done in general. I mean this is my I can put an example and I'm going to mention a name and I'm sorry if you listen McCarthy was in a position acting for for the longest and no nobody brought him down. Um because the because because the ordinance that we name again you name the position directly one position and and that's what I'm seeing as a target you know let's let's redo the whole ordinance let's do the old ordinance for the whole city and that way it won't happen because again I can name I can name you a couple of position that it was never brought down. they've been acting in the city before this or before this administration
through this administration and and and they were acting for years but now we're making a change but again and I love the changes but when we mention only one position that's what I feel myself that I don't want to be attached as a targeting somebody or targeting one so I can mention two things one I wasn't a counselor before so what happened before in other administration is not my concern we were here we were here when McCarthy was long enough
McCarthy McCarthy that that is that is a mistake um that was a mistake. But what I can say is I was a co-sponsor um when the ISD director position was not brought down to the full council for its 90-day expiration. So it was myself and councelor Leant trying to enforce this this section of the of the ordinance. Um however that was eventually withdrawn because then the administration did present a candidate to be confirmed. So um so again the problem is that it has not we have not um voted to continue the extension. That is that's the underlying llining problem. The other examples that you're trying to make counselor the administration has put on the agenda for the council to vote for an additional 90 days etc. Um, so that's that's the difference here in this situation compared to the past.
And also what I want to add is that as some of us are prepared to choose and pick who's going to take that position. I believe in not all of us are qualified to choose who's going to work in there where some of us doesn't have even the minimum requirement to pick somebody at that high as a director of of of development and putting on our power. I mean, we might be capable of doing it, but I mean, I don't want to be in a position where where a a kindergarten is going to choose my position where I have all kinds of qualifications. So, it bringing us to us here when some of us and I'm talking in general. I'm sorry if I offend anybody, but some of us doesn't have the minimum qualification to choose somebody again at that high level. It should be also a matter of this staying up the personal department. We choose and bring down and then we choose the three or the four how we do it. But us picking the one that is going to be there when we know counelor that some of us doesn't have the minimum qualification to pick somebody that has all kinds of degrees and put them in a place to do this kind of job.
If if I mean if that's the argument then we should we shouldn't be authorized to to do a search for the elected school board. We shouldn't be authorized to confirm the police or fire chief. we shouldn't be authorized to to hold a selection nor an interview process for the city attorney nor the city clerk. Um so I I don't know I understand. Um but but those those were powers that we had. Those were powers that we have and it hasn't changed. But now these are powers that we want to take on our on this is this is chang. This is not a we this this is this is a ordinance that's that's been ordinance that's a law. This is not councelor Stephanie and Fe making it up.
But no but I understand but as much as I like it and I like the change. What I didn't like is just targeting one position only. If we go back to the drawing board and we put the whole city in that and change the whole ordinance, I will be in full support. Okay. Um, I will gladly do that. I, as I mentioned, I've already done my homework and from my understanding, this is the position that has not been brought before the council for it 90day extension.
But we need to be prepared for all the position that might go through the same thing. So, we don't have to change it down the road. So, why don't we do it all as a whole, as a package, the whole thing? We don't have to go through it again. Once again, you have a perfect example right behind you. It happens. It changed. Now it happened again. So it gonna prevent this one maybe to move forward. But why don't we do it for the whole thing? That way they don't come back with another temporary position and we're going to be here again having the same discussion. That's I mean that's my that's my opinion. I think also I mean also prior um the other council before and now I mean I mean going back to to qualifications which I've also been consistent everything that I'm doing tonight may seem targeted but I've been consistent since day one
but I do and again I've been consistent where I stand since day one. I'm in I mean again I'm in support of it if it's the whole city but when again we and we have this conversation before when you mention directly a position you know we're going to make this change for that not to happen again blah blah blah blah this and that that's the argument but when when I feel this is how I feel that doesn't reflect how the councelor feels and that's that's why I put myself I mean I love the fact that we going to make a change but we should do it at the whole city not just because that position because that position we should do it I mean so it won't happen again in any other position The ordin here's the thing though. So the ordinance that is for the whole the whole city. Okay?
That ordinance section is for the whole city. It just so happens that at this point the only issue with the position that we currently have is with that position. That's not targeting anyone. That's not targeting a position. That is the current situation that we have. Um and now that is being brought to light. I'm sure um if the council does authorize its legal power that we that we have written in our in our laws, I'm sure moving forward, this administration and future administrations will not commit the same mistake of going almost 300 days um without without their the lawful um vote of a 90 of an additional 90-day extension. So at at one point also when do we as a council say enough is enough? Cuz right now we're being taken as a joke. It's almost 300 days. It's almost 300 days. And in the email provided to you as evidence as as supporting documents as well. there's this back and forth um blaming um another individual and and other individuals and also um reference to the election that things like this are important because there's an election. That's a joke. That is a joke. And like I mentioned, we took an oath in office and part of that language specifically states our laws, our city charter and an ordinance. And this is an ordinance. Now, I'll be the first one to continue this and I understand we made the mistake prior of not enforcing this, but now we're here today and it's about changing the future and I that's my response to you council.

So the final um I mean the final path to go is this uh resolution to request action from the personnel uh department if that's uh is that right or do we have any other avenue to address this uh um violation of the ordinance? So, I mean, there there is a violation of the 90-day period. We're well over that. Um, another resolution, if the administration does send the name down, then we can vote to extend the 90 days or whatever days it is that that we need to extend. Um I also want to make clear that um this word of targeting I'll be be more than happy to change the language of the resolution to make it more generic. But like I mentioned this is the only case as of now that I know. So either way it's still quote unquote targeting and I'm only using that because it was used by by the committee because that's not my intention whatsoever.
Um now it has been a month since I worked on this so that could change. I'll be more than happy to go back to the personnel director to see if we have any any further acting positions that are either near the expiration or already over the expiration of the 90 days. I'll be happy to add that or not even add that because they're looking for more generic um generic language. But at the end of the day, when we're talking about this, the positions will be named because those are the positions in violation. It's not the individual in the position. It's the position and the action of the lack of action from the administration. That's what I want to make clear. Yes.
Um so there is no targeting is that we're not currently following. It's been almost 300 days that we haven't followed and I'm here trying to make a change for the future so that this doesn't continue occurring because it it has been a trend way before us and currently as us as as counselors. So overall I'm trying to do better. I'm trying to follow our rules and um setting a platform for whomever was is to come next after us.

Um it was uh submitted by attorney uh Dana Cohen. I believe he's here today to speak on this. My role was to bring this matter to the Lawrence planning board. Any change to the lawn zoning ordinance requires planning board review and um and a determination made. There is also a request from this council that this the planning department do an assessment of that neighborhood prior to that. Um I do have the three documents here for me.

Um and again there is a what's we call a corer study where we did an analysis of the properties on the four blocks surrounding this property and the decision um the planning board uh the planning department came up with was that the proposed change um while we don't make any advisement to this um we don't we are not in favor or against this in any manner. We don't have a decision on this again, but the proposed change would not be in violation of the law because of the nature of the neighborhood that is already made up of a lot of commercial properties, a lot of non-residential properties. As you can see, there's actually more non-conforming properties than there are conforming properties on that. In that case, a single change would not be spot zoning in our opinion. But other than that, uh I I will let the uh other speakers uh make their arguments for this project.

My name is attorney Dana Cohen. My office is at 873 Turnpike Street in North Andover, Mass. I represent the owner of a particular property that's on Parker Street, number 128. His name is George Desmet. And you may recall the business that he ran for over 40 years called Packard Pharmacy. There's also an adjacent building 130 um Parker that is um at this time run as all office buildings. M uh Mr. Desmond ran the pharmacy, but he he chose to uh retire and now he's looking to sell his property. What we didn't know was that it was in an R2 zone. So, it's never occupied as a residential property and he's looking to sell it. We tried to go the special permit route, but it's not a uh we couldn't get a special permit. So, we were advised to um go to planning board, get their recommendation, and they unanimously voted to uh in an advisory capacity to recommend a zoning change for this parcel. As Mr. McCarthy mentioned, up and down um Packard Street, uh sorry, Parker Street, there are all uh businesses throughout this area. There are banks, gas station, car wash, retail markets, school, library. These are all uh uses uh permitted uses if it's in a B1 or B2. So, we are looking to get it reszoned since it was a pharmacy. No one ever got a special permit or change the zoning out of residential. And so, um, unanimously from the planning board, you have this
document of their decision signed by Betty Camlo Korea, who actually works for Century 21, our neighbor at 130. Parker, Brenda Rosie was there, Gabriella Tav Tavveras, and Anolina Tiveras.
So, um, Mr. McCarthy presented you with documents that showed up and down the street that we've all traveled many times. Uh it makes sense to allow this particular property to be uh zoned consistent with the rest of the street. But
but my question is this is only one property. It's only one piece of property that it's on a business complex if we can call it that way. So we want to change that particular piece on that. That that's the request here and it's not considered spot zoning according to Mr. McCarthy. There are other business owners that may want to change their zoning as well, but I'm only here for this particular parcel. And if and if you look at the other properties that are in the area um that if you look at AAA auto repair, Tony's Convenience, the ADT Security up and down the street, they've also come before the various committees and boards and requested a zoning change from residential or whatever their change was to business use. So that area is just only R2 right now.
We're we're just R2. No, nobody realized that all these years the pharmacy was running in an R2 in R2 zone in that in that zone. So it just it it was either something that was overlooked and it should have been changed a number of years ago, but for almost 45 years he was running his pharmacy and had a very nice business there. So we're just trying to continue the business use in that property. Yeah. There was no interest to sell back in those days
through your ch business was blooming. There was no interest to sell. Now there's no business going on now. We need to change it to sell it. That's how I see it. I I didn't hear what you said. I'm sorry. Business was blooming back in those days. So it it was it was a pharmacy, right? It it was a pharmacy. Yeah. So it was no intent to sell cuz business was blooming. Now there's no business there. Now we got to send change it owning to sell it. I I think that's how I see it.
Yeah. Well, I think that um the city is is thriving. Businesses are thriving. This building has remained vacant since um the pharmacist retired. So the city would generate more renu revenue if another business were allowed to be there. But being in R2 zone, it doesn't allow them to run a convenience store or another use of the property. So what what kind of business are you thinking to have it in there?
So there are a number of uses that are permitted in that area. So it could be used as a bank, convenience store, retail store, a laundromat, all the permitted uses in that uh B1 zone. Those are permitted uses. So they don't need special permits. So Mr. McCarti So the you went to the sewing board and
you went to the zoning board. Went to the planning board. The planning board. Correct.
What about the zoning? Um there's the planning board is the board that's responsible for the city's ordinances and they are the advisory board to this council for all matters related to changes in ordinance uh related to land use not the zoning board. The zoning board of appeals is the board you go to to appeal a decision from the building commissioner or get a variance. So, and they agree that's to change to from residential to commercial or it's going to be both at the same.
So, the the the property is currently zoned residential 2 that allows single family homes and two family homes only. doesn't allow multifamilies. It doesn't allow many businesses. Um the B1 district is the local business district. That's the least commercial business district we have. It's the business district that's designed for areas where there is a mix of residential and business. Um again, there's been a lot there's a lot of commercial businesses on the street. Most of them predate the zoning ordinance. The zoning ordinance was created about 1950. This store itself um goes back to the 1980s. I mean I mean more than that back to back to the 1920s. So the the the store was already a commercial building when the city established the zone as residential too. When you predate it, you're you're you called grandfathered. That protects you.
So that use is grandfathered. So if the property was sold, another pharmacy or maybe a convenience store could go in there without this happening. But other commercial uses are barred. So the only way to to do that is to change the zoning ordinance. And did you build um any business over there? It's going to be also they're going to build any residential on the top of the
um I don't know that. I'm not a big advocate of building on top of existing buildings, but they could do that if they wished. Um, anybody could. Um, the the B1 uh commercial district is less allows less uh development than a B2 or B3, but it's possible. So, it is possible. Yes. Okay. I mean, at the end of the day, it's it's a business building. So, it's a business. So, I mean, for them to sell it.

In my understanding in the Commonwealth of Massachusetts, this is spot zoning since we are making the change, asking to make the change specifically for this transaction. Now, I believe from what I've been told by my client and others that this is going to be attempting to be a laundromat,
which would be a big difference from a pharmacy. Um, which I believe would impact all the neighbors. could be positive, but also could be negative, especially for my client since the water line is the same water line. The water meter is the same water meter. So, these are all things that need to be addressed ahead of time. So, I'm here to specifically just put on the record that there is opposition to this. I I understand that it could go to the city council. It'll be public hearing then, which I know I will be I will be there as well, as well as other uh other businesses, maybe residents on the city of Lawrence. So, I just wanted to put that on my put that out there as well. So, thank you.

Um and we should actually uh as you can see as well that we'll be removing overhead electric lines that are actually crossing the spot river as well. So we'll be rem we'll be doing some cleanup with our lines in that area to make things uh just more favorable in general. And um yeah.
So you have to relocate it. Why you have to relocate to install a new pole? Yeah. So, there shouldn't be any new poles going down. Uh, it should just be relocating two poles.
